THE NIGHTMARE YOU MAY BE LEAVING YOUR FAMILY AND WHAT YOU CAN DO TO AVOID IT

In California, you generally have the following two options regarding your estate: (1) you let the government decide what
happens to your assets (in which case, costly probate is usually involved); or (2) you take full control of what happens to your assets (and avoid costly probate entirely).
In the following, I address the most common questions that I receive as an estate planning lawyer.
How much is probate and why do I want to avoid it?
The cost of probate is set by statute in California under Probate code § 10810 and is based on your gross estate (which could equate to a small fortune). This statutory fee is payable to your personal representative as well as to the attorney. Aside from the actual cost of probate, the length of time to administer and close probate usually takes over a year but can take multiple years in some circumstances.
If you have no plan, you’ll have no say and the government will decide on your behalf
Failure to plan means your estate will default to the California plan under the Probate Code. Even if you had certain independent authority to administer a decedent’s estate, the court must approve certain transactions including the estate’s final distribution.
Said differently, your family will be at the mercy of the court.
I have a will. Isn’t that enough?
Most people believe a will is the answer, but unfortunately a will alone does not avoid probate. A will allows you to control how your property is distributed but the will still needs to be probated. Another important aspect about wills you should keep in mind, is that wills are only effective after your death. If you become incapacitated, your will provides no protection with respect to your financial affairs or medical decisions.
So, in addition to a will, what else do you recommend?
A trust. Even with a small estate, a trust helps you avoid the headache and non-confidential process of probate. A trust allows for planning during incapacity and gives immediate control of your trust assets to your successor trustee. A trust also allows you to maintain control over your property and distribution to your
family. Families with young children may not want their children to inherit their share of the estate at 18. A trust allows parents to control the distribution to their respective spouse or children for a sum of years or age of the beneficiary.

Getting a trust set up can be completed in just a few short weeks and requires very little time on your part but there are a few traps you will want to avoid when considering your options.

What’s Not Covered by Medicare Part A & B
Original Medicare doesn’t cover everything. Some of the items and services Original Medicare doesn’t cover include long term care; most dental care/dentures; routine eye exams and eyeglasses/contacts; acupuncture; routine hearing tests and hearing aids.
The good news is that there are now options for Medicare supplements (which pay second after Medicare pays first and allow you to go to any doctor that accepts Medicare without a referral) that do! There are Medicare supplements that have additional benefits to cover routine vision exams and give you an eyewear allowance as well as a routine hearing test benefit and set low copays on hearing aids and the fitting exams as well as routine acupuncture and chiropractic.
Some other additional benefits include; free fitness memberships to gyms such as LA Fitness, 24 Hour Fitness, the YMCA and more, and a quarterly amount of money to spend on over the counter medications, vitamins, oral and eye care products, etc.
If you’re already on Medicare with a Medicare supplement you can change to this type of plan anytime in the year (unbeknownst to most). However, you do have to answer underwriting questions so if your health isn’t good, you may be declined. But the good news is that you can change to one of these plans using the birthday rule which guarantees your acceptance as long as you apply during the month of your birthday or within the two months following. My experience has been that the premiums for these plans are competitive to what someone is currently paying for their Medicare supplement that doesn’t have all of these “bells and whistles.”
THE VALUE OF A CPA FINANCIAL ADVISOR
Some things in life are better together. Peanut butter is great, but better with jelly. S’mores are wonderful, but somehow tastier when eaten next to a campfire. Along with this good news for Medicare supplements, there is also the good news that while you do live in a very expensive area and pay a lot for many necessities because of this, you don’t need to pay a premium for a Medicare supplement and a Medicare RX plan because there are Medicare Advantage plans in Orange County that have zero monthly premium and they also include your Medicare RX coverage. (These plans are also referred to as Part C-and you must still pay your Medicare Part B premium)
These plans are offered by private insurance companies that have contracts with Medicare to provide you with your Medicare Part A & B benefits, and while doing so they go over and above what Original Medicare will pay. They have no deductible, very few medical copays, low out of pocket maximums (majority are $899 or less in 2022). Many people I meet with are also surprised at the number of additional benefits these plans offer. All of the previously mentioned additional benefits and much more including dental coverage. In Orange County the only good options in my opinion are the HMO plans, there is too much out of pocket for the very few PPO offerings. I find the majority of OC physicians are in participation with these HMO plans, the key is to making sure all of your physicians are in the same network that participates with the HMO plan. That’s an important part of my job when helping new clients. Sometimes giving up a physician that you rarely see (or didn’t care much for anyway) is necessary for a Medicare Advantage plan to work for you. Either way, I feel the good news in 2022 is that there are great options for all Medicare beneficiaries, and I’m here to help explain them to you.

There are three main types of skin cancer: basal cell carcinoma, squamous cell carcinoma, and melanoma. Because each has many different appearances, it is important to know the early warning signs.
Look especially for change of any kind. Do not ignore a suspicious spot simply because it does not hurt. Skin cancers may be painless, but dangerous all the same. If you notice one or more of the warning signs, see a board-certified dermatologist right away, preferably one who specializes in diseases of the skin.
ACTINIC KERATOSIS
An actinic keratosis (AK) is a crusty, scaly growth caused by damage from exposure to ultraviolet (UV) radiation. An AK is considered a precancer because if left alone, it could develop into a skin cancer. AKs are the product of a lifetime accumulation of UV damage and typically appear on areas most commonly exposed sun, such as the backs of the hands, forearms, face, neck, and scalp.
SQUAMOUS CELL CARCINOMA
Squamous cell carcinoma (SCC) is an uncontrolled growth of abnormal cells arising in the epidermis, the skin’s outermost layer. SCCs often look like scaly red patches, crusty bumps, warts, or elevated growths with a central depression. SCCs may appear suddenly and some forms are tender to touch. They can become disfiguring and sometimes deadly if allowed to grow. More than 1 million cases of SCC are diagnosed each year in the U.S., which translates to about 115 cases diagnosed every hour. Incidence has increased by 200 percent in the past three decades in the U.S., and more than 15,000 Americans die each year from this type of skin cancer.
BASAL CELL CARCINOMA
Basal cell carcinoma (BCC) is the most frequently occurring form of all cancers, with more than 4 million cases of diagnosed in the U.S. each year. BCCs may look like open sores, red patches, pink growths, shiny bumps, or scars. Any skin lesion that doesn’t heal, or bleeds with even gentle trauma, such as drying with a towel, is concerning for a BCC.
MELANOMA
Melanoma is a very dangerous form of skin cancer. Melanoma is caused mainly by intense, occasional UV exposure (frequently leading to sunburn), especially in those who are genetically predisposed to the disease. An estimated 178,560 cases of melanoma are diagnosed in the U.S. each year and is fatal for an estimated 9,320 of these patients. Fortunately, if melanoma is recognized and treated early, it is almost always curable.
WHAT PATIENTS NEED TO KNOW
1. Everyone needs to perform a self-skin exam once a month.
2. Melanoma can appear anywhere on the skin, including the palms/soles, under your nails, and places...for most, have never seen the light of day (genitalia). For this reason, it is important to look everywhere. Lock the bathroom door, get out a hand mirror, and check, it could save your life.
3. What to look for: ABCDEs, and an ugly duckling
A - Asymmetry: If I draw a line down the middle, do the sides match?
B - Border: Is there a nice crisp border, or does the mole melt into the surrounding skin?
C - Color: Moles should be one color, one shade of brown. Is there a variety of shades or additional colors, such as black, red, white, or blue?
D - Diameter: Any mole larger than 6mm, ie the head of a pencil eraser, has a higher risk of becoming melanoma.
E - Evolution: Has it changed?
F - The Ugly Duckling Sign: Most people have a “signature mole,” their own personal mole appearance and architecture. Is there a mole that seems different from all the others?
4. Everyone needs a full body skin exam by a board-certified dermatologist once a year, more frequently if you have a family history of skin cancer, a personal history of skin cancer, or live in an area with substantial sunshine.

Perkins Custom Coatings has been installing SpartaFlex on OC garage floors for nearly 14 years and has completed over 9,000 floors during that period of time. Its CEO and owner, Paul Frankel is considered by many to be the most knowledgeable contractor in the local market. “Unlike many of our competitors, we strive to do an onsite assessment including a moisture test for every floor coating project we install and instead of using the ‘one size fits all’ approach, we develop a coating solution that we believe will last for decades not just for a few years.”
Perkins uses only the most advanced surface preparation methods available and will either diamond grind or shot blast every floor that he installs. Old, failing, yellowed ep-
oxy coatings can also be removed during this same process. “Despite the fact that Coatings Industry requires concrete to at least be diamond ground before installing a new coating system, many of my competitors will install their coatings right over raw or pressure washed concrete just to save a few bucks - I will never do that” says Paul.
Perkins also is known for its professional and unique approach to repairing concrete cracks. “Anyone can slap some crack repair paste to cosmetically fix a crack” says Paul. A year later, when the concrete moves again and damages their brand new floor coating, the devastated homeowner will learn that this damage is not covered by the typical Epoxy warranty. “We are the only company that I know of that uses a ‘structural crack repair’ technique to fix cracks. The process is so effective we can offer our customers a warranty that can cover future damage from cracks!” says Paul.
After the surface prep is completed, a very effective moisture control primer is applied to the concrete. “This is extremely important” says Paul because for many homes built in Socal before 2005, elevated moisture vapor levels in the garage concrete can have a detrimental impact on floor coatings. Paul does a fast and non-destructive moisture test for every one of the pre-2005 homes he visits and develops a unique installation plan for each home. For newer homes, Paul and his crew can use a basic primer that dries a bit faster allowing installation of a garage floor in as little as one day!
The color chips that give the Perkins floor its legendary appearance are sandwiched between this primer and finish coat. Perkins carries the widest selection of colors and sizes in the market and uses a ‘full chip broadcast’, not a partial sprinkling of chips like many of its competitors. “The full chip broadcast gives the floor a consistent appearance and makes the floor much more durable and helps hide dirt better than the partial broadcast finish” says Paul.
Finally, Perkins installs the SpartaFlex polyaspartic finish coat and the finished garage comes to life. “Epoxy & SpartaFlex floor coatings are virtually identical in appearance when they are first installed” says Paul. “However, when you will really begin to appreciate a SpartaFlex floor is a few months down the road when you would typically start to see problems develop with an Epoxy floor. If there was a better material on the market, I would be selling it, but there isn’t and that is why we love selling SpartaFlex.”

There’s a popular Christmas carol recorded by Andy Williams, back in 1963, called “It’s the Most Wonderful Time of the Year.” Now, the holiday season may have drawn to a close, but in many places (especially in the Southwest) the most wonderful time of the year is here. Temperate weather and a rather robust list of seasonal offerings make Taos, New Mexico the place to be as colder months give way to spring. In March, outdoor activities like skiing, snowshoeing or relaxing in a local hot springs continue to top the charts. But for families visiting the area, outdoor recreation is just the tip of the iceberg. Ballooning, golf, tennis - landmark sites, destination dining, shopping and art galleries - even guided tours on horseback are all accessible from Taos’ historical downtown.

In the early evening, my husband and I headed to the Anaconda Bar for a post-adventure aperitif - its libations and custom craft cocktails made a quick date night possible even with the kids in tow. Aptly named for the giant sculpture winding its way through the venue, the upscale lounge offers live entertainment, seasonal patio seating and a lovely light refreshment menu (the Green Chile Smash Burger on brioche was perfect for sharingyes, you are sensing a theme - Green chile appears to be a uniquely New Mexico menu ingredient).
While in town for a long weekend, we also took to the road a bit - stretching all the way from Santa Fe, the “High Road to Taos” winds its way through the scenic Sangre de Cristo Mountains - with scores of interesting historic sites (think Spanish colonial towns and Pueblo Indian villages) and vistas along the way - passing through vast valleys, verdant forests and high deserts. Nestled just to the northwest of town is the otherworldly-looking Earthships - a community of 70-odd sustainable homes made entirely from recycled materials.
A particular highlight of the trip was the “pedestrian thrills” atop the steel-deck Rio Grande Gorge Bridge - an absolutely phenomenal feat of engineering with epic views of the yawning chasm and wild waters. I am terribly afraid of heights - so suffice to say it was quite outside my comfort zone to walk along the “sidewalk” designed with tourists in mind and step out onto the little “porches” that jut out over the void with only a chest-high guardrail between me and the Rio Grande 650 feet below.
Take the kids to a leisurely brunch at De La Tierra and give everyone the chance to sleep in a bit - or opt for a tasty grab + go breakfast so you can hit first chair on the mountain or embark on an early walking tour. Whatever you choose to do - listen to Andy Williams, and take advantage of the most wonderful time of the year in Taos.

The Key to your Child’s Success! Summer Reading
Summer reading may not be a priority for children, yet it’s important to make it one. Why? Summer reading is critical to a child’s ability to retain information learned, and grow in knowledge and critical thinking skills, in order to maintain literacy skills learned throughout the school year.
Reading, in general, is highly effective at building up a child’s knowledge in a vast amount of subject areas including English, math, science, and history. Studies have discovered a greater intellectual progress in vocabulary, spelling, and math when children read more than what is required at school. Research has further credited reading as a strong tool for growing comprehension skills and gaining a greater understanding of the world. Children who read with consistency throughout the summer are able to
stay ahead of their classmates during the school year.
The selection of books we have curated for summer reading are intentionally different from books children might read during the school year. Some are fanciful or fantasy (dogs that accompany their kid-owners to school, for example), most have pictures (illustrations and infographics, or graphic novels); and most can be read in short fragments, for example in the car or during thirty-minute reading bursts – which work especially well in building capacity in reluctant readers. We hope you will enjoy one or more of these books – or others you find while browsing library stacks or visiting your local book store.

It’s not really possible to perfectly sum up a Klassen book - it’s truly something one needs to experience to fully appreciate.
