Keys to Renting The best way to handle noise complaints By Joy Peck, Executive Director Landlord Association of the Inland NW
oise complaints are seldom easy to handle. Other tenants in your duplex or building or neighbors who live close by may have different tolerances for varying types of noise. Some people can accept music, barking dogs, children at play, and other common noises better than others. This is one of those problems that defy a one-size-fits-all or a blackand-white answer. But doing nothing won’t help, and noise can drive away good tenants or lead to calls to the local police. So once you are facing a noise complaint, you have to deal with it promptly, preferably catching the offending tenant when the noise is happening. What most experienced property managers and landlords report is that a “One Warning� approach seems to work best. Develop a notice or come into the LLA office and we can help you create a notice that states the complaint, that it violates the lease or rental agreement (and perhaps even city noise ordinances), and that a second occurrence may result in termination of tenancy. If you are called out a second time for the same infraction, look to your rental agreement or lease for remedies. If the tenant signed a month-to-month rental agreement or has rolled over from a lease to a month-to-month basis, the easiest way to handle that second report is to serve the tenant a 20-Day Termination of Residency Notice. To some small landlords, that seems too harsh, since it would result in a vacancy to fill, an ad to write and pay for, and interviewing for a new tenant – all things that take time, effort and cost that they do not want to undergo. These landlords, then, just let the matter go and hope that the tenant somehow magically changes their behavior or that the complainants give up complaining. Neither of these hopes generally turn into reality, so kicking the can down the road is not a solution, it’s just a continuing headache for the landlord. When there is a noise complaint, the landlord must decide: Do I want to keep this problem or solve this problem. Hence the 20-Day Termination of Residency Notice being served and sticking to it. If the tenant is on a lease, the choices are very, very limited, since it is extremely difficult to end the tenancy of a resident who is paying the rent on time and not breaking any

criminal laws. Sometimes the loudest tenants know a landlord will end their tenancy if they rent month-to-month, so they ask for a year’s lease or even insist on a lease as a protection from frequent moves. But if a landlord has given such a tenant a lease and gets a noise complaint, the next step is to serve each person on the lease a 30Day Notice to Cure Lease Obligations. This notice has a space to list the landlord-tenant violation (violating the quiet enjoyment) and the section of the lease that states the noise policy for the rental unit. Here are some tips. • If it isn’t already in your rental agreements or leases, add language that clearly say that tenants must take responsibility for reining in their guests who may not be aware of the rules. Tenants are responsible for telling their guests the rules. • If it is a multi-family unit, post the rules in the office, in laundry rooms or other common spaces. • Apply all rules uniformly. Don’t single out any one person or any one group. For instance, don’t refer to children, teenagers, cyclists, etc. Simply set a noise level and let your tenants know what it is. The decibel level of whatever town or county your rental is in can be found at their websites or by calling the city council office or code enforcement office. • Document all complaints and the actions taken; conversations or phone calls with the noisemaker(s), notices served, posting additional rules flyers, giving a “First Notice,â€? etc. • Make certain your lease has teeth outlining the right to evict a tenant who generates noise complaints from other tenants or neighbors. • Be specific!! On your rules poster put such items as no yelling or blasting music. No running up and down stairs for exercise or play. No under-age drinking or kegs on the patio, etc. • Encourage tenants to communicate with each other. Once tenants are familiar with the people who live around them, they tend to feel better about the inevitable, occasional noises and don’t react as strongly. “Keys to Rentingâ€? content is for informational purposes only and not meant as a substitute for legal advice. The study also discovered that taxes vary substantially across the nation. In most communities, they cost about $1,000 per homeowner and are below 1 percent of the home’s value. Sixty percent of counties nationwide had an average tax burden between $500 and $1,500 per homeowner. However, the burden is substantially higher in certain counties in California, Illinois and the Northeast, where homeowners pay closer to $3,000 each. New York and New Jersey have the most counties with the highest property tax burdens.
