The other day, my law clerk placed a document on my desk that we both knew upon cursory review would prove highly problematic for our client It was a will drafted by an attorney that had been executed without witnesses, only a notary Which means that in spite of the best intentions of the individual who wanted to clearly outline his last wishes , w, the resulting document was worthless.
A will has to be witnessed by two disinterested parties, so a notarized will is without benefit at the courthouse or anyplace else, with perhaps the exception of family reunions In this case, what the family believed to be a valid will had been sitting in a filing cabinet for nearly two decades. After their patriarch passed away, his heirs discovered that the document was of no benefit in terms of executing their father's final wishes
Notarized signatures on wills are not the only witness mistakes that show up on documents - in their rush to get instruments signed and put in force before Dad and Mom leave for Maui, families often ask individuals who are completely inappropriate to witness their signings. Consider the document which left all the writer's personal property to her neighbor who had been her bridge partner for 40 years The problem? The will ended up being "abridged" because the partner was one of the two persons who witnessed the drafting of the document
The problem? Persons who are beneficiaries of an instrument (i.e. a will or a trust) should not be a witness to the execution of the documents.
Most attorneys who focus on estate planning understand that the people called on to be the witnesses to the signing of any of the documents involved should also meet another range of common sense guidelines. In general, it is a good idea to think of how those persons who are going to confirm the signing of any instrument would look answering a judge's questions. In other words, would the witness make a good witness?
In certain other instances, for example, when a document is being executed for an elderly person and one of the beneficiaries is a care giver of the person signing the instrument, the law may require a specialized certificate from a lawyer besides the attorney who drafted the instrument Without the certificate, the instrument may be worthless
Each of the instances of wrong witness choice typically leads to the same wrong result: the clients will be left in a situation where the document drafted has no effect: it becomes a car without an engine or a boat without a sail.
The alternative, seek the guidance of a professional who limits her or his practice to estate planning , disclose to that professional any relationships you have with the witnesses you intend to use with your instruments, and don't argue when the professional prompts you to use someone you may have never met before as the witnesses to your execution It will be for your own good





Question: How do I handle the situation when the visiting parent refuses to talk to the custodial parent? Putting all the pressure on the child to ask –“Mom he asked if I can go visit…” or “Mom he asked if I can go here…” - Beth, Mission Viejo

Answer: Without knowing the dynamics of your marriage, divorce and age of children, A simple technique to try is write a letter (since he won't speak to you) to your co-parent letting him know you want to work with him on minimizing the stress on the children and have a "working alliance" to communicate. He can text or email if he is still hurting or retaliating from the divorce if he needs to communicate requests or better yet, ask him what he would be most comfortable using with the exception of the children Let your child's father know that you will be giving permission and the words to your child to respond to his requests by directing him back to you. An age appropriate and respectful response might be, "could you please ask mom for me." Just an afterthought, dad might feel like the child himself by having to ask your permission. Working toward a Parental Alliance may look like giving him a calendar of events so he can see for himself if anything is planned for the children ( and that can be updated on line too), and discuss some parameters ahead of time so there will be less need for confrontation The greatest gift you can give your child is a childhood free from adult conflicts This can also be a learning tool to teach your children about conflict resolution
Question: Is there such a thing as a “Healthy Divorce”?
Answer: The short answer is there is a “Healthier” way to divorce which can minimize the emotional, financial and energy the traditional court options offer A growing option nation wide consists of non-court, non-adversarial and a private process called Collaborative Divorce. When an individual first enrolls in Medicare Part B, they have 12 months to obtain an Initial Preventive Physical Examination (IPPE) This exam is a onetime preventative visit and not to be confused with an Annual Wellness Visit that follows annually or a “routine physical check- up” that some seniors may receive every year or two
The passage of the Affordable Care Act (or what some of you refer to as “Obamacare”) made a number of improvements to Medicare coverage preventative services and it removed the copayments and deductibles that used to be a part these services and added coverage of new benefits such as an Annual Wellness Visit and HIV screening.
When you prepare for your Initial Preventative Physical Examination, your healthcare provider will want to see your medical records (if they haven’t been seeing your prior to this IPPE visit) and your immunization records They will want to know as much as you do about your family health history and see a list of all medications and supplements that you’re currently taking, the dosage and how often
Following this portion of your exam, the IPPE will have 7 different components These components enable the Medicare provider to identify risk factors associated with various diseases and detect any disease that exists in order to begin treating it. Other components involve education and counseling, end of life planning, a physical examination and referrals to other preventative services covered under the Part B portion of Medicare (Such as bone mass measurement, colorectal cancer screening, cardiovascular blood tests, diabetes screening and so on)
The Annual Wellness Visit (AWV) offers “Personalized Prevention Plan Services” (PPPS) and it covers nine key elements, many similar to what a Medicare beneficiary receives in their Initial Preventative Physical Examination. The AWV is a preventative wellness visit and not a “routine physical check-up”. In addition to the AWV, many vaccinations are also covered at no cost as well by Medicare; annual flu, pneumonia and hepatitis B. The shingles vaccine is covered, but you’ll pay a co-pay for the vaccination (This falls under your Part D Medicare coverage) and depending on what Medicare Supplemental or Advantage plan you have; a possible co-pay to the provider administering the vaccine

Corazón is the small group behind the huge impact of people helping small Mexican communities like Valle de las Palmas They’re not about giving hand-outs, they give hand-ups The message is simple: if your community is in need of their service they require one thing from you In order for them to help you, you must help your own neighbor first And, in addition to building new homes, they provide scholarships, school uniforms for children, medical care, support, job training and classes in adult education

1. What’s the difference between what a doc tor of podiatr y does and what a pedicurist does?


Ivar Roth, DPM: There is a large gap in care between what a pedicurist does and a doctor of podiatry does. In the state of California a pedicurist cannot use a scalpel or any instrument that can result in the cutting or penetrating of the skin or work on any foot or toes that have an infection At least 50% of the population has a fungus nail infection or fungus infection of the feet War ts, (which look like corns) are also a virus infection of the skin. While a podiatrist can work on these conditions, the average person who seeks these services doesn’t want to make a doctor visit to have these problems taken care of This is partly due to the fact that many of these services aren’t covered under insurance and this would be a very expensive way to handle corns, callouses or fungus nails. Add to this the HMO environment and a doctor just does not have the time to effectively treat these problems because they are time consuming and thus a less than effective job is performed
2. If someone wants a pedicure, but has these common infections or viruses, what’s left for them to do?
Dr. Roth: Enter what I call the podiacuristTM. This means becoming a Californian licensed pedicurist who has trained under me to develop their professional podiatry skills I teach them to use a scalpel and other instruments to deal with infected or hardened nails and thick callouses Think dental hygienist for the feet The podiacuristTM is an employee of my podiatry office and can provide these services under my license To ensure the highest quality of work possible, all work is checked by a podiatrist at the conclusion of the service.
3. Is there anything like this in existence?
Dr. Roth: Not until now This is a new concept that I’ve developed after dreaming and planning for over 20 years This is a self-realization that premium foot services are not offered anywhere, let alone in a safe, clean and supervised environment performed by specially trained personnel (pictured are Brian and Gina who have a combined 30 years experience).

Laguna Beach is famous for its temperate air and legendary waves, but entrepreneur Tyler Russell hopes the seaside town will become equally well known for its airwaves
Russell, a 23-year-old Chapman University graduate, launched Laguna’s only FM station KX 93.5 in October 2012 playing generational alternative rock and presenting informative progressive talk
“The Friendship Show,” part of the station’s programming, is an hour-long broadcast showcasing thought-provoking individuals who impact the community. The entertaining and enlightening show is hosted by Friendship Shelter’s executive director, Dawn Price; director of programs, Mark Miller; and journalist and educator Scott Hays



The Friendship Shelter remains one of Laguna Beach’s oldest and most respected human services organizations; it houses approximately 30 residents helping homeess locals achieve self-sufficiency.
“From time to time we will talk about things that are specifically going on in our organization, but really the Show is trying to address larger issues,” said Miller.
Saturday mornings from 9-10 a m the beachside station buzzes as the Friendship Show connects the community with conversation
Hays, who co-produced Shelter Me, a benefit CD and documentary to help raise awareness about the homeless, says he was honored when Price and Miller invited him to serve as cohost of the show “I jumped at the opportunity to work again with Friendship Shelter, and to give back to the community,” said Hays
Weekly, this trio of Laguna Beach residents showcase soulful music and inspirational individuals while examining important social issues shaping and changing the local landscape.
Recent guests range from art forger Tony Tetro and famed jazz-blues musician Rabbi Blue to physician-author Dr Jacques Souadjian, M D and the iconic singer-songwriters of local band Honk
“If somebody fascinates us, we’ll figure out a way to bring them on the show,” said Price
One of the many benefits of a local public radio station is that it gives a voice to those who often go unheard
“I enjoy the conversations and the opportunity to shine a light on really interesting stuff that people don’t know about that’s in their own community,” said Price, “It’s always an interesting hour.”
KX 93.5 FM is a non-profit station supported solely by fundraising efforts, donations, and sponsorships The non-commercial, low-power radio station’s signal stretches five square miles and can also be heard online covering community events, news, traffic, and surf conditions
“Laguna Beach is a really unique community and the Friendship Show is so aptly named because friendships and community are so critical to this town and our organization,” said Price.
Together with Russell, these three friends continue breaking barriers in broadcasting and using the airwaves to connect the community
