Vacation rentals: More complicated than you’d think AirBnB, Homeaway and others

By Tim Brogdon As Michael Durant pointed out in a letter to the editor, VRBOs (short-term vacation rentals) are likely not “making a killing.” And I do agree with Mr. Durant, in the hope that the town trustees and the planning and zoning commission give the issue of allowing shortterm rentals (STRs, which include VRBO, AirBnB, Homeaway, etc.) within the town limits of Carbondale the attention that it does deserve. But I am not concerned with how much profit operators of STRs do or don’t realize. I am concerned with the short and long term effects on the quality of life in our town from allowing investment in STRs (specifically nonowner occupied, nonCarbondale resident operated investment properties).

I was conflicted with the question of STRs as I have friends and acquaintances who rely on the extra income generated by STRs just to maintain their own financial equilibrium. My family sublets our downstairs unit on a longterm basis and we would be challenged without the income generated from that apartment. So I researched the question of shortterm rentals.

Municipalities across the country have recognized that the question of shortterm rentals comes down to a landuse issue. Three primary concerns routinely manifest themselves: lack of parking, excessive trash, and occasional unruly tenants disturbing the neighborhood.

Other reported issues are related to zoning, unreported sales and lodging tax, and unlicensed/unregistered business and commercial ventures.

Given that some Carbondale residents, including myself, rely on extra income generated from property we own, it would seem the challenge for policy makers is in defining what constitutes a shortterm rental. Are there different types of shortterm rentals and if so, should different types of STRs be regulated differently?

Type I STRs are typically defined as being “owner-occupied” properties. In other words, the owner of a residential property has decided to rent out one room or more of their personal residence, an adjacent suite to their primary residence, a non-attached ADU on the same property as their primary residence etc. on a short term basis (often defined as less than 30 days).

Based on other towns’ ordinances, Type I STRs are typically defined as “owneroccupied” properties. The owner of a residential property has decided to rent out one room or more on a short-term basis.

Communities have found Type I STRs expose neighborhoods to less disruption because an onsite property owner is more likely to manage their STR responsibly rather than an absent operator.

Type II STRs are often defined as a “nonowner occupied” property that is rented for less than a 30-day period. I suspect that Type II STRs operated by resident property owners (i.e., property owners whose primary residence is within the same community as the STR) will manage their STR with the intention of maintaining the quality of life of the neighborhood due to the property owner’s exposure to the community. But that is an assumption.

Type III STRs are typically defined as “nonowner occupied” properties that are either multiple units on a single property, or multiple units on adjacent properties, rentable for less than 30 days. For example, Bend, Oregon, does not allow an STR (of any type) within 250 feet of another STR owned by anyone. Type III STRs are often treated in much the same manner as motels. In most communities, Type III STRs are identified as purely commercial investments.

Glenwood Springs has the most stringent regulations I have seen.

According to research by the City of Aspen (2011), STRs, in Glenwood Springs are only permitted in zones that are already zoned for lodging or accommodation; VRBOs are only permitted in zones that allow for motels and hotels, effectively disallowing STRs in residential neighborhoods. I think this broad of an approach is too extreme for Carbondale. On the other hand, to have no regulation or oversight is simply “leaving the chicken coop door open for the fox” as my grandma would have said.

I was conflicted with the issue of STRs as I am aware of the benefit to some of us from utilizing property we own to generate extra income. However, next door to where I live, an investor who is not a resident of Carbondale owns three properties contiguous to each other (two of which are currently committed to the shortterm rental industry). One of the VRBOs next to me sleeps 10 people at a time. The second VRBO on adjacent property to the first sleeps at least six. The SHORT-TERM RENTALS page 19

Disappointed in Martin

Dear Congressman, please reply

Dear Editor: Thank you for running the informative interview with contender Aron Diaz for the Garfield County Board of Commissioners. Mr. Diaz says he is very interested in economic diversification and representing the entire county.

I was disappointed but not surprised that John Martin did not respond to your request for an interview. In 2014 when the country residents were first faced with huge increases in insurance premium costs, I contacted Commissioners Jankovsky and Martin. While I often don’t agree with the views of Jankovsky, he did respond very promptly and was also concerned about the escalating health insurance costs. John Martin did not even bother to respond.

Twenty years as a commissioner has appeared to make Mr. Martin complacent. I think it’s time we give him that message and vote for Aron Diaz, who has extensive qualifications and appears energetic and motivated to represent all residents of Garfield County.

Dear Editor: The directors of the Crystal Valley Environmental Protection Association (CVEPA) are writing to request that you change your position on the termination of oil and gas leases in the Thompson Divide.

CVEPA is an organization that is dedicated to the protection and preservation of the natural environment and is a leader in promoting environmentally sound practices within the watershed of the Crystal River and neighboring areas. CVEPA was formed in 1972 and has a membership of over 100.

The members of CVEPA serve this mission through their observance of the activities in our valleys and by the actions of our elected representatives. CVEPA expects you — our United States, Colorado, District 3 Representative — to be responsive to the needs and concerns of your constituents.

Approximately five years ago, the Thompson Divide Coalition (TDC) began an extensive study of the Thompson Creek area with regard to its value and appropriate use. As our elected officials, you and Senators Bennet and

Udall were among the first to be invited to participate in review and discussions. Unfortunately, you did not participate in any of these reviews, studies and public hearings.

And now, after these studies and meetings have been completed, we learn that, without participation in this process, you rebuke the thoughtful decisions of the USFS, the BLM, and an overwhelming citizen voice. Instead, it appears you have promoted the plans and proposals from the oil and gas industrial development interests that have, financially, supported your election and position in Congress.

The CVEPA Board of Directors and its members cannot support a congressional candidate who is unresponsive to the District’s needs and the needs of those who live and work here and who want to respect and preserve our natural heritage, sensitive wildlife areas, and its natural environment.

Accordingly, we urge you to reconsider your position on the 25 leases within the Thompson Divide area and support their being terminated in perpetuity, rather than suspended temporarily. The favor of a reply is requested.

Marijuana update: Trustees ‘tweaking’ ordinances

By John Colson Sopris Sun Staff Writer Carbondale’s elected leaders last week “tweaked” the town’s ordinances governing the still-evolving cannabis industry, in keeping with what some trustees in past years have labeled a “work in progress” in terms of overseeing the new businesses.

Among the changes is a provision that the town now has the authority to either approve or reject an application for reasons outlined in the town’s own codes, rather than relying on state law to cover whatever localized, specifically Carbondale-related circumstances might arise.

Also included in the revisions are requirements that cannabis-shop applicants for business licenses must now: • Provide proof they have leased a commercial space where the proposed business will operate for at least a year’s duration, which is the term covered in the license; • Submit a “certificate of good standing” issued by the state; • And a requirement that employees take part in any training sessions, concerning laws and other matters relating to the legal sale of marijuana, that are arranged by the town and hosted at Town Hall.

In addition to approving a new set of revisions to the town’s existing codes, the Board of Trustees held a lengthy discussion about other changes that are likely to be coming soon, including a possible reduction in the maximum number of cannabis-related

businesses that will be allowed here.

The discussion followed on the approval of the “tweaks” to the town’s codes, and primarily was meant to deal with two of the thorniest complaints about the cannabis business from neighbors of the stores and others — odors emanating from

cultivation operations and retail shops, and the concentration of cannabis-related businesses in the Village Road/Buggy Circle section of Carbondale.

“I want to be cautious of unintended consequences,” declared Trustee Ben Bohmfalk, referring to a fear that the trustees might enact new laws that unintentionally interfere with the normal course of business among the town’s cannabis concerns.

For example, he said, a restriction of the number of marijuana cultivation centers might unduly restrict the industry’s overall operation and, in conflict with state law, make things more difficult for customers of

the new industry.

Town Manager Jay Harrington pointed out that, at least in the medical marijuana segment of the industry, there is “vertical integration,” meaning medical marijuana shops must grow a certain percentage of what it sells — something that is lacking in the rules set up for the retail industry.

Harrington also noted that two large cultivation operations in town — one already in business, the other planned — are not designed to solely meet the needs of the Carbondale clientele, a circumstance that disturbed some on the board.

The board also appeared moved by the lament of Diana Quinn, a businesswoman in the Village Road commercial complex that is home to several cannabis-related businesses.

She and others have complained in the past that the proximity to the pungent pot businesses creates an atmosphere that is a hardship on their business.

“Right now,” Quinn told the trustees, “we do have a marijuana slum in Carbondale.”

She asked for a rule prohibiting cannabis shops from being within 400 feet of another cannabis business, similar to one that is in place in the downtown area.

“We’re owners here,” she said of herself and others in the Village Road complex, who also are not happy with the situation, adding about her cannabis-selling neighbors, “These people are renters. The town should take a stand and protect the business owners.”

Trustee Katrina Byars, who said she be-

lieves the 400-foot spacing rule might make sense, and that she liked the idea of limiting the number of plants allowed to individual cultivation operations, which might work against Carbondale’s reputation as a town that grows the pot consumed in other communities in the valley.

Trustee Frosty Merriott, who also said he favors coming up with a spacing plan to relieve the concentration of businesses, stressed to his fellow trustees that the problem of odors seems to be restricted only to the cultivation businesses, not to sales outlets, manufacturing concerns or testing labs, which also are now operating in Carbondale.

In general, following a detailed discussion, the trustees agreed with proposals to establish a limit of three of each kind of business in town (the present limit is five); limit the size of “grows” (as cultivation centers are known); requiring some type of carbon-filtration system to control odors; and possibly a requirement that cannabis-related businesses use renewable energy to meet their electricity needs.

It was also agreed that, rather then simply impose the new limit on the number of businesses, the town should establish rules that whittle that number down to three through attrition.

Town staff will work with attorney Alison Wente of Aspen, who has been the town’s chief legal counsel on cannabis regulation, on a new set of proposals that will come back before the trustees at a future meeting.

One result of CCAH’s application for the town to become an official Colorado Creative District is the “way-finding” markers on the Rio Grande Trail and other locations. The state agency Colorado Creative Industries whittled the list of 2016 Creative District applicants from 15 to eight a few weeks ago and Carbondale made the cut. CCI recently said it hoped to announce the designees (aka “winners”) by June 17 (after The Sopris Sun went to press). The other finalists were: Aurora, Breckenridge, Crested Butte, the Golden Triangle Creative District, Mancos and Steamboat Springs.

Creative District status brings with it various kinds of support from the state of Colorado.

Police continue accident investigation Town Manager Jay Harrington, in his June 10 memo to town trustees and other recipients, reported that police continue to investigate a June 7 accident in which a 61-year-old Carbondale man, Jose Alonzo Serrano, was hit by a car while crossing Highway 133 at a crosswalk near Village Road. The investigation was nearing its conclusion, Harrington reported, and Serrano remains hospitalized in serious but stable condition. The driver, Harrington wrote, stayed at the scene of the accident and cooperated with police.

In other news from Harrington’s memo, town workers spent considerable time and effort preparing for last weekend’s Ride The Rockies event here, including sweeping the bike route through town to clear gravel and other debris.

Town employees also helped an artist who had to make repairs to a sculpture, part of the Carbondale Public Arts Commission installation that was damaged by high winds, Harrington reported.

Other employees kept up with weeding and other landscaping work along Highway 133, and working with ongoing “irrigation system challenges,” Harrington wrote. He stated that there has been “increased run time on the controllers trying to keep the grass in the parks green and the flowers blooming.”

Harrington reported to the trustees that the chip & seal program for the town’s streets has been completed for this year.

The summer mid-day farmers market was scheduled to begin on Wednesday, June 15 at the 4th Street Park and Plaza, and will run on Wednesdays, from 10 a.m. to 3 p.m., through the end of September.

The annual Bonedale Skate Revival competition is scheduled for June 18 from 10 a.m. to 2 p.m. at the North Face Skateboard Park.

A dog agility competition, “Dogs on Course North America,” is scheduled for Saturday and Sunday, June 18-19, from 7 a.m. to 5 p.m. each day, at the Bridges High School soccer field along South Third Street.

Town planners Janet Buck and John Leybourne together took part in last week’s Colorado Mountain Region Planners Rendezvous, which drew about 50 participants and was hosted at the Carbondale Town Hall. Buck was part of a panel discussion of the topic, “Encouraging Unique Mountain Town Industries/Entrepreneurship.”

Leybourne facilitated a discussion session on marijuana regulations.

A new mobile home, intended to house a municipal employee, arrived last week and has been set on town-owned property near the wastewater treatment plant.

Crews were reported to be working on hookups and building a skirt around the mobile home.

Last Tuesday’s (June 7) power outage for Xcel customers caused problems with the pump system at the Roaring Fork water treatment plant, but the problem has been corrected, Harrington reported. Officials at Xcel reported they were unable to locate the cause of the power outage.

Town employees are working on the bathrooms at the Gateway RV Park, at the intersection of Highways 82 and 133, Harrington wrote, and portable toilets were to be brought in while the work is underway.

Two Carbondale police officers — Randy Rodgers and Robb Windham — will be at training sessions this week, Rodgers at a Field Officer Training School and Windham at a Standard Field Roadside Sobriety Instructor class.

Harrington reminded trustees and others that the town’s summer recreation brochure is available on the Internet (www.carbondalerec.com), and that all summer programs are open and ready for registrations, including such programs as tennis lessons, riding lessons at North Face Bike Park, swim lessons at the municipal pool, skateboarding lessons, soccer instruction and more.

From June 2-9, Carbondale officers handled 247 calls for service. During that period, officers investigated the following cases of note:

FRIDAY, June 3: At 53 minutes past midnight, a man was assaulted by an unknown assailant at 403 Main St. No further details were reported by police in a summary sent to the Sopris Sun. FRIDAY, June 3: At 8:56 p.m. police stopped a vehicle on Main Street for careless driving. The driver was later arrested on suspicion of drunk driving and other charges.

SATURDAY, June 4: At 1:13 a.m. police stopped a vehicle for failing to drive on one side of Colorado Avenue. After investigating, the officers arrested the driver on suspicion of drunk driving. Later on that same day, they arrested the same man on a felony warrant out of Mesa County.

SATURDAY, June 4: At 5:56 a.m. police contacted a 20-year-old man on North 8th Street, and subsequently arrested him for underage drinking.

SATURDAY, June 4: At 11:04 p.m. police responded to a report of a young child walking alone along Highway 133. The child was returned to his parents, and the county department of social services was notified of the situation.

WEDNESDAY, June 8: At 2:02 a.m. police observed several vehicles in the neighborhood of Village and Surrey Roads that appeared to have been broken into. No suspects were found.

Crystal River meeting draws crowd, no action Every chair was filled and people lined the walls at the sides and back of the meeting room in the Church at Redstone Tuesday afternoon, where government officials and their constituents addressed a proposal to seek official Wild and Scenic designation for the Crystal River, which flows outside the church.

At the church, officials from Pitkin and Gunnison counties, as well as the Town of Marble, took testimony from a couple dozen people, most of them residents along the 39-mile stretch of the Crystal that is the subject of the designation effort.

According to the text of the proposed Act of Congress, which is the route to getting designation, the Crystal would be designated Wild & Scenic from its headwaters above the sparsely populated seasonal ghost town of Crystal, all the way north to the diversion structure for the Sweet Jessup Canal, which irrigates ranches at the north end of the river near Carbondale.

The meeting was opened by Pitkin County Commission Chair Rachel Richards who, along with her four fellow commissioners, was joined at the table by Gunnison County Commissioners Phil Chamberland, Jonathan Houck and Paula Swenson, the board chair; and by Marble town council members Mike Yellico and Tim Hunter.

Attorney Bill Jochems of Redstone, along with former Pitkin County Commissioner Dorothea Farris and local entrepreneur and activist Chuck Ogilby, told the assembled crowd that the goal of the proposed designation is a singular one — to prevent construction of dams on the Crystal.

Don’t dam it Jochems pointed out that there once were two such dams proposed, a 280-foothigh dam below Redstone and another below the historic townsite of Placita, further upstream.

They were first dreamed up by water development interests in the 1950s but abandoned two years ago due largely to local opposition.

Wild & Scenic opponents A number of opponents to the designation proposal spoke at the Redstone meeting, criticizing Jochems and his team for not doing enough to notify adjacent landowners about the plans and expressing

concerns that federal oversight would mean loss of landowners’ ability to do as they like with their land, among other fears.

“I don’t want a dam, but I don’t want to give up my rights,” declared riverside landowner Jeffe Hall. She and her husband, attorney Larry Hall, have been lobbying the Marble town council against the designation idea for some time.

Supporters of the proposed designation insisted that local land-use control would remain with local authorities, and that private property rights and water rights were meant to remain as they are now.

Supporters Others at the meeting, however, supported the proposal.

“I am adamantly in support of wild and scenic designation for the Crystal River,” said local environmental activist Dee Malone.

Citing indications that Front Range interests are gearing up to obtain ever increasing volumes of water through diversions from Western Slope streams and rivers, Malone said, “If we want the Crystal River to run dry, we will avoid getting wild and scenic designation.”

Some questioned the need for designation, expressing belief that other routes, such as anti-dam resolutions passed by the county commissioners, might suffice to keep the Crystal free of dams and diversions.

But government officials in the room countered that such decisions are “above our pay grade,” as Gunnison County’s Paula Swenson put it. The only reliable route for such an outcome, the audience was told, is through the USFS and the Act of Congress.

Redstone resident Peter Martin, a supporter of designation for the Crystal, at one point told the opponents, “I think this committee has addressed your major concerns” and questioned why opponents kept up with their opposition.

Pitkin County’s Rachel Richards told the audience that there will be much more discussion about this topic, at meetings of the Redstone Caucus and the Crystal River Caucus, as well as by the Town of Marble.

The meeting at Redstone closed with a remark from Pitkin County Commissioner Steve Child, who recalled that when he was

16 and growing up in the Snowmass Creek valley, a water diversion proposal was made to divert flow from West Sopris, East Sopris and Capital creeks for delivery to the Front Range.

It was fought, and the plan died, Child said, adding, “That’s the thing I’m afraid of, somebody filing for water rights on the upper Crystal and proposing a dam … it can be done.”

After a follow-up meeting that night at the Marble Town Hall, where town council members and Gunnison County Commissioners debated the same topic with town residents — many of whom also had been at the Redstone meeting — the consensus was that more information is needed before either the town or the county can decide whether to oppose or support the bid for designation.

Obituary Virginia Rau Knittle 1930-2016 Virginia Knittle died at home in Carbondale, Colorado, on June 8, 2016. She was born in St. Louis, Missouri, on Aug. 31, 1930. She had lived in Carbondale for 11 years.

She was preceded in death by her husband, LTC Joseph William Knittle, Jr., and her son, Joseph William III. She is survived by son Kurt of Flagstaff, Arizona, son David of Basalt, Colorado, daughter Christa of Eugene, Oregon, daughter Daniela of Carbondale, Colorado, and two grandchildren.

There was a celebration and remembrance gathering on June 12 at the Carbondale Methodist Church. Donations may be made in her honor to the church and Alzheimer’s research.

Jochems said that, had they been built, they would have flooded Redstone, drowned the nearby Redstone Castle and created two reservoirs with more water in them than the Ruedi Reservoir on the Fryingpan River east of Basalt.

The Wild & Scenic Rivers Act, passed by Congress in 1968, was approved, Jochems said, in reaction to a dam-building frenzy all over the West, particularly the construction of the Glen Canyon Dam that drowned a famously scenic landscape and created Lake Powell in Utah.

The 1968 act, Jochems acknowledged, not only prevented rivers from being dammed up, but also contained provisions for condemnation of private property and other controversial actions by federal authorities.

“We don’t want any of that,” Jochems said, emphasizing that the proposed designation would have only one purpose — to keep the Crystal River free of dams and diversion structures intended to take water from this region over to the thirsty cities and subdivisions of Colorado’s Front Range region.

He said the designation would not affect water rights held by private citizens or local towns, or the use of private property along the river, as long as that use was not in conflict with the designation.

“We’ve done everything we can to protect the status quo of this stream, and nothing more,” Jochems declared. “They can’t build a dam any more, or send water out of this valley — that’s all it means.”

His statements were backed up by Scott Fitzwilliams, supervisor of the White River National Forest, whose agency has concluded that the Crystal is eligible for Wild & Scenic designation.

The Roaring Fork High School cheer team has worked hard this year to raise money to attend the Universal Cheer Association camp at CMC’s Spring Valley campus.

The 11 girls and one boy put on a fund-raising yard sale, held a car wash, sold RFHS bumper stickers and held bake sales but are still $2,000 short, according to coach Carol Farris. “We are a self-funded club and do not receive any money from the school or boosters,” said Farris. At the camp, cheer teams from all over Colorado and Wyoming will stay at the CMC dorms for three nights, and learn new cheers, half-time routines and stunts for the 2016/2017 school year. Last year, the RFHS cheer team took fourth place in a competition and two cheerleaders, Eric Sotelo and Paige Gianinetti, made All American. Folks have been noticing the grass is drying up at the Hendricks Dog Park (near Wells Fargo) of late. “We have received several phone calls … ,” said Public Works Director Larry Ballenger. Turns out that someone (a non-town employee) turned off the zone valve for the park’s sprinkler system for unknown reasons. Ballenger said this department is looking into a way to lock the valve box.

Homeless shower passes drying up When the Carbondale Homeless Alliance came together last winter, one of its goals was to pay for shower punch passes at the Carbondale Recreation Center to help local homeless folks clean up. “We keep a (20 punch) pass at the front counter and the homeless people of the community … use it for taking a shower,” said CHA organizer Lynn Kirchner. Each pass costs $120 and the recreation center is down to only three. This just in Colorado Congressman Scott Tipton (RThird District) sounds pretty jazzed about a gigantic natural gas deposit recently discovered in the Piceance Basin in western Colorado. “The potential of this find for western Colorado’s economy and for our national energy security is tremendous,” Tipton said in a press release. “This is an incredible opportunity to create jobs and economic growth … .

Crime Stoppers Crime Stoppers of Garfield County is offering up to $1,000 for any information that will lead to the arrest and/or indictment of the suspect or suspects involved in the burglary and vandalism of the Spring Valley Sanitation District sewer treatment plant at 2300 County Road 114 near Glenwood Springs, according to a press release. A van at the site was also damaged. Windows were broken out of the building, which was ransacked.

Gearing up Saturday morning at Roaring Fork High School bustled with activity in preparation for the start of the Denver Post’s annual Ride the Rockies on Sunday. By late afternoon, a village rose up on the high school grounds and bikers began to pour out of buses and cars to find their tent, register, use one of the hundreds of Porta potties, relax and get their bikes ready for the ride beginning on Sunday morning.

Trustees OK CRMS water/sewer tap request In exchange for water rights

By John Colson Sopris Sun Staff Writer The Carbondale Board of Trustees last week agreed to provide water and sewer taps for new teacher housing at Colorado Rocky Mountain School (CRMS), despite a moratorium on the sale of taps to homes or businesses outside town limits.

But unlike deals worked out for previous provision of water service to the school, this time the school is being directed to provide the town with water rights sufficient to cover the amount of water that will be coming to the school through pipes hooked up to the town’s water treatment plant.

CRMS, a private boarding and day-student school founded in1953 just to the west of town, has long been considered a vital part of Carbondale’s business and cultural climate, and is viewed as a special case in terms of service by the town’s utilities.

In keeping with this general policy, the school has asked the town for 1.6 EQRs (equivalent residential unit, or amount of water used by a single-family household) of treated water to serve a new teacher-housing duplex being built under the school’s 1999 Campus Master Plan.

Tap fees to be assessed to the school

for water and sewer service (the amount of money the town charges for “tapping” into the water and sewer systems) are to be nearly $20,000 — $12,600 for the water tap, $7,072 for the sewer tap — according to a memo from the town’s utility department.

During a lengthy discussion of the issue at the June 8 meeting of the Carbondale Board of Trustees, the board briefly considered asking the school to make an additional $3,600 “payment in lieu” of the actual signing over of water rights, an option that is permitted in the town codes.

But Joe White, director of finance for CRMS, said that payment was not part of the school’s expectations when it applied for water and sewer service for new teacher housing.

“We don’t have $3,600 for this in the project budget,” White told the trustees.

According to the memo from Carbondale Utility Director Mark O’Meara, CRMS, for reasons unknown, was not required to either pay a fee or dedicate water rights the last time the school requested a water tap, in 2011, though O’Meara noted that since 2002 the town’s codes have required either a fee or a water right be given in return for water service.

Both O’Meara and Mark Hamilton, the town’s attorney, recommended that either a fee or a water right be part of the current agreement, and O’Meara indicated that it

Navarrete-Portillo murder trial continues

By John Colson Sopris Sun Staff Writer The jury in the murder trial of Carbondale resident Arturo Navarrete-Portillo, accused of murdering his wife with a machete last year, was expected to begin deliberations on Wednesday after closing arguments from the prosecution and the defense, according to court officials.

The jury has heard days of testimony about the incident, which took place on Feb. 16, 2015, when Navarrete-Portillo, 47, allegedly beat up his wife during an argument and then slashed her face and neck with a machete that had been hanging in a closet of their Carbondale apartment.

His defense attorneys from the Glenwood Springs public defender’s office have not disputed that Navarrete-Portillo killed his wife, and the defendant reportedly admitted it while testifying.

But his attorneys contested whether the act rose to the level of first-degree murder, as he was charged.

Instead, defense attorneys strove to convince the jury that Navarrete-Portillo was incapacitated by a day of drinking with his wife, in the grip of passion, and bereft of his reasoning capabilities when he killed his wife, Maria Carminda Portillo-Amaya, 30, in the early morning hours.

His attorneys have asked for conviction of a lesser charge.

On Monday, the defendant testified that his wife taunted him about her having been with another man who performed better sexually than Navarrete-Portillo,

driving him into an uncontrollable rage, according to published accounts of the trail proceedings.

Navarrete-Portillo reportedly spent about three hours on the stand on Monday, describing his memory of the time leading up to the killing and the belittling statements he claimed his wife made to him.

A prosecuting attorney told the jury that Navarrete-Portillo, enraged over the remarks, took the machete out of a closet and slashed her at least five times in the face and neck.

The defendant said that he and his wife had separated at times during their marriage and that he had seen her with another man, which he described as troubling and difficult for him.

He denied, however, that he had planned to kill her, though he reportedly admitted to writing a letter to the victim’s sister in El Salvador, outlining a murder-suicide plot involving himself and his wife that he admitted he had invented.

Navarrete-Portillo is believed to have been trying to kill himself later on the morning of Feb. 16, 2015, after the murder, by deliberately driving his vehicle into the back of a livestock truck on Highway 82.

He was hospitalized with serious injuries after the crash, and while there he told emergency medical technicians and, later, law enforcement officials that his wife was dead and where she could be found.

The judge in the case, earlier this week, indicated that jury deliberations might spill over into June 16 before a verdict could be reached.

might be time to take another look at the utility-services policy, suggesting that either a fee or water rights be required with any future service agreements.

Acting Mayor Dan Richardson, after hearing from White and O’Meara, suggested that the school needed to come up with either the fee or what he termed “wet water” to boost the town’s portfolio of water rights.

“We have to do this to protect the citizens of Carbondale for the future,” Richardson said, alluding to the fact that the town is expecting that at some point in the future the growing water needs of the population and businesses of Carbondale could outstrip the town’s current stock of water rights.

Plus, he continued, CRMS “does have the ability to do this (pay the fee or turn over the water right), so I don’t think it’s too much of a burden for us to ask this.”

In addition, Richardson pointed out that a 1999 letter from then-town manager John Hier made it clear that the school was required, at that point, to pay a fee in return for water service.

Trustee Frosty Merriott said he felt the town should seek actual dedication of water rights, remarking, “We know we’re going to have a water shortage at some point,” particularly if current weather-related trends continue to cause droughts on the southwestern section of the U.S.

“I do think it’s incumbent upon us to be realistic about this,” Merriott said, referring to statewide predictions of water shortages over time, for a variety of reasons.

Merriott’s sentiment was echoed by others on the board, including Trustees Katrina Byars and Ben Bohmfalk.

“I totally agree,” said Bohmfalk, “we want the water. But for this little project, we want to work with them,” and he said he would be comfortable with just a fee for this specific agreement.

Hamilton asked whether the trustees wanted to confine the present discussion to the 1.6 EQRs being requested now, or expand it to include the total of 10 EQRs estimated to be needed for the build out of the CRMS building master plan.

Byars noted that, if the school figures out how much water that would call for and simply dedicated it to the town now, it would eliminate the need for CRMS to come before the board of trustees piecemeal as the master-plan build out continues.

White said he agreed with that, conceptually, but that it is not his call to make and that he needed to consult with the school’s administration.

In the end, the board decided unanimously to ask for water rights in return for water service, but to give the school several months to work with town staff to determine the amount of water to be turned over, and how best to dedicate it to the town.

Bike to work, get fed, on June 22

“In Glenwood Springs, stop by for breakfast burritos, coffee and orange juice, and to meet other riders,” said Librarian Sue Schnitzer, manager of the Glenwood Springs Branch Library.

“Carbondale riders can stop by or park their bikes at the RFTA Carbondale Park and Ride,” said RFTA spokeswoman Jennifer Balmes. “We’ll be serving coffee and snacks, and offering info on bus schedules and bikes on buses.”

Both events are free, and are set for 7 to 10 a.m. The Glenwood Springs Branch Library is at 815 Cooper Ave. The RFTA Carbondale Park and Ride is at Highway 133 and Village Road.

Earlier in the spring, some observers noticed the gardens on the north side of the Third Street Center just seemed to explode to life over night.

How did that happen? Well, it didn’t just happen. Dawn Rains, of Living Soil Gardens, helped to make it happen in part by keeping the garden totally organic. “A key element to a weed free garden is preventing weeds from going to seed and discontinuing the cycle of the weed seed,” she told The Sopris Sun. Rains does allow native columbines, however, to drop their seeds every year. “Another huge element is intention,” she continued. “When I approach the garden it is with respect and a knowing … a relationship that I have with the piece of earth.” DHM did the garden’s initial design. Since Rains’ company started caring for the garden, she has worked to increase the soil’s fertility. And let’s not forget the honeybees. “It is absolutely amazing how many honeybees are in the salvia every spring, and we all move about them completely peacefully at the entrance to a public building … so beautiful.” On a personal note, Rains grew up in Marble, attended Roaring Fork High School and earned her Master Gardener Certificate through Colorado State University last year.

What happens in Carbondale, stays in Carbondale The Carbondale Rotary’s “Happening” was the hottest ticket in town on Saturday night. It all happened in the glamorous Carbondale Recreation and Casino Center. We’re talking professional card dealers and pit bosses, dinner from celebrity chef Susie Jimenez, music from Valle Musico and a silent auction. The happening crowd received $300 each in chips, which they disposed of quickly or grew until the end of the night. No actual money was paid out, but score was kept. Paul Stonich was the Biggest Winner for building his grubstake to more than $17,000 in chips; Biggest Loser was Peg O’Brien with minus $10 in chips (she bought more chips and proceeded to lose them).

The night netted close to $18,000 for local scholarships. In the past two years, the Rotary has awarded “Happening” proceeds to local non-profits. “This year, we wanted to be hyper-local and serve local students," said outgoing Carbondale Rotary President Steve Skinner. “That’s how we came up with the slogan, ‘What happens in Carbondale, stays in Carbondale’,” he added.

The club, which meets at 7 a.m. on Wednesdays at the Carbondale Fire District’s main fire station, also enlisted help from the Thursday noon Rotary Club for the silent auction and “spin the bottle” wine roulette.

There is no reason to assume that the third property will not also become a STR. That house sleeps at least six people if not more. That would conservatively be 22 beds for overnight lodgers along the bike path. I’m uncertain if our neighborhood is zoned for this volume or type of lodging. I am also uncertain how the nonresident operators of these STRs intend to manage the potential for unruly transient lodgers. We have a lot of children in our neighborhood. I am pretty certain that parking will become an issue. (On several occasions, I have taken it upon myself to knock on the door of the original VRBO to ask lodgers to please not park their vehicles and trailers in front of the entrance to the bike path).

To me, this is not the same thing as a resident of Carbondale renting out an ADU on their own property of residence (Type I) or even the same as other residents of Carbondale who rent out a separate property from where they reside (Type II). This looks more like a collection of investment properties that would typically be defined as

Type III — especially as the investors don’t maintain their primary residence in the Town of Carbondale. I must wonder what the bed-andbreakfasts think about this circumstance, along with our two motels.

In any regard, I agree with Mr. Durant that, on paper, it doesn’t seem as if owners of STRs are “making a killing.” I prefer to price our downstairs rental below the market rate and maintain a long- term rental relationship with our tenants, which benefits my family and tenant, all the while maintaining the quality of our neighborhood and community rather than subjecting our family and our neighbors to a revolving turnstile of tourists and partiers. According to a map of existing STRs available from the P&Z, there are currently 42 known

STRs within Carbondale, which is more than double the number reported by Mr. Durant.

As Carbondale is viewed from New York to L.A. as a prime adventure and tourist destination — especially given Carbondale’s proximity to Aspen — I must wonder how long it will take for other investors to catch on that there are no regulations, restrictions, or guidance in place in Carbondale. I suppose it will boil down to the question of what does the Town of Carbondale wish to look like in a few years? A community of neighbors and neighborhoods or a community of investors and tourists.
