Small Business: The Backbone of Our Economy

The legal definition of “small business” is somewhat confusing because it varies by country and industry In the United States our Small Business Administration (SBA) has different size definitions depending on the industry the business is in Overall, the SBA generally defines a small business as $7 million in annual gross sales for retail businesses, 100 employees or less for wholesales businesses, 500 employees or less for manufacturing businesses, and $7 million in gross revenue for service businesses Even if a business is above the size standard defined by the U S Small Business Administration, there are other measurements that can often be used to qualify for the SBA loans
In 2010, there were around 27.9 million small businesses in the United States, as repor ted in Banc Investment Daily, a community bank newsletter These businesses employed about half of the “private” sector. Additionally, they accounted for about two-thirds of the new jobs created between 1993 and 2011.
Here in South Orange County California, a company with 100 to 500 employees would not be considered particularly “small ” In Australia, a small business is defined as having 15 employees or less That sounds a little closer to what we typically see in South County
One of the most common reasons why small businesses struggle is undercapitalization. The rule-of-thumb advice frequently given to entrepreneurs is to have access to the first year’s worth of operating costs in addition to the expenses incurred in opening the business. In general capital should be paid in by owners or investors Most banks will not loan to new ventures and require a two or three year track record
Once, established, a small business has several sources of financing including SBA Loans and traditional commercial loans. Many banks, including Independence Bank, offer both these types of loans.
At Independence Bank, we suggest an initial look at the small business’ loan request with limited documentation We call this a “preflight” for the purpose of making an initial assessment of the potential for approval This takes only a few days and can provide the borrowing small business with valuable insight, relatively quickly.

Death and Taxes

Will Rogers once said that the only difference between death and taxes is that death doesn't get worse every time Congress meets. At the risk of contradicting an American icon, in some cases, Congress has allowed Death Taxes to get better, rather than worse.
Ever since President Ronald Reagan signed the landmark Kemp-Roth Tax Cut (popularly known as the Economic Recovery Tax Act of 1981) into law, families have employed a common practice in their estate plans: The A-B Trust This trust design allowed moms and dads to save their kids a bushel full of estate taxes by dividing the family treasure at the first death into one share for each parent, basically making sure that many estates that would otherwise have been taxed could go to the next generation without any payment to the government.
When planners first began using the split involved with A-B Trusts, the “exemption” or “estate tax free” size of an estate was only $225,000 This meant that by using the A-B split, a couple could pass $450,000 to their children without additional tax planning- a fact that clearly pushed most people to the point of establishing a trust with this “divided house” approach; many people had estates larger than that amount and needed not only to maximize the benefits of their exemptions, they needed to employ other planning techniques as well to avoid taxes at death
By 1987, the tax exempt amount of an estate had risen to $600,000, which combined for a couple at $1 2 million, so that most Californians who owned any real estate still needed to “double down” on their trust plans to keep estate taxes at bay. Over the years the value of our estates which could pass to our beneficiaries without taxes continued to rise, until the year 2011, when the tax free estate level rose to $5 million, or $10 million for a couple.
For a couple with combined assets less than $5 25 million (the 2013 “Tax-Free” amount), there is a real need to consult their planning counsel Simply put, while the benefits of having a “split” done on the estate of a family which has assets above $5 25 million at the first death are still significant, couples with assets unlikely to reach or surpass that amount should reconsider having the automatic or mandatory split built into their trusts. Why? Simple– the process of dividing the estate at the first death is indispensable if there is a tax benefit (Since Estate Tax rates have floated between
35% and 65% since 1982) to be gained from the split, yet a family whose assets do not reach that amount may have no tax benefit from dividing an estate at the first death
If the couple’s estate amount is within the tax free levels (less than $5.25 million in 2013), they should think seriously about whether they desire to split their estate at the first death Unless there is a nontax reason for the split, such as earmarking the first-dying spouse’s estate among the children of multiple marriages, the initial fees for the split should make most couples reconsider what they want their trusts to require at the first death
These costs and extra work at the first death include asset appraisals, accounting, legal work, the ongoing costs for separate income tax returns for the deceased spouse’s “B” trust, along with ongoing accounting issues and unnecessary restrictions on the survivor’s access to funds in the “B” trust. All these issues combine to make many people hope to avoid the division if there is not a tax motive for it at the time of the first death
In spite of all these concerns, most planners still advise caution in dealing with the changes in a couple’s estate plan Some planners recommend leaving an option to elect at the first death not to divide the estate at the first death. This approach makes sense if the trust also includes language allowing the surviving spouse to take advantage of the deceased spouse’s exemption amount later on This optional process is called “Portability,” and it makes it possible at the first death for the survivor to elect not to do a division of the trust at that time, but instead for the survivor to file an estate tax return at the first death and claim the deceased spouse’s exemption amount (his or her $5.25 million tax free amount) for later use in the surviving spouse’s tax planning

It’s not a PPO Yet time after time, people refer to it as one It’s just not so ladies and gentlemen.
It’s BETTER than a PPO. Medicare Supplemental plans pay any provider of service that accepts Medicare assignment (Meaning they will bill Medicare first and then the Supplemental Medicare insurance plan second ) There are no “in” and “out of network” differences as there are with a PPO plan PPO stands for “Preferred Provider Organization” There is no such thing in the terms of Medicare Supplemental plans. If you want to seek treatment or care out of your local area or state, as long as that doctor accepts Medicare assignment you’re golden There is one PPO Medicare plan and it’s a Medicare Advantage plan It’s offered by Anthem Blue Cross It started out affordable and rich in benefits and that has changed over the years I generally steer those that want the flexibility of that plan in terms of seeing doctors to a Medicare
Supplemental Plan N insurance policy and then add a Stand-Alone prescription drug plan.

Answer: Plastic surgery is becoming more and more common among men but women still do make up the majority of patients in most plastic surgery offices. We have been doing plastic surgery for more than 30 years and must say that the popularity of such procedures, in both men and women, is at an all time high People watch plastic surgery procedures on television, read about them in everyday magazines and feel free to discuss their personal wish lists with friends When we first began in this field, it was unusual for patients to be so free with their questions or to share their experiences with their friends so readily after surgery. This openness and the availability of vast quantities of information about plastic surgery on the internet have lead to much better informed patients, and fueled both males and females with a desire to look better In our personal experience, 25 years ago men constituted less than 5 per cent of
our practice but today, this number has easily passed 25 % Almost an equal number of men as women seek consultations regarding nasal surgery. Men frequently request information regarding eyelid surgery and facial rejuvenation And as you mentioned, one of the most common complaints heard from men is a desire to remove laxity for the neck, often so that a shirt collar is more comfortable or a neck profile could be more pleasing The desire for liposuction is also pop-
ular in both sexes but the areas men request suctioned differ from female patients Most men have concerns in the neck, abdominal, love handle or chest regions, while the most common area of concern in females is the hip and thigh area In a nutshell, neither men nor women enjoy looking older or flabbier – those of both sexes who do not like what they see in a mirror feel free to call us. I must mention that treatment goals for things like baggy lower eyelids or neck laxity are the same for men and women, but when discussing brow position or lip fullness, we will have a different recommendation for males and females Another factor leading to the increase in popularity in plastic surgery is affordability – for example we have a special zero down, zero interest financing plan that we are promoting through December which will allow someone to get a full facelift for only $499 per month for 24 months ($199 per month for upper and lower eyelids, $271 per month for a breast augmentation, or $299 per month for a tummy tuck)!

in spite of all these concerns, most planners still advise caution in dealing with the changes in a couple’s estate plan. Some planners recommend leaving an option to elect at the first death not to divide the estate at the first death. This approach makes sense if the trust also includes language allowing the surviving spouse to take advantage of the deceased spouse’s exemption amount later on
What does this amount mean for couples? Basically, the question of whether to cause a trust to include a division of assets at the first death is an issue which is, in some cases, a matter that involves more than just tax or financial issues For example, two couples, each with an estate of exactly $5.25 million at the time of doing their trusts could come to different conclusions about whether to require a split of the estate at the first death or whether to simply allow the surviving spouse to make an election at the first death whether or not to divide the estate
The first couple might be young, with each in work areas where they expect the estate to grow significantly every year. This husband and wife might be concerned that an early death of one spouse after the estate has grown even just slightly might give the surviving spouse too much oppor tunity to share an estate with a future spouse, perhaps to the detriment of the couple’s children This concern has motivated many spouses over the years to require a split of the trust at the first death even when the estate tax could be avoided without dividing the estate in two.
Another couple with the same size estate might be more advanced in age and might have little concern for growth of their estate since their assets are focused on income producing investments for their retirement. These two might also share a goal of keeping the post retirement, post first-death costs down for the surviving spouse. This, along with the concern of avoiding administrative costs for the surviving spouse, might allow them to decide to allow the surviving spouse to file an Estate Tax Return at the first death, which elects to claim the deceased spouse’s Estate Tax Exemption for use later on These older couples often know that which ever one survives, the primary concern will be for the trust assets to go to the couple’s children, so that post first death control issues seem less relevant in the decision making process
Another five or ten couples of similarly sized estates might come to even different conclusions about how to adjust their trusts in light of the increase in the Estate Tax Exemption amounts. This is because the issues which each estate needs to consider will change from one household to the next for reasons completely unrelated to the tax dollar limits involved, such as concerns for special needs family members, grandchildren issues, and a host of other concerns Families of larger and smaller means also need to revisit their trusts because the tax free estate numbers have shifted the consequences of trust language which has not kept up with the changes in the tax law.
One thing is true for all families who have trusts: the failure to examine your estate distribution language now can cause your families to endure problems later that could be removed with simple document changes that would allow the use of improved provisions of Estate Tax Law.

You decide to try pilates for the first time, so you jump on the computer, google pilates and find that within five miles of your house there are a number of studios. The question becomes, how do you choose the best one for you?
First of all, keep in mind that pilates is not a trademarked entity, so not every studio or instructor is created equal. When pilates is taught and preformed correctly the effects are amazing, but if it’s not being taught in a professional manor injury can occur Thankfully, there are a number of cer tifications and training programs for instructors, so with a quick inquiry you can make the best decision.
When it comes to being a professional pilates instructor there are two major steps to earning a cer tification First, the would-be teacher has to take an in-depth training course, consisting of lectures, anatomy classes, and a certain required amount of hours in self-practice, observation, and teaching. Once the student has tested out of the teacher-training course they are considered to be a “Certified Pilates Teacher Trainer.”
The other half of becoming an officially “Certified Pilates Instructor” is passing a standardized test through a governing body called the Pilates Method Alliance (PMA) The PMA organization is the only governing body in the industry and has set specific standards that are required from the various teacher-training courses These regulations create the quality of instruction and preserve the integrity of the pilates method.
There are a million different pilates facilities clamming to have a teacher-training course, but with in the industry there are really only a few quality teacher training courses available Overall a teacher-training course should be at least 500 hours or take six months or more to complete. Be weary of courses taken online or over a weekend Some of the leading teacher-training courses to look for are BASI, Ron Fletcher Pilates, Stott, Balance Body and Polestar Also, the instructor should be PMA Certified Most professional studios will have this information available on their website or give it over the phone.

1. What’s the difference between what a doc tor of podiatr y does and what a pedicurist does?
Ivar Roth, DPM: There is a large gap in care between what a pedicurist does and a doctor of podiatry does In the state of California a pedicurist cannot use a scalpel or any instrument that can result in the cutting or penetrating of the skin or work on any foot or toes that have an infection. At least 50% of the population has a fungus nail infection or fungus infection of the feet. War ts, (which look like corns) are also a virus infection of the skin While a podiatrist can work on these conditions, the average person who seeks these services doesn’t want to make a doctor visit to have these problems taken care of. This is partly due to the fact that many of these services aren’t covered under insurance and this would be a very expensive way to handle corns, callouses or fungus nails Add to this the HMO environment and a doctor just does not have the time to effectively treat these problems because they are time consuming and thus a less than effective job is performed
2. If someone wants a pedicure, but has these common infections or viruses, what’s left for them to do?
Dr. Roth: Enter what I call the podiacuristTM This means becoming a Californian licensed pedicurist who has trained under me to develop their professional podiatry skills I teach them to use a scalpel and other instruments to deal with infected or hardened nails and thick callouses Think dental hygienist for the feet The podiacuristTM is an employee of my podiatry office and can provide these services under my license. To ensure the highest quality of work possible, all work is checked by a podiatrist at the conclusion of the service
3. Is there anything like this in existence?
Dr. Roth: Not until now This is a new concept that I’ve developed after dreaming and planning for over 20 years. My 10-year-old daughter was about to step off the edge of a sheer cliff, with nothing but 100 feet of air between her and the bottom of a canyon, deep in Mexco’s Sierra Madres What, I asked myself, was I thinking? If her hook didn’t hold, or if the zip line collapsed, she would be toast. For several gut-wrenching moments I seriously questioned my quality as a mother
ican Southwest, the Copper Canyon is the Mexican destination opposite the beaches –both directionally and experientially It’s where paved roads are scarce and cell coverage is even scarcer; it’s where modern civilization and native cultures still collide; it’s where over 60 species of oak trees can be found and it’s where the reverberations of the Mexican Revolution are still being heard
And it’s an ideal destination for a family adventure
Questioning myself was something I had frequently done over the course of the preceding five months. Every time I told someone that my husband and I were taking our kids to Mexico, I was forced to question myself because everyone was questioning me Were we sure this was a good idea? Had we not been paying attention to the news?
The tribulations suffered in recent years by our nation’s southern neighbor are sobering, to be sure One of the many casualties has been our own perception of Mexico as a destination It’s a casualty that doesn’t only rob Mexicans of the tourism revenue; it robs us of rich experiences that Mexico has to offer, not the least of which are Las Barrancas del Cobre, known to us as the Copper Canyon.

My parents didn’t stop talking about the experience for years Two decades later my husband and I have teenagers of our own, and we want what I expect most parents want from travel experiences: eye-opening, enriching, memorable fun. Safety is assumed… unless you star t thinking about going to Mexico with your children in 2013.

gion – not by foot, but by rail That’s how most people, and all tourists, get there.
Railroad aficionados from all over the world come to ride the train into the Copper Canyons 90 years and $90 million in the making, with 408 miles of track, 86 tunnels and 37 bridges, El Ferrocarril Chihuahua Pacifico (“El Chepe”) is an engineering marvel and one of the most spectacular train rides on the planet At one point the train makes a 180-degree turn inside a mountain; at another, it loops over itself. It passes waterfalls, hugs mountainsides and flies over rivers and gorges The platforms between cars are secure, yet wide open, letting passengers lean out from waist up to get unfettered views of stunning landscapes
It was near the completion of El Chepe in the 1960’s when lawyer Roberto Balderrama decided he would rather pioneer the hospitality industry in the Canyons than practice law. Today, under the management of his youngest son Bernardo, there is no better way for Americans – especially those with children – to tour the Copper Canyon system than with the Balderrama family of hotels
An eleven-hour bus ride from the border city of Nogales found us in Los Mochis, a big city on the Sea of Cortez that is home to Hotel Santa Anita, known for its incredible cuisine (as are all the Balderrama hotels) From Los Mochis into the Copper Canyons and back again we were in the hands of Sue and the Balderrama family, who curated our experience without overwhelming us
An hour inland from Los Mochis is the colonial town of El Fuerte, which is known as the “gateway” to the Copper Canyon and is home to the Balderrama Hotel Posada del Hidalgo With tall arches giving entrance to deep porticos, heavy ten-foot doors, and fountained courtyards permeated by tropical warmth, the Hidalgo is a perfect confluence of Mexico’s colonial past and colorful present; at once elegant and welcoming, and utterly beautiful.
A storied history makes the Hidalgo a destination in itself One portion of the hotel was originally the private residence of the de la Vega family It is said that Diego de la Vega, the man believed to be behind the legend of Zorro, as a boy inhabited the southerwestern-most room Proper homage is paid to El Zorro at the Hildalgo. In fact, he shows up at happy hour to brandish his sword, dance with the ladies and delight the children.
All six rivers that form the Copper Canyon system run into the El Fuerte River and out to the Sea of Cortez From Hotel Posada del Hidalgo, Balderrama guides take their guests on an El Fuerte river float to spot rare birds, or on a riverside walk to discover Cahaita Indian petroglyphs that are thousands of years old.
From El Fuerte, a few hours on El Chepe took us deep into the Copper Canyons, going from sea level to 5,000 feet in a morning, past some of the most stunning sights that Mexico has to offer At the small town at Bahuichivo a Balderrama bus awaited to take us to the tiny village of Cerocahui, 45 mountainous minutes away, with nothing in between.
Descending into the Cerocahui valley is a revelation – “picturesque” doesn’t touch it Soaring peaks on every side, Cerocahui is home to perhaps 500 people and is centered around a small 16th century cathedral, a catholic boarding school serving Tarahumara girls from around the canyon system, and the small Balderrama Hotel Misión. Donkeys, cows, even horses freely roam the little cobbled streets and rambling fields In the summer monsoon season, the sun beats brightly in the morning before afternoon storm clouds roll in to obscure the highest peaks in mystery
There is no internet accessibility or cell service this far into the canyons (a remarkable benefit for the digitally overwhelmed). In Cerocahui there isn’t even anywhere for a visitor to eat besides Hotel
Misión, which makes it a good thing that the Balderramas’ most talented chef makes it his home.
Fig, apple and quince trees grow throughout the grounds at Hotel Misión, while across the little river that cuts through the village, grapevines producing for chardonnay and merlot are cultivated under the diligent tending of Balderrama caretakers The small Misión vineyard is the highest in North America. In the last few years visitors have begun to flock to Cerocahui for the small harvest festival formed by Mr Balderrama, where guests get to crush grapes and enjoy their fill of wine
This deep in the canyon, contact with the Tarahumara Indians is common. Tarahumara comes from the native word Raramuri, which means “foot runner.” About 70,000 of these most primitive North American Indians live throughout the Copper Canyon system. The rugged, isolated terrain has offered the peaceable Tarahumara retreat from modern culture, away from which they have been running – literally – for centuries
Of course, the Tarahumara know the canyons better than anyone. My uncle tells of a short day hike he took away from the village into the canyons Though he is an experienced hiker, the canyons are known to be as changeful as they are beautiful and many a hiker has lost his way My uncle got caught at sunset, slightly lost He had been standing at a divergence in the trail for several minutes, quickly losing light and debating the path he should choose, when he looked up to see a Tarahumara man sitting quietly on a boulder above him, watching. When my uncle asked in Spanish the way to the village, the man simply pointed the way
Interaction with the Tarahumara is a privilege They are shy and quiet, (even with each other) and they tend to live in very independent family groups, coming together as a community only a couple of times a year. Those who live close to the “mestizo” villages such as Cerocahui sometimes come to town to sell their pine-woven baskets, beaded jewelry and wooden carvings Some make money as guides to visitors like us We wanted to see the Cerocahui waterfall (a magnificent five-mile
roundtrip hike from the village), and it was a 75-year-old Tarahumara man who led us nimbly through the river and into the forest to gift us an experience that we’ll never forget

She took us to meet a sweet family at their small “ranch” on a steep hillside At the edge of their proper ty we waited to be invited in, per the Tarahumara custom While we visited, small Tarahumara children peeked shyly around corners of stone doorways, apparently as bemused by us as we by them.
higher altitude region of Divisadero offers a thrill – not the kind where a family gets lost on a hike and must be (luckily) saved by a well-oriented Tarahumara, but the kind engineered by mechanics and marketed by professionals
A few years ago the state of Chihuahua installed an adventure park near Divisadero, taking advantage of the region’s natural valleys and plateaus to create the third-longest zip line course in the world In the coming months a line will be added that will be the single longest zip line in the world Families couldn’t ask for a more exhilarating way to experience the Copper Canyon than to soar over it, a fact to which my 10-year-old can attest (her zip line held after all).

I’m about to get real with my review of Ricardo’s Place Mexican Restaurant, because I have some picky expectations. You might be thinking that I’m forced to say only kind things about them, but it’s not true No, I fought to write this piec because they are my favorite Mexican eatery

Where to begin? Well, I like a festive environment, and Ricardo’s doesn’t disappoint. In fact, the staff are nice and welcoming, seat you as fast as possible, and the music is just loud enough to put you in the mood for a chimichanga, yet not so loud you feel like a mariachi band is playing live beside your table They serve the chips and salsa super fast Now, I like to feast on the chips and salsa like a starved wild animal (you know you do, too, at least I’m honest!) but don’t get me wrong, if the salsa isn’t good I just know the rest of the meal will be
The menu is torture Try to choose between home-made carne asada tacos, the family recipe, hand-made tamales, chile relleno, or heir signature soups that throw down. One thing’s for sure, you’re going to get a huge portion and hopefully if you don’t finish it, that means Ricardo’s leftovers for lunch he next day! (I always eat everything, I know nothing of ortion control, so that’s kind of bittersweet )
o yeah, the food’s delicious, the service is spectacular and he ambiance rocks. I found out they do catering and it made me think twice about not having my wedding in Oregon so they could cater But what I really love about Ricardo’s is Ricardo himself! I first met him while he was promoting other local small businesses He was even helping his competition That’s the kind of guy he is I got to meet his family when they taught me how to make their tamales Within seconds I totally felt like part of the family. And, there’s no end to how Ricardo works to better the San Juan Capistrano community, so you know your dollars spent at his restaurant aren’t just going to his pockets, but back to our community.
I don’t care if you have a current favorite Mexican spot, you need to try Ricardo’s (located at 32082 Camino Capistrano in San Juan Capistrano) Just don’t get mad at me if you love it so much you have to go back every week!
Willa Porter - Trotting Along Since the 1980s
Willa Porter is an 82-year-old mother of five who has been running in the Dana Point Turkey Trot since her move to Dana Point in 1989 Although she wasn’t much of an athlete in her younger years, she says that her five sons moving out of the house pushed her to get out and exercise more She became an avid lover of running and competed in various Southern California marathons over the years The Turkey Trot quickly became her favorite race due to the beautiful weather and family atmosphere. When she first began the Trot there was only a 10k race offered, which she handled with ease. She now competes in the 5k race, and continues to win in her age group each year She claims she prefers the shorter race, allowing her to head home early and prepare a Thanksgiving feast for her family She’s carried the tradition on by bringing all her grandkids to the race each year.
