id you know that nearly $10 trillion in assets are benchmarked to the Standard & Poor’s 500 Composite Index, including about $3.5 trillion in index assets?1 The S&P 500 is ubiquitous. It is constantly referenced in financial and non-financial media, and we may compare the return of our own investments to its performance. As the index represents approximately 80% of the value of the U.S. equity market (or about 80% of market capitalization), it may be worthwhile to gain a better understanding of its structure and workings.1 Breaking down the benchmark. The S&P 500, as we know it today, was introduced in March 1957. It tracks the market value of about 500 large firms that are listed on the Nasdaq Composite and the New York Stock Exchange. The S&P is structured to include companies from across the sectors of the business community, in an effort to represent the breadth of the U.S. economy.1,2 There are a number of criteria a company must meet to be considered for inclusion in the index. A firm must be a U.S. company publicly listed on a major equity market exchange, have a market capitalization of $6.1 billion or more, and have at least 250,000 of its shares traded in each of the six months prior to its consideration for index membership by Standard & Poor’s. A company must also be financially viable: the ratio of its annual dollar value traded to its float-adjusted market cap must be greater than 1.0.3

The S&P has changed over time. Companies have been gradually removed and added over the past 60-odd years. At the benchmark’s fiftieth anniversary in 2007, just 86 of the original components remained. Subsequent mergers and acquisitions have reduced that number further.3 Right now, about 20% of the weight of the S&P is held in ten companies, and the performance of tech shares influences the benchmark’s return, perhaps more than any other factor.3 The index has been altered through the years in response to changes in the economy. Across several decades, the makeup of the index’s various sectors has differed, along with their weightings. This leads to frequent updates for the equity funds that aim to replicate the index; in order to maintain that replication, they may quickly need to buy or sell shares of corporations that are being added or removed.3 Keep in mind that amounts in mutual funds and ETFs are subject to fluctuation in value and market risk. I’m not sure that I’ve ever associated the word ethical with a law office before. Maybe with an animal shelter, or a non-profit dedicated to planting trees.


hile ethical business tends to be fruitful, feelings of fairness, honesty, and equality don’t necessarily go hand in hand with child custody cases or marriage dissolutions. Six years ago, that changed for Elisabeth Donovan. As a young attorney, she worked for a large firm, taking on case 18 June 2019 |

Helping clients make it through a difficult time comes naturally, when one has found their way through their own story of anger, disappointment, and healing and come out the other side. “I’ve learned to cultivate a real sense of mindfulness, which allows me to be present and available: in each moment open to my clients.” Her time in the courtroom has helped her achieve great results for her clients, but it is her passion that sets Elisabeth apart. Personally connecting with each person that walks in the door is the key to give them the best representation possible. “I work with each client personally to develop a cost-effective case strategy that won’t incur unnecessary fees, while obtaining the best possible outcome.” That’s where the word ethical comes in. Focusing on What Matters

I was in the zone. Heart pumping, uber-focused, lost in the moment. Halfway through a box of Rosemary and Olive Oil Triscuits with cheese and a glass of wine, Outlander streaming on the television, kids down for the night.


hen the episode ended though, I looked down and my lap was covered in crumbs, wine glass empty beside me: and at the end of the couch was my yoga mat. Unused for weeks now, always some excuse or another as to why I didn’t have the energy, or the time, or the money to get to a class and shape up, like I’d been intending to for months.

Over lunch recently, a couple of my mom friends and I grudgingly conceded that it had been too long since we really looked at how we were taking care of ourselves, instead, spending time on fruitless pursuits (like binge watching our favorite Netflix shows) that threatened to sink us deeper and deeper into the couch cushions. We’ve all tried our hand at gyms and at-home workout programs over the years, but nothing really seemed to stick. There are three main types of skin cancer: basal cell carcinoma, squamous cell carcinoma, and melanoma. Because each has many different appearances, it is important to know the early warning signs.


ook especially for change of any kind. Do not ignore a suspicious spot simply because it does not hurt. Skin cancers may be painless, but dangerous all the same. If you notice one or more of the warning signs, see a board-certified dermatologist right away, preferably one who specializes in diseases of the skin. ACTINIC KERATOSIS An actinic keratosis (AK) is a crusty, scaly growth caused by damage from exposure to ultraviolet (UV) radiation. An AK is considered a precancer because if left alone, it could develop into a skin cancer. AKs are the product of a lifetime accumulation of UV damage and typically appear on areas most commonly exposed sun, such as the backs of the hands, forearms, face, neck, and scalp. BASAL CELL CARCINOMA Basal cell carcinoma (BCC) is the most frequently occurring form of all cancers, with more than 4 million cases of diagnosed in the U.S. each year. BCCs may look like open sores, red patches, pink growths, shiny bumps, or scars. Any skin lesion that doesn’t heal, or bleeds with even gentle trauma, such as drying with a towel, is concerning for a BCC. SQUAMOUS CELL CARCINOMA Squamous cell carcinoma (SCC) is an uncontrolled growth of abnormal cells arising in the epidermis, the skin’s outermost layer. SCCs often look like scaly red patches, crusty bumps, warts, or elevated growths with a central depression. SCCs may appear suddenly and some forms are tender to touch. They can become disfiguring and sometimes deadly if allowed to grow. More than 1 million cases of SCC are diagnosed each year in the U.S., which translates to about 115 cases diagnosed every hour. Incidence has increased by 200 percent in the past three decades in the U.S., and more than 15,000 Americans die each year from this type of skin cancer. MELANOMA Melanoma is a very dangerous form of skin cancer. Melanoma is caused mainly by intense, occasional UV exposure (frequently leading to sunburn), especially in those who are

genetically predisposed to the disease. An estimated 178,560 cases of melanoma are diagnosed in the U.S. each year and is fatal for an estimated 9,320 of these patients. Fortunately, if melanoma is recognized and treated early, it is almost always curable.

WHAT PATIENTS NEED TO KNOW 1. Everyone needs to perform a self-skin exam once a month. 2. Melanoma can appear anywhere on the skin, including the palms/soles, under your nails, and places...for most, have never seen the light of day (genitalia). For this reason, it is important to look everywhere. Lock the bathroom door, get out a hand mirror, and check, it could save your life. 3. What to look for: ABCDEs, and an ugly duckling A - Asymmetry: If I draw a line down the middle, do the sides match? B - Border: Is there a nice crisp border, or does the mole melt into the surrounding skin? C - Color: Moles should be one color, one shade of brown. Is there a variety of shades or additional colors, such as black, red, white, or blue? D - Diameter: Any mole larger than 6mm, ie the head of a pencil eraser, has a higher risk of becoming melanoma. E - Evolution: Has it changed? F - The Ugly Duckling Sign: Most people have a “signature mole,” their own personal mole appearance and architecture. Is there a mole that seems different from all the others? 4. Everyone needs a full body skin exam by a board-certified dermatologist once a year, more frequently if you have a family history of skin cancer, a personal history of skin cancer, or live in an area with substantial sunshine.

What is the process and when might a patient expect to see results? A: The primary benefit or goal of treatment is to restore a patient’s ability to have spontaneous intimate experiences, restored confidence and a natural sex life. Unlike other treatment options, there’s no timing to take a pill when you want to perform. No injections to medically induce an erection, which can obviously be very intrusive when you are “in the moment.” Treatment is non-invasive - no surgery and no side effects. In terms of what a patient can expect of the process, the first step is to schedule a consultation - a 10 to 30-minute phone call with a member of our team will give us an idea of whether or not he is a good candidate for the treatment. After he is determined to be a quality candidate and that the root cause of his ED is likely a vascular disorder, the patient will visit our office for an in-person consultation with one of our physicians. The next step would be to begin treatment, which typically involves six visits over the course of three to five weeks. Then we wait for 90 days as the body takes six to 12 weeks to fully react to the treatment, at which time he’ll come back in for a follow up visit with the doctor. ne of my favorite things about Salt Lake City is its abundance of trees. In fact, the University of Utah campus, on the bench of the city’s foothills, is a designated State Arboretum, with over 8,000 trees. Boasting 300 plus varieties, including almost 40 different types of conifer, the city, and the campus in particular are an incredible sight in the early days of spring as the beech, elm, oak, and Japanese flowering cherry trees begin to bloom. It is said that you can experience all four seasons in a day, and that is certainly true if you’re planning on venturing up any of the myriad canyons that flank Salt Lake’s downtown sprawl. Sun in the morning and snow in the afternoon (winter into late spring) makes for beautiful days exploring all that the city has to offer: bookstores like The King’s English with its incredible storytime workshops; classic diners like Ruth’s with plates for the kids and biscuits as big as your head; or the gorgeous City 42 June 2019 |

In nearby Cottonwood Heights, we opted to expand our kids’ palates sampling Vietnamese "street food” at the newly opened Saola ( (owners are putting the finishing touches on the space, which will showcase a beautiful sushi display and full bar, several semi-private dining areas and an expansive dining room). A fan of Pho? There are extroverts and introverts. There are loud personalities and reserved ones. Those who love dinner in with a few friends, or a real lollapalooza with everyone they know. The common ground between both types?

Candy knows her way around a celebration. In business since 1990, she and a cadre of incredible ladies have been making every occasion special for their customers with everything from invites to home decor. “Customer service comes first, but that’s pretty simple when we all love the idea of celebrating every holiday.” Nowadays the competition is building online, but even with expedited shipping, nothing really helps set the tone of a party like talking through a theme or decor details with an expert. “Each one of the wonderful women (there are 17 of them!) who work here can walk you through the process and share our etiquette gleaned from 29 years in business.” 46 June 2019 |

Paper goods, balloons, and home decor weren’t Candy’s original business plan. “I kind of stumbled into the party,” she notes with a chuckle. “I met a darling girl at a class I was taking and she said she was interested in opening up a party store in Orange County! I jumped in with both feet, not knowing a darn thing about this business. Well, except that I do love parties.” Quickly growing to love chatting with each and every customer who walked in the doors, Candy soon realized that on a very personal level, the business was about the personal friendships she was developing, and the small and large moments that made up each individual’s lives. “May-

Some might question why I would make the drive to Costa Mesa from my home in San Juan Capistrano to peruse Candy’s wares. I could honestly spend hours wandering around the store looking at all the amazing hostess gifts, home decor and unique presents for weddings, baby showers, holidays and all of life’s other occasions. I’m already envisioning retro party ideas (think 80s, western, disco, Roaring 20s or other era-themed events where only a paper invitation will do). For a more curated experience, all you have to do is see what’s coming up on the events list. From taking a modern calligraphy workshop to spotting the team at a wedding show, there’s something for everyone, even those of us with little or no decision making skill to speak of. You’ll feel

Four year old Mack is a great dog looking to find his new best buddy. He loves to be active and doesn’t mind long walks or vigorous romps outdoors. Friendly and attentive, Mack responds very well to training and would thrive under further direction from an experience dog owner.

Kenai is a handsome Husky who is really quite the sweetheart. Like most Huskies, Kenai is high energy and does best after some vigorous exercise. he primary purpose of diabetic socks is to keep your feet dry, decrease your risk for foot injury and avoid preventing or slowing blood circulation. The difference between diabetic socks and regular cotton socks is that they are usually are made of materials that wick away moisture, are fitted, padded and are non-binding. Because people with diabetes are at higher risk of foot injuries and infection due to damage to their circulatory and nervous

Take a Moment with the Merrills Who else would you ask other than the “Medicare Answer Man” or the "Medicare Presenter" for Mission Hospital? Congratulations, You’re Turning 65!

One of the biggest benefits of turning 65 is you qualify for Medicare, but many are not sure how it works and what they should do now. This 2019 Special Edition Newsletter will take you through the process and explain in plain English what you need to do. By now you have probably received tons of mail and trying to pick one company or agent over the others can be challenging. We can help! We are the Merrills, and we have helped thousands of baby boomers with their Medicare Insurance in Orange County. Here are some basics for your consideration. Original Medicare (Parts A and B) Medicare was started in July of 1965. It is provided by the government and pays fees for your care directly to the doctors and hospitals you visit. Part A helps with hospital cost and Part B helps with doctor and outpatient care. In 2005, the government added part D and this helps pay for prescription drug costs. Part D is covered later in this newsletter, but you need to know you’re required to have “credible drug coverage” as part of your plan. Medicare Part A (Hospital Coverage) Part A helps with the cost of your inpatient hospital stays and skilled nursing care after a hospital stay. Medicare part A premium is free to you as long as you have worked at least 10 years in this country. Although the monthly premium is free, the deductibles and copays are not. To walk into a hospital will cost over $1,300 and if your stay is longer than 60 days, then a copay of over $300 is added on for days 61-90 and over $600 per day for days 91-150. Medicare Part B (Doctor Visits) Part B helps with doctor visits including outpatient care at hospitals and clinics, lab tests and some skilled nursing care. The nice part is you can see any qualified doctor who is eligible to participate in Medicare and who is accepting new patients. There is a monthly premium for Part B and most people pay $135.50 per month, but if you’re single and making more than $85,000 per year or married making over $170,000, you will pay a higher monthly premium. As far as copays, you’ll pay the first $185 then generally Part B pays 80% of your doctors’ fees and you are responsible for the remaining 20%. In our experience, the Part B 20% that you are responsible for puts you at unlimited financial risk. (We’ll talk later about ways to limit your risk.) Medicare Part D (Prescription Drugs) Part D helps with the cost of prescription drugs. Part D plans are sold by private companies and range in price anywhere from $15 to over $100 per month. WORD OF WARNING: You will read that Part D is optional. The problem is if you don’t sign up when you first become eligible and decide to at a later date, you will be assessed a penalty and that penalty will stay with you the rest of your life. For example, a person turns 65 and doesn’t take medication and decides against enrolling in Part D. When they turn 70, their doctor prescribes an expensive medication and this individual decides to enroll into Medicare Part D. Shortly thereafter they receive a letter from Medicare stating their late enrollment penalty. In this example that person’s penalty would be roughly $25 per month for the rest of their life.

Original Medicare doesn’t cover everything. Original Medicare helps you get basic coverage, but you should expect to pay some of the costs. Many people enroll in additional insurance coverage to help them pay for the cost and benefits that aren’t covered by Original Medicare Parts A and B. That is why you need to know the difference between Medicare Supplement Plans and Medicare Advantage Plans. Medicare Advantage Plans: (Medicare Part C):

Medicare Advantage plans are run by private companies. You have probably heard of United Healthcare, Anthem Blue Cross, Blue Shield, SCAN, Humana, Kaiser, etc. These companies offer Advantage Plans. They combine coverage for certain hospital costs, doctor visits and most include Part D coverage at no additional cost. In most plans you choose a primary doctor and your doctor has access to specialists within their group. Many plans offer additional benefits not offered by Original Medicare such as Vision, Dental, Hearing, Chiropractic, Acupuncture and Gym Memberships. Although you continue to pay your Part B premium, many Advantage Plans offer $0 monthly cost. All plans also offer Out-of-pocket limits on medical cost. (Remember the unlimited 20% you’re responsible for on Part B costs?) There is one health question that can keep you from being eligible: ‘Do you have end stage renal disease?’ If that is a no, you’re in! Each year you have a chance to change your coverage during the Annual Enrollment Period (AEP), which starts October 15th and runs through December 7th. Medicare Supplement Plans: These are also called Medigap plans as they help you cover some or all of the costs that Medicare Parts A and B don’t cover. The nice part is you can see any doctor in the USA that participates in Medicare. For the freedom of seeing any participating doctor, the premium is higher. Remember you still keep paying your Part B premium and with a supplement plan, your Part D premium is separate and not built in like most Advantage plans are. When you turn 65, you have a guaranteed issue in a Supplement Plan and are ‘Guaranteed Renewable.’ That means the policy renews automatically from year to year as long as you pay the premium on time.

Personal Note We can’t tell you the hundreds of times we’ve sat at a kitchen table and the person turning 65 walks over with a stack of papers 3 inches thick and says, “Am I really supposed to read all this?” Our job is to help people with their Medicare insurance – that’s all we do 365 days a year! Obviously we would like to earn your business, but more importantly we want to make sure you have the best insurance that is tailored around your needs. Also, we make sure you are within Medicare’s rules so you don’t receive a dreaded penalty letter! By the way, the person you sign up with becomes your Medicare agent, so choose wisely!

STAIRWAY TO HEAVEN If you’re looking for a memorable way to work in a bit of exercise on your trip, try hiking the Diamond Head Crater. I have to say, there’s something rather empowering about walking up the inside slop of an extinct volcano. More than 3,500 feet in diameter with a 760foot summit, Diamond Head is a lasting remnant of a volcanic explosion that occurred about a half a million years ago. Ancient Hawaiians called it Laeahi, which translates to “brow of the tuna.” The name “Diamond Head” has more recent roots in the 1800s, when British sailors mistakenly believed that the glistening calcite crystals embedded in the lava rock were diamonds lodged in the lodged in the crater’s soil.

It takes 45 minutes to an hour to reach the summit, and half that time for the trip back down. The trail is a switchback with the mountain on one side and a railing on the other. After a lookout point that doubles as a rest stop, the trail takes a steep upward ascent through a series of stairs and tunnels carved into the mountain. The last set of stairs is a 99-step climb that my husband and kids clamored up with little effort while I took the slow and steady - and decidedly less “in shape” approach - that eventually ends at a World War II bunker. From there, you step out to one of the best panoramic views of the island. We lucked out with the weather during our four-day trip to the islands which meant that once we summited the crater, we were rewarded with a spectacular view of Oahu’s entire leeward side (the side to which the wind is blowing). Entry into the state park is $5 per vehicle or $1 per pedestrian.
