Jury: Woman’s fall was own fault BY NICK TABOREK Daily Press Staff Writer

SM COURT In a law suit that could have cost City Hall millions of dollars, a civil jury has determined a Big Blue Bus driver is not to blame for the partial paralysis of an 83-year-old woman who fell shortly after getting onboard. In a case stemming from a 2008 incident, Beatrice Kaufman alleged that the bus driver gave her insufficient time to be seated after getting on the bus. As the driver pulled away from the curb Kaufman fell, breaking

her hip and sustaining other injuries that have left her paralyzed below the waist and confined to a 24-hour care facility. Through her attorneys at Santa Monica firm Greene, Broillet & Wheeler, Kafman’s final settlement offer before the case went to trial was nearly $4 million. City Hall had offered her $25,000. At trial, Debra Kanoff and Anthony Serritella, lawyers in the City Attorney’s office, argued Kaufman had plenty of time to find a seat but intentionally remained standing after getting on the bus, holding

onto a support beam instead of heading for nearby seats that were available. She waited about seven seconds and then let go of her support rail while the bus was moving, losing her balance and falling because of her own negligence, they argued. Kaufman, now 84, testified during the week-long trial, being brought in on gurney to tell her story. Opposition to the stimulus plan is nearly universal among top national Republicans like former presidential candidate Mitt Romney — who says it hasn’t created private sector jobs — and Minnesota Gov. Tim Pawlenty, who calls Obama’s plan a big waste of money.

Negrohead Mountain in Southern California’s Santa Monica range was officially renamed Saturday in honor of a black pioneer who settled the area in the 19th Century. The 2,031-foot mountain near Malibu, the highest peak in the area, became Ballard Mountain after John Ballard, a blacksmith and former slave who bought land on the mountain in 1880. The name originally contained a vulgar racial slur that even appeared on federal maps, but it was changed to “negro” in the 1960s. About 90 people including some two dozen Ballard descendants attended the renaming ceremony Saturday at the site where Ballard owned a 320-acre homestead near what is now the community of Seminole Hot Springs. “I don’t know what it means to Los Angeles as a whole, but it means a lot to me,” Ballard’s 85-year-old great-grandson Reggie Ballard, a retired LA Fire Department captain, told the Los Angeles Times. The U.S. Geological Survey’s Board on Geographic Names approved the change last year after a request from the Los Angeles County Board of Supervisors. “It’s not often you get a chance to right an historical wrong,” Supervisor Zev Yaroslavsky, who made the name-change motion, said at the ceremony Saturday. A permanent plaque with Ballard’s name and story is being placed near the top of the peak. Ballard was part of a small group that founded Los Angeles’ African Methodist Episcopal Church in 1869 but left Los Angeles for the mountains 50 miles away a decade later. Historians believe that Ballard and his family were fleeing growing segregationist polices in the city.

I feel obligated to respond to Mr. Wheeler’s “Letter to the editor” on Feb. 17 (”Looking for another party”). Mr. Wheeler, I think you must be confused why people do not want the “ObamaCare” that has been proposed to the public (and I use that term loosely). I am sorry that you have people in your family who have specific health needs and requirements and I feel for you, but this health care proposal will not fix your fears if you lose your job. When you need to go to the hospital or emergency room there will be a long wait and so will your doctor’s office. You will not get the same health care you have been providing your family because the government isn’t going to pay for the things your family members might need. They may die while waiting for an operation or not get diagnosed in time because “ObamaCare” won’t have the time & money to spend on you. Having the government control our health care is a horrible mistake. Have you been to other government agencies before and had good results: social security, IRS, DMV and INS just to name a few. What the government could do for us is regulate the insurance companies who are the ones making it impossible for people to have insurance. We should be able to buy insurance from any state, choose whatever coverage works for our lifestyle (which includes not having insurance if you don’t want it, instead of being penalized), and be rewarded for taking good care of your health like car insurance. So Mr. Wheeler, we are not being obstructionists or people interested in political gain. We are people who have thought this proposal out and don’t like the outcomes we see in the future. We are trying to protect your family from bad health care. God bless your family and I hope you stay employed so you can chose the health care you want and the doctors you trust.

appoint someone to fill the late Ken Genser’s seat on the dais. The appointed one (as opposed to anointed one) will serve until November when the voters will elect a candidate to serve out Genser’s term which expires in November, 2012. There are three key names in play. Former planning commissioner Terry O’Day, present planning commissioner Ted Winterer followed by Santa Monica for Renters’ Rights chair Patricia Hoffman. SMRR council members constitute a four to two majority. O’Day resigned from the Planning Commission last August. In his resignation letter he wrote, “I believe that my time and attention is needed more elsewhere. In particular, with my family, my environmental activist work and my career." However, O’Day told the Daily Press last week (“Candidates Stump for council seat," page 1, Feb. 13-14) that he “stepped down from the Planning Commission in order to spend more time with a close friend who was terminally ill and who died late last year.” There seems to be a discrepancy here. Which is it, Terry? Family and career or nursing a dying friend? This contradiction isn’t the first time O’Day has seemingly played fast and loose with the facts. It was O’Day who, as co-chair of Save Our City (the committee that opposed 2008’s Measure T ballot proposition capping commercial development), set a new standard for campaign lies and deceit. I know I’ve beaten Measure T to death, but I look at it as a new benchmark for fraudulent and dishonest campaigning. O’Day and SOC Co-Chair Judy Abdo shoulder complete responsibility for this low point — even for Santa Monica politics. Developers, hotels and real estate interests contributed the lion’s share of $772,000 to O’Day’s SOC in 2008 and the $100,000 he raised for a council run in 2006. Contributors included firms with large projects currently awaiting city approval. At least one, possibly two, council persons oppose Winterer because he “is too divisive” by co-authoring and backing RIFT (Peoples Initiative to Reduce Traffic) which became Measure T on the 2008 ballot. Since when is having a different opinion being divisive? Weren’t those opposed to “T” also divisive? Lying to and deliberately misleading voters is even more divisive in my book. O’Day’s credibility is the issue and his closeness with developers and related deeppocket special interests is equally troubling. His record of community involvement and record for supporting priority needs such as more housing can’t compare with Winterer’s. O’Day’s potential appointment — and likely run for council this fall (appointment or not) — is already dogged by questions about character, honesty and special interest largess.

SMRR power brokers are already lining up Rent Control Board member Jennifer Kennedy or freshman school board member Ben Allen as possible tie-breakers if council deadlocks between O’Day and Winterer. Nevertheless, O’Day on council is the kind of real “divisiveness” Santa Monica doesn’t need. This leaves one real choice for Genser’s seat: Ted Winterer. AN END TO FREE PARKING?

Here in California, everything is in the crapper. State politicians have no grasp of priorities or managing resources. Forget piloting the ship of state away from the financial rocks. Their time is spent on social engineering or personal agendas, not solving problems. California’s legislators are universally despised. The poster child for dysfunctionality is state Sen. Alan Lowenthal (D-27th District, Long Beach) who is more concerned about too much free parking than balancing budgets and finding funding for education. His SB 518 limits free parking throughout California. The legislation (approved by the Senate and headed for the Assembly) encourages municipalities and counties to curb free parking or lose out on transit grants. It would allow municipalities to earn “points” through parking reforms such as eliminating free parking for commercial, retail and residential developments and requiring employers to issue transit passes. It also provides financial incentives for cities and counties to curb free street parking and at government offices. State funding would be available for “paid” parking facilities and transit programs. Bonus “points” could be redeemed for grants. Here in Santa Monica, such a scheme would be welcome. The social engineers at City Hall have been trying to force us out of our cars for decades. Being paid by the state to eliminate free parking — seen by many City Hall transit and enviro-nuts as encouraging private vehicle use — would be a gift from heaven to city leaders and staff while making life miserable for the rest of us. With California billions of dollars in debt, where does Lowenthal think he’s going to find the money to pay for all this? School funds? Maybe we should all ask our own state senator, Fran Pavley -—whose 2012 re-election campaign is already in full gear. She’s consistently supported and voted for this piece of garbage legislation. Better yet, let’s eliminate free parking for all senators, assemblymen and members of Congress by confiscating their “parking fee exempt" license plates. Gas prices on way down THE ASSOCIATED PRESS CAMARILLO The average price of regular gasoline in the United States is down 3.29 cents over a two-week period to $2.63. That’s according to the national Lundberg Survey of fuel prices released Sunday. Analyst Trilby Lundberg says the average price for a gallon of mid-grade was $2.77.

Premium was at $2.88. Cheyenne, Wyo., had the lowest average price among cities surveyed at $2.32 a gallon for regular. Honolulu was the highest at $3.33. In California, the average price for a gallon of regular was $2.87. Stockton had the state’s least expensive gas at $2.79 a gallon. Los Angeles was the steepest at $2.90.

’Shutter Island’ makes waves with $40.2M debut DAVID GERMAIN AP Movie Writer

Martin Scorsese and Leonardo DiCaprio’s voyage to “Shutter Island” has landed them at No. 1 at the weekend box office. Their creepy crime thriller set at a remote insane asylum opened with $40.2 million, according to studio estimates Sunday. A Paramount Pictures release, “Shutter Island” is the fourth collaboration for Scorsese and DiCaprio and the best opening yet for both the director and star. Scorsese’s previous personal best was $26.9 million with his 2006 Academy Awards champ “The Departed,” which also starred DiCaprio. The biggest previous debut for DiCaprio was $30.1 million for 2002’s “Catch Me If You Can.” Along with “The Departed,” DiCaprio and Scorsese also worked together on “Gangs of New York” and “The Aviator,” both of them earning best-picture nominations at the Oscars. “The two of them have great chemistry, and you see it on screen,” said Rob Moore, vice chairman at Paramount. Roman Polanski’s thriller “The Ghost Writer” got off to a big start in limited release, pulling in $179,000 at four theaters in New York City and Los Angeles for a whopping average of $44,750 a cinema. That compares to a $13,440 average in 2,991 theaters for “Shutter Island.” The film likely benefited from months of press coverage over Polanski’s arrest in Switzerland last fall and his possible extradition to the United States, which he fled in 1978 after pleading guilty to unlawful sexual intercourse with a minor. "If not for the notoriety in his public life, no, I don’t think this would have done as well,” said Paul Dergarabedian, box-office analyst for Hollywood.com. “It put a spotlight on Polanski, maybe not for all the right

reasons. But they say there’s no such thing as bad publicity, especially when it comes to marketing a movie.” Released by Summit Entertainment, “The Ghost Writer” stars Ewan McGregor in the title role, a man hired to punch up the dreary memoirs of a former British prime minister (Pierce Brosnan) who has been accused of ordering the abduction of terrorism suspects and handing them over for torture by the CIA. The previous weekend’s top movie, the all-star romance “Valentine’s Day,” slipped to No. 2 with $17.2 million, falling a steep 69 percent from its $56.3 million debut. The Warner Bros. release raised its total to $87.4 million after 10 days in theaters. The science-fiction sensation “Avatar” is still going strong after two months in theaters, coming in third with $16.1 million and raising its record domestic total to $687.8 million. Worldwide, the 20th Century Fox film has taken in $2.47 billion. Adapted from Dennis Lehane’s novel, “Shutter Island” stars DiCaprio as a U.S. marshal caught up in conspiracies and delusions while investigating the disappearance of a patient at a hospital for the criminally insane. “Shutter Island” had been scheduled for release last October and was considered a potential Oscar contender given the awards success of Scorsese and DiCaprio’s earlier collaborations. Just six weeks before the planned release last fall, Paramount abruptly bumped “Shutter Island” to February, the studio calling it an economic decision that would increase the film’s profit potential. “We knew that more time was only going to help us get the word out and get a broader audience,” Moore said. Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Hollywood.com. Final figures will be released Monday.

WASHINGTON Top researchers now agree that the world is likely to get stronger but fewer hurricanes in the future because of global warming, seeming to settle a scientific debate on the subject. But they say there’s not enough evidence yet to tell whether that effect has already begun. Since just before Hurricane Katrina hit Louisiana and Mississippi in 2005, dueling scientific papers have clashed about whether global warming is worsening hurricanes and will do so in the future. The new study seems to split the difference. A special World Meteorological Organization panel of 10 experts in both hurricanes and climate change — including leading scientists from both sides — came up with a consensus, which is published online Sunday in the journal Nature Geoscience. “We’ve really come a long way in the last two years about our knowledge of the hurricane and climate issue,” said study co-author Chris Landsea, a National Oceanic and Atmospheric Administration top hurricane researcher. The technical term for these storms are tropical cyclones; in the Atlantic they get called hurricanes, elsewhere typhoons. The study offers projections for tropical cyclones worldwide by the end of this century, and some experts said the bad news outweighs the good. Overall strength of storms as measured in wind speed would rise by 2 to 11 percent, but there would be between 6 and 34 percent fewer storms in number. Essentially, there would be fewer weak and moderate storms and more of the big damaging ones, which also are projected to be stronger due to warming. An 11 percent increase in wind speed translates to roughly a 60 percent increase in damage, said study co-author Kerry Emanuel, a professor of meteorology at MIT. The storms also would carry more rain, another indicator of damage, said lead author Tom Knutson, a research meteorologist at NOAA. Knutson said the new study, which looks at worldwide projections, doesn’t make clear whether global warming will lead to more or less hurricane damage on balance. But he pointed to a study he co-authored last month that looked at just the Atlantic hurricane basin and predicted that global warming would trigger a 28 percent increase in

damage near the U.S. despite fewer storms. That study suggests category 4 and 5 Atlantic hurricanes — those with winds more than 130 mph — would nearly double by the end of the century. On average, a category 4 or stronger hurricane hits the United States about once every seven years, mostly in Florida or Texas. Recent category 4 or 5 storms include 2004’s Charley and 1992’s Andrew, but not Katrina which made landfall as a strong category 3. Outside experts praised the work. The study does a good job of summarizing the current understanding of storms and warming, said Chunzai Wang, a researcher with NOAA who had no role in the study. James Lee Witt, former director of the Federal Emergency Management Agency, said the study “should be a stern and stark warning that America needs to be better prepared and protected from the devastation that these kinds of hurricanes produce.” The issue of hurricanes and global warming splashed onto front pages in the summer of 2005 when MIT’s Emanuel published a paper in Nature saying hurricane destruction has increased since the mid-1970s because of global warming, adding it would only get worse. Several weeks later Hurricane Katrina struck, killing 1,500 people and the 2005 hurricane season was the busiest on record with 28 named storms and seven major hurricanes. But then other scientists led by Landsea disputed the conclusions that storms were already increasing in number or intensity. Now Landsea and Emanuel are coauthors on the same paper with Knutson. In 2007, the authoritative Intergovernmental Panel on Climate Change said it was “more likely than not” that manmade greenhouse gases had already altered storm activity, but the authors of the new paper said more recent evidence muddies the issue. “The evidence is not strong enough that we could make some kind of statement” along those lines, Knutson said. It doesn’t mean the IPCC report was wrong; it was just based on science done by 2006 and recent research has changed a bit, said Knutson and the other researchers. Lately, the IPCC series of reports on warming has been criticized for errors. Emanuel said the international climate panel gave “an accurate summary of science that existed at that point.”

White House trees on the move THE ASSOCIATED PRESS WASHINGTON On an otherwise quiet Saturday at the White House, there was quite a sight along the driveway: the careful unearthing of two trees to make way for some construction underneath the front lawn. People walking along Pennsylvania Avenue saw two enormous cranes stationed just outside the West Wing. One crane lifted away a sugar maple tree that had been planted by President Ronald Reagan in 1984. And then a large linden tree, planted by the National Park Service in 1979, was also

hauled out of the ground. The White House said both trees eventually would be replanted in the front yard. They are being moved as part of a project to modernize the electrical wiring, duct work and other underground infrastructure of the building. No cost estimate of the project was immediately released. A White House official said more details on the construction project would be released soon. The moving of the trees was scheduled for the weekend to limit the disruption of daily activities at the White House.

But these advances are only a small evolutionary step from the world’s first battery designed by Alessandro Volta in 1800 using layers of metal and blotting paper soaked in salt water. With battery technology advances long overdue, researchers are racing to develop more efficient ways to store power. One hopeful option is in the use of carbon nanotubes, which can store much more electricity by weight than lithium-ion batteries while keeping their charge and remain durable for far longer. But what are carbon nanotubes, and how can they be used to store energy? Technicians skilled in working with matter at the molecular (nano) level can arrange pure carbon molecules in cylindrical structures that are not both strong and flexible. They have significantly higher energy density and can store more electricity than any currently available technology. These tubes, each only billionths of a meter wide, essentially become highly efficient, electrically conductive pipes for storing and providing power. Electrical engineers at the Massachusetts Institute of Technology (MIT) have formed

carbon molecules into tiny springs that store as much electricity as same sized lithium-ion batteries but can maintain a charge while dormant for years and work well in temperature extremes. Stanford University researchers have created ink made from carbon nanotubes that can be drawn onto paper where it serves as a high-capacity rechargeable energy storage medium. And University of Maryland scientists have created nanostructures able to store and transport power at 10 times the energy density of lithium-ion batteries. Other technologies in development include batteries using zinc-air, lithium-air and other combinations of elements to provide longer run-times between recharges. Others still are working on prototype nuclear batteries, the trick being to make them small enough to be practical, let alone safe. Of course, the accelerating growth of nanotechnology itself, which has not yet been thoroughly tested to evaluate potential down sides, has some health advocates worried. Animal studies have shown that some nanoparticles, if inhaled or ingested, can harm the lungs and also cross the bloodbrain barrier, which protects the brain from toxins in the bloodstream. And then there are fuel cells, created in 1839 but only recently commercialized. Not batteries per se, fuel cells generate, store and dispense power by forcing a reaction between a fuel (hydrogen from water, methanol) and oxygen, creating usable nonpolluting electricity. One major hurdle for fuel cell makers is making them small enough to be able to work in laptops and other small personal electronics. Want to talk environment? Woman was seeking $4M FROM SUIT PAGE 1 elderly plaintiff, but said she believed the accident was clearly not the bus driver’s fault. “It’s a huge case where the plaintiff counsel I’m sure felt the sympathy would carry the day and instead the jury focused on the evidence,” Kanoff said. “It’s sad, but that doesn’t mean somebody else should pay for it,” she said. In making City Hall’s case, Kanoff relied on a video tape from the Big Blue Bus surveillance system that showed the incident. Kanoff argued the tape clearly showed Kaufman “having time to get to the seat but not making an effort whatsoever to be seated.” The jury voted nine to three that the city had no liability for the plaintiff ’s injuries. While criminal trials require a jury’s unanimous agreement for a verdict to be reached, nine out of twelve votes is sufficient to reach a decision in a civil case. Geoff Wells, one of Kaufman’s attorneys, called the jury’s decision a “complete shock” and said he plans to file a motion to invali-

date the verdict. He said he expects the socalled “motion for judgment notwithstanding the verdict” to be heard within a month. “Nine of the jurors, I think, basically ignored the evidence in the case because they felt sorry for the bus driver,” Wells said. Wells said the video tape of the accident shows the bus driver admitting a mistake after Kaufman was injured. “On three occasions the bus driver said, ‘I’m sorry, I thought you were seated,’” he said. Kaufman’s medical bills since the accident have totaled about $2 million, Wells said, and future medical expenses could cost about $3 million more. Kanoff said the victory at trial was gratifying primarily because the verdict will save City Hall money. “If a person is injured because of their own fault ... the tax payers shouldn’t have to pay for it,” she said. “The truth is [Kaufman is] injured and all the money in the world is not going to make her walk again.” nickt@smdp

Morris aids others at risk FROM CP PAGE 1 genetic testing for mutations on her BRCA1 or BRCA2 genes — mutations which increase a person’s risk for breast and ovarian cancers. “For a while I wasn’t sure it was something I wanted to do,” Morris said. “It’s one thing to know you’re at high risk because your mother had breast cancer early in life and it’s another to know you’re at astronomically higher risk because you carry a genetic mutation.” Morris tested positive for a BRCA2 mutation, the same as her mother. While a woman’s average risk of developing breast cancer during her life is 12 percent, a woman with a mutation on either gene has a likelihood of 50 to 87 percent. Mutations also increase the chance of developing cancer at a younger age and in more aggressive forms. After discovering her vulnerability, Morris began searching for options, but failed to find an extensive guide on managing her risk. “I wanted a guide I could read and dogear the pages and take with me to all my doctors appointments,” said Morris. “There wasn’t anything out there.” Three years ago, after countless hours of research and careful decision making, Morris underwent a prophylactic mastectomy. One day during her recovery, Morris was walking with her sister-in-law, lamenting the lack of comprehensive resources available while making her decision. “I was griping to her and she said, ‘You know what? Just write it,’” Morris said. “I know I looked at her like she lost her mind.” However, after studying journalism as an college undergraduate and practicing law for 13 years, Morris knew she had the research skills to undertake the work. She approached Gordon, the head of GenRISK Adult Genetics Program at Cedars Sinai and one of the top experts on hereditary breast and ovarian cancer, for guidance. Gordon agreed to help. Since it’s Feb. 23 publication date, the book has received great response and remained in the number one or two spots on Amazon’s new releases, breast cancer list. Morris said the book’s success lets her know that writing the book was the right thing to do. “Finding out you carry a mutation ... can be a very isolating experience,” Morris said.

“You just feel like the weight of the world is sitting on you.” In her book, she wove together her own journey with the experiences and decisions of others, hoping those who read it will feel they are supported and have options. Although Morris said surgery is not the answer for everyone, it was what she needed to find peace. She disliked the stress of MRIs or mammograms every six months and waiting for biopsy results of any abnormalities. She found her concern over developing breast cancer dominated her thoughts night and day. “As soon as I had the surgery I woke up without feeling that level of oppression and stress,” Morris said. “[Fear] does not run my life.” Now, Morris has more energy to focus on the things she loves about Santa Monica, like being involved in her two sons’ classrooms as a parent volunteer and walking the cliffs overlooking the beach. Morris said that when she came to Santa Monica in 1994, she fell in love with the weather and outdoor activities the climate allows for most days of the year, such as hiking, biking and being near the beach. “I grew up in the middle of the country where there was no ocean,” Morris said of her upbringing on a Missouri farm. “When I moved out here I decided if I was going to move all the way across the country, I was going to live near the ocean.” Morris also spends time as an outreach coordinator for the Los Angeles branch of Facing Our Risk of Cancer Empowered (FORCE), a nationwide support group for those at high risk for cancer. She continue to raise awareness of genetic predisposition to breast and ovarian cancers. She urges women, even those without gene mutations, to begin mammograms during their 40s, regardless of recent opinions that women should wait until their 50s. “Until there’s a broader knowledge among the general population, as well as the medical community, to look at family history and try and identify women like me who might be at very high risk, we are doing a disservice,” Morris said. She added she hopes women will look deeply into their family backgrounds to determine if they might be at risk, and, if they are, realize they are not alone. news@smpd.com

militiamen and trekking through unforgiving mountainous terrain, Madhel Majok escaped the mass slayings and genocide of the Sudan that killed his parents. The 9-yearold orphan fled to neighboring Kenya, where he then survived vigilante shellings on his crowded refugee camp. Majok remained in limbo for eight years while waiting for any country to grant him refuge. Now 17, Majok has found safety in a small New England enclave 30 miles west of Boston. He’s a star soccer player at Holliston High School, listens to Tupac and Biggie at his leisure and lives comfortably in a foster home, thanks to a federal program that matches refugee minors with American families. “I like it. It’s peaceful... quiet,” said Majok, who wears American urban-style clothes and stays in a home with four other refugee Asian and African children. “Took me a long time to get here.” The U.S. Office of Refugee Resettlement, which has 700 refugee children in foster care, has asked states to prepare to foster more international refugee children like Majok, whose parents either have disappeared or been killed by war or natural disaster. The need is heightened by continuing armed conflicts in Africa and recent events such as the earthquake in Haiti. The request means that Massachusetts and other states must ask more households to open up their homes for foster care or ask existing foster families to take in another refugee child at a time of economic downturn. “Between all the wars going on and all the (human) trafficking laws that have changed, more children are needing safe homes,” said Sherrill Hilliard, the program manager for Refugee Immigration & Assistance Program in Washington. “And we’re doing our best to find them.” Massachusetts, a state that historically has taken in one of the largest shares of the nation’s unaccompanied refugee minors, has been asked to increase its current share of 93 to 125, said Richard Chacon, director of the Office for Refugees and Immigrants in Massachusetts. The U.S. Department of Health & Human Services says 14 states and the District of Columbia, participate in the federal Unaccompanied Refugee Minor Program: Arizona, California, Colorado, Florida, Massachusetts, Michigan, Mississippi, New York, North Dakota, Pennsylvania, Texas, Utah, Virginia and Washington. It is not the only way parentless refugee children can find safe haven in the U.S. The Obama administration, for example, recently said it will allow orphaned Haitian children to enter the U.S. temporarily on an individual basis. And some groups, like the Heartland Alliance in Illinois, help unaccompanied undocumented children by providing housing and legal representation. The U.S. program, developed in the early

1980s to help thousands of parentless children in Southeast Asia, has aided more than 13,000 refugee children fleeing war, famine and economic turmoil. It remains the most consistent source for refugee children in the U.S., with the assistance of the United Nations. In 2008, foster homes and related facilities in the United States and 67 other countries took in 16,300 orphans, according to Tim Irwin, the spokesman for the U.N.’s High Commissioner for Refugees. That’s the highest number since the agency started keeping records, Irwin said. In the U.S., states license foster homes with the help of the Lutheran Immigration and Refugee Services and the U.S. Conference of Catholic Bishops. The federal government reimburses states for all costs of the children’s schooling, health care and related expenses. It’s the same federal program that helped resettle 3,800 “Lost Boys” from Sudan in the early 2000s. Cost of care for refugee minors varies, depending on need. In Massachusetts, the state Office for Refugees and Immigrants has budgeted about $3 million to serve 93 minors. Arizona’s State Refugee Coordinator Charles Shipman said his state has been asked to increase its numbers from 43 to 63. Arizona can find those new foster homes, Shipman said, but it’s going to take some time. “You have to work to develop more homes,” Shipman said. “It’s a pretty intense process to adequately serve these kids.” Hilliard said her state has been asked to double up from 50 to 100 children. “We’ve already got eight more on the way,” she said. Mary Bartholomew, who oversees the Massachusetts program for Lutheran Social Services, said social workers in the state are racing to look for new homes because of the expected rise in numbers. She said some former foster parents are opening up their homes to more children. Michelle and Peter Zimmerman, of Leicester, Mass., said they wanted their two sons, now 15 and 13, to know “how blessed they were.” After taking in Liberian refugee Sam Barclays, who later joined the U.S. Marines, Bartholomew asked the family to consider fostering two refugee brothers who had escaped a prison in Myanmar. The boys fled Myanmar where they were wrongly accused by the military government of trying to sell a car, said Lian Sian Kim, 18. The Zimmermans accepted. In 2008, after living in hiding in Malaysia, Kim and his brother, Lian Sian Sang, 16, arrived at the Zimmermans’ doorstep. “It was nice,” said Kim, now a student at Leicester High School. “I didn’t like the snow at first. But it’s OK now.” A few months later, Majok arrived at the home of Paul Boulanger, a 68-year-old single father in Holliston, Mass., who has fostered three dozen refugee children in 30 years. Boulanger also has teens living with him from the Congo, China and Myanmar. All are attending school, learning English and playing sports.
