D-308 loses appeal of lawsuit Judge upholds verdict in $2.5M trial over 2008 student death in classroom

By TONY SCOTT tscott@kendallcountynow.com An Illinois appellate judge has sided with the estate and the mother of a School District 308 student who died at Oswego High School in 2008 in a wrongful death lawsuit filed against the district.

In May of 2015, a Kendall County jury awarded $2.5 million to Mary Stewart, the mother of 18-year-old Jeffrey Stewart, and Stewart’s estate.

Court documents say Stewart collapsed and died of an asthma attack on Feb. 13, 2008.

“Stewart’s teacher, Stacy Harper, ran to Stewart’s side and told two students to go by foot to the other side of the building to get the nurse, but, contrary to school policy, Harper did not call or have someone call 911 for another 7 to 20 minutes,” according to court documents.

The school district appealed the jury’s decision, but the Second District Appellate Court of Illinois affirmed the jury’s decision last Wednesday.

According to the Appellate Court decision, the district argued that the Kendall County judge, Timothy J. McCann, “erred in: (1) denying its motion for a new trial, based on insufficient evidence of willful and wanton conduct (and denying its motions for a directed verdict and judgment n.o.v. on the same basis); (2) issuing a jury instruction that was not supported by the evidence; and, earlier, (3) denying

summary judgment based on section 2-201 absolute immunity and allowing the case to proceed to trial.”

The Appellate Court decision reads that while the district argued that siding with the Kendall County jury would create a precedent regarding teachers calling 911, they disagreed.

“The district argues that, if we affirm the jury’s decision here, we will create a burdensome policy of requiring an educator to call 911 each time a student faces harm,” the court wrote.

“We disagree. First, the district already has a policy that an educator must call 911 in response to a medical emergency. Second, each case is sui generis [Latin for “of its own kind”].

Each jury will evaluate the unique facts before it. Here, Harper certainly faced a medical emergency, with a student fighting for his life. Yet, Harper pursued a course of action that he must have known would result in a several-minute delay before a medical professional could provide instruction or aid. Under these circumstances, the jury could reasonably find that Harper’s course of action was willful and wanton.”

Oswego man arrested in sex case Arrest follows 3-month investigation into his contact with teen girl

By TONY SCOTT tscott@kendallcountynow.com The Kendall County State’s Attorney’s Office has charged a 55-year-old Oswego man with several felonies, including criminal sexual abuse, following a three-month investigation by the Oswego Police Department, in connection with his involvement with a 16-year-old girl.

Oswego police announced the arrest Thursday of Daniel Tondu, 55, of

the 200 block of Bluegrass Parkway in Oswego. Kendall County prosecutors have charged Tondu with: aggravated criminal sexual abuse (Class 2 felony), attempted aggravated criminal sexual abuse (Class 3 felony), indecent solicitation of a child (Class 3 felony), and grooming Daniel Tondu (Class 4 felony).

Police conducted a three-month investigation into a report taken this past May in which “a female juvenile reported contact of a sexual nature occurring between her and an adult male at a residence in the 200 block of Bluegrass Parkway in Oswego,” police said in a press release.

investigation after the parents of a 16-year-old female victim reported that she and Tondu had exchanged several text messages,” according to police spokesman Cathy Nevara.

“During the investigation, it was learned the texts were of a sexual nature and that Tondu had allegedly solicited the victim to perform acts of sexual conduct.”

A Kendall County judge issued a warrant for Tondu’s arrest on Wednesday, setting bond at $100,000, according to Nevara. Tondu turned himself in to the Oswego Police Department, where he was booked and released on bond, she said.

A pending court date is set for Sept.

8 at 8:30 a.m. at the Kendall County Courthouse in Yorkville, police said.

Vote on shooting range postponed Pushed back to Sept. 28

By TONY SCOTT tscott@kendallcountynow.com A Kendall County zoning panel postponed a vote on a proposed shooting range at the request of the range’s attorney.

The County Regional Plan Commission was slated to discuss and most likely vote on the proposed Dirt Road Range, planned for a 38-acre site at 16502 Church Road in southern Kendall County, just north of the Kendall-Grun-

dy county line, at its meeting Aug. 24.

However, Senior Planner John Sterrett received a letter from Yorkville attorney Daniel J. Kramer, representing the petitioner, Robert Delaney, stating that his client was still working on revised drawings and “additional matters to submit to your department and to the Regional Plan Commission.”

Delaney is asking for a special use agricultural zoning so he can build the range.

The Regional Plan Commission granted the request, and the item will be on the agenda for the next RPC meeting, set for 7 p.m. Sept. 28 at the Coun-

ty Office Building at 111 W. Fox St. in Yorkville.

At the commission’s July meeting, a standing-room-only crowd of neighbors at the meeting voiced objections to the range, saying they were concerned about noise, additional traffic, and its effect on property values.

The range would be operational starting at 10 a.m. Tuesday through Friday and 9 a.m. Saturdays and Sundays, and would close at 8 p.m. or a half-hour before dusk, whichever comes first.

It will have 24 shooting lanes with a shooting distance of 75 feet, according to county documents.

BRIEF Juvenile arrested in school bus theft in Oswego Township A juvenile faces a charge of motor vehicle theft in connection with the theft of a school bus, according to the Kendall County Sheriff’s Office.

Police said Naperville police located the bus in the parking lot of a church Aug. 25 at about 6 p.m. in the 2400 block of Wolf’s Crossing Road in Oswego Township.

Police said the juvenile who was found driving the bus was taken into custody and later released to their parents.

The assessed value of all property in Kendall County increased an average of 7.5 percent over last year, according to the county’s supervisor of assessments.

Andy Nicoletti, the county’s chief assessing official, collects assessments from the nine townships – including a three-township assessment district – to prepare for the county’s property tax collection process.

This year’s taxes, to be paid in 2017, will be based on 2013, 2014, and 2015 property values, Nicoletti said.

“The county, as a whole, went up about 7.5 percent,” he said. “It varied by township – some townships went up more than that, some townships went up less than that.”

Under state law, all properties – excluding those used for agricultural purposes – must be assessed at one-third their fair market value for property tax purposes.

Nicoletti said the highest increase took place in Little Rock Township – its overall assessed value went up a little more than 18 percent. The other townships increased as follows over last year’s assessments: Big Grove, 1.12 percent; Bristol, 10.2 percent; Fox, no change; Kendall, 7.02 percent; Lisbon-NaAuSay-Seward multi-township district, 4.95 percent; and Oswego, 5.57 percent.

Nicoletti said there is some control of property tax increases because of the Property Tax Extension Limitation Law, which was put in force by county voters in a November 1997 referendum.

Commonly referred to as the tax cap, the PTELL limits the total yearly increase in taxes extended, or billed, to 5 percent or the Consumer Price Index, whichever is lower. Nicoletti said CPI was 0.7, so “it’s not gonna be a huge increase.”

“In a PTELL county, the taxing districts set their actual levy, so if they need $1 million, they say, hey I need $1 million, and they divide that by the assessed value that’s within that district to come up with their rate,” he said. “Whereas, in a non-PTELL county, they set the rate and say, we want $5 per $100 of assessed value, so if assessments decrease that will affect how much money they’ll collect. The whole point of PTELL was to keep things from going way up or coming way down, and keeping it more of a rolling type situation.”

Residents could see increases in their tax bills, Nicoletti confirmed, but it depends on individual property values and the tax rates of the local government agencies.

“There is a potential for an increase in the taxes, but we are a PTELL county,” he said. “So typically as assessments increase, tax rates come down, and as assessments decrease, tax rates go up.”

Nicoletti said the tentative publication date for assessments in this newspaper is Sept. 15. Property owners have 30 days from that publication date to file appeal paperwork for an appeal with the county’s Board of Review, he said, which would be Oct. 17.

In the past couple years, approximately 500 people have appealed their property assessments to the county, Nicoletti said. However, he said residents should first try to negotiate with their local township assessor.

“The best thing to do when people get their assessment notice, or if they see the publication, is to contact their township assessor and talk to them about the assessment,” he said. “Because sometimes things can be resolved with the township assessor without having to go through the formal Board of Review hearing.”

Nicoletti said there are typically two issues that people have when they appeal an assessment.

“There are usually two avenues where people will pursue that – houses that are like theirs or larger within their subdivision are assessed for less than they are, or they have comparable sales of properties that show that their house is worth less than what it’s assessed for,” he said. “So they can go on market value or uniformity – those are basically the two avenues that they can pursue.”

However, like every year, Nicoletti stressed that nothing can be done once people receive their tax bills in the mail in May. The time to act is in the fall, when they see their assessments.

“There’s nothing that can be done by the time a tax bill comes out,” he said. “The 30-day window you receive in the fall is when you have the time to contest the assessed value.”

Incentives now part of doing business, sadly Concerned that Binny’s Beverage Depot might locate in a neighboring community, the Montgomery Village Board voted earlier this month to approve a sales tax incentive agreement worth $1.5 million to assure that the popular beverage purveyor would open a store in the village’s Ogden Hill shopping center at Route 34 and Route 30.

Then, just days later, the Oswego Village Board approved a sales tax incentive agreement worth $180,000 with Darden Restaurants Inc. to secure the development of a Longhorn Steakhouse on an outlot in the village’s Prairie Market shopping center along Douglas Road.

Developers/retailers know that municipalities – especially in neighboring communities with common borders hungry for more tax revenues – are in a weak bargaining position when it comes to their incentive requests. If the municipality takes a hard line and just says “no,” there is a real strong possibility the retailers and developers will take their plans to the next town down the road.

A further complication is that incentive requests put local officials in a very difficult spot politically. If they reject incentives out of hand, they run the risk of being party to their town losing a retailer or other business to a

neighboring town, but if they say “yes” they are accused of giving away the store to developers and retailers.

There was a time we can remember here – back in the 1980s – when developers and retailers did not routinely ask for any sales tax rebates or other incentives when seeking approval of their projects. But those days are long gone in Kendall County and across the nation as now developers, retailers and all manner of other of businesses routinely ask for rebates and other tax breaks for their projects.

For the sake of the taxpaying public, which ends up subsidizing the developers and businesses that benefit

directly from the incentives, we wish it weren’t so. But the hard reality is that incentives are now just part of doing business. It’s no longer a question of if a developer or business will ask for an incentive, it’s how much and what type?

Just saying “no” in most cases is not a viable option, especially in Oswego and Montgomery, which border each other along three key business corridors: Routes 34 and 30, and Orchard Road. As a result, when it comes to incentives it’s incumbent upon local officials to attempt to strike the best deal possible for themselves and their constituents.

Melons offered cool, sweet relief on hot days Like overbearing out-of-town relatives, they came early and stayed late. But it looks like the dog days of summer have finally left, and good riddance I say.

Now we move into early fall, and dog lovers all over the area will troop to the hardware store to pick up extra vacuum cleaner bags to deal with the annual shedding ritual. When we used to have Shelties, they lost their hair in bunches, which made locating them easier, I suppose. But it was still a pain.

The days of our bare feet sticking to the kitchen floor from excess humidity, I hope, are finally exiting stage right for another year.

Usually, the dog days (July 3 to Aug. 11) get here about the time the watermelons and muskmelons are really starting to come on, which, as far as I’m concerned, makes the whole uncomfortable exercise worth the trouble.

Both kinds of melons were big parts of my life during summers growing up, first on a farm and later on what were then the outskirts of Oswego.

I didn’t realize it when I was a youngster, of course, but we owe our friends in Asia and Africa a debt of gratitude for the gift of both muskmelons and watermelons.

The muskmelon, named for the musky smell of its ripe golden flesh, is probably native to central Asia, and has been cultivated since at least the beginning of the Christian era. In fact, it was one of the first Old World plants introduced in the New World by Europeans.

Meanwhile, watermelons were

REFLECTIONS Roger Matile first cultivated in the hot equatorial regions of Africa, most particularly the Kalahari Desert area. The melon was named for its extremely juicy red flesh, which is surrounded by a thick green rind.

My dad loved muskmelon, and we usually tried to grow them in the garden out on the farm. I guess I got my love of them from him, and like him, I like mine served with a light sprinkling of salt to bring out the flavor.

My cousin, Bill, however, introduced me to the joys of eating muskmelon with a scoop of ice cream. The old Fox Valley Snack Shop, located in downtown Aurora on Galena Blvd. about a half block east of what the Paramount Theatre – now the Paramount Arts Centre – but on the opposite side of the street, featured a lot of interesting specialties. One of their summer favorites was a half muskmelon served with a huge scoop of ice cream filling the cavity.

At first, I was not about to eat such a thing, but Bill was older and enthusiastic about the taste, so I agreed to try it. I still like that particular dessert on hot summer days.

Watermelon was one of the most popular summer picnic desserts during my childhood. When we’d have a picnic on someone’s farm, especially if they had dairy cows, the melons would be chilled in the milk

house coolers normally used to keep milk fresh until it was picked up for processing. Otherwise, a washtub was filled with water and a block of ice was chipped into small pieces and dumped into the tub to cool the melon.

After one of our typically huge picnic dinners – or if we were at the Gittlesons’, a hot dog roast over an open fire in the farm driveway – ice-cold melons were cut into slices and the slices quartered. To eat watermelon properly, you had to assume the proper position – slightly bent at the waist to keep the juice from dripping onto your clothes – and become expert at spitting seeds in those pre-seedless melon days.

Only old ladies ate their melon on a plate with a fork.

Some years ago, when I had our family movies transferred to video, one of the scenes brought back a vivid memory of summers in the early 1960s.

Our neighbors came over for a Fourth of July picnic that summer more than 50 years ago, and I remember that it was a HOT Independence Day. We ate outside, but the scavenger bugs were so bad we spent most of the meal swatting them away from the food and from ourselves – scavenger bugs bite.

When it was time for the watermelon, the bugs were drawn to the sweet melon in swarms that were so thick it was hard to eat a piece of melon without downing a scavenger bug or two. The home movie shows the entire group, slightly bent at the waist to keep the juice off, attempting to eat melon quarters while wandering around in a random manner and waving away the swarms of biting scavenger bugs.

Watermelons were also popular at numerous roadside stands back in those days. Every once in a while, you’d see a handmade sign along the roadside, advertising “Ice Cold Watermelon Ahead,” and it was hard to drive on past in the days before auto air conditioners. Those stands were especially popular out in Kansas where we used to visit relatives during those hot, dry 1950s summers.

Nowadays, we buy our watermelons in supermarkets already cut into quarters. This summer, I’ve bought my share. Last year’s crop was, on balance, horrible, but we’ve had a lot better luck this year.

Worse yet, modem muskmelons are relatively hard to find, and cantaloupe, which are apparently all the rage these days, seem to have been crossbred with cannon balls. Their flesh, especially that of California melons, is hard and tasteless. But if you can find a Muscatine muskmelon at either a farm stand or at one of our local farmers’ markets, you’re in for a real treat.

The old days of sweet melons as picnic desserts are also pretty much gone. Family picnics in our fragmented times are out of style, and you can’t find blocks of ice to chip with an ice pick anyway.

But when the dog days of summer start arriving, I’m still programmed to search for sweet melons. And their taste still takes me back to the hot but fun days of those times decades ago.

Our National Anthem has been back in the media recently, and once again it seems we don’t know how to react when we see an act of protest.

Last week, San Francisco 49ers quarterback Colin Kaepernick refused to stand for the National Anthem prior to a game against the Green Bay Packers. Following the game, Kaepernick told reporters he was “not going to stand up and show pride in a flag for a country that oppresses black people and people of color.”

Right away, social media warriors went to work, calling Kaepernick ungrateful, unpatriotic, arrogant, and a few other words that can’t get printed in a family newspaper. There were even cases of him being called that vile, repugnant N word, which kind of goes to show you that social media is a great showcase of irony.

VIEWS Tony Scott Now, we all have the freedom of speech to express what we think of Mr. Kaepernick. We can disagree with his decision and why he chose to make it. However, in our haste to express anger at what we see as disrespect, we should not call him un-patriotic or, even worse, un-American.

I have relatives and friends who have served in the military, as most of us do. We know that they have made sacrifices to their bodies, their minds, and their lives for this country. However, they did not die or fight for an anthem, or a pledge, or a flag. They fought, rather, for the ideals embodied in those symbols. They fought for

the freedom of religion, the freedom of the press, the right to bear arms and, yes, even the right to protest.

They fought for the right for a man to sit instead of stand when he feels his country is not doing enough for African-Americans when it comes to social justice. They also fought for people to remain silent during the Pledge of Allegiance, or to raise their fist during an Olympic medals ceremony, or to march in the streets using their freedom to assemble to protest police brutality or any other issue.

Also keep in mind that both the National Anthem and the Pledge are, relatively speaking, recent additions to our culture. The Star Spangled Banner, based on Francis Scott Key’s poem “Defense of Fort McHenry,” was not made our National Anthem until 1931 by an act of Congress. The Pledge was created by an ad writer for a mag-

azine to coincide with the Columbian Exposition of 1892. I would argue that the Constitution and Declaration of Independence both trump the anthem and the pledge.

Again, we have the right to criticize Kaepernick. He isn’t my favorite person, particularly as a QB who trampled over my Packers in the playoffs twice. And like most professional athletes, he’s loud and boisterous. He may not even be using this opportunity as a genuine protest. You don’t have to like what he did, or agree with his stance.

Still, he has the right to make such a stand. You can call him any name in the book – be creative! – but just don’t call him un-American. In fact, I’d argue he’s doing the most American thing any one of us can do.

Independent map needed

To the Editor: Ever since the midterm elections the push to put the Independent Map Amendment on the ballot for the upcoming election has been actively moving ahead.

The end result was amazing: over 500,000 Illinois voters signed a petition to put this issue on the ballot and polls show overwhelming support for it among Illinois voters. Nevertheless, the anticipated opposition by the politicians has been strong, and the issue is now before the Illinois Supreme Court.

Illinois government is broken. Career politicians rig elections by drawing legislative maps behind closed doors to benefit themselves. In the 2014 general election there was no challenger in 60 percent of legislative races.

To the Editor: I learned a valuable lesson today and want to pass it on to you because it is not common knowledge.

Three days ago my carbon monoxide detector began beeping in the middle of the night. I got up and checked it and saw that the backup batteries had not been replaced in more than a year. So I figured that was the problem. Replaced them and went back to bed.

This morning it began beeping again.

Replaced them and it beeped again. Got up and unplugged it, checked the batteries and they were good so I guessed it was the unit.

In some dim place in my memory I thought I remembered that they have a life of four or five years.

So I called 911 and said it was not am emergency but I asked to speak to the fire department.

“Our surplus of rock salt right now will help us get through this upcoming winter,” he said. “Which means I had to order significantly less rock salt.

Where we’re typically spending about $300,000 on rock salt, we’re only gonna spend about $75,000 on rock salt, so that difference is being applied to the road program as well.”

In past years, the village would seek bids in the spring, and then the road work would typically be completed in the fall just prior to asphalt plants shutting down for the winter, Hoppenstedt said.

“We did something different this

year, and we put it out to bid in January,” he said. “The bids came back in February, we were able to award the contract very early to Geneva Construction, who was the prevailing bidder, and they were able to schedule us as their first project of the year. We really like how that’s worked out for us, so we intend to continue to do that.”

As a result, the street improvement program work in the village this year is “substantially complete,” and it means that the village gets better prices in bidding, Hoppenstedt said. For next year’s program, the bids will go out in January, be awarded in February and then work should start in April, as soon as the weather breaks, he said.

“There might be a few punch list items remaining, but everything’s done and has been since probably mid-July,” he said. “So we’ve been very pleased with how that all worked out. We’re not under the gun, we believe that we got some better bid pricing because the contractors who were bidding the project didn’t have a full schedule. As their schedules fill up they put a little bit of extra money on it because if they’re gonna squeeze it in and get it done they want to make something off it. They’re ‘hungrier’ that early in the year.” ​According to Hoppenstedt, streets

Currently we feel like we have a strong chance at qualifying and being awarded financial assistance for Aucutt. If we are not awarded, this may be deferred out a year or two.”

At the July meeting, Village President Matt Brolley said he was pleased at how the bidding process and the road program worked out this year.

“I like to see us ahead of the curve,” he said.

Trustee faces disorderly charge OSWEGO LEDGER Montgomery police arrested a village trustee, Steve Jungermann, on a misdemeanor charge of disorderly conduct following an incident Aug. 15 in the 2100 block of Kathleen Court.

In a press release issued Aug. 25, police said they were dispatched to Kathleen Court at approximately 11 p.m. after Jungermann called them to report hearing fireworks in the area.

Upon arrival, police said they could not locate any evidence of fireworks and no one could positively identify the suspects who allegedly lit off the fireworks. After further investigation, police said they determined that a verbal

altercation had occurred before and during their investigation.

Police said Jungermann, who resides in the 2100 block of Emma Court, was arrested Aug. 23 in connection with the incident after residents signed complaints against him. Police said Jungermann is set to appear at the Kendall County Courthouse in Yorkville on the charge at 8:30 a.m. Oct. 6.

Jungermann has lived in Montgomery since 2007. He was appointed to the Montgomery Plan Commission/ZBA in 2009, re-appointed to a second term in 2013, and elected commission chairman February of that year. He was elected to a four-year term as village trustee in April of 2013.

BRIEF Oswego woman involved in boating mishap dies in Joliet ER

JOLIET – An Oswego woman died Wednesday in Joliet after a boating incident in Seneca.

Linda M. Young, 59, was pronounced dead at 12:15 a.m. Wednesday at the emergency room of Presence Saint Joseph Medical Center, according to the Will County Coroner’s Office.

Young was involved in a boating mishap Tuesday on the Illinois River in Seneca, according to the coroner’s office, and an autopsy determined the preliminary cause of death to be drowning due to injuries suffered in the incident.

The case is being investigated by the Illinois Department of Natural Resources’ conservation police.

More Montgomery streets will be paved during next year’s road improvement program and work is expected to be finished earlier than in past years, village officials said.

With greater than expected revenue from the non-home-rule sales tax approved by voters in November 2014, combined with savings on road salt for the upcoming winter, village public works officials told the Village Board at a recent meeting that they will be able to pave 3.74 more miles of streets next year.

The board unanimously approved a contract with Engineering Enterprises Inc. of Sugar Grove at a July meeting for $244,000 for design engineering for the 2017 Motor Fuel Tax and Infrastructure Road Program.

The road improvements will cover 7.7 miles of streets, according to Todd Hoppenstedt, the village’s public works director. “In addition, the plan includes crack sealing and patching in locations throughout the village,” he told the board.

Measure targets nonprofit thieves Rep. Wheeler wants stronger penalties

By TONY SCOTT tscott@kendallcountynow.com A local legislator and former board chairman for the Kendall County Food Pantry wants those convicted of theft from nonprofit organizations punished more severely.

Rep. Keith Wheeler, R-Oswego, has filed a bill stating that anyone convicted of theft from a nonprofit, 501(c)(3) organization be sentenced to one felony class higher than other convicted thieves. Theft that qualifies as a Class X felony would have a minimum penalty of seven years in state prison, according to the proposed bill.

Wheeler said he was spurred on by the alleged theft from the food pantry that is part of an ongoing law enforcement investigation. Wheeler served on the food pantry board until 2014.

Police executed search warrants on the food pantry building in Yorkville and a Kendall County residence in June. Police said the search warrants were part of an investigation regarding “suspicious transactions and possible theft of funds from the Kendall County

Food Pantry accounts.”

Six days after the search warrants were executed, Maria Spaeth, then the food pantry’s executive director, and her husband, Ken, resigned from their duties at the pantry, according to food pantry officials. Maria Spaeth, a Yorkville resident, was found dead two weeks later at her Lake Holiday vacation home of an apparent prescription drug overdose, according to DeKalb County Coroner Dennis Miller.

Recently, a new board took over the organization’s leadership and the name was changed to Kendall County Community Food Pantry Inc. Kendall County State’s Attorney Eric Weis announced recently that a special prosecutor has been assigned to the theft case. Judge Timothy McCann appointed a special prosecutor from the Illinois Office of the State’s Attorney Appellate Prosecutor.

Weis, a former food pantry board member, said the special prosecutor was needed “due to me being a potential witness in the case.”

Wheeler said the food pantry theft case has “hit home” for him.

“The issues that surround what happened here recently at the food pantry certainly hit home for me and my family,” he said. “The fact that what happened, and I don’t even know what

all happened, could have that much impact on an organization that takes care of so many people in multiple ways.”

Wheeler said he would like to see other reforms, but that he doesn’t want any such reforms to result in more costs for nonprofits.

“We’re going to look at other things as well, because I think there’s an education component Rep. Keith to this,” he said. “We Wheeler haven’t solved that mystery yet because, one of our goals is not to raise the cost of doing business for not-for-profits in Illinois, because it’s already hard enough to make it work.”

Wheeler said the penalty was justified because such a theft impacts an entire community.

“You’re not hurting one individual or one organization, you’re hurting so many,” he said. “Not-for-profits have a general purpose – that’s why they’ve been granted that 501(c)(3) status – but they’re serving a community. So the whole community is being taken from when these kinds of thefts occur. It impacts a larger entity – our community – and we think the penalty should be larger as well.”

Wheeler said he spoke with local prosecutors about the bill, including

“It wasn’t a long conversation when they realized the goal was to give them better tools, to make this more meaningful,” he said. “The punishment is going to be severe. Stealing from a nonprofit is going to become a felony.”

Wheeler said such a theft hits volunteers and donors hard.

“My wife and I have talked about this more than I can explain,” he said.

“We feel as though we were stolen from, because... the most substantial part of our not-for-profit giving, our charitable giving, for years has been the Kendall County Food Pantry. So whether it’s thousands of dollars, or in our case thousands of hours, both for us, frankly, it’s a meaningful thing. It just rips your heart out that anyone would do that, or could do that.”

Such a theft also makes donors question whether they should be giving to the organization, at a time when the nonprofit needs support from the community, according to Wheeler.

“You’ll see the ‘why’ behind this is really to protect those volunteers, to protect the people who are in need, and the donors from thinking that they shouldn’t put their money in their community,” he said. “They should. That’s the best place to put it. That’s why we put this together.”

4 new laws expand hunting, fishing opportunities

The laws were signed Saturday by Gov. Bruce Rauner during Conservation Day at the Illinois State Fair Aug. 20.

Senate Bill 2410 expands the youth license program to include trapping.

People younger than 18 may apply for a license, and must be accompanied by

an adult age 21 or older who also has a valid state trapping license.

House Bill 5788 added catfish to the list of fish that can be taken by bow fishing, or the use of specialized archery equipment to shoot them, and House Bill 4604 allows for permits to take bobwhite quail, chukars and gray partridge on public hunting grounds.

Both bills allow the Illinois Department of Natural Resources to set rules setting limits without requiring a state statute.

OSWEGO LEDGER School District 308’s class of 2016 has proven to be the best. For five consecutive years, District 308 students have consistently scored above the state ACT average, and this year they logged their highest overall composite score to date, according to information provided by the district.

This year’s 1,205 ACT-tested students had an average composite score of 21.5, above the Illinois statewide average composite of 20.8.

Moreover, District 308 students scored higher than the state average in all subjects: 21.2 in English, compared with a state average of 20.5; 21.1 in mathematics, compared with the state’s 20.6; 21.8 in reading, compared with 21.0 for the state; 21.5 in science, compared with the state’s 20.6; 21.5 composite, compared with the state’s 20.8.

“These best-ever average composite ACT scores provide greater opportunities for District 308 students,” said Superintendent Dr. John Sparlin in a statement released by the dis-

A score of 21 is generally accepted by higher education institutions as the minimum standard for being “college ready.”

As another measure of district success, the percentage of ACT-tested students who are ready for college coursework also outpaced the state average in every subject.

The percentages of college-ready ACT-tested students from District 308 show that: 72 percent are ready for college English composition coursework, compared with only 64 percent statewide and 61 percent nationally; 49 percent are college-ready in social science coursework, compared with 42 percent statewide and 44 percent nationally; 46 percent are college-ready in college algebra coursework, compared with 41 percent statewide and 41 percent nationally; 42 percent are college-ready in biology coursework, compared with 36 percent statewide and 36 percent na-

tionally; 30 percent are college-ready in all four subjects, compared with 26 percent statewide and 26 percent nationally.

Associate Superintendent Dr. Judith Minor echoed Dr. Sparlin and attributes this year’s higher average composite ACT test scores to the districtwide hard work and commitment of teachers, administrators, support staff, and students.

“The success of the graduating class of 2016 who took the ACT test spans all student groups and underscores the district’s commitment to better prepare all students for post-secondary success,” said Minor.

District 308’s ACT test scores have fluctuated slightly over the past few years, partly due to changes in scoring.

For example, in 2013, the district average composite scores slipped due to reporting changes that included the scores of students with special needs for the first time. In prior years, ACT results didn’t include the scores of students who took the test with extended time.

Property owners and tenants in Montgomery will be held responsible for illegal fireworks displayed on or shot off on their property under an amended ordinance adopted by the village board in a unanimous ballot Monday evening.

Montgomery Police Chief Daniel Meyers told the board that the ordinance is modeled after one adopted previously by the city of Elgin that allows police there to issue tickets to home or property owners where fireworks have been used.

Meyers said police will issue compliance tickets to those found in violation of the ordinance. “If they don’t pay it (the fine) then we’ll add it to their water bill,� Meyers said. “I think it is another tool that will help us combat

some of the fireworks complaints that we have received.�

Meyers said Elgin police issued 17 compliance tickets around the July 4th holiday this summer and police believe the ordinance has proven effective in curtailing fireworks use.

A portion of the ordinance reads: “...evidence of fireworks paraphernalia or other fireworks related debris which is found on the property shall be conclusive evidence that (fireworks activities) have occurred and the property owner and or lessee of such property shall be deemed responsible for such activities and may be subject to� penalties.

When questioned by board member Theresa Sperling, Meyers said until now village police officers had to witness individuals lighting fireworks before they could ticket them. “That very, very rarely hap-

pened,� Meyers acknowledged.

Village President Matt Brolley told board members he supported the ordinance because it grants village police some additional enforcement authority when dealing with individuals using fireworks.

Referring to the ordinance, Brolley said, “I like the fact that it takes it (enforcement) up a notch up and there is one more level of accountability. If you let people do this on your property you are going to end up with a ticket.�

Brolley noted that illegal fireworks have been a source for continuing complaints from village residents in recent years, especially in subdivisions west of Orchard Road.

He also noted the noise from fireworks can disturb residents – including veterans with post traumatic distress disorder – and pets.

Board member Denny Lee voiced support for the ordinance, noting that more people may now call in fireworks complaints since police will be able to issue tickets after they observe “evidence of fireworks paraphernalia.�

Flushing is scheduled to continue throughout September. Dates may fluctuate due to weather.

Illinois American Water conducts an annual flushing program of its water distribution system to help ensure continued high-quality water service.

Flushing the water system entails sending a rapid flow of water through the water mains.

As part of the flushing program, fire hydrants are checked and operated to help ensure fire protection in the community.

According to Richard Hermann, senior manager of field services and production for the Chicago Metro District, “Water main flushing is performed annually to ensure customers receive reliable and high-quality water service at their homes or businesses.

Flushing not only helps remove mineral sediment, which can accumulate in the pipes over time, but is also an essential maintenance procedure to ensure fresh water is delivered to our customers that meets state and federal drinking water standards.”

Illinois American Water will place signs in neighborhoods where flushing is occurring so residents are aware of the system work.

While the flushing program is underway, customers may experience a slight drop in water pressure or temporary water discoloration. Customers should refrain from doing laundry during the time of day the flushing program is taking place in or near their neighborhood.

If tap water is discolored, it is recommended that several cold-water faucets are allowed to run for a short time until the water runs clear. Using more than one faucet allows the water to clear faster.

After runs by Kyle Morrissey and Isaiah Emanuel, Joey Lumino capped the drive with a 20-yard TD for a 16-0 lead. Lumino added a 74 yard TD run for a 24-0 halftime lead.

The second half was much of the same as DeMarco and Nikolas Hampton added two more scores. The defense was led by Tyler Curtin, Antonio Hughes and Kyle Morrissey. The team is now 2-0.

Neuqua Valley 13, Oswego 8th grade Orange 0: The Orange defense was able

to stop Neuqua’s offense from getting any traction behind strong defense from the entire unit, including Jonathan Rivas, Anthony Cikauskas, Luke Childers and Dominic Karl.

Senior class set sights on big finish in Peoria Oswego’s Bennett Peterson, Oswego East’s Dylan Zangri leading early

By KRISTIN SHARP ksharp@kendallcountynow.com Situated just a few miles apart, the Oswego and Oswego East boys’ cross country teams are racing towards the same goals in 2016: a team qualification to the Class 3A state meet in November.

State experience returns for both programs, with Oswego senior Bennett Peterson and Oswego East senior Dylan Zangri qualifying individually last fall.

“Bennett is going to be at the state meet and his goal is to be All-State, but he knows what it’s like to be there alone and you can see that he’s taking to heart the idea that he needs to be there with his team,” Oswego coach Dan Whipple said. “The team is doing

a really good job working together and the seniors are being backed up real well by our junior class.”

Oswego returns a nucleus of seniors who have been part of the Panthers’ varsity pack for three years, including Collin Boone and David Gaytan.

Juniors Mitch Bradford, Joe Fioresi and Brandon Nelson along with sophomores Kyle Kelty, Brady Mello and Nathan Miller are also in the conversation to be in the top seven.

“We had a good talk over the summer about how far they’ve come and what they’ve learned, and how strongly they feel about their purpose on this team,” Whipple said. “So many of them were relied upon as underclassmen to be varsity runners and we’ve come to a point in the last year or two where the freshmen are allowed to be freshmen

and the sophomores are allowed to be sophomores. They’re part of a culture now where things are in line where they’re supposed to be.”

Oswego took a step closer to qualifying for state last year, finishing ninth at the sectional, but return five of its top seven from that roster.

“We spent a lot of time last winter and spring talking about racing with confidence and they did a good job learning how to deal with the pressure,” Whipple said. “We broke this season down to one main purpose, and that’s to get to the state meet. Everything else is extra.”

Oswego opens the season at the University of Wisconsin-Parkside Invite on Saturday.

Oswego East has two meets under its belt, racing at the Yorkville Invite

on Aug. 22 before traveling to Plainfield Central on Aug. 25.

The Wolves won the dual with a perfect score and five runners in the top five.

Zangri is the Wolves’ early front runner, with senior Jake Klancir, senior Bradley Thornton, junior Matt Blanco, senior Chris Smith and sophomore Will Roeder showing early promise in the top group.

“This is the first time in a few years that we’ve been senior-heavy, so that’s a good sign for us,” Oswego East coach Jim Milner said. “[Zangri] has the experience now and everyone is looking to him to show them the way, and he does the right things at practice, so he sets a great example. It’s definitely making the team a lot better.”

Oswego East now turns its focus to the T.F. South Invite on Saturday before a trip to Detweiller for the Peoria Woodruff Invite on Sept. 10.

The Class 3A girls cross country season will certainly be an interesting one this fall, with two competitive districts neighboring Oswego and Oswego East.

To the south, Minooka is defending the Class 3A state champion. To the west, Yorkville moves into the Class 3A field after winning five straight state titles in Class 2A. Oswego returns four runners from its 2015 state team as the Panthers made it to Peoria for the first time since 1987, and came away with a 19th-place finish. Sophomore Isabelle Christiansen, who finished 26th downstate in her high school debut last fall, will once again lead the pack with junior Grace Pagone, sophomore Ava Weyrich and junior Megan Berg returning from the state squad that had a 27-second split at Detweiller Park.

“We’ve made a ton of progress since June and had a really good week last week before we open up in Wisconsin,” Oswego coach Eric Simon said Oswego dropped out of the St. Charles East Leavey Invite after receiving an invite to the University of Wisconsin-Parkside Invite on Saturday. The Panthers race in the Joliet Central Steelmen Invite before the Richard Spring Invite hosted by Peoria Notre Dame at Detweiller Park.

Juniors Abby Flammersfeld and Kendra Standish are back for the Wolves while juniors Amanda Bonczkowski ad Isabella Gyori and sophomores Elyssa Gall and Katherine Sim expected to break into the top group. Freshmen Morgan Ede and Kara Webb are also fighting to keep up with the top 10.

“Kendra made huge gains this summer and Alexis has gotten better and better over the last couple years,” Oswego East coach Lisa Cook said. “Abby can run the 200 to the three-mile, so we’re expecting some pretty good things. Our focus is to get those three closer together.”

Oswego East completed its first race of the year at the Yorkville Invite on Aug. 22, and Standish led the Wolves with a time of 19:04.8 to place ninth. Henz (20:02.5), Flammersfeld (20:26.9), Gall (20:44.4) and Gyori (20:45.9) completed the top five. Yorkville won the invite with 22 points followed by Downers Grove South (53), Northside Prep (82) and Oswego East (101).

Wolves downed by Waubonsie Valley

The high school soccer season is still young, and so is the Oswego East boys’ soccer team.

In both cases, there is still time to grow, but there are sure to be pains along the way. The Wolves found out that lesson the hard way as they suffered a 3-1 defeat to Waubonsie Valley on Aug. 25.

“We have a lot of seniors, but we have a lot of guys who still don’t have a lot of experience,” Oswego East coach Steve Szymanski said. “Still, it’s two games in [to the season]; we’re not hitting the panic button.”

For much of the first half, the Wolves traded blows with the Warriors. Chances were created on both sides for the first 10 minutes of play, and possession was even throughout.

Then, Waubonsie Valley junior Rogerio Grimado opened the scoring with 30 minutes to play in the first half; his first of two goals in the game.

Oswego East (0-2) was able to counter quickly with the help of super-sub Nikhil Mohanty. The senior was able to come off the bench and create a quick opportunity, finding sophomore Ford Frazer on a long ball into the box. Frazer made a quick break past his defender, and headed the ball home for the equalizer with 15 minutes left in the half.

“I saw [Frazer] making that run, so I just hit it as hard as I could to that back post, and [Frazer] put a beautiful ball in the net,” Mohanty said.

“I saw I had an advantage over the defender, so I just used my speed over [the defender’s] strength to put the ball in the net,” Frazier recounted of his second goal in as many games to start this year.”

Much to the dismay of the Wolves, it would be all they could muster, and the 1-1 tie score would quickly evaporate. Waubonsie Valley notched another goal to regain the lead just six minutes later on a broken play. Warriors’ junior Giacomo Parrino was the beneficiary of the scramble in the penalty box, knotting the ball past Wolves’ sophomore goal keeper Nathan Huerter, to make the score 2-1 in favor of Waubonsie Valley.

The second half would open with the same score line, and a Wolves’ team that was quickly running out of gas. After a free kick was awarded to the Warriors just outside the penalty area, Waubonsie Valley put the game away with Grimado’s second goal: a beautiful shot that tucked its way into the near post.

Oswego East was unable to mount a comeback the rest of the way.

Oswego East fills lineup with emerging talent

By KRISTIN SHARP ksharp@kendallcountynow.com Opening the season with a rebuilding Aurora Central Catholic program didn’t give the Oswego East girls’ tennis team quite the first impression the Wolves hoped for.

Oswego East had no trouble sweeping the Chargers, 7-0, on Aug. 24, and Saturday’s Oswego East quad was rained out – leaving the Wolves to wait for Southwest Prairie Conference play to open this week for their first challenges of 2016.

“Overall, we’re all pretty excited about the possi-

bilities this year,” Oswego East coach Pete Conrad said.

Oswego East has a talented mix of returning seniors and promising newcomers and Conrad will play a stronger singles lineup against non-conference opponents. The lineup will change for SPC play, with a heavy doubles lineup instead.

“Our conference looks like it might be stronger in terms of doubles, so to compete, I think we’ll make some moves,” Conrad said. “A lot of things have changed. We lost Jaiere Harlow, who went to state every year for us, so that’s a big loss.”

Sophomore veteran Mary Weber will move from

the No. 3 singles court up to No. 2 singles, but will also pair up with freshman Eden Short to play No. 1 doubles depending on the Wolves’ opponent.

Junior Simran Singh is expected to play in multiple positions, and projected to play No. 1 singles against conference opponents.

Seniors Kertana Kota and Annie Carmody will pair up at No. 2 doubles after both graduated their previous doubles partners from last fall.

Seniors Angel Javier and Ravina Shah are slated to pair up at No. 3 doubles, and freshman Kaija Harlow and sophomore Niyta Chagoor will also make a doubles duo for Oswego East.

Panthers wrap up winning weekend in Plainfield

By KRISTIN SHARP ksharp@kendallcountynow.com Area volleyball teams opened the season with local tournaments at Plainfield North, and a co-host event between Oswego East and Metea Valley.

In a newly-formed 16-team Metea Valley-Oswego East tournament, the Wolves swept pool play with wins over Burlington Central (25-22, 25-9), Providence Catholic (17-25, 25-19, 25-17) and St. Ignatius (25-20, 27-25) to advance to the Gold Bracket.

“The girls found the attitude and commitment it took to win a game, so we went 3-0 against some very good teams,” Oswego East coach Adam Thurlwell said.

Oswego East (4-3) lost to Joliet Catholic 15-25, 23-25 in the semifinals, but finished the weekend with a 25-23, 19-

25, 25-21 win over Whitney Young to take third place overall.

“We came out flat against JCA, but we beat a very tall Whitney Young team – they were probably 6-foot all the way around, so we had a chance to play teams that gave us a lot of different looks,” Thurlwell said. “We’re headed in the right direction.”

Meghan Delaney finished with a team-best 70 kills over the five-match schedule with seven aces, four blocks and 31 digs. Autumn Augustine had seven aces and 32 digs, and joined Delaney on the All-Tournament team.

Sarah Schultz had 37 kills, Allison Bertrand had 12 kills and 25 digs and Mikayla Chevalier had six aces. Jalah Williams finished with five blocks and Hannah Bornemann made 70 assists while Katie Ayers had 49.

out at libero and she killed it,” Thurlwell said. “They had a great tournament, and it was good to see that senior leadership and the juniors acclimate to the team.”

On Friday, tournament participants also sent a touching message via Twitter to Rockford Lutheran – a team that withdrew earlier in the week to attend the funeral of a student that day. Large groups of players from pool play sites at Metea Valley and Oswego East held signs that read “Thinking of RLS.” “Rockford Lutheran had a tragedy at their school and couldn’t make it, so we got the girls together and took a picture. It’s a small school – 300 kids – so you can only imagine the impact that has,” Thurlwell said.

The Oswego girls’ volleyball team shook off some first game jitters to emerge from its opening tournament at Plainfield North with a 3-2 finish.

The Panthers (3-2) opened pool play last Friday and dropped a 26-28, 17-25 match to Lockport before falling to Sandburg 20-25, 23-25. Oswego moved into Bronze Bracket and went 3-0 to take 17th place overall. The Panthers defeated Plainfield North 25-18, 25-17, Wheaton Warrenville south 25-22, 25-11 and Shepard 24-26, 25-13, 25-18.

“Coming out for our first games of the season is always interesting because of first game jitters and not competing with each other for awhile.

Our match against Lockport showed that, as unforced errors (as every other team would say) essentially brought us to the stand still,” Oswego coach Matt Slechta said. “We are slowly learning the tempo that we want to consistently play at, and our hitters are slowly starting to connect with our setter.”

Oswego will continue its 15-match road trip against Rosary this week.

Two Oswego defenders got their hands on Minooka quarterback John Carnagio’s two-point conversion pass in the end zone and swatted it away Friday night to preserve the Panthers’ 7-6 win in the Southwest Prairie opener and season opener for both teams.

The Indians (0-1, 0-1) trailed Oswego (1-0, 1-0), 7-0, with 4:04 to play in the fourth quarter after Panthers quarterback Levi Olson found receiver Elliott Pipkin with a 44-yard touchdown pass.

Minooka started at its own 30. Carnagio’s passing and the running of Elijah Williams had the Indians at the Panthers’ 21-yard line in seven plays.

Carnagio then tossed a pass that almost hit the helmet of an Oswego defender but instead fell into the arms of Williams, who then outran two defenders to the end zone to cut the lead to 7-6 with 1:34 left in the fourth quarter.

Then lightning filled the sky over the stadium, and the game went into a weather delay for almost two hours.

When it resumed, Minooka brought its offense onto the field to go for the win.

The Indians split three receivers to the right side of the field. Carnagio rolled right, had time, and whistled a ball into the end zone, but it was knocked away. The Panthers recovered the ensuing onside kick attempt and ran out the clock.

“We wanted to dog their No. 1 (receiver) Isaiah Hill,” Oswego coach Brian Cooney said. “Our plan was to double-cover him. We knew from watching film that when their quarterback is pressured he will roll to his right, so we gave him the edge on the left and brought heat up the middle.

“He’s a pretty elusive quarterback when he needs to be. He got that throw off, but we had man coverage across the end zone. We had the sense they were going to go for two, so we used that hour and a half to our advantage.

I’m sure they did, too. We drew up the best defense with the best personnel that would put us in a position to win.

It turned out that it worked on this one.”

Carnagio talked about the offensive plays that helped the Indians drive for a score.

“The quick-game stuff was working on our last drive,” he said. “It was there the whole game. Something just got into us at that time, and we kicked it up a notch. We were able to drive it down the field.

“That was the first time we ran that play with that route. I told Elijah to look early. I ran up and threw it and it barely made it over the defender, but he caught it and shed a couple of defenders and scored.”

Carnagio completed 19 of 29 passes for 177 yards and a touchdown. He did not throw an interception.

The Panthers’ and Indians’ defenses held serve for the first three and a half quarters. Oswego sacked Carnagio four times. The Indians sacked Olson twice and forced and recovered a fumble.

“The main thing we have to do is forget about this,” Carnagio said. “We can’t do anything about it now. Offensively, we just have to step it up and execute better. Our defense played great. You can’t ask much more of them.”

Oswego will make its home debut at Ken Pickerill Stadium on Sept. 2, hosting Plainfield North. The Tigers start 1-0 start after a 40-8 victory over Oswego’s Elliott Pipkin (3) celebrates the Panthers’ lone touchdown score on Friday, Aug. 26, against Minooka.

Ivory Kelly-Martin makes debut with four TDs, 222 yards rushing

By DICK GOSS sports@kendallcountynow.com The debut of Ivory Kelly-Martin in the Southwest Prairie Conference trumped the SPC football debut of Joliet West on Friday night.

The Iowa-bound Kelly-Martin, a featured running back in Nazareth Academy’s march to the Class 5A state championship last season, transferred to Oswego East for the second semester of his junior year. All the 5-foot-11, 192-pound senior did Friday was rush for 222 yards in 24 carries and score four touchdowns as the Wolves ran past the Tigers, 49-14.

Kelly-Martin scored on runs of 1, 40, 1 and 26 yards, quarterback Jaylon Banks added a 35-yard scoring run and Chase Bruns kicked field goals of 34 and 32 yards for Oswego East, which led, 290, in the second quarter.

Joliet West got on the board late in the second quarter on sophomore quarterback Jaxon Aubry’s 8-yard pass to Terrence Neal. Aubry, who also threw a 20-yard scoring pass Johnny Holman in the third quarter, finished 28 of 50 passing for 307 yards. He was harassed by the Oswego East pass rush, was intercepted twice and the Tigers, who rushed for a net of 19 yards, lost two fumbles.

“I think our offense sputtered a little at the beginning,” West coach Jason Aubry said. “Before we figured out what we could do, we were quite a bit behind.

We just shot ourselves in the foot a lot.

We did not have good field position. We played an awful lot on our own side of the field. You can’t start inside the 10, and you can’t start with double sticks (20 or more yards to a first down after a penalty or huge loss).”

Jaxon Aubry’s top targets were Omari Ferguson, who caught 12 passes for 94 yards, and Holman, who grabbed six for 105. Kevon Dorris caught four for 32 yards and Neal three for 56.

“I wasn’t pleased with our offensive execution late in the second quarter and early in the third quarter, but our defense stepped it up and kept us in good shape,” Oswego East coach Tyson LeBlanc said.

In addition to turning the ball over four times, West was penalized 12 times for 102 yards.
