Count commissioners surrendered Dear Editor: As a former Garfield County commissioner and State Oil and Gas (COGCC) commissioner I feel compelled to respond to an article in the July 25 Post Independent, entitled, “Sullivan critical of county’s revision for O&G facilities.” I agree with Mr. Sullivan’s concerns and I am outraged.

By adopting a regulation that makes all “on and off-pad” facilities a “use –by- right,” Commissioners Jankovsky, Martin and Samson have taken away our rights as property owners in Garfield County to formally challenge industrial activity that will impact our land values, businesses and quality of life. They are blatantly disregarding their oath of office.

The Garfield County commissioners have completely surrendered their land-use authority to the oil and gas industry. In effect, they have said “any and all uses of land in Garfield County for purposes related to oil and gas activity, no matter what impacts they may have on others, are acceptable and we don’t even need to listen to those that may think otherwise.”

County commissions and the COGCC

play very different roles in Colorado. The COGCC is responsible for regulating the technical side of developing oil and gas, and counties are responsible for regulating landuse. Typically in Colorado, county land-use codes require an application process for the establishment of facilities that support drilling. In most cases a public hearing is required, allowing an opportunity for the public to voice their support or concerns. These facilities include: compressor stations, water treatment facilities, tanks, pipelines, roads and any other facility supporting development.

But by making all “on and off-pad” facilities a “use by right,” the Garfield County commissioners have eliminated any opportunity for Garfield County residents to formally voice their concerns.

It is time for responsible leadership in Garfield County. We need a county commission that will represent all of its constituents, including individuals, landowners, business owners, the agricultural, recreational, and tourism industries, royalty owners and the oil and gas industry — not just the oil and gas industry.

Vote for me Dear Editor: Hello, my name is Sue Franciose and I’m running for Eagle County coroner in the upcoming Nov. 4 election. During the campaign process, I’ve had the opportunity to meet a lot of residents that have similar questions. I’d like to take this time to answer these questions and clarify some areas.

Where did the coroner’s role come from?

The office of coroner was formally established in England in 1194, to “keep the pleas of the Crown (Latin, Coronae).” “Coroner” referred to an officer whose job was to determine how and when a person died and to collect taxes. In more recent history, the coroner was seen as an unbiased, non-political position, and in many states, given the authority to arrest the sheriff, providing a check and balance system.

2. What are the qualifications to be a Colorado county coroner? The requirements for a Colorado county coroner are: A high school diploma, no felony conviction and must reside in the county. Many Colorado county Coroners have NO medical background.

FRIDAY July 31 At 1:05 a.m. police responded to a report of a bear on Capitol Ave. They were unable to locate the bear.

THURSDAY July 30 At 2:26 p.m. police responded to Eighth Street in regard to allegations of ordinance violations for growing and storing marijuana. An officer contacted a citizen and said a building and zoning official will be in touch to resolve the issue.

By Lynn Burton Sopris Sun Staff Writer Here is how an 1889 Aspen Weekly Times article covered what might have been Carbondale’s last official “shindig.” The headline read “An Old Time Shindig,” with a “Special correspondence” byline and “Carbondale, Jan. 26” dateline. The article read: Last night the social hop given at their pleasant home by Mr. and Mrs. Oscar Holland proved to be one of the most successful social events of the season. The dancing hall was beautifully wreathed in evergreens. The entertaining couple proved to be adepts (sic). The supper was superb, with all the delicacies from home and abroad. Davis Harris’s string band furnished the music. Dancing continued until six in the morning, when breakfast was served, after which the

finishing dances were had.

Among those in attendance were: Mr. and Mrs. Chas. Fravert, Mr. and Mrs. Alex Thompson, Mr. and Mrs. E.D. Hill, Mr. and Mrs. Chas. Sewell, Mr. and Mrs. Oscar Holland, Mr. and Mrs. Wm. Campbell, Mr. and Mrs. Geo. Alcorn, Mr. and Mrs. M.H. Dean, Mrs. Rogers and Mrs. Harris; Young ladies: Nellie Alexander, Cora Camp, Edna Denmark, Bertha Perham, Jennie Wald, Lottie Thompson, Norise Moriarity, Nevad Alexander, Lura Tucker, Mabel Nurnberg, Lizzie Woodward, Anna Wald, Verne Cox, Sadie Nicols, Allie Barber.

Although not acknowledged in the article, Hattie’s greatnephew, Lew Ron Thompson, is confident that young men also attended the party. “She (Hattie) was a matchmaker,” Thompson told The Sopris Sun last Saturday, while he and Mt. Sopris Historical Society Director Beth White spruced up the 129-year-old brick house for this Saturday’s official Shindig. “That’s one reason they had these parties.”

Horse poop takes center stage in Redstone

By Lynn Burton Sopris Sun Staff Writer It’s the Code of the West: • Never try on another man’s hat; • Never pass anyone on the trail without saying “howdy;” • Remove your guns before sitting down at the dinner table; • Cuss all you want, but only around men, cows and horses.

There are other important provisions in the unwritten Code of the West, but they broadly encourage hospitality, fair play, loyalty and respect for the land.

Yep, ma’am, we all live in the west, including Redstoners, so we’re all subject to the Code of the West to one degree or the other. That’s one reason the issue of horse poop on the road (aka “road apples”) has surfaced in Redstone.

Word has it, someone recently put a flyer on everyone’s front door who lives on Redstone Boulevard, urging them to attend the Aug. 5 Redstone Community Association to discuss: • “Banning horses without bun bags from The Redstone Blvd. because of the horse manure not being picked up by Riders;” and

9 p.m. on Aug. 9.

A partier from 1889 would probably feel comfortable at the 2014 Shindig. Thompson will start a fire early on Saturday in a brick-lined pit on the grounds, then load in plenty of beef, cover the pit with its heavy steel top, then spread sand on top – just like pit barbecue was cooked in the Old West.

With the sand sealing the pit, the fire soon goes out but the heat is retained, which cooks the beef (or whatever else is in here) “just right.”

The Thompson House lawn, kept alive and thriving with untreated irrigation ditch water, is thick and green, and probably looks much like it would have when Oscar, Hattie, their family and friends walked on it 125 years ago. At Saturday’s Shindig, there’ll be lawn games and tents in case it rains. Much of the property’s original wrought iron fence still rings the property. The stage will be set up in the northwest corner of the lawn, just this side of the fence, with tables in front of that.

The musical lineup features Steve Skinner & the Thompson Dividers, the Carbondale Rhythm Collective, Valle Musico, Sharon Young and Dory Light, and Jack Lanning.

Throughout the evening, Bill Kight will stroll the grounds as Jasper Ward, a Colorado pioneer who moved to the state as a freighter, then went on to become a town marshal in Tincup, saloon owner and preacher, and in there somewhere became the first settler in what is now the New Castle area. On stage at 8 p.m., Kight will tell Ward’s story the way that Ward himself would tell it.

Throughout the evening, the MSHS will conduct guided tours of the downstairs and upstairs of the historic Thompson House. The home’s furnishings are original to the house and many date back to the time of its construction. On the back porch, there’s even what was back then a new-fangled device – a washing machine.

After Oscar’s death in 1920, Hattie continued to run Pleasant View Ranch, which covered more than 1,000 acres of what is now River Valley Ranch and parts of south Carbondale. She also traveled the world and brought home many treasures. To honor Hattie and Carbondale-area women, the MSHS will also present its inaugural Hattie Thompson award to a recipient who embodies her spirit.

The Thompson House Museum is technically located at 633 North Bridge Dr. at the north end of River Valley Ranch.

Federal lawsuit targets cops aer “shooter” drill

Come to find out, the Redstone Community Association’s Aug. 5 meeting has been rescheduled to Aug. 12, “ … but it (horse poop) isn’t an issue we can do anything about,” said RCA vice-chair Cathy Montgomery.

The two-page flyer asks Redstone residents to “please bring ideas” on how to help with the issues and that “Cowboys & villagers can be friends.”

Redstone apparently isn’t a one-horse town, but it is pretty much a one-road village. Redstone Boulevard runs north and south through the village, lined by houses, shops and a restaurant or two before dead-ending at the Redstone Inn – where horse-drawn sleighs have been known to park in the winter.

Besides proposing a ban on undiapered horses and gun shots within hearing range, the flyer also includes helpful information about horse poop, including: it should age for about six months before being used on gardens; and, horse manure is unlikely to spread disease to people, with human

Topless ATVer “saves” hiker In an incident that reliable witnesses describe as “even better than an Elvis sighting,” a young woman wearing nothing but a smile from her waist up was seen driving an ATV up the high road to Lead King Basin on Sunday. Come to find out, the topless ATVer fronted a band at the Mountain Fair main stage on Aug. 23, although she was fully clothed at the time. A witness called The Sopris Sun and reported his party of five humans and three dogs was descending to the switchbacks when they encountered the young woman who was enjoying the out-of-doors the way it should be. The “Party of Five,” as it’s now being called, confirmed the rare occurrence to other hikers who asked about what they thought they’d just seen. “We confirmed what they’d seen then asked them ‘Did you know you were in a topless zone?’” The topless ATVer caught back up with the Party of Five after turning around but the weather had turned cool and by then she was wearing a vest.

She asked if any of the hikers needed a ride back down and one took her up on it, saving about three miles of wear and tear on her legs and lungs.

Don’t tell anyone Because Ramblin’ Jack Elliott is coming to town, specifically to Steve’s Guitars, “In the old part of the Dinkel Building,” and living-room style seating is limited. Fit to be recognized Three Carbondale guys recently proved their fitness by winning or doing well in their age categories in an Ironman competition or Crossfit event. Let’s start with David Clark.

Clark placed first in the Men’s 55-59 age group at last weekend’s Boulder Ironman. The

event entailed a 2.4-mile swim, followed by a 112-mile bike race and then a 24-mile marathon. Clark made it across the finish line with a time of 10 hours, 25 minutes, 47 seconds. He is ranked 65th out of 2,800 athletes in his age group.

Also competing in the Boulder Ironman, Tim Mason finished third in his 65-69 yearold age group. Mason is a former chef at the Ship of Fools, Glenwood Canyon Brewpub and most recently the Pour House.

Meanwhile, at the Crossfit Games out in Los Angeles a couple of weeks ago, Mark Fischer finished fourth in his 55-59 age division.

The Carbondale Chamber of Commerce has released a map, showing how the riders in the USA Pro Challenge professional bike race will snake their way through town on Aug. 19.

The 128 CrestedButte-bound racers will enter town from Aspen at about noon, pedal west on Main Street to Seventh, turn south at the swimming pool, continue one block along Sopris Park to Euclid, turn east and continue for one block before making a hard right onto Weant Boulevard and then up to Highway 133. Road closures are expected to start at about 10 a.m., according to town officials.

The entire race takes place Aug. 18-24.

The lawsuit, filed in Denver, also names as defendants Life Care Centers of America, Inc., (doing business as Heritage Park Care Center), Colorado Medical Investors, LLC (doing business as Heritage Park Care Center), Robert Baker (executive director of Heritage Park), Jessica Varley (human resources director of Heritage Park) and Melanie Holmes (director of nursing at Heritage Park).

When contacted by The Sopris Sun, Heritage Park issued the following statement concerning the lawsuit: “Heritage Park Care

Center associates are specially trained to care for residents and patients in need of nursing and rehabilitation care. We recognize that our facility is their home, and as part of our ongoing focus on safety, we conduct routine training drills to prepare for various scenarios such as fire and natural disasters.

“In October 2013, we conducted one of these emergency preparedness exercises in conjunction with the local police department.

We have become aware of a former employee who has filed a complaint related to the exercise.

“Due to a pending lawsuit, we cannot provide further information but are working to resolve the situation. In the meantime, Heritage

Park Care Center remains focused on providing quality care to our patients and residents.”

Schilling and town manager Jay Harrington referred all questions to the Denver-based Rice, who represents the town through the Colorado Intergovernmental Risk Sharing Agency.

Rice told The Sopris Sun that Zimmerman was on duty at the time he took part in the drill at Heritage Park, that Schilling was aware of the drill, Heritage Park asked for the town’s assistance, and the town was not paid. “ … (the town) did it as a public service.”

Meeker’s lawsuit claims that “Defendants intentionally failed to disclose to LCCA employees … that the gunman … was actually a police officer and that the hostage situation was merely a drill.”

Rice told the Sun that Heritage Park did post notices of the impending drill, but it was not the police department’s responsibility to post the notices.

Meeker, the plaintiff, was hired at Heritage Park on Sept. 10, 2013.

In her detailed account of the incident, Meeker said her supervisor told her to see what a gentleman (Zimmerman) in the day room wanted, because he “looked suspicious.”

When Meeker approached Zimmerman, he told her to follow him down a hall to show her something. They came to a room, where Zimmerman pulled his jacket back, “revealing a gun tucked into the waistband of his jeans,” the lawsuit states.

“As Ms. Meeker cried and begged for her life, the man said in a hushed tone that this was a ‘drill.’”

The drill continued, with two other Heritage Park employees being drawn into the room. When the drill concluded, Meeker was escorted into director Robert Baker’s office for de-briefing.

Meeker resigned on Oct. 20.

As for shooting guns in Pitkin County, deputy Levi Borst said the county does not have an ordinance that relates to when and where it’s OK to discharge a firearm, but does enforce state statutes. Those statutes mostly address safety.

Which brings us back to the Code of the West. The code does not say anything about cleaning up after your horse, but implies that consideration for others is a central component, such as “don’t stir up dust around the chuck wagon.”

They do a scene investigation, identify the deceased, notify the next of kin, determine the cause and manner of death and issue a death certificate. An autopsy is usually required to accurately determine the cause and manner of death. The Eagle County coroner DOES NOT perform autopsies. The autopsies are

done by pathologists (MDs) and the findings or report is then sent to the coroner’s office.

The coroner’s office reports the findings to the family and issues a death certificate.

Taste of summer salads Serves 4-6

Salad: 4 cups of arugula 3 small-medium peaches, pitted and chopped 3 small beets, steamed and chopped 1/2 cup of roasted and salted almonds, roughly chopped

Dressing: 4 Tablespoons lime juice 2 Tablespoons olive oil 1 Tablespoon raw local honey or coconut nectar 1/4 teaspoon sea salt

Instructions: 1. Mix all salad ingredients together in a bowl 2. In a jar with a lid, shake together dressing ingredients 3. Pour 1/2 of dressing over salad, toss and let sit 5-10 minutes 4. If desired add remaining dressing 5. Serve and eat with joy!

High Tone Auto Body: A place to meet by accident

By S. Michael Jundt Meeting by accident isn’t always a bad thing, and for these two auto body professionals it meant the merging of both family and industry talents.

Jacob and Melissa Jones, owners of Basalt’s High Tone Auto Body, are no strangers to life’s impacts. “We literally met accidently,” says Melissa. “Jake was driving a low-profile vehicle and while slowing for a speed bump, I rear ended him.” The two became high school sweethearts and have been married for 17 years.

“We moved to the valley seven years ago from Southern California,” says Melissa.

“We wanted a better environment to raise our family in.” Daughters Audrey and Callie, 16 and 14, love the Roaring Fork Valley, and being a family that enjoys the outdoors — skiing, fishing, rafting — has proven Colorado to be their ideal choice.

“Jake worked at High Tone for six years before we purchased it,” Melissa continues.

“His dad owned an auto body shop in California and my dad worked for a large highend dealership, so we both have been around the industry all of our lives.”

Jake’s forte is body painting, but his 18 years of collision technology and management experience brings the perfect qualities to ownership. While Melissa’s eye for quality control, strong customer service values, and finesse with stubborn insurance companies more than rounds out their partnership.

Both Jake and Melissa are environmentally conscious and scrutinize their shop to uphold the highest green standards. They also enjoy giving back to the community.

“We started by sweeping the floors so we are looking for an intern, someone who is actually interested in working in the body shop long term. In the old days, all great tradesmen learned the skill that was handed down from the journeyman. We are hoping to give our skills to the next generation.”

Wyly opens Guralnick; Korologos continues “Magic” Sopris Sun Staff Report The Wyly Art Center presents “Subject to Change: unnatural selection” by Jody Guralnick at the new Wyly Annex exhibition space at 174 Midland Ave. in downtown Basalt. The opening reception takes place from 5 to 7 p.m. on Aug. 8.

Guralnick will premier her new work as a site-specific installation comprised of found, natural and man-made objects, combined and altered by porcelain and wax.

“Some of Jody’s new work will hang from the ceiling, some will be displayed on tables and chairs, and some will be presented as large wall-hung panels,” said a Wyly spokeswoman.

Guralnick received her MFA from Pratt Institute in New York. Her work has been exhibited nationally and internationally, and she has been shown at the National Art Museum of China in Beijing, Art City Gallery in New York, David Floria Gallery in Aspen, Anderson Ranch Arts Center in Snowmass Village, CU Art Museum in Boulder, New Contemporaries in London, and Studio 10 in Zurich. In 2013, Guralnick was a visiting artist at the American Academy in Rome.

“Material Magic” The Ann Korologos Gallery in downtown Basalt continues “Material Magic: Six Sculptors Create.”

The show features western themes and influences in bronze, ceramic, wood and glass by sculptors Veryl Goodnight, Gordon Gund, Neil Clifford, Amy Laugesen, Lloyd Schermer, and Immi Storrs.

Goodnight’s work reflects deep affection for animals, capturing both their power and beauty.

She works from life, resulting in a visible inti macy with her subject matter. “Having a living, breathing model nearby provides information that a thousand photos can’t convey.” Goodnight has placed work in private and public collections throughout the world. Among her most notable achievements is a seven-ton bronze monument, “The Day The Wall Came Down,”

Schermer’s art career began decades ago. As a newspaper publisher he was surrounded by the very material — wood and metal type — that would ultimately be transformed into his sculptures and monotypes. When typeset technology was replaced by offset printing, Schermer held onto his own cache and the idea for creating sculpture was born. As Schermer likes to remind his collectors, “You are dealing with two diminishing resources: antique type and me!” Schermer divides his time between Arizona and Aspen, where he is an honorary trustee of The Anderson Ranch Art Center and a lifetime trustee of The Aspen Institute.

New York-based artist Immi C. Storrs is best known for her imaginative, yet refined, sculptures inspired by the animal kingdom.

Storrs portrays familiar animals in a highly styl-

commissioned for the George Bush Presidential Library in Texas, with a second casting on exhibit at the Allied Museum in Berlin.

Gund was born in Ohio, educated in Massachusetts, and now divides his time between Aspen and the East Coast. He has worked in bronze, wood, and clay for more than three decades. A six-foot version of his work “Flukes” is in the permanent collections of the Philadelphia Museum of Art, the Grounds for Sculpture, and the Cleveland Arts & Medicine Institute. Although Gund lost his sight in 1970 from retinitis pigmentosa, his sculpting process results in elegant forms and highly polished surfaces which are a delight to touch and behold. “Sculpting keeps me in touch with the world. I visualize the images, how they look from different angles, in motion, and their visual expression,” he said.
