LETTER TO THE EDITOR Dani Brzozowski is the change the IL-16 deserves To the Editor, I’ve been a resident of Illinois 16th District since 2013; I’ve never known the 16th with a representative other than Adam Kinzinger. In fact, Kinzinger is among the most senior members in the House of Representatives.

How come, then, Kinzinger keeps letting his district down?

Given that Rep. Kinzinger so rarely holds town hall meetings, I don’t believe he is in any way in touch with our district and our needs. A lot has changed in the past several months, yet “Absent Adam” remains as elusive as ever. A quick glance at his Facebook page shows how out of touch he is, and I no longer feel comfortable with Kinzinger representing myself, my family and my district in Washington D.C. Fortunately for us, we will have another option this November: Dani Brzozowski.

Brzozowski is committed to accessibility and wants to listen and learn from her constituents so she can best serve us.

Brzozowski has held many virtual town halls, even in the middle of the pandemic and has offered her cell phone number to attendees so they can call her personally to discuss important issues.

If elected, Dani is determined to keep her residency in LaSalle County so she doesn’t lose touch with the district she serves.

Dani Brzozowski is exactly the change that IL-16 deserves.

Rep. Kinzinger has been in Congress for almost a decade and has little to show for his time in Washington. Brzozowski is committed to putting in the work from day one. I look forward to voting for Dani Brzozowski this November and I hope you cast your ballots for Dani and join me.

IVCC opens new Agriculture Program Facility

‘It keeps getting better and better’

BY KEVIN CHLUM kchlum@shawmedia.com OGLESBY — Four years ago, the IVCC agriculture program restarted with just nine students and two courses.

Now in its fifth school year, the program features 37 students, 19 classes and two associate of applied science degrees.

The evolution of the program took another step forward Sept.

24 with the virtual grand opening of the IVCC Agriculture Program Facility — built in an old dairy barn — on the south end of the campus.

“Our goal was to stay connected to the antiquated dairy barn with a new facility that carries on the tradition of farming, but in a new era with state-of-the-art equipment and new technology,” IVCC president Jerry Corcoran said. “I’m proud of the fact that we never lose sight of the need to modernize our campus so facilities match the faculty and staff when it comes to providing first-class teaching and learning environment for our students. This facility meets that objective.”

Willard Mott, one of the agriculture program’s coordinators, called the new facility “remarkable,” highlighted some of the accomplishments of the program

to date and discussed the benefits of the new facility and the 153-acre campus farm.

On Tuesday, IVCC students helped level a vertical tillage tool and tilled more than 50 acres of corn stalks. The program also is working with the University of Illinois extension to plant a cover crop demonstration and conduct research on local agriculture issues.

“The new agriculture center will be a hub for hands-on learning experiences for students — everything from routine maintenance and set up of equipment to conducting field research and demonstrations on the farm,” Mott said. “The center provides the space needed to house equipment while students prepare it for field operation, collect data and learn more about its state of the art operation. It provides opportunities that would be hard to find anywhere else.”

LaMoille High School graduate Luke Lovgren, in his third semester with the IVCC agriculture program, said the new facility shows IVCC’s commitment to the program.

“It keeps getting better and better,” Lovgren said about the program. “The enthusiasm and energy in the program grows each day.

I’m happy to be here at a time when so many people are working on projects like this new maintenance shed that show the college is investing in a positive future for

students.”

State Sen. Sue Rezin and state Rep. Lance Yednock both praised the IVCC agriculture program and the new facility.

Rezin called agriculture the “cornerstone of the Illinois economy.”

“You saw a need, and you responded,” Rezin said about the program. “It’s been four years, and look where you are now.”

Yednock called the IVCC program “the gold standard of community college agriculture programs statewide” and said the program will develop the kind of employees that agriculture businesses need.

“They want quality workers who understand the industry, and that’s what they’ll be doing at this institution, forming the next generation of farms and agri-business

leaders,” Yednock said.

The next phase of the project is a building for a classrooms, labs and faculty offices.

“I want to reassert the board’s commitment to the Agriculture program and the tremendous promise it demonstrates,” IVCC board chair Jane Goetz said. “Willard [Mott], [co-coordinator] Kathryn [Seebruck] and Dean Ron Groleau have developed a solid curriculum to prepare our students for university transfer and immediate employment in one of the district’s 7,000-plus agriculture-related jobs. The board will continue to provide the resources needed to recruit, educate and graduate industry-ready students. We stand with you and believe in your ability to develop a flagship program.”

Medicare open enrollment is right around the corner starting Oct. 15 and going through Dec. 7.

Each year, Medicare beneficiaries should review available Part D plans to ensure they have the best plan for their needs. Through SHIP (Senior Health Insurance Program) funding, the Putnam County Community Center has trained Medicare counselors who can provide unbiased help as well as enrollment assistance.

In addition to Part D plans, counselors can help you explore other parts of Medicare such as Extra Help and Medicare Savings programs to help with the cost of Medicare. During 2019 open enrollment, PCCC SHIP counselors helped clients save over $29,000.

Medicare assistance is available Monday through Friday, by appointment only; call 815-339-2711 or 800757-4579 to schedule.

For those new to Medicare Part D, the PCCC will host “Your Guide to Medicare Part D” on Monday, Oct. 5, at 5:30 p.m. Call ahead if you plan to attend the program.

PCCC Community Outreach staff member Janice Holst has recently started making monthly visits to different locations in the county again following a four-month hiatus due to COVID-19.

The next community outreach event is scheduled for 9:30 to 11:30 a.m. Oct. 22 at the Lake Thunderbird Clubhouse. Call ahead if you plan to attend.

The PCCC is following all necessary guidelines for the safety of its staff and participants.

Putnam County gets COVID-19 warning Putnam County is among the 17 counties around the state currently listed at the COVID-19 warning level.

A county enters a warning level when two or more risk indicators that measure the amount of COVID-19 increase.

As of Sunday, Sept. 27, Putnam County had 59 confirmed cases since the start of the pandemic.

Since March, 1,172 residents have been tested.

Zip codes with more than six cases: • Granville, 30 cases out of 338 tests.

• Hennepin, nine cases out of 293 tests.

There have no COVID-related deaths reported in Putnam County.

Although the reasons for counties reaching a

warning level varies, some of the common factors for an increase in cases and outbreaks are associated with large gatherings and events, bars and clubs, weddings and funerals, long-term care facilities, correctional centers, schools and cases among the community at large.

Public health officials are observing people not social distancing, gathering in large groups and not using face coverings. Some communities lack access to convenient testing before people become symptomatic. In some counties, local law enforcement and states’ attorneys are not enforcing important mitigation measures like social distancing and the wearing of face coverings.

Additionally, some people refuse to participate

in contact tracing and are not providing information on close contacts or answering the phone.

The following metrics are what trigger a warning: • New cases per 100,000 people; If there are more than 50 new cases per 100,000 people in the county.

• Number of deaths; When the weekly number of deaths increases more than 20% for two consecutive weeks.

• Weekly test positivity; The seven-day test positivity rate rises above 8%.

• ICU availability; If there are fewer than 20% of intensive care units available in the region.

GriefShare support group will start new session Oct. 6 PRINCETON — GriefShare, a support group for those who have lost a spouse, child, family member or friend, will be starting a new meeting session from 6 to 8 p.m. beginning Tuesday, Oct. 6, at the Evangelical Covenant Church, 24 N. Main St. in Princeton. Meetings will be every Tuesday evening through Jan. 5.

There will be a special holiday session, “Surviving the Holidays,” that will be held on Dec. 15.

GriefShare is a 13-week video seminar series that features some of the nation’s foremost Christian experts on grief and recovery topics as seen from a biblical perspective. Each GriefShare session has three distinct elements — video seminar with experts, support group discussion with focus, and personal study and reflection. Born: February 26, 1948; LaSalle Died: September 23, 2020; Rockford GRANVILLE — Joseph Benedict Borostowski, 72, of Granville, passed away with his family by his side on September 23, 2020, in OSF St. Anthony Medical Center in Rockford.

A Celebration of Life was held from 2 to 7 p.m. Saturday in the Hurst Funeral Home in LaSalle, with full military services conducted at 2 p.m. by the LaSalle/Oglesby Veterans Memorial Group.

Joe was born in LaSalle on February 26, 1948, to Benedict and Dorothy (Buczkowski) Borostowski. He married Dollie Gisler on November 29, 1969, in St. Hyacinth’s Church in LaSalle.

He served with the United States Air Force during Vietnam from 1968 until 1971. Joe graduated from St. Hyacinth’s School and then St. Bede Junior College. He worked as a supervisor at Sauer Sundstrand. He

enjoyed fishing, camping, mushroom hunting and his grandchildren.

Joe is survived by his wife, Dollie of Granville; three children, Michael Borostowski of Granville, Ramona Borostowski of Granville and Laura (Steve) Ely of Dixon; seven grandchildren, Andrew Borostowski, Alex, Abbi and Diana Ely, and Ariana, Brook Ann and Adam Borostowski; four sisters, Chris Pohar of LaSalle, Rose Riva of Oglesby, Jeanette (Russell) Hicks of Florida and Mary (Bruce) Brankle of Indiana; and one brother, Robert (Trudy) Borostowski of Peru.

He was preceded in death by his parents; two sisters, Diane Hohman and Susan Borostowski; a granddaughter, Brooke Ann; and his three dogs, Mike Dog, Smokey and Bailey.

Pallbearers were Andrew and Adam Borostowski, and Alex, Abbi and Diana Ely. Memorials may be made to St. Jude Midwest Affiliate of Peoria in honor of Adam Borostowski.

Weygand is a mixed media artist based out of Ottawa. She is the owner of Open Space Art Gallery and Studios in Ottawa, a contemporary art gallery showing Illinois based artists. She works mainly with photography and acrylic or oil paints but also has a strong love for sculpture.

10 To the Electors of the State of Illinois: The Illinois Constitution establishes a structure for government and laws. There are three ways to initiate change to the Illinois Constitution: (1) a constitutional convention may propose changes to any part; (2) the General Assembly may propose changes to any part; or (3) a petition initiative may propose amendments limited to structural and procedural subjects contained in the Legislative Article.

The people of Illinois must approve any changes to the Constitution before they become effective. The purpose of this document is to inform you of proposed changes to the Illinois Constitution and provide you with a brief explanation and a summary of the arguments in favor of and in opposition to the proposed amendment.

Proposed changes in the existing constitutional amendment are indicated by underscoring all new matter and by crossing with a line all matter which is to be deleted.

PROPOSED AMENDMENT TO SECTION 3 OF ARTICLE IX OF THE ILLINOIS CONSTITUTION ARTICLE IX – REVENUE SECTION 3. LIMITATIONS ON INCOME TAXATION (a) The General Assembly shall provide by law for the rate or rates of any tax on or measured by income imposed by the State. A tax on or measured by income shall be at a non-graduated rate. At any one time there may be no more than one such tax imposed by the State for State purposes on individuals and one such tax so imposed on corporations. In any such tax imposed upon corporations the highest rate shall not exceed the highest rate imposed on individuals by more than a ratio of 8 to 5. (b) Laws imposing taxes on or measured by income may adopt by reference provisions of the laws and regulations of the United States, as they then exist or thereafter may be changed, for the purpose of arriving at the amount of income upon which the tax is imposed.

EXPLANATION The proposed amendment grants the State authority to impose higher income tax rates on higher income levels, which is how the federal government and a majority of other states do it. The amendment would remove the portion of the Revenue Article of the Illinois Constitution that is sometimes referred to as the "flat tax," that requires all taxes on income to be at the same rate. The amendment does not itself change tax rates. It gives the State the ability to impose higher tax rates on those with higher income levels and lower tax rates on those with middle or lower income levels. You are asked to decide whether the proposed amendment should become a part of the Illinois Constitution.

ARGUMENTS IN FAVOR OF THE PROPOSED AMENDMENT Illinois' current tax system unfairly benefits millionaires and billionaires and this amendment will set things right for middle-class and working people. Currently, it is unfair that billionaires pay the same tax rate as regular people.

Voting "yes" on the amendment means that the State will enact a new tax structure where only those making above $250,000 a year will see their taxes go up. This amendment is simply upgrading Illinois' old tax system to a graduated system which is how the federal government and the majority of other states do it.

This Amendment Would Make Illinois' Tax System Fair.

Approval of this amendment would enact a fair system that allows the state to tax wealthy people at higher rates and lower income people at lower rates, replacing Illinois' current unfair tax system, in which wealthy people pay the exact same tax rate as lower and middle income people.

Illinois' current tax system unfairly benefits millionaires and billionaires, and approval of this amendment will set things right for the middle class and working people.

This amendment will help small business owners by creating a stable economic environment for their businesses to thrive.

While others try to mislead you, under the current tax system in Illinois, policymakers already have the authority to set any tax rate and to change tax rates at their will. The current system forces policymakers to charge the same tax rate to everyone, regardless of how much money they make. If this amendment passes, the State will have the ability to tax higher income earners at a different rate.

In fact, upon passage of this Amendment, a new tax structure will go into effect where 97% of taxpayers will pay the same or less, while only those making more than $250,000 a year will see a tax increase. This amendment does not tax retirement income.

The Federal Government and Most States Use the Graduated Tax System Proposed in this Amendment, Not the Unfair System Currently Used in Illinois.

Illinois is among a minority of states that do not utilize graduated tax rates because the Illinois Constitution requires a "flat tax" that penalizes middle-class and working people and benefits higher income individuals.

A majority of states and the federal government already use the kind of graduated income tax system proposed in this amendment to ensure that wealthy people pay their fair share of taxes.

Nearby states including Iowa, Minnesota, Missouri, Ohio, and Wisconsin are among the majority of states that have graduated tax systems.

Illinois' Current Income Tax System Relies on Taxes from Middle and Lower Income Earners, While a Graduated System Would Lower that Burden and Fund Critical Programs such as Education and Human Services.

While some states have fair tax rates in which the highest income earners pay the highest tax rate, Illinois' "flat tax" rate continues to rely unfairly on taxes from middle and lower income earners.

Under Illinois' "flat tax" structure, a nurse making $50,000 per year pays the same tax rate as an executive making $4 million per year. A graduated tax rate would have the executive pay more.

Because of the way our current tax system is set up, the bottom fifth of Illinois taxpayers (those making below $21,800) contribute 14.4% of their income to state and local taxes, compared to 7.4% for the top 1 percent of Illinois taxpayers.

If this Amendment passes, the State has already enacted a new graduated tax structure where 97% of taxpayers will pay the same or less.

Under the new tax structure, only the top 3% of Illinois income earners would pay more in income taxes. Everyone who makes $250,000 or less a year would pay the same or less.

Over 95% of small businesses earn $250,000 or less a year in profits, and their owners will not see a tax increase under the new tax structure.

This change will generate additional revenue each year that can help address Illinois' budget deficit and fund critical programs, including the State's education system, public safety, and social services like mental health and substance abuse treatment and domestic violence shelters.

After the COVID-19 Pandemic, We Need to Do All We Can to Help the Economy and Middle-Class and Working People.

Working people and essential workers like nurses, first responders, and grocery store clerks should not pay the same tax rate as the wealthy. Nurses making $50,000 a year should not pay the same tax rate as an executive making $4,000,000 a year.

Having wealthy people pay more would reduce the burden on working families. This is money that middle and lower income people need for housing, groceries, medicine, and essentials.

When the wealthiest people pay more, middle and lower income earners can pay less while the State funds critical services that our essential workers rely on.

ARGUMENTS AGAINST THE PROPOSED AMENDMENT 1) The Amendment gives the Legislature power to increase taxes on any group of taxpayers with no limits and no accountability and without any requirement to use the additional revenue to fund essential needs such as healthcare, education, or public safety.

2) Taxes and spending are out of control. The Legislature should not be allowed to keep raising taxes until they get their spending under control.

3) In the wake of the COVID-19 pandemic, now is the worst possible time for a massive tax increase.

The Amendment gives the Legislature power to increase taxes on any group of taxpayers with no limits and no accountability and without any requirement to use the additional revenue to fund essential needs such as healthcare, education, or public safety.

The proposed amendment would give the Legislature unlimited new authority to increase income tax rates on any group of taxpayers at will, including low-income and middle-income families and small business owners. There would be no limit on the number of tax brackets that could be created and no limit on how high tax rates could be increased on individual taxpayers. In addition, this proposed change will pave the way for a tax on retirement income.

Nothing in the amendment requires the Legislature to do anything to control spending. Nor does it require funds to be spent on essential needs such as healthcare, education, or public safety. It would simply give the Legislature a blank check to spend billions of dollars however they want, with no accountability.

Taxes and spending are out of control. The Legislature should not be allowed to keep raising taxes until they get their spending under control.

Illinois already has some of the highest property taxes and sales taxes in the nation. And the Legislature has increased Illinois income tax rates twice in the past decade to try to deal with the out-ofcontrol spending in Springfield.

Even before the COVID-19 pandemic, our state had a huge and growing multi-billion-dollar budget deficit, and the unfunded pension liability skyrocketed to over $137 billion. That's because the Legislature has continued to increase state spending instead of eliminating government waste, corruption, and abuse.

Because they refuse to control spending or pass major reforms, the Legislature will just continue to raise taxes on everyone in Illinois, and middle-class families will be their next target.

In the wake of the COVID-19 pandemic, now is the worst possible time for a massive tax increase.

The COVID-19 pandemic caused layoffs, unemployment, bankruptcies, and closures. As small businesses and local employers struggle to rebuild, this is the worst possible time to impose huge new tax increases. Even before the COVID-19 crisis, many residents and businesses were leaving the state because of the high tax burden. If the Amendment passes, it would be the last straw for thousands of small businesses, causing more jobs to leave the state, and making Illinois lose out on investments to rebuild our economy. This would mean fewer jobs and less opportunity for Illinois families.

GRANVILLE — Co-hosted by PCHS Interact and Putnam County Rotary, the Red Cross blood drive held at the Granville American Legion on Sept. 11 was a success — on several levels.

The project was a fitting remembrance, honoring lives lost on Sept.

11, 2001, and the heroism of first responders then, and now. The event provided students — all born after the tragedies of that day — a meaningful opportunity to learn and participate. The event also coincided with national “Blood Collectors Week” celebrating the compassion and commitment of

front-line blood drive staff.

In all, 21 units of blood were collected. Donors included five PCHS students, two of whom were first-time donors, and school staff, Rotarians and community members. The numbers were particularly good considering that Putnam County schools had temporarily closed down that day due to COVID-19 issues.

Rotary and Interact extend thanks to the American Legion for offering their facilities for the blood drive, to all front-line staff and to all who donated to help save lives.

Flo’s on Pulaski is more than big tenderloins I tried Flo’s on Pulaski in Peru, when a friend told me the breaded pork tenderloins were the largest he’s seen.

They didn’t disappoint.

Not only were the tenderloins huge, but they had a crispy exterior and a meaty interior thicker and juicier than the norm.

The tenderloin was only my introduction to what has become a favorite stop in LaSalle County.

With daily homemade specials posted to Facebook, the Flo’s menu has everything from fried chicken and cod served family style with spaghetti and Illinois Valley ravs, to burgers and pizza and a $10 Polish platter on the third Saturday of every month featuring kielbasa, pierogies, potato pancakes, cabbage rolls and haluski all served with sauerkraut.

The daily special that caught my eye this time was the chicken Oscar – a special that’s in the restaurant’s regular rotation. The entree is a lightly battered chicken breast topped with a butter sauce and crab meat on top of a bed of rice and served with asparagus. This is a keeper.

None of the flavors were overdone and they complemented each other well, making each bite a perfect mix of a creamy and rich (but not too rich) sauce and fried chicken.

My dinner companion ordered the quarter fried chicken light, which is a breast and a wing served up crispy and crunchy with coleslaw, choice of potato, bread and spaghetti and Illinois Valley ravs – all for $10.

We started the meal with an appetizer of the garlic and mozzarella ($4.95) – similar to the garlic nuggets served across the area but filled with a bite of melted cheese.

And then we topped it off with the homemade dessert special of apple crisp, which came with a serving of vanilla ice cream to complement the crisp. With fall around the corner, this was the perfect

All together, our bill was about $43, making Flo’s an excellent choice for homemade food at affordable prices.

At the time, Flo’s was only offering carryouts with curbside pickup and deliveries because of coronavirus. I was able to phone in the order and pick up my food at the front

door. Give them between a half hour and 45 minutes to make your food.

Under normal conditions, the restaurant doubles as a neighborhood bar on Peru’s Pulaski Street, which adds to the overall experience.

Visitors will turn north on Pulaski Street from U.S. 6 and go up a small hill to find the

tavern on their right with a big Stroh’s sign in the front.

According to Facebook, customers are able to dine indoors again since Sept. 14.

For anyone looking to try Flo’s, keep an eye out for daily specials, including their breakfast boxes, or jump right into ordering one of the largest breaded pork tenderloins

around. It will definitely take care of both lunch and dinner.

• The Mystery Diner is an employee at Shaw Media.

The diner’s identity is not revealed to restaurant staff when ordering or picking up the food. If the Mystery Diner cannot recommend the establishment, we will not publish a story.

The Putnam County Library District has announced programs for October.

All Putnam County libraries • Monday, Oct. 12 — All libraries will be closed for Columbus Day. They will reopen on Tuesday, Oct. 13.

Hennepin • Fall Into Reading — For the month of October, the Hennepin library branch encourages to read.

For every book that is read, or visit made to the library, patrons may submit their name on a slip for an opportunity to win a prize basket.

• Thursday, Oct. 8 — A virtual hand-on science sphero training will be at 6 p.m. Participants can check out a sphero from the library for online training. There is a limit of 11 spheros across the county to check out; limit 1 per household.

Patrons will learn the basic use of the sphero robot and the materials that come included. This is part of the IEEE Chicago Section Grant.

A Zoom link will be posted on the website.

• Thursday, Oct. 15 — Megan Baznik will discuss the Devil in the White City at the Chicago World Fair at 6:30 p.m. The program will be both in person and virtual on Facebook and Zoom. A Zoom link will be posted on the website.

Suppan will present “Ottawa Rescue Case on Jim Gray” at 6:30 p.m. The presentation will be done in person and virtual on Facebook and Zoom. A Zoom link will be posted on the website. Suppan will discuss the Underground Railroad that was organized to help runaway slaves seek freedom. The Northern District of the Illinois State Supreme Court became the scene of a hearing of a runaway slave, Jim Gray, who had been arrested in Union County in southern Illinois.

• Thursday, Oct. 22 — Grab and go craft event. Participants will make a Popsicle stick spider web.

• Every Thursday — Story time at 3:30 p.m.

• Homework Helper — Students are welcome to work on homework at the library during library hours.

Granville • Saturday, Oct. 12 — Grab and go craft event will be potato stamp ghosts and clothespin button bats.

• Saturday, Oct. 24 — Witches Circle: The Hocus Pocus Hags will perform at 11 a.m. at Hopkins Park. Those coming for the show should bring their own chairs and blankets; the bathrooms will be closed. The group started dancing in the Illinois Valley four years ago.

After seeing a video of a German witch dance, a couple of the ladies decided this would be a fun thing to do. The first group was about

13 ladies. In 2019, approximately 45 ladies, ranging from 16 to 70, danced their way to the streets.

Practice started in a garage and slowly moved to a new location and then once again had to move to an even bigger location. These ladies are the most creative when it comes to their outfits — head pieces and makeup.

Thursday, Oct. 29 — A Putnam County Community Center representative will be at the library from 9:30 to 11:30 a.m. for seniors who have questions about Medicare and open enrollment.

• Every Tuesday — An online story time at 9 a.m. on Facebook.

• Preschool story are to be determined.

Magnolia • Saturday, Oct. 3 — A story hour and pick up of family movie night bag will be at 10 a.m.

MAGNOLIA FIRE PROTECTION DISTRICT ORDINANCE NO. 2020-1 AN ORDINANCE CONCERNING FEES CHARGED TO NON-RESIDENTS WHEREAS, numerous state statutes permit fire protection districts to bill for services provided, to wit: a. 70 ILCS 705111f Charge against Non-Residents, b. 430 ILCS 5515 Hazardous Material Emergency Response Reimbursement Act, c. 415 ILCS 5/22.2 Environmental Protection Act, d. 625 ILCS 5/11-501.01(1) Required to make restitution.... for costs of emergency response (DUI), and; WHEREAS, the MAGNOLIA FIRE PROTECTION DISTRICT (the "District") may be called to render service to non-residents and others who by operation of law can be required to pay for services in specific circumstances.

THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE MAGNOLIA FIRE PROTECTION DISTRICT OF PUTNAM COUNTY, ILLINOIS: SECTION I: PERSONS AND AMOUNT. It shall be the policy of the District to charge for its services when such services are provided: a. outside the geographical taxing area of the District; b. to persons, companies or businesses not a resident of the District; c. as the result of spill and Spiller Pays Law can be invoked; or d. are related to DUI charges.

The fees for these services shall be in accordance with the Illinois Compiled Statutes whenever such Statutes clearly establish fees or limits, Fees for services not set by law, shall be in accordance with the schedule of fees set by the District from time to time. These services shall be billed to the persons receiving services from the District.

SECTION 2: EXCEPTION. Services rendered pursuant to a mutual aid call in accordance with a bona fide mutual aid agreement shall not be billed, unless otherwise permitted by state or federal law.

SECTION 3: PROCEDURE. The Fire Chief or Officer in Charge shall determine the name and address of the person receiving service at the time services are rendered. Within five (5) days, the Fire Chief will determine if such person is a candidate for billing under this Ordinance. Any questionable candidates shall be referred to the Board of Trustees for elimination. The Fire Chief shall bill the recipient and all bills remaining unpaid more than sixty (60) days shall be referred to the Board of Trustees for handling. a. REIMBURSEMENT FOR HAZARDOUS MATERIAL EMERGENCY RESPONSE: In the event the District is not reimbursed by a responsible party for services rendered in connection with a hazardous materials emergency response, the District, in accordance with Section 5 of the Hazardous Materials and Emergency Response Reimbursement Act, 430 ILCS 5/5, shall make application to the emergency response reimbursement fund of the State of Illinois.

SECTION 4: VALIDITY. The invalidity of any part of this Ordinance shall not affect the validity of any portion which can be given effect without such invalid part.

SECTION 5: EFFECTIVE DATE. This Ordinance shall take effect and be in full force from and after its passage and approval.
