MEMORANDUM OPINION AND ORDER DENYING DEFENDANTS’ MOTION TO DISMISS PLAINTIFF’S CLASS ACTION ALLEGATIONS IN HER FIRST AMENDED COMPLAINT THIS MATTER comes before the Court upon Defendants Magellan Health, Inc. (“Magellan Health”), Magellan Healthcare, Inc., Magellan Health Services of New Mexico, Inc., Merit Behavioral Care Corporation, and Magellan HRSC, Inc. (collectively “Defendants”) Motion to Dismiss Plaintiff’s Class Action Allegations in her First Amended Complaint (Doc. 35, filed 1/9/18). Having reviewed the parties’ briefs and the applicable law, the Court finds that Defendants’ Motion is not well-taken, and is, therefore, DENIED. BACKGROUND Plaintiff Maureen Deakin (“Plaintiff”) is suing Defendants to recover unpaid overtime wages that she alleges Defendants failed to pay her and other employees in accordance with the federal and state law. Plaintiff’s First Amended Class and Collective Action Complaint, Doc. 32, filed 12/12/17. Plaintiff asserts two counts: Failure to Pay Wages in Accordance with the Fair 1
