‘Underappraisals’ an issue only when home seekers not well counseled

ooming markets with escalating property listings expose cases in which appraisals compute values that are noticeably lower than buyer offers on the table, according to industry observers.

That can be a problem if so-called ‘under-appraisals’ leave the potential acquirer bidding above their means.

But representation from veteran agents can keep clients from asking too much.

“I think it’s an issue, especially if somebody doesn’t have (an agent) on their side,” says David Kent, owner and broker-in-charge of The Real Buyers Agent in Mount Pleasant, S.C. Kent hasn’t had an under-appraisal case but believes they’re possible in any hot market.

His comments follow the National Association of Exclusive Buyer Agents’ late summer survey among its members on under-appraisals and Current Market Analyses, or CMAs. Survey results show that 87 percent of agents who exclusively represent buyers haven’t had issues with customers’ homes under-appraising.

But nearly 39 percent contend that under-appraisals are typically an issue in their area. Another 44 percent say they weren’t sure if it was an issue, according to the agent association.

“It appears that the problem with appraisals is a result of an emotional home buyer who offers far too much money for a property because of his or her fear or being outbid and not having a buyer agent willing to explain that the house just isn’t worth that much 4

money,” says Richard Rosa, of Buyers Brokers Only in Haverhill, Mass.

A vast share of members, 94 percent, say they complete the market analyses for their buyers to assist with a purchase offer, according to the Avondale, Ariz.-based association, formed in 1995 for companies set up to represent only real estate buyers.

According to the exclusive buyer group, the newest and least experienced agents of traditional brokerages typically are buyers’ agents. More experienced associates handle listings. The surveyed Exclusive Buyer Agents note that 53 percent of buyer agents in their area are the newest agents in the brokerage.

“Since working with buyers tends to be more time intensive, it is very common to see brokerages give that work to the least experienced agents in the office,” says Jon Boyd, an association member of The Home Buyer’s Agent of Ann Arbor, Mich.

“When we view properties with buyers, we actively help evaluate the homes while we are there. An inexperienced agent can’t provide that service,” she says.

Exclusive Buyer Agents argue that the way to fix the problem is to form teams. “Our office has very experienced long-time agents, says Melanie Wilson, association member of A Buyer’s Best Choice Realty in Johnson City, Tenn. “New agents are forming teams with experienced agents and doing buyer agency that way,” she says. The appraisal can play a key role in house sales, particularly when the transaction involves a mortgage rather than an all-cash deal.

One thing to note: The appraiser’s valuation an opinion – albeit an educated one – of what the property is worth. It doesn’t matter what the buyer is willing to pay or what the seller is willing to accept, Lew Sidelman, a housing and real estate columnist, wrote in syndicated column in 2015.

If the appraisal comes in too low for the lender to accept the buyer’s application for a mortgage, the seller will have to lower the price or the buyer will have to come up with more cash to make the deal work, he says.

himself as a realtor and loan officer in California, says buyers have options with lenders if the appraisal comes in low. They can walk away from the loan, they can make up the price difference in cash or they can renegotiate the deal with the seller, he says in a blog earlier this year.

In a Realtor confidence survey Nov. 2016-Jan. 2017, the National Association of Realtors found that 22 percent of respondents faced appraisal issues.

Among the reasons why appraisals come in low: artificially inflated prices resulting from multiple offers, the NAR says, according to an article on the balance.com.

One of the reasons that appraisals don’t always match up with the agreedto price is that buyers and sellers agents are looking at the transaction from two different sides, says Kent, the South Carolina-based buyers agent.

“Listing agents are forward (looking), checking what the home value would be four months from now,” he says. “I’m always looking back, what it (last) sold for.”

We are now selling our home but worry that if we get a buyer we will not be able to quickly find a new house. Is there some way to delay closing so we have more time to look for another property?

Answer:

In the usual case, it takes 43 days to close according to July statistics from Ellie Mae. However, closing times vary according to the needs of individual buyers and sellers as well as local custom.

The buyer might lock-in a mortgage rate for 45 days — close later and the lock can be lost. Instant closings are also unlikely because of federal rules such as the need to provide the Closing Disclosure (CD) at least three days before settlement and the time required

for a home inspection, appraisal and loan underwriting.

In an ideal world you would like to close on the sale of your home and the purchase of a replacement property on the same day. In reality, that may not happen. Research from the National Association of Realtors shows that 18 percent of all sellers who settled in July stayed over after closing. Closing is not delayed. Instead, sellers stayed at the property after the settlement paperwork was signed.

Staying over after closing requires what is known as a “post-settlement occupancy agreement” — a form that can be available from a broker or attorney.

For buyers, a request for a post-settlement occupancy agreement can be very attractive with cautions. If a seller wants to stay on, there is a matter to negotiate — maybe you will consider such a request if the seller will leave the washer and dryer or take down that old tree out back.

Also ask, do you have a proper post-settlement occupancy agreement for your jurisdiction? You need a specific form because local rules can differ.

If you are financing with a mortgage be very careful to follow the loan agreement. If you purchased the property as a residence then lenders expect you to move in within a given time frame, say 30 to 60 days after closing.

That means the seller must be out and gone so you have enough time to move in as required. If you do not move in by the deadline the lender may have cause to wonder if you’re actually an investor and not an owner-occupant. This can be a big problem because lenders have different — and stiffer — requirements for investment borrowers. In the worst case they may cry foul — or mortgage fraud.

3 Efforts to Help Student-Loan-Holding Homebuyers Finding ways student debt and mortgages can mix Student loans are a financial weight on millions.

But it’s not just those with the bills who are impacted. The housing market, which in turn fuels the overall economy, is weakened. Indeed, several surveys show that many are delaying home purchases because of student debt.

Now, creative efforts are underway to help borrowers with student debt get a mortgage:

Mortgage lenders are recognizing contributions from an employer or parent toward student loan repayment.

Currently, about 4 percent of employers offer their workers a “student loan assistance” benefit.

Under this benefit, which is growing more popular, firms regularly contribute directly to the education debt of the worker.

Moreover, some have a parent or other relative that provides regular help paying student loans, or other debt, like a car loan.

Fannie Mae, which makes lending rules, now allows lenders to consider these contributions in calculating how much mortgage for which a borrower qualifies.

One builder is now helping purchasers pay off debt, and more builders may follow.

Research on student debt holders showed that although “many might be able to qualify for a mortgage, they didn’t want to add to their debt load with a mortgage,” says Jon Lawless of Fannie Mae. Working with builder Lennar, and its subsidiary Eagle Home Mortgage, Fannie Mae is monitoring a program whereby Lennar provides homebuyers up to 3 percent of their purchase price to pay down their student loan balance.

Education debt holders that are homeowners may be able to pay down student loans with a cash-out refinance.

Any homeowner who refinances his mortgage for a bigger one pays a slightly higher interest rate and fees than borrowers who refinance without a “cash-out”.

Now, those higher charges are eliminated for those using cash to pay student debt, Lawless says.
