Yes In My Back Yard The so-called ‘yimby’ movement looks to push for more new, affordable housing developments

F

irst came nimbys – looseknit groups of entrenched neighborhood homeowners that oppose adjacent new development.

The title, which reputedly dates to the early 1980s, is based on the slogan, “Not in My Back Yard.”

The once-catchy moniker has lost much of its luster as a societal buzzword even as the issue remains: Battles continue over allegedly disruptive land uses such as industrial or major commercial projects near long-time residential enclaves.

Still, the title’s familiarity spurred a spin-off term in the past five years or so that evokes some of the same controversies. It’s “yes in my back yard,” or yimbys. In this case, disputes are over hugely high-priced rental and ownership markets in alluring big-city downtowns. Reasonably well-off millennials favor new, more moderately priced developments in the works, but those still somewhat expensive properties tend to push out established, lower-income minority groups.

“A series of new groups have emerged in U.S. cities including 4

San Francisco, Seattle and Austin, as well as globally, lobbying not against development but for it,” says ApartmentList, which describes itself as a website that accumulates apartment listings from Internet sources into a map-based depository.

“These advocates, known as yimbys (yes in my back yard), argue that their lives are threatened by housing shortages and skyrocketing rental prices.”

According to Apartment List, the yimby movement got its start in the San Francisco Bay Area and has its ground zero in the Mission District as “well-paid tech workers” gentrify the historically low-income Hispanic neighborhood.

Due to evictions and the lack of affordable housing, one-third of the Mission’s Hispanic population is expected to be displaced between 2000 and 2020. Deepa Varma, director of the San Francisco Tenants Union, expressed frustration at seeing a “new group come in and portray Latinos fighting for the preservation of their neighborhood as nimbys,” the website notes.

The yimby movement isn’t exclusive to the West Coast or high-tech areas: there’s a New York yimby website and a “yimby festival” as early as 2013 in Toronto.

Media outlets have joined in to write about the phenomenon. The Guardian cites such places as Sydney, Australia and Oxford, England as “one of a series of new groups that have sprouted up, lobbying not against development but for it.”

According to the publication, “Yimby activists helped push through a 25-story apartment and retail/ restaurant development in Oakland this year despite local opposition.”

The San Francisco Bay Area has among the highest rents in U.S., the Guardian says. It notes that greater San Francisco-Oakland-San Jose added 307,000 jobs between 2010 and 2013, but built fewer than 40,000 new housing units, according to state of California estimates.

“It’s clear that this is a housing shortage – and the answer is to build housing,” says Laura Foote Clark, who heads San Francisco-based Yimby Action. “You generate policy by yelling

about things,” she says.

In New York, an online publication called “Yimby News” boasts a section on the five top developments the group is watching.

For instance on Nov. 30, 2-17, the website reported on permits filed for 328 and 330 Sackett St. in the Carroll Gardens section of Brooklyn.

The property showcases a pair of four-story residential buildings, located five blocks from the Carroll Street subway station. “The project is near plenty of commercial activity, with several bars and restaurants located within walking distance, and Gowanus’ nightlife is also just a few blocks to the east. (Gowanus is another Brooklyn neighborhood). The Brooklyn Home Company will be responsible for the development,” according to Yimby News.

Also this summer, The Atlantic wrote a piece entitled “’Not in My Backyard’ to ‘Yes in My Backyard.’ Out of a desire for more-equitable housing policy, some city dwellers have started allying with developers instead of opposing them,” the magazine says.

Tax No-Show Question:

We own a small business and want to buy a home. We met with a loan officer who wants to see our tax returns. Like many businesses we have deductions, which result in a smaller taxable income, but are perfectly legal. Can we get a mortgage without showing our tax returns?

Answer:

According to the Bureau of Labor Statistics, 15 million people are self-employed, about 10 percent of the workforce. For this reason you can be certain that lenders are familiar with business tax returns and understand, for example, that a deduction for depreciation is not an actual cash expense.

While individual loan programs may require

lenders to review tax returns, it is possible to get mortgage financing without them. To understand why, you have to look into the Ability-to-Repay rule. In basic terms it says that any commercial lender originating a residential mortgage must prove the borrower has the financial capacity to repay the debt.

What’s interesting about the rule is that it gives lenders a lot of flexibility. Lenders must make “a reasonable and good faith determination based on verified and documented information that, at the time the loan is consummated, the consumer has a reasonable ability to repay the loan.”

According to the Consumer Financial Protection Bureau, lenders must “verify that consumers can afford to repay their mortgage – that’s the whole point. Lenders will make that determination by looking at documents such as payroll stubs, tax returns, student loan statements, credit history and other financial information … Looking at this kind of documentation is something responsible mortgage lenders have always done, and the new rule makes sure that every lender follows prudent underwriting practices.”

Today it is again possible to get financing without tax returns, but the terms are different.

The lender must verify the ability of the borrower to repay the mortgage. If not tax returns then how about other evidence of financial stability such as personal bank statements? As a borrower you’ll likely pay for the privilege of alternative underwriting with a higher interest rate, a requirement for more down, or both.

What you will not get is a verification-free loan application where the lender does not poke and prod every financial statement it receives.

If you have the choice – and it’s likely that you do – speak with experienced loan officers.

The odds are overwhelming that lenders have worked with other business owners and have the ability to properly assess your tax returns and verify your financial situation. If your loan can be underwritten the usual way you are likely to pay less, and that should be incentive enough to try.

Here’s how to make sure your credit doesn’t get dinged in the transition

t takes good credit to make buying and moving to a new home possible.

But if movers aren’t careful about leaving things behind, they risk losing their good credit record.

In a 2016 survey, credit.com found that 26 percent of Americans who claim they have never checked their credit reports said they haven’t done so because credit reports aren’t important to them. Nearly 29 percent of Americans didn’t think it was necessary to check their credit records because they always paid their bills on time.

However, you can only pay the bills you know about.

Bills that don’t follow a mover to a new address are a key reason late payment or collection notices end up on a credit report, says Adam Levin, credit.com’s co-founder.

Anyone thinking of buying a home should check reports well before they actually plan to apply for a mortgage. Everyone is entitled to one free credit report from each of the three major credit bureaus once a year. Visit www.annualcreditreport.com to request a report.

“You want to give yourself enough time to correct any errors or find out about negatives [items on the report] that aren’t mistakes but could take time [to pay off],” Levin says.

Once you know your new address and moving date, call the customer service lines of all the places that you’re expecting bills from, like utilities, credit card companies and doctors to update your information, advises Levin.

Forwarding mail to the new address is another necessary step. But even then, some bills can get lost, since forwarding only last a certain amount of time, says Levin. Medical bills are especially prone to getting lost, since an issuer may wait for the amount paid by an insurer before billing the consumer.

Check credit reports again after a move, to ensure that no surprise items spoil your report, Levin advises.
