Regular property visits keep problems to a minimum

NOTICE: The Landlord Association of the Inland NW has moved from its previous location in the Hutton Building to the new address at 225 E. 3rd Avenue, Suite 2, Spokane, WA 99202. During the street repair on 3rd avenue, our new office is best accessed from 2nd Avenue and Spokane Street. There is sometimes a concern that visiting a rental property or entering a rental unit too often could be considered abusive by a tenant and cause complaints or high turnover. On the other hand, they are also very aware that not checking on the condition of the rental property will yield some nasty surprises when the tenant moves. So a frequently asked question is this: How often can a landlord or property manager enter a unit to check for housekeeping problems? This is a tricky question to answer, because most landlord association offices get complaint calls from tenants claiming harassment by their landlord or property managers. The average rental unit check is twice a year, which is maybe not often enough for some landlords. That is an internal inspection. It’s always advised to drive by your rental properties once a month or so to check for signs of trouble. In Washington State, you must give a 48-Hour Notice to Inspect (and this means two complete 24 hour days). A landlord or property manager cannot count the day of service and, if you mail the notice, allow an extra day for mailing. If the property is being sold or if the unit is being shown to prospective applicants because the current tenant is moving, then only 24-hour notice is required. You may require in the lease (by either adding an addendum or entering on the lines on the lease left empty for additions) that a tenant shall allow a housing inspection at
regular intervals. There may also be wording in the body of the lease or in an addendum that tenants must maintain the unit in a clean manner, but you will need to be specific ‌ one person’s “cleanâ€? is another person’s disaster. If you want to, you may set it up in the lease to inspect once a month, but most tenants find this oppressive. Inspecting once a quarter is more acceptable. However, landlord attorneys, court decisions, and common sense caution about being in a tenant’s face too often and to also keep the requirements reasonable. If a landlord is the type of person that expects hospital sanitary standards or Home Beautiful housekeeping, then landlording may not be the profession for them. Tenants view the space they have rented as a place where they have privacy and can be comfortable and casual. So the unit will probably not be as tidy as your own home and yet still be considered clean. Judges may determine that your attempts to have a tenant maintain your private housekeeping standards as unreasonable. On the other hand, you may ask that wet items not remain on floors since that causes mold problems, that dishwashers and garbage disposals be kept clean and free of food since this can cause operational problems and attract ants and other pests. That the yard is watered on a regular basis to keep the grass alive, and that the carpet is regularly vacuumed, etc. Being specific helps since there are vastly differing standards of housekeeping. “Keys to Rentingâ€? content is for informational purposes only and not meant as a substitute for legal advice.
