Yes, they’ll still bust you for pot Violators think the cops have quit enforcement, but they haven’t

Note to readers — This is an article on what people should know ahead of the legalization of recreational cannabis taking effect Jan. 1.

If the weekend weather is clear and the parking lot is full, Phil Wire will inevitably catch a whiff of marijuana somewhere on the trails at Starved Rock State Park.

Wire is a sergeant with Illinois Conservation Police, and marijuana at the parks is a problem that has long tested his patience, not least because falls happen even when visitors aren’t impaired.

It’s only gotten worse since marijuana was decriminalized and since the Legislature legalized recreational marijuana starting Jan. 1.

Wire and his staff still issue tickets to those they catch in the act, however. Pot remains completely illegal until the end of the year, and even after Jan. 1, you still can’t light up at the parks — or anywhere in the open, for that matter.

“Not only can’t you smoke it in public, but those under 21 cannot possess it at all,” Wire said. “We still will be enforcing those laws.”

Discreet users could be forgiven for thinking marijuana has become

quasi-legal. Pot was decriminalized three years ago statewide, and Gov. J.B. Pritzker signed recreational marijuana into law this past June.

But full legalization doesn’t begin until Jan. 1, and police are still writing tickets to educate violators on how the still-unfolding law is going to work. Get ticketed for smoking a joint and you’re likely to get a reminder marijuana won’t be 100 percent legal even after Jan. 1: Under the new law, you can’t smoke it out in the open, inside public places such as grocery stores or in your car.

Behind the numbers A passing glance at the crime statistics would lead to the mistaken belief police have thrown up their hands and quit enforcing cannabis laws. They haven’t. In LaSalle County, for example, misdemeanor pot arrests have fallen sharply — from 19 arrests in 2016 to just five this year — but what once carried jail time is now an ordinance violation carrying only a fine, and those offenses have ballooned by 71 percent over the same three-year span as misdemeanors fell off.

In other words, cops aren’t seizing less marijuana — they’re simply filing the offenses under a different

heading at the courthouse.

The same trend is taking place in Bureau and Putnam counties.

Bureau County State’s Attorney Geno Caffarini said misdemeanor pot arrests, too, have fallen off a cliff and that pot seizures now result in civil offenses that don’t even cross his desk.

Putnam County Sheriff Kevin Doyle said he’s had zero misdemeanor pot arrests since the fall of 2017, all replaced by ordinance violations that recently cracked double-digits.

“We still enforce,” Doyle said.

“We’re not throwing out the law, if that’s what the public is thinking. It is still illegal.”

Not the new alcohol Getting users to awaken to the limits that will be in place come Jan. 1 has been difficult. Most of those caught violating cannabis laws think pot is no more regulated or restricted than alcohol, and that’s an oversimplification.

“I think there are misconceptions,” Doyle said. “They think they can have this anywhere they want. It’s still not going to be legal to be under the influence at work or behind the wheel.”

As Peru Police Chief Doug Bernabei explained it, authorities do not yet have a court-accepted testing method for showing impairment at the time of a traffic stop. That means police will continue relying on laboratory analysis to show impairment, and a lab test will come back positive for residual use.

“Often times we won’t know if the person used cannabis minutes ago or days ago,” Bernabei said. “That

a situation where the confusion and challenges law enforcement face about the new law will cause reasonable, yet ultimately false conclusions.

“I am really concer ned about innocent people being charged with a serious driving offense when it may be months and months later before test results come back exonerating them. That is not good.”

Users probably don’t know these things because they’re having less contact with defense lawyers these days. Ottawa defense attorney Joe Navarro would gladly brief his clients on how the law is changing, but those nabbed for low-level cannabis offenses simply aren’t coming in.

“It’s a civil offense now, so they just go into the courthouse and pay it,” Navarro said. “How long has it been since I defended one? It’s got to be a few years.”

Doyle acknowledged even authorities are having difficulty keeping up with the changes as Jan. 1 looms. He was surprised to learn recently one consequence of legalized cannabis reported in Colorado is higher auto insurance. Cannabis has led to so many accidents that a 22-year-old woman will, on average, pay $85 more in auto insurance than a 22-year-old woman in Illinois.

“The general public doesn’t have all the facts on this, or they bury their heads in the sand,” Doyle said.

Gonzalez played on the volleyball team and is practicing for a role in the fall play. She looks forward to joining the wrestling team, and maybe the track team this spring.

One of her favorite memories made so far during her stay was going to the Sadie Hawkins Dance with friends.

Her message to students who are considering an exchange program

is to “just do it.”

“It may seem super scary, but it’s worth it. Maybe it’s hard like you’re missing everything, but in the end, it’s so worth it,” she said. “It’s one year. It’s not so long. When you think about it, it’s already gone.”

Gonzalez was placed at Putnam County High School through International Cultural Exchange Services, which is an accredited cultural exchange agency.

Putnam County native Andrea Crew is a placement coordinator and field manager for the organization. She said she is always looking for host families for the program.

“Being a host family is like traveling without leaving home,” she said. “To bring a student with another culture, language and world perspective into your home, it not only gives them an American experience but allows you to experience their traditions and values they bring from their home countries and their families.”

ENNEPIN — Putnam County High School is hosting an exchange student from Madrid, Spain, this school year.

Sofia Luna Gonzalez, who goes

by Luna, chose to spend her junior year in America to get firsthand experience about the culture and the English language.

Before arriving here in August, Gonzalez had never been to the U.S., and at 16 years old, she admits the decision to leave home for the school year was a “scary one.”

But once she learned just how welcoming Putnam County was, it really put her at ease, and she’s been enjoying her stay.

Gonzalez’ biggest adjustments have been the food and moving to a much smaller community.

She said in Spain, much of their food is homemade.

“We cook a lot,” she said.

While there are plenty of fast-food options where she lives in Spain, it’s very rare they eat out compared to how often they do in America.

Also, when Gonzalez learned she would be staying with the Erik and Alexis Cwikla family in the small town of Hennepin (population 757), she was shocked at just how small it was. “I said, ‘That’s like country.

Like real country,’” she said with a laugh.

“In Putnam County, everything is spread out and the towns are small.

Also, there’s no public transport.

You need a car, but students can’t drive, so it’s super hard.”

But it seems small-town life has grown on her. She’s come to love the small towns and says “they’re super cute.” The insects, however, are not something she’s gotten used to.

Gonzalez has taken interest in her classes at Putnam County High School. She especially enjoys sociology, foods and journalism, which are extracurricular courses no stu-

Nov. 1 was the official retirement date of Hennepin Power Plant, according to Vistra Energy, which has operated the facility. Employees are currently wrapping up some of the final activities now that the plant has ceased operation. After that, a small number of employees will remain onsite to perform decommissioning activities for the plant. Initial decommissioning tasks are to close the plant safely, ensure environmental and regulatory rules are met, and inventory equipment to determine what to keep or sell to third parties. The Hennepin Power Plant was one of four coal plants Vistra Energy announced would be closed in Illinois.

RONALD ZELLMER to his immediate family and frequently enjoyed the company of his mother and father. The unconditional love for his mother, father, grandmother and grandfather goes without saying.

He was a charismatic person who could make anyone laugh or would roast them until they cried. Jacob marched to the beat of his own drum and regardless of his bold personality and sometimes controversial opinions, he was loved and cherished by many.

Jacob is survived by his wife, Jessie, and daughter, Ila, of Granville; his parents, Barb and Jon Bouxsein of Hennepin; one brother, Nicholas Bouxsein based at Marine Corps Base Hawaii; and one sister, Nicole Bouxsein of Hennepin.

He was preceded in death by his maternal grandparents, Robert and Mardell Keeney Sr.; and one uncle, Jeff Bouxsein.

Services were held Monday, Nov. 11, at the Dysart-Cofoid Funeral Chapel in Granville. Burial was in the Granville Cemetery in Granville.

Visitation was held Sunday, Nov. 10, at the funeral home.

Contributions may be directed to a trust fund that has been set up for Ila’s education at North Central Bank.

PEORIA, Ariz. — Ronald Ray Zellmer, 72, of Peoria, Ariz., formerly of Illinois and California, died Sunday, Oct. 27, 2019, at home.

Ron was born Feb. 13, 1947, in Spring Valley, the son of Walter and Elaine (Gillette) Zellmer.

He was raised in Granville, and graduated from Putnam County High School. He entered the U.S. Army in 1965 and was honorably discharged in 1968.

On Sept. 30, 1967, Ron was united in marriage to Joyce Ann Panier at the First Lutheran Church in Granville. The couple lived many places and made many friends. They retired to Peoria, Ariz., in 2008.

Ron enjoyed spending time with his wife, family and friends, and playing cards, fishing and golfing.

Ron is survived by his wife, Joyce of Peoria, Ariz.; his daughter, Krista (Mark) Platte of Waverly, Iowa; his son, Eric (Leigh) Zellmer of Trabuco Canyon, Calif.; his grandchildren, Nathan and Kelsey Platte of Waverly, Iowa, and Easton Zellmer of Trabuco Canyon, Calif.

He was preceded in death by his parents and brother, Kenton.

Burial will be in the National Veterans Cemetery in Phoenix on Friday, Nov. 29. A Celebration of Life will be held at Peace Lutheran Church in Peoria, Ariz., on Saturday, Nov. 30.

GRANVILLE — Jacob Ira Bouxsein, 29, of Granville died of natural causes on Wednesday, Nov. 6, 2019, at Soggy Bottoms Duck Club. At the time of his death, Jacob was doing what he loved, duck hunting with his friends and father.

Jacob was born Dec. 1, 1989, in Peru to Jon and Barb (Keeney) Bouxsein. He married Jessie Hodgson on Oct. 3, 2015, at Lake Thunderbird.

He graduated from Putnam County High School in 2008 and attended Illinois Valley Community College. Jacob was employed as a commercial fisherman and part-time maintenance worker at Lake Holiday. Jacob was also a stay-at-home dad.

He was a duck slave at Soggy Bottoms Duck Club, where he enjoyed spending his time. Jacob enjoyed numerous outdoor activities, especially waterfowl hunting and netting carp with his father. He was a gun enthusiast and a proud member of MAGA country.

He was a devoted father. He adored his daughter, Ila, who had him wrapped around her little finger. Jacob was a loving husband to his wife and spoiled her with three meals a day to her liking.

Jacob made sure to make an impact in his brother’s and sister’s lives by continuously loving and harassing them. He was committed

PUTNAM COUNTY DEATH INVESTIGATOR

ROSEMARY ‘BAMI’ BIAGI HENRY — Rosemary F. “Bami” Biagi, 95, of Henry, formerly of Hennepin, passed away Tuesday, Nov. 5, 2019, at St. Margaret’s Hospital in Spring Valley.

She was born Sept. 11, 1924, in Peru to Casmir and Hattie (Pilarek) Hybki. She married Frank Biagi on Sept. 30, 1950, in St. Valentine’s Church in Peru.

She graduated from LaSalle-Peru High School and upon graduation attended sewing school in Peru. She had worked at Westclox, where she met Frank.

She had also been the chef at J&L Steel Mill in Hennepin.

Her children, grandchildren and great-grandchildren enjoyed her yodeling. She loved her music, and had a great faith and loved her church.

She enjoyed watching the river and all of the wildlife in and around the river.

Her favorite quote was “Don’t forget my face, I’ve got my eye on you.” She ended her phone call to her grandchildren every night with “red button good night.” Also, her family knew her

love for “Honeybuns.”

She is survived by two daughters, Rosalie (William) Calbow of Henry and Christine (Thomas) Biagi-Roscoe of Oglesby; two granddaughters, Carolynn (James) Harper and Aimee (Anthony) Shinall; four great-grandchildren, Zachary Howell, Nicholas Howell, Allison Harper and Jackson Shinall; one brother, Leonard Hybki of Peru; and one sister, Frances Ziegler of Henry.

She was preceded in death by her husband, Frank Biagi; and two brothers and one sister.

Funeral services were held Saturday, Nov. 9, at St. Patrick’s Church in Hennepin with Father Patrick DeMeulemeester and the Rev. Gregory Jarzombek officiating.

Burial was in Sacred Heart Cemetery in Granville.

Visitation was held Friday, Nov. 8, at the Helmer-Shields Funeral Home in Granville, where a rosary was also recited. Additional visitation was held Saturday at the church.

Memorials may be directed to the family.

IN BRIEF CDC gives full recognition to IVCH Diabetes Prevention Program PERU — A diabetes prevention program that helps Illinois Valley residents who have prediabetes deal more effectively with the disease has received full recognition from the federal Centers for Disease Control and Prevention (CDC).

Deb Redd, coordinator of the Diabetes Center for Excellence at Illinois Valley Community Hospital (IVCH), said notification the center had achieved full recognition status came in a letter from Ann Albright, director of the CDC’s division of diabetes translation.

Preliminary autopsy results indicated he suffered a heart attack and died at the scene. Cofoid said his office is awaiting final autopsy results and toxicology is pending, which may take four to six weeks.

IVCC welding class takes pride in doing its part to honor fallen soldiers

BY DEREK BARICHELLO Shaw Media OGLESBY — When a volunteer approached Illinois Valley Community College instructor Tony Sondgeroth about his class creating a steel sculpture for the Surround of Honor in Illini State Park, Sondgeroth said “there was no way I could tell him no.”

“We were going to find a way to do this,” Sondgeroth said.

His students felt the same way, seeing it as an opportunity to create a real-world project.

“You have to use your head,” said Thomas Laible, of Henry, of the experience. “It’s not just reading off paper, or a worksheet.”

The roughly 700-pound rust steel sculpture of a soldier kneeling toward the boots and gun of a fallen soldier has become a part of the Marseilles memorial paying tribute

to all of Illinois’ fallen soldiers from Middle East conflicts.

It was dedicated Friday, just three days head of this year’s Veterans Day. Sondgeroth announced he had an extra project if any students wanted to help.

Rebecca Reed of LaSalle was one of the volunteers, because “the fun part of welding is doing this kind of stuff.” Reed participated in the creation of the Heritage Park Vintage Wall Mural in Streator, and remembered the payoff.

“It’s a great feeling,” said Reed, a St. Bede graduate. “After this is built, it will be here for a long time.”

Reed took the lead in improving the design. She wants to go into production welding for a career, but in between classes, she makes welding sculptures, using her artistic talents to make welding more fun.

Sondgeroth sought out Laible to be another volunteer.

“He said he needed my knowledge of the PlasmaCam table, my eye for design,” Laible said.

The computer-controlled PlasmaCam table uses a plasma torch to cut and reproduce designs. Creating the soldier sculpture was Laible’s first “big project.”

Working for the last couple of weeks, Laible edited the design program, made the first cutout, then made the actual sculpture about 30 percent bigger.

“It’s awesome; I didn’t think much about it at first,” Laible said.

“I thought it would be another project with the PlasmaCam, but I’m really excited knowing this is going up as a tribute, a thank you to everyone, the soldiers who gave their life.

“This will be standing for the next 60 years. It’ll be there for a while, and knowing that feels pretty great, actually.”

Sondgeroth said several students from his class took time before or after class to help with the design.

“After a while, it became an entire welding department project,” he said.

“I think we all firmly believed in what we were creating.”

The Surround of Honor where the sculpture was placed consists of steel panels that hold engraved bricks with the name, branch and

hometown for each fallen soldier.

The memorial is an addition to the Illinois Fallen Soldier Tree Memorial that was completed in October 2009. At that time, 250 oak trees were planted on a 2.5-acre meadowland site, along with a 7-ton granite stone with a bronze plaque.

The experience of creating something that will be used in the real world, Sondgeroth said, can’t be duplicated.

“They get a much deeper appreciation for what they’re creating.”

SPRINGFIELD — In light of the recent health issues related to electronic cigarettes, state Sen. Sue Rezin (R-Morris) has filed legislation aimed at reducing underage individuals’ access to vapor products.

Senate Bill 2288 prohibits the sale of tobacco products, electronic cigarettes and alternative nicotine products within 100 feet of a school.

Retailers who violate this provision would be subject to penalties.

“The alarming trend of teenagers

using vapor products should scare any parent wanting to ensure the safety of their children,” Rezin said.

“While this bill alone won’t end this epidemic, the goal is to make it more difficult for children to get their hands on these products, reducing the likelihood of them getting hooked.”

In a 2019 study, 27.5 percent of high school students reported using an e-cigarette within the past 30 days, which Rezin said demands the attention of public officials.

“A quarter of our young people have self-reported that they are using a product that has unknown long-term health effects and is not only available for them to consume, but is also highly addictive,” Rezin said. “My legislation puts vapor and other tobacco products directly in line with the radius set for alcohol sales.”

Rezin is also working on additional legislation to combat this health crisis and is considering the following: • Placing stricter controls on

how these products can be marketed to young people, marketed near schools, or marketed as being healthy.

• Addressing the ongoing problem of so-called “strawman” sales.

• Requiring all retailers to display a notice that warns consumers that vaping unregulated THC is proven to be dangerous to their health.

• Requiring that all e-cigarettes be sold only from behind the counter, or displayed in an age-restricted area.

IXON — Dave Hellmich is ingrained in the Sauk Valley, from cycling across its country roads to filling a seat at community tables as an advocate for the community college that’s shaped generations.

Hellmich came to Sauk Valley Community College as its president in 2015; he has worked more than three decades in higher education, including serving as an administrator and English professor at community colleges in Florida, Minnesota and Kentucky.

Points of pride during his time at the college include the resurrection of the agriculture program, the multicraft extended internship program, and the Promise Impact Program, as well as the Sauk Valley Community Leadership Program.

The Promise Impact Program is in its early stages and would allow qualifying high school students to earn tuition and fees for up to three years in a career or transfer program at Sauk if they meet certain requirements, including 100 hours of community service.

“I believe it will be the most important thing to launch in the Sauk Valley since the college,” Hellmich said of the program, adding that school officials think it will increase enrollment by 20 percent.

The agriculture program came back to Sauk in fall 2017 after being absent for about two decades. It features agribusiness and career technical tracks as well as test plots on campus for hands-on learning.

The extended internship program is a partnership with area industries and allows students to get paid work experience while earning a two-year associate’s degree in the Multicraft Technology Program, which includes fields of electronics, electrical, welding and HVAC. Lori Cortez, dean of institutional advancement at Sauk, said Hellmich, who’s a first-generation college graduate, is a student advocate who believes everyone deserves an education.

“He truly does believe he’s here to serve everyone in our community,” Cortez said. “He always makes sure people feel welcome here.”

Hellmich joined the college during the state budget crisis, and as colleges and universities were making layoffs and shuttering programs, Hellmich went on a listening tour in the community, found that agriculture education was in high demand,

and worked to get it off the ground despite obstacles, Cortez said.

“Under his leadership, we’ve been able to implement new programs, policies and procedures that are responsive to community needs,” she said.

He also pushed for the college to fund Project Vital, an adult literacy and English as a Second Language, a program that’s usually funded by the state. Many colleges closed down those programs during the budget impasse, but Hellmich saw the importance of the program, which serves more than 200 people a year, Cortez said.

The college is integral in growing the community as a place to work, raise a family and stay, Hellmich said.

“I think the college is the linchpin in the Sauk Valley becoming a destination,” he said. “Lots of folks want the quality of life that the Sauk Valley can provide.”

He also values open discussions in collaborations, to grow a smart invested team working hard to critically analyze situations and make informed decisions.

Hellmich, 60, is the president-elect of the Dixon Chamber of Commerce and Main Street board, serves on boards for KSB Hospital

Hometown: Greensburg, Ind. Alma mater: Bachelor of Arts in English from DePauw University in Greencastle, Ind.; Master of Arts in American Literature from Indiana University; and Ph.D. in Higher Education Administration from the University of Florida.

Hobbies: Cycling 4,000 miles a year, spending time with his wife, Linda. and its foundation, is a member of the #DixonStrong Leadership team, is chairman of the Sauk Valley Community Leadership Program and a board member of the Sterling Rotary Club.

“It’s important for the image of the college, and it contributes to the expansion and contemplation of ideas,” he said.

His staff also serve roles on boards for a variety of groups and organizations, to promote widespread community involvement.

“He’s heavily invested in the community, and he encourages all of us to be connected,” Cortez said.

He’s also part of the Shaw Media Illinois Corporate Advisory Board, a collective of leaders from throughout the Shaw Media footprint, which includes the Bureau County Republican.

Hellmich, who started as a paper boy when he was 8, is a strong advocate for the importance of newspapers, as they serve as the “critical conscience of democracy.”

“The rights of the free press have

been critical in this country’s history, and it’s critical now,” he said.

He’s concerned about the growing partisanship divide in the country and the danger of fake news, making it more important than ever to have a free, vibrant press digging into the truth.

He earned his Bachelor of Arts in English from DePauw University in Greencastle, Ind., his Master of Arts in American Literature from Indiana University, and his Ph.D. in Higher Education Administration from the University of Florida.

His wife, Linda, is a clinical psychologist at KSB Hospital in Dixon.

They have three daughters and two granddaughters, with another on the way.

Hellmich cycles 4,000 miles a year, favoring the scenery of the rolling hills north of Dixon as well as rides toward the bison of Nachusa Grasslands. Off the bike, he enjoys area events and attractions such as the Grand Detour Arts Festival, the Dixon riverfront and Rock Falls sculpture walk, and the Northwest Territory Historic Center.

He grew up in a small Indiana town with similar industry as the Sauk Valley heavy in agriculture and manufacturing. He’s the fourth of 11 children, and his parents always taught them to treat others with respect.

“Coming here was like coming home,” he said. “It’s a close-knit community with Midwestern, small-town values where we feel accepted.”

Area food pantries will benefit from library fines Food for Fines will run Nov. 11-23 For 10 years, local food pantries have gained when library patrons “pay” their fines with food donations during Food for Fines.

Since 2016, library patrons have donated nearly 3,000 items during the two-week Food for Fines event,

the overdue fine equivalent of $2,791. The collected food helps restock pantry shelves in November and December.

From Monday, Nov. 11, through Saturday, Nov. 23, patrons can erase their library fines with food donations as payment, each donated item wiping out $1 in fines.

Don’t have any overdue fines?

Donations will be accepted at participating libraries and then delivered to the food pantry.

FYI One of the participating libraries is the Putnam County Public Library District; Jay Kalman, director, 815-925-7020.

Because of food safety, the food must be in its original packaging; damaged packages, expired food or glass containers are not accepted.

Suggested food items include canned fruits and ve getables, soups, cereals, pasta mixes and

canned meats.

Bring food items to the circulation desks, not in book drops. Donated food is not accepted for lost or damaged books, replacement of cards or interlibrary loan fees.

Participating libraries are Peru, LaSalle, Richard A. Mautino, Putnam County, Graves-Hume, Prince­ ton, Oglesby and Jacobs Library.

This is the 10th year area libraries have cooperated to benefit area food pantries through fine forgiveness.
