PERFORMANCE WORK STATEMENT (PWS) III Corps NCO Academy (BLC) Portable Chemical Latrines Contract FY18-FY19 PART 1 General Information The Contractor shall furnish all labor, tools, materials, vehicles, equipment, transportation, supervision, and other necessary means to deliver, relocate, pick-up and service portable chemical latrines under all weather conditions at FT Hood, TX and off post training areas if necessary within 30 miles of Fort Hood, TX. The contractor shall perform to the standard and specifications outlined in this Performance Work Statement (PWS). Workload may increase or decrease due to adjustments in the training cycle dates, but will remain within the general scope of the contract. Payment will only be made by the Government for services ordered, received, and accepted at the time of contract award. The Contractor will not be compensated for work performed that is not authorized by this contract or a contract modification.

1. GENERAL: This is a no personal services contract to provide and service portable chemical latrines. The Government will not exercise any supervision or control over the Contractor’s employees performing the services herein. Such employees contracted to provide services shall be accountable solely to the Contractor who, in turn is responsible to the Government.

Scope : The Contractor shall furnish all labor, tools, materials, vehicles, equipment, transportation, supervision, and other necessary means to deliver, relocate, pick-up and service portable chemical latrines under all weather conditions at FT Hood, TX and off post training areas if necessary within 30 miles of FT Hood, TX. Basic service requirements will consist of 378 latrine days/36 Training days (number of portable chemical latrines required multiplied by number of days required) and 68 portable chemical latrines serviced on site (number of portable chemical latrines to be cleaned multiplied by times to be serviced). A schedule of the requirement is listed in paragraph 5 of this PWS. Any deviation from that schedule will be coordinated between the Government and the Contractor using a Fort Hood Form 350-25 or a Contractorprovided request form(s) submitted to and approved for use by the Contracting Officer no later than 10 days after performance start date. The portable chemical latrines shall be delivered to the site the evening prior to ensure the portable chemical latrines are on location and operational at the start time of training. The dates and times of placement of portable chemical latrines are flexible due to time changes and location of existing portable chemical latrines, however, the Contractor shall place the portable chemical latrines prior to the required start date and time. The Contractor shall perform to the standard and specifications outlined in this Performance Work Statement (PWS).

Workload may increase or decrease due to adjustments in the training cycle dates, but will remain within the general scope of the contract. Payment will only be made by the Government for services ordered, received, and accepted at the time of contract award.

The Contractor will not be compensated for work performed that is not authorized by this contract or a contract modification. The format below or one created by the contracting officer will be used to submit the service request to support monthly classes/cycles for the Academy. The Government will submit the request form via email to the Contractor no later than 10 days before requirements are to be performed.

1.1 Period of Performance: The period of performance shall be for a base year (12 months), 2 March 2018 – 1 March 2019, and two 1-year option periods.

1.3 General Information 1.3.1 Quality Control: Quality Control is the responsibility of the Contractor. The Contractor shall develop, implement and maintain an effective Quality Control System which includes a written Quality Control Plan (QCP). The QCP shall implement standardized procedure/methodology for monitoring and documenting contract performance to ensure all contract requirements are met. The Contractors’ QCP must contain a systematic approach to monitor operations to ensure acceptable services/products are provided to the Government. At a minimum, The QCP shall address continuous process improvement; procedures for scheduling, conducting and documentation of inspection; discrepancy identification and correction; corrective action procedures to include procedures for addressing Government discovered nonconformances; procedures for root cause analysis to identify the root cause and root cause corrective action to prevent re-occurrence of discrepancies; procedures for trend analysis; procedures for collecting and addressing customer feedback/complaints.

Upon the Government’s request, the Contractor shall provide to the Government its QCP and any related documentation. QCP is to be delivered electronically within 10 days after contract award. An electronic copies of a comprehensive, written QCP shall be submitted to the Contracting Officer within 5 working days when changes are made, thereafter. After acceptance of QCP, the Contractor shall receive the Contracting Officer’s written acceptance of any proposed change to its QC system. The FT HOOD NCOA if will be allowed to changed or delete dates with 72 hrs notice to vendor or with guidance by higher command.

1.3.1.1. Preliminary Inspection: This inspection shall be performed at the time of delivery of the portable chemical latrines and acceptance by the Government. It shall include a check to insure that all equipment is serviceable and acceptable. The Government will periodically inspect and evaluate the Contractor’s performance of the terms specified within this contract.

1.3.2. Recognized Holidays: The Contractor may be required to perform services on holidays.

1.3.3 Hours of Operation: The Contractor must be available for performance between the hours of 0600-1700 and may be required to work on Federal holidays when the Government facility (III Corps NCO Academy) is open for duty. For other than firm fixed price contracts, the Contractor will not be reimbursed when the Government facility is closed for the above reasons. At all time, the Contractor must maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons.

1.3.4 Place of Performance: Contact performance will occur at and within 30 miles of Ft Hood Texas.

1.3.5 Type of Contract: The Government will award a Firm-Fixed-Price contract.

1.3.6 Key Personnel: The Contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the Contractor when the manager is absent shall be designated in writing to the Contracting Officer. The names will be provided to the Contracting Officer no later than 10 days before performance start. The contract manager or alternate shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available between 6:00 a.m. to 4:30 p.m., Monday thru Friday except Federal holidays or when the government facility is closed for administrative reasons.

PART 2 DEFINITIONS & ACRONYMS 2. DEFINITIONS AND ACRONYMS: 2.1. DEFINITIONS: 2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

2.1.3 DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.4. DELIVERABLE. Anything that can be physically delivered, but may include nonmanufactured things such as meeting minutes or reports.

2.1.5. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.6. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

2.1.7. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.8. QUALITY ASSURANCE SURVEILLANCE PLAN Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

2.1.9. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.10. SUBCONTRACTOR. One that enters into a contract with a prime contractor.

The Government does not have privacy of contract with the subcontractor.

2.1.11. WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.

2.1.12. WORK WEEK. Monday through Friday, unless specified otherwise.

Access and general protection/security policy and procedures. This standard language is for contractor employees with an area of performance within Army controlled installation, facility, or area. Contractor and all associated sub-contractors employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

2.1.14. For contractors that do not require CAC, but require access to a DoD facility or installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

2.1.15. iWATCH Training. Contractor employees with an area of performance within an Army controlled installation, facility or area. The contractor and all associated subcontractors shall brief all employees on the local iWATCH program (training standards provided by the requiring activity ATO). This local developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within 30 calendar days of contract award and within YY calendar days of new employees commencing performance with the results reported to the COR NLT 15 calendar days after contract award.

2.1.16. For contracts that require OPSEC Training. Per AR 530-1 Operations Security, the contract employees must complete Level I OPSEC Awareness training. New contract employees must be trained within 30 calendar days of their reporting for duty and annually thereafter.

2.1.17. NCIC and terrorist threat data base screening required. All contract employees, including subcontract employees, who are not in possession of a current Common Access Card (CAC) will be vetted by the local security office to determine fitness and eligibility for access IAW DTM 09-012, paragraph 2.b(4) to include but not limited to an NCIC and Terrorist Database screening. The Vendor will ensure that the government has sufficient biographical information to conduct said screening including, but not limited to the person's name, date of birth, and social security number. Contract employees are responsible for ensuring all subcontract employees are vetted and will maintain a by name list of all active subcontractor employees. Contract employee will provide list upon request to vendor, COR/COTR and or ATO. PART 3 GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES 3. GOVERNMENT FURNISHED PROPERTY: 3.1. The Contractor shall dispose of all waste tanks at a location identified by DPW in accordance with current federal, State and local laws, ordinances and regulations.

Coordination may be accomplished with the FT Hood Main Cantonment Area DPW Exterior Water Utilities at (254) 287-7286. Debris and trash recovered from the interior of the latrine or from the waste will be considered infectious waste and must be disinfected by soakage in a 10-percent Chorine bath for a minimum of 30 minutes.

Disinfected debris and trash shall be double bagged in leak-proof bags and disposed of by depositing in multiple containers (e.g., dumpster. Debris and trash recovered from the outside of the portable chemical latrines and judged by the Contractor not to have made contact with human body waste does not have to be disinfected but must be single bagged in leak-proof plastic bags and disposed of by depositing in a multiple container (e.g., dumpster).

PART 4 CONTRACTOR FURNISHED ITEMS AND SERVICES 4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES: 4.1 General: The Contractor shall furnish all supplies, equipment, facilities, material, equipment, and services not listed in Section 3 of this PWS required to perform work under this contract. Contractor vehicles shall present a neat appearance and have the Contractor’s name affixed for easy identification. Contractor shall have vehicle insurance on vehicles that will enter FT Hood Military Reservation. The insurance will be the basic insurance allowed by the state of Texas on vehicles.

PART 5 SPECIFIC TASKS 5. SPECIFIC TASKS:

5.1. Basic Services. The Contractor shall furnish all equipment, toilet paper, management, and labor necessary, to clean, sanitize, and pump out portable chemical latrines in accordance with the agreed- upon delivery schedule.

5.2. Standards: 5.2.1. Delivered portable chemical latrines shall conform to the generally acceptable industry standards and local standards for quality, sanitation, and cleanliness. The Contractor shall ensure that all portable chemical latrines are clean, free from soil and stains, and fungi and microorganisms, including pathogens and disease-producing organisms. Chemical latrines shall be free of unpleasant odors. Twenty (20) percent of portable chemical latrines delivered to any given location will be marked “Female” and the remaining 80 percent will be marked “Male.”

5.2.2 The Contractor shall perform work under sanitary conditions.

5.2.3. The Contractor shall replace any damaged portable chemical latrines within 24 hours of notification by the Contracting Officer or the Government’s unit representative.

5.2.4. The Contractor shall deliver and service the portable chemical latrines to the minimum standard of cleanliness and replenishment in accordance with applicable publications at Part 6. Each chemical latrine shall contain a Minimum of five (5) gallons of sanitary liquid and two rolls of toilet paper. All portable chemical latrines must be placed on a level surface at least 100 meters (328 feet) away from natural water sources and tank trails. Portable chemical latrines must be anchored down during high wind conditions IAW Fort Hood Regulation 420-36.

5.3 The Contractor shall maintain a computer system and provide the Government a valid email address for receiving and processing the portable chemical latrine requests.

The Contractor will be responsible for confirmation of all requests that have been received through email no later than 48 hrs after email submission.

5.4. Contractor shall delivery the chemical latrines to the site the evening prior NLT 1800 hrs. to ensure the chemical latrines are on location. The chemical latrine(s) shall be placed and functional prior to the start time for training. If the location is inaccessible, the Contractor must contact the III Corps NCO Academy S3 or S4 personnel for instructions 254-286-5668/254-289-2990.

5.5. Contractor shall complete monthly invoices through WAWF . The Invoices will be used by the S4 to match the request, validate services, and make payment through WAWF. 5.6. Delivery of Portable Chemical Latrines: The Contractor shall deliver portable chemical latrines in accordance with the schedule described below. The Contractor shall coordinate with the Government’s representative prior to delivery and removal of the portable chemical latrines. Contractor attendance at both the preliminary and final inspections is mandatory. Adjustments to this delivery schedule will be coordinated

between the Government and the Contractor. III Corps NCOA reserves the right to adjust the delivery of portable chemical latrines, due to inclement weather. A 12 hour courtesy call will be given in the situation of inclement weather or any other unforeseen circumstances.

III Corps Track – PV 17195 45251 Note 1: Portable Chemical Latrines will be dropped at III Corps track the day prior to training no later than 1600. Chemical latrines will be picked up from III Corps track no later than 1700 on training day.

5.7. In addition to the above-cited delivery schedule, the Contractor shall deliver portable chemical latrines as specified in Block 1-10 of FH Form 350-25 or the

equivalent contractor-provided form approved by the Contracting Officer. The portable chemical latrines will be cleaned, wiped down, washed out, pumped out and restocked with toilet paper.

5.8. Service of Portable Chemical Latrines: The Contractor shall service the portable chemical latrines at the end of training day at any of the given training locations. The cleaning frequency will be in accordance with Block 8 of FH Form 350-25 or the equivalent contractor-provided form approved by the Contracting Officer. Cleaning shall be performed to the standards listed in paragraph 5.2, above.

5-9. The Contractor shall take all the necessary precautions to prevent spillage of the waste tank contents during removal, leaning, and transportation. In the event of spillage, the Contractor shall thoroughly entire area contained by the spill. If over five (5) gallons are spilled, the Academy S4 shall be notified telephonically immediately.

5.10. The Contractor shall dispose of all waste tanks at a location identified by DPW in accordance with current Federal, State and local laws, ordinances and regulations.

5.11. The Contractor shall place the portable chemical latrines on the grid specified in Block 9 on FH Form 350-25 or the equivalent contractor-provided form approved by the Contracting Officer. If the grid location is not accessible then the Contractor will contact the III Corps NCO Academy S-4 (254) 286-5668 for instructions.

5.12.. Removal of Portable Chemical Latrines: The Contractor shall remove portable chemical latrines as specified in Paragraph 5 or Part 1, paragraph 1. 5 of FH Form 35025 or the equivalent contractor-provided form approved by the Contracting Office. The portable chemical latrines should be removed from the delivery location/training area no earlier than 1700hrs/5:00 p.m. on the last day of usage, unless an earlier removal time has been approved by the Government.

5.13. Quality Control: The Contractor shall perform quality control in accordance with the approved QCP. A file of all inspections conducted by the Contractor and the corrective action taken shall be maintained and made available to the Government, upon request.

5.14. The Contractor shall retain records generated during execution of the QCP for the term of the contract, including any extension. These records shall be made available for review by the III Corps NCO Academy S4 or the Quality Assurance Evaluator.

5.15. Upon receipt of a Contract Discrepancy Report (CDR), the Contractor shall respond to the Contracting Officer within two (2) working days. The Contractor will complete the CDR and prove a written explanation, stating why the performance was unsatisfactory. The Contractor shall indicate how the performance will return to satisfactory levels. The Contractor will indicate how recurrence of the problem will be prevented in the future.

5.16. The Contractor shall repair and replace the portable chemical latrines as often as necessary or as directed by the Government to keep them in a watertight, fly tight, neat and sanitary condition in compliance with the contract.

5.17. Each latrine shall have a contractor identification or logo and an easily readable serial number affixed to the exterior of the unit.

6. CONTRACTOR MANPOWER REPORTING (CMR): The Contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Department of the Army, Fires Center of Excellence via a secure data collection site. The Contractor is required to completely fill in all required data fields using the following web address: http: //www.ecmra.mil/, and then click on “Department of the Army CMRA” or the icon of the DoD organization that is receiving or benefitting from the contracted services.

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2016. Contractors may direct questions to the help desk by clicking on “Send an email” which is located under the Help Resources ribbon on the right side of the login page of the applicable Service/Component’s CMR website at http://www.ecmra.mil. The required data fields include: (1) Contracting Office, Contracting Officer, Contracting Officer's Technical Representative; (2) Contract number, including task and delivery order number; (3) Beginning and ending dates covered by reporting period; (4) Contractor name, address, phone number, e-mail address, identity of contractor employee entering data; (5) Estimated direct labor hours (including sub-contractors); (6) Estimated direct labor dollars paid this reporting period (including sub- contractors); (7) Total payments (including sub-contractors);
