Putnam County man granted gun rights restoration by state Supreme Court
2020 Supreme Court ruling was key to Thursday’s decision JERRY NOWICKI - CAPITOL NEWS ILLINOIS In its latest round of opinions Thursday. Nov. 18, the Illinois Supreme Court restored a Putnam County man’s right to a Firearm Owners Identification card over the objections of the Illinois State Police. A 2020 ruling by the Illinois Supreme Court which declared gun rights to be civil rights was key to a Thursday decision that restored Putnam County man Thomas Brown’s right to a FOID card. Brown was a FOID cardholder for several years, most recently applying for and being granted renewal in 2013. But in 2016, he tried to purchase a gun at a federal firearm licensee, leading the Illinois State Police to conduct a background check. That unearthed a 2001 conviction in California on a “misdemeanor offense of inflicting
corporal injury on a spouse” that he did not disclose on his FOID application, according to a court filing. California law provides after a period of 10 years a person convicted of a misdemeanor can no longer be penalized for gun possession. Brown’s lawyers argued because Brown was eligible to own a gun in California after 10 years, that means he had his “civil rights restored,” satisfying a specific exemption in federal law that allows for his gun ownership. The court agreed, stating “California law does not apply to Brown in a vacuum,” and he does not have to show an “affirmative statement of restoration” from the state of California in order to show that he had his civil rights restored. The court dismissed ISP’s argument Brown should have sought a pardon from the California governor to receive an affirmative statement of restoration, stating Brown would have needed a pardon only if the firearm ownership prohibition was still in

The fact California does not consider gun ownership a civil right did not matter in this case, because, the court wrote, “this court unanimously concluded (in the 2020 Johnson case) that restoration of firearm rights under the FOID Card Act constitutes ‘civil rights restored’ for purposes of federal law” It was necessary for Brown to show he satisfied that exception in federal law, because the state’s FOID Act specifically states granting relief to a person who is appealing their denial cannot be done in violation of federal law. Outside of that question, the Supreme Court determined the Putnam County court did not abuse its discretion in determining Brown met all the other criteria to have his gun rights restored. The Supreme Court noted it had to rule only on whether the circuit court abused its discretion in determining whether Brown met the criteria, which

COVID-19 cases rise again in Bureau, Marshall counties
Health department: Vaccination clinics continue in Bureau, Putnam and Marshall counties COVID-19 cases again were on the rise in Bureau and Marshall counties within the three-county region of the Bureau, Putnam and Marshall County Health Department. From Nov. 8-14, there were 95 cases in Bureau County, up three from the previous week; 18 cases in Marshall County, up six; and five cases in Putnam County, down five. “As we approach the holidays, it is so important to protect those we love,” the Bureau, Putnam and Marshall County Health Department wrote in a Facebook message sharing the data. There were fewer than 10 deaths from complications related to COVID19 and four new hospital admissions from the coronavirus reported in Bureau County in the past seven days, according to the Centers for Disease Control and Prevention. There were
no hospital admissions for COVID-19 in Putnam or Marshall counties, the CDC said. There were 18,011 Bureau County residents fully vaccinated against COVID-19 as of Monday, which is 54.5% of the county’s population; there were 3,085 Putnam County residents fully vaccinated, which is 53.75% of the county’s population; and there were 6,184 Marshall County residents fully vaccinated, which is 53.62% of the county’s population. COVID-19 vaccination clinics continue in all three counties, according to the Bureau, Putnam and Marshall County Health Department. Clinics are scheduled at the Bureau County Health Department, 526 S. Bureau Valley Parkway, Princeton; Nov. 24 at the Putnam County Health Department, 220 E. Granville National Bank president, CEO Sheedy set to retire Gregory L. Sheedy, president and CEO of the Granville National Bank, is set to retire from his position at the end of the year, after 25 dedicated years. “It has been my pleasure to serve as the bank’s leader in the Sheridan community for the past 25 years,” Sheedy said. “I am honored to have shared the oversight of the bank’s growth.” In 1996, Sheedy was hired as president and CEO of Sheridan State Bank, which concurrently was acquired by Granville Bancshares, Inc. (holding company of The Granville National Bank) Sheridan State Bank merged with The Granville National Bank in 2016. Under Sheedy’s leadership of Sheridan State Bank and later, The Granville National Bank, assets doubled in size and achieved record earnings as he delivered sustained financial success and growth — all while staying true to the original mission of the bank. He leaves an indelible
imprint on the Granville National Bank for having provided strong leadership through its dynamic growth and profitability, the bank said in a press release. “Through his profound dedication, sincerity, and professionalism, Sheedy demonstrated the importance of strength of character, which has enabled the bank to have a history of strong financial performance through good times as well as the challenging times of the great recession of 2008 and the 2020 pandemic. While his daily presence and perspective will be missed, his outstanding leadership will remain a model for the bank to continue its long history of strong financial performance and service to our communities,” the bank said in its news release. Sheedy graduated with a bachelor’s of science degree from the University of Illinois and a masters of business administration from Lewis University. He also is a graduate of the Graduate School of Bank-
ing in Madison. He began his career at Federal Land Bank as a credit officer. He also worked for AO Smith Corp. as a credit manager covering North America. Later, he was the executive vice president and senior lending officer at The First National Bank. While working in Peru, he served with the Illinois Valley United Way for eight years as a board member and served as president of the United Way board. Sheedy also served as a founding member and board president for the Community Unit 2 Foundation for Education for six years. The Board of Directors has named Sara E. Biagini, currently executive vice president as successor CEO and president, effective in the New Year. An open house will be hosted during banking hours on Wednesday Nov. 24, at Sheridan Bank to celebrate Sheedy’s retirement. All friends, colleagues and members of the community may attend.

Putnam County Food Pantry prepares for Christmas Again this holiday season, the Putnam County Food Pantry, in collaboration with Toys in the Pantry, organizations, businesses, churches and schools from across the county, will be distributing Christmas baskets to local families in need. This is the 34th year the pantry has sponsored the basket project. The baskets contain food and gifts for the children and senior citizens. Included are items for a full Christmas dinner, breakfast and pizza for
Christmas Eve. The baskets will be distributed on Saturday, Dec. 18. To support the Basket Project, cash and food donations continue to be needed. Products such as coffee, hot chocolate, drinks, Jell-O, canned fruit, easy-to-prepare meals, and personal care items will be especially appreciated. A cash donation of $75 will support the cost of food for one average-size family. Donations may be sent to the Putnam County
Food Pantry, Box 96, Granville, or deposited directly at the Granville National Bank. Food may be left at any of the county banks or at the Food Pantry. Over the years, the Putnam County community has been tremendously supportive of the on-going work of the food pantry and the Christmas Basket Project. The pantry board sends its thanks and wishes for a happy holiday and a new year of peace to the people of Putnam County.

More than 500 deer harvested in La Salle, Bureau counties during archery season More than 47,000 deer have been hunted by archers in Illinois through Sunday, according to the Illinois Department of Natural Resources. The preliminary totals are down about 4,000 from the same period in 2020 when 51,742 deer were hunted by archers. Archery deer harvests for the same period (Oct. 1 through Nov. 14) in 2018 were 45,416 and in 2019 was 45,962. In La Salle County, 538 deer were hunted by archers; 530 deer were hunted by archers in Bureau County; 303 deer were hunted by archers in
Marshall County; 224 deer were hunted by archers in Putnam County; 186 deer were hunted by archers in Livingston County. Only Putnam County’s numbers are up from 2020. The others counties are down from the previous year: La Salle County had 644 deer hunted by archers at this time last year; Bureau County 603; Marshall County 331; and Livingston County 205. The top five counties through Nov. 14 of this year were Pike (1,635), Jefferson (1,224), Fulton (1,156), Adams (1,066) and Macoupin (920).

also state an applicant must not be dangerous and granting them a FOID card cannot be against the public interest. “Again, our sole task is to determine whether the trial court’s decision was arbitrary, fanciful, or one that no reasonable person would make,” the court wrote. “Not only was the trial court’s decision not arbitrary, fanciful, or one that no reasonable person would make, it was well supported by the evidence.” ISP had argued that granting Brown a FOID card would be against the public interest, citing his 2001 arrest, a 2005 DUI conviction in Bureau County, a 2005 arrest for battery in La Salle County that did not lead to criminal
charges, and a 1997 conviction for misdemeanor assault that occurred when he was a minor. But the Supreme Court determined none of those cases indicated he would be a danger, particularly in light of a letter from Brown’s ex-wife, the victim of the 2001 incident, which indicated “that no weapon was involved in the incident, she was not injured, nor did she believe that Brown intended to injure her.” The fact Brown omitted the 2001 conviction from his 2013 FOID application could be overlooked as well, according to the court, because he was “under the impression that the charge in California was disposed of with court supervision and that, if he completed his sentence without incident, that was the last he would hear of the matter.”

He loved to visit with everyone and wanted to know everything about them. He loved having grandkids and great-grandkids around his home at all hours of the day and night. Bill graduated from Hopkins High School the class of 1954. He served in the United States Army from 1955 – 1957. He worked at Henry Chevy Garage and helped Deno Orlandi pump gas when he was in high school. Bill was
an electrician and started working at Mascal Electric in DeKalb. In 1966 he went to work for Tri Town Electric until retirement. He was a member of the electrician’s Union (IBEW) #176 for 42 years. State Rep. Lance Yednock, D-Ottawa, said the application period is open for the Illinois Conservation Foundation 2022 Conservation Achievement Scholarship program. “The ICF Conservation Achievement Scholarship gives high school seniors the opportunity for muchneeded financial aid going into studies focused on protecting our natural resources,” Yednock said in a news release. “Illinois has always been a super power for agriculture and other natural resource focused industries and this scholarship program provides a means for that to continue.” Yednock is encouraging high school seniors to apply for the program, which will reward four scholarships of $2,000 available for the current school year. The ICF annually awards scholarships to outstanding high school seniors in Illinois who demonstrate effective, voluntary, long-term dedication to the preservation, protection or enhancement of the state’s natural resources. The ICF Conservation Achievement Scholarships have been awarded
since 2005. Applicants must be an Illinois resident and a senior in an Illinois high school. Applications must be received by the ICF by March 1. SHAW MEDIA Students attending Illinois Valley Community College in the spring semester could receive payments made possible from the Higher Education Emergency Relief Fund, board members learned Thursday. Students enrolled in 12 or more credit hours will receive $1,000. Those taking six to 11 hours will receive $500. Payments will be made to students enrolled as of April 7. In addition, high school students enrolled in IVCC dual credit/dual enrollment courses in the spring will have all tuition and the registration fee waived. Students who complete a Career and Technical Education dual credit course will qualify for a tuition waiver for three credit hours in the summer or next fall. With the exception of IVCC employees and high school students, any student who enrolls in the spring will receive a $100 IVCC bookstore gift card to use on books and supplies. “We recognize the importance of supporting students throughout the pandemic and are committed to helping them achieve their academic and career goals,” Vice President for Student Services Mark Grzybowski said. In other action, trustees approved protection, health and safety projects totaling more than $2.7 million including: • Energy upgrades and piping repairs in Building C boiler room for $206,195 • Repairs to parking lot 1 for $53,130 • Removal and resurfacing of parking lot 5 for $718,200 • Complete renovation of the band room (D201) for $1.7 million to include elevator replacement, asbestos abatement and replacement of walls, ceilings, lighting and the raised floor. Baseball and men’s and women’s soccer will move to Division II; men’s and women’s tennis moves to Division I. Women’s and men’s cross country will compete in Division II when those programs begin in fall 2022. The license strengthens IVCC’s program and likely will allow it to grow and process industrial hemp. Twenty-three students are enrolled in the college’s Introduction to cannabis production this fall. The course is part of the Basic Cannabis Production certificate program. An Advanced Cannabis Production certificate begins in January.
