From Jen Rupert Dear Editor: By now, all registered voters should have received their 2015 Election ballot. As a RFSD school board candidate, I urge all to get out and vote. Your vote is your opportunity to make a choice for what you believe in.

As the parent of a third-grader, I have a vested interest in the future of our schools.

If we don’t actively push on improving our schools, they won’t improve. In my conversations throughout the valley, despite the great work of the existing board, many people still don’t feel that they have an advocate. I am running because I want to serve in that role.

My strengths as a leader lean towards my ability to listen, engage and motivate. I believe these are skills needed on the board to ensure that our district vision and Strategic Plan moves forward and ensures excellence in education for all our children. I will proactively seek out the community’s viewpoint. Active engagement within our entire district is the next piece of the chain to propel our schools forward. I would use my skills in leadership, people management, communication and planning for the benefit of all people, all children and all of the schools within our community.

I am not afraid to question the status quo. I don’t believe in unnecessary change but I do believe that it is important to always keep an eye towards the future, and be ready to adjust goals and strategies as needed. My years spent as a teacher, trainer, athlete, teammate, student, wife and mom have taught me the importance of hard work, perseverance, teamwork and compassion. I am a fourth-degree master instructor in Korean martial art Soo Bahk Do, a practice that emphasizes discipline, respect, community, justice, peace, courage, honesty and humility — all skills I’ll need in this job. Most important though is that I’m going to listen to you, I’m going to work for you and I will not let up.

From Karl Hanlon Dear Editor: I am running for Roaring Fork School District Board, District A. I have committed not to spend any money – either my own or others’ – on my personal campaign so that people can focus on getting the district bond issue, 3B, passed. No ad can tell you who I am or what I have done as well as the people who have worked with me over the years both personally and professionally as a father, volunteer, attorney, non-profit board member and school board member.

It would be easy to talk about what I would do if elected, but I believe it is more important to look at what I have done. I have made real progress on the issue of affordable and attainable housing for our teachers and staff, initially by making the hard decision to scale back the plans for a multi-million dollar development in Carbondale that was simply unattainable and then focusing the board and staff on smaller scale projects that we could accomplish. After that decision I started reaching out to our various communities and local governments to start the conversation about building or acquiring units in each municipality. That hard work has paid off and we will be considering a letter of intent with the Willits developer to acquire 14 units of affordable rental housing if 3B passes.

As a product of a great public education system and a first generation college graduate, I believe passionately in the idea that we can and must deliver the best education to every student. That means retaining the best and the brightest teachers, administrators and staff. It means listening to what all of our communities want their schools to look and be like. It means being honest and transparent about our strengths and weaknesses. Most of all it means bringing an optimistic pragmatism to bear so that we stop talking and start doing.

Each one of us is a passionate, involved parent. In today’s world you expect an elected official to bring more to the table than just passion, you expect them to have the experience, knowledge, insight and proven leadership to help move us into the future.

Town putting final touches on cat ordinance Trustee defends cats’ rights

By John Colson Sopris Sun Staff Writer Carbondale’s elected leaders once again spent a lot of time talking about cats on Tuesday night, though the talk focused on municipal fiscal issues as much as it did on whether cats are guilty of killing too many songbirds in this region.

In the end, the Board of Trustees decided to direct town staff to draw up a proposed ordinance governing the lives and activities of cats and cat owners, but with options built in to the draft ordinance regarding such issues as whether to require that cats be spayed or neutered, whether they be vaccinated against rabies and feline leukemia, and whether the new law should include mandatory licensing and installation of electronic identification chips under the skin of all owned cats in town.

In addition, some of the trustees were skeptical about an estimate from Police Chief Gene Schilling that implementing the new ordinance could cost as much as $20,000 annually.

“I think $20,000 is too much,” said Trustee Frosty Merriott, who has been a proponent of an ordinance intended to keep cats under tighter control than they have been historically.

The underlying issues of the proposed ordinance have been discussed at length since July, when Mary Harris, president of the Roaring Fork chapter of the National Audubon Society, appealed to the trustees for help in what she said was rampant predation of the local bird population by out-of-control cats.

Harris, claiming that birds were killing billions of birds nationally and that the problem was reaching a critical stage locally, convinced the trustees to call for an ordinance with strict controls on the movement and activities of cats.

But Harris’ statistics and motives were called into question by others, most prominently local real estate broker Cindy Sadlowski, who for 15 years has run a program called the Street Cat Coalition that has worked to trap, spay and neuter feral cats and then release them as a way of keeping down the cat population.

The resulting uproar led to the trustees’ creation of a special committee charged with coming up with a law that both sides could live with.

That proposed ordinance was before the trustees this week.

“I see it as kind of like the issues of seat belts, tobacco use and climate change,” said Merriott at the trustee meeting, explaining that it is a matter of education of the public as much as one of creating laws.

“So, we’re trying to address it,” concluded Merriott, who was one of two trustees who served as liaison to the cat committee.

Others on the board, however, had strong views in opposition to the ordinance being proposed.

Trustee Pam Zentmyer, for instance, declared her reluctance to require rabies and feline leukemia vaccinations for cats, maintaining that the vaccinations themselves can cause fatal reactions in the recipients, particularly in older cats.

And, she said, there has not been an outbreak of either disease in Garfield County in the past three years, so the requirement would be meaningless as well as potentially harmful.

Citing the proposed ordinance’s reference to cats that have bitten or scratched someone as “aggressive” animals in need of inoculation, she said, “Every cat on the planet has bitten or scratched someone. It’s part of their … mystique,” a remark that provoked laughter among the trustees and those in the audience.

“I would say that’s their right as an animal,” (if provoked) Zentmyer continued. “It’s what they do.”

Zentmyer also objected to the ordinance calling for the town to spend up to $20,000 to implement the ordinance, and for the police department to be the agency in charge of enforcing the law.

“It’s an irrational expectation of our budget and of the police staff,” she said.

Trustee Katrina Byars also spoke up, but against the focus of the proposed ordinance, saying, “I don’t think that the problem is nuisance cats, or scratching cats.”

The problem under discussion, she said, is the disappearance of birds, which she said is a function of habitat disappearance, particularly in riparian areas, which she said is the place where birds nest and hatch their eggs.

Rather than spend $20,000 on the cat ordinance, she said, the money would be better used to rehabilitate and restore bird habitat, pointing to the Delaney Nature Park as an example where she argued that roaming and noisy dogs have driven away large numbers of birds.

Zentmyer agreed, remarking, “There’s probably been more loss (of birds) there than from the predators.”

In the end the trustees called for staff to determine whether it is legal for the town to require vaccinations, and look at the licensing requirement, before drawing up a proposed ordinance for the trustees’ consideration.

In other action the trustees: • Approved a liquor license renewal and change in management for the Black Nugget Saloon; • Promoted Ken Harrington from an alternate position to full member on the Planning and Zoning Commission, and appointed Lauren Suhrbier to the open alternate’s position on the commission; • Approved a special use permit for a three-room bed &

• Approved a new business in town, the Laughing Dog Group, which will make marijuana infused products for retail and medical marijuana outlets.

Obituary Ruchille Lee Mead 1936-2015 Ruchille Lee Mead, known to all of us as Ro, left us at 4 a.m. on Oct. 24, 2015 after a long and courageous battle with pancreatic cancer. She died in her home surrounded by a tidal wave of love from family and friends both near and far.

Born in Denver on Dec. 3, 1936, to Sylvia Kanarek Rosenbloom and Samuel Johah Rosenbloom, she stayed in her home town for 36 years, married young up-and-coming attorney Robert Meer, joined the country club and pretended to be a suburban housewife long enough to have three children and learn to play bridge like a shark.

Her liberal roots started showing when she began actively working for the Democratic Party and taking pottery classes from tall, handsome Henry Mead, who ignited her lifelong passion for clay and won her heart in the bargain. With kids and kilns in tow, they arrived in the Roaring Fork Valley in 1973 and built their hand-made house up Cattle Creek where they married and set up shop. Ro's unique ceramic style emerged in the form of colorful slab built bowls and platters and her natural affinity for people surfaced when she began teaching classes for Colorado Mountain College. During the 1990’s she teamed up with close friend Candy Resnick and together, they created tile murals and three-dimensional installations all over the country.

The early 2000's saw Ro reinventing herself yet again, when she taught art at Yampah Mountain High School in Glenwood Springs, and subsequently took on the task of rebuilding the Carbondale Council on Arts and Humanities. Her efforts established CCAH as the beating heart of our community and put Carbondale on the map.

As if all this was not enough, she managed to find time for other pursuits on the side. She was an avid outdoor enthusiast, balls-to-the wall skier, a gourmet cook with a very green thumb, and she managed to can one hell of a lot of tomatoes. Outspoken and bold, honest and generous, our Rosybelle (a.k.a. The Duchess of Bridgewater) was one amazing woman and her door was always open.

She is survived by her daughter, Lauren Meer; son, Jonathan Meer; and five grandchildren: Emily, Holly, Taylor, Ryan and Jordy.

She was preceded in death by her son Douglas and her beloved partner Steve Ward. No stranger to sorrow, she grieved mightily but emerged from each loss stronger than ever. Now it is our turn mourn but also to celebrate her and follow her example of embracing each other and our lives with no holds barred.

Streeters busy; parkers shut restrooms Sopris Sun Staff Report

Carbondale’s street crew had a busy week from Oct. 19-23, according to a memo from Town Finance Director Renae Gustine (on behalf of Town Manager Jay Harrington) to the Board of Trustees, town employees and others.

According to the memo, the crew: • Replaced a drainage culvert at the Gus Darien Riding and Rodeo Arena along County Road 100 east of town; • Removed portions of heaved concrete sidewalks along Village Road and Wheel Circle; • Performed utility locates for the Roaring Fork Transportation Authority’s ongoing expansion of the BRT Park and Ride lot along Highway 133; • Used the town road grader to smooth the road up to Hillcrest Cemetery on White Hill east of town; • Did repairs to the asphalt trail along County Road 108 toward Colorado Rocky Mountain School west of town; • Continued working to install LED Christmas holiday lights along Main Street.

The town’s parks department workers, aside from their routine maintenance on trash containers and dog waste stations, began closing down and winterizing public restrooms at local parks and athletic fields, as well as finishing up on the installation of engineered wood chips at Colorado Meadows park and delivering wood chips to Miners Park for installation at the playground there.

Gould Construction is “wrapping up” its

work on the Thompson Park housing project, according to the memo, although subcontractors are still working on a new bathroom at the site.

At the adjacent Ross Montessori School construction site, workers were scheduled to switch access routes into the site to the new Lewie’s Lane right-of-way.

Town officials had the final walk-through inspection of the Industry Way water line project, including the new water line, fire hydrants and a storm water drainage system, and reported the project to be complete.

Carbondale police officer Luke Blake, after attending a class on the “carotid restraint” method of subduing suspects, reported that it was “an excellent class.”

Another local cop, Steve Kuhl, received a letter of commendation from the Carbondale Fire District for his part at an ambulance call on Oct. 19. According to the memo, Kuhl acted quickly to keep open the airway of a one-weekold infant who was having difficulty breathing, enabling the ambulance to head for Valley View Hospital after only about a minute at the scene of the incident.

Police are keeping up their focused patrol at the Highway 133 roundabout, at the intersection with Main Street, and other “trouble spots” where cars, pedestrians and bicyclists seem to have difficulty negotiating through traffic.

Calibration of various instruments were performed at the town’s water and waste-

water plants last week, according to the memo, following “technical difficulties “with the Nettle Creek chlorine analyzer. Instruments for the water system are now certified for another year, the memo stated, although further calibrations had to be rescheduled due to a “family emergency” on the part of the technician in charge.

The memo reported that Nettle Creek remains the town’s primary source of water while maintenance“runs”are conducted on the town’s Crystal Well and Roaring Fork water plant.

Recreation programming for last week included Motion Mondays and Wild & Whacky Wednesdays Pre-school events, Early Release Wednesday Open Gym and Youth Only Facilitated Climbing, Youth Climbing Class, Mommy & Me Climbing Class, Fall Volleyball League for Adults, and the after school Youth Volleyball and Dodgeball Derivatives classes, according to the memo.

Specialty classes for the week included Summit Conditioning, and Tae Kwon Do. Registration is now being taken for Men’s Basketball League, Broomball League, Base Building for Cyclists, the Dinky Dunker Basketball program for first and second graders and the Youth Basketball League for third through sixth grades.

Cop Shop From Oct. 16-22, Carbondale police officers handled 259 calls for service. During that period, officers investigated the following cases of note:

FRIDAY, Oct. 16: At 7:17 p.m. Carbondale police stopped a vehicle for making a right turn on a red light without stopping. After investigating, the officers found the driver did not have a current drivers license, arrested him and took him to Garfield County Jail.

SATURDAY, Oct. 17: At 12:36 p.m. police received a report about an apparent attempted break-in involving a smashed-in glass door. The matter is under investigation.

SATURDAY, Oct. 17: At 7:12 p.m. police got a report about two “suspicious persons” at the RFTA park-and-ride lot along Highway 133. An investigation revealed that both men were wanted on warrants, but that only one of the pair was “within extradition range.” That man was arrested on the warrant and taken to Garfield County Jail.

TUESDAY, Oct. 20: At 4:22 p.m. police took a report of a stolen wallet, and credit cards from the wallet, that reportedly had been used in local businesses. Police are advising area businesses to be on the lookout for a white male with a light beard and a mustache, carrying a backpack.

THURSDAY, Oct. 22: At 10:01 p.m. a man was kicked out of a bar for being visibly intoxicated. Police then told the man to stay out of any bar or liquor store. When the man was seen going into a liquor store about 10 minutes later, he was arrested for trespassing and summoned into court.

Chamber election results Read this; save lives Carbondale and Rural Fire Protection District says it wants to remind folks that one simple step can help save your life and the lives of others. Changing smoke detector and carbon monoxide alarm batteries when Daylight Saving Time ends on Sunday, testing those alarms and reminding others to do the same are some of the simplest, most effective ways to reduce tragic deaths and injuries. Fire Chief Ron Leach also recommends that

smoke detectors in homes be replaced every 10 years “and have both ionization and photo electric capabilities to alert people to all types of home fires.” Carbon monoxide alarms should be replaced every five to seven years. Smoke detectors and carbon monoxide alarms should be tested once a month to make sure they are working properly. A smoke detector should be installed on every level of a home and inside each sleeping area.

Zombies are “thrilled”

Zombies of all ages gathered on the south lawn of the Carbondale Branch Library on Oct. 24 to perform Michael Jackson’s “Thriller” dance in conjunction with hundreds of “Thrill the World” events around the world. According to the “Thrill the World” website, the event is more than just simultaneously dancing to the six-minute song. It is a celebration of a performance genius and celebrating all people around the world as a community, regardless of political, economic or racial background.

Aspen survey results released Results from Aspen’s Citizen Survey are in and city residents continue to say they enjoy a high quality of life and feel safe in the city, according to a press release. Ingram named 2016 Colorado Teacher of the Year Sopris Sun Staff Report The Colorado Department of Education has named Basalt High School teacher Leticia Guzman Ingram as its 2016 Colorado Teacher of the Year, according to a press release.

Ingram is the school’s English language development coordinator, and a history and math teacher.

Interim education commissioner Elliot Asp said Ingram was selected for the honor based upon her experience, passion and ex-

pertise with English learners and their families. He said she demonstrates excellence in all levels: she has an outstanding rapport with her students, colleagues, parents and administrators, while also contributing to world communities when she works with Teachers Across Borders.

“She constantly strives to perfect her craft and her impact on the community is immeasurable,” Asp said. “She creates a classroom where students from different backgrounds feel safe to practice together

and learn together.”

As Colorado Teacher of the Year, Ingram will get many professional development opportunities through the National Teacher of the Year program, get to attend a ceremony at the White House and go to Space Camp in Huntsville, Ala. for a week. Roaring Fork Valley groups consider prescribed burns Sopris Sun Staff Report A group of six local organizations are exploring the possibility of conducting a prescribed fire in the upper Hunter Creek Valley in the spring of 2016, according to a press release. The project originated with the Hunter-Smuggler Cooperative Plan, which was finalized in early 2014 and seeks to improve wildlife habitat, forest resiliency

and recreation in the Hunter Creek Valley and surrounding landscape.

The goal of the prescribed burn is to improve wildlife habitat, restore the historical fire regime and decrease the risk from a catastrophic wildfire. The collaborative group includes, The Aspen Fire Department, Aspen Center for Environmental Studies (ACES), Wilderness Workshop, Pitkin County, the

city of Aspen and the White River National Forest. “It’s rare to see a diverse group like this all pulling toward the same goal,” said Will Roush Conservation director at the Wilderness Workshop. “We’re excited that so many partner organizations are working together to restore fire to the landscape and reduce the risk posed by catastrophic wildfire.”

New lighting technology prompts ordinance review

By John Colson Sopris Sun Staff Writer Town staffers are hard at work revising and updating Carbondale’s exterior lighting ordinance, with plans to unveil the draft of a proposed new law at a meeting of the Planning and Zoning Commission at on Nov. 12.

The changes come at the direction of the town’s Board of Trustees, who have expressed concern that the current lighting ordinance is out of date and difďŹ cult to enforce, at least partly because new lighting technology has changed the way lights on one building or facility can affect the neighbors of that facility or infringe on enjoyment of the starďŹ lled night skies above town.

In particular, said Trustee Katrina Byars, town ofďŹ cials have concerns about a sign along Highway 133, in front of the former Roaring Fork Physicians building that now houses a church and preschool, which some believe is overly bright at night.

Referring to the LED lighting technology, Trustee Frosty Merriott declared, “I think they’re really obnoxious, quite frankly, and distractions to drivers. We need to get that ďŹ gured out. We don’t need ďŹ ve or 10 or 20 of these in Carbondale. And we don’t have anything that really addresses that kind of lighting right now.â€?

The revision process is being overseen by town planner John Leybourne, who sent a

copy of the draft revisions to The Sopris Sun on Tuesday with the proviso: “At this point it is not public, as there are going to be changes before it goes to the P&Z (the planning and zoning commission).�

In general, the revisions are intended to keep town ordinances in step with “new technologies in lighting (that) have resulted in higher-efďŹ cacy light sources (lumens per watt),â€? according to the draft.

And while the ordinance, as it stands now, means to encourage the use of newer, higherefďŹ ciency lighting technology in town, it also is intended to “recognize that control of glare, light trespass and (light) pollution, and reduction of energy consumption are criticalâ€? to citizens’ enjoyment of the night sky as well as to the town’s commitment to environmental activism and energy conservation.

In its current form, the ordinance would set up lighting “zones,� with restrictions meant to prevent exterior lighting from adversely affecting the natural environment, neighbors and other inadvertent results that might cause unwanted disturbances.

One section of the draft ordinance deals with the phenomenon of motion-detectors that turn on outside lights, often as a security measure, that can in some circumstances cause annoyance to neighbors or project an unwanted amount of light into the night sky.

P&Z presents UDC’s ďŹ nal chapter

By John Colson Sopris Sun Staff Writer Carbondale's Planning & Zoning Commission on Oct. 29 at 6 p.m. will start going over the ďŹ nal segment of the ongoing creation of the UniďŹ ed Development Code (UDC), a consolidation and updating of the town's development review regulations. The meeting is designed to introduce Module 3 of the UDC to the public.

Module 3 is the latest and ďŹ nal section of the UDC, which has been in the works for about two years, and is what John Leybourne, one of the town's planners, acknowledged is “the 'meat' of the UDC as it pertains to setbacks, building heights and such.â€?

The draft Module 3 is available for public review, as are other modules and documents involved in the UDC effort, by visiting the town's website (www.carbondalegov.org) and then clicking on

the UDC button in the lower left corner of the site's home page.

As described in the cover letter for Module 2, this section covers the potentially controversial topic of “development standards,â€? which includes “how the land itself is protected or modiďŹ ed, where development takes place on (a) site, how the buildings are designed, how the (land) use is operated, etc.â€?

For example, the UDC proposes to set new standards for “sensitive area protection,� with rules intended to ensure that “development should be environmentally sensitive and protect natural site features to the extent possible.�

Module 3 also recasts the existing open-space standards, which the cover letter calls “unclear� because “the open space standards in the existing Carbondale code are confusing and scattered� in different parts of the town's regulations.

“It generally is unclear (about) the purposes that open space is intended to serve,” the cover letter continues, “whether such spaces must be dedicated (to public ownership), how much is required, what areas may count as open space, and how such spaces are to be maintained.”

Other subjects include “transportation and connectivity,” design standards for commercial and residential structures, off-street parking requirements, and lighting and signs.

In the “general standards for all residential development,” the document proposes controls on such matters as the allowable maximum size of an attached garage door and the space behind it (depends on the size of the lot, the size of the house and the size of the facade of the house).

In diagrams, graphs and narrative text, the UDC outlines a range of different parameters that would guide development in Carbondale if the document ultimately is adopted, such as setbacks, building design (including the minimum allowable dimensions of bedrooms and courtyards in multi-family projects), and building heights.

Concerning the historic commercial core (HCC) along Main Street, the UDC states flatly, “The HCC height limits in the existing ordinance are confusing and unnecessarily complex.”

With variable height limits dependent on, for example, a building's orientation to Main Street, and “incentive” options under certain circumstances that allow a greater building height, the current codes are not effective, according to the UDC. Instead, the UDC proposes a 27-foot height limit for all buildings within 20 feet of Main Street, and a 35-foot limit for buildings 35 feet or more from Main Street, partly to allow sunlight to hit the street in the winter months to prevent snow buildup.

Adjustments would be allowed under the UDC, but the document sets a 42-foot height limit, period, on any building within the HCC zone.

Some aspects of the Module 3 present a daunting volume of proposed rules and regulations, as have the previous modules.

The Module 3 chapter on Development Standards, for example, runs to 114 pages, and the chapter on Definitions is 43 pages long.

But the Module 3 chapter on Subdivision is only seven pages long because the Clarion Associates’ consultants concluded that most of what is in the existing subdivision regulations can be retained with only minor changes.

According to head planner Janet Buck, the UDC is scheduled for final adoption by the Board of Trustees in March of 2016.

Trustees like RFTA’s new ACP language

By John Colson Sopris Sun Staff Reporter The much-debated, at times heavily criticized Access Control Plan (ACP) for the Rio Grande Trail right of way, stretching from near Aspen to Glenwood Springs, is back before the various local governments up and down the Roaring Fork Valley, and Carbondale officials have said the latest version of the ACP is a considerable improvement over the initial version.

“It created a little more flexibility,” said Carbondale Town Manager Jay Harrington in a recent interview, referring to the Roaring Fork Transportation Authority’s apparent planning direction in the ACP. “I think the term we’d use is, ‘they’ve softened the language’” with regard to wishes by municipalities, counties and private property owners who want to cross the right-of-way in one form or another, Harrington said.

The 34-mile corridor known as the Rio Grande Trail has been owned by RFTA and its predecessor entities since the 1990s. The right-of-way has been the subject of numerous planning documents by RFTA over the years, all with an eye toward preserving the right-of-way for continued use as a pedestrian and bicycling trail, or for the possible resumption of rail service.

The agency is working to preserve the Rio Grande right-ofway under rather strict guidelines and regulations promulgated by the federal Surface Transportation Board. The STB has set up a “rail banking” method for preserving abandoned rights-of-way for possible future rail service, and the stringent requirements of rail banking and restrictions in the number and types of crossings are what are driving the current dialogue about the ACP.

The letter Harrington last week provided a letter sent by Carbondale on Sept. 25 to RFTA assistant director Angela Henderson, shortly before RFTA released the latest revised ACP on Sept. 30.

The letter, from Carbondale Public Works Director Larry Ballenger, outlined some of the town’s continuing concerns about the ACP. In that letter, Ballenger noted that the wording of the ACP concerning crossings of the old right-of-way could be a problem.

The relevant section, according to Ballenger’s letter, declared that federal guidelines aim to “reduce the total number of at-grade crossings by 50% by eliminating or consolidation of at-grade crossings to preserve RFTA’s corridor . . . .”

That arrangement, Ballenger wrote, “would severely limit and restrict growth and development in communities along

the corridor as well as property owners along the corridor.”

Another section of the ACP stated that RFTA hoped to stick with a policy of only permitting private crossings and utility crossings under revocable licensing that could be terminated with only a 30-day notice from RFTA. “It would be difficult, if not impossible, for a public or private utility to operate on a 30-day encroachment license,” Ballenger wrote in part.

One point of concern Harrington told The Sopris Sun, is the juncture where North 2nd Street crosses the Rio Grande Trail.

A street that parallels the trail, leads into land owned by the Nieslanik family, which is the potential site of a residential elder-care center that would use the North 2nd Street crossing of the Rio Grande Trail, as its primary access route.

The town is investigating the potential costs of upgrading that street and that crossing, and is concerned about how the crossing might be affected by any new guidelines or requirements in the ACP. “I think, long-term, we’re going to need to do improvements at that crossing,” said Harrington in a recent interview.

Possible conflict Another possible point of conflict, Harrington said, is the town’s interest in extending Industry Way from Highway 133, across the Rio Grande Trail and through to 8th Street. No right-of-way exists at present for a crossing of Industry Way at the Rio Grande Trail, Harrington explained, and a restrictive attitude on the part of RFTA and the ACP could be problematic, he said.

But, he added, “They (RFTA) have been pretty good (about) going line by line to make changes” in the ACP that are acceptable to Carbondale.

At its meeting on Tuesday night, the Board of Trustees concluded that while negotiations between RFTA and the town seem to be progressing acceptably, the rail-banking restrictions may not be the best way for those negotiations to continue.

Rather, the trustees agreed, the town’s talks with RFTA should seek another avenue of approach to crossings than the restrictive rail banking program, although there was no certainty among the trustees about whether another avenue exists or what it might be.

The trustees directed town staff to include those concepts in another letter from the town, to be delivered to RFTA in time to make the Oct. 30 deadline for public comment.

Mayor Stacey Bernot predicted that the ACP will continue to undergo revisions for some time, and that there will be more opportunities for negotiations and formal comment by Carbondale and other governments up and down the Roaring Fork Valley.

Lighting om page 13 The draft ordinance also offers an “on-site review” by town staff to determine if the lighting outside a particular home, business, school or other facility is in compliance with the town’s lighting law.

Evidence of the difficulty the planning staff faces, as they try to evaluate and rewrite the 22-page existing ordinance, is at the bottom of the final page.

Following four pages worth of definitions, explaining some of the more obscure terminology contained in the draft document is a line of text in blue that states, “The definitions were pretty weak, so I started over.”

The P&Z public hearing on the draft ordinance is scheduled to be held at Town Hall, 511 Colorado Ave., Carbondale, CO at 7 p.m. on Nov. 12.

Copies of the proposed ordinance are to be on file and open to public review in the Planning Department office at Town Hall.

Along the way Every fall, the Nieslanik families’ cattle are escorted back to the lower 40 (give or take) from summer pasture on BLM land.

On Tuesday, after sorting, counting the cattle and a quick lunch break, the group (including humans on horseback, cows and dogs) left the sorting pens and headed down through town to their winter digs. With the exception of a few stops along the way to drink or contemplate whether or not to trespass, it was a pretty smooth drive.
