Henderson trial date set for Aug. 6 Judge sets final status hearing for July 19

BY DAVE COOK news@putnamcountyrecord.com HENNEPIN — Several examples of case law were referenced during arguments regarding the criteria of what constitutes a delay during the May 17 hearing for suspect Richard A. Henderson in Putnam County Circuit Court.

Henderson, 26, is the Standard man investigators believe stabbed Christina and killed Diamond Judd-Mennie Bradley, 16, of Spring Valley, whose body Putnam was found along a County state’s rural Putnam County attorney road on Jan. 27.

Charged with the Class 3 felony of concealment of a homicide death, Henderson is being held on $1 million bond and faces additional charges as evidence continues to be processed.

“It is incumbent upon the state, not the defendant, to commence trial, under my theory, by June 5,” Public Defender Roger Bolin previously said during a May 10 hearing.

During Henderson’s May 17 hearing, Bolin read excerpts from the 2006 Illinois Supreme Court case “People v. Cordell.” Putnam County State’s Attorney Christina Judd-Mennie used the same case to argue her point to Judge Stephen Kouri.

The state has 120 days in which to begin a trial, and Bolin said his client has been in custody since Feb. 5. Putnam County State’s Attorney Christina Judd-Mennie argued the last three continuances were agreed upon by both sides at previous hearings and that by doing so, the 120-day count would have stopped during those periods.

Kouri said he had reviewed the suggested cases submitted by both sides and said March 1 is when the dispute begins, 23 days into the 120day count.

“He (Bolin) said ‘We would like the record to reflect the defendant will tender a plea of ‘not guilty’ and ask that this matter be settled with a jury trial,’ So, if the matter stops there, I’d agree with Mr. Bolin,” Kouri stated.

However, he then said the matter didn’t stop there, and that Bolin hadn’t requested a trial date at that time. He added that by agreeing to the previous orders of continu- Roger Bolin ance, which didn’t conPutnam tain a set trial date, the County public defense had acquiesced defender as to how the schedule was proceeding.

Kouri ruled the delays from May 10-17 were attributable to the defense and that the case was currently 30 days into the 120-day count for a speedy trial.

“I’m trying to balance the 120 days as a shield vs. a sword,” he said.

Henderson’s final status hearing was set for 2:30 p.m. July 19. His trial date was set for 9 a.m. on Aug. 6, although the judge said that date may or may not be moved.

Any future charges against Henderson will result in a second trial at a later date unless both sides agree to the delays it would cause. While both sides indicated they would rather not go through a second trial, it may be unavoidable.

BY ZACHARY J. PRATT TONICA — As the Tonica School Board prepares for a special meeting regarding the limitation of a visitor’s access to school grounds, some more information on the process has been explained.

Principal-Superintendent Chuck Schneider said that the maximum length of time a visitor can be banned is one year, though it was mentioned that the length might change depending on whether infractions cause the subject to be revisited.

A visitor was described as anybody not a student or staff.

Schneider said that, in his capacity as superintendent, he can ban a visitor, but only for a few days. To do so for any length of time beyond that would be overreach, as such measures require board action.

He said, “If you’re going to do more than that, to where it can be

more than 10 days or so,” it has to go through a board hearing.

• Some parents seem to be demanding their presence when school officials speak with their kids. Schneider explained that, with the school officials serving in the parent’s capacity during the school day, they are not required to have parental permission in order to talk to the students.

“That’s not how it works,” he said.

TONICA — After the district’s recent years on a financial downslide, Tonica Grade School’s amended budget could indicate an upswing.

Jim Whitmore, Tonica School District’s financial consultant, presented an amended budget, noting that the amendment is a normal procedure and “doesn’t mean havoc has struck.”

Overall, the report appeared promising.

“It has been seven years since Tonica has finished a fiscal year with a balance in the ed fund of a million,” Whitmore said.

This year changes that, placing the budget, as discussed, at “one million, twenty-eight thousand dollars.”

After the district experienced a downward trend regarding these funds, the current numbers look promising. However, it is yet to be seen whether this is the beginning of a trend upward.

“Is this a trend or not? I don’t know,”

Whitmore said. “If it shows up similar to this in a year, it’ll increase my hope.”

Another area of concern appears to be taken care of for the coming year. The TORT fund had been low, so the district reworked the tax levy to build it up, moving some from IMRF and social security, an effort which seems to be paying off.

“We have the TORT fund fixed for next year,” Whitmore said.

In addition, the district had earmarked $35,000 out of working cash for the TORT fund, an amount that Whitmore said the district did not have to touch.

“We have not expended any money from working cash,” he said.

In other news: • The board approved the extension of Chuck Schneider’s contract as superintendent for an additional year, so it now runs five years from July 1.

• Whitmore was also approved as this coming fiscal year’s financial consultant.

UTICA — If you’ve never met Conservation Officer Michael Filipiak yet, you will on your next Starved Rock State Park trip.

Filipiak will be all over the park, Starved Rock Lodge and a few select areas in Utica.

Not in person, but printed out on a near life-sized sign warning hikers of the dangers of falling.

Pam Grivetti, president of the Starved Rock Foundation, said the new signs that warn hikers to stay on the trails because the sandstone is fragile and may lead to falls is part of the foundation’s goal of educating the public.

The signs also notify hikers that fines begin at $120.

“Hopefully this is an attention-getter,” Grivetti said.

Grivetti said she wanted to do something after reading a number of articles last year regarding hikers who have fallen on the

“We can only put up so many signs,” he added. “We need people to read it.”

He said the signs look good and he hopes his picture will remind hikers of the danger.

Two signs will be placed in the Visitors Center, two in the Starved Rock Lodge, and two more will be placed at the Utica’s Casey’s General Store and Shell gas stations.

A seventh is also coming soon with both the front and the back of the officer’s uniform.

This effort is in addition to flashing signs that were added to the entrances of the park in the past.

Grivetti said she hopes hikers heed the sign’s words.

“We just want to keep people safe,” Grivetti said. “They don’t realize, you get off these trails, and your life becomes in jeopardy.”

Dobrich sentenced in hit-and-run fatality

BY DAVE COOK dcook@bcrnews.com OTTAWA — Luke T. Dobrich, 40, of Oglesby was sentenced in LaSalle County court on May 18 to 360 days in jail for the hit-and-run death of a Spring Valley man.

Wyatt K.L. Wyatt, 22, was killed in the accident on the night of June 4, 2017. His body was found on Bottom Road between Granville and Peru, and Dobrich was arrested soon after.

Dobrich initially faced charges for one count of leaving the scene

of an accident leading to a death, a Class 4 felony. Dobrich paid 10 percent of a $100,000 bond and was released pending his trial.

Wyatt’s body was found at 9:28 p.m. June Luke T. 4 on 70 N. 2551st Road, Dobrich just east of August Hill Winery and about a mile south of Peru.

LaSalle County Sheriff’s deputies and Oglesby Ambulance arrived on the scene and found Wyatt unre-

sponsive.

Investigators from the sheriff’s department and the Illinois State Police crime scene and accident reconstruction teams were on the scene Wyatt throughout the night.

Wyatt Wyatt was born Feb. 26, 1995, in Sterling to Jolyn Wyatt, now of Browntown, Wis., and Tom Wyatt of Hennepin.

He graduated from Princeton High School in 2013, and he worked at

Tonica’s new TIF district goes into effect Village to receive increment in 2019

The Tonica Village Board has approved the various elements of the Tax Increment Financing District that has been in development.

Village President Kevin Sluder said at Monday night’s meeting that this action puts the TIF district into effect, though lawyers were still tweaking certain language for the LaSalle-Peru Township High School District. Sluder said that the language changes were going to be, essentially,

• Village engineer Jack Kusek said that Tonica’s street program is calculated to cost $140,000, with $90,000 of that coming from motor fuel tax funds. The project includes distinct elements, as Third Street is to be reshaped, with added stone and chipping. Kusek said other streets will receive asphalt.

Bradley was last was seen on Jan. 23, and she was reported missing the following morning. Her body, stabbed multiple times, was found Jan. 27.

According to Putnam County Sheriff Kevin Doyle, investigators think Henderson and Bradley met online and that Henderson picked the teen up near her home between 6:30 and 7:30 a.m. on Jan. 24. Investigators believe Henderson then drove to the spot where her body was found and killed her.

Henderson was arrested after being interviewed at the police station. Tips, interviews, surveillance cameras and pings from Bradley’s cellphone link him to her death, Doyle has said.

Dobrich, facing Judge Cynthia M. Raccuglia, pleaded guilty to one count of failure to report an accident involving injury or death, a Class 4 felony with a base sentencing of one to three years in prison, and one count of misdemeanor driving under the influence.

All other counts were dismissed.

The plea deal also includes a community service requirement.

Dobrich had no prior criminal record.

POLICE REPORTS LASALLE COUNTY SHERIFF Single-vehicle accident At 10:42 p.m. on May 18, deputies investigated a single-vehicle accident on North 23rd Road in Eden Township. A vehicle driven by Nathaniel Welch, 18, of Granville was westbound on North 23rd Road, east of Meridian Road, when he lost control, left the road and the vehicle rolled onto its side. Tonica EMS responded to the scene. There were also two male juveniles in the vehicle. There were no injuries and no citations issued.

Single-vehicle accident At 4:29 a.m. on May 20, deputies investigated a single-vehicle accident at Route 251 and North 12th Road in Hope Township.

Keith Holmes, 33, of Lostant was northbound on Route 251 when he fell asleep.

Deputies said Holmes crossed over into the ditch to the west, struck the culvert and then crossed over North 12th Road and came to a stop on the culvert on the north side of North 12th Road. No injuries were reported. Holmes was cited for operating an uninsured motor vehicle.

IVCC dental clinics schedule more than 106 appointments

OGLESBY — Illinois Valley Community College’s dental clinics scheduled more than 106 appointments this semester and attending doctors found several undiagnosed conditions ranging from a fractured tooth under a crown, an abscess, wisdom teeth impaction and rampant decay cause by xerostomia (dry mouth).

Program coordinator Heather Seghi said, “I’m really pleased with the turnout. Each year, we try to reach more and more people from the community to help those who may otherwise not have had the chance at a dental exam, X-rays and cleanings due to cost or lack of insurance.

“About 95 percent of the patients we have seen in our clinic do not have dental insurance, or carry the medical card, which does not cover preventative dental procedures, such as cleanings, bitewing X-rays, sealants and fluoride treatment for adults.

“When a doctor recommends a treatment we do not offer, we give contact information to other programs in Illinois that can offer lower cost dental treatment ranging from a deep cleaning to restorative or surgical procedures from the dental schools in Illinois,” she explained.

Clinics give dental assistant students hands-on experience working with patients under the supervision of their instructor, a hygienist and dentist.

“Dental assistants are able to take digital and film X-rays, assist the dentist chairside, take dental impressions, blood pressure readings, complete lab work and practice checking patients in.

“At the end of the clinics, a volunteer dentist performs mock-interviews with each student and pro-

vides feedback so they are confident going into an actual interview,” she added.

Students appreciate the handson, fast-paced nature of the clinics as well as working with patients to improve their dental health.

Ashley Bice of Peru said, “It’s the best part of the program. For now, I hope to find a job in an office working as a dental assistant but I feel IVCC’s program has set me up to succeed if I decide to attend a hygiene program in the future.”

Leeann Artos of Streator added, “I get to see results on projects I’m working on and I’ve learned to stay organized as I go.”

Jocelyn Luna of Mendota enjoys working with different materials and the experience she gets while learning. Meagan Clark of Peru said the clinics prepare students for a real office. “It feels good knowing I will graduate with my Dental Assisting certificate and associates in science debt-free!”

Part-time student Jessica Bogatitus of Spring Valley said, “I will not see patients until next year, but I am looking forward to making them smile! After completing the program, I hope to work in a pediatric dental office.”

Seghi noted, “After completing the program, graduates can go on to work chairside in a private practice or institutional office, as an administrative assistant, in insurance offices, for dental manufacturers, management consulting firms, teaching or in dental laboratories.

“If they continue to go onto hygiene school, they will be more prepared for the demands of the program and typically if a dentist had to choose between a dental hygienist and a dental hygienist with experience as

LASALLE — Stage 212 has announced auditions for the children’s theater production of “Mary Poppins, Jr.” will take place at 6 p.m.

Friday, June 15, and 1 p.m. Saturday, June 16, (attend one) at the theater, 700 First St. in downtown LaSalle.

A full production by kids, for kids, “Mary Poppins, Jr.” is open to all children entering grades 4 to 10.

Director Reid Tomasson will cast approximately 30 children in a variety of lead and supporting roles. Kids will be taught a portion of the song “Feed the Birds” from the musical,

a dance combination and will do a reading from the script. No advance preparation is necessary, but kids should come dressed to move. Flipflops are strongly discouraged. All auditioners should bring a calendar with all of their summer conflicts. No absences will be allowed after Aug. 1.

Virginia’s advice for longevity: Stay active

OTTAWA — Virginia Cooper’s smile lit up her face as family members filed into Heritage Woods last Tuesday and gave her a hug, one by one.

“Happy birthday, Grandma!” was repeated again and again as they greeted the centenarian dressed in bright colors, including a hot pink cardigan and matching sparkling earrings.

“What did I do to deserve all this?” wondered aloud Cooper, who is known as Peg, during a birthday celebration in the dining room of the Ottawa assisted-living facility.

In honor of turning 100 years old, she was presented with certificates and cards from local and state officials, as well as the president, a U.S. flag flown over the state Capitol, and a key to the city.

“It’s a key to the city, and it’s a key to our hearts,” said Ottawa Mayor Bob Eschbach after pointing out that both he and the 1937 graduate are Ottawa High School alumni.

“It doesn’t seem possible that I can be that old,” Cooper said.

The diehard Chicago Cubs and Chicago Bulls fan, who will miss watching a game only to play cards (preferably euchre), said the key to her longevity is being on the go.

“Stay active and keep busy,” she said. “Don’t stay in your room all day.”

Katy Hauser, Cooper’s oldest of three children, attributes her mother’s long life, most of which was spent on a Lostant farm with her late husband Clifford, to her diet.

“They grew their own garden.

They had their own beef and didn’t eat processed foods. That’s part of her longevity,” Hauser said.

Speaking of food, folks in Lostant may know Cooper for the pies she baked for the Village Inn. “She was the best pie maker.

Everyone wanted one of Peg’s pies,” said Cooper’s daughter, Karen Breckenridge, of Lostant. A couple of Cooper’s six grandchildren said there were always pies at family gatherings.

great-grandchildren she has, Cooper chuckled and said “lots,” adding that with a recent birth there are now six great-great-grandchildren.

Between her growing family, holidays, milestones and celebrations, Cooper said she likes to look to the future rather than the past. “I always have something to live for,” she said.

That said, Cooper does seem to long for a simpler time regarding one technological advance: smartphones.

“I don’t like them,” she said with a puckered mouth and wrinkled nose. She thinks people should spend more time interacting with each other instead of looking at their hand-held devices.

As for social media, the closest thing she had was a party line.

“The neighbors could all listen,” she said of the wooden telephone with the hand crank. “So you had to be careful what you said!”

On May 13, 68 of Cooper’s relatives traveled from six states and throughout Illinois to celebrate the birth of this woman who is described by family and friends as “bubbly.”

“She’s been a great example. She is always on the go,” said Cooper’s oldest grandchild, Brenda Othick, of Crystal Lake. “I always say, ‘When I grow up, I want to be like her.’ “
