Zoning OK’d for landscapers Business will be on Caton Farm Road

By TONY SCOTT tscott@kendallcountynow.com The Kendall County Board recently unanimously approved a special use zoning for a new landscaping business in unincorporated Kendall Township.

Chris and Megan Jensen are planning a landscaping business at 7225 Caton Farm Road, on the north side of Caton Farm Road just west of Church Road.

According to county documents, the business “will include landscape maintenance, installation of landscaping, and related activities” and no yard or landscape waste will be stored on-site “with the possible exception of balled

Senior Planner John Sterrett said the equipment used for the business is used in excavating and that Kendall Township officials had a Bob “H.D.” concern about that. The Davidson township voted to deny the petition, he said.

The County Regional Planning Commission, Sterrett said, recommended that any equipment be limited to the equipment the business is operating so that it doesn’t become an excavating operation in the future.

Sterrett said excavating businesses are not allowed in the county’s ag zoning districts.

Four new laws that took effect Monday seek to expand hunting opportunities and fishing opportunities while protecting state lands and wildlife.

The laws were signed Saturday by Gov. Bruce Rauner during Conservation Day at the Illinois State Fair.

Senate Bill 2410 expands the youth license program to include trapping.

People younger than 18 may apply for a license, and must be accompanied by an adult age 21 or older who also has a valid state trapping license.

House Bill 5788 added catfish to the list of fish that can be taken by bow fishing, or the use of specialized archery equipment to shoot them, and House Bill 4604 allows for permits to take bobwhite quail, chukars and gray partridge on public hunting grounds.

Both bills allow the Illinois Department of Natural Resources to set rules setting limits without requiring a state statute.

Under Senate Bill 3003, the department can offer free landowner hunting permits for deer and turkey as long as the landowner has at least 40 acres.

The bill also combines the application for deer and turkey into one, and requires the department to hold a youth turkey season for two consecutive weekends instead of the current one weekend.

Department Director Wayne Rosenthal said in a statement that the new laws will “help our conservation efforts and will allow a new generation to develop a love for the great outdoors here in Illinois.”

“Giving more opportunities to appreciate our resources to these young Illinoisans will ensure conservation of our lands for generations to come,” Rauner said.

Local law enforcement, attorneys react to change in Illinois marijuana law

Local law enforcement and prosecutors are dealing with a new law that allows for a certain amount of marijuana possession to be punishable by a fine instead of jail time. with possession of cannabis, they all get booked, they’d have to get booked at the police station,” he said. “With these amounts under 10 grams, those people would no longer have to get booked. So there are going to be some cases now that we’ll just deal with out in the street, issue the citation, turn the cannabis in to evidence and be done with it. So, probably on a smaller scale, in those particular cases, it will reduce the amount of resources needed.”

Weis said, however, that the law created some issues, as the 187-page document was signed by the governor on a Friday afternoon, giving little time for prosecutors, law enforcement and other officials to prepare for the change.

“It came down on a Friday afternoon, which made it a little difficult to implement,” Weis said. “We had police officers calling our office at 4:30, 5, 6 at night going, ‘What do we do now that we have this new law that’s effective immediately?’ So there were some procedural things that we had to address right away.

We have to train our officers that these are no longer arrestable offenses in and of themselves.”

He said his staff is trying to figure out what a “civil law violation” actually means, since it’s not a non-criminal civil violation, nor is it a straight

“The [circuit court] clerk’s office is trying to figure out how to disburse fine money, how do they handle these, what happens if they don’t show up to court, how do we deal with them, what forms are we gonna need?” he said. “You don’t plead guilty; even though you’re guilty of the offense, you don’t really plead guilty to a civil law violation. So these things are works in progress throughout the state and nobody has a clear direction.”

Weis said organizations for the circuit clerks, state’s attorneys, and law enforcement are “sharing as much information as they can.”

“It’s been not unmanageable, but it’s been somewhat of an adventure as we look at the different things that had to change because of the new law,” he said.

Burgner also lamented that the bill was signed on a Friday afternoon and went into effect immediately.

“That was one of the challenges with this law is, it went into effect immediately,” he said. “It was signed on a Friday, and it was effective immediately, so that obviously makes it challenging for law enforcement

Local law enforcement and prosecutors are weighing in on a new state law that allows for a ticket and fine in lieu of jail for the possession of 10 grams or less of marijuana.

Gov. Bruce Rauner signed Senate Bill 2228 into law as Public Act 99-0697 on July 29. The law states that the possession of 10 grams – or 0.035 of one ounce – of marijuana is a “civil law violation punishable by a minimum fine of $100 and a maximum fine of $200.”

The law also states that “if a person is convicted of 10 grams or less of cannabis, the penalty for possession of any drug paraphernalia seized during the arrest for that offense shall be a civil law violation punishable by a minimum fine of $100 and a maximum fine of $200.”

Kendall County State’s Attorney Eric Weis said the new law essentially took what were “low end” class B and class C misdemeanor criminal charges and made them “civil law violations.”

“One of the things we’re dealing with is, what does that actually mean?” he said. “They are fine only, they cannot go to jail; they’re not arrested, they are not fingerprinted, booked, as they were before.”

They also decreased the penalties for charges above that by one category, Weis said.

“If you had a class 4 felony weight before, it’s now a class A misdemeanor,” he said, for example.

Yorkville Police Chief Rich Hart said the city has been sending possession cases for anything less than 2.5 grams through the city’s administrative adjudication process, similar to parking tickets and other ordinance violations. He said the city will simply increase the amount to 10 grams to reflect the state law.

“We won’t be taking anything through the county [court system] at all; we’ll be taking it through our adjudication,” he said. “We’re just going to increase the [maximum legal] weight to 10 grams to mirror the state.”

Oswego Police Chief Jeff Burgner said fewer people going through the court system and getting booked for possession of small amounts of marijuana will probably reduce the amount of resources needed.

To the Editor: I applaud the local towns (Oswego and Yorkville) that have agreed to swap equipment between them to make services more efficient.

This is the first step in a much bigger process that is long overdue. Our current government entities and their boundaries were established when the fastest form of travel and communication was via a horse. Private businesses have been using technology for a hundred plus years to combine, eliminate redundancy and be more efficient.

I realize what I am about to write is a huge paradigm shift in thinking but believe it is long overdue. Why do we still need so many local government agencies at the city, township, park and forest preserve level and for that matter at the county level? Some will say it’s written in the state constitution and laws. Fine, amend them to reflect current times, technology and equipment.

Just think of all the redundancies that exist when towns fight over and offer competing incentives for the little open land that remains between them, or the various road districts, school districts, etc. that adjoin each other and send men and equipment long distance to the fringes of their respective territories.

Imagine what would happen if every person whom the government has classified a “victim” to buy their votes were to realize the power of success and happiness lies within them? Politicians, pretended preachers and news outlets would lose money and their place of importance. Welfare departments would have to be shut down, laying off thousands of government workers whose votes are also funded by the taxpayer.

Frank Zappa had it right and Sandra Fluke affirmed it. Go to college if you want sex and go the library if you want an education. I believe there is a difference between knowledge and education and that it’s time to get our children out of the public education system and empower them with the knowledge to become independent rather than cultivate them into believing they are victims for future votes.

The Plano Middle School at 804 S. Hale St. has been around since 1959, but Mark Heller, its principal, was showing it off Monday, Aug. 15, like it was a new building.

From the day students left school for summer break, workers have been busy installing a new air conditioning and heating system at a cost of $2.4 million. And thanks to a team of workers who accepted a challenge, everything was operating as it was supposed to for the opening of school the next day.

The school board was meeting in the school’s library Monday night, so Heller asked that members take a break so he and Bryan Appel, school district director of operations, could give them a quick tour of the building.

Appel said the HVAC system they replaced was the original 1959 steam boiler and was a mix of several different types of heating and minimal cooling equipment.

The work also included a new energy saving lighting system in every room that can be controlled by the user or on an automatic system that turns the lights off after the room is vacant for a certain time. And they also are operated by the amount of outside light that enters each room, he added.

Even the heating and cooling systems can tell if a room is vacant and vary the temperature a few degrees to save energy, he noted. And for the first time since the building was constructed, fresh air can be brought in from the outside.

Heller handed out kudos to his custodial staff for making the building look like a new facility. Considering how things were torn apart during the summer to install the new HVAC equipment and several offices were torn apart for remodeling and relocating, it was not an easy job.

Old wood paneling in the front entrance was removed and replaced with a coat of fresh paint. High school students designated AP Scholars

By LYLE R. ROLFE news@kendallcountynow.com More than 20 Plano High School students have been named Advanced Placement Scholars, according to Principal Eric Benson.

He said this is based on the students’ results from their 2016 AP Exams. This is a 367 percent increase from 2015, Benson noted.

AP Scholars are identified within three levels – AP Scholar, AP Scholar with Honor, and AP Scholar with Distinction.

One student, Lucas Thoms, also was identified as a National AP Scholar.

Benson said this honor is granted to students in the United States who receive an average score of at least 4 on all AP Exams taken, and scores of 4 or higher on eight or more of these exams.

2 towns agree on public works pact Oswego, Yorkville will cooperate to save time, money

By TONY SCOTT tscott@kendallcountynow.com Yorkville and Oswego will be sharing some public works services in an agreement the Yorkville City Council unanimously approved Aug. 9.

The agreement had been reviewed by the Yorkville City Council’s Public Works Committee, and was approved by the Oswego Village Board at its Aug. 2 meeting.

According to City Administrator Bart Olson City Administrator Bart Olson, Oswego has already requested to use Yorkville’s Vactor truck “to assist cleaning catch basins for two days.”

“We would identify a project at a later date in exchange – potentially leaf pickup in the fall,” Olson wrote in a memo to aldermen.

The agreement states that officials “have reviewed the infrastructure and assets under each of their respective jurisdictions and have determined that the citizens and taxpayers of [Yorkville] and [Oswego] would be better served if the maintenance of certain infrastructure and adjacent areas be performed by the Public Works Department that is best equipped to perform certain tasks, thereby saving time and resources and permitting immediate attention to the needed maintenance or repair.”

The agreement says the two municipalities will use “on an ‘as needed’ basis, the service required to the roadways such as mowing, snowplowing,

jetting, leaf collection or such other maintenance as deemed necessary to improve the use and safety thereof and jointly determine whether [Yorkville’s] public works employees or [Oswego’s] public works employees are better able to provide the needed service.

“The [two public works departments] shall agree and advise each other of the date and time such services are to be provided. In the event either the city or the village is unable to assist at any given time, all services to the roadways shall be the responsibility of the unit of government (city or village) having jurisdiction over the roadways.

In other words, this agreement does not reduce, eliminate or transfer the responsibility of the city or the village to repair and maintain the roadways within their respective jurisdictions.”

Trail lease OK’d

In other business on Aug. 9, Yorkville aldermen voted to approve a 20-year lease of ComEd-owned land that will complete the land acquisition process for the Kennedy Road bike and pedestrian trail. The cost of the lease is $1, according to the lease document.

Aldermen voted 5-2 in favor of the lease agreement. Aldermen Seaver Tarulis and Carlo Colosimo, who have consistently voted against the trail, voted against the lease agreement. Aldermen Jackie Milschewski, Larry Kot, Joel Frieders, Diane Teeling, and Chris Funkhouser voted in favor of it. Alderman Ken Koch was absent.

The City Administrator Bart Olson City Council also approved Planning and Zoning Commission appointments.

Approved were Randy Harker as chairman, Deb Horaz, Rich Vinyard, Reagan Flavin Goins, Jeff Olson, Don Marcum, and Bill Gockman.

He continued, “This had the potential to open police agencies up to some liability if they weren’t keeping up with these types of changes. It could have easily gone unnoticed for a few days and you have your officers out there enforcing an old law when they’re not aware that a new law is in effect.”

Burgner said it “would have been nice” to have a 60-day window or even a Jan. 1 start date so agencies could prepare for the change.

“I personally don’t know what the urgency was that this needed to go into effect that day,” he said.

Burgner said those found with 10 grams of marijuana or less will be given a ticket, similar to a speeding ticket.

“It’s an uncommon type of law to issue civil tickets to people, so it’s something we definitely had to work with our state’s attorney’s office on what their procedure is on how we’re going to handle these,” he said. “We

had to take into consideration adult versus juvenile. Our juvenile cases typically go through juvenile probation, however, with these being civil that changes that process.”

He said his agency would be using the same form as a speeding ticket but with a “note at the top that it’s a civil violation.”

Burgner said he would be speaking with village officials about the potential for taking such tickets through the village’s adjudication process instead of the courts. However, he said officials had been hesitant in the past due to concerns about the ability of neighboring police agencies to communicate about such non-criminal violations.

“I plan to speak with our policymakers to make sure they’re aware of this new law and the implication that it has, and then we’ll decide at the staff and policymaker level on how we want to move forward with it,” he said.

Burgner declined to comment about whether he’s in favor of fullon marijuana decriminalization, but said it’s a topic where you cannot be “somewhere in between.”

“This particular topic is a topic where you’re either all in or you’re not,” he said. “Because trying to be somewhere in between, it makes it very challenging for law enforcement agencies to enforce.”

City weighs telecom tax hike

SANDWICH – A telecommunications tax rate increase for providers of both cellular and landline telephone service was discussed at the Aug. 15 Sandwich City Council meeting.

The deadline for submitting the rate increase request is Sept. 20, 2016.

The consensus of the council was that the amount should be increased from the present 3.75 percent to the maximum allowed, 6 percent, bringing in annual revenue of about $75,000.

Mayor Rick Olson said, with the state collecting lower income taxes for cities, that Sandwich needs to find other means of revenue.

The city attorney is to draft an ordinance for action by the council at a future meeting.

Alderman Dave Fraser said his brother, Joe, reported that Olde Timers Antique Center was swamped this past weekend during the Antique and Collectibles Show held at the Sandwich Fairgrounds. He said there were many new customers he’d never seen before.

Cited for speeding on Rt. 34 Plano police ticketed Kyle Butler, no age given, of the 300 block of East Church Street, Plano, after stopping his 2008 Acura for speeding on Route 34 at Waubonsee Drive

Minor injuries in rollover Two juveniles were injured in a rollover crash at Ashley Road and Plattville Road in Lisbon Township south of Yorkville on Aug. 22 at 8:34 p.m., according to the county sheriff’s office. Police described the juveniles’ injuries as minor and said they both refused transport to the hospital. Police said they determined the pickup truck the juveniles were riding in was being operated in a reckless

manner both on and off the road when the accident occurred. Police cited the juvenile driver of the pickup truck with driving in the wrong lane and reckless driving.

Vehicle damaged An estimated $100 in damage was done to the windshield of a vehicle parked at a business in the 10-20 block of Sherman Street in Fox Township, county sheriff’s deputies were notified on Aug. 22.

Motorcyclist injured in crash A Newark resident, Eric T. Boon, 48, of the 0-500 block of Rennesoy Drive was injured when he lost control of his motorcycle on Aug. 21 at 6 p.m. on Rennesoy Drive at Townhouse Road in Big Grove Township, according to the county sheriff’s office. Progress is Plano’s goal after tough-luck 2015

By KRISTIN SHARP ksharp@kendallcountynow.com The Plano soccer team may be coming off a five-win season, but that record was not indicative of the Reapers’ effort over 23 games.

With a solid group of returning seniors and a talented junior class returning to the field, Plano head coach Tom Dean is optimistic.

“We were a competitive losing team. There were really only two games where the other team took us apart, and in everything else we kept the score close,” said Dean, who enters his sixth year with the Plano soccer program. “We’re excited for the season.”

Forward Ivan Alanis and defender Will Benson will anchor the lineup in their senior seasons along with co-captain and center midfielder Alban Hoti.

Alanis had 19 goals last season and is chasing the all-time scoring record at Plano.

Julian Moreno, Augustin Garcia and Luis Alcantar will add depth to the midfield position while Eric Nunez will play center midfield.

“I always wanted four tournaments.

The Plano boys’ golf team traveled to nearby Edgebrook Golf Course for the Roger Keller Classic and took eighth place overall.

The event was scored using the Stableford System that awards points to golfers based on how well they play.

Niles Notre Dame defended its 2015 title with 120 points to finish ahead of Prairie Central (111) and Peotone (107).

Jake Nietfeldt of Peotone was the individual champion with 35 points.

The Reapers finished with 16 points, and Tim Malkosky led Plano with six points individually while Anthony Martinez had five points. JJ Dolan, Tyler Knispel and Kayvon Crenshaw also competed for the Reapers.

On Aug. 18, Plano shot a 233 in a triangular and lost to Lisle (174) and Peotone (168). Martinez led the Reapers with a 50 while Knispel, Malkosky

Plano is scheduled to host its first match of the season at Cedardell, with Coal City and Manteno coming to Plano for the Interstate Eight Conference triangular on Friday. Play continues on Aug. 30 with a triangular against Sandwich and Seneca at Edgebrook.

Girls Golf: The Plano girls’ golf team opened the season with a round of 223 at Cedardell Golf Course on Aug. 15 to win a quad meet over Somonauk (276), Westmont (301) and Seneca (307. Ashley Martinez was the medalist with a 47, while Lexi Clark (53), May Long (56) and Shannen Paxton (67) scored for the Reapers.

Plano improved to 4-0 in match play with a dual win over Westmont, 176221 in Westmont on Aug. 16. Martinez shot a 37 to earn medalist honors while Clark (44), Long (46) and Paxton (49) completed the team score.

With a talented group of underclassmen stepping into the varsity ranks this fall, there’s some competition to earn a spot in the Plano volleyball rotation.

Coach Lisa Esmond has three sophomores and a freshman vying for time on the court against seven returning seniors and three juniors to create a skilled and deep lineup for the Reapers.

“It’s a great group of girls,” Esmond said. “Seniors show great leadership and truly enjoy the game.”

Seniors Emily Schopp and Bradi Gann and sophomore Alyssa Dolan will be co-captains, with Schopp returning as middle hitter and Gann expected to play in a number of different roles in the front row.

Dolan will run out of the outside with junior Ali Cross while sophomore Lexi Tisberger will add depth in the middle.

Senior Eveline Chaidez returns as libero. Seniors Brittany Strause, Carina Herrara, Janeice Mosley and Gisselle Melendez, juniors Chloe Bird and Natalie Castenada and freshman Kaylee Read complete the roster.
