It’s your “life,” use it!

This spring, Clarke County Development Corporation (CCDC), in collaboration with Clarke Community School District, Clarke County Board of Supervisors, Clarke County Hospital board and the city of Osceola hired Spoke Communications to help them with a public relations marketing effort.

The first thing Spoke Communications did was begin a process of understanding how people in Osceola get their information. Part of the process was the establishment of a new website called ClarkeCountyLife. com. “ T h e challenge so many times in a community is that information that gets circu- Trickey lated is not always accurate,” said Bill Trickey, executive director of CCDC. “So, we wanted to at least have a place where people knew they would get

POLICE REPORT Gaspar Jose-Francisco, 25, of Osceola was charged with two counts of third-degree sexual abuse and one count of sexual exploitation of a minor July 20.

—————— Michael Lynn Wogan, 38, of Lamoni was charged with violation of a no-contact order and second-degree theft July 25.

ACCIDENTS A citation for failure to maintain control was issued after an accident 2:40 p.m.

According to a Clarke County Sheriff’s report, Andrew William McKnight, 16, of Osceola, driving a 1992 Dodge pickup north on 240th Avenue, lost traction before the crest of the hill.

This caused him to fishtail on the gravel and over correct. The vehicle crossed the gravel and entered the west ditch, rolled several times and came to a stop by a culvert.

McKnight, who was wear-

ing a seat belt, was checked out by medical officials and released.

Damage estimate is $3,000 to the vehicle owned by Brian Keith McKnight.

Loebsack announces more than $7.35 million to support Iowa colleges Congressman Dave Loebsack, D-Iowa, announced that 27 community colleges, colleges and universities across Iowa have received a total of $7,351,702 from the U.S. Department of Education to help increase college retention and graduation rates among high risk students.

The TRIO Student Support Services (SSS) Program is a competitive grant that awards funds to institutes of higher education to provide academic and other support services to low-income, first-generation or disabled college students.

The program will help increase students’ retention and graduation rates, facilitate their transfer from twoyear to four-year colleges, and foster an institutional climate supportive of the success of low-income and first generation college students and individuals with disabilities. Details of the grants are below.

“Having grown up in poverty I know first-hand the uphill battle many low-income students face. I was very lucky to have had the support of caring adults in my family, school and community, but all too frequently the story is much different,” Loebsack said. “Support for our students is critical to ensure everyone has the opportunity to succeed in our 21st Century workforce. This funding will help schools and teachers comprehensively address their students’ needs, giving them the motivation to remain engaged in school and helping them to succeed academically.”

TRIO Program participants must be low-income, a first-generation college students or an individual with disabilities. All participants must be enrolled or accepted for enrollment in a program of postsecondary education at an institution of higher education and have a need for academic support.

Required TRIO Program services include academic tutoring; advice and assistance in postsecondary course selection; information on financial aid programs and benefits and assistance in completing financial aid

applications, including the FAFSA; education or counseling services designed to improve financial and economic literacy; activities designed to assist participants enrolled in four-year institutions in applying for admission to, and obtaining financial assistance for enrollment in, graduate and professional programs; and activities designed to assist students enrolled in twoyears institutions of higher education in applying for admission to, and obtaining financial assistance for enrollment in, four-year programs of postsecondary education.

Clark Gamble Geddes, 87, of Osceola died July 18, 2015, at Southern Hills Specialty Care.

Clark Geddes, son of Ronald Gamble Geddes and Sarah Elizabeth (Leonard) Geddes, was born Nov. 6, 1927 in Farrar.

He received his education at Farrar High School and graduated in 1945. Following graduation, Clark enlisted in the United Sates Marine Corps and served for 15 months during the Korean Conflict and eight years with the Marine Corps Reserves.

On Sept. 5, 1953, he married Dixie Irene Stebbins at Farrar Methodist Church.

Phyllis Bernadine Mooberry, 92, of Grimes died July 22, 2015, at Mercy Hospice in Johnston.

Phyllis Mooberry, daughter of Ralph and Carrie (Sinn) Muselman, was born

Dec. 6. 1922. She graduated from Osceola High school in 1941.

She married James Mooberry June 29, 1941, in Bethany, Mo., and they lived in Osceola until moving to Des Moines in 1955 and were currently residing at Kennybrook Village in Grimes.

Phyllis worked as a certified nurse aide until her retirement in 1983. She attended New Hope Assembly of God Church.

Phyllis is survived by her husband James Mooberry of Grimes; sons, Jerry (Terri) Mooberry of Snohomish, Wash., and David Mooberry (fiancé Kerri) of Urbandale; five grandchildren and three great-grandchildren.

Phyllis was preceded in death by her son James Lynn Mooberry.

The website is up and ready to go for people to look at. It can be viewed from a mobile phone, and if people have an iPhone, there’s an app to download. The Android version of the app is still being finished.

When asked why people should go to the website, Trickey answered, “To understand what’s going on in the community, look for news that’s going on in the community. Good things are happening in the community.”

Planning for the future, Osceola wastewater plant, city move on renovations A city’s growth and continued development relies on up-to-date, effective wastewater treatment and regulation. This is always a priority for city administrators, managers and their employees. How they manage the updates and costs associated with them is often a reflection of the care and commitment they have to residents and businesses.

The city of Osceola’s current wastewater plant, designed and built in the late 1970s, was showing the wear of community growth and time by the early 2000s. So, in 2003, the plant underwent significant updates to sustain much needed services and help with the growth we see today. These updates addressed issues like corrosion of lines, concrete and infrastructure, volume limitations, as well as state and federal regulation updates.

“That’s pretty standard,” said Donnie McCuddin, superintendent of the city’s wastewater plant. “In an aggressive atmosphere like ours, a wastewater plant will need upgrades about every 15 to 20 years.”

Now, 12 years after the 2003 renovations, the city and water treatment plant have embarked on plans for updating to meet the most recent demand and Osceola’s future growth, as well as updated DNR standards required by the next certification deadline.

“Clean water regulations are being ramped up and they’re affecting everyone’s permits,” McCuddin said, “They’re reviewing issues at big plants, handling of a million gallons of wastewater or more, first. (Osceola) is just below that benchmark, so we wanted to start now, making sure we were proactive in our management and upkeep of the plant.”

An estimated $12 million will be needed to achieve the new wastewater plant renovation project. At an increase of 20 percent, this will affect

rates for Osceola residents and businesses across the board. But, in an effort to lighten the burden, the city developed a plan to spread the rate increase out in 5 percent increments over the next few years. This computes to an annual increase of approximately 40 cents for average users.

Businesses and residents alike will benefit from this slow distribution of costs over having the entire increase applied at once.

When asked about the rate increase strategy, Ty Wheeler, Osceola’s city administrator, said, “While other similar-sized cities have applied the renovation update costs in a single rate increase – some as much as 65 percent – that just didn’t bode well with us. So spreading the rate out over the next few years will make it easier on our residents as well as keep the cost of doing business in Osceola low.”

DNR inspections are expected to take place at the Osceola plant within the next 12 to 18 months. If the necessary updates and repairs to the plant aren’t made, Osceola could have their certification held or be fined until the issues are resolved.

“We’ve seen this on the horizon for almost five years, now. We can either plan now or pay later,” McCuddin said. “They (DNR) appreciate the efforts that we are making. It happens everywhere. It’s just something that needs to be done. And we wanted to do it right, for the plant, for our residents and businesses, as well as the future of Osceola.”

Renovations to the wastewater plant will be complete, upgrading or completely replacing the current plant, by 2020. While some renovations have already started, the wastewater plant and the city will continue their sustainability and feasibility study, finishing by 2017. By 2019 a final wastewater plant design will be presented.

The event is at East Lake Park, the upper northwest level. It is open to ages 3 to 18. All participants under the age of 12 must be accompanied by an adult throughout the event.

Prizes will be awarded to all. It is cost-free. A meal will be provided.

BACK IN TIME Sunrise Knoll: Dr Sells’ houses

Frank Wesley Sells was a physician and surgeon in Osceola and Murray. In addition to a medical practice, he started a house building program soon after World War 1, building 25 houses in Osceola for employees of the pipeline and armory.

Modern houses to rent were scarce articles in towns the size of Osceola. These houses served the community with modern homes.

His enterprise almost wholly took care of the then housing shortage. These houses were then known as, and are still referred to by some today as, “Dr. Sells’ houses.”

In September 1929, Dr. Sells built four new modern residences. Three were built around a court (Court Street today) constructed in the center of a block at the rear of a residence on West McLane Street.

These houses were similar in construction to the six he built

during the early 1920s, three on South Fillmore Street and three on West McLane Street just south of where the three new ones were built (Court Street).

The fourth house built was on East Cass Street between South Adams and South Kossuth streets.

Dr. Sells contracted for seven more new buildings to be erected that fall, making a total of 11 built that fall. Of that seven, one was on South Park Street, one near East Ward School, also between South Adams and South Kossuth streets.

In 1942, Dr. Sells contracted for eight more houses on the west side of North Adams Street between East Washington and East Webster streets. This area was known as “Sunrise Knoll” and the houses were all modern with full basements, shower baths, sun parlor, porch and garages along the “drive” on the west side of the houses.

ple style homes known as pyramidal roof cube houses in Osceola.

The house itself is a square with a chimney in the center and a roof that comes up evenly from all four edges without gables or eves. The interior is a four-room arrangement under a pyramidal roof.

Some homes have been modified making the home style less obvious with additional rooms and porches added. This modest type of house was popular from 1900 to 1940 and built by the railroad companies for homes for their workers.

These homes are located in the areas of town where a rail line was not too distant.

—————— In the late 1950s and mid 1960s, several houses were moved from the Truro pipeline booster to Osceola and country locations.

Locations of some in Osceola are East Washington and South Kossuth streets, West Cass Street and North Ridge Road and the 400 block of North Fillmore Street.

HCI Hospice Care Services selected to participate in the Medicare Care Choices Model WEST DES MOINES – HCI Hospice Care Services has been selected to participate in the Medicare Care Choices Model, announced by Health and Human Services Secretary Sylvia M. Burwell.

The model provides Medicare beneficiaries who qualify for coverage under the Medicare Hospice Benefit and dually eligible beneficiaries who qualify for the Medicaid Hospice Benefit the option to elect to receive supportive care services typically provided by hospice and continue to receive curative services at the same time.

The announcement is part of a larger effort at HHS to transform the health care system to deliver better care, spend dollars in a smarter way, and put patients in the center of their care.

All eligible hospices across the country were invited to apply to participate in the model.

Because of robust interest, CMS expanded the model from an originally anticipated 30 Medicare-certified hospices to over 140 Medicare-certified hospices and extended the duration of the model from 3 to 5 years.

This is expected to enable as many as 150,000 eligible Medicare beneficiaries with advanced cancers, chronic obstructive pulmonary disease, congestive heart failure, human immunodeficiency virus/ acquired immunodeficiency syndrome who receive services from participating hospices to experience this new option and flexibility.

Participating hospices will provide services under the model that are currently available under the Medicare hospice benefit for routine home care and respite levels of care, but cannot be separately billed under Medicare Parts A, B, and D. Services will be available around the clock, 365 calendar days per year and CMS will pay a per beneficiary per month fee ranging from $200 to $400 to participating hospices when delivering these services under the model. Services will begin starting Jan. 1, 2016, for the first phase of participating hospices and in January 2018 for the remaining participating hospices.

Individuals who wish to receive services under the model must fall into certain categories:

Must be diagnosed with certain terminal illnesses (e.g., advanced cancers, chronic obstructive pulmonary disease, congestive heart failure and human immunodeficiency virus/acquired immune deficiency syndrome); • Must meet hospice eligibility requirements under the Medicare or Medicaid Hospice Benefit; • Must not have elected the Medicare or Medicaid Hospice Benefit within the last 30 days prior to their participation in the Medicare Care Choices Model; • Must receive services from a hospice that is participating in the model; and • Must have satisfied model’s other eligibility criteria.

Vanessa Bakley hit a two-run single in the third inning and Spurgin hit an RBI double in the inning.

Sara An- Redman drew added an single in the fifth inning, while Sydnee Redman stroked a two-run single.

The bottom of the sixth inning would have been the last inning of the game, since the two teams had hit the 90-minute time limit for all consolation round games.

Nerves seemed to get the best of the Lady Indians in the record-breaking loss.

The game started out with a miscommunication allowing the leadoff batter to reach base. After Clarke recorded two outs, an infield error extended the inning and Solon went on to score three runs.

“It was a miscommunication to get the first runner on,” head coach Lindsay Diehl said. “We’ve been working on that. We’ve been preparing for that. We knew what their game plan was going to be. We just kind of stubbed our toe.”

“We were at a good point in their lineup where I felt like Sydnee had handled those kids. We knew where to pitch them and we just didn’t get the outs when we had the opportunities,” Diehl said. “We work on this thing called Base 2, where we try to get check marks, and one of them is answer back. They earned that check mark that inning.”

After the opening loss to Solon, Diehl told her team she predicted a fifth-place finish. The win over Boyden-Hull/Rock Valley gave the Lady Indians the opportunity to play for fifth place.

But, in a 1-1 game in the top of the third inning, Clarke gave up six unearned runs and Mount Vernon went on to win 114.

Young Roadrunners finish eighth in Class 2A

FORT DODGE — The Interstate 35 softball team might not have come away with any victories here last week at the Class 2A State Softball Tournament, but the Roadrunners gained valuable experience.

The Roadrunners lost their opening game 3-0 to top-ranked Fort Dodge St. Edmond, which went on to finish third.

Pitcher Carlyn Stanley gave up only one earned run in the loss, but the Roadrunners finished with just two hits and committed five errors.

I-35 coach Tim Bogs started a lineup of six sophomores, two freshmen and an eighth grader against a veteran Gael squad with six players who appeared in the 2013 state tournament.

“I thought we were a little nervous,” Bogs said. “Usually we swing the bat pretty well. Usually we get ahead in the count and sit on a pitch and drive. We didn’t get any drive on the ball today.”

Bogs said he saw similarities in St. Edmond’s situation two years ago with a young team that developed

into this year’s 2A favorite, to his team’s current experience.

“They’re number one,” he said. “In a couple years, if we develop like they did, then we’ll be the number one team. We can be disappointed in losing, but not in our effort. It’s a building experience.”

Stanley pitched well again in a 6-4 loss to Durant in the consolation semifinals, giving up just two earned runs as the Roadrunners again committed five errors. She struck out four and gave up just six hits.

For the game, Interstate 35 outhit Durant 8-6.

After giving up a single run in the top of the second inning, Stanley tied the score in the bottom of the third with a solo home run.

Durant went up 3-1 with two runs in the fifth inning and then scored three more in the top of hte sixth inning for a 6-1 lead.

But the Roadrunners rallied with three runs of their own in the bottom half of the inning to draw within 6-4.

Shai Major delivered a two-run single in the rally, scoring Kate Stanley and Josie Wickett. Laynie Duff also recorded an RBI single in the inning.

Interstate 35 had the top of the order due up in the bottom of the seventh inning, but went down in order.

Central Springs defeated the Roadrunners 6-2 in the seventh-place game, as the young Roadrunners committed three more errors.

“In three games, I think we gave up 15 total runs, but probably three of them were earned,” Bogs said.

“We have to play better defensively. We can’t make 13 errors in three games. That didn’t include the mental

of mad about that. When the year starts, we have to shake that stuff off and be ready to play.”

Even though the Roadrunners played from behind the entire tournament, they never gave up. That was an encouraging sign for Bogs.

“I told them, disappointed we lost three times, of course, but not disappointed,” he

said. “We could have caved and we could have quit. We hung in and we battled every time. We never did quit. I was proud of that and I was proud that we kept going until the very end of every game.”

Wells contributes in Shrine Bowl win CLARKE:

CEDAR FALLS — Central Decatur senior Trenton Wells came up short in his attempt to play in the UNI-Dome back in November, as the Cardinals were eliminated in the state quarterfinals by eventual Class 1A state champion Iowa City Regina.

Saturday, Wells finally got to play at the UNI-Dome, helping the South squad win its fifth straight Iowa Shrine Bowl Game, 37-24 over the North squad.

“This is a great place. It’s fun to play in,” Wells said. “Turf is a little slick, but we adjusted. It was fun.”

Wells played safety for the South squad’s defense in the second and fourth quarters. Mount Ayr’s Joe Ricker played defensive tackle and Creston/O-M’s Alex Nielsen played safety for the South squad in the first and third quarters, with both getting subbed in during the fourth quarter.

Shrine Bowl rules allow for the team trailing in the second half to receive the kickoff after scoring, which kept the South squad’s defense on the field more often in the second half. When South squad coaches were able to freely substitute with less than 7:00 remaining on the clock, both Ricker and Nielsen garnered more playing time to spell the fourth quarter players.

The South squad took a 16-3 lead into the halftime break when Carroll’s Addison Ross intercepted a pass in the end zone in the waning seconds of the first half, keeping the North squad out of the end zone.

The lead quickly ballooned in the second half, as Dowling Catholic’s Ryan Boyle, who will be joining the Iowa Hawkeyes in the fall, scored on a 3-yard touchdown run just 3 minutes into the third quarter.

Just minutes later, Boyle hit North Scott’s Ricky Grimes on a short pass route and Grimes took the ball 80 yards for a touchdown to put the South up 30-3.

“It was great to get the big win,” Ricker said. “It was a real fun game to play in.

We were always up, so it was always fun.

Our team, as a whole, played outstanding.

I was really, really happy with our performance.”

Ricker made several tackles in the game, including a solo tackle for a loss.

“Sydnee was gassed in that first game,” Diehl said. “I really wanted to give Alex that experience.

She knows she has a lot of work to do, both of them, in the offseason. We have the opportunity to have two great pitchers. I look forward to what this experience does, for all of our kids, to motivate them.”

Kindred finished with two hits and two RBI in the loss, while Ally Deutsch and Lexy Carson each had RBI base hits.

“We gave ourselves the opportunity (to finish fifth). I saw a lot of fight in the first game today, and not as much in the second game today,” Diehl said.

“I felt like I held my own against those big D-I athletes that are getting looks,” said Ricker, who will play at Iowa Western Community College. “At first, I kind of wondered. I knew he was real big and strong from wrestling, but I felt like I held my own just fine. I did everything I wanted to do on him and I surprised myself at how well I could hold up with those big D-I linemen.”

Nielsen also recorded several tackles from his safety position and also broke up a deep pass play that likely would have gone for a North touchdown if it had been completed.

After not playing defense during his senior season while leading the Panthers as a quarterback, Nielsen said it was an adjustment getting back to defense.

“Playing defense was an adjustment for me, but I’ve played there before. I was used to it. Rusty at first, but it was fun to play with the guys,” he said. “I felt confi-

dent. I could break, make tackles, make plays. One broken coverage, I think, but other than that, we were solid on the back. It was a great game for us.”

Likewise for Wells, playing safety was a bit of an adjustment. Wells had not played the position since his sophomore year, but looks to play safety and also punt at Grand View University.

“Going from d-end to safety was a little bit different, but it was all right. It was fun to get back to safety and knock some people around,” Wells said. “I thought I did all right. I was right where I was supposed to be every time. Missed a couple of tackles, but other than that, it was pretty good.”

Wells said the weeklong experience at the Shrine Bowl was an unforgettable experience.

“It’s been pretty great. Just being around everybody and meeting new people was pretty fun,” he said. “And doing it for a good cause makes it even better.

Fry chosen for NAEDA scholarship award FENTON, Mo. – Dalton Fry of Osceola has been selected as a recipient of the NAEDA Equipment Dealers Foundation (EDF) Scholarship for the 2015-16 academic year.

Fry’s total scholarship of $2,000 includes matching funds from his sponsoring equipment dealership Vetter Equipment Co., headquartered in Indianola.

Fry will be attending Vatterott College, studying Diesel Mechanics in the upcoming school year.

“Dalton has been shadowing the service technicians in

our service department and helping with various project for our sales department. They donated a million dollars to Joe’s political campaign, with promises of more to come.

When they said Joe seemed to be “just our kind of guy,” he didn’t think too much about it. He thought they were referring to his stand on various social justice issues and his involvement in starting up the area’s first comprehensive homeless shelter program.

Joe became suspicious when he received a call one Monday morning. The caller was brief – and to the point.

“So,” the unidentified voice said, “heard you got a boatload of money from those developers, guess we know how you’ll be voting if you get elected.”

Joe assured the caller that he planned nothing of the kind. When Joe said his style was to research and ask questions before he voted on anything, the caller laughed, said, “Good luck with that,” and quickly hung up.

Just an hour later, the president of the company that had donated to his congressional campaign came calling.

Walking straight through his outer office, he stood over Joe’s desk. “Who do you think you are?” he asked, adding ominously, “You’ll never win without us. We’ve got the money you need, and you have a vote we need. Thought we had an understanding, Joe.” Joe stood to face his visitor. “Who do you think I am?” he asked.

The development company president laughed. “You’re the guy we gave a million bucks to, that’s who you are.

You’re our investment. We didn’t get this far in business without expecting good returns on our investments. Hope I’m clear here. You do understand, right, Joe?” “Oh, I think I get it quite clearly now. I’ll have a check ready for you in the morning. Thing is, you helped me more than you realize. You helped me to be rock-solid sure of who I’m not. My apologies for wasting your time, and for anything I did or said that made you think I’d be ‘your kind of guy.’ No way, no how. Not happening. Would you like to pick that check up, or do you want me to mail it?”

As Joe stood to show him out, the man’s shocked, then angry expression did not escape his attention. As they passed back through the outer office, he turned on Joe.

“You know you’ll never win without our help, right? Winning takes money, and you just threw away the best money you’re gonna get.” With that, the man walked out, slamming the office door behind him.

Dave, Joe’s secretary, had seen and heard it all as he sat at his desk in the outer office.

Dave said something, but Joe didn’t catch it. “Sorry Dave, I didn’t hear what you said.”

“Well, sir, what I said was, good thing you know who you are, and what winning really is.”

Joe returned the campaign contribution, and he did not win the election. As his secretary Dave affirmed, Joe demonstrated who he was (and who he was not). He also clearly understood that “winning” is much bigger than an election.

Joe shared his morning’s events with our small business “leads” group at lunch that day.

At one point he took a deep breath, looked at each of us around the table, and said, “I have kids. They trust me and I try my best to show them how to live, how to face challenges and temptations. Frankly, I trust Jesus. He’s my example of how to live, and I can’t recall one instance of His being bought by anyone. Who’s He? He’s my Savior, the leader of my life. Who am I? I’m His disciple. Here’s the thing: If I’m already sold on Him, I can’t be bought by anything, or anyone else.”

Scripture reminds us, “Through him we received both the generous gift of his life and the urgent task of passing it on to others who receive it by entering into obedient trust in Jesus. You are who you are through this gift and call of Jesus Christ.”

Joe’s sharing challenged all of us to be continually aware of who (and whose) we are. If, as he said, you are already “sold on Christ,” you truly cannot be bought by anyone or anything else.

You’re already a “winner” in everything that truly, eternally matters, and no earthly, temporary thing can ever take that away from you. Ever.

The purpose of this chapter is to beautify and preserve the appearance of the City by requiring property owners and occupants to maintain grass lawns at a uniform height within the boundaries of their property and on abutting street right-ofway in order to prevent unsightly, offensive or nuisance conditions.

52.02 DEFINITIONS. For use in this chapter, the following terms are defined: 1. "Curb," "curb line" or "curbing" means the outer boundaries of a street at the edge of that portion of the street usually traveled by vehicular traffic.

2. "Cut," or "mow" means to mechanically maintain the growth of grass, weeds or brush at a uniform height.

3. "Owner" means a person owning private property in the City and any person occupying private property in the City.

4. "Parking" means that part of a street in the City not covered by a sidewalk and lying between the lot line or property line and the curb line; or on unpaved streets, that part of the street lying between the lot line or property line and that portion of the street usually traveled by vehicular traffic.

52.03 CUTTING SPECIFICATIONS AND STANDARDS OF PRACTICE. 1. Every owner shall cut, mow and maintain all grass, weeds and brush upon the owner's property (whether vacated or non-vacated) and adjacent to the curb line or outer boundary of any street, which includes the parking area abutting the owner's property, any time the vegetation reaches a height of more than 8 inches.

2. Every owner shall cut, mow and maintain grass, weeds and brush adjacent to the curb line, including the parking area abutting the owner's property, in such a manner so as to be in conformity with and at an even height with all other grass, weeds or brush growing on the remainder of the owner's property.

3. Every owner shall cut, mow and maintain grass, weeds and brush to the center line of any undeveloped City right-of-way, alley, or street adjacent and abutting the owner's property in such a manner so as to be in conformity with and at an even height with all other grass, weeds or brush growing on the remainder of the owner's property.

4. Nothing in this subsection shall be deemed to restrict the planting and cultivation of any crop raised or harvested for use or sale for agricultural purposes, such as corn, soybeans, hay or another generally recognizable agricultural crop on Commercial or Industrial land.

Land located in Commercial or Industrial zoning must also comply by mowing any ROW that is located on or adjacent to the property to avoid any vision impedance.

5. This subsection does not apply to grasses grown as agricultural crops on undeveloped property or to grasses growing in any area declared by the City Council to be natural woodlands or prairie habitat areas.

52.04 NOXIOUS WEEDS. 1. Every owner shall cut and control noxious weeds upon the owner's property (whether vacated or non-vacated) and adjacent to the curb line or outer boundary of any street, which includes the parking area abutting the owner's property, and to the center line of any adjacent undeveloped right-of-way, alley, or street, by cutting noxious weeds to ground level or use of herbicides to eliminate or eradicate such weeds.

2. Noxious weeds include any weed growth or plant designated as noxious by the State Department of Natural Resources rules and regulations or by the Code of Iowa.

52.05 NOTICE TO ABATE NUISANCE. Whenever a weed and grass control nuisance exists upon any property, a City official may serve notice upon the owner, owner's agent, or occupant of the property to abate the nuisance within forty-eight (48) hours or within a stated longer period if the City official determines it necessary to avoid undue hardship. Such notice shall be made by one of the following methods: posting the notice in a conspicuous place upon the premises where the nuisance exists, U.S. certified mail, or regular U.S. mail service. Any subsequent violation within the same calendar year may be abated without further notice.

52.06 FAILURE TO ABATE NUISANCE. The City or their agents may mow any property, which is not mowed by the above dates, and a charge of $75.00 per hour for such mowing, plus a surcharge of $100.00, will be charged to the property owner. Any property owners who fail to mow their properties, thus allowing the same to be mowed by the City or their agents, and who do not provide payment for the mowing within 30 days as required, will be assessed by the City for such costs, which will be collected in the same manner as general property taxes.

52.07 PLACING DEBRIS ON CITY STREET. It shall be unlawful for any person to throw or deposit upon a City street leaves, grass or any other landscape debris likely to be washed into the storm sewer and clog the storm system. Any owner, owner's agent, or occupant of the property in violation of this provision shall be subject to the following fine schedule: 1. First Offence: Written Warning 2. Second Offence: $50.00 3. Third Offence: $100.00 4. Every Offence Thereafter: $150.00 5. The City or their agents may clean deposited leaves, grass, or any other landscape debris which have been placed on the City Street and for which a fine has been issued, and a charge of $75.00 per hour for such work, plus a surcharge of $100.00, will be charged to the property owner. Payment shall be made in the same manner in which is described in 52.06.

SECTION 2. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

SECTION 3. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.

The purpose of this chapter is to beautify and preserve the appearance of the City by requiring property owners and occupants to maintain grass lawns at a uniform height within the boundaries of their property and on abutting street right-ofway in order to prevent unsightly, offensive or nuisance conditions.

52.02 DEFINITIONS. For use in this chapter, the following terms are defined: 1. "Curb," "curb line" or "curbing" means the outer boundaries of a street at the edge of that portion of the street usually traveled by vehicular traffic.

2. "Cut," or "mow" means to mechanically maintain the growth of grass, weeds or brush at a uniform height.

Reisinger of Osceola plans to attend Graceland College this fall to pursue a degree in agriculture business management.

“Hannah is a goal-oriented, determined and hard-working young woman who has taken every opportunity to expand her knowledge,” said Brandi Boyd, the high school FFA advisor.

“She has had great experiences through FFA conventions, hog shows, selling her own home-made honey at the local farmers’ market and working at the family’s car dealership that will provide a great background for her future career in ag.”
