Election Officials Contest Wayne County Election WAYNE COUNTY/ SALT LAKE CITY - The office of Spencer Cox, Lieutenant Governor of the State of Utah, who is in charge of overseeing elections within the state, announced on Friday, July 15, 2016 that allegations of misconduct were “recently raised related to the county commission primary race in Wayne County.” The announcement stated that if proven to be accurate, the allegations may have impacted the final outcome of the election. In response to the allegations, Lt. Gov. Spencer J. Cox, in conjunction with the Attorney General’s Office, the Wayne County Attorney’s Office and the Wayne County Clerk/Auditor’s Office, have filed in 6th Judicial District Court the necessary legal petition to contest the Wayne County commission primary election. This court filing is necessary at this time because the deadline to file an election contest was July 15. “We moved faster than probably we wanted to, but had to because we had until [last] Friday to contest the elections. It is an ongoing investigation, and we would have liked to have more time to know where

we stand, but needed to act by Friday, July 15,” said Mark Thomas, who is Director of Elections within the Lieutenant Governor’s office. Utah state statute says that to contest an election you have to file within 10 days of the election canvass. The legal petition filed on July 15 states, “The challenge to the election is based, primarily, on the conduct of the candidate, Respondent David Brinkerhoff's, wife, Respondent Coral Brinkerhoff, who is an employee of Wayne County and who improperly and wrongfully used her official position to improperly change voter affiliations to allow voters to vote in as a Republican in the 2016 primary election, as well as improperly and wrongfully using her official position to access voter databases to determine who had, or had not, voted by mail and then used that information to call voters and urge them to vote for Respondent David Brinkerhoff.” The petition continues, “Respondent Coral BrinkerElection Results Cont'd on page 2
