A closer look at town’s greenhouse gas goals e year 2015 has come and gone

By Ted Stude The proposal by the Carbondale Board of Trustees to add a “climate action tax” to the other taxes already attached to residents’ bills for electricity and natural gas was apparently an attempt to continue the goals for reduction of “greenhouse gas emissions” (principally consisting of carbon dioxide) that were established by the “Energy & Climate Protection Plan” that was adopted by Carbondale’s then-trustees in 2005.

The plan was subtitled “Creating a Strong Carbondale Economy with Clean Energy,” which was certainly presumptuous considering the general tendency of Carbondalians and their elected representatives to be long on concern for environmental preservation (or at least the appearance of it), but short on knowledge of the technical and economic principles required to substantively achieve it either locally or globally.

The “Energy & Climate Protection Plan” (available on the town’s website) is 15 pages long, not counting appendices. I am retired with a professional background in civil/environmental engineering, have a master’s degree in economics, and have a lifelong commitment to what was formerly called “conservation.” There are many parts of the plan with which I agree, and many with which I disagree. But for the sake of brevity, I’ll discuss two of its provisions that are particularly relevant now.

That implies that — following the technical/economic principle of diminishing marginal returns on capital investment — these agencies are increasingly hard-pressed to identify carbon emission reduction projects that meet even relaxed economic criteria, and thereby justify the continued employment of the “energy experts” on their staffs. If the principle of diminishing returns has been temporarily offset by the decreased costs of solar panels or other technological developments, I have not seen any documentation of that by the proponents of the “Climate Action Tax.”

OPINION

Where is the analysis?

First, the plan set the goal (apparently for all households and businesses in Carbondale and not just from municipal operations) to “Obtain at least 30% of our energy for heating & electricity from renewable sources by 2015.”

Was this based on any sort of analysis that considered the capital costs to Carbondale residents and businesses, versus the benefits to them in reduced annual energy costs? No. Instead, it was based on an Internet review of “goals set by communities and corporations around the globe.” This included places like Los Angeles and Stockholm, Sweden, and corporations like Hasbro, Inc., that have little in common with Carbondale.

Second, the plan set a criterion that expenditures on energy-saving projects should have a payback period of “five years or less.” This is actually a very high economic bar to reach. If it were objectively applied to the many potential energy conservation projects, only the most basic, relatively trivial, would qualify for funding. I would support (and have professionally used) a more conservation-friendly payback period of 10 or 15 years, provided that it honestly recognized the various subsidies for “renewable energy” as costs.

But over the past 10 years, between the efforts of the town and its non-profit energy-conservation surrogates, CORE and CLEER, most of the projects that meet even the less restrictive economic criteria

Skepticism My skepticism as to the ability of Carbondale and its surrogates to implement energy conservation projects cost-effectively is heightened by the highly biased hype that appears on their websites regarding the two major projects that have been built in Carbondale under the plan – the Recreation Center and the Third Street Center. There is much boasting of the savings in net electrical energy consumption. But there is no documentation of the cost of achieving this, or of the cost and effectiveness of measures used to reduce the consumption of the natural gas that is needed to heat the buildings, or of the non-renewable electrical energy that is needed to power the buildings at night and when the wind is not blowing. I suspect that this lack of comprehensive documentation is related to the crusade to block further natural gas development in a part of the Thompson Divide area, based on extreme speculation as to negative impacts on Carbondale and disregard of the beneficial role of natural gas in replacing coal nation-wide in power generation.

The “big picture” that I see regarding Carbondale’s “climate protection” policy is this. The trustees have been so ideologically committed to the goal of reducing worldwide carbon emissions, they have been blind to practical considerations as to how much reduction could actually be achieved by Carbondale acting essentially alone, at what cost, and at whose expense. In rejecting the proposed “climate action tax,” the majority of voters of Carbondale declared that they don’t care to participate further in a presumptuous effort to set an example for the world of concern for the environment — at least not at the expense of additional taxes on themselves and others who can least afford to pay them without some form of offsetting tax relief.

CRMS eco-warrior a plaintiff in climate lawsuit Judge moves it forward

By John Colson Sopris Sun Staff Writer Proponents of a lawsuit accusing the Obama administration of violating the rights of American young people and future generations, by contributing to global warming through the promotion of fossil fuels, recently won a victory in U.S. District Court in Eugene, Oregon when a judge ruled that the lawsuit has sufficient merit to continue through the federal court system.

And there on the steps of the Oregon courthouse was a student from Colorado Rocky Mountain School, Jaime Butler, 15, of Flagstaff, Arizona, who is one of 21 plaintiffs in the precedent-setting lawsuit.

The suit, filed last year with the help of an Oregon-based nonprofit organization named Our Children’s Trust, a group of attorneys, and climate scientist Dr. James Hansen, moves ahead after a March 10 decision from U.S. Magistrate Judge Thomas M. Coffin in Eugene, Oregon.

“In this case, the government has allegedly taken action through subsidies, regulations, etc., that creates massive CO2 emissions, and has failed to limit such emissions despite a duty to do so,” states the judge’s decision, in part.

“This decision is one of the most significant in our nation’s history,” said attorney Phillip Gregory, with the law firm Cotchett, Pitre & McCarthy of Burlingame, Cal., on behalf of the plaintiffs. “The court upheld our claims that the federal government intensified the danger to our plaintiffs’ lives, liberty and property … for present and future generations.”

The local link in the case, Butler, is a member of CRMS’ class of 2019. She is part of a group of youths whose ages range from eight to 19, and who hail from various parts of the country.

But the school’s Facebook page displays a photo of the 21 students, including Butler, at an Oregon courthouse in March where the judge’s ruling was hailed as a victory.

“Defendants have known of the unusually dangerous risk of harm to human life, liberty, and property that would be caused by continued fossil fuel use and increased [carbon dioxide] emissions,” the complaint continues.

The 21 plaintiffs in a lawsuit against the federal government with their attorneys in Oregon to celebrate a judge’s decision that their lawsuit can move forward.

According to the Denver Post profile, industry activists “posted hostile comments on the Earth Guardians’ Facebook page and Roske-Martinez’ Web page, and called the Martinez home with threats.”

Other plaintiffs include eight-year-old Levi Draheim, the youngest of the group, who has said he can no longer swim in a river near his home in Indialantic, Florida, due to an increase in bacteria in the water and fish die-offs, according to the Huffington Post.

About half the plaintiffs are from Oregon and Washington, with the rest from Arizona, Colorado, New York, Hawaii, Louisiana and Pennsylvania, according to the Our Children’s Trust Web site.

Seeking court order While acknowledging that the Obama administration has taken steps to combat climate change, the plaintiffs specifically are seeking a court order to force the federal government to implement a national plan to cut atmospheric concentrations of carbon dioxide to 350 parts per million — the level many scientists agree is the highest safe concentration — by the end of this century.

The concentration of CO2 in the world’s atmosphere has topped 400 parts per million already, and scientists have predicted the levels will continue to in-

crease unless emissions of CO2 and methane are reduced.

At last month’s hearing, Judge Coffin reportedly questioned a U.S. Department of Justice attorney about whether the government, by encouraging natural gas drilling as a way of reducing U.S. dependence on foreign oil, is “trading future harm for present-day benefits,” according to a summary on the EcoWatch Web site.

“Are you robbing Peter to pay Paul?” the judge reported asked of a Justice Department lawyer.

Attorney Nate Bellinger of Oregon, who works for Our Children’s Trust, said the next step in the court battle will be a review of Judge Coffin’s decision by another judge in the same court.

If the ruling is affirmed, Bellinger said, the case will then be headed to trial, as further appeals would be unlikely.

Bellinger explained that many of the plaintiffs know of each other, or have met through the Earth Guardians organization, which also is a plaintiff in the lawsuit.

Aside from the federal lawsuit in Oregon, Bellinger noted that Our Children’s Trust is involved in other environmental lawsuits around the country, such as one in Denver that recently went against six young plaintiffs hoping to chip away at the Colorado Oil & Gas Conservation Commission’s inherent conflict of interest in its oversight of the state’s energy industry.

Attacks COGCC Filed by Roske-Martinez and five other youth activists, the suit attacks the COGCC’s dual purpose under state law, which is to both promote the development of oil and gas reserves in Colorado and to be a watchdog over the industry’s potential for polluting the air and water near drilling rigs and other facilities.

A little over a week ago, Denver District Court Judge Eric Elliff ruled against the young plaintiffs’ suit, which arose from an attempt to force the COGCC to “stop issuing permits that allow oil and gas drilling until it is proven that drilling can be conducted without adversely impacting human health and safety and without harming the environment and wildlife,” according to a summery on the Our Children’s Truste site.

The COGCC rejected the youths’ petition, and the plaintiffs turned to the courts.

“Without question, this decision (by the COGCC) places public health at a level that is only as important as corporate dollars,” said Julia Olson, a native Coloradan and director and chief legal counsel at Out Children’s Trust.

“The health, safety and welfare of all Coloradans are now subordinate to the interests of the fossil fuel industry’s development of oil and gas resources,” Olson continued. “While no one suggests that public health, safety and welfare should be the sole factors, they should certainly be the primary factors in everything the state does, including natural resource development.”

The case has been sent to the Colorado Court of Appeals, where the plaintiffs hope to obtain a different judicial result.

FRIDAY, April 1: At 1:22 p.m. police were called to investigate a case of vandalism on South 2nd Street, where a home had been egged the night before.

As Carbondale’s municipal workers continue with the transition to spring and summer programs and activities, the parks department took what Town Manager Jay Harrington described as “the first step in weed mitigation at the North Face Bike Park” at the south end of town.

In his weekly memo to the Board of Trustees and other recipients, Harrington reported that the town’s parks department oversaw the burning of weeds that have sprung up since the snows have melted.

The “second step,” Harrington continued, will be the placement of weed barriers and pea gravel “on the horizontal surfaces of the pump tracks” which was to be done this week.

The third phase of weed mitigation, Harrington reported, will be to seed the berms and hillsides of the pump track, the jumplines and the non-riding surfaces “to establish a native low growing grass,” which he wrote will be done when the irrigation system is turned on for the season.

The town is striving to avoid using herbicides for weed control, in keeping with previous declarations by town leaders that only natural weed control methods would be tried before any chemicals would be applied.

In other news: The John M. Fleet Municipal Pool has been uncovered, and is being readied for the summer season of swimming. The first scheduled use of the pool will be American Red Cross lifeguarding classes, scheduled to take place from May11-15. To qualify, a participant must be 15 years old, at least, by the end of the class.

There also will be lifeguard classes in June, a session that is to take place from June 15-19, Harrington wrote. Prospective lifeguards can register for the classes on line at the town’s recreation Web site (www.carbondalerec.com) or by contacting the town’s

Aquatics Coordinator, Margaret Donnelly at mdonnelly@carbondaleco.net.

Additionally, information about the town’s summertime recreation programming can be found at the Web site, or by picking up a copy of the town’s recreation brochure at the Carbondale Recreation and Community Center next door to Town Hall on Colorado Avenue. The brochure was scheduled to be mailed out to local residents on April 14, and both online and walk-in registration for programs currently is available.

In other recreation news, Harrington reported that the parks crew has installed two new volleyball nets at Miners Park, and has roto-tilled the sand in the volleyball courts to soften it up for games. Parks employees also started work on the handrail at Staircase Park along the Crystal River.

Parks Department and Utilities Department workers met at the Gateway RV Park bathhouse recently to discuss proposed maintenance work on the park’s water system, according to the memo.

Regarding the town’s finances, Harrington reported that sales tax revenues for the first quarter of 2016 are up more than 8 percent over the same period in 2015. The town derives the majority of its annual income from sales taxes.

The town’s planning staff has been working with applicants for a new privately funded senior housing project, on a site north of the Rio Grand Trail near the trail’s intersection with North 2nd Street, dealing with pre-application requirements and application requirements, Harrington reported in his memo.

The new Unified Development Code, known as the UDC, has been finalized and is now posted on the town’s Web site (www.carbondalegov.org), and copies have been sent to town staff, town boards and commissions, referral agencies and to citizens who signed up for updates on the code, Harrington reported.

SATURDAY, April 2: At 10 minutes past midnight, an officer was called to a bar concerning a disturbance in progress, arriving to find a 26-year-old male being held down by bar security personnel. An investigation turned up allegations that the man had punched one of the bar’s security guys and a female bartender. The suspect was arrested an issued a summons into court.

SATURDAY, April 2: At 1:49 a.m. police stopped a vehicle at North 4th Street and Colorado Avenue for failing to stay in its lane, and subsequently arrested the 23year-old driver on suspicion of driving under the influence of alcohol or drugs.

SUNDAY, April 3: At 1:58 a.m. police stopped a vehicle at Main Street and East Bank Point for failing to keep to the right side of the road, and subsequently arrested the 31-year-old driver on charges of driving while drunk or drugged.

WEDNESDAY, April 6: At 1:57 a.m. police stopped a vehicle for failing to stay in its lane. After investigating, officers ticketed the 26-year-old driver for driving under the influence of alcohol, driving without a valid license and for driving with a revoked license.

Congratulations to long-time Carbondale resident Mary Lilly, who celebrated her 100th birthday on April 7. Mary tells The Sopris Sun that as a young woman, she skied all over the world. She attributes her longevity to an active life style, and being married to a doctor who taught her healthy habits such as no drinking or smoking.

Carbondale Community Food Co-op looks to future Important membership meeting April 30

By John Colson Sopris Sun Staff Writer Members of the Carbondale Community Food Co-op are being invited to take part in an upcoming meeting of the membership and managers of the organization, and while some might have worried that the meeting could bring out some bad news, those in charge say that’s not the case.

A notice on the organization’s Web site describing the April 30 membership meeting contained the statement, “We need your active participation right now to keep our doors open. We will also be presenting important issues for members to vote on!”

But the situation is not in any way as critical as that statement might seem to some, according to one co-op veteran.

“Things are going really well,” said coop vice president Laurie Guevara-Stone on Monday.

While management of the small, natural-foods emporium is challenging, as it has been since it opened its doors eight years ago, it is not in immediate danger of closing she said.

Still, she conceded, “We have been losing money for years,” and some of the discussion at the April 30 members’ meeting will be to talk about “rebranding” the

business, possibly with a new name and logo, and about the idea of making changes in the membership-dues arrangement to boost income.

“We’re just trying to make some changes to make the co-op more sustainable,” said Guevara-Stone, explaining that one item in particular is needed — a “point-of-sale” system that would allow for better inventory control as well as let the management keep track of how many shoppers are members and how many are not.

Guevara-Stone noted that, while the coop has about 500 members, there is no way of knowing how many non-members are buying items over any given period of time.

“We’d love to have more members,” Guevara-Stone said, but she added, “We just really want more people to shop there and support the co-op.”

The computerized system in question, known in shorthand as a POS, “costs thousands of dollars” and remains out of the organization’s financial reach for now.

One aspect of the co-op’s fiscal constraints, Guevara-Stone conceded, is that the co-op has some fairly significant debt to pay off, including debts to long-time vendors, which the organization plans to remedy before any big cash outlays for equipment updates.

Despite those difficulties, the co-op has expanded beyond its original space and recently completed a remodel that opened the current space up a bit, Guevara-Stone said.

“It seems like a whole new place,” she enthused. “It seems a lot bigger.”

When asked if the organization is contemplating any further expansion into neighboring commercial spaces, Guevara-

Stone replied, “We’re talking about that, but nothing’s really firm yet.”

The â&#x20AC;&#x153;building,â&#x20AC;? at 559 Main, is actually one of two buildings at the corner of 6th and Main streets, one of which is occupied by Teresaâ&#x20AC;&#x2122;s Market. The building that houses the co-op has a couple of other retail spaces that have occasionally stood vacant for some time.

The property is owned by Bren Simon, who, following a reportedly acrimonious court battle with family members of her late husband, Mel Simon, in 2012, came out with an unspeciďŹ ed portion of the $2 billion estate.

She has since been quietly accumulating real estate in and around Carbondale, including the property that houses the co-op. â&#x20AC;&#x153;Sheâ&#x20AC;&#x2122;s been great to work with,â&#x20AC;? Guevara-Stone said of Simon. â&#x20AC;&#x153;Sheâ&#x20AC;&#x2122;s been a great landlord.â&#x20AC;?

But the expectation held by some members of the coop and other observers of Carbondaleâ&#x20AC;&#x2122;s business climate Laurie Guevara-Stone is that at some point Simon CCFC VP will want to tear down the moderately ramshackle buildings that now occupy the property and build something new.

And the concern among co-op managers is that the organization might not be able to afford the rents in whatever is built.

But, said Guevara-Stone, Simon has given no indication as to when or if that might happen. â&#x20AC;&#x153;She keeps saying she has no immediate plans to do anything,â&#x20AC;? Guevara-Stone explained.

Simon, whose late husband was a shopping-mall magnate in Indianapolis, Indiana, is in charge of the Melvin &

Bren Simon Foundation, which has a long record of providing support for a number of health-care, environmental, social welfare and therapy organizations around the country, among other activities.

Simon, who owns considerable real estate in the center of Carbondale, has not consented to interview requests through intermediaries and remains a somewhat elusive ďŹ gure in the townâ&#x20AC;&#x2122;s commercial and political landscape.

Carbondale’s bag fee subsidizing Waste Diversion Day Coming April 30

By John Colson Sopris Sun Staff Writer Carbondale residents once again will, at the end of this month, have an opportunity to clear out their collections of junk and gear in a way that not only will give them more space at home but also will benefit the environment by keeping all that junk from ending up in local landfills.

And the costs of disposing of all that junk will be paid by a program that also has been hailed for its environmental benefits — the town’s five-year old ban on plastic grocery bags and a related fee.

Every time a customer asks for a paper bag to carry their groceries at the Carbondale City Market grocery store, they pay 20 cents for it, and that money accumulates in a fund that is used to subsidize costs associated with the town’s annual Waste Diversion Day (WD Day) and spring clean up.

This year’s WD Day falls on April 30, from 8 a.m. to 4 p.m., at 4th Street and Colorado Avenue, across from Town Hall.

Carbondale residents can avail themselves of special pricing and “free offers” if they bring a photo ID and a utility bill or vehicle registration to confirm their intown status.

For example, for town residents the cost of disposing of a “regular pickup load” of general household waste will be $10. Non-

residents will be charged $25. For bigger loads, residents will be charged $20, while non-residents will pay $35.

As has been done in previous events of this kind, WD Day will feature a number of different types of environment-friendly collection sites for household waste, including furniture and appliances (see the town’s website for details about these types of items at carbondalegov.com).

Also accepted will be electronic items such as cell phones, computers, light bulbs, and large and small batteries; large items such as old tires; and other material.

The event is organized by the town’s Environmental Board, known locally as the EBoard, which is made up of nine volunteers who meet regularly and come up with ways to “address environmental issues that may include environmental pollution, solar orientation, water quality, air quality, use of pesticides and herbicides, transportation, water conservation, and recycling and solid waste,” according to a description on the town’s Web site.

Landfill diversions According to a fact sheet drawn up by E-Board Chair Julia Farwell, there are many reasons to divert waste from the landfill, including the fact that items of trash often contain “resource waiting to be extracted” and reused for other purposes.

ates methane, which is currently considered the most harmful of the greenhouse gases that experts say are contributing to global warming and climate change.

Finally, there is the need to save space in existing landfills, many of which face closure or other difficulties if they continue to fill up as they have in the past.

Farwell has a list of companies who will be taking recyclable items turned in on April 30 to a wide range of recycling operations — such as one that “demanufactures” electronic equipment in Fruita, Colorado, and then ships it to smelters in the U.S., and a processor of old tires in Colorado Springs.

Farwell and her fellow E-Board members lamented that last year too much of the stuff collected on WD Day actually ended up in landfills, although it was not supposed to.

Farwell decided last fall, after that season’s WD Day, to exact pledges from hauling companies working with the WD Day event, to ensure that they would take the recyclable material, as well as lawn and yard waste, to recycling centers rather than simply dumping them at a landfill somewhere.

For textiles and household goods, the EBoard has made arrangements with the Basalt Thrift store to handle the goods for resale and/or recycling. Farwell’s mention of the arrangement, in a summary provided to The Sopris Sun, notes that only clean

textiles will be accepted, although “torn and stained items are okay” and adds, “usable textiles and household goods are resold to raise money for charities locally.”

A new program for WD Day calls for locals to turn in their old campaign signs from recent elections, which the EBoard will “repurpose” for Dandelion Day craft uses.

Another new entry in the WD Day event will be a focus on cleaning up litter along the town’s streets and in the parks, a program that was inspired by remarks from outgoing Carbondale Trustee Pam Zentmyer during a discussion between the Board of Trustees and the E-Board.

To facilitate participation by citizens, Farwell reported that the E-Board “will be providing bags and gloves, so stop by and show our parks, streets and trails a little love by picking up litter — not just for this event but year round!”

There also will be free compost, courtesy of EverGreen Events, handing out compost delivered from the Pitkin County landfill’s composting facility, and free LED lights for those who bring in old light bulbs for recycling. The E-Board also will distribute reusable shopping bags and “Waste Free Roaring Fork” booklets outlining some of the waste diversion efforts underway in the valley.

Wellness paradigm: We’re programed for vitality If your house were on fire, whom would you call? The fire department, of course. The fire fighters would come in with axes and hoses and make sure the fire was out. When your house needed to be rebuilt, would you again call the fire department? Of course not. Dr. James Chestnut, a health researcher and chiropractor, uses this analogy to highlight the difference between sickness- and wellnessbased health care.

Modern allopathic medicine is the fire department. It is really good at putting out the fire — that is, dealing with an emergency such as a broken bone, an infection or an emergency surgery.

Mainstream medicine assumes that we will all get sick eventually and thus is always on the lookout for a fire. Allopathic medicine focuses on treating disease after it has happened; in this model “preventative” medicine is just early detection and treatment, not true prevention. This world view represents the sickness-care paradigm and defines how medicine is practiced most of the time in the United States.

The wellness- care model is based on the belief that a lot of fires don’t need to happen in the first place. The wellness paradigm posits that our natural state is health; human beings are programmed for vitality, not for ill health and disease.

From my perspective, this calculation should be the determining factor in whether we choose to enjoy fish or use a quality fish oil supplement. Healthy cells are the basic building blocks of our bodies — our “houses.”

By necessity, science reduces variables as much as possible to arrive at answers to questions. Modern medicine does pretty well dealing with a few variables.

However, the hugely varied big picture of true good health and well-being is much too complex for a medical study. The wellness paradigm approaches the big picture by asking what is needed to provide a solid foundation and strong timbers and beams. The wellness paradigm looks to build the house. Provide nutritional sufficiency, reduce toxicity, eat well, move well and think well, and the firefighters won’t have to come with their hoses too often.

At Third Street Center Davi Nikent, Center for Human Flourishing hosted 20 wellness businesses, nine community gardens/CSAs in the Calaway Room and the gym. Thanks to everyone who said YES to the invitation. Special thanks to Mindful Life Program and Buddy Program, who held open house events in their suites, and

posted at each library branch, Carbondale Branch Library, Glenwood Springs Branch Library, New Castle Branch Library, Silt Branch Library, Rifle Branch Library and Parachute Branch Library.
