4.1 Laws and regulations The traditional villages of Himara Municipality have a significant cultural and historical value. These settlements should be protected and developed in a sustainable way. Certain regulations are drafted for the protection and the future development of these important assets. These documents are the basis regulating policies for the territorial development in these areas. They define the allowed interventions as well as conditions for development. Some of these areas are more specifically regulated than the other ones, according to the level of importance. These laws/regulations are: 1. Cultural Heritage Laws: • Law Nr. 90 48, date 07.04.2003 “For Culture Heritage”, amended • Law Nr. 27/2018 27.06.2018 “For Cultural Heritage and Museums” 2. Decision of Council of Ministers (DCM) for the designation of Historic Centres Since January 2016, four villages in Himara Municipality are designated as protected historic centres. These villages are Himara village, Dhërmi, Vuno and Qeparo village. These villages are protected historic centres and as such, there are certain rules to be followed. • D.C.M Nr.28, date 20.01.2016 “On the Declaration of the Historic Center of Himara and the adoption of the regulation for the administration of the buffer zone around”. • D.C.M. Nr.29, date 20.01.2016 “On the Declaration of the Historic Center of Dhërmi and the adoption of the regulation for the administration of the buffer zone around”. • D.C.M. Nr.30, date 20.01.2016 “On the Declaration of the Historic Center of Vuno and the adoption of the regulation for the administration of the buffer zone around”. • D.C.M. Nr.636, date 7.9.2016 “On the Declaration of the Historic Center of Qeparo and the adoption of the regulation for the administration of the buffer zone around”. 3. Himara General Local Plan Approved form the National Territorial Council on 16.10.2017 Decision Nr.02 These laws envision rules and development policies that need to be followed. Developments and new construction are more restricted in some areas, depending on their protection status. Categories of Protection Status:

1• Monuments of 1st or 2nd Category 2• Inside a Historic Centre or Buffer zone (in Dhërmi, Vuno, Himara, Qeparo) 3• A building that doesn’t have Cultural Heritage Status (does not fall under any of the categories above) but is part of a traditional village.

1 What is a Cultural Monument? “Cultural monument”, is the object or the construction of historical-cultural values that is protected by the state1. Division of Monuments according to the categories

• “Cultural Monument of the 1-st Category” is the construction of special

importance for the cultural heritage which is preserved in the entirety of their architectural and technical components1. 1. Compositional and architectural components cannot be changed. 2. Volume composition, architectural treatment of the outer and inner faces as well as the functional solutions (plan arrangements) can’t be changed, 3. Architectural and technical components (construction techniques and materials) cannot be changed 4. The yards, the fences, the outer gate and the supporting structures are an organic part of the monuments and as such, are prone to the same rules. 5. When a part of the monument has been damaged transformed or is missing, complementary interventions can be undertaken, in accordance with the initial state. 6. For Monuments outside the Protected Centres, it is not allowed to build new structures in the properties in the borders of Culture Monuments. 7. For Monuments outside the Protected Centres, it is not allowed to build new structures in the properties in the borders of Culture Monuments. 8. Each case should be analyzed from the National Restoration Council2.

• “Cultural Monument of the 2-nd Category” 1. Second category monuments are buildings with cultural-historic values, mainly as an integral part of the urban-architectural ensemble, which are part of the urban fabric of the village along with their own architectural values. 2. Second Category monuments are kept intact in terms of their initial volumes and architectural treatment both inner and outer in cases when it is necessary to preserve typical environments and elements such as wood carvings, gypsum work, ornaments or valuable architectural furnishings. 3. In the inner parts of second category monuments it is allowed to change the compositional structure as well as the usage of contemporary techniques, without damaging the outer composition2.

2 What is a Historical Centre? “Historical Centre” is a distinct urban territory, part of a city/village, representative of a historical period or of a development city stage, consisting of elements of intangible cultural heritage which, apart from the urban structure, include architectural, environmental, cultural, historical elements, landscapes within and around the area, archaeological evidence, panoramas, urban profiles, prospects and the points of the reference. Historical Centres are important areas of historical and cultural value, and as such, they are protected from the law. Every intervention that will be done in Historical Centres should follow the regulations provided in the Decision of Council of Ministers and be approved from the National Territorial Council1. 3 What is a Buffer Zone? “Buffer zone” is a defined territory with clear boundaries outside the historical centre, the architectural / urban ensemble, the architectural complex and the cultural monument, whose role is the protection of the values of these cultural properties, and the provision of the light, perspective, cultural landscaping, viewing, enjoying and using by the public1.

4.3 Historic Centres Himara Fshat The Historic Centre of Himara city is confined from the southern, western and northern part from the surrounding walls of the Himara Castle and it is the area with significant historic and architectural values, documenting the development path of this settlement since antiquity up to the present. It contains antique monuments such as Himara Castle, whose beginnings date back to the IV-III B.C. centuries, monuments of worship, such as the Church of St. Sergius and Bacchu, which must belong to the Episcopalian centre of Himara, a series of other post-Byzantine churches as well as a series of dwellings with a great variety and a cobblestoned path network. The Borders of the Historic Centre of Himara, and the protected area around are illustrated in the zoning map below.

Dhërmi The Historic Centre also includes the green areas inside of its boundaries. The historical centre of Dhërmi is comprised of two zones: • Zone I which includes buildings in both sides of the National road, at the entrance of Dhërmi village; • Zone II which includes old part of Dhërmi and extends in the north-eastern direction, up to the ruins of the Monastery of Panaisë, and extends up to the National road in the south-western direction.

4.3 Historic Centres Vuno The Historic Center of Vuno Village is comprised in two zones: • Zone I which includes the buildings on both sides of the national road (mainly Old Vuno); • Zone II which includes the section located below the national road that consists of the Church of St. Spiridon ensemble together with the school and the Church of St. Mehill. In these areas there are included a considerable number of dwellings with a varied typology and a cobblestone road network, sometimes developed in gradients on the steep terrain sometimes with tunnel passageways under village dwellings.

Qeparo The historic center of the village of Qeparo (old village) includes all the existing buildings and consists of a compact traditional composition that develops around the church and the central square. The built ensemble represents interesting typologies, especially in the formation of urban spaces, and includes a considerable number of dwellings with a varied typology among which a dwelling of 1st category cultural monument (Minella Gjika’s house) and a cobblestone road network, sometimes developed in gradients on the steep terrain and sometimes with tunnel passageways under village dwellings. The buildings are generally 2-storey and are constructed with stone wall.

4.3 Historic Centres Allowed Interventions in the Historic Centre: • The restoring and revitalizing interventions in the Historic Centre of as well as in monuments of both categories will hold the purpose of converting the historic centre in an important touristic centre of rural and familiar character. In order to accomplish this scope, studies on the restoring and revitalizing intervention methods are conducted for the Historic Centre as well as for the rehabilitation of its special areas. In order to preserve the urban-architectural values of the Historic Centre, inside this area it is only permitted: • Systematic preservative interventions, restoring and maintenance in the Historic Centre, as well as in the monuments of both categories, which lean on the criteria for the preservation and restoration as specified in the national and international normative acts of the field, implementable in our country as well. • Restoration interventions which aim at the preservation of urban-architectural spaces, the traditional path network both in terms of technical aspects and composition, keeping intact the land configuration of the urban fabric (solid vs void ratio) as well as traditional vegetation; • surveys for the rehabilitation of the particular parts, regarding the structures which being built, damage the values and compositional unity of the Historic Centre. • surveys that define the structures where preservation and restoration work is going to be done, in order to increase their values, objects in state of decay or inappropriate for the function they hold that affect the urban fabric of the area where it is allowed to intervene as well as the green plots. • Rehabilitation and preservation or restoration interventions in a series of structures in the Historic Centre which are in state of decay, in order to prevent their further degradation. In cases that the ruins are preserved and represent architectural, compositional values, but affect the ensemble of objects they are part of, reconstruction process can be done on the same volume of the existing structure (circumferential walls), with the main aim of preservation, as much as possible, of the authentic visible inner and outer elements, based on the clear graphic, photographic, based on the typology, architectural treatment, and the original construction technique. In cases that the ruins are less than 3 meters, they must be strengthened and can be re-erected in special occasions, in accordance with the principles mentioned above. The Projects for these interventions must be analyzed and approved by the Scientific Council as well as the National Restoration Council. • In cases of natural disasters, such as dam collapses or combustions of valuable cultural heritage objects, the reconstruction can be done on the existing structures, in accordance with the compositional and architectonic arrangement of the state prior to the combustion, based on the clear graphic documentation. • The retreading and reconstructions which are integrated in the architectural ensemble of the area, in accordance with the composition and treatment of the outer facades, keeping the maximum height intact. • In the Historical Centre it is not allowed to build new structures with the exception of underground engineering systems and reconstructions also mentioned above. • Projects for th adaptation, reconstructions or new additions are approved from the National Restoration Council.

The Buffer zone and its boundaries The buffer zone consists of: • Buffer zone 1 • Buffer zone 2 Buffer zone 1 contains a series of dwellings with architectural values as well as the village’s typical path network. Buffer zone 2 is an area with structured vegetation, which consists of an ancient plot, planted with olive trees. The buffer zone’s boundaries are defined with geographical coordinates as well as in the zoning map of each of the villages.

Allowed Interventions in the buffer zone • In the buffer zone the path network’s composition is preserved • The environmental values are preserved, keeping the land configuration as well as the variety of the traditional vegetation. • It is not allowed to change the existing path network. Interventions must preserve the traditional techniques and materials. • Restorations, adaptations and reconstructions are done in order to increase the values of the structures as well as improve the living conditions, which must be in accordance with the architectural and urban character of the ensemble. • The maximum height of floor number must be equal to the average floor number of the adjacent buildings. However, not more than 2 storeys-6.5 m up to the roof cornice. • The architectonic composition of the buildings must be adapted to the architectonic and ornamental character of the traditional architecture, using stylizations(small interpretations) of its morphological, compositional, volume and color features. • The projects for adaptation, reconstruction as well as new buildings are approved by the National Council of Restoration. The survey, design and implementation of work in the Historic Centre as well as specific monuments. • The Restoration projects and culture monument’s restoration are done by specialized governmental institutions and licensed subjects. The projects are evaluated in the Scientific Council of Institute of Culture Monuments and approved by the National Restoration Council. • The implementation of the previous work is done by the Regional Directorate of the National Culture Vlorë or by licensed subjects in restoration under the surveillance of the supervisor, appointed by the Institute of Culture Monuments. • Studies and projects for the intervention on the street network and underground infrastructure are drafted by the Institute of Culture Monuments, Regional Directorate of National Culture Vlorë in collaboration with Himara municipality or from licensed subjects in restoration field. Exploitation of monuments • The Culture Monuments are part of the contemporary environment. They are utilized, according to each specific case, for the functions they were initially built for as well as for other functions, provided that this new function does not affect the values for which the monument is protected. • The exploitation of culture monuments, for purposes other than the one they were initially built for, can be done only after it is approved in the National Restoration Council.

4.4 How to get Permission • If your house is a Culture Monument or located in one of the Historic Centres, follow Case A, and then Case B • If your house is not a Culture Monument or in a Protected Centre, skip to Case B directly

Case A: Protected centres & Culture Monuments In Protected Centers and in cases of buildings that are Culture Monuments (either first or second category) the permission procedures in the villages go through two steps: • Firstly, it is required to apply for permission in the Institute of Culture Monuments. To do so, you need to submit the full documents to the National Directorate of Culture Monuments (DRKK Vlorë). After it is inspected from the DRKK, the documents are sent to the Institute of Culture Monument, the Technical and Scientific Secretariat and then to the National Territorial Council (KKR). Only after being granted the permission • From the Institute of culture Monuments, you can follow the process and apply for permission in the Municipality (list of documents to apply for permission can be found in the next page). • After completing the first step, the process continues by applying for permission in the Municipality.

In case of Culture Monuments or Historic Centres, before initiating the procedures of application, it is advisable to go to the Regional Directorate of Culture Monuments Office (DRKK) in Vlora. There, you will find all the necessary information regarding the application procedures. The project should be drafted by an architect with a license in restoration work The Project should follow the restrictions and rules provided in the Albanian Restoration Card, The Law for Cultural Heritage (see page..) and the Decision of Council of Ministers (see page..) for Protected Historic Centres.

Documents that are required for permission: 1. The detailed project of restoration which should include detailed plans, façades, sections of the existing and proposed structure. This package should also contain the property titles of the structure. The package should be in three copies and should have the sign of the architect who drafted the project. 2. Technical Report; This report should contain a short description of the structure’s history, its current status, location, previous interventions (if any), existing state, as well as all envisioned interventions. These report should be accompanied with photographic evidence and signed by the architect who drafted the project. 3. Technical specifications. All materials used and interventions should be specified clearly. This document should be signed by the architect who drafted the project.

4. Project Report and Financial Projections / Estimation Costs of Construction, with clear and detailed budget items and signed by the architect.

4.3 How to get Permission Case B: Application at Municipality If the house is not a Monument and neither inside a protected historical centre, you should only apply for permission at the municipality. There are three types of categories if you want to make changes in your house

1• Interventions which do not require a permission, 2• Interventions which only require submitting a preliminary statement 3• Interventions which require a permission for reconstruction work

Interventions that do not require a preliminary statement or construction permission: • External Interventions for Repairing and Replacing Finishing • Interventions in the exterior of buildings, provided the original features are preserved • Refreshment /relaying of painting, plastering and coating of facades with materials that have the same characteristics and colors as existing ones; • Cleaning of the facades • Repair and replacement of windows and doors, shutters and shopfronts (including the use of different materials) without changing its features such as, shape, color, design and dimensions of open elements • Partial replacement of roof covering, without changing the shape, slope and characteristics of the coating; • Repairing and replacement of gutters and chimneys, even with different materials • Repairing of balconies, terraces, basements or protective barriers; • Placing window security bars • Placement of sun shades and mosquito nets; • Courtyard Arrangement • Repairing of existing surrounding walls / fences • Inner interventions: • Floor structure repairing and reconstruction; • Repairing and restoration of plaster and paint; • Repairing and renovation of doors and windows, including the placement of glass panels. • Interventions in sanitary facilities: • Repairing and replacement of sanitary and other plant facilities • Works for the elimination of architectural barriers and adaptation • Addition of structures for persons with disabilities; • The movement of soil, that is related in particular to the exercise of agricultural or livestock activities, including interventions in hydraulic farming plants.

Interventions that require preliminary statement

• Interventions of general maintenance when they bring changes in existing features, such as shapes and colours; • Interventions in the interiors such as: - reinforcement of internal bearing structures; - opening and closing of internal doors; • The construction, removal or alteration of internal (non-bearing) walls, for example, for toilet facilities; • The placement of new sanitary facilities and heating / cooling plants. • Construction of ramps for the adaptation of buildings for persons with disabilities; • Structures that are installed for instant and temporary needs, without foundations, with demountable materials, without using reinforced concrete structures, concrete blocks or masonry and concrete flat roofs, which are removed in any case, within a maximum period of 6-months; • The installation of solar, photo-voltaic panels, in service of buildings, in accordance with the restrictions that may arise from the legislation on the protection of cultural, historical or environmental heritage; • Public infrastructure and electronic communications facilities, that do not affect the house’s constructive system, do not change the use and size of infrastructure, as well as development conditions in the surrounding area; • The repair, maintenance and rehabilitation of irrigation, drainage and flood protection infrastructure systems; • Placement of sun tents and pergolas, in accordance with the guidelines mentioned above (see page..) • Interventions aimed at maintaining or enhancing energy efficiency and acoustics in an existing structure that does not affect the constructive system of the building (e.g., foundation-based interventions, retaining wall, etc.); • Demountable greenhouses, without foundation, serving to agricultural activities; • Placing advertisements on the exterior facades, for the purpose of promoting private economic activity

4.3 How to get Permission Case B: Application at Municipality 3

Interventions that require construction permission

• Interventions that result in the construction of new structures, including temporary ones, except for cases provided in this regulation: • Interventions that result in reconstruction, renovations and restoration leading to the creation of a wholly or partially different structure from the previous one and resulting in the addition of units and / or alteration of the construction volume, the surface of the building, the external appearance of the building, the use or the constructive system • Placement of advertising on the outer facades, with the purpose of promoting private economic activity.

Case B: Application at Municipality What Documents do I need to submit for each of the procedures? Documents needed for the Preliminary Statement: 1. An authorization from the owner to the applicant (usually architect). 2. A notarized statement from the owner / co-owner of the property regarding the type of work they are going to carry out. 3. The ownership title or a certificate from the office of property registration (ZRPP), acquired in the last three months from the time of the application. (the cadastral map and the accompanying files should be attached). If you don’t posses ownership titles, a certification from the Municipality and the village chief confirming that the you are the owner of that property is also accepted. 4. The technical project, which includes existing and intervention plans needed to be submitted, the technical report from the architect / designer and architect’s personal license (notarized), where the license category is in accordance with the type of interventions that will be made, within the validity period.

Case B: Application at Municipality In cases that you don’t posses ownership titles, a certification from the Municipality and the village chief confirming you are the owner of that property is also accepted. For more information, please consult the village chief or Municipality office.

Documents needed for Reconstruction Permission 1. The application form. 2. A notarized statement of the applicant’s authorization. 3. Certificate of ownership or a certification from the property office, with the map attached, acquired from the property registration office (in case you don’t posses ownership titles, a certification from the Municipality and village chief is enough). 4. A venture contract, bound between developers, landowners (or their proxy representative), and the constructor who will complete the work, which should be original and bound before the notary. 5. License of the construction company. The subject should be registered in the National Registration Centre. 6. A certification by the General Directorate of Local Taxes, that the construction company has paid the local taxes and fees. 7. A topographic survey in scale 1:2000 8. Building’s plan in 1:500 scale (drafted by a licensed surveyor). 9. Timeline of the construction period 10. Construction Cost Estimation drafted according to the referential prices 11. A certificate from OSHEE (the operator of the electricity distribution) that all the payments have been done. 12. The Architectural Project • A Technical Report, drafted by the architect with all the technical specifications. • The architect’s license with the respective categories of the construction work that will be carried out and within the respective time-frame. The designer should be registered in the National Registration Center. • A signed declaration of the architect, in which the architect declares his responsibility in drafting the project, in accordance to all the standards and regulations in power. • Copy of the insurance policy of the designer 13. The Construction Project : • Attached to the project: • The technical report including a description and respective calculations. • The architect’s license with the respective categories of the construction work that will be carried out and within the respective time-frame. The designer should be registered in the National Registration Center. • A signed declaration of the architect, in which the architect declares his responsibility in drafting the project, in accordance to all the standards and regulations in power. • Copy of the insurance policy of the designer 14. The thermal and ventilation project:: • The technical report including a description and respective calculations. • The architect’s license with the respective categories of the construction work that will be carried out and within the respective time-frame. The designer should be registered in the National Registration Center. • A signed declaration of the architect, in which the architect declares his responsibility in drafting the project, in accordance to all the standards and regulations in power. • Copy of the insurance policy of the designer 17. Fire Protection Project of the structure, approved by the Fire Protection Directorate (signed) Attached to the project: • The technical report including a description and respective calculations. • The architect’s license with the respective categories of the construction work that will be carried out and within the respective time-frame. The designer should be registered in the National Registration Center. • A signed declaration of the architect, in which the architect declares his responsibility in drafting the project, in accordance to all the standards and regulations in power. • Copy of the insurance policy of the designer. 18. Technical assistance from the Construction Institute (Instituti i Ndërtimit) for all type of constructions. 19. Proof of payment of the application fee. 20. Proof of payment of the infrastructure impact tax.

Local Resident

Check in the list provided in this documents what type of procedure you need to follow

If the interventions you will carry out don’t require permission, you don’t need to go through the other steps

For Reconstruction Permission or Preliminary Statement

Get a notarized letter that allows the architect to take actions in your behalf

Hire an Architect

Get an ownership certificate or a certification from the Municipality and the village chief

Check the documents needed for the type of your intervention Make sure you have a complete package (list is provided in this booklet)

If any document is lacking Municipality sends application back

Submit package to Municipality

Permission is granted
