Organizations team up to deliver food to District 34 student residences During the pandemic the Antioch Traveling Closet (ATC) has switched its focus from collecting clothing to collecting food to deliver to Antioch District 34 student residences on a weekly basis. Members of the Antioch Fire Department donated enough money to purchase frozen chickens for the ATC weekly food bags. Antioch subdivisions have been doing weekly collections to help the ATC with their cause and District 34 staff members have been assisting with the delivering of the food bags.

One day she was here and the next she was gone.

We’d been taking care of our granddaughter during the weekdays since September. And although getting up early in the morning to care for her was a bit of a yawn, our dear granddaughter was anything but.

We thought we’d have her with us until the end of May. We sort of thought we’d have a few more months. But things happen, don’t they?

And now, we not only don’t have her here every day, we can’t see her or hug her or be the recipients of her rare but sticky kisses. Thank goodness for FaceTime.

The virus, the pandemic, has changed lives for everyone. This little glitch is our price to pay. In the big scheme of things it is inconsequential. Still, inconsequential is our new every day and I can’t help but miss her. We all can’t help but miss her – me, her papa and uncles.

Now she is home with her mom and dad and that’s a great thing. Still we miss her little big personality.

We miss the way she used to strut around the house circling around the kitchen island giggling. We miss playing hide and seek even though she never changed her hiding place. We miss her Pebbles Flintstone ponytail. We miss her “Owie-boo-boos.”

I miss sitting with her as she napped every afternoon.

But she is safe and we are safe and in these unprecedented times, you have to be grateful for the little things. I am most definitely grateful for one grand little thing in particular. Can’t wait to FaceTime again.

Gov. JB Pritzker said early last week that three of the state’s four regions are on pace to enter the next phase of reopening the state’s economy by the end of May, but he pushed back against suggestions that the state should begin to reopen earlier.

“If we were to lift all of our mitigations entirely at the end of the month, modeling shows that there would be a new surge of COVID-19 and a higher R-naught in each of the four regions, even in the least hard-hit regions of our state,” Pritzker said during a daily COVID-19 briefing in Chicago.

The R-naught is a scientific expression that refers to the rate of spread from one infected person to another who was not previously infected. An R-naught of 2 means one infected individual will, on average, spread the disease to two other people. An R-naught of 1 means the disease is continuing to spread, but that it is relatively controlled.

Public health officials said Illinois has an R-naught value of 1, and that the goal is to get it below 1 over a sustained period of time.

The briefing was unusual in that Pritzker and Illinois Department of Public Health Director Dr. Ngozi Ezike appeared separately in a video conference from their homes, a new self-isolation measure being taken after a member of Pritzker’s senior staff tested positive for the disease last week.

On May 5, Pritzker outlined a five-phase plan for reopening the state on a region-by-region basis if those regions achieve certain benchmarks.

All regions of the state are in the second phase, which allows retail stores to open for online and telephone orders for pickup and delivery, but it continues to prohibit public gatherings and require people to wear face coverings when they are in public and cannot maintain a six-foot distance from others.

IDPH guidelines, and hospitals can resume performing elective surgeries.

In the next phase, known as the “Recovery,” face coverings and social distancing will still be required but manufacturing, offices, retail, barbershops and salons may reopen to the public, provided they comply with capacity limits and other safety precautions mandated by IDPH. People will also be allowed to gather in public in groups of 10 or fewer.

One of those benchmarks is to lower the percentage of tests that come back positive to below 20 percent and to keep it there for 14 days.

Pritzker three of the state’s four regions are currently below that mark. And while the northeast region, which includes Chicago and the surrounding suburbs, was at 22.3 percent as of May 8, he said there still is time for that region to meet the benchmark by May 29.

The governor said the rate of tests that return as positive was 9.1 percent in the north-central region; 6.0 per-

cent in the central region; and 10.5 percent in the southern region.

A second benchmark is that a region should have no overall increase in hospitalizations for COVID-like illnesses over a 28-day period.

So far in May, he said, all regions have reported substantial decreases in hospitalization rates: an 18.6 percent decrease in the northeast region; a 35.8 percent decrease in the north-central region; a 44.4 percent decrease in the central region; and a 54.3 percent decrease in the southern region.

The third requirement is that a region have a “surge capacity” of at least 14 percent of its surgical beds, intensive care unit beds and ventilators. Pritzker said all four regions of the state were meeting that benchmark as of midnight Friday, May 8.

Despite those numbers, Pritzker said Illinois still has not hit its “peak” in the spread of COVID-19, which was originally estimated to happen in mid-May. He said that because the state has

Ranger police are strongly urging preserve visitors to lock car doors, close windows, and keep personal property out of plain view, take it with you, or leave it at home.

It takes less than a minute to break a car window, unlock the door and remove items left inside. Often there are no witnesses to these offenses because of the ease and speed.

These larcenies can be prevented with a little foresight and planning. If visitors see suspicious persons, vehicles, or activities, they should call 847-

The simple act of placing valuables in the trunk of your car and out of plain view before you arrive at your destination can significantly reduce the likelihood of being a victim of auto burglary. A laptop, cell phone, GPS, wallet, purse, or even a cup holder full of change can tempt a would-be thief. You may believe that leaving these items on the floorboard or under the seat and covering over them will keep them safe, but instead it just broadcasts that you may be concealing something of value in your car.

Conceal and Secure • Secure your valuables. Be aware of your surroundings.

Don’t broadcast your movements when hiding valuables.

As you arrive at your destination, whether it’s a forest preserve, grocery store, or shopping mall, be aware that someone may be watching as you put valuables under your seat.

Instead, secure them in your

trunk or glove box before you arrive at your destination, hide them completely out of sight, or take them with you when you leave your car.

• Vehicle registration. Black out the address on your registration and photocopy it. Keep the copy, not the original, in your car. You must be able to present it to a police officer upon request.

• Personal information attached to keys. If stolen, having personal information or a vehicle license number attached to your keys only compounds the problem. A criminal now has access to your home, automobile or office.

• Personal mail. Don’t leave it in your car.

• Garage door opener. Keep it out of sight.

Lock It Up • Always lock your vehicle and take your keys with you, even for quick errands.

• Never leave your vehicle running.

• Lock your vehicle’s trunk,

hatchback or tailgate.

• Close all windows and doors, including vent or wing windows and sunroofs.

• Buy—and use—a vehicle alarm. You may think no one notices alarms anymore, but they are effective deterrents to thieves looking for an easy target.

Park Safely • If you have a garage, park and lock your car in it, and lock your garage doors. Always lock your car when it’s parked in the driveway.

• Park in a well-lit area.

• Park in an area visible to pedestrian and vehicular traffic.

• Before entering your vehicle, scan the surrounding area, and always check the interior and the floor and rear seat areas.

State receives first shipment of COVID-19 treatment Remdesivir Meanwhile, Illinois’ top health official on Monday said the state has received its first shipment of Remdesivir, an antiviral drug that

has proven early success as a treatment for COVID-19 patients.

Dr. Ngozi Ezike, director of the IDPH, said the federal government shipped 140 cases of Remdesivir vials to Illinois on Saturday. She said each case of the drug, which is injected intravenously, provides treatment to about five patients.

“The National Institute of Allergy and Infectious Diseases recently conducted a clinical trial and found that patients who received Remdesivir had a statistically significant shorter time to recovery, compared to those receiving a post placebo,” Ezike said during state leaders’ daily briefing on COVID-19.

Ezike said IDPH sent cases of Remdesivir to 14 hospitals around the state by considering hospitalization and intensive care data, as well as hospitals that are treating the most critically ill patients and patients of color.

“We do expect to receive more Remdesivir in the future,” she said.

The Lake County Sheriff’s Dept. reported the following arrests in Lake County. Suspects are considered innocent until proven guilty in a court of law.

been successful in slowing the spread of the disease, it has also pushed back the time when the peak will occur, which is now expected to happen in mid-June.

“A pushing out of our peak is a natural consequence of flattening the curve,” Pritzker said. “Remember that no one can truly stop this virus without a vaccine. But what we’ve been aiming to do since early March is slow down the exponential rate of transmission. When we do that, it leads to a slower rate of infections over a longer period of time, giving our health care system the ability to treat those who have complications and giving our pharmaceutical researchers time to develop effective treatments and potentially a vaccine.”

Warrants team apprehends man wanted in child abuduction On May 12, 2020, the Lake County Sheriff’s Warrants Team apprehended a Chicago man who had just committed a child abduction in Marengo.

At approximately 6:30 a.m., Marengo Police Department issued a regional police broadcast informing area police agencies that Dvino E. Thomas, 34, of the 5500 block of South Hamilton Avenue, Chicago, just abducted a child in Marengo. Thomas is currently on mandatory supervised release from the Illinois Department of Corrections.

Members of the Sheriff’s Warrants Team were familiar with Thomas, as they had previously arrested him. Sheriff’s Warrants Deputies contacted Marengo Police Officers and learned Thomas had been visiting with a two-year-old child, who he is possibly the father of, but does not have parental right

to. Thomas was supposed to bring the toddler back to the child’s mother, but when he arrived in the 1000 block of Briden Drive, Thomas Marengo, the two began to argue. Instead of returning the toddler to her mother, Thomas took the toddler and fled the scene in his vehicle. The mother of the child called 911 to report the incident.

Sheriff’s Warrants Deputies were familiar with previous areas Thomas frequented in Lake County and began searching for him. At approximately 11:00 a.m., they located Thomas’ vehicle in the area of Grass Lake Road and Sunset Drive in Unincorporated Antioch. Thomas

likely recognized the Warrants Deputies’ vehicles because he quickly left Grass Lake Road and turned onto a residential street while increasing his speeds. Warrants Deputies were able to successfully surround and stop Thomas’ vehicle in the area of Monaville Road and Avon Drive, Unincorporated Lake Villa. He was taken into custody and the toddler was located safe inside the vehicle.

The toddler was turned over to a relative. Thomas was transported to the McHenry County Jail where he was subsequently charged by Marengo Police and the McHenry County State’s Attorney’s Office with Child Abduction.

Thomas remains held in the McHenry County Jail pending an initial court hearing.

All defendants are presumed innocent unless proven guilty in a court of law.

“While traffic on the roadways has been lighter amid the COVID-19 pandemic, we continue to see serious crashes, excessive speeds, and individuals making the unwise choice to drive under the influence,” said Sheriff John Idleburg. “We will

have extra deputies out during this time to ensure those utilizing our roadways can do so safely.”

The traffic safety campaign is administered by the Illinois Department of Transportation with federal highway safety funds.

Lake County government collects over twelve tons of nonperishables during food drives On April 23, Lake County Government partners hosted a drive-thru, no contact food drive at the Lake County Government Building in Waukegan to benefit Northern Illinois Food Bank. With the generosity of the local elected officials, the Lake County Government staff, and the public, 11,910 pounds of non-perishable items were collected, delivered, and then distributed to those in need by Northern Illinois Food Bank’s partner pantries.

Due to the success of that event and recognizing the need is still so great, a second event was held May 23 at Robert W. Depke Juvenile Justice Complex in Vernon Hills. The beneficiaries of this event were Giving Point in Winthrop Harbor, Midwest Veterans Closet in North Chicago, COOL Pantries in Waukegan, Phoenix Rising in Knollwood, and Vernon Township in Buffalo Grove. 12,100 pounds of non-perishables, cleaning products, diapers, and hygiene products were

collected and distributed to these local Lake County food pantries this afternoon.

“Our 2 food drives held 3 weeks apart successfully collected over twelve tons of non-perishables thanks to our elected officials, employees, and the generous members of the public. No one should go hungry during the COVID-19 pandemic.

The 19th Judicial Circuit, Lake County Government officials, the Lake County State’s Attorney Office, the Lake County Sheriff’s Department, the Lake County Coroner’s Office, and the Lake County Circuit Clerk’s Office asked for help to support our friends and neighbors in a time of need and food insecurity, and the community responded. Residents of Lake County should be proud to call it home,” said Chief Judge Diane Winter.

Additionally, a special thank you to the Lake Bluff Police Department for assisting in weighing the donations that were received.

Departments continue death investigation for woman that died from apparent dog attack The Fox Lake Police Department along with the Lake County Coroner’s Office is investigating the death of a 52 year old female that occurred in the 600 block of Knollwood Rd. of Ingleside IL. The Police Department received a call at 4:43 p.m. on Saturday, May 9, 2020 for a person who was bleeding.

The female was located deceased at her residence.

She sustained wounds that were consistent with animal bites. Officers located three dogs on the premise.

All dogs were contained and removed from the property by the Lake County Animal Care and Control. The dogs will remain in the care of the Lake County Animal Care

and Control’s office for the duration of the investigation.

The age and breeds of each dog have been estimated as: • Blue - 2 year old male French Bull Dog at 55 lbs • Rocco - 2 year old male French Bull Dog at 36 lbs • Spike - 15 year old male Collie mix at 25lbs The Fox Lake Police Department had previously responded on April 13, 2020 for a report of the male dog, Blue, biting the male resident. The bite was reported to the Lake County Animal Care and Control and the dog was placed on home quarantine at that time. A second call was received on April 21, 2020 for the same dog biting the male resident again. Both

bite incidents occurred within the home. The dog was removed from the residence at that time and turned over to the Lake County Animal Care and Control where it was placed under hospital quarantine. The Fox Lake Police Department does not have any record of bite reports involving the other two dogs living at the residence.

An autopsy was performed at the Lake County Coroner’s Office on May 12, 2020. The preliminary results indicate she died as a result of injuries received from a dog attack.

This investigation is still being conducted by the Fox Lake Police Department and the Lake County Coroner’s Office.

Single vehicle crash in Richmond causes two fatalities

A 35-year-old Wonder Lake man and an unidentified female passenger have died as a result of a single vehicle crash that occurred Sunday evening in the 7900 block of Tryon Grove Road, unincorporated Richmond.

On May 17, 2020 at 10:20 p.m., the McHenry County Sheriff’s Office, Richmond Fire Protection District, Wonder Lake Fire Protection District, and Spring Grove Fire Protection responded to a single vehicle crash involving a 2001 Toyota Camry that had crashed on Tryon

Grove Road, west of Keystone Road.

On scene investigation indicated the Toyota had been traveling eastbound on Tryon Grove Road. For unknown reasons the Toyota failed to navigate the curve in the roadway and instead it exited the roadway to the south where it struck multiple trees.

The driver was wearing his seatbelt, while the passenger was not wearing hers at the time of the crash.

They were both pronounced deceased at the scene. There

were no other occupants in the vehicle. No airbags deployed and that area of the roadway was closed for approximately five hours. The weather is not believed to be a contributing factor to the crash.

The investigation into the crash, and the identity of the female passenger, continues by the McHenry County Sheriff’s Office Major Crash Investigation Unit and the McHenry County Coroner’s Office. Toxicology reports will be pending through the Coroner’s Office.

CLC Board of Trustees continues educational delivery and business operations, appoints new board members Since the coronavirus pandemic began to take hold in communities across the United States and particularly in Lake County, Ill., the Board of Trustees of the College of Lake County (CLC) has led offering students and the local community a range of resources.

As part of implementing an alternative learning delivery model for students and faculty, as well as ensuring a positive remote work model for staff, consistent communication has been increasingly important.

Dr. William M. Griffin, CLC board chair, stated, “President Lori Suddick and I communicate often as this crisis continues to take new turns. During this time, it is imperative to have good relations and open communication between the board chair and the president.

and Amanda Howland, vice chair, highlighted the following board-supported decisions that received overwhelming support: • Timely and useful coronavirus updates containing information and resources directly related to CLC and the region; • A new Lancers Keep Learning website providing educational and counseling support and guidance for students and community members; • Technology delivery to students who rely on information technology resources typically only available on campus; • Introduction of the Lancers Keep Learning Fund, allowing eligible students to apply for financial assistance for educational costs and critical basic needs; • Modified policies and procedures to be appropriate and student-friendly in light of

new conditions; and • Distribution of $2.4 million in CARES Act funding to CLC students.

The virtual meeting ensured the continuity of essential college business and included the election and appointment of new trustees.

In addition, the board unanimously approved and appointed former senior executive Vaseem Iftekhar and attorney Torrie Mark Newsome to fill two vacancies on the Board, positions left open by the retirement of Dr. Catherine M. Finger and the death of Timothy Powell. The two newly appointed trustees will be sworn in at the Board’s next meeting on Tuesday, May 19, 2020 at 6 p.m.

Vaseem Iftekhar is a retired senior executive with over three decades of experience in research and development in the pharmaceutical industry including at Abbott Laboratories. A dedicated community volunteer with a focus on interfaith understanding, Iftekhar has been a member of the CLC Foundation Board and is a member of the Daily Herald’s Sounding Board.

Upon learning of his appointment as a trustee, Iftekhar said, “Affordable education is a right of every citizen in this country. Community colleges play a key role in providing meaningful education and training to enhance the opportunities for everyone and support our economy.”

Attorney Torrie Mark Newsome is a former 20-year employee of Abbott Laboratories, has volunteered for

United States Air Force Reserves and is a former Assistant State’s Attorney for Lake County. In 2005, Newsome founded The Law Office of Torrie Mark Newsome. He is the immediate past chair and a former member of the CLC Lakeshore Advisory Committee. Newsome also taught Introduction to Paralegal Studies at CLC for 13 years.

Upon learning of his appointment as a trustee, Newsome said, “CLC is a very special institution in my life and the life of my family; my mom and two of my three children are graduates of CLC. Pritzker warns of ‘consequences’ for businesses, counties opening early Says licenses could be revoked, funding withheld

On May 13, Gov. JB Pritzker warned business owners and local governments of consequences they will face if they defy his stay-at-home order.

Pritzker said there are no “easy decisions” in a pandemic and said he sympathizes with local elected leaders struggling with difficult choices.

“But what I don’t have sympathy for is those so intent on disregarding science and logic, so afraid to tell their constituents what they may not want to hear—that they put more people’s lives at risk,” the governor said during a virtual news conference from his home in Chicago.

Pritzker has faced pushback from local officials across the state who are seeking to reopen sectors of their economy earlier than the May 29 date when regions can begin moving to the third phase of his reopening plan.

But, Pritzker said, those leaders were not elected “to do what’s easy,” they were elected “to do what’s right.”

He also warned of consequences for businesses that try to reopen too quickly.

“For the small minority of businesses that choose to ignore the medical doctors and the data, and to ignore your legal obligations to residents of your community, there will be consequences,” he said.

Those include revocation of licenses for those businesses and professionals licensed by the state.

“Counties that try to reopen in defiance may not be reimbursed by FEMA for damages they cause, because they ignored the law,” he said. “Local law enforcement and the Illinois State Police can and will take action. But there is no consequence the state could impose that is greater than the harm that you will do to your own communities.”

It was announced May 13 that the General Assembly would convene a legislative session this week to focus on pandemic response, a state budget and other matters.

Pritzker said he respects Republican calls for bills requiring legislative approval to extend his disaster proclamation, but he said all actions thus far are aimed at public health.

“I think everybody understands that what I’ve been doing is following the science and the data and doing what’s best for our economy, given that the virus is out there,” he said. “I want to remind everybody that when people get sick, and when they die, that too has an economic cost aside from the terrible cost to families and communities. There’s also an economic cost to our state when that’s happening, so take that into account when you’re suggesting that we should follow a different path.”

Hospitalization numbers remained roughly flat, with 4,563 hospitalized due to COVID-19 as of midnight May 13—1,208 of them in intensive care beds and 714 of them on ventilators.

Pritzker also gave an update to the state’s strategy for dealing with spread at long-term care facilities. He also said a resident of the state-run Manteno Veterans Home who had been in hospice for several months recently tested positive for the virus and died.

That facility had 30 residents of 220 and 19 employees of 307 test positive for the virus between April and May, and all residents have been tested recently. All positive residents and others contacted by them have been isolated.

He said one of 153 residents and none of the 219 staff at the LaSalle Veterans’ Home have tested positive; five of 51 residents and none of the 78 staff members at the Anna Veterans Home tested positive, although some staff tests were still pending; and there were no known positive residents or staff at the Illinois Veterans Home at Quincy, although more than 200 residents and 50 staff were awaiting results.

Pritzker said the state is testing residents even at longterm care facilities that do not have positive cases of the virus, as almost half of the state’s 3,792 COVID-19-related deaths can be tied to such facilities.

“IDPH has prioritized testing at long-term care facilities and to our vulnerable populations where infection is more likely to lead higher severity cases, especially amongst communities of color,” he said.

Those at state-run veterans homes face the same precautions as all long-term care facilities in Illinois, he said. Since March 5, all visitors and staff have been screened before entry into the home, and by March 10 all vendors were barred from visiting facilities and off-campus activities and on-site construction projects were canceled.

Family visits were confined to end-of-life visits as well.

He said the state has provided 30,000 tests to 129 facilities around the state. He said the state has also distributed personal protective equipment to all 102 counties, and local health departments distribute it to longterm care facilities.

“Our state and stockpile always provides a backup for them, and is not the primary supplier for private business, such as nursing homes,” he said. “Having state government fulfill each individual request would not be efficient, or in any way, manageable.”

Still, he said, the Illinois Emergency Management Agency and IDPH have coordinated an effort to directly deliver PPE to more than 1,200 nursing homes and other long-term care facilities across the state. Those shipments began on April 30 and have reached more than 85 percent of the facilities.

Property tax deferral among several measures approved by Lake County Board At its May 12 meeting, the Lake County Board passed several measures in response to the COVID-19 pandemic.

These include: • An ordinance giving Lake County property owners more time to pay each installment of their property taxes due to impacts of COVID-19.

• A temporary ban on open burning in unincorporated Lake County.

• A resolution establishing a special committee focused on supporting residents and businesses with recovery and relief utilizing COVID-19 federal funds.

• The allocation of $2.4 million in federal funds received by the County to nonprofit organizations in Lake County providing housing, food and utility assistance.

In recognition of the financial hardship that many Lake County taxpayers are experiencing in light of the COVID-19 pandemic, the County Board enacted an ordinance that allows taxpayers to spread their property tax payments over four installments, instead of the usual two installments. If the second half of the payment is made by the second due date, no late fees will be incurred.

The payments were originally due on June 8 and Sept.

8. Under the ordinance, property owners must still pay the full amount of taxes due, but may spread them over four payments on the schedule outlined below without incurring any interest penalties for late payments: • 50% of the first installment payment is due by June 8, 2020 • 50% of the first installment payment is due by Aug. 7, 2020 • 50% of the second installment payment is due by Sept.

8, 2020 • 50% of the second installment payment is due by Nov. 9, 2020 The Lake County Treasurer’s Office will be sending notice of the deferred payment plan to Lake County property owners through the mail. Lake County property owners will receive this notification in approximately two weeks.

“Lake County is working tirelessly to ensure we are utilizing every tool possible to help residents during this pandemic,” said Lake County Board Chair Sandy Hart.

“Our newly established special committee is the next

step in providing recovery assistance to our local community.”

The Board passed a resolution establishing a special committee focused on COVID-19 recovery and relief. The committee will provide timely guidance and strategic priorities to the County Administrator for the planning and execution of the federal COVID-19 response funds provided to Lake County under the Coronavirus Aid, Relief and Economic Security (CARES) Act. The special committee’s first meeting will be held virtually on Friday, May 15 and can be viewed online at lakecounty.tv.

In other action, the Board also enacted an emergency ordinance that temporarily bans open burning in unincorporated through June 10, 2020. Recreational fires that are no larger than 3’ x 3’ x 3’ used for warming, cooking, and other recreational purposes are not included in this ban. More information on the temporary ban and alternatives to burning yard waste can be found at lakecountyil. gov/openburning.

Lake County has already received the first allotment of entitlement funds through

the CARES Act to respond to the COVID-19 pandemic, including $1,709,120 in additional Community Development Block Grant funding (CDBG) and $777,472 in additional Emergency Solutions Grant (ESG) grant funding.

At its May 12 meeting, the Board approved the distribution of those funds to several Lake County nonprofit organizations that are working to provide assistance to those in need of housing, food and utility payment assistance. A list of organizations receiving the funding can be found on the link at lakecounty.legistar.com.

The proposed funding recommendations were designed to support high-capacity, vetted programs able to scale up rapidly and respond quickly to the crisis. United Way of Lake County’s 211 information and referral call service saw a 92 percent increase in call volume in the month of March, driven by an increase in COVID-19 calls. The top five needs identified in COVID-19 calls were: rental assistance, food pantries, electric service payment assistance, homeless shelters and gas service payment assistance.

A document included in a downstate representative’s revised lawsuit against Gov. JB Pritzker suggests the governor does not have the authority to issue successive disaster proclamations.

On April 23, Republican Rep. Darren Bailey, from Xenia, first alleged the governor overstepped his power by declaring more than one state of emergency to address the COVID-19 pandemic.

Now, in amended arguments, Bailey cites a memo from the office of Republican Attorney General Jim Ryan in 2001 that says the Illinois Emergency Management Agency Act allows a governor to wield expanded authority only “for up to 30 days.”

Pritzker first issued a disaster proclamation on March 9.

Since then, he has extended that proclamation twice, most recently through May 30.

In the 19-year-old memo, senior assistant attorney general Michael Luke wrote that expanding those emergency powers to last more than 30 days “would render the limitation clause meaningless.”

Taking into account the rest of the law, he added, a governor would need permission from the General Assembly for any extension.

“This Attorney General opinion lays bare the overreach of the executive branch being perpetrated by this gamesmanship,” Thomas DeVore, Bailey’s attorney, wrote in the revised lawsuit filed May 13.

While that document is not legally binding, DeVore said the “optics” of its existence “will be horrific for the governor’s office,” especially because the attorney general’s office did not disclose the memo to a judge sooner.

Pritkzer, during his daily COVID-19 update May 13, said current Democratic Attorney General Kwame Raoul

“has not issued that (memo) to us,” and pointed out that the office is representing Pritzker in this case.

The disaster financing section of the act further supports that argument, Bailey alleges in the lawsuit. A governor is allowed to spend a certain pot of state money on a disaster, and, if the General Assembly is not in session, to transfer funds from other accounts as needed only “until such a time” as the Legislature “can convene in regular or extraordinary session.”

Raoul’s office previously argued that if Pritzker’s disaster proclamation was allowed to lapse on April 8, or 30 days after the first one was issued, it “would lead to absurd, unjust, and profoundly harmful results to a degree rarely, if ever, contemplated by an Illinois court.”

The law does not specify a governor cannot declare more than one disaster, the office argued in a court filing.

In each of Pritzker’s proclamations, he cites COVID-19 as a continuing public health disaster.

According to the IEMA Act, a disaster is a wide breadth of circumstances “requiring emergency action to avert danger or damage, epidemic … (or) public health emergencies. …”

DeVore, in an interview, said that is key. He does not contest Pritzker was legally permitted to issue the first proclamation, but said the following two were not allowed.

A disaster exists, he said, only if there is a threat that requires emergency action to avoid.

“How are you going to avert something—a public health emergency—that’s already here? That is why Governor Pritzker cannot issue a second or third proclamation.

He’s admitted he’s not trying to avert anything, he’s trying to manage its effects,” DeVore said.

And he argued the gover-

nor’s legal team is practicing legal gymnastics by building a 30-day deadline into each proclamation.

“I assure you he’s putting that in there to cause that proclamation to expire so he can then issue another one and recharge his emergency powers,” DeVore said.

The Legislature, when it convenes this week for the first time since March 5, should not pass a law allowing Pritzker to continue using emergency powers to combat COVID-19, he added. That would be an unconstitutional, “excessive” delegation of the General Assembly’s powers.

Bailey is asking a judge to declare the governor’s second and third disaster proclamations unlawful and prevent him from issuing any further ones.

He is also asking a judge to agree the Department of Public Health, not the governor, has “supreme authority” to place a resident under quarantine and shutter a business due to public health concerns.

Four other lawsuits move to federal courts A second Republican state representative who also filed a lawsuit challenging Pritzker’s emergency powers asked a judge May 12 to halt enforcement of the stay-at-home order until a court rules in his case.

Machesney Park Rep. John Cabello asked the Winnebago County Circuit Court for a temporary restraining order because, he said in a statement, the governor’s plan to reopen Illinois’ economy is “wholly inadequate.”

“I have filed my temporary restraining order to put the governor on notice that we are not going to let him dictate to local communities,” Cabello said. “I trust our local officials and our citizens more than I trust politicians from Springfield or Chicago.”

The outcome of Cabello’s case could affect all state residents. If a judge agrees Pritzker cannot legally issue successive 30-day disaster proclamations, it could release residents and businesses from the governor’s restrictions.

DeVore, who is also Cabello’s attorney, said shortly after this request was filed May 12, the attorney general’s office asked the case be moved to a federal court. And earlier last week, lawyers also asked three other cases be moved to a federal court—one filed on behalf of a hair salon owner and two for a restauranteur with two establishments. All are represented by DeVore.

The attorney general’s office, which represents Pritzker, did not comment on its motivation for a change in venue.

In an interview, DeVore said while his clients did not file their challenges in federal court, they do not oppose the shift.

“My clients could’ve went to a federal court. They didn’t. This is an issue of disagreement between the good people of the state of Illinois and the executive branch,” he said. “For some reason, the attorney general was not particularly excited about that.”

The three lawsuits filed

by Sonja Harrison, owner of the Clay County-based Visible Changes Hair Salon, and Kevin Promenschenkel, owner of Poopy’s Pub & Grub in Carroll County and Dookie’s Pub & Grub in Clinton County, are nearly identical.

They are asking judges in three counties—now, federal courts—to agree their businesses were shuttered without an avenue to appeal, that the Emergency Management Agency Act cannot afford Pritzker the power to close businesses, and that the steps outlined in the Illinois Department of Public Health statute must be followed.

Patel selected to Undergrad Research intern program

Tilak Patel, an Iowa State University kinesiology and health major from Richmond, was selected as a spring 2020 Louise Rosenfeld Undergraduate Research intern in the College of Human Sciences.

Patel is working with Jason Gillette, associate professor in kinesiology, to study biomechanics, specifically analyzing exoskeletons, crutches, and post injury ACL diagnostics.

The Louise Rosenfeld Undergraduate Research Internship Program is designed to equip Iowa State University College of Human Sciences undergraduate students with first-hand research experience while they contemplate studying toward an advanced degree.
