is expected to be judge, mediator, houseparent, counselor or bouncer. A landlord should not place herself or himself in ANY of those roles. It seldom, if ever, works out well and usually only increases the prospect of actual legal difficulties. The best policy is to have the House Rules Addendum signed along with the Lease, Smoke Detector Form, Mold and Mildew Form and Property Condition Report (all are required to be a landlord and to be fully protected under the Landlord –Tenant Law Act). This means the House Rules go into effect when the tenant(s) move in. Otherwise, House Rules go in effect at a specific future date for all tenants in all the rental units. This is to avoid the appearance of discrimination, harassment, or retribution of one set of tenants or another. The general lag time is the same as with other notices which announce changes in terms of tenancy, that is generally a minimum of 30 days and usually begin on the 1st of a month. Set as generous lag time as possible and announce the House Rules change in a letter to each tenant in their own name. Keep a dated copy in your files, too. If you are preparing House Rules on your own, there are some categories that are important to consider: Alterations to the property; use and care of appliances; damages; deposits; what happens if one person leaves the tenancy early; fire extinguishers or fire prevention information; garbage collection, costs, recycling and suitable trash containers; overnight guest policies; yard care; parking; locks and lost key policies; use of patios and decks for parties and cooking; pest control and cleanliness problems; pets; quiet or study hours; responsible parties, including alcoholic beverages if one of the tenants is under drinking age; reporting repairs; storage space; sharing utility bills; and smoking. At the beginning of the roommate, student or multi-family housing experience, everyone is optimistic, but personal preferences, quirks, personality conflicts and eccentricities lead to emotional and even legal complications. House Rules, having it all in writing, can prevent situations from getting out of control and help resolve them when they do. “Keys to Renting” content is for informational purposes only and not meant as a substitute for legal advice. here are any number of reasons families might want to make better use of the space they have in their current or new home. As a family grows, their lifestyle changes, and space for storing toys or doing homework is at a premium. Multigenerational living, where elderly parents, grown children or other relatives all live under the same roof has become common. Or it may just be cosmetic, and the best way to keep clutter at a minimum. Home builders and remodelers are responding to the demand by maximizing the utility of living spaces without sacrificing visual appeal. With creative storage and built-in features, dining rooms can become home offices or game room in minutes, living rooms can be used for family meals, and foyers can store much more than coats and umbrellas. In new home construction, smallerscale, walkable communities have become popular. To accommodate the size constraints of a skinny lot, homes are being designed with features like stacked garages where two cars can be housed trunk to hood instead of side by side. Using flexible walls, attractive flooring material and a roofless interior garage space, the area can easily be converted to a patio for entertaining. Improved energy efficiency of windows and doors means homes now feature more indooroutdoor connectivity. Moveable walls and outdoor spaces tucked within the home’s floor plan provide for better flexible use of the space, as well as improved privacy in densely populated areas. The often-unused space under a stairwell can be engineered to accommodate filing cabinets or drawers, or even to create a sanctuary for the family pet complete with a bed and gates to close it off. Drawers built into stair risers are a great place to store small items such as gloves and hats or art supplies. The trend extends to home furnishings as well. Murphy beds, where a piece of furniture conceals a bed that can be set up for sleeping in few minutes, have been around for many years. Modern murphy beds are hidden not only in armoires or bookcases, but new designs feature beds that lower from the ceiling electronically at the touch of a button, or fold out from inside a desk or counter. Other creative, multipurpose furniture designs include dining tables that convert to a billiard table, bookcases that contain fold-down chairs for when you’re entertaining more than the usual number of friends and family, and cocktail tables with trays that pull out for eating in front of the television. House rules can solve problems before they happen nce the lease is signed, most landlords, property managers and tenants file away their copy and forget all about it again until the tenant is ready to move out and trying to figure out how to get their deposits back. The landlord retrieves their copy to see what it says about notice, damages and other exit requirements. In other words, the Rental Agreement or Lease tends to not be words to live by on a day-to-day basis, even though they contain many, many explanations, requirements, rules and restrictions. House Rules, on the other hand, are the words to live by on a day-to-day basis and are just as binding as the lease. In fact, House Rules are an addendum to the lease and is a fully legal document. Although a landlord or property manager is not required to have a House Rules addendum, there are some circumstances that seldom run smoothly without them, for instance – multi-family housing situations like a fourplex or apartment building, in student housing, or roommate situations. This is because these situations are either higher density than a single family rental house, or because unrelated people share the same rental unit and usually have only a shortterm social or financial interaction based on circumstances that can easily change. Having a written document to help work out problems, responsibilities, and disputes is especially useful for roommates, students, and first-time renters unfamiliar with how renting is different from living in their parent’s home. Although there is no particular form or wording for House Rules, the Landlord Association has a 14x8? professional House Rules Addendum and a Roommate Addendum that a landlord can either use outright or modify to meet the criteria of their own properties. And yes, creating House Rules is yet one more time-consuming task, but it’s fairly easy and can save hours, even days of working out misunderstandings, both between landlord and tenants, and among the tenants themselves. Anyone who has been part of a roommate situation knows that policies about overnight guests, study or quiet times, cleaning responsibilities, deposits, laundry and cleaning disputes, unexpected move-outs by one tenant or roommate, parking, damage, parties, who gets the biggest room or the storage space, etc …. all lead to severe headaches for the landlord. And usually the landlord or property manager

Question: My husband and I have made a reasonable bid on a short sale. Why wouldn’t the bank jump on our offer rather than go into foreclosure? Is there a requirement for the owner to sell the house within a given timeframe?

Answer: It’s really all about what’s “reasonable” and to whom. A good way to check is to follow the money. With a short sale, we have an owner who wants to sell a property for less than the mortgage balance. This would be perfectly fine if the owner paid for the loss, but instead, the lender is asked to take a loss. That’s inherently unreasonable to lenders. A lender has no obligation to accept any short sale offer. However, under rules introduced in June 2012, the Federal Housing Finance Agency says lenders must meet several requirements: 1. Lenders must review and respond to requests for short sales within 30 calendar days from receipt of a short sale offer and a complete borrower response package. 2. Lenders must provide weekly status updates to the borrower if the short sale offer is still under review after 30 calendar days. 3. Lenders must make and communicate final decisions to the borrower within 60 calendar days of receipt of the offer and complete borrower response package. The lender will scrutinize a short sale offer for three big reasons: First, it will check local home sales to assure that your offering price is as high as possible – and perhaps look for better offers. Second, it will see what other assets and income the owner has that can be used to offset the loss. Third, the lender will scrutinize the deal to assure that the transaction is an arms-length sale and not an arrangement where ownership will magically (in other words, fraudulently) revert back to the borrower. So while you may regard your offer as “reasonable,” the lender sees it as a loss – and something to investigate with care.
