Marijuana ordinance taking shape

aced with a state-mandated deadline of Oct. 1, the Carbondale trustees are moving closer to nailing down a licensing ordinance to regulate the retail marijuana trade that Colorado voters authorized when they approved Amendment 64 last November.

Among the consensus agreements reached at Tuesday night’s meeting: • The trustees will cap the number of retail marijuana stores to five, at least temporarily; • All four categories of the marijuana industry now allowed under state law will be allowed in Carbondale: retail sales, cultivation, manufacturing and testing; • The ordinance will prohibit marijuana establishments from opening within 500 feet (as measured by pedestrian routes) from schools, daycare centers and other marijuana outlets; • The trustees will amend the town’s criminal code to address public consumption of marijuana.

The trustees indicated the public consumption amendment will be patterned after the town’s open container law, which prohibits drinking alcohol in parks, streets and other public places.

Police Chief Gene Schilling told the trustees that public smoking has not been a big problem since Amendment 64 went into effect. With small amounts of marijuana possession now legal in Colorado, and nothing on the books in Carbondale about smoking it in public, Carbondale police have been left with having to ask smokers to put out their joints or to take them home.

What VelociRFTA is all about

By Dan Blankenship and Jacque Whitsitt Questions have arisen lately about the VelociRFTA bus-transit-system construction projects under way throughout the Roaring Fork Valley.

Some might have forgotten that, in 2008, the Roaring Fork Transportation Authority asked the region’s voters to approve a 0.6 percent sales tax increase and $44.5 million in bonding authority to provide funding for the VelociRFTA busrapid-transit project and other capital improvements.

In 2008, RFTA’s ridership soared to a record 4.85 million passengers. There was an epic snow year, and gas prices exceeded $4 per gallon. Throughout much of the year, there was standing room only on RFTA’s commuter-bus services. Riders who experienced the overcrowding understood that fuel prices were likely to spike again and that the capacity and convenience of RFTA’s transit services needed improvement. That’s why voters said “yes” to the VelociRFTA bus-rapid-transit plan even though the economy was melting down.

For the past five years, RFTA has been working to deliver on the promises it made to voters. The VelociRFTA project includes 13 new bus-rapid-transit stations at eight locations, three new park-and-ride facilities and 18 new compressed-naturalgas, low-floor buses. The project has put hundred of people to work in our valley at a time when the construction industry has been hard hit by the recession.

The VelociRFTA stations, which will open Sept. 3, are attractive, functional and built to last 30 years or more. RFTA worked for many months to determine what local communities desired in the bus-rapid-transit system and came up with features that live up to those expectations.

The community wants enclosed waiting areas, covered bicycle storage and outdoor seating along with design, safety and technology enhancements. To provide security, emergency call buttons are available at every station. Space was required within the stations to house ticket-vending machines, real-time-passengerinformation signs, electronic equipment and bus-schedule information. Most of the expensive equipment is stored within the stone icon that bears the RFTA name and lets everyone know the VelociRFTA bus-rapid-transit service can be found – seriously, it’s not a fireplace! The station platforms are level with bus doors so that passengers can get on and off the buses more easily and rapidly.

Bus rapid transit offers the reliability, convenience and efficiency of rail service by using an array of intelligent transportation-system technologies. RFTA’s new global positioning systems will allow riders to monitor the arrival times of buses, in real time, throughout RFTA’s 70-mile service area. Passengers can use computers or smartphones to find out when the next bus will be arriving at their stop. WiFi will be available at the bus-rapid-transit stations and on the VelociRFTA buses. Discounted bus passes will be dispensed by ticket-vending machines at the stations.

The hallmark of the VelociRFTA bus-rapid-transit service will be its convenience.

Depending on the season, service at bus-rapid-transit stations will be provided every 10 to 12 minutes during peak hours and every 15 to 30 minutes during non-peak hours over major portions of the day. Bus-rapid-transit service also will be available on weekends during the winter and summer. The anticipated travel time on VelociRFTA buses between Glenwood Springs and Aspen will be about one hour.

The financing was kicked off by the region’s vote of support in 2008 and RFTA’s application for a Federal Transit Administration Very Small Starts grant. In 2011, after successfully completing the FTA’s rigorous and competitive Very Small Starts Project Development process, RFTA was awarded a $25 million grant, which required our local match of $21.2 million. In a few short weeks, RFTA will hold the distinction of becoming the nation’s first rural transit agency to implement a busrapid-transit system.

It has been a privilege for the RFTA board and staff to bring the VelociRFTA vision to life. You can familiarize yourself with VelociRFTA by riding free Sept. 3 through 6. Try walking or riding your bicycle to a VelociRFTA station to get some exercise, reduce auto-congestion and conserve energy. Check out the bus-rapidtransit stations, plop on an egg, hop on a bright-blue bus, and discover the liberating feeling you can get from a frequent dose of VelociRFTA DNA (don’t need autos)!

Your voice and the state water plan

By Gail Schwartz On May 14, Governor Hickenlooper signed an executive order directing the development of the first long-term State Water Plan by and for Coloradans. The “gap” between our water supply and demand is of critical concern today and in the future. This planning process will be the foundation of a larger discussion about water needs and allocation. I recommend that all Coloradans engage in this important effort.

The state water plan will pave the way for water decisions that responsibly and predictably address future challenges. The governor’s executive order detailed that the plan must promote a productive economy that supports vibrant and sustainable cities, viable and productive agriculture, and a robust skiing, recreation and tourism industry. It must also incorporate efficient and effective water infrastructure planning while promoting smart land use and strong environmental protections that include healthy watersheds, rivers and streams, and wildlife.

The Colorado Water Conservation Board (CWCB) has been tasked with creating the Colorado Water Plan. The board must submit a draft of the plan to the governor’s office by Dec. 10, 2014, and a final plan by Dec. 10, 2015. The CWCB will incorporate the state’s Interbasin Compact Committee (IBCC) and nine Basin Roundtables recommendations to address regional long-term water needs.

As chair of the Interim Water Resources Review Committee (WRRC), I will help ensure that the diverse voices of Colorado’s water community are heard during the development of this plan. The 10-member WRRC is comprised of legislators representing districts in each of the state's major river basins. The committee has a full agenda as we are charged to review water issues and propose legislation. The WRRC will also remain actively engaged with the CWCB in development of the State Water Plan.

A recent public opinion survey on water issues in Colorado indicated that only 30

percent of Coloradans believe the state has enough water to meet its current needs.

Furthermore, nearly 70 percent of Coloradans indicated they believe there is insufficient supply for the next 40 years.

Stakes high in school testing debate

By Debbie Bruell Sopris Sun Correspondent At the same time that discontent with U.S. educational policy is mounting, our local school district is preparing for a visioning process for the community to explore and define what we want locally for the education of our children. The Sopris Sun is running a series of articles that addresses some of the key concepts at the center of national and local discussions about educational reform. This article is the second in that series.

The first article addressed the concepts of educational standards and assessments – two basic elements of education that have come to be defined very narrowly in recent education policy and dominate the government's approach to school reform. This article looks more closely at how No Child Left Behind has made state-mandated standards and standardized testing the focus of U.S. education policy and some problems with this “test-and-punish” approach.

No Child No Child Left Behind (NCLB), signed into law in 2002, required every state to create a set of standards — the basic level of knowledge and skills that every single child should be able to achieve at each grade level — and select a standardized test that would measure each child’s proficiency level on these standards. States were required to test every child, every year, from third through eighth grade (with increasing testing requirements in subsequent years).

States were given until the year 2014 to get every child proficient on all math and

English standards. For every year that a school or a district did not make “Adequate Yearly Progress” (AYP) toward this goal of 100 percent proficiency, they would face a series of increasingly severe punishments — from being publicly scorned to having the school shut down.

Some common criticisms of NCLB’s narrow focus on high stakes standardized testing include the following: 1. The standardized tests begin to drive the instruction, rather than focusing on what’s best for kids.

Skills that cannot be tested by standardized test (such teamwork or oral communication skills) as well as subjects that are not included on the tests (such as history, science or the arts) tend to become less valued as part of the learning experience simply because they are not on the test. Getting good test scores often becomes the primary goal rather than focusing on engaging students or “sparking” their curiosity.

2. NCLB focuses on the basic, necessary level of achievement, rather than higherlevel thinking skills.

While making sure that every child learns the basics of reading, writing and math is certainly an important goal, many

critics have noted that children need much more than a minimum level of reading, writing and math, especially to succeed in the 21st century.

3. In many states, teachers have been held accountable for teaching such a huge number of standards that it is overwhelming and stifling.

Teachers are generally told, “The standards define what you have to teach, not how you teach it.”

However, if a teacher has more than 100 standards to teach in one subject area, and is required to report on each standard for each child, teachers have little time to do anything besides plow through the standards as quickly as possible.

Creative and handson learning experiences, as well as delving deeply into long-term projects, have become less Sir Ken Robinson common simply because they are considered more time-consuming.

A few years ago, a fourth-grade teacher in Re-1 was required to teach and report on over 100 “Essential Learner Objectives” just for reading and writing. (As will be discussed later, this number has been greatly reduced.)

It is largely inner-city schools in low-income communities of color that are getting shut down. Rather than being provided with the resources they need to succeed, they are being replaced with privately run schools receiving public funds. In some cases these privately run schools are getting lower test scores than the schools they replaced. (The charter schools in our community, Carbondale Community School and Ross Montessori School, are not run by private corporations.)

5. Huge expenditures of resources — public funds as well as teacher time — are being spent on testing.

According to a study by the Piton Foundation, in the year 2005 alone, nearly $25 million was spent on implementing Colorado's standardized test — the CSAP (Colorado State Assessment Program).

Many critics point out that re-directing those resources to publicly-funded preschool, all-day kindergarten and/or teacher training programs would have a much greater impact on improving the education of our children.

Eliminate testing?

Given the above criticism of high stakes standardized testing, does that mean we should completely eliminate standardized testing? While both Superintendent Diana Sirko and Assistant Superintendent Rob Stein have concerns about how standardized testing has been used through NCLB, they also see some value in high-quality SCHOOL TESTING page 5

Stein told The Sun in an interview earlier this year that some form of standardized testing is important so that truly ineffective schools can be “red agged.â€? He gives the example of a Boston school he worked with years ago that was “frightening: kids weren’t learning, teachers weren’t teaching, it was an oppressive, racist environment.â€?

Aside from such extreme cases, Stein also notes that high quality standardized tests can be useful for all districts in terms of helping them identify speciďŹ c areas in which students are not performing as well as they could be.

Stein noted that standardized tests have helped our district identify college-readiness as an area in need of improvement.

According to Sirko, another useful role for good standardized tests is to enable parents to compare their children’s progress to children across the state or the nation so that parents can be assured that their children are gaining the essentials they need to be successful beyond their individual school district.

Even some of the sharpest critics of U.S. public education speak about the important role that good standardized tests can play as part of an educational system. For example, Sir Ken Robinson, a leading speaker on the

power of imagination and creativity, who gave the most-watched Internet TEDtalk on how“schools kill creativity,â€?states in a recent TEDtalk:“Testing is important. Standardized tests have a place. ‌ They should be diagnostic.â€?

Robinson also clariďŹ es that standardized testing “should not be the dominant culture of education ... It should support learning, it shouldn’t obstruct it, which of course it often does.â€?

Other education experts note that the key beneďŹ ts of standardized tests could be gained by simply testing a sample of students each year and/or testing just two to three times before high school graduation, rather than testing every student every year. Many countries which rank high on international assessments use this sampling approach.

In spite of the challenges associated with high stakes standardized testing, there are examples of innovative, inspiring and highachieving public schools across the country.

Future articles will explore some of the alternatives being proposed nationally to address the shortfalls of NCLB and whether it is possible to follow state mandates regarding high stakes testing without letting them dominate the shape of our schools.

Department heads have turned in their preliminary budgets for 2014, according town manager Jay Harringtonâ&#x20AC;&#x2122;s weekly report, thus setting in motion a process that usually stretches into December.

A sampling of other items from the Aug. 16 report include: RFTA scheduled a meeting to discuss the bus stops on Main Street and the feeder bus system next Thursday.

The town received a complaint about the streetlights at the new library not working. The townâ&#x20AC;&#x2122;s electrician was assigned to sort out the issues associated with the streetlights.

CDOT has reimbursed the town for one half the cost of the Access Control Plan, which the trustees approved several months ago.

Arnold wins 100 miler What did you do last weekend?

Ashley Arnold, a Carbondale local, went out and won the women’s division of the Leadville 100 Trail Race, according to the iRunFar.com website. Arnold posted a time of 20 hours and 25 minutes; second place finisher Shaheen Sattar was 2 hours and 17 minutes behind. The race, now in its 30th year, is an out-and-back from the historic mining down, with elevations from 9,200 feet to the Hope Pass summit at 12,600 feet.

Most of the route is on forest trails and mountain roads. After the race, Arnold told iRunFar’s Byron Powell that she’d had coffee with Zeke Tiernan the day before leaving for the race, and he told her “At some point, you’re going to think ‘why am I doing this. I’m going to quit.’” Arnold then told Powell that at one point she thought she really should quit due to an upset stomach brought on by not drinking and eating enough. But at the halfway point at Twin Lakes, she saw her crew cheering her on and kept on going “ … I really focused on eating (from then on).” Arnold said of her crew “I couldn’t have asked for a better crew. It was amazing. My pacers are amazing.”

On Red Canyon’s fire lines with Garrett Kennedy

By Nicolette Toussaint Sopris Sun Correspondent Garrett Kennedy was enjoying his day off on Aug. 12 when the phone rang. At around 1:30 p.m., a wildfire had broken out along County Road 115, approximately three miles southeast of Glenwood Springs. Within about 45 minutes, Glenwood Springs and Garfield County firefighters knew they needed help battling the blaze. The Carbondale Fire District got a call and so did Kennedy.

That day, Kennedy, who is a firefighter and paramedic, dealt with seven other issues: “car wrecks, smaller fires and rescues,” including an injury due to a fall in Marble.

Those problems don’t hold off when there’s a big blaze like the Red Canyon fire.

But by 6 p.m. on Monday, Kennedy says that the Red Canyon fire had “grown to about 150 acres, and people could see it from here. We were getting calls from all over.” Kennedy handled calls, dispatched crews and equipment until around 10:30 that night. He was back at 6:30 the next morning for what turned out to be a scorching day.

Kennedy’s crew of six — including Carbondale firefighters Ron Kroesen, Logan Piccolo, Tom Morelli, Ken Clark and Adam Bugner — went up County Road 115, joining more than 60 men and women dispatched from all over the Roaring Fork Valley, and even from towns as distant as Fruita, Montrose and Golden.

“Tuesday started off slow. We had a fire line around the blaze,” Kennedy recalls. To create a fire line, crews cut brush and trees with chain saws, then dig a trench at least foot wide.“For us, the job was mostly pulling hoses, finding hot spots, digging them up and squirting water on them. Making sure the fire didn’t get outside the perimeter.”

But it did.

Bringing community together A good time was had by all at the annual KDNK Blues & BBQ fund-raiser, which took place last Saturday at Fourth Street Plaza park. The Goat restaurant catered the event and had an array of sumptious eats from which to choose, although it appears here as if co-owner Stacey Baldock can’t quite believe what this customer asked for. Meanwhile, as Shannon Muse danced to the sounds of the Stevie Ray Vaughn tribute band Double Trouble, some kids were obviously having fun and enjoying the music … while others apparently did not.

Norwoods look forward to gallery’s 32nd year

By Will Grandbois Sopris Sun Correspondent Frank Norwood came to the Roaring Fork Valley in the 1970s to sell his whimsical etchings in Aspen. He was joined by Sally Snyder in 1979, when he was living in a log cabin (now the Mount Sopris Historical Society museum) on Hendrick Ranch outside of Carbondale.

The economy went south in the early 1980s, and Frank and Sally made ends meet framing art out of their little home. The enterprise proved a success so they opened The Framer in an upstairs room of the historic Dinkel building in 1982 and were married the following year.

Thirty years ago, the town was home to about 2,000 folks, many of whom were coal miners with a smattering of ranchers and others, but the seeds of the arts community to come were already beginning to sprout.

The Norwoods shared the top floor with the Carbondale Council on Arts and Humanities (a budding organization that at that time was dedicated mostly to putting on Mountain Fair), Mary Matchael’s glass studio, Liz Phillips’ jewelry shop, KDNK (which owes its call letters to the building and was originally broadcast directly from the radio tower on the side), and Wally Bacon’s guitar shop.

With the subsequent renovation and opening of the Crystal Theatre downstairs, John Toly and Jim Darien, who each had upstairs apartments in the building, quickly found themselves at the epicenter of the town’s growing cultural scene.

The Norwoods’ aspirations were growing and they soon found themselves looking for a bigger space. At that point, The Framer became Main Street Gallery and The Framer, highlighting some of Frank’s own etchings as well as prints by other artists.

cation at Fourth and Main. In 1990, they opened a shop in Glenwood Springs and in 2000 moved it to a prime location downtown at 817 Grand Avenue The Main Street Gallery and Framer now occupies more than 3,000 square feet of gallery and shop space in the two towns.

Their Glenwood location is managed by Nancy Page, who has been with the business for 21 years, with the help of Virginia Gera for the last 10. Cate Tallmadge, who assisted Frank and Sally when she was a senior in high school, recently returned to The Main Street Gallery and the Framer from the Art Institute in Chicago, Frank said she has been a tremendous asset at the Carbondale location.

At their location at 399 Main, just across from the Dinkel Building and the Fourth Street Plaza, the Norwoods are at the center of everything. Right now, you can check out works by Dean Bowlby, Stephen Datz, Daniel LogĂŠ, Charles Morris, Mary Noone and many more. Frankâ&#x20AC;&#x2122;s prints are still for sale, and several of the original plates are on display as well. One wall showcases a wide variety of frames, and their back room hosts an array of equipment â&#x20AC;&#x201D; quite a contrast to the 7-inch table saw they started out with.

Carbondale continues to grow, but with the help of their staff, Frank and Sally say they have been able to keep up with the expanding community and its art scene. Now that Tallmadge is on hand to help run the gallery, Frank says he has even started working on new etchings for the ďŹ rst time in a decade.

As charged, the water plan has a broad scope and will inevitably need to address difďŹ cult and contentious issues. I believe that we should ďŹ rst focus on conservation and efďŹ ciency both at the municipal/industrial level and in agriculture. Water conservation is an area with broad consensus. A recent public opinion study of Coloradans identiďŹ ed conservation as the most important water related issue. Other studies have strikingly demonstrated that 80 percent of Coloradans favored conservation over new construction projects. In 2013, I sponsored SB13-19, which gives landowners a new tool to conserve water without injuring their water rights. New conservation and efďŹ ciency tools are needed in the State Water Plan as they stress wise use of our precious water resource.

Conservation may be just one piece of this larger puzzle, and I want to hear what pieces are important to you. The dialogue around the State Water Plan is a critical discourse to ensure the protection of Western Slope water, reduce the â&#x20AC;&#x153;buy and dryâ&#x20AC;? cycle on our agricultural lands and demand responsible urban and industrial use.
