As we begin a new SPE year, I find it fi ng to reflect on the many quali es that make Midland and the broader Permian Basin a great place to live and work.

The Society of Petroleum Engineers recently introduced a new tagline: “Solu ons. People. Energy.” Of these three pillars, “People” stands out most to me. Over the past decade in Midland, it has been the people who have shaped my family’s experience and established our deep roots in this community.

We have all encountered the ques on, either from others or in moments of personal reflec on: “What makes Midland special, and why would someone choose to live here?” My answer is consistent and clear — it is the people (just take a look at the pictures from our recent summer social with AADE!).

When the outlook for our industry grows uncertain, when we are in need of collabora on, encouragement, or support, it is to one another to our colleagues and our community that we turn. The people of Midland and the Permian exemplify resilience, determina on, and a forward-thinking spirit that places us at the forefront of innova on in the energy sector.

Moreover, it is the people who drive the innova ve solu ons that con nue to shape the future of our field. In this same spirit, our Board of Directors (BOD) is working diligently to align these values through a series of study groups and General Mee ngs designed to facilitate the exchange of technical knowledge among our members.

Very Recent News as Related to Permian Basin Businesses

On July 4, 2025, President Trump signed into law the One Big Beau ful Bill Act (OBBBA) of 2025 (also known as the 2025 Budget Reconcilia on Act and H.R. 1). Among a very long list of provisions, this act modifies sev‐eral energy tax incen ves, including moving earlier several expira on dates and imposing increasing re‐stric ons under a “foreign en ty of concern” (FEOC) provision.

You probably are aware that EOR ac vity in Texas has been quite dormant since the emergence of the ex‐ci ng age of horizontal wells. Prior to 2010 and the horizontal well boom, it had climbed to provide as much as 28% of the Permian Basin’s oil produc on. This new legisla on includes an important policy reform long advocated by our local CO2 Conference Commi ee members. It now provides parity between 45Q tax credit values for pure CCS (aka CO2 capture and saline storage/waste disposal) and CO2 EOR plus storage. Our Con‐ference group is of the opinion that it should help soon restore interest in EOR, especially when the shale boom starts to wind down to some degree.

These three provisions in the bill below provide a high-level look at how the new legisla on can impact busi‐ness in oil producing regions and West Texas in par cular.

IRS Tax Code Sec on 45Q – Tax credit for storing carbon oxides

CO2 EOR parity: raised tax credit for CO2 EOR to same as geological storage ($85/metric ton* for quali‐fied projects)

New projects need to begin construc on by 2033 (no change)

Tax credit transferability (to non-par cipa ng par es) maintained subject to the FEOC restric on

Sec on 45V – Hydrogen produc on tax credit

No changes except needing to begin construc on earlier (by January 1, 2028)

Sec on 45Z – Clean fuel produc on tax credit (think transporta on fuels)

Tax credit extended through 2029

Eliminates enhanced values for sustainable avia on fuel produced a er December 31, 2025

FEOC restric ons in place.

* one metric ton of dense phase CO2 equals 19.25 mscf making the $85/ton a huge tax credit for the equipment needed to capture and store the CO2
