One of my all-time favorite things to do is get a mocha and go boutique shopping I’m especially happy if I can find one of those shops that sell vintage, antique, botanicals, clothes, jewelry, soaps, candles and all of those little goodies that put you in that fun buying/decorating mood! Beth Carney, owner of Curiosity is perhaps the sweetest and funniest gal you’ll meet She’s creative, down-to-earth and a smart businesswoman In fact, she’ll be launching a new line of pure ingredient soaps launching in September. She has a keen eye for buying and is privy to items left over from model photo-shoots, Hollywood estates and those must have times you just, um must have! I, in particular, am in love with her botanical selection Her prices are also fabulous! “There is something for every budget,” Beth says “I love when people enter my store and find just what they’re looking for and maybe something they didn’t even know they needed,” she laughs. “I enjoy this business because I’m a people person and love my customers I love meeting new people but I’m proud that most of my customers have been coming here for years, and we’re on a first-name business!”
Curiosity also has many one-of-a-kind items. “We feature many talented artists and their work,” says Beth “I also have fun, fresh items coming in constantly from the estates of music and film stars ” I couldn’t stop drooling over the new and used cottage furniture, and small touches of cute items everywhere. Among the cuteness were some amazing highend jewelry, art and decorations. It was such a great afternoon of shopping. Even thought it’s a tiny boutique, I was happily lost for over an hour

Answering the Evolving Challenges Facing the “Smaller” Business

I began the process of writing this article by, of course, Googling. I wanted to do a piece on the challenges facing the smaller business. I wasn’t thinking of a “new” business and, in my mind, “smaller” could be pretty substantial; say $3 to $5 million in annual revenue
searched “challenges facing small businesses” and was surprised at the number of articles I found. As I read them, I discovered that they were published from 2008 until today The challenges mentioned have evolved from “raising capital to survive” in 2008 to “finding the right employees” in 2013 That evolution is hear tening (our economic outlook is improving) and frightening (when will business be fun again?).
The lesson, it seems, is to learn to adapt to the ever-changing business environment How do we do that? Here are a few ideas
Read and learn all you can about the current economic conditions and where the exper ts think the economy is going Focus on the economic facts and try to separate the emotion of politics from the consideration of the facts Politically we all have our biases that influence our thoughts, but if we are planning, we must be realistic As someone once said “it is what it is ” I would add to that “not necessarily what we want it to be ”
Talk to your peers in town. Get their take on what is happening. That may be through the Chamber of Commerce, the Downtown Business Association, or some other such group It might be an ad hoc group you build yourself It might be through your service club (Rotary, Kiwanis, Lions, or Exchange) Make this a habit, not a one-time thing Most everyone is anxious to share this knowledge Realize that the situation is in a constant state of change and requires constant attention to understand it.
Build a team of experts to help you You need relationships with a taxation expert, a financial planner, an attorney, and a banker Share with them and be open You might circulate financial statements monthly or quarterly with your team Realize that there is a balance between minimizing taxes and being “bankable ” Ask for their advice You might get them together, share your plans and needs, and discuss strategies to get you where you need to be, jointly.

This job forces me to divulge my favorite hidden shopping spots: sad but true. My evil boss asked me to go vintage shopping for work one day when she introduced me to this store Can you imagine the audacity of my job? When I was visiting, a woman was being sized for a party gown. (Yes, Junqie’s has their own tailor). I guarantee that woman’s gown will make her most striking woman at the party. There’s something about vintage wear that just defines class
They have live music on Sundays, and sale racks out front daily. They have an amazing selection of jewelry and sunglasses (I bought three pairs and don’t judge! I told you I had a problem), not to mention incredible hats

Q:
I’ve heard a lot about breast cancer genes and wonder, should I be tested?
A: What you have most likely heard about are BRCA1 and BRCA2 genes These are human genes that produce tumor suppressor proteins, which are proteins that help repair damaged DNA and consequently help ensure the stability of the cell’s genetic material If either of these genes do not function correctly then they may not sufficiently repair DNA damage that occurs in the cell. As a result, cells may develop changes that ultimately lead to cancer. Specific mutations of the BRCA1 or BRCA2 gene may be inherited and those mutations may greatly increase a woman’s risk of developing breast and or ovarian cancer in addition to other cancers including fallopian tube cancer Men can also inherit harmful BRCA1 or BRCA2 mutations and they too can be at increased risk of breast cancer as well as other cancers such as prostate cancer Both genders with BRCA1 or BRCA2 mutations will be more likely to have cancer of the pancreas
Together, mutations of BRCA1 and BRCA2 genes comprise approximately 20-25% of hereditary and about 5-10% of breast cancers overall. Breast cancers associated with genetic mutations tend to develop at younger ages than breast cancers that occur sporadically. A harmful BRCA1 or BRCA2 genetic mutation may be inherited from either parent Each child of a parent who carries a mutation in one of the genes has a 50% chance of inheriting the mutation
In general, a woman’s lifetime risk of developing breast and or ovarian cancer is greatly increased if she inherits a harmful mutation of either the BRCA1 or BRCA2 gene About 1 in 8 women in the general population will develop breast cancer as some point during their lives. Recent research shows that approximately 55-65% of women who inherit a harmful BRCA1 mutation and around 45% of women who inherit a harmful BRCA2 mutation will develop breast cancer by age 70 years In nearly half of families with multiple cases of breast cancer and in up to 90% of families with both breast and ovarian cancer, their disease is caused by harmful mutations in BRCA1 or BRCA2
Fortunately, harmful BRCA1 and BRCA2 genetic mutations are very uncommon Most experts agree that genetic testing in individuals who do not have cancer should only been done if the individual has a strong family history of certain patterns of cancer. These patterns include having several family members diagnosed with breast and or ovarian cancer, or if there is a single family member with more than one occurrence of breast cancer or with both breast and ovarian cancer, or if there is a male member of the family with breast cancer
If you are concerned that you may have the mutation or are unsure of your family’s medical history I would suggest that you talk to your doctor about a referral for genetic counseling. A genetic counselor will discuss genetic testing with you in great detail and help determine if you are a candidate for screening. Often patients with breast cancer undergo screening for the genetic mutations in BRCA1 or BRCA2 so if any of your family members have breast cancer it may be wise to inquire as to whether or not they have been screened because the results of their screening will also greatly influence whether or not you should be screened

Question: "Botox does wonders for my frown lines but I’m not particularly fond of the shots. Also, Botox does not work very long on me – my dermatologist told me that I built up a resistance to the Botox, but I have to get another set of shots every 3 months if I am to keep my lines away. Can you do plastic surgery on these lines and make them go away?"

Answer: We’d like to make a couple of comments. First of all, Botox is a very effective muscle paralyzer and works almost always by weakening the muscles into which it is injected You are not unusual in seeing the results fade away after about three months
We have performed thousands of similar injections and find that the effects of Botox rarely last longer than what you have experienced. Botox injections are very useful for someone wishing to look their best for a special occasion, but many patients dislike repeated injections on a permanent basis Interestingly, 85% or migraine headaches have their trigger point in this area, and these folks will see their migraines disappear for the 3 months that the Botox is working
The same muscles that cause these frown lines between the eyebrows, called the corrugator and procerus muscles, can be surgically removed with a minimally invasive procedure called an endoscopic brow lift This approach is similar to what an or thopedic surgeon does when he looks into a knee or shoulder with an arthroscope, or a gynecologist does when looking at internal organs with a laproscope through an umbilical incision The approach is minimally invasive, yet accomplishes the same result as the older forehead lift which entailed making a long cut across the entire scalp
Pre & Post Brow Lift: 79 year old with severe frown lines on her forehead and between the brows, marked facial wrinkling and relatively minor neck laxity that were improved by an endoscopic brow lift as well as a lower lid blepharoplasty, facelift and full face resurfacing - all done in one four hour operation. The after photo shows her appearance two years later at age 81. Your results may vary.
If you have any specific questions about cosmetic procedures, your best bet would be to see a qualified plastic surgeon to review your options.
In the endoscopic brow lift, a few stab wounds are made behind the hair line, allowing the instruments to be inser ted. The tissues are freed from the bone, the muscles sculpted, and the brows usually raised a few millimeters The brows are fixed in their new position with a bioabsorbable device called an Endotine The incisions are rarely perceptible after healing has taken place. Healing from this minimally invasive procedure is quick and there are no tell tale signs of surgery. Something very important happened in 1966 that was so big, it changed how our society took care of its seniors and how people looked at their futures and growing old It was the introduction of Medicare. It’s taken 47 years to come up with something as big as that transition to our nation’s healthcare, but now it’s here. The Patient Protection and Affordable Care Act, “lovingly” referred to by some as “Obamacare.”
Health insurance will now be guaranteed issue and underwriting will be a thing of the past People with health issues will no longer pay more for their coverage, and smokers won’t pay more than non-smokers Subsidies to offset the premiums and help with co-pays will be available to those in lower to low-medium income brackets and will happen “real-time” so you don’t have to wait for a reimbursement at the end of the tax year The subsidy will be based on your income for the upcoming tax year and adjustments will be made to your tax bill if you make more that you thought you would and will work in your favor if your income declines
It’s impor tant for people, especially those currently without coverage or paying obscene amounts of money for their current plan due to health conditions to be aware of the initial enrollment period deadline; December 15th, 2013 to start January 1st. That’s when the new Insurance Marketplace plans go live across our country. If you miss that date, you still have the month of January, February and March (up to March 15th) to obtain coverage under the Initial Election Period that ends March 31st, 2014.

Death and Taxes

Will Rogers once said that the only difference between death and taxes is that death doesn't get worse every time Congress meets At the risk of contradicting an American icon, in some cases, Congress has allowed Death Taxes to get better, rather than worse
Ever since President Ronald Reagan signed the landmark Kemp-Roth Tax Cut (popularly known as the Economic Recovery Tax Act of 1981) into law, families have employed a common practice in their estate plans: The A-B Trust. This trust design allowed moms and dads to save their kids a bushel full of estate taxes by dividing the family treasure at the first death into one share for each parent, basically making sure that many estates that would otherwise have been taxed could go to the next generation without any payment to the government
When planners first began using the split involved with A-B Trusts, the “exemption” or “estate tax free” size of an estate was only $225,000. This meant that by using the A-B split, a couple could pass $450,000 to their children without additional tax planning- a fact that clearly pushed most people to the point of establishing a trust with this “divided house” approach; many people had estates larger than that amount and needed not only to maximize the benefits of their exemptions, they needed to employ other planning techniques as well to avoid taxes at death
By 1987, the tax exempt amount of an estate had risen to $600,000, which combined for a couple at $1.2 million, so that most Californians who owned any real estate still needed to “double down” on their trust plans to keep estate taxes at bay Over the years the value of our estates which could pass to our beneficiaries without taxes continued to rise, until the year 2011, when the tax free estate level rose to $5 million, or $10 million for a couple
For a couple with combined assets less than $5.25 million (the 2013 “Tax-Free” amount), there is a real need to consult their planning counsel. Simply put, while the benefits of having a “split” done on the estate of a family which has assets above $5 25 million at the first death are still significant, couples with assets unlikely to reach or surpass that amount should reconsider having the automatic or mandatory split built into their trusts Why? Simple– the process of dividing the estate at the first death is indispensable if there is a tax benefit (Since Estate Tax rates have floated between
35% and 65% since 1982) to be gained from the split, yet a family whose assets do not reach that amount may have no tax benefit from dividing an estate at the first death
If the couple’s estate amount is within the tax free levels (less than $5 25 million in 2013), they should think seriously about whether they desire to split their estate at the first death. Unless there is a nontax reason for the split, such as earmarking the first-dying spouse’s estate among the children of multiple marriages, the initial fees for the split should make most couples reconsider what they want their trusts to require at the first death.
These costs and extra work at the first death include asset appraisals, accounting, legal work, the ongoing costs for separate income tax returns for the deceased spouse’s “B” trust, along with ongoing accounting issues and unnecessary restrictions on the survivor’s access to funds in the “B” trust All these issues combine to make many people hope to avoid the division if there is not a tax motive for it at the time of the first death.
In spite of all these concerns, most planners still advise caution in dealing with the changes in a couple’s estate plan. Some planners recommend leaving an option to elect at the first death not to divide the estate at the first death This approach makes sense if the trust also includes language allowing the surviving spouse to take advantage of the deceased spouse’s exemption amount later on. This optional process is called “Portability,” and it makes it possible at the first death for the survivor to elect not to do a division of the trust at that time, but instead for the survivor to file an estate tax return at the first death and claim the deceased spouse’s exemption amount (his or her $5 25 million tax free amount) for later use in the surviving spouse’s tax planning.

This is partly due to the fact that many of these services aren’t covered under insurance and this would be a very expensive way to handle corns, callouses or fungus nails Add to this the HMO environment and a doctor just does not have the time to effectively treat these problems because they are time consuming and thus a less than effective job is performed
2. If someone wants a pedicure, but has these common infections or viruses, what’s left for them to do?
Dr. Roth: Enter what I call the podiacuristTM This means becoming a Californian licensed pedicurist who has trained under me to develop their professional podiatry skills I teach them to use a scalpel and other instruments to deal with infected or hardened nails and thick callouses Think dental hygienist for the feet The podiacuristTM is an employee of my podiatry office and can provide these services under my license. What does this amount mean for couples? Basically, the question of whether to cause a trust to include a division of assets at the first death is an issue which is, in some cases, a matter that involves more than just tax or financial issues For example, two couples, each with an estate of exactly $5.25 million at the time of doing their trusts could come to different conclusions about whether to require a split of the estate at the first death or whether to simply allow the surviving spouse to make an election at the first death whether or not to divide the estate
The first couple might be young, with each in work areas where they expect the estate to grow significantly every year. This husband and wife might be concerned that an early death of one spouse after the estate has grown even just slightly might give the surviving spouse too much opportunity to share an estate with a future spouse, perhaps to the detriment of the couple’s children This concern has motivated many spouses over the years to require a split of the trust at the first death even when the estate tax could be avoided without dividing the estate in two.
Another couple with the same size estate might be more advanced in age and might have little concern for growth of their estate since their assets are focused on income producing investments for their retirement. These two might also share a goal of keeping the post retire-

These older couples often know that which ever one survives, the primary concern will be for the trust assets to go to the couple’s children, so that post first death control issues seem less relevant in the decision making process
Another five or ten couples of similarly sized estates might come to even different conclusions about how to adjust their trusts in light of the increase in the Estate Tax Exemption amounts. This is because the issues which each estate needs to consider will change from one household to the next for reasons completely unrelated to the tax dollar limits involved, such as concerns for special needs family members, grandchildren issues, and a host of other concerns Families of larger and smaller means also need to revisit their trusts because the tax free estate numbers have shifted the consequences of trust language which has not kept up with the changes in the tax law.

Answer: As important as it is to have consistency and structure with children’s lives, life is in a constant state of change More important is the damage done to children when they hear or feel they are a burden to their parents when they hear them arguing over whose turn it is to have them. It is normal to feel vindictive or spiteful when one parent has plans to do something fun without the children and force the issues about time/date obligations, especially when you may be looking forward to a break from the kids It is in the best interest of the children to be flexible even if it feels one-sided. If you have specific plans, you may want to have a backup such as other family members or trusted friends. Have a backup plan if it was not your weekend and now find yourself parenting again. Ensure that children at any age are not able to hear the conversation with the other parent, never make your opinions or unhappiness with the parent who interrupted your plans known to the children
Suggestions for non-custodial parent activities:
Children need quality parent time, not a camp director Don’t overcompensate and feel you have to make every weekend more spectacular than the last
• Libraries often offer free reading and movie hours
• Airports, lakes and shopping malls are fun for outings
• Camping or visiting local farms
• Visit to a beach or museum
• Start a hobby or collection together
• Check your local city tourism office for idea
• Watching a movie at home together with popcorn or make your own Sundaes
• Invite your child’s friend once in a while
Find activities that build relationships. Children have their own cycles, phases and stages!

eing half Japanese, I'm always on the hunt for fresh, flavorful Japanese dishes So I was par ticularly excited to see Choya Japanese Cuisine open in the Ocean Ranch Center in Dana Point. And even more so once I sampled the menu offerings, which range from nigiri sushi and sashimi to "combo bento," noodle dishes and donburi (rice bowl dish) to free range chicken, lamb chop and salmon filet - literally something for everyone
The sashimi is served as cold, thick cuts of tuna, salmon, hamachi (yellowtail) and fresh from the sea uni (sea urchin) There are so many tempting signature roll options, you'll hard pressed to pick ust one of two. But you can't go wrong with the Golden Lantern Roll made crab and shrimp and topped with tuna and salmon.

1. Caffeine. Typically given a bad rap, caffeine, taken in moderation, will actually help improve your performance on a run. Caffeine gives you the extra boost, keeps you clear of that “batteries are draining” feeling and helps you enjoy the activity Moderation for most runners sits between two to three cups of drip coffee per day, but keep in mind that every body is different.
Drink fluids early and often. Water is important, but when your runtime totals more than an hour, include electrolyte drinks that have sodium as the main mineral player – this will keep your body and emotional state at full efficiency
