Remembering Amendment 2 Dear Editor: 20.5 years ago, more or less, I was engaged in a pretty snarky exchange of views with a local “mental health” therapist on the topic of gay discrimination. I was against it.

Still am. A part of that exchange took place in the pages of The Sopris Sun’s predecessor, the Roaring Fork Valley Journal.

There I was, a native Coloradan, an alumnus of both CRMS and CMC, but born with a “y” chromosome that seemed real fond of other “y” chromosomes. And 20.5 years ago, more or less, quite a few of my fellow Coloradans demonstrated their serious dislike of me in the form of what was then known as Amendment 2. (I thought the number was ironic, since in addition to everything else, it also smelled a whole lot like number two). And they were proposing to enshrine this dislike of one of their native sons in the Constitution of The Centennial State. The aforementioned Ph.D. saw no real problem with this, but I did. Still do.

The public termination of my “friendship” with the aforementioned “doctor” in these pages was a very satisfying thing, but not nearly so satisfying as the SCOTUS decision that came soon afterward. In a decisive 6-3 smackdown (7-2, 8-1, or 9-0 would’ve been better, but still), SCOTUS struck down Amendment 2 in a decision known to history as Romer v. Evans.

Today Romer v. Evans turned a healthy 20 years old, and we may have the chance to learn just how healthy it is, when it will be used as the basis to repudiate HB2, a similarly execrable piece of legislation to be found in North Carolina. It’s interesting, the designation HB2. There we go with the number two again.

In an especially whiny dissent even for him, Justice Antonin Scalia said that the whole thing was an exercise in needlessness. But I’m here to note that Romer v.

Evans still reverberates in the USA’s halls of justice, while Nino is still doin’ the dirt nap.

The aforementioned Ph.D. and the bitches lost, while the cool guys and I won.

Sharing community, economy Dear Editor: The connections between the Roaring Fork and North Fork Valley run deep. People travel between the two valleys to see friends, climb mountains, eat locally produced food, and build businesses. Travel over McClure Pass has likely gone on for millennia, and we all probably know friends who have lived and put down roots in both valleys. Many Roaring Fork residents get locally grown produce from the farms in the

North Fork, while ranchers from the Roaring Fork sell their meat to those on the other side of McClure as well. We share more than just a connected landscape. We also share a community and economy.

Earlier this year our shared Congressman, Scott Tipton, floated a draft bill, largely written by an oil and gas company, SG Interests, that would exchange roughly 30,000 acres of gas leases in the Thompson Divide, west of Carbondale, for new leases in the Hubbard and Mule park area north of Paonia. For nearly a decade, citizens in the Roaring Fork Valley have been working to protect the Thompson Divide from gas development. For nearly as long, citizens in the North Fork have been fighting gas leasing near their communities and dealing with the impacts of existing gas production in the upper reaches of their watershed.

While Tipton’s bill would get rid of the majority of the existing gas leases in the Thompson Divide, it contains zero protections from future leasing for either the Thompson Divide or key lands within the North Fork Watershed, something people on both sides of McClure Pass have been consistently and strongly asking Congress to help with for years. Perhaps most significantly, the bill would provide no protections whatsoever from new impacts to the lands, waters, and air of the North Fork Valley; large portions of the citizens in the North Fork don’t want to see that happen. Similarly, the Wilderness Workshop and residents of the Roaring Fork have consistently drawn the line in efforts to protect the Thompson Divide at passing our problem off to anyone else. With all this in mind, it’s clear that Congressmen Tipton’s lease exchange bill is bad for both our communities. It’s not something either of our organizations can support. We’ve got too much in common, and we care too much about the people and lands on both sides of McClure Pass.

Yes for CRES Dear Editor: I realize that when it comes to elementary schools in Carbondale, there are many choices. To me, Crystal River Elementary School has proven to be exceptional. In the year that she has been going there, my child has thrived scholastically, creatively, developmentally and socially. To say that I am delighted with her progress would be an understatement!

The teachers and staff go above and beyond for each child. They are kind and caring as well as excellent educators. CRES

Honeybees are moving Dear Editor: It’s spring and honeybees are on the move. They’re going to spend the next month or so looking for new places to live as they swarm out after a long winter.

Swarms are NOT dangerous and are considered docile, unless you try to hurt them, like any creature. Please call your local beekeeper if they’ve relocated too near to your house or business for your comfort.

$400K streetscape project moving forward Colorado Avenue to the TSC

Nesting ospreys banking on Excel tower Sopris Sun Staff Report Hiding in plain sight, a pair of osprey has taken up residence on top of the Excel tower across Highway 133 from Alpine Bank.

Sharp-eyed bank customers first noticed the birds building their lofty nest two or three weeks ago. By last weekend, word had spread and at least one group of viewers munched on the bank’s Saturday donuts as they watched the birds’ comings and goings.

Ospreys were endangered by the effects of DDT in the mid-20th century, according to the National Geographic Website, but since DDT and related pesticides were banned in 1972, they have made a good come back in many parts of North America.

Ospreys’ primary diet is composed of fish, typically in the 4-12 inch range (as seen here). Males do most of the hunting and females the feeding. In the Excel tower case, Mr. Osprey doesn’t have far to fly, as the Roaring Fork River is less than a quarter mile away.

The Carbondale osprey joins another pair of nesting osprey on Highway 82 between Basalt and El Jebel. The nest as been there for several years. Last December, Pitkin County and Holy Cross teamed up to put an “osprey cam” on a pole about 20 feet from the nest. You can check it out at pitkincounty.com/953/osprey-cam.

There is also a nesting pair of osprey in Dotsero, according to the Colorado Parks & Wildlife Website.

Getting back to Carbondale, a local Audubon Society member told The Sopris Sun she has contacted Excel to see about putting a more stable platform on top of the tower (one slid off last year). She also talked to the US Forest Service, who told her none of the towers pose a risk as far as electrocution goes.

At this point, it’s impossible to tell how many baby osprey are 75-feet off the ground with their parents, but time should tell as the spring and summer goes on. Incubation takes about 38 days; the age at first flight is about 51-54 days.

Bring your binoculars and stay tuned.

The Town of Carbondale is getting set to spend $400,000 on improvements to the Third Street corridor, which stretches from Colorado Avenue to the Third Street Center and has become an active travel route between downtown and the TSC. But, stressed Andrea Korber of the Land+Shelter consulting firm working on the plan, the changes will not involve new paving of the street surface or construction of new sidewalks, at least not in this initial phase.

“This is more like, what can we do about parking,” she said at a May 19 public outreach session in Town Hall, the second of two meetings, and at a “walking tour” of the target area, where members of the public were invited to check out the plans and make comments.

Another aspect of the project, she said, will have to do with plantings along the street corridor; protection of trees in the corridor and the placement of ditch crossings that might act to expand the town's irrigation-water ditch system.

Plus, she said, there is hope that certain problems with drainage of storm water can be addressed at some points along the street.

Korber and a team of specialists presented a collection of maps and diagrams to explain to the public exactly what is being contemplated at this point, including improvements to existing sidewalks that have buckled, slumped or in other ways become as hazardous as they are helpful to pedestrians.

“We need this,” Korber said, “because that's how the kids get from schools to the downtown area.”

Public meetings In the public meetings about the plan, there has been discussion of the east side of 3rd Street, which is characterized on maps and diagrams as “rural residential” and which has been kept free of sidewalks, curb and gutters.

“There is no sidewalk there,” Korber said, noting that the current condition of that stretch of the street seems to be OK with the public.

“That was one of the strong desires expressed,” she said, “to 'keep it rural,'” as one member of the public commented.

One possible deterrent to construction of new sidewalks along the east side of the street, she added, is the possibility that the Roaring Fork School District

might one day want to build an affordable-housing neighborhood on land that historically has been an athletic field just south of the old Carbondale Middle School, now home to the Bridges High School and other school-related functions.

If that occurs, she said, officials expect that that end of 3rd Street, along with sidewalks old or new, might need to be torn up to accommodate work on the underground utilities.

Among the changes being discussed is a switch from parallel to diagonal parking along some stretches of the street.

Also, the existence of ancient trees along the streetscape drew particular attention from Dan and Meredith Bullock, who both described themselves as tree advocates.

For example, they talked with the planners for some time about trying to protect a tall, very old spruce tree that stands adjacent to the sidewalk, near the joining of the grounds of the Bridges facility and grounds, and the athletic field/school bus barn where homes might one day be built. A note attached to a diagram of that area bore the statement, “Could be in conflict with future housing ingress,” due to the possibility that an internal street meant to serve the houses might intersect with 3rd Street right-of-way where the tree now stands. It was noted at the meeting that the grouping of ancient spruce trees around the school already had suffered the loss of several trees when the new Carbondale Branch Library was built.

The 3rd Street right-of-way, Korber said, is about 75-feet wide from Colorado Avenue to the library, and narrows to about 60 feet south of that point.

In some parts, encroachments have occurred, whether by fences, parts of houses or other structures, or small trees planted in the right-of-way for various reasons.

It will be up to the town government to determine how such encroachments should be treated.

Korber was unsure if there will be further publicoutreach meetings before she and her team of urban designers finish up their design work, which she said could be in early June.

At that point, she said, the plans will be presented to the town for review.

Public Works Director Larry Ballenger, who attended the May 19 meeting but said little, noted that the town's consultant, SGM Engineering, has indicated it can come up with final engineering drawings for the street improvement project within a month of receiving the final preliminary design from Land+Shelter.

Asked whether work on the improvements could begin later this year, Ballenger replied, “It would be nice.”

Sopris slide has slud it’s last kid

From May 13-20, Carbondale officers handled 236 calls for service. During that period, officers investigated the following cases of note:

Sopris Sun Staff Report The town’s insurance provider has advised town officials to either repair or remove the “tree slide” in Sopris Park, according to Town Manager Jay Harrington’s weekly report to the trustees, staffers and others. The report said the slide is old, made of fiberglass, and replacement parts and materials are not available, so “in all probability, it will be removed.”

In other news from Harrington’s report: Town employees worked on a new mobile home site at the wastewater treatment plant last week. The work includes replacement of a water service line, grading of the site and construction of a retaining wall. Delivery of the mobile home is expected in the first week of June.

Technicians continued to “trouble-shoot the irrigation system on the Highway 133 corridor” last week, as well as going on a “walkthrough inspection” of landscaping along the corridor with the Western States Reclamation consulting firm. The memo reports that some of the vegetation planted along the corridor is “having difficulty establishing” for reasons that were not explained.

The Xcel utility contractor working in burying utilities on Rock Court and Wald Drive reported it was unable to bore a line conduit underneath the road, and will need to excavate the street to install the new main line.

SATURDAY, May 14: At 6:22 p.m., police were called to an accident at Hendrick and Barber drives, where a truck pulling out of a driveway had been hit by another car. There were no injuries reported, and the driver of the truck was issued a ticket.

SUNDAY, May 15: At 4:46 p.m., a pedestrian on a skateboard ran into a car driving north through the crosswalk at the roundabout at Main Street and Highway 133. The skateboarder sustained minor injuries and was taken to a hospital by a family member.

MONDAY, May 16: At 11:29 a.m., a woman reported that someone had stabbed her exterior house wall. No suspects were reported at the time.

MONDAY, May 16: At 5:21 p.m., officers received information on juveniles dealing and buying drugs. The information was forwarded to the federal Drug Enforcement Administration.

Carbondale Mountain Fair announces music lineup Sopris Sun Staff Report Folks who plan their Mountain Fair around the Gazebo Stage music lineup can start looking ahead to the weekend of July 29-31.

As usual, expect an eclectic blend of everything from world beat to cumbia, with a healthy dose of rock, blues, Americana, country and the unclassiďŹ able.

Friday evening starts at 4 p.m. in front of the Gazebo with the Fireball Drum Circle (note: that’s what The Sopris Sun calls the drum circle, anyway) and opening ceremony with Rhythms of the Heart.

At 5 p.m. on Friday, it’s Sneaky Pete and the Secret Weapons. “The Weapons have been taking Wyoming by storm with their funky, gritty, jam funk that gives you no choice but to get up and dance,� said a Mountain Fair press release. “Their weapons are instruments and they will start the 45th (Mountain Fair) off in great-groove style. One of the band members, Jack Tolan, is a Roaring Fork Valley local so expect a great show of friendship.�

Wrapping up Friday’s action at 7 p.m., it’s the Portland based Tango Alpha Tango. From the ďŹ rst bluesy electric-guitar riff, front man Nathan Trueb shows his ability to write a good tune and dominate a guitar neck, but the band’s awless fusion of blues and rock, with funky bass lines and psychedelic keys, make it the perfect kick-off to Friday night at Mountain Fair.

Saturday, July 30 11 a.m. — Zononoka is part of the Western Slope Rhythm Collective, and is bringing marimbas and drumming to new heights. Featured musicians include locals Eric Baumheier, Aja McAdams and friends.

12:30 p.m. — Niceness hails from the San Juan region of Colorado. The band blends solid grooves with lyrics that hail back to the origins of reggae music, with nods to soul, hip-hop and funk. Their debut recording is called “Sunshine.� The lead singer, Koral, said she found her conscious roots at Colorado Rocky Mountain School.

Germain takes state Roaring Fork High School sophomore Jasper Germain won the 3A high-jump title at the Colorado High School Activities Associate state meet at Jefferson County Stadium on Saturday. Facing Lutheran’s Ryan Goldhammer in a jump off, Germain cleared 6-5 to win gold. Before that leap, Germain’s personal leap was 6-1. In other state track meet action, Roaring Fork’s Justin Thompson (also a sophomore) placed sixth in the long-jump with a personal best of 21-feet, 1.5 inches. Yet another sophomore, Jazmin Contreras, placed eighth in the 100-meter dash.

Tune in Local folks get some pretty good face time on the Sportsman’s Channel “Hook the Future” TV show at 1 p.m. on May 30. The show’s Captain Don Dingman booked a float trip on the Colorado River with Alpine Angling/Roaring Fork Anglers in early April, and brought along a crew to record the excursion.

A new book in town Jeff Achey and BJ Sbarra have published a climbing guidebook, titled “Western Sloper: Western Colorado Rock Climbs, Vol. 2,” that includes 1,200 routes on the Western Slope.

The New Castle-based Achey is known for bold first ascents in the Black Canyon and Utah’s Canyonlands in the 1980s. Kebler Pass still closed Kebler Pass, which intersects with Highway 133 on the other side of McClure Pass and connects motorists with Crested Butte, has not yet opened, and will not open by Memorial Day, according to Gunnison County Public Works Director Marlene Crosby. In a press release, Crosby said part of the pass (County Road 12) is still too wet for vehicular traffic.

Inaugural autism walk puts best feet forward Nellie poses for the camera

Volunteers, friends, families, facilitators and four-legged creatures gathered at the Gus Darien Rodeo Arena last Sunday afternoon to participate in the first of what will become an annual Carbondale autism walk.

Officially called the “GOAuTism! Family Fun Walk,” the excursion started at the rodeo grounds, continued along the Rio Grand Trail to Town Hall, and ended back at the arena. The purpose, according to organizer Sheryl Barto of Smiling Goat Ranch east of Carbondale, was “to generate awareness.” She said there are only two other autism walks in Colorado, and they’re both in Denver.

Barto, a certified Horse Boy autism therapy practitioner, added, “It exceeded all expectations. The positive energy and support of community was so incredibly moving.”

Approximately 75 folks participated in the walk, including the JROTC from Glenwood Springs High School. The GSHS students have also been assisting Barto with a sensory trail at the ranch, where she’ll be hosting play-date sessions for autism families free of charge this summer.

The four-legged creatures at Sunday’s walk included goats and horses, which Barto said, “are an integral part of the Smiling Goat/Horse Boy program. We wanted to allow the public to meet the stars of our program!”

Trustees eye options to regulate short-term rentals

By John Colson Sopris Sun Staff Writer Carbondaleâ&#x20AC;&#x2122;s elected ofďŹ cials let the world know last week that they do not appreciate speculative home buyers taking long-term rentals out of the townâ&#x20AC;&#x2122;s affordable-housing mix, in order to make a killing by offering short-term rental to tourists.

At the same time, the townâ&#x20AC;&#x2122;s Board of Trustees (BOT) concluded that certain kinds of short-term rental arrangements might be tolerable under certain circumstances, as long as those beneďŹ ting from the relatively new industry pay their taxes and agree to abide by whatever the BOT comes up with in terms of regulations.

Exactly which types of short-term rentals will be allowed, and how the town will regulate them, will be the subject of ongoing debate and research by ofďŹ cials at town hall for the near future.

The issue arose at a May 18 â&#x20AC;&#x153;special meetingâ&#x20AC;? of the trustees, who wanted to know if the town has any options for recapturing lost sales-tax and lodging-tax revenues due to short-term rentals in private properties, and what the town might or should do to regulate such rental arrangements.

Airbnb and VRBO Carbondale, like many other towns and cities around the U.S., has found itself in the middle of what some have described as an $85-$150 billion industry involving a

plethora of new acronyms (Airbnb, VRBO and others) and the offering of rooms in houses, whole houses or condominiums for rent by the day or the week, as a way of homeowners to earn extra money.

According to town planner John Leybourne, there are 40 such short-term-rentals (or STRs for short) in and around Carbondale today, roughly half of which are actually inside the town boundaries.

In a memo to the trustees, the planning department referred to the new kind of holiday lodging as an outgrowth of â&#x20AC;&#x153;the advent of the Sharing Economy,â&#x20AC;? a phenomenon related to a reduction in incomes for many people that started with the 2008 Great Recession.

The memo from the townâ&#x20AC;&#x2122;s planners also noted that the newly enacted UniďŹ ed Development Code, which guides the town in land-use decisions, â&#x20AC;&#x153;does not address short-term rentals as an allowed use and the town only requires that lodging tax [and sales taxes] be collected, with no other review required by the building or planning departments.â&#x20AC;?

The issue also has been raised at a meeting of the town planning and zoning commission (P&Z), which requested that the trustees identify issues or problems related to STRs for further investigation.

The packet of information provided to the trustees last week included a â&#x20AC;&#x153;comparison chart,â&#x20AC;? prepared by The GarďŹ eld County Planning Department, showing

how other towns and counties have dealt with the issue in their own jurisdictions.

According to the memo, the regulations created in other jurisdictions address such impacts as: â&#x20AC;˘ Noise, increased trafďŹ c, parking congestion, trash collection; â&#x20AC;˘ The loss of long-term rental units; â&#x20AC;˘ Building code safety questions, such as carbon monoxide and smoke detectors, ingress and egress issues, occupancy limits, renter safety regulations and others; â&#x20AC;˘ Licensing and the collection of tax payments.

At the Carbondale meeting, several residents spoke of their need to rent out their homes, or rooms within their homes, in order to make ends meet ďŹ nancially. â&#x20AC;&#x153;We donâ&#x20AC;&#x2122;t want to have a roommate, but we do enjoy the income,â&#x20AC;? said Kevin Hartman, who said he rents his property through the Airbnb website.

Another, Greg Fitzpatrick, said he has rented to about 150 visitors from such diverse countries as China, the United Kingdom and Holland, visitors who might never have come to Carbondale otherwise and who beneďŹ ted the townâ&#x20AC;&#x2122;s economy by shopping and eating out.

Town Manager Jay Harrington told the trustees that the ďŹ nance department monitors STR websites to keep track of who is renting out spaces.

Harrington said the ďŹ nance department has reported that the tax collections

basically cover the costs of the monitoring activity.

Trustee Katrina Byars suggested the town might want to put a cap on the number of STRs, and that a permit system might be advisable, as the town moves to prevent the loss of affordable housing stock.

And Trustee Marty Silverstein said he has no problem with rentals of â&#x20AC;&#x153;mother-inlawâ&#x20AC;? apartments, although he added that the town might want to impose limits on how long homes can be rented out if the owner goes away on vacation. â&#x20AC;&#x153;The investment-type property is the one I have concerns about,â&#x20AC;? Silverstein concluded, citing safety issues and the loss of housing for local working people.

Trustee A.J. Hobbs said he favors the use of permits and taxes to regulate the industry, and would be willing to talk about restricting STRs to homes owned and occupied by permanent, full-time residents. â&#x20AC;&#x153;I think the short-term rentals do add vibrancy to our community,â&#x20AC;? said Trustee Frosty Merriott, though he added that a cap on the number of rentals might make sense.

The townâ&#x20AC;&#x2122;s staff will be reviewing the issue based on the trusteesâ&#x20AC;&#x2122; comments, and bring the matter back up for discussion at both the P&Z and the BOT.

ARTmentors presents local high school artists Sopris Sun Staff Report As a part of the Claudette Carter ARTmentors Program, the Art Base (formerly the Wyly Art Center) presents three upcoming student mentee exhibitions at the Charles J. Wyly Gallery.

The opening receptions are May 26; June 10 and June 24, each from 5 to 7 p.m. Each mentee exhibition runs for nine days, according to a press release.

The Charles J. Wyly Gallery, at the Art Base main campus, is located on 99 Midland Spur in downtown Basalt. Gallery hours are Tuesday through Saturday, from 10 a.m. to 4 p.m. â&#x20AC;&#x153;Swingsâ&#x20AC;? opens May 26, and will highlight photography and mixed media works by Basalt High School junior Cheyenne Myers and instructor Nancy Lovendahl.

Myers grew up in the Roaring Fork Valley and has always been interested in the ďŹ ne arts, especially when viewing life

through a photography lens. â&#x20AC;&#x153;Life has a tendency to swing in extremes â&#x20AC;&#x201D; highs and lows, sweet and bitter, good and bad. Being imperfect humans,â&#x20AC;? she said. â&#x20AC;&#x153;We all are cursed with the blessing of emotions that reďŹ&#x201A;ect those extremes. This past year, I have recognized these emotional swings, inspiring me to create this body of work. These works highlight the sentimental daydream of what is real â&#x20AC;&#x201D; emotion.â&#x20AC;? â&#x20AC;&#x153;What Are You Thinking,â&#x20AC;? which opens on June 10, will focus on mixed media drawings from Roaring Fork High School junior Katelyn Krehbiel and instructor Ingrid Magidson.

Krehbiel began drawing in eighth grade and picked up the skill quickly, enjoying the instant gratiďŹ cation of two-dimensional art.

She believes that her technical skill of drawing comes from understanding three dimensional shapes, such as in clay, and how light builds off of curves and edges to create shape.

â&#x20AC;&#x153;Through learning to work with a range of mediums and techniques, I try to show a different view of people. I try to ďŹ nd the hidden emotion in each of my subjects, and ďŹ nd the layers of personality that people may try to keep hidden â&#x20AC;&#x201D; the good and bad in all of us. I focus on eyes because they are the window into us. Through my ďŹ gures, I try to show what is hidden within the model that is beyond skin deep, and bring to light the beauty that is the human condition.â&#x20AC;? â&#x20AC;&#x153;Indecision,â&#x20AC;? which opens on June 24, showcases surrealist-based acrylic and spray painted works by Basalt High School junior Lindsey Webster and instructor Kathy Honea. Opponent makes case against Crystal River designation e wild-and-scenic issue

And proponents of the designation have said that each new river granted wild and scenic designation is subject to its own, particular set of guidelines and rules, which in this case includes language that specifically states that private property rights, or private or municipal water rights, will not be affected if the river is designated wild and scenic.

Still, Darien said the possibility of federal oversight and control of the river and its environs is at the heart of his opposition to designation.

“What I’m concerned with is having the federal government ‘helping me’ on my ranch,” he declared.

By John Colson Sopris Sun Staff Report While proponents seeking “wild and scenic” designation for the Crystal River believe they have a strong contingent of locals on their side, at least one Marble area resident opposes the idea and believes he will not be alone in his opposition.

“They say they’ve talked to everybody along the river and they’re all for it,” said Larry Darien, a native of the Roaring Fork Valley region and long-time owner of property near Marble in Gunnison County. “But they haven’t talked to anybody in Gunnison County.”

Darien said there are a number of landowners along the Crystal as it passes through Gunnison County who oppose the designation, and whom he expects will be there alongside him for a pair of meetings on June 14 at which the matter is to be publicly debated.

One meeting, scheduled for 4 p.m., will be at the Church at Redstone, and the second, on the same day, will be at the Marble Town Hall at 6 p.m. The public is invited to both meetings, and participating organizations are expected to include representatives of the two counties, the Town of Marble, the U.S. Forest Service, Wilderness Workshop, and the Crystal River Caucus, among others.

A group of long-time locals — lead by Dorothea Farris (who lives in Pitkin County), Bill Jochems (a resident of Redstone, also in Pitkin County) and Chuck Ogilby (who lives near Redstone and owns property in Marble) — have been working quietly with others who support wild and scenic designation for a 39-mile stretch of the upper Crystal, under the federal Wild & Scenic Rivers Act of 1968.

History According to a timeline provided by Farris to The Sopris Sun, the current activity in support of wild and scenic designation builds on work going back to the 1980s, when proponents conducted an inventory of lands near the river and put together a “general proposal” that was met with “interest” on the part of the public, “but also opposition, primarily over concerns with federal authority over private property and existing property rights.”

But since the turn of the 21st century, the timeline indicates, “support for designation quietly grows as area ranchers start to place conservation easement on their properties, and citizens realize designation would protect the Crystal from dams and diversions while not affecting private property or water rights.”

“The primary objective [of seeking the designation] is to prevent dams on the main stem of the Crystal and to prevent diversion of water from the Crystal outside the watershed,” states a “presentation summary” outlining the group’s goals.

Farris and others commonly cite the fact that in 2012, the year before the current designation effort got started, the American Rivers organization listed the Crystal as “one of America’s 10 most endangered rivers.” That listing was based largely on the fact that from the 1950s until just recently, there have been attempts to get two dams built on the Crystal — one near the site of the Penny Hot Springs north of Redstone, the other at the old townsite of Placita slightly south of Redstone.

Photo by Lynn Burton Those dams, Farris has said repeatedly, would have created reservoirs the size of Ruedi Reservoir [east of Basalt on the Fryingpan River] and would have drowned Redstone and much of the area surrounding the junction of Colorado Highway 133 and Gunnison County Road 3 leading to Marble.

The Colorado River District in 2013 gave up conditional water rights for those dams, after being sued in water court by Pitkin County and other groups. A year later, the river district declined to join the growing list of local governments that have supported exploration of the designation idea, which include the towns of Carbondale and Marble, the Redstone Community Association, Gunnison County, Pitkin County’s Healthy Rivers and Streams board and Pitkin County’s Crystal River Caucus, according to news reports.

The district’s main reason for opposition, according to district official Chris Treese, is its objection to the aim of Farris and others to see that there will be no further plans for dams on the upper Crystal River.

If granted by an act of Congress, the designation would cover the Crystal from Beaver Lake just upstream from the Town of Marble, all the way northward through Redstone to the headgate of the Sweet Jessup Canal that serves downvalley ranches.

$1 million easement Darien, whose land just outside of Marble is protected by a conservation easement that brought him nearly $1 million, has long opposed wild and scenic status for the river, arguing that such a status would mean unwarranted federal interference in the way landowners along the Crystal use their land.

“I think it’s unneeded,” he said of designation.

Adding that he does not favor construction of dams on the Crystal, he believes there might come a time when one is needed, particularly in light of predictions of water shortages throughout the west in the coming years due to climate change.

Given that, he said, “I think it’s shortsighted to preclude being able to build a dam on the Crystal.”

In a separate conversation with The Sopris Sun, Darien declared, “We live in an arid environment. That’s why we’ve been building dams out … west.”

Darien cited several other reasons for his opposition to wild and scenic designation, such as his understanding that the original 1968 Congressional act creating the wild and scenic rivers policy to set things up so the federal government could take control of land use within a quarter-mile of either bank.

Darien said that part of his concern about increased federal authority is due to his belief that the US Forest Service, under wild and scenic rules, would be able to exert control over his grazing rights for livestock within the quarter-mile zone, and would be authorized to ensure public access to the river regardless of a property owner’s wishes.

“So that is a taking, if you own the property,” Darien maintained. “Seeing how well the federal government manages everything, I really don’t think they can manage my property as well as I can.”

Disputing Darien Farris and others have disputed Darien’s interpretation of the act, maintaining that designation of wild and scenic does not mean the federal government will exert control over private property rights, private water rights or local control of the river.

“What we’re seeking here is a very stripped down version of a wild and scenic designation,” Jochems told participants in a Colorado River Basin Roundtable in 2014.

“We propose to leave land-use control entirely with Gunnison and Pitkin counties, as it is now. We don’t propose any further federal control over land use. We don’t want features that would allow any condemnation of property. All we’re concerned about is the main stem of the Crystal River and keeping it free of dams.”

A review of the original 1968 act itself by The Sopris Sun did not reveal any language that called for federal control of private property within the quarter-mile zone, though the Act does describe federal oversight of publicly held lands bordering the river.

White River National Forest Supervisor Scott Fitzwilliams, who said he plans to attend one or both of the June 14 meetings about the river designation, said his agency has no plans for such control, and that land-use decisions will be left to the governmental jurisdictions through which the Crystal River flows.

“Really, what we will want to do is maintain the existing character of the river,” he said, adding, “that’s part of what we’re going to talk about” on June 14.

He noted that while the USFS has supported the exploration of wild-and-scenic designation for the Crystal, the agency has yet to make a formal declaration of support or a recommendation for Congress on the matter, which he said will depend on further study.

CMC teachers retiring; looking back and ahead Denise Reynolds and Sue Feeney

By Debbie Bruell Sopris Sun Correspondent Two long-time teachers at Carbondale Middle School will be retiring at the end of this school year: social studies teacher Denise Reynolds and science teacher Sue Feeney.

Denise Reynolds The idea of becoming a teacher didn’t enter Reynolds’ mind until college, she told The Sopris Sun in an interview earlier this week. “Horses were my best friends,” she said, and she always imagined working with horses when she grew up. As a college student, she spent her summers working on a dude ranch, leading horseback riding trips and hunting trips. But she decided “there was not a lot of future in that,” and the more she thought about it, the more she liked the idea of spending her days around kids.

Reynolds received her undergraduate degree in secondary education, physical education and health from Western State Colorado University in Gunnison. Her first teaching job was in Winter Park, working as a substitute teacher, track/field coach, and ski instructor.

Reynolds got married and had her first child shortly after graduating college. Since her husband David, a certified public accountant, worked during the day, Reynolds decided to work as a bartender so that she could take care of her two young children during the day, and her husband could take

care of them in the evenings.

Once her children were school-age, she went back to full-time teaching and “never wanted to give it up.” As she told The Sun, “The kids make me laugh every day, and they teach me something every day. They keep me young.”

She began at Carbondale Middle School in 1994, teaching physical education and health.

She also taught technology and math before settling in as a social studies teacher in 1996.

Reynolds said her favorite subject to teach has been ancient Rome, which she teaches as a simulation project: Every student has a Roman identity and is part of a group of students who make up a Roman family.

Reynolds takes on the part of an extremely strict Roman teacher; she holds classes outdoors as the Romans did; Roman money (denarii) becomes the currency exchanged in their imitation Roman community; the students build models of Roman-style houses and do activities that people did in ancient Rome, such as creating mosaics and putting on Roman theater productions.

Reynolds’ plans for her retirement include spending time in Portland, Oregon with her son, daughter-in-law and first baby granddaughter, Rhye Calamity Reynolds; and with her daughter and son-in-law who live on 15 acres outside of Houston — enough land, Reynolds noted, for horses, which she hopes will happen someday soon.

Sue Feeney Feeney’s teaching career began in Arizona where she taught physical education. She also coached girls’ volleyball, basketball, and track/field. She moved to the Roaring Fork Valley in 1990, working as a substitute teacher then a full-time teacher of various subjects at Glenwood Springs Middle School.

In 1998 her neighbor, Cliff Colia, who was Carbondale Middle School principal at the time, convinced her take a job as speech teacher at CMS, where she has worked for

the last 18 years.

When Colia asked her to switch from teaching speech to teaching science her first response was, “No way. I don’t know anything about science.” As a child, Feeney attended a Catholic school which, Feeney told The Sun, was not a big fan of science.

Colia, however, convinced her to give it a try. Feeney taught herself science, and believes that that experience of having to teach herself something she knew very little about helped to make her a good science teacher.

She discovered she had a passion about science, and has continued to teach it for the past 17 years.

Feeney said her favorite thing to teach is plate tectonics because “it explains so much about how our planet came to look the way it looks now. It explains earthquakes and volcanoes … The kids love it too.”

Her goal as a science teacher has been to get kids to have fun with science and learn to love it. One of the most rewarding aspects of teaching, she said, has been when students returned to visit her later in their lives and tell her that they’re working in the field of science.

Feeney and Reynolds celebrated their final weeks as teachers at CMS by singing Frank Sinatra’s “Fly Me To The Moon,” accompanied by several eighth grade jazz band students, at the school’s recent spring band recital. Neither Feeney nor Reynolds really knows how to sing, Feeney told The Sun, “but the things we’ll do for the kids …!”

The Carbondale Police Department last week hosted a class on â&#x20AC;&#x153;Integrity Centered Leadershipâ&#x20AC;? at town hall, drawing about 40 police ofďŹ cers and administrative staff from around the region.

One police-ofďŹ cer position remains unďŹ lled, according to the memo, and advertising for a new round of applicants will begin soon, the memo  reported.  Police ofďŹ cer Mike Zimmerman, the police department's school resource ofďŹ cer, was scheduled to go along on a fourth-grade, three-day camping trip this week at Highline Lake.

The Carbondale Planning and Zoning Commission and the town's Tree Board held a joint meeting last week to discuss how the new UniďŹ ed Development Code â&#x20AC;&#x153;relates to trees in town.â&#x20AC;? No conclusions from the meeting were reported.

Carbondale ofďŹ cials are in the midst of a special-use permit process with the U.S. Forest Service about alterations to the Nettle Creek treatment plant. According to the memo, the permit process should be completed soon, and siding material for the treatment plant has been approved.

The regional group discussing a valley-wide Water EfďŹ ciency Plan met last week, with ofďŹ cials from the Ruedi Water and Power Authority, Element Water, Roaring Fork Conservancy, City of Aspen, Town of Basalt, City of Glenwood Springs and the Town of Carbondale in attendance. In addition, the group recently met with the state's Rural Water Association concerning â&#x20AC;&#x153;outreachâ&#x20AC;? on what is known as the Watershed Plan, regarding land parcels in GarďŹ eld and Pitkin counties.

The two plans â&#x20AC;&#x201D; Watershed and EfďŹ ciency â&#x20AC;&#x201D; are interrelated and work on the two plans will be conducted â&#x20AC;&#x153;in tandem,â&#x20AC;? according to the memo.
