PRELIMINARY STATEMENT

Plaintiff Jacob Falk (“Plaintiff”) brings this collective and class action

individually, on behalf of those similarly situated, and on behalf of the proposed Rule 23 Class Members to recover overtime compensation from his former employer Cade Drilling, LLC (“Cade” or “Defendant”). 2.

Defendant violated the Fair Labor Standards Act (“FLSA”) by failing to include

all required remuneration into Plaintiff’s regular rate to calculate overtime for the overtime hours worked by Plaintiff, the Potential Plaintiffs, and Rule 23 Class Members (as defined herein). Defendant paid Plaintiff and other oilfield workers (including, but not limited to hands, roughnecks, drillers, technicians, and operators; collectively, “oilfield workers”) nondiscretionary bonuses, per diem pay, and other forms of pay (collectively, “Additional Pay”), but
