Sheriff Booker will run for reelection in 2026

MORRISON – Whiteside County Sher-

iff John F. Booker announced May 6 that he will run for a third term.

Booker, whose seat will come up for election in November 2026, was first elected to the office in 2018.

“I am honored to have served as your sheriff for the past two terms and I’m excited to announce that I am running for

reelection to build on the progress we’ve made together,” Booker said.

Under his leadership, the department has implemented enhanced training programs for deputies, bolstered community

policing initiatives and incorporated the latest technologies to support law enforcement efforts, Booker said.

“Having lived in Whiteside County for 34 years, I understand the values and needs of our community, and my experience has prepared me to continue leading the sheriff’s office with integrity, professionalism and dedication,” he said. “Politics has no place behind the wheel of a patrol car and I will continue to ensure that our law enforcement remains focused

on what truly matters: keeping our community safe.”

Booker has been in law enforcement for 34 years. A Democrat, Booker was first elected to office in 2018 after defeating Republican Kris Schmidt, who at the time was a Whiteside County sheriff’s deputy. Booker won reelection four years later after defeating Republican challenger Mike Lewis, who at the time was Tampico’s police chief and earlier had served as a Whiteside County sheriff’s deputy.

River Bend schools partner with Constellation for summer learning classes

FULTON – River Bend Schools students, in partnership with Constellation, will experience summer enrichment classes from June 2-6.

About 150 students in grades 4-8 will participate in the program, which is designed to spark curiosity, build

skills and prepare students for a successful year ahead, River Bend Schools Superintendent Darryl Hogue said.

The summer enrichment classes will include hands-on activities, STEM-based learning, creative arts, culinary arts and physical activities. With a focus on exploration and fun, the weeklong series aims to promote

lifelong learning while providing a safe and stimulating environment for students.

Classes will be held at River Bend Middle School. Transportation and meals will be provided.

Times and touring the Field of Dreams, as well as several other fun and exciting adventures.

More than 300 students also will participate in one-day trips offered in June and early July. Trips include a 3D printing tour, visiting Medieval

Died: May 8, 2025 in Sterling, IL

Retta Marcum, age 71, of Fulton, died Thursday, May 8, 2025 at CGH Medical Center in Sterling.

Retta was born April 10, 1954 in Clinton, IA, the daughter of Harry and Helen (Turner) Petersen. She married John Marcum on June 10, 1972 at Zion Lutheran Church in Clinton, IA. She was employed as a Pharmacy Tech at Berg’s in Fulton, a CNA at Harbor Crest in Fulton, and was a River Bend School Bus Driver. Retta was a member of the First Baptist Church in Clinton and enjoyed vacationing with her family, attending her grandchildren’s sporting events, planting flowers, shopping, and bowling.

She is survived by her husband, John Marcum

of Fulton; her daughter, Tonya (Craig) Buikema of Rockford; her son, Ryan (Korri) Marcum of Fulton; two brothers, Mike (Virginia) Petersen and Rick (Karen) Petersen both of Fulton; four grandchildren, Hannah (Adam Kuhr) Buikema, Caleb (Signe Dobbs) Buikema, Gabe Marcum, and Gavyn Marcum; one sister-in-law, Sue Marcum; several nieces and nephews and great nieces and great nephews; and her grand-dog, Rora.

She was preceded in death by her parents; one sibling in infancy; one brother-in-law, Jim Marcum.

A visitation will be held on Tuesday, May 13, 2025 from 5:00 – 7:00 PM at the McDonald Funeral Home in Fulton. A Celebration of Life will be Wednesday, May 14, 2025 at 10:00 AM at the funeral home with Pastor Ron Lott of the First Baptist Church in Clinton officiating. Leota Mae “Lee” Roberts, 80, of Bettendorf, Iowa, passed away peacefully surrounded by her loved ones; Sunday, April 27, 2025, in her home. She was born March 9, 1945, in Pittsburgh, Pennsylvania, born to Sally (Aul) and raised by her parents Charles and Estella (Leonard) Overly.

Lee graduated from Palm Beach High School in West Palm Beach, Florida. Shortly after high school Lee married the love of her life

Doug where they would create the love story of a lifetime. She was united in marriage to Douglas David Roberts on August 30, 1963, in Palm Beach, Florida. She birthed three children Jeffrey, Carol, and Christine. Whom Lee was immensely proud of for their many accomplishments in life. So much so she had Doug pack up their entire existence and followed them cross country.

Lee thoroughly enjoyed working as an activities assistant at Prophet Riverview Good Samaritan Society, Grand Villa of Palm, and Harbors Chase of Palm nursing homes. She enjoyed playing the piano for the Sunday service or helping the “ladies” with crafts. During her time of employment at these locations she made many lifelong friends as well.

100th anniversary of Upper Mississippi River National Wildlife and Fish Refuge to be topic May 18

FULTON – Ed Britton, wildlife refuge manager of the Savanna District, will present a program on the 100th anniversary of the Upper Mississippi River National Wildlife and Fish Refuge at 2 p.m. Sunday, May 18, at the Fulton Martin House Museum.

Britton will talk about the history of the refuge and the fish and wildlife species present in the local area of the Mississippi – a great natural resource that Fulton shares with Clinton, Iowa.

His topic also will cover the management challenges of the “often times” unpredictable changes of Fulton’s closest neighbor, the “mighty” Mississippi River.

Britton will provide information on

things; some of her favorites included the simple things in life. Whether it be an ice-cold diet coke, a hidden gem in a thrift store, or a sweet treat. In her free time, she also enjoyed restoring furniture, gardening around her home, and a hot sunny day at the beach. But most of all, she will be remembered for the love she had to offer. She made sure that everyone around her felt her welcoming arms. As for Lee’s family we know she is happy being reunited with the love of her life and smiling back at all of us. We will see her in the spring flowers, the crazy lady with a cart full at the thrift store, or any time we pass a dairy queen.

The Fulton Martin House Museum, 707 10th Ave., consists of 11 rooms of historical artifacts and an extensive photo gallery of local interest. The Fulton Historical Society manages the property for the city of Fulton. In addition to bequeathing their home, Maxine and Leonard Martin donated $355,000 to the city to ensure there would never be any cost to the local taxpayer. Interest from the principle is used to cover maintenance costs only.

The north entrance is easily accessible. Refreshments will be served at the presentation.

One of the museum’s permanent displays features the Lincoln Highway Bridge, erected in 1891 over the Mississippi River.

Rapids City tae kwon do students compete in tournament

Chung Kim’s Black Belt Academy hosted its annual Inter-School tournament on April 26 in Bettendorf, Iowa.

The Inter-School tournament was designed by Grand Master Kim as a way to bring the branch schools together for friendly competition while giving students a chance to learn how to compete.

Many times it is the student’s first time competing. The Chung Kim branch schools in attendance included Rapids City and Milan from Illinois and Bettendorf, Davenport, Dewitt, Ankeny and Adel from Iowa.

With about 70 competitors, the tournament started with the youngest white belts competing and moved through the belt ranks and ages, concluding with the adult black belt competitors.

Each age group/belt rank division first performed their forms, followed by board breaking and ending with the fighting/free-sparring competition.

The Rapids City tae kwon oo school holds classes from 5:30 to 7 p.m. Tuesday and Thursday at the Rapids City Community Center.

It is a traditional style of tae kwon do, with the focus on developing the martial art spirit.

The school has been holding classes in the Port Byron/Rapids City area for 39 years.

Clinton’s Bickelhaupt Arboretum begins bold new chapter

CLINTON, Iowa – Under a cloudy sky, dozens of residents, alumni, community leaders and college officials gathered at the Bickelhaupt Arboretum on May 1 where the scent of damp soil mingled with spring blossoms and the promise of a bold new chapter.

Golden shovels in hand, they leaned into the earth – not just to mark the start of a construction project, but to plant the next seeds in a legacy five decades in the making.

“This is more than a groundbreaking,” said Brian Kelly, president of Clinton Community College. “It’s the continuation of a dream that started with two people walking the streets of Clinton, wondering how they could help humanity.”

That dream belonged to Bob and Frances Bickelhaupt, a local couple who transformed their private property into a public garden beginning in 1970.

What began as a personal conservation project has grown into an arboretum spanning 15 acres and housing more than 2,000 species of trees, shrubs and perennials.

Now it’s poised for its most ambitious transformation yet.

The Bickelhaupts’ story has become something of Clinton folklore. In 1964, the couple walked 90 miles of city streets on 38 excursions, mapping tree species and discussing their shared vision to give back to a community that had given them so much.

Confronted with the devastation of Dutch elm disease and a lack of public green space, they imagined an educational arboretum that could heal, teach and inspire.

Now, through the joint efforts of Eastern Iowa Community Colleges and the Paul B. Sharar Foundation, that legacy is being renewed. A $5 million renovation campaign – years in the making – is set to transform the arboretum into a more inclusive, sustainable and community-centered space by November 2025.

Among the most vocal supporters of the project is Shawn Hill-Lamb, granddaughter of Bob and Frances Bickelhaupt, who spent childhood summers on the property when it was still her grandparents’ home.

“I remember picking the apples in an apple tree that my grandmother had. We fished and we played in the creek all day long. And, of course, we learned to swim

here in the swimming pool,” Hill-Lamb said.

Hill-Lamb later joined the arboretum’s board of directors and played a key role in helping her family transfer the property to the Paul B. Sharar Foundation and Eastern Iowa Community Colleges in 2014. She said the renovation builds on the foundation her grandparents laid with purpose and care.

“They always were planning for the

future,” Hill-Lamb said. “This renovation project will beautifully honor my family’s legacy.”

Plans include ADA-accessible facilities, community gathering spaces, expanded educational programming and long-term sustainability measures. The updates will improve access and ensure the arboretum remains a resource for learners of all ages.

Fundraising was led by the Clinton

Community College Paul B. Sharar Foundation. Jenny Boysen, former EICC board member, the foundation’s president and a Clinton Community College alumnus, praised the teamwork behind the effort.

“When we first heard about the idea, I wasn’t sure we could pull it off,” Boysen said.

Fulton Kiwanis Club gives $3,000 to Rec League

FULTON – The Fulton Kiwanis Club presented the Rec League with a check for $3,000 on April 21.

“The money will be used as needed for uniforms, referees, repairs, groundskeepers fees, etc., so that 356 boys and girls can have a fun summer playing softball and baseball,” committee chairpersons Barbara and David Frantz said in a news release.

The Fulton Kiwanis Club raised the money by selling banner advertising that hangs on the field fencing from May through September each year.

“We give 100% of all money raised to the Rec League. Without the caring businesses that advertise, this could not happen. We thank all of them very much,” the release said.

Kiwanis Lt. Gov. David Frantz presented the check to Colleen Temple, Jean Roeder, Larry Buikema and Larry Russell.

Local school districts to receive state library grants

DIXON – The Erie, River Bend, Riverdale, Morrison and Prophetstown-Lyndon-Tampico school districts are among 30 districts in the 37th District that will receive state library grants, State Sen. Li Arellano Jr., R-Dixon, announced April 23.

The annual grants, totaling $34,000, have been awarded to public schools throughout the district. The grants, administered by the Illinois Secretary of State’s office, are aimed at supporting school libraries serving students from kindergarten through 12th grade.

“These grants are a great win for our students, educators and communities,” Arellano said. “School libraries are more

than just books, they’re learning hubs that promote literacy, access to technology and academic achievement. I’m proud to see our local schools receiving these important funds to strengthen those resources.”

The library grants can be used for buying books, e-books, audiobooks, periodicals, multilingual materials, updated technology and educational programming.

1965: Both bridges reopen after Mississippi River flood

60 Years

May 12, 1965

With the opening of both bridges over the Mississippi River and the opening of a section of Highway 84 between Fulton and Highway 30, Fulton residents now have access to the outside world in all directions and business and living conditions rapidly are returning to normal after the recent flood.

The Junior class voted to cancel the dinner planned as part of the Junior-Senior Banquet and Prom and the money will be given for flood relief. Junior class officers are Diane Faber, president; Jim Koenes, vice president; Shelia Wade, secretary; and Gary Bowen, treasurer. Class sponsors are Harold Vance, Ed Criss, James Zahnle and Mrs. Roline Bruhn.

50 Years

May 14, 1975

Mrs. David Vogel was installed as vice president of the Fulton Junior Woman’s Club during the May dinner meeting. New president Mrs. Robert Feldt was absent and will be installed at the September meeting. Others installed were Mrs. James Zuidema, secretary, and Mrs. Donald Tollstam, treasurer.

Voting will take place on a proposal to annex additional territory to the Schmaling Memorial Library District. People in the area to be annexed presented a petition to the board of trustees of the library asking that it be extended to them. When the number of people served passes the 5,000 mark, they become eligible for state and federal funds and specialized services.

40 Years

May 15, 1985

Fulton High School students inducted into the National Honor Society were Amy Dannels, Andrea Senior, Joyce Deelsnyder, Pamela Engelkins, Kirsten Tollstam, Lisa Turner, Charlene Kerr, Dawn Sterenberg, Heidi Kolk, Jeff Medema, Kristi Wiersema and Dan Kettler.

Another move toward making the proposed new shopping center for Fulton a reality was taken at a special meeting of the City Council. The council voted unanimously to ask for bids on the tract at the intersection of Highway 84 and 14th Avenue. Investment in the project might be more than a million dollars and there is the possibility that 70 new jobs will be created.

30 Years

May 10, 1995

A huge storm system produced several tornadoes, hail and strong winds and heavy rain moved across the area. Several tornado clouds were spotted throughout the area and one tornado touched down east of Fulton, causing devastation to several farms and homes. Jeff Holesinger’s farmhouse was completely gone and several outbuildings were destroyed.

All that remains to get developers started on a new 16-unit condominium in the northern part of Fulton is a change in zoning classification on the land. The property is being purchased from Joseph Keegan. The homes will be in eight buildings with two units in each building.

20 Years

Supporters on both sides of the announcement of the closing of the Albany K-5 grade school continue their efforts. The Albany group has sent letters to residents in the proposed area of the annexation to Erie schools. Concerned Citizens of River Bend who are opposed to the detachment from River Bend schools also have been active working to provide

information. The River Bend citizens group has presented a Fact Sheet detailing information on the plan.

The Dutch Days Festival was well-attended with a large crowd for the parade and other festivities. Cloudy skies started off both days of the festival, but the sun came out and brought with it plenty of visitors to the event.

Awesometown Music announced Fulton’s annual Venusfest in Heritage Canyon. Awesometown has lined up five girl bands as they raise money for breast cancer awareness. Proceeds will go to Gilda’s Club in the Quad Cities.

Congratulations to River Bend Middle School students Max Lemke and Mandy Alstead. Max and Mindy were chosen to represent RBMS at the annual Illinois Principal Association Leadership awards ceremony. A retired principal spoke to students about leadership and emphasized to students that they are leaders. Max and Mindy were chosen to attend the banquet by the eighth grade staff at River Bend Middle School.

“But when you have leaders like Brian Kelly and Karen Vickers, and you’ve got people like Ann Eisenman running marathons around you, how can you say no?”

Boysen laughed as she recalled a memorable moment with Eisenman.

“Ann caught me while I was walking and asked for a letter of support for permeable pavers,” she said. “You don’t say no to Ann. I’m glad I didn’t.”

Eisenman, who coordinated planning, grant writing and community outreach, said the renovation reflects the community’s values.

“This project is really about stewardship,” she said. “It’s about honoring what came before us and making sure the arboretum remains a place for learning, reflection and connection for everyone.”

Clinton Mayor Scott Maddasion, who lives nearby, said the arboretum is part of the daily life of many Clinton residents.

“This property is very highly trafficked and a lot of people walk by my house to go right into the arboretum, and they’re walking their dogs and things like that,” he said. “It’s a wonderful piece of property to have in the middle of town and a treasure for our community. This project is just going to amp that up even more, so I am really excited to see this come to fruition.”

Liang Chee Wee, chancellor of Eastern Iowa Community Colleges, drew parallels to his upbringing in Singapore, which is known for its lush green public spaces.

“This place offers a kind of welcome we all need,” he said. “It invites us to slow down and appreciate the world around us. That’s what makes it so important.”

As the ceremony came to a close, Kelly acknowledged the emotional significance of the arboretum to many Clinton residents.

“I can’t count the number of homes I’ve visited that have prom pictures or family portraits taken here,” he said. “This space is part of our shared story.”

He looked out at the crowd, smiling.

“Start thinking about your outfit,” he said. “We’ll see you back here in November.”

Features of the renovations and enhancements project include:

• The Events Center is a large area offering a variety of seating options. The 2,033-square-foot room features floor to ceiling windows overlooking the spacious outdoor deck and the Bickelhaupt Arboretum.

• The Deck with Railing will be out -

side of the Events Center. It’s an area that provides options for events at the Bickelhaupt Arboretum. At 2,200 square feet, the composite deck features sweeping views of the arboretum landscape with seating for 110.

• The Art Installation in the pool footprint is a feature of the Gathering Room. Artwork will be installed in the pool cavity of the Events Center with special lighting and covered with glass flooring, creating a unique environment for family gatherings, special events and conferences.

• Education Center rooms feature 1,242 and 800 square feet of learning environment including a library space.

• Welcome Pavilion is the entry point to the Bickelhaupt Arboretum from the parking lot. This open air structure provides a respite from the rain and a place for learning materials.

• The Gathering Place is the first stop upon entry through the Welcome Pavilion. Accessible pathway, benches and shade are a wonderful place to experience the sight and sounds of the Bickelhaupt Arboretum.

• The Animal Exhibit is a walk through nature. Visitors of all ages will enjoy seeing animals in their native habitats.

Fulton wins conference meet: The Lady Steamers took top honors at the Northwest Upstate Illini Conference meet May 8 in Dakota.

Fulton scored 143 points en route to the title. Second place went to LenaWinslow with 120 points, followed by Galena (84), Forreston-Polo (81), Amboy (55), Pecatonica (53), West Carroll (39), Stockton (38), Milledgeville (37), Morrison (13), Dakota (7) and AFC (2).

Fulton’s 4x100 relay team of Paige Cramer, Brooklyn Thoms, Haley Smither and Miraya Pessman took first in 50.09 seconds.

The 4x800 relay team of Ellie Mulder, Breleigh Terrock-Hayton, Peighton Stretton and Jessa Read won in 10:21.33.

Grace Bray won the 300-meter hurdles in 49.39 seconds, followed by teammate Chole Wilkin in second at 50.62.

Kylie Smither won the shot put with a throw of 11.45 meters and was second in the discus at 31.66 meters.

Pessman won the long jump with a leap of 4.74 meters, followed by Cramer in second place at 4.59 meters.

Emery Wherry won the triple jump at 9.89 meters and Olivia Knott was fourth.

Fulton 6, East Dubuque 5 (8 inn.): Belle Curley had a walk-off RBI single that scored Kira Wilson in the extra inning. The Steamers scored five times in the fourth before the Warriors tied it 5-5 with three runs in the fifth. Wilson finished 3 for 5 and Jessa Read had two RBIs and pitched a complete game with nine strikeouts.

Morrison 13, Annawan 1 (5 inn.): Morrison’s Ava Duncan pitched five innings with four strikeouts and one walk, scattering 11 hits. Kiyah Wolber had three RBIs and Bella Duncan had two doubles and two RBIs.

Erie-Prophetstown 13, Mendota 1 (6 inn.): E-P had five extra-base hits in the road win. Wynn Renkes led the way with two doubles and three RBIs and pitched three scoreless innings. Ayden Klendworth worked three innings and got the win.

East Dubuque 1, Fulton 0: The Steamers lost in a pitchers’ duel after being outhit 2-1. East Dubuque’s lone run came without a hit in the second inning after multiple errors. Fulton’s Jessa Read took the loss after pitching six innings with six strikeouts, no walks and no earned runs allowed. Curin Oberman pitched a complete game with eight strikeouts and two walks for the Warriors.

Morrison wins 10th straight

MORRISON – After what she described as a “rocky” start to the season, Bella Duncan and Morrison are on a roll.

Opening the season with a 3-3 record, the Fillies have lost only once in the past month.

Duncan’s pitching, a balanced offense and just having fun are big reasons why.

Duncan threw her fifth no-hitter of the season in a 9-0 nonconference win over Bureau Valley on May 9.

Morrison (15-4) won its 10th straight game.

Duncan pitched aggressively and kept the pressure on as she struck out 18 and walked none. Bureau Valley (13-15) reached once on an error and Sadie Bailey reached twice on catcher interference calls.

Kiyah Wolber and Allie Anderson each had two RBIs and Bella Scachette had three of Morrison’s 12 hits in the win.

“Having 10 wins in a row for us is absolutely huge,” Duncan said. “We’ve just been doing so well. I can’t ask for anything better.”

Committed to play softball at Western Michigan, Duncan was recruited to the school for her hitting.

She entered the game batting a teambest .561, but the Fillies haven’t needed to rely on her bat this season. There is more balance on offense this year compared with previous years.

Seven Fillies had hits and scored runs for Morrison in the win over the Storm. Anderson, Madi Armitage and Bella Scachette‘s younger sister, Ava, all had doubles.

“We’ve finally found a way to have hit after hit and really get those runs each inning,” Bella Scachette said. “It’s big for us that we’re scoring a run each inning usually. That’s something that we haven’t been doing this whole year until recently and it’s made a huge difference in our 10 wins in a row.”

The second and fifth innings were the big ones for Morrison on Friday as they scored four times in each frame.

While dominating the game, Morrison had fun doing so. Team chants, jokes in the dugout and hyping one another up

happened frequently.

“It’s made a big difference for us when we all realized that the whole point of this game is to have fun,” Bella Scachette said. “We’ve been playing better. I would say that’s like the root of our wins right now is us having fun.”

Duncan said her main strength in the circle is her rise ball as she attacks hitters.

“Once I get going, I don’t like to stop,” she said. “I’m a very fast-faster pitcher. I like to get in there, get things done and get out.”

Bureau Valley coach David Shepard said that was a challenge for his hitters as they tried to escape an offensive funk while playing some tough teams. They also were shut out twice against Biggsville West Central (21-3).

“She likes to work fast,” Shepard said of Duncan. “If you’re not prepared for that, it can take you off guard. I kept telling our girls, you need to slow her down. And she threw nothing but strikes and she would climb the ladder. She pitched really well.”

The Fillies are the No. 1 seed at the Class 2A Princeton Regional, opening their postseason May 20.

Up next is a big Northwest Upstate Illini Conference matchup with Milledgeville on Tuesday.

Duncan said continuing to have success all comes back to having fun and staying calm.

“That’s what I love about them,” Morrison coach Chelsea Eads said about the team. “That’s the whole point we play softball, to have fun. I always tell them there’s no point in being here if you’re not having fun. ... We owe everything that we have to the game. It’s given us so much, so it’s important to have fun.”

Area boys and girls basketball players from the Northwest Upstate Illini Conference competed in their high school uniforms one last time at the Jim Shaw All-Star Basketball Classic on May 4 at Eastland High School.

Competing players had to be in the WCCI-listening area and be an all-conference member. The event was sponsored by the Northwest Illinois Sports Hall of Fame.

In the girls game, the North team won 63-50 behind an MVP performance from River Ridge-Scales Mound’s Laiken Haas, who scored 29 points. West Carroll’s Caitlyn Stingley scored eight points in the second half and Domynique Lego scored two.

Morrison’s Camryn Veltrop led the South team with 20 points. Eastland’s Olivia Klinefelter had eight points and Fulton’s Kylie Smither added eight.

Milledgeville’s Kendra Hutchison had four points. Pearl City’s Fallyn Endress scored four and Kendra Kuhlemeier had six.

Area girls invited but unable to play were Morrison’s Kaylee Pruis, West Carroll’s Emma Randecker and Forreston’s Jayleigh Newill.

In the boys game, Eastland’s Adam Awender earned the Most Valuable Player honor after scoring 33 points to help the South team beat the North 93-64. Awender hit nine 3-pointers, including six in the third quarter. The team was coached by Eastland’s Tyler Zumdahl.

Milledgeville‘s Micah Toms-Smith scored 11 points, Brendan Greenfield had seven, Peyton Spears had 13 and West Carroll’s Tyler McGinnis had three. Lena-Winslow’s Michael Mowery scored 12 and Pearl City’s Tyler Clark had eight.

Reaching double figures for the North All-Stars were East Dubuque’s Bradin Lee (11) and River Ridge’s Damon Dittmar (14) and Joseph Winter (15).

Invitees who were unable to play included Morrison’s Colton Bielema and Fulton’s Braeden Brennan and Jacob Huisenga.

Section 13. There is herby imposed upon the cus tomers an Electricity Infrast ructure Maintenance fee ("franchise fee") of one (I) percent upon the gross revenues, minus uncollectible accounts, generated from sales of electr icity and distribution service, pursuant to the Tariff, by the Company within the corporate limits of the City. The franchise fee shall be remitted by the Company to the C ity on or before the last bus iness day of the calendar quarter following the close of the calendar quarter in which the franchise fee is charged. A. The City agrees to modify the level of franchise fees imposed only once in any 24-month period. B. The Company will commence collecting franchise fee s on or before the first Company billing cycle of the first calendar month following ninety (90) days of receipt of information req uired of the City to implement the franchise fee, including the City's documentation of customer classes subject to or exempted from City-imposed franc hise fee. C. The City shall be sol ely responsible for i dentifying customer classes subject to or exempt from paying the City imposed franc hise fee. The Company shall have no obligation to collect franchise fees from customers in annexed areas until and unless such ordinances have been provided to the Company by certified mail. The Company shall commence collect ing franchise fees in the annexed ar eas no sooner tha n sixty (60) days after receiving annexation ordinances from the City. D. The Company shall not, under any circumstance s be required to return or refund any franchise fee s that have bee n collected from customers and remitted to the City. In the event the Company is required to provide data or informat ion in defense of the City's imposition of franchise fees or the Company is required to assist the City in identifying customers or calculating any franchise fee refunds for groups of or individual customers the City shall reimburse the Company for the expenses incurred by the Company to provide such data or information G. With respect to the distribution or tr ansportation by the Company of natural gas sold to the customer by a third-party supplier of the commodity, the percentage of gross recei pts shall be applied to the customer's full cost of gas delivered within the City, including all costs of acquisition, ownership, and transportation whereof, wherever incurred. In determining the amount of the fee, the Company may presume that the customer's commodity cost of gas is the same as if the gas were sold by the Company, unless a differ ent cost is provided is hereby struck and the follo wi ng Section 13 is substi tuted therefore: Section 13. An Utility Franchise Fee of one (1) perce nt is imposed upon, and shall be collected from, the natural gas customers of the Company receiving service and located within the corporate limits of the City.
