Supporting greater community rights

By Mary Russell Residents of Carbondale are lucky because it is one of relatively few municipalities in Colorado that operate under home-rule charters.

Home rule offers citizens the opportunity to be somewhat self-governing, allowing them to propose local regulations, through charter amendments, to their elected officials.

In a statutory governmental subdivision of the State of Colorado, like Garfield County, citizens are not given any rights to petition for new laws or vote on whether to adopt new laws or regulations. We can participate in hearings and vote in elections, but there is nothing written in our state or county regulations requiring elected officials to act on our wishes.

To be fair, I should note that our county commissioners must abide by Dillon’s Rule, a law created by the Federal Government that does not allow local officials to create laws that do not align with state law. Our county government has no legal authority over corporations, when the activities conducted by the business has been legally preempted through state law.

Home Rule communities have a leg up over statutory communities, in that they can create laws that run counter to state regulations, albeit with a threat of being sued by the state. But communities like Lafayette, CO, for example, have put human and nature’s rights above corporate rights by banning fracking of oil and gas wells within its boundaries.

The 2016 Colorado Community Rights

Amendment will give all citizens in all municipalities across Colorado the same basic rights you currently hold in Carbondale — a Community Bill of Rights, meaning an inherent right to local self-government.

I, as a citizen of unincorporated Garfield County, want the right to work with my neighbors to say what I want for my community, along with the right to vote on important issues that affect that community.

I want my county commissioners to look at our charter and make decisions based on what the collective citizens of Garfield County have decided will best serve our needs.

Colorado’s Secretary of State just approved the language of the 2016 Community Rights Amendment. This is what will appear on the 2016 Colorado ballot, when we gain the 150,000 necessary signatures.

This is the official language as of today: “Shall there be an amendment to the Colorado constitution concerning a right to local self-government, and, in connection therewith, declaring that the people have an inherent right to local self-government in counties and municipalities, including the power to enact laws to establish and protect rights of natural persons, communities, and nature and the power to define or eliminate the rights and powers of corporations or business entities to prevent them from interfering with those rights; and declaring that such local laws are not subject to preemption or nullification by any federal, state, or international laws?”

to determine the validity of Longmont’s and Fort Collins’ bans on fracking, industry representatives said future drilling will come ever closer to municipal boundaries, and that lower prices are pushing them to use ever larger well pads. This amendment is one way a community in Colorado, like Carbondale, can dictate what they want to happen without having to spend endless time, effort and money fighting what they don’t want to happen in their community.

An example is Battlement Mesa, in western Garfield County, which is going to become one of the new industrial zones of Colorado when the gas rigs go up.

They’re not the first, and they won’t be the last, under state law, and there is nothing they or our county commissioners can do about it. Without this amendment to our state constitution, more neighborhoods and communities like Battlement Mesa will be fracked.

I’ve seen many passionate citizens fighting for social and environmental justice step away from their efforts to enact change, out of pure frustration and a lack of power when faced with the billion-dollar fossil fuel companies.

But some have kept fighting.

Activist Tim DeChristopher used civil disobedience to stop an illegal auction of mineral rights to industry representatives in Utah. And even though the government agreed that the auction itself was illegal, Tim was convicted of criminal acts and sentenced to two years in prison. His actions, and sentence, haven’t changed the system that continues to permit industry activities that aren’t healthy for our communities.

Changing the system by amending the laws that make Preemption and Dillon’s Rule the law of the land will.

All of us want the right to peaceful habitation, prosperity, clean air and clean water.

As we are learning, we don’t actually hold those rights — the State of Colorado does. County commissioners, elected by the citizens, may want to help us achieve those rights but their hands are tied. They can only do what the state tells them they can do.

There is a solution to this conundrum.

The solution is to amend the Colorado Constitution’s Bill of Rights, giving all municipalities, like Carbondale, the legal right to be self-governing. Does this sound like something you would support for all citizens of Colorado? If it is, then I need your help to get the 2016 Colorado Community Rights Amendment on the ballot.

Madame Secretary’s latest visit to Carbondale

By Barbara Dills Sopris Sun Correspondent Madeleine Albright, who recently visited Carbondale, is the first woman to have served as U.S. Secretary of State.

Nominated by President Bill Clinton in December of 1996, she was unanimously confirmed by a Senate vote of 99-0 and held the post from 1997 until 2001, the end of Clinton’s term. Prior to becoming Secretary of State, Albright served for four years as the U.S. Ambassador to the United Nations.

She currently is professor of International Relations at Georgetown University’s Walsh School of Foreign Service and serves as a director on the board of the Council on Foreign Relations.

Speaking on Dec. 21 at Thunder River Theatre, one of several turns as a guest of the Roaring Fork Cultural Council, she was interviewed by local resident Jim Calaway before a packed house, describing her in his introduction as “one of the leading individuals in the world to help us understand better the mess we have in our foreign affairs.”

The following are excerpts from Albright’s wide-ranging comments.

On the Middle East: “I’m so glad you started with an easy question. [Laughs] You said the world is a mess. That’s a diplomatic term. I have never seen it quite as complicated. A lot of it has to do with issues of religion, which are not easy for Americans to discuss because of our separation of church and state and our open-

ness and diversity.”

“The thing that has made this complicated is that the differences between the Shia and Sunni also mirror differences between the Persians and the Arabs. And the Persians and the Arabs have been having arguments about who’s really in charge in the Middle East. So that combination — of the divisions between Shia/Sunni and Persian/Arab — is part of the issue.

“What has happened, at the moment, is that there has been a hijacking of Islam by those who have decided that they do not like us and the Western world. And that’s what makes this so difficult.”

On the legacy of the war in Iraq: “I think the war in Iraq is one of the greatest disasters in American foreign policy. And the reason is that we undertook it as a result

If people go back and look at the problems within the Christian religion, and Protestants versus Catholics … the Thirty Years’ War, and lots of other things that went on, I think Islam has not gone through that sort of change. There are questions about how you interpret the Koran.”

“The Old Testament is pretty violent if you really read it, and the Koran is too, and there are also examples of using swords and fighting in the New Testament. So it isn’t as if the holy books were as peaceful as we might think. And so what’s happened is that the Koran has been interpreted by some as being much more violent. It is not more violent than the Old Testament if you really go through and read it.”

On recent progress in normalizing relations with Cuba: “I think it is a big step forward. Castro was using the embargo as an excuse for not having things happen on the island. I think it's the right direction and a big accomplishment for President Obama.”

On the U.S. relationship with China: “I go to China often, and I find it endlessly fascinating. Despite our big discussion about

the Middle East [this evening], I think our most important relationship of the 21st century is with China.”

On climate change and the recent climate meetings in Paris: “When I’m asked what is the greatest threat to national security, it’s climate change.

The question is, how to make people focus on it, because it doesn’t seem as immediate as some of the other things.”

On the global immigration crisis: “I am prejudiced on this. I am an immigrant.”

“If you put yourself in the shoes of the people who have trudged across deserts, carrying their children and all their worldly goods, gotten into some boat they are afraid is going to sink, and, I used to say, been treated like dogs — but dogs in America are treated better — and then they basically are told to disappear, it’s appalling. It’s the biggest humanitarian crisis that we’ve seen since the end of WW II, and I think that we need to step up.”

“When people ask me what’s the most important thing that has ever happened to me in life, it’s becoming an American, there’s just no question. As I was handing out naturalization certificates to new citizens a couple of years ago, I said to them, ‘I have this very same piece of paper. It’s the most important piece of paper you will ever get. Guard it safely.’ And they said, ‘This is such an amazing country, where a refugee can get a piece of paper from a former Secretary of State.’ And I said, ‘What a country, where a refugee can become Secretary of State!’”

JUlY Teens Giving Back Denise Wright says “There’s nothing more powerful than a group of kids with an idea.” Wright should know. The Roaring Fork High School teacher has worked with kids for years. This summer, she is the part-time coordinator for a new studentdriven group called Teens Giving Back, which volunteers at CARE, Heritage Park and other public and private organizations.

“Kids are some of the most generous people you’ll ever meet,” Wright told The Sopris Sun. “They love giving back.” About 25 students were involved with TGB.

Carbondale’s 14 pot-related shops Carbondale counted 14 pot-related busi-

Few arrests at Mountain Fair Carbondale Police Chief Gene Schilling said the 44th annual Carbondale Mountain Fair, was more peaceful than it has been in recent years, with very few arrests by either the Carbondale cops or by the supplementary officers brought in to help out with law enforcement at the fair. “I thought we were going to get by with hardly anything,” Schilling told The Sopris Sun, explaining that as of the evening of Saturday, July 25, there had been none of the usual incidents involving belligerent, often intoxicated fair attendees getting into shoving matches or fist fights.

Red Rock Diner sold The Red Rock Diner, where founder Bob Olenick has been serving meals to hungry customers for 21 years, recently was sold to Marty Voller, a New Castle man with two decades worth of his own ties to the valley’s restaurant scene.

The sale of the business closed on July 1, and while Olenick said he’ll be hanging around for a month or so to help with the transition, it is now under new management.

But, Voller assured a reporter during a phone interview on Tuesday, customers won’t see any big changes in the menu or other aspects of the business.

Town Briefs Cop Shop Get those old Christmas trees to Town Hall

From Dec. 17-23, Carbondale police officers handled 177 calls for service. During that period, officers investigated the following cases of note:

The towns street crew, which continued to devote most of its energy to plowing the streets and dealing with ice buildup around Carbondale last week, aided by the town’s utility department, also has prepared a site at Town Hall, 511 Colorado Ave., to receive Christmas trees for recycling, according to a Dec. 24 memo from Town Manager Jay Harrington to the Board of Trustees, town employees and other recipients.

Town residents with Christmas trees ready for disposal can call Town Hall at 963-2733 for information about the tree drop-off program.

Also working on snow and ice removal this week was the town’s parks crew, working on sidewalks and trails around Carbondale, Herrington reported.

The contractor working on a new shelter at the Community Oven in Bonnie Fischer Park, at the north end of the Third Street Center property, was scheduled to complete the last part of the project this week — installation of an extension of the bread oven’s chimney up through the newly completed metal roof on the structure, Harrington wrote.

Town officials continue to seek contractors for two other town projects — erecting a roof over a set of grandstands at the Gus Darien Riding arena on Catherine Store Road (Garfield County Road 100) east of town, and renovation of the announcers’ booth at the arena. A pre-bid meeting for contractors is scheduled for Jan. 12 at Town Hall, and the bids received are to be opened on Feb. 2, according to Harrington.

SUNDAY, Dec. 20: At 11:16 a.m. officers took a report of an accident at Crystal Bridge Drive in the River Valley Ranch subdivision. No injuries were reported by police.

TUESDAY, Dec. 22: At 7:54 a.m. police received a report of a two-car, non-injury accident at the roundabout at Highway 133 and Main Street, reportedly caused by icy conditions. According to police, one of the cars involved slid off the road and over a curb, and then was hit by a following car that was unable to stop. No tickets were issued, police reported.

THURSDAY, Dec. 24: Police investigated a twocar, non-injury accident on Dolores Way, in which a car was hit from behind while the driver of the car that was hit was putting on her seatbelt. No tickets were issued.

FRIDAY, Dec. 18: A burglar or burglars broke into the Wagner Rents shop along Dolores Way in Carbondale, making off with an estimated $45,000 worth of tools and about $300 in cash, according to police, who did not learn of the burglary until Dec. 21. Eagle County authorities believe a Wagner Rents shop in Eagle County was hit on the same day. Police did not publicly report the Carbondale burglary until Dec. 24, and are still investigating the crime. Anyone with information about the incident is urged to call the Carbondale Police Department, 963-2662.

FRIDAY, Dec. 18: At 11:23 a.m. police received a report from a local business that had taken in a counterfeit $1 bill. No further information was contained in a report from the police department.

Among the programs currently open for registration are hockey classes for adults, which will take place on Friday nights in January. Registration deadline for the Adult Learn to Play Hockey program is Jan. 3 Harrington reminded locals that the two community ice rinks — one at the Gus Darien arena on 100 Road and another at the intersection of Fourth and Main streets in the center of town — are now up and running.

The in-town rink is open from noon to 9 p.m. daily, and no stick sports are permitted at that rink, Harrington reported.

Hockey and broomball are allowed, however, at the Gus Darien Arena.

Skate rentals are available for $3 per day, or for $10 for three days, at the Rec. Center, for use at both rinks.

At the Carbondale Police Department, the town’s newest cop, Off. Bill Kirkland, was due to start his first shift on Dec. 28, Harrington wrote. That brings the department’s overall complement of employees to 16; Chief Gene Schilling, 13 other officers, and two administrative personnel, according to the list on the town’s website, carbondalegov.org.

At the town offices in Town Hall, Harrington reported, work continues on Carbondale’s comments relating to the Draft Environmental Impact Statement concerning natural gas and oil leasing in the Thompson Divide region to the southwest of Carbondale.

The monks also performed an opening blessing for the Mountain Fair, at 4 p.m. on July 4.

A proposed new ordinance in Carbondale, aimed at keeping domestic cats from roaming around and killing birds, prompted a reaction from a local woman who has been working to cut down the number of feral cats here and elsewhere in Garfield County. “I don’t want to go to war here, [but] they’re just ramming this ordinance through without hearing the other side of the story,” said Carbondale cat-advocate Cindy Sadlowski, concerning her effort to slow or derail the town’s consideration of laws eliminating the freeroaming liberty of local cats. The issue of cats versus birds arose when Carbondale resident Mary Harris, president of the Roaring Fork chapter of the National Audubon Society, appeared several times before the trustees to plea for laws restricting the movement of cats.

City Market submits paperwork

Trustees consider pay hike

Nearly 15 years after plans first emerged for development of a 24-acre parcel of land on Carbondale’s western edge, the town government received paperwork meant to start a development review process for a new grocery store and associated businesses on a portion of what once was known as the Crystal River Market Place site. The town’s planning department accepted an “introductory application” from King Soopers (aka locally as City Market). The submission includes a 58,000-square-foot grocery store and related retail businesses.

One of the town’s elected leaders has suggested that those serving on the Carbondale Board of Trustees get a raise, perhaps as much as a 66 percent jump in the monthly amount paid by the taxpayers. “I think it should be $1,000 a month for the trustees, maybe $1,500 a month for the mayor,” Trustee Allyn Harvey told The Sopris Sun in an interview. Trustees earn $600 per month, or $7,200 per year for their service, while the mayor earns $1,000 per month or $12,000 per year. If the trustees YEAR IN REVIEW page 7

BonďŹ re spreads out For Carbondalians who spend time in the midvalley area between El Jebel and Basalt and occasionally feel the need for a familiar brew to pep them up, the BonďŹ re Coffee shop has opened a new location in the Element Hotel in the Willits shopping district.

BonďŹ re, which opened in Carbondale in 2011 and two years later merged with DeďŹ ant Bean Coffee Roasters to round out its business plan, is run by Carbondale native Charlie Chacos and a dedicated crew of barristas.

BonďŹ re Coffee Willits is more modern that the one in the Dinkel Building in Carbondale, as a complement to the appointments of the Element Hotel, Chacos reported in an announcement.

It offers a limited food menu including egg burritos and pastries from local bakeries, and initially its hours are 6 a.m. to 5 p.m., seven days a week.

Bernie fires up Carbondale Carbondale resident John Field had not expected to become the local organizer of a “Roaring Fork 4 Bernie Sanders” presidential campaign organization. But, he admitted that’s essentially what he is, at least in terms of his role in the 2016 presidential election. “I've never really done anything … as far as organizing is concerned,” said Field, who moved to the Roaring Fork Valley about three years ago. Impressed by what Sanders had been saying on the campaign trail, Field reserved the Calaway Room at the Third Street Center and started telling people to come and watch the man that Field believes will be the next President of the United States.

“There were 61 people in the room,” he said in an amazed tone, noting that when he reserved the Calaway Room, “There was a lot of people that (expressed) heartfelt (sentiments), knowing that we had to do something to take this country back from the oligarchy.”

Bear raids increase The general opinion among wildlife experts was that there was more than enough bear fodder in the high country this year, and the bears were not likely to be heading into towns in large numbers to forage through garbage cans to fatten up for the winter. But, according to area wildlife manager Perry Will, that outlook changed somewhat.

“Activity … really picked up … , as far as bear conflicts,” said Will. He reported that there have been numerous conflicts between bears and humans in the upper regions of the Roaring Fork Valley, and even a few bear sightings in Carbondale

Health clinic opens at RFHS New at Roaring Fork High School this year: a non-profit health clinic that will serve not only high school students but students from other Carbondale schools as well.

The clinic is a partnership with Roaring

Fork School Health Centers (RFSHC), the Aurora-based Rocky Mountain Youth Clinics (RMYC), and the Roaring Fork School District. The clinic will offer a wide range of medical, behavioral health, dental, nutritional, care coordination and referral services. “We can now support the health needs of our entire school community,” said RFHS Principal Drew Adams. The RFHS joins Basalt elementary, middle and high schools in hosting a Roaring Fork School Health Centers clinic, which operates under the auspices of Rocky Mountain Youth Clinics.

Bull rider shoots for Guinness Bull riders hang on for eight seconds to make their ride. Greg Casteel has been hanging on for 41 years and his biggest ride might still be to come. He applied to Guinness World Records to be recognized as the world’s oldest bull rider and expects a company representative to visit the Carbondale area to check him out. Casteel, 54, grew up in Arkansas, “on the west bank of the Mississippi.” When Casteel was 13, he talked his father into taking him to a rodeo to get on a bull. “He wasn’t involved with rodeo … He said ‘we’re going to get this over with real fast.’” That was in 1975 and Casteel is still riding. “It’s my passion.”

The elected leaders of the Carbondale fire district voted 4-1, to move ahead with a ballot question, asking for a tax hike that would bring in roughly $600,000 more in annual property tax revenues than are now coming into the department's coffers. The sole dissenting vote came from Carbondale

& Rural Fire Protection District (CRFPD) board member Carl Smith, a former fire fighter and paid staffer at the CRFPD who won election to the board in 2014 largely based on his public skepticism about the board’s handling of its fiscal affairs. At the end of an Aug. 19 meeting, after the vote was taken, Smith was grilled about his ongoing criticism of what he has termed the fire board’s lack of transparency and sound financial planning. “I wonder if you’re going to actively, uh, go against the men and women on the fire department, to advance whatever cause you’re advancing,” said district resident and volunteer firefighter Mark Luttrell, who spoke out in favor of a tax hike at the meeting and criticized Smith for his dissenting viewpoint, according to a recording of the meeting.

I will never be against them. I resent that (accusation).” His concern, he said, is that the board does not have a wellcrafted plan to present to voters. But, he said later, he will continue to voice his opinion, stating that it is his right to do so under state and federal law and is part of his obligation to the voters who elected him to the fire board. He said he agrees with the proposed 2016 budget submitted by Fire Chief Ron Leach, which calls for raises for paid personnel next year.

“I’m very supportive of paying them the salaries they need,” Smith said.

SEPTEMBER library director steps down Amelia Shelley, the long-time director of the Garfield County Public Library District, announced she leaving her job in October, to take the job of Executive Director of the Fort Vancouver Regional Library District in the south-central and southwestern section of the state of Washington. She came

to the job in 2007, just as the district was embarking on an ambitious building program to either replace or significantly improve the existing, aging library buildings in the six towns that make up the district.

Realizing a dream Students, Roaring Fork Energy Club members, teachers and community members of all ages gathered to plant 13 trees near the entrance of Roaring Fork High School on the morning of Sept. 5. After four hours of digging, shoveling, watering and a fair share of laughs, the trees now stand tall and proud, ready to provide beauty and shade for generations of Roaring Fork High School students to come. Roaring Fork High School senior Fiona Laird started Teens for Trees to create an outdoor courtyard to not only beautify the school, but to provide students with a nice place to spend time outside. Funding was provided by a 5Point Film grant; several local businesses provided in-kind donations.

USDA cites Marble Distilling The management at Marble Distilling Company (MDC) got word they received a $197,000 grant from the U.S. Department of Agriculture, which recognizes the distillery’s “leadership” in water conservation and energy efficiency. The grant acknowledges the MDC’s system for recycling four million gallons of water and using heattransfer technology to leech energy from the water at certain points in the system to heat and cool the distillery building as well.

Community steps up for CRES

As students at Crystal River Elementary School (CRES) returned to classes this year, they were full of “oohs” and “aahs” when they saw the new amphitheater-style space on the western edge of the campus. Over the summer, a group of parent volunteers and professionals designed and constructed the school’s 750-square-foot outdoor learning space that has four rows of concrete seating on a large concrete pad next to the town’s historic ditch system. A steel structure defines the edges of the space and provides shade. Members of the Parent Teacher Organization took charge of the project after the school was awarded a $5,000 Lowe’s Toolbox for Education grant.

Totem pole finds a home Community access radio station set a 17-foot totem pole in front of its studio on S. Second Street, after local sculptor John Doyle donated it to the non-profit station.

An Aspen-area resident commissioned Doyle to carve this totem pole several years ago, but never picked it up. Station manager Steve Skinner discovered the pole in a garage earlier in the year and approached Doyle about the donation.

TRUU minister a full-time resident The Two Rivers Unitarian Universalist (TRUU) fellowship hired Florence Caplow as its first minister who will live in the Roaring Fork Valley full time. Caplow was a field biologist for much of her adult life, and is also an ordained Zen priest and teacher in the Soto Zen tradition.

Cannabis testing lab gets green light A Carbondale-based cannabis testing lab was expecting to get to work next week, after a lengthy delay, following word from state regulators that marijuana growers and manufacturers of edibles infused with THC are now formally required to submit to the testing procedures.

According to principals in the business, Green Hill Laboratories, which has facilities on Village Road, received its state certi-

fications and local permits last spring, when it was approved for microbiological testing of marijuana buds grown for commercial sale and edible products infused with tetrahydrocannabinol, or THC, the psychoactive ingredient in marijuana plants.

But state regulators failed to issue rules requiring that business involved in the industry must submit their products for microbial testing, only requiring that they be tested by chemical means.

The revised rules have fixed all that, and Green Hill plans to get its full testing business going soon.

Trustees thinking about raises It appears as though a majority of Carbondale’s elected leaders are leaning toward enacting a pay raise for future trustees, but first they want to hear from their constituents about the idea.

Toward that end, the trustees next week (at a meeting on Sept. 22) will take input from the public on a proposed ordinance that would authorize a 50-percent pay hike for the trustees and the mayor starting with the upcoming municipal election in 2016.

The idea was raised in early August by Trustee Allyn Harvey, whose seat on the board is up for election in 2016, but initially was questioned by Trustees Katrina Byars and Pam Zentmyer.

The trustees ultimately voted to approve the pay hike, with Zentmyer dissenting, meaning that after the 2016 municipal election trustee pay will rise from $600 per month to $900 per month, and the mayor’s check will go from the current $1,000 per month to $1,500 per month.

School district info-meetings The Roaring Fork School District, hoping to educate taxpayers about its proposed $122 million bond issue for capital improvements in Glenwood Springs, Carbondale and Basalt, scheduled seven community meetings around the district in September and October, including two in Carbondale.

The bond question was to be on the ballot in November.

Clay Center snags grant The Carbondale Clay Center received a $6,500 grant from Colorado Creative Industries, a division of the state’s Office of Economic Development, to support the Center’s operations, keep class fees low and generally make the Center’s programs accessible to all community members.

The Center serves approximately 300 students of all ages in year-round classes.

OCTOBER First harvest A new garden for Spanish speaking families at Roaring Fork High School celebrated its first harvest this year, an example

of the continuing integration and partnerships between the Hispanic and Anglo community in Carbondale.

The garden, collaboration between the Valley Settlement Project (located at the Third Street Center) and Fat City Farms, boasts eight families who planted an array of produce over the summer, including the traditional crop of corn that is a staple for families throughout Latin America.

Using town’s bag-ban proceeds The volunteer members of Carbondale’s Environmental Board (E-board), along with the towns public works department, found a new way to use proceeds from the town's ban on plastic shopping bags in a way that benefits the town’s residents, according to E-Board member Julia Farwell.

The latest use of the bag-ban money was the Oct 3 Household Hazardous Waste Diversion and Eco-Learning Day, a combination of activities that took place along Colorado Avenue across from Town Hall.

At that location, town residents were invited to turn in everything from old cans of paint and other liquid chemicals, to electronic gear such as old computers and cell phones that have accumulated over time, either free or at a low cost.

The bag-ban proceeds were used to defray costs of recycling and disposal of the waste materials.

“I felt lost from my purpose before I moved back to Colorado two years ago to help my dad with his business,” said Weber.

“It has been infinitely comforting to be back and realize that I come alive when serving my community.”

Weber explained that her purpose is to be here helping residents of the Roaring Fork Valley attain the finest alternative medicine that they can acquire. And let’s face it, any alternative to “Big Pharma” is an alternative worth exploring.

“I love my job and I am in this for the

long haul,” said Weber. “I love the ongoing relationships I have with my members and the unending journey of educating both myself and the public on cannabis. I like to joke that I am a florist but really I am more like a pharmacist: education on dosing, meticulous record keeping and patient consultation are my main tasks.”

When patients apply to the medical marijuana registry they are choosing better prices, higher dosing in infused products and “in theory” cleaner medicine, Weber said. “We at ARFW grow extremely clean, pesticide free cannabis and you can tell from the flavor. If the weed you are smoking tastes bad on the exhale, is making your throat sore, or if you feel ‘out of sorts’ after smoking it, it may be that the flowers are laden with toxic pesticides and chemicals.

what they used during the growing process.

And just like with your fruits and vegetables, that is what you’re consuming.”

She continued, “This is, in my opinion, is the biggest problem in Colorado’s marijuana industry today: there are too many harmful chemicals that license holders are legally allowed to use and are in turn entering our bodies and waterways. Colorado should be growing 99.99 percent organic cannabis across the board, just like Maine’s medical marijuana laws. For Coloradans who like cannabis and care about their health, the smart choice is a medical card.”

Primary concerns were the creation of bandit trails and the amount of dog poop that needs to be cleaned up every month, said Council members Davis Farrar and Chris Brandt, who also noted that users of the system should be responsible enough to pick up after their pets and to refrain from cutting new trails that can contribute to erosion of the area.

CR 106 resolution?

The contentious debate over the fate of County Road 106, which bisects the campus of Colorado Rocky Mountain School near Carbondale, moved a step further toward resolution when the Garfield Board of County Commissioners (BOCC) maintained its 2-1 split over how to manage public pedestrian and bicycle use of the historic right of way.

As of mid-October, the pathway was to consist of an eight-foot bike and hike lane, marked out by painted lines on the western side of the existing pavement for about 300 feet along the southern portion of its route through the school, then switch to the eastern side of the road, under a compromise supported by the BOCC. The commissioners remained unsure about the idea of paving or not paving the trail and other development ideas, worried about the costs involved.

Town budget at $6.2 million Town officials were homing in on the town’s proposed 2016 budget, which called for expenditures of slightly more than $6.2 million in the general fund, which covers the town’s day-to-day operating expenses.

At a budget hearing, Finance Director Renae Gustine laid out a general-fund plan divided up between several departments, with roughly 65 percent of the money going for personnel costs.

Overall, according to a chart included with the documents provided to the trustees, the general fund's proposed $6.2 million would be only slightly below the total estimated expenditures for 2015, which were expected to come in at $6.3 million once the current budget year was closed out.

Sewell takes to the air Carbondale native Alex Sewell started a helicopter tour business, operating out of the Glenwood Springs Municipal Airport, to take tourists, realtors and any other interested customers on flights over the Roaring Fork Valley region.

“I always wanted to fly helicopters, ever since I was a little kid,” said Sewell, who got his permit at a school in Boise, Idaho.

Basalt teacher is honored

The Carbondale Board of Trustees agreed to continue to be part of the Two Rivers Drug Enforcement Team (TRIDENT) for another year, despite the fact that most of the agency’s work seems aimed at the communities of Glenwood Springs and Rifle.

Police Chief Gene Schilling reported that, from January through September of 2015, TRIDENT made 81 arrests on 34 cases, only one of which was Carbondale related.

But Schilling maintained that the task force’s work has impacts on Carbondale beyond the judicial ones, such as improving the atmosphere of neighborhoods that

NOVEMBER Down on the farm A 30-year-old man, Casey Piscura, told the Sopris Sun he has realized his lifetime passion of working on a farm and, at the same time, working with local young farmers on ways to reinvigorate the valley’s his-

toric farming culture.

Working with the Sewell family on their ranch just south of Carbondale, Piscura hopes to align his efforts with other area ranches and big land holdings, to provide opportunities for others with an interest in alternative, organic agriculture.

Too much light?

As Carbondale officials work on revisions to the town’s lighting code in response to concerns about LED lighting on signs, a couple of local establishments in particular have been cited as examples of why the changes are needed — the sign for the Faith Lutheran Church at 1340 Highway 133, and the lights at the Planted Earth nursery business on Highway 82.

Two members of the Carbondale Board of Trustees — Frosty Merriott and Katrina Byars — have specifically pointed to the church sign as an example of the reason for their concerns, and have mentioned that they are worried that further use of LED lights might add to the town's growing worries about light pollution.

And Merriott confirmed that the lighting at Planted Earth, located outside the city limits along Highway 82, also has caused him concern.

The town expects to re-examine the lighting issue in the new year.

Nearing UDC won’t undo PUDs

In another ongoing revision of Carbondale’s town codes, the Planning and Zoning Commission was hard at work on a new Unified Development Code intended to streamline regulations and make the town’s codes more user friendly for developers and interested citizens.

But one thing the revised codes will not do, officials confirmed, is change a historic crop of Planned Unit Developments that have dominated land-use proposals in recent years.

This is true even though officials have long admitted that one reason to write the UDC was to make it easier for people to use the codes, and eliminate the need for developers to turn to PUDs, which essentially involve creation of specific zoning and use regulations for the project in question.

A former Colorado State University Extension agent for Garfield County told the Sopris Sun that the market for hay, which once was driven by a high number of cattle and horse operations, has slacked off in recent years.

Still, some ranchers said they never depended on hay sales from year to year anyway, and that they typically grow hay to feed their own livestock and not much more.

launchpad has a birthday The Launchpad, a combined gallery, dance studio and office space for the Carbondale Council for Arts and Humanities and the Dance Initiative now housed in the old Gordon Cooper Library on 4th Street, had its first birthday this month.

And officials told the Sopris Sun that it had been a year of collaboration and happy surprises for both organizations.

The two share the space, which is owned by the Town of Carbondale and leased to the two nonprofit groups, and CCAH Executive Director Amy Kimberly described programs ranging from an installation of edible landscaping to a puppet show for the Dia de los Muertos holiday as examples of some of the collaborative projects that happened through the year.

Tests don’t do it all A documentary by filmmaker Greg Whiteley, shown at the Crystal Theater on Nov. 8, described how Whiteley’s vision of education has changed from a belief in the use of standardized testing to a greater belief in the value of classes that inspire, empower and engage both students and teachers.

The film, titled “Most Likely To Succeed,” highlighted a charter-school network in San Diego County, California where about half the students are eligible for free or reducedprice lunches, and where a focus of the instruction is on significant group projects rather than teaching to the tests required by federal and state educational bureaucracies.

The project, according to the film, ran the gamut from production of an ancient Greek play but altered to a setting in modern-day Pakistan, to elaborate physics projects involving geared mechanisms.

The film argues that the current mainstream model for education dates back to the 1890s and was meant to turn out an obedient workforce for factory jobs, which is no longer relevant in the modern U.S. economy.

BlM calls for gas lease cancelations Opponents of gas drilling in the Thompson Divide area rejoiced after the U.S. Bureau of Land Management (BLM) proposed in November to cancel 18 oil and gas leases in the hotly contested backcountry region, and significantly reduce the size of seven others.

But there remain 40 leases located within the original boundaries of the 225,000-acre region known as Thompson Divide, that were left in place under existing lease rules and stipulations, as well as the seven leases that were reduced in size, all of which still are open to exploration and mineral extraction.

And as part of its recent proposal, the

BLM has predicted that under its proposed Alternative 4, which cancels some leases and shrinks others, those leases essentially left whole and developable could represent several hundred wells drilled over a total land mass of more than 50,000 acres.

The BLM decision is in keeping with a 2014 Forest Plan issued by White River National Forest Supervisor Scott Fitzwilliams, which temporarily withdrew roughly 61,000 acres of the Thompson Divide area from further leasing considerations for the next 15 to 20 years. The BLM and the WRNF together oversee oil and gas leasing decisions affecting the White River district.

In remembrance The decision sparked considerable anger among Garfield County citizens and others, who contributed close to $25,000 to Planned Parenthood and, in letter writing campaigns and comments on the Internet, condemned the commissioners' action.

Jankovsky, in an exchange of e-mails with The Sopris Sun, suggested that a reporter visit the PPVC website rather than seek copies of the offending e-mails from him.

“Just go to Planned Parenthood's PAC: PPVotesColorado,” Jankovsky wrote in reply to a request for copies of the e-mails he had cited at the BOCC meeting.

When a reporter persisted, Jankovsky wrote,“I will not be sending you those e-mails.”

In a later email, after he was asked if he actually received any e-mails from PPVC, Jankovsky responded, “Somehow I was on the e-mail list for PPVotesColorado” and added, “The e-mails did not come through my county e-mail address, however, if you would like to pursue a CORA (Colorado Open Records Act) request you know the drill.”

DECEMBER Marble Distilling gets a prize Marble Distilling Co., 150 Main St. in Carbondale, was awarded the Exceptional Implementation of Sustainable Technologies award from the U.S. Green Building Council of Colorado during the council’s 2015 awards banquet in Denver on Dec. 1.

Michelle Marlow, owner, and architect Jeff Dickinson were on hand to receive the award.

The distillery was awarded this distinction for the implementation of the WETSTM system, (Water Energy Thermal System), created by the MDC ownership and design team.

This innovative system saves both energy and water by recirculating and storing heat and “coolth” (cold water) for the distillery process as well as heating and cooling the building, rather than dumping hot water and energy down the drain. 1.8 Billion BTUs and 4.1 million gallons of water are saved each year through this innovative process.

Carbondale's Board of Trustees overrode objections from the town's top police official at a meeting on Nov. 24, and by a vote of 41 approved a new law providing stricter oversight of domestic cats in town than the previous town code.

But the new law is not as strict as some wanted it to be, in that it does not require that cat owners have their pet cats spayed or neutered, licensed and vaccinated for certain known feline diseases.

Instead, cat owners are “encouraged” under the new law to arrange to have the cats fixed, licensed and vaccinated.

The sole dissenting vote at the trustee meeting came from Trustee Pam Zentmyer, who at one point argued that the fees linked to the new ordinance might result in cats being abandoned if they are picked up by police on some infraction.

Jankovsky mum on emails Garfield County Commissioner Tom Jankovsky has declined to release e-mails that he said were behind his move to yank funding from the Glenwood Springs Planned Parenthood offices in November month.

The Board of County Commissioners on Nov. 2 voted unanimously to withhold a grant of $1,500 from Planned Parenthood, after Jankovsky reported receiving “emails that I find to be very partisan, and very political” from an organization called Planned Parenthood Votes Colorado (PPVC), the political, nonprofit arm of Planned Parenthood.

Year in review continued om page 14 were arrested for armed robbery of the Sweet Leaf cannabis shop on Village Road, following a manhunt that involved four different law enforcement agencies and the area's district attorney's ofďŹ ce.

The escapade started on Monday morning when two men walked into the Sweet Leaf cannabis shop and one of the men brandished a gun, according to police. The arrest afďŹ davit said the men were wearing camouaged masks and socks on their hands when they entered the shop.

Arrested were Aurturo-Nuno Cervantes, 20, and Erick Jose Colon, 25, both of Glenwood Springs, and Bryan Flores-Calix, 19, of Silt, and a 17 year old juvenile who was released to the custody of his parents.

The 3 adult suspects were taken to the GarďŹ eld County Jail with bonds of $100,000 each.

Ro Mead celebrated Hundreds of people showed up at a memorial celebration of the life of Ruchille “Ro� Mead, long time Carbondale resident and arts activist who died on Oct. 24 at her home in Carbondale.

The event featured music and dancing, skits and storytelling, and readings from various sources, marked by alternating noise and silence, humor and drama, laughter and lots and lots of tears.

According to one observer, most of those attending were from Carbondale, but some came from Denver and other, more far-away places.

Fire district prospects better The Carbondale Fire District goes into the New Year with a considerably rosier outlook, ďŹ nancially speaking, than has been the case for the last couple of years, thanks to a recent tax hike approved by district voters.

And a large portion of that improved outlook concerns the district's paid personnel — 18 full-time ďŹ reďŹ ghters and emergency medical technicians currently, but with plans to hire three more full-time ďŹ re ďŹ ghters/paramedics in 2016.

The district's voters on Nov. 3 approved a tax hike that, along with increases in the assessed values of property throughout the district, is expected to generate nearly $1 million in new revenues for the coming year, according to a report on the 2016 budget by Fire Chief Ron Leach.

Overall, with all income sources included, the 2016 budget for the district is projected at $2.67 million in operating revenues and expenses, also known as the General Fund, of which $2.54 million is from property taxes.
