Time for Hometown Days Yorkville’s annual festival returns Friday, continues through Sunday KENDALL COUNTY RECORD Yorkville’s Hometown Days community festival returns tomorrow, Friday, through Sunday in Beecher Community Park on Game Farm Road.

Organized by the city’s park and recreation department with the active sponsorship of numerous local businesses including the First National Bank, the fest will again feature a wide variety of fun, family activities, including the Pride and Joy Car Show, baby contest, carnival, 5K run, and live musical performances.

The city is also bringing back one of the crowd favorites from 2015’s festival: the Ultimate Air Dogs Show.

Those attending can park in the designated grass area next to the track or these other nearby locations: Beecher Center, Yorkville City Hall, Yorkville Public Library, Yorkville High School, and Yorkville Freshman Academy.

Here is rundown on many of this year’s fest attractions:

Carnival

Sponsored by the Yorkville Congregational United Church of Christ, the free event will be held in the Beecher Building parking lot on Game Farm Road from noon to 4 p.m.

Some of the vehicles that will be on hand will be a Kendall Area Transit bus, Yorkville Police and Kendall County Sheriff’s Department vehicles, City of Yorkville Public Works Department equipment, a tow truck from Area 47 Towing, and semi from Fred Wayne Trucking.

Rush-Copley Family Area

The Rush-Copley Family Area will feature bounce houses, Touch-A-Truck and Jacob’s Well free comfort station.

Come cool off with Jacob’s Well or bring your kids for a fun and free time in the bounce houses. The Rush-Copley family area will be open from noon to 6 p.m. on Saturday and Sunday.

Ultimate Air Dogs Competition

Enjoy a show of courage and athletics, from dogs and their owners as they jump off a dock after a Frisbee into a pool of water.

Come as a spectator or compete with your own dog.

Open jump time is available on Friday evening from 5 p.m. to 7 p.m. The competition will run from noon to 6 p.m. on Saturday and 1 p.m. to 5 p.m. on Sunday.

Join the Yorkville Parks and Recreation Department and the Yorkville Public Library for a 5k fun run during the Yorkville Hometown Days Festival.

The race will start at 8 a.m. in the parking lot of the Yorkville Public Library (902 Game Farm Rd, Yorkville).

The race will then proceed north to Conover subdivision, then south to town square and then back to library to finish. Please see the race map for a full route of the race.

Sheridan, only a few weeks ago, sang at the famous New York Metropolitan Opera. He also sang last summer in Italy as the youngest person to sing in an opera. The 21-piece big band will play from 2 to 4 p.m. The Yorkville Big Band has been playing in Yorkville, for our local activities, since the band was founded by Dempster Junior High School Band Director Rick Falato in his retirement in 1993.

We’ll miss that old caboose when it’s gone For nearly a decade an old Burlington Northern Railroad caboose with the words “Cicero Yard Service” painted in white on its green exterior has sat quietly near the Illinois Railway’s tracks in downtown Yorkville.

The city of Yorkville purchased the caboose in 2007 at a cost of $10,500 from a Nebraska resident. The city purchased the caboose with the intent of one day restoring it and then putting it on display in its train-themed Bristol Station Park in the Whispering Meadows subdivision.

But those plans were – pardon the pun – derailed in 2008 when the

recession hit and the city found itself struggling to pay its own operational expenses.

While the city budget continues to shake off the effects of the recession, the estimated $20,000 to $30,000 needed to restore and the display the caboose is still not available. As a result, the city council, in a unanimous ballot, wisely voted last week to put the caboose up for sale.

We’re rail fans here at the Record and we’re hopeful that the city will be able to find a good owner who can restore and properly display the caboose. It’s important the caboose

be preserved since it is one of a dwindling number of such railcars.

Railroads were once required to have cabooses on all their freight trains as a safety feature.

But changes in federal transportation rules in the early 1980s allowed railroads to begin replacing cabooses with End of Train Devices (ETDs). The ETDs perform many of the functions once handled by rail crews in cabooses – without the expense of those crews.

Yes, we’re still disappointed that a prior city council went ahead and spent $10,500 in taxpayer funds to

purchase the caboose without a further financial commitment for its restoration. However, current city officials and taxpayers may be able to find some solace in the fact that city and other area residents have gotten some use of the caboose over the past nine years.

We know of several amateur and professional photographers who stopped to take its photo or use it as a backdrop for special event photos.

Like the photographers and our fellow rail fans who would stop often to gawk, we’ll miss that caboose when it’s gone.

Melons offered cool, sweet relief on hot days Like overbearing out-of-town relatives, they came early and stayed late. But it looks like the dog days of summer have finally left, and good riddance I say.

Now we move into early fall, and dog lovers all over the area will troop to the hardware store to pick up extra vacuum cleaner bags to deal with the annual shedding ritual. When we used to have Shelties, they lost their hair in bunches, which made locating them easier, I suppose. But it was still a pain.

The days of our bare feet sticking to the kitchen floor from excess humidity, I hope, are finally exiting stage right for another year.

Usually, the dog days (July 3 to Aug. 11) get here about the time the watermelons and muskmelons are really starting to come on, which, as far as I’m concerned, makes the whole uncomfortable exercise worth the trouble.

Both kinds of melons were big parts of my life during summers growing up, first on a farm and later on what were then the outskirts of Oswego.

I didn’t realize it when I was a youngster, of course, but we owe our friends in Asia and Africa a debt of gratitude for the gift of both muskmelons and watermelons.

The muskmelon, named for the musky smell of its ripe golden flesh, is probably native to central Asia, and has been cultivated since at least the beginning of the Christian era. In fact, it was one of the first Old World plants introduced in the New World

by Europeans.

Watermelons were also popular at numerous roadside stands back in those days. Every once in a while, you’d see a handmade sign along the roadside, advertising “Ice Cold Watermelon Ahead,” and it was hard to drive on past in the days before auto air conditioners. Those stands were especially popular out in Kansas where we used to visit relatives during those hot, dry 1950s summers.

Nowadays, we buy our watermelons in supermarkets already cut into quarters. This summer, I’ve bought my share. Last year’s crop was, on balance, horrible, but we’ve had a lot better luck this year.

Worse yet, modem muskmelons are relatively hard to find, and cantaloupe, which are apparently all the rage these days, seem to have been crossbred with cannon balls. Their flesh, especially that of California melons, is hard and tasteless. But if you can find a Muscatine muskmelon at either a farm stand or at one of our local farmers’ markets, you’re in for a real treat.

The old days of sweet melons as picnic desserts are also pretty much gone. Family picnics in our fragmented times are out of style, and you can’t find blocks of ice to chip with an ice pick anyway.

But when the dog days of summer start arriving, I’m still programmed to search for sweet melons. And their taste still takes me back to the hot but fun days of those times decades ago.

Our National Anthem has been back in the media recently, and once again it seems we don’t know how to react when we see an act of protest.

Last week, San Francisco 49ers quarterback Colin Kaepernick refused to stand for the National Anthem prior to a game against the Green Bay Packers. Following the game, Kaepernick told reporters he was “not going to stand up and show pride in a flag for a country that oppresses black people and people of color.”

Right away, social media warriors went to work, calling Kaepernick ungrateful, unpatriotic, arrogant, and a few other words that can’t get printed in a family newspaper. There were even cases of him being called that vile, repugnant N word, which kind of goes to show you that social media is a great showcase of irony.

VIEWS Tony Scott Now, we all have the freedom of speech to express what we think of Mr. Kaepernick. We can disagree with his decision and why he chose to make it. However, in our haste to express anger at what we see as disrespect, we should not call him un-patriotic or, even worse, un-American.

I have relatives and friends who have served in the military, as most of us do. We know that they have made sacrifices to their bodies, their minds, and their lives for this country. However, they did not die or fight for an anthem, or a pledge, or a flag. They fought, rather, for the ideals embodied in those symbols. They fought for

the freedom of religion, the freedom of the press, the right to bear arms and, yes, even the right to protest.

They fought for the right for a man to sit instead of stand when he feels his country is not doing enough for African-Americans when it comes to social justice. They also fought for people to remain silent during the Pledge of Allegiance, or to raise their fist during an Olympic medals ceremony, or to march in the streets using their freedom to assemble to protest police brutality or any other issue.

Also keep in mind that both the National Anthem and the Pledge are, relatively speaking, recent additions to our culture. The Star Spangled Banner, based on Francis Scott Key’s poem “Defense of Fort McHenry,” was not made our National Anthem until 1931 by an act of Congress. The Pledge was created by an ad writer for a mag-

azine to coincide with the Columbian Exposition of 1892. I would argue that the Constitution and Declaration of Independence both trump the anthem and the pledge.

Again, we have the right to criticize Kaepernick. He isn’t my favorite person, particularly as a QB who trampled over my Packers in the playoffs twice. And like most professional athletes, he’s loud and boisterous. He may not even be using this opportunity as a genuine protest. You don’t have to like what he did, or agree with his stance.

Still, he has the right to make such a stand. You can call him any name in the book – be creative! – but just don’t call him un-American. In fact, I’d argue he’s doing the most American thing any one of us can do.

To the Editor: I found three different and related articles in the Aug. 18 Record of interest.

The Forest Preserve board voted to not place a tax increase referendum on the November ballot. The discussion was that the board should not go to taxpayers for an increase until it has been assured that the most efficient use of current funds are in place. The same board voted to buy another horse for Ellis House. The same individuals, acting as the county board, went on record they would act on noise issues at private event venues in the county.

Best deal maker ever?

To the Editor: Donald Trump, aka the best deal maker ever, seems to be having trouble making deals along the campaign trail. The most recent failure centers around his purchase of over 3,500 hardback books titled “Crippled America: How to make America great again.” These books were purchased at full retail and given out at the convention. Even the least distinguished authors can get discounts up to 40 percent off books they buy themselves to give away.

Just the other day Mr. Trump had his landlord increase his rent on his cam-

paign headquarters in New York by over 400 percent to over a $150,000 month.

The Russians might be tougher negotiators than even Trump’s landlord.

Mr. Trump is also paying full retail to Tap Air Inc. to rent his airplane to fly all over the place. Mr. Trump is being criticized for traveling to localities where he has no chance of winning. But he has a nice airplane to ride in and is racking up frequent flyer miles and airplane costs.

These figures are from the Federal Election Commission, who tracks these sort of things from reports the candidate files.

So the best deal maker is paying out the nose for things he could get cheaper and therefore may not have as much money to spend on ads to promote his candidacy as the Election Day draws near and he tries to defeat “crooked Hillary.”

But if Trump Towers is raking in the rent, and Tap Air Inc., which Mr. Trump is the CEO, is raking in big fees for travel and the publisher of the book is getting full price and sending royalty checks back to the author, is Donald Trump a poor dealmaker? Or is he really a good businessman?

The assessed value of all property in Kendall County increased an average of 7.5 percent over last year, according to the county’s supervisor of assessments.

Andy Nicoletti, the county’s chief assessing official, collects assessments from the nine townships – including a three-township assessment district – to prepare for the county’s property tax collection process.

This year’s taxes, to be paid in 2017, will be based on 2013, 2014, and 2015 property values, Nicoletti said.

“The county, as a whole, went up about 7.5 percent,” he said. “It varied by township – some townships went up more than that, some townships went up less than that.”

Under state law, all properties – excluding those used for agricultural purposes – must be assessed at one-third their fair market value for property tax purposes.

Nicoletti said the highest increase took place in Little Rock Township – its overall assessed value went up a little more than 18 percent. The other townships increased as follows over last year’s assessments: Big Grove, 1.12 percent; Bristol, 10.2 percent; Fox, no change; Kendall, 7.02 percent; Lisbon-NaAuSay-Seward multi-township district, 4.95 percent; and Oswego, 5.57 percent.

Nicoletti said there is some control of property tax increases because of the Property Tax Extension Limitation Law, which was put in force by county voters in a November 1997 referendum.

Commonly referred to as the tax cap, the PTELL limits the total yearly increase in taxes extended, or billed, to 5 percent or the Consumer Price Index, whichever is lower. Nicoletti said CPI was 0.7, so “it’s not gonna be a huge increase.”

“In a PTELL county, the taxing districts set their actual levy, so if they need $1 million, they say, hey I need $1 million, and they divide that by the assessed value that’s within that district to come up with their rate,” he said. “Whereas, in a non-PTELL county, they set the rate and say, we want $5 per $100 of assessed value, so if assessments decrease that will affect how much money they’ll collect. The whole point of PTELL was to keep things from going way up or coming way down, and keeping it more of a rolling type situation.”

Residents could see increases in their tax bills, Nicoletti confirmed, but it depends on individual property values and the tax rates of the local government agencies.

“There is a potential for an increase in the taxes, but we are a PTELL county,” he said. “So typically as assessments increase, tax rates come down, and as assessments decrease, tax rates go up.”

Nicoletti said the tentative publication date for

assessments in this newspaper is Sept. 15. Property owners have 30 days from that publication date to file appeal paperwork for an appeal with the county’s Board of Review, he said, which would be Oct. 17.

In the past couple years, approximately 500 people have appealed their property assessments to the county, Nicoletti said. However, he said residents should first try to negotiate with their local township assessor.

“The best thing to do when people get their assessment notice, or if they see the publication, is to contact their township assessor and talk to them about the assessment,” he said. “Because sometimes things can be resolved with the township assessor without having to go through the formal Board of Review hearing.”

Nicoletti said there are typically two issues that people have when they appeal an assessment.

“There are usually two avenues where people will pursue that – houses that are like theirs or larger within their subdivision are assessed for less than they are, or they have comparable sales of properties that show that their house is worth less than what it’s assessed for,” he said. “So they can go on market value or uniformity – those are basically the two avenues that they can pursue.”

However, like every year, Nicoletti stressed that nothing can be done once people receive their tax bills in the mail in May. The time to act is in the fall, when they see their assessments.

“There’s nothing that can be done by the time a tax bill comes out,” he said. “The 30-day window you receive in the fall is when you have the time to contest the assessed value.”

By TONY SCOTT tscott@kendallcountynow.com City officials say they are limited in what action they can take in a dispute between tenants of a Yorkville apartment complex and their landlord regarding mold in some of the units.

Some residents of the City Center apartment complex on Route 126 began complaining to the city and Kendall County Health Department officials about mold in the units starting last spring.

Two reports on mold in the apartments were issued: one commissioned

by James Markby, the property owner, and another by the city. Both cleared Markby of the presence of toxic mold in the apartments.

However, at a City Council meeting held Aug. 23, one current tenant told aldermen she was still having issues at her apartment. She said the landlord came in and cleaned it but that the mold is back.

A former tenant, Racheal LaRue, said mold is still found throughout some of the apartments.

For his part, Markby said at the meeting that he has been cooperative with the city and that the residents’ complaints are not based on scientific data. “Through this process we’ve been very cooperative with the city, and also very patient; a very important process to go through,� he said. “You’ve heard from our residents, but not much from us. These commentaries by our residents have been emotional and, in fairness, speculative and not really based on data.�

Markby said the summary of the mold reports “is parallel.� “To quote the summary lines from each: cause of the microbial growth is due to hygienically unclean functional living space and the other saying (the mold is) due to lack of good housekeeping practices,� he said.

Markby said most of the residents in the complex are satisfied. “We have many residents that are very happy at City Center,� he said. “Many who have been with us since we took over in 2010 at that location.

Wheeler bill stiffens penalty for nonprofit thieves

By TONY SCOTT tscott@kendallcountynow.com A local legislator and former board chairman for the Kendall County Food Pantry wants those convicted of theft from nonprofit organizations punished more severely.

Rep. Keith Wheeler, R-Oswego, has filed a bill stating that anyone convicted of theft from a nonprofit, 501(c)(3) organization be sentenced to one felony class higher than other convicted thieves. Theft that qualifies as a Class X felony would have a minimum penalty of seven years in state prison, according to the proposed bill.

Wheeler said he was spurred on by the alleged theft from the food pantry that is part of an ongoing law enforcement investigation. Wheeler served on the food pantry board until 2014.

Police executed search warrants on the food pantry building in Yorkville and a Kendall County residence in June. Police said the search warrants were part of an investigation regarding “suspicious transactions and possible theft of funds from the Kendall County Food Pantry accounts.”

Six days after the search warrants were executed, Maria Spaeth, then the food pantry’s executive director,

and her husband, Ken, resigned from their duties at the pantry, according to food pantry officials. Maria Spaeth, a Yorkville resident, was found dead two weeks later at her Lake Holiday vacation home of an apparent prescription drug overdose, according to DeKalb County Coroner Dennis Miller.

Recently, a new board took over the organization’s leadership and the organization’s name was changed to Kendall County Community Food Pantry Inc. Kendall County State’s Attorney Eric Weis announced recently that a special prosecutor has been assigned to the theft case. Judge Timothy McCann appointed a special prosecutor from the Illinois Office of the State’s Attorney Appellate Prosecutor.

Weis, a former food pantry board member, said the special prosecutor was needed “due to me being a potential witness in the case.”

Wheeler said the food pantry theft case has “hit home” for him.

“The issues that surround what happened here recently at the food pantry certainly hit home for me and my family,” he said. “The fact that what happened, and I don’t even know what all happened, could have that much impact on an organization that takes care of so many people in multiple ways.”

Wheeler said he would like to see other reforms, but that he doesn’t want any such reforms to result in more costs for nonprofit organizations.

“We’re going to look at other things as well, because I think there’s an education component to this,” he said. “We haven’t solved that mystery yet because, one of our goals is not to raise the cost of doing business for not-for-profits in Illinois, because it’s already hard enough to make it work.”

Rep. Keith Wheeler said the Wheeler penalty was justified because such a theft impacts an entire community.

“You’re not hurting one individual or one organization, you’re hurting so many,” he said. “Not-for-profits have a general purpose – that’s why they’ve been granted that 501(c)(3) status – but they’re serving a community. So the whole community is being taken from when these kinds of thefts occur. It impacts a larger entity – our community – and we think the penalty should be larger as well.”

Wheeler said he spoke with local prosecutors about the bill, including Weis.

“It wasn’t a long conversation when they realized the goal was to give them better tools, to make this more meaningful,” he said. “The punishment is going to be severe. Stealing from a nonprofit is going to become a felony.”

Wheeler said such a theft hits volunteers and donors hard.

“My wife and I have talked about this more than I can explain,” he said.

“We feel as though we were stolen from, because... the most substantial part of our not-for-profit giving, our charitable giving, for years has been the Kendall County Food Pantry. So whether it’s thousands of dollars, or in our case thousands of hours, both of us, frankly, it’s a meaningful thing. It just rips your heart out that anyone would do that, or could do that.”

Such a theft also makes donors question whether they should be giving to the organization, at a time when the nonprofit needs support from the community, according to Wheeler.

“You’ll see the ‘why’ behind this is really to protect those volunteers, to protect the people who are in need, and the donors from thinking that they shouldn’t put their money in their community,” he said. “They should.

That’s the best place to put it. That’s why we put this together.”

Neighbors of the proposed Dirt Road shooting range in southern Kendall County voiced their objections to the range at the July Regional Planning Commission meeting.

At the commission’s July meeting, a standing-room-only crowd of neighbors at the meeting voiced objections to the range, saying they were concerned about noise, additional traffic, and its effect on property values.

The range would be operational

Tuesday through Sunday, starting at 10 a.m. Tuesday through Friday and 9 a.m. Saturdays and Sundays, and would close at 8 p.m. or a half-hour before dusk, whichever comes first.

The range will have 24 shooting lanes with a shooting distance of 75 feet, according to county documents.

The Yorkville Big Band will be starting its 23rd year of big band dancing in the Yorkville area. The Yorkville American Legion Post 489 will host the dance every third Sunday from September to May. The band’s first dance is Sept. 18 from 6 to 9 p.m., including a dance lesson with Patricia Ray from 6 to 7 p.m. followed by the Yorkville Big Band from 7 to 9 p.m.

A Kendall County zoning panel postponed a vote on a proposed shooting range at the request of the range’s attorney.

The County Regional Plan Commission was slated to discuss and most likely vote on the proposed Dirt Road Range, planned for a 38-acre site at 16502 Church Road in southern Kendall County, just north of the Kendall-Grundy county line, at its meeting Aug. 24.

However, Senior Planner John Sterrett received a letter from Yorkville attorney Daniel J. Kramer, representing the petitioner, Robert Delaney, stating that his client was still working on revised drawings and “additional matters to submit to your department and to the Regional Plan Commission.�

Delaney is asking for a special use agricultural zoning so he can build the range.

The Regional Plan Commission granted the request, and the item will be on the agenda for the next RPC meeting, set for 7 p.m. Sept. 28 at the County Office Building at 111 W. Fox St. in Yorkville.

There will be a benefit for Yorkville resident Sara Iobbi from 4 p.m. to close Oct. 1 at Southbank Original BBQ, 129 E Hydraulic St. in Yorkville.

Iobbi was diagnosed with breast cancer in June at the age of 29. She is currently undergoing chemotherapy and will have a bilateral mastectomy to follow. The $20 donation includes a BBQ dinner and one drink ticket. There will be live music, games, raffles and a silent auction.

Oswego resident arrested on felony sex abuse, other charges

By TONY SCOTT tscott@kendallcountynow.com The Kendall County State’s Attorney’s Office has charged a 55-year-old Oswego man with several felonies, including criminal sexual abuse, following a three-month investigation by the Oswego Police Department, in connection with his involvement with a 16-year-old girl.

Oswego police announced the arrest Thursday of Daniel Tondu, 55, of the 200 block of Bluegrass Parkway in Oswego. Kendall County prosecutors have charged Tondu with: aggravated criminal sexual abuse (Class 2 felony), attempted aggravated criminal sexual abuse (Class 3 felony), indecent solicitation of a child (Class 3 felony), and grooming (Class 4 felony).

Police conducted a three-month investigation into a report taken this past May in which “a female juvenile reported contact of a sexual nature occurring between her and an adult male

at a residence in the 200 block of Bluegrass Parkway in Oswego,” police said in a press release.

“Oswego police had begun the investigation after the parents of a 16-yearold female victim reported that she and Tondu had exchanged several text messages,” according to police spokesman Cathy Nevara. “During the investigation, it was Daniel Tondu learned the texts were of a sexual nature and that Tondu had allegedly solicited the victim to perform acts of sexual conduct.”

A Kendall County judge issued a warrant for Tondu’s arrest on Wednesday, setting bond at $100,000, according to Nevara.

Tondu turned himself in to the Oswego Police Department, where he was booked and released on bond, she said.

A pending court date is set for Sept.

An Illinois appellate judge has sided with the estate and the mother of a School District 308 student who died at Oswego High School in 2008 in a wrongful death lawsuit filed against the district.

In May of 2015, a Kendall County jury awarded $2.5 million to Mary Stewart, the mother of 18-year-old Jeffrey Stewart, and Stewart’s estate.

Court documents say Stewart collapsed and died of an asthma attack on Feb. 13, 2008.

“Stewart’s teacher, Stacy Harper, ran to Stewart’s side and told two students to go by foot to the other side of the building to get the nurse, but, contrary to school policy, Harper did not call or have someone call 911 for another 7 to 20 minutes,” according to court documents.

The school district appealed the jury’s decision, but the Second District Appellate Court of Illinois affirmed the jury’s decision last Wednesday.

According to the Appellate Court decision, the district argued that the Kendall County judge, Timothy J. McCann, “erred in: (1) denying its motion for a new trial, based on insufficient evidence of willful and wanton con-

duct (and denying its motions for a directed verdict and judgment n.o.v. on the same basis); (2) issuing a jury instruction that was not supported by the evidence; and, earlier, (3) denying summary judgment based on section 2-201 absolute immunity and allowing the case to proceed to trial.”

The Appellate Court decision reads that while the district argued that siding with the Kendall County jury would create a precedent regarding teachers calling 911, they disagreed.

“The district argues that, if we affirm the jury’s decision here, we will create a burdensome policy of requiring an educator to call 911 each time a student faces harm,” the court wrote.

“We disagree. First, the district already has a policy that an educator must call 911 in response to a medical emergency. Second, each case is sui generis [Latin for “of its own kind”]. Each jury will evaluate the unique facts before it.

Here, Harper certainly faced a medical emergency, with a student fighting for his life. Yet, Harper pursued a course of action that he must have known would result in a several-minute delay before a medical professional could provide instruction or aid. Under these circumstances, the jury could reasonably find that Harper’s course of action was willful and wanton.”

129th annual Sandwich Fair opens Wednesday

By PAT WALLIS news@kendallcountynow.com SANDWICH – The 129th annual Sandwich Fair will be held Wednesday, Sept. 7, through Sunday, Sept. 11, always the Wednesday through Sunday following Labor Day. The oldest county fair in Illinois has a new Hospitality Pavilion across from the familiar Round Office and the DeKalb County Sheriff’s Building.

The Pavilion will have flaps to protect fairgoers from rain and offer shade. It also provides tables and chairs for resting, greeting friends and eating that once-a-year favorite, Fair Food.

There are plenty of modern conveniences, as well. Besides having a topof-the-line website, sandwichfair.com, there’s a DeKalb County Sheriff’s and Emergency Care Center across from the Hospitality Pavilion, and handicapped-accessible exhibit halls, commercial buildings, lunch stands and restrooms.

Traditional horse races in the very early days of the Sandwich Fair were reported as being run through the heavily wooded fairgrounds, with some riders taking shortcuts, trying to beat their neighbors.

Now it’s harness racing on the halfmile track starting at 11 a.m. Wednesday, Sept. 7. No admission is charged.

Main Stage entertainment by the racetrack includes a free show at 6:30 p.m. Wednesday, Sept. 7, featuring lumberjacks competing in log-rolling on water, pole-climbing and cutting wood with buck saws. It’s first come, first served seating.

Visitors are invited to watch the lumberjack feats at other fairgrounds venues throughout the fiveday fair, free.

Tickets for the National Truck Pulling Association truck pulls held at 6:30 p.m. Thursday, Sept. 8, are $20 each per adult for Hot Seats, reserved seats and infield seats. Tickets for children age 12 and under are $5 for infield seats.

By JOHN ETHEREDGE jetheredge@shawmedia.com Property owners and tenants in Montgomery will be held responsible for illegal fireworks displayed on or shot off on their property under an amended ordinance adopted by the village board in a unanimous ballot Monday evening.

Police Chief Daniel Meyers told the board that the ordinance is modeled after one adopted previously by the city of Elgin that allows police to issue tickets to home or property owners where fireworks have been used.

Meyers said police will issue compliance tickets to those found in violation of the ordinance.

“If they don’t pay it (the fine) then we’ll add it to their water bill,” Meyers said. “I think it is another tool that will help us combat some of the fireworks complaints that we have received.”

Meyers said Elgin police issued 17 compliance tickets around the July 4th holiday this summer and police believe the ordinance has proven effective in curtailing fireworks use.

A portion of the ordinance reads: “... evidence of fireworks paraphernalia or other fireworks related debris which is found on the property shall be conclusive evidence that (fireworks activities) have occurred and the property owner and or lessee of such property shall be deemed responsible for such activities and may be subject to” penalties.

When questioned by board member Theresa Sperling, Meyers said until now village police officers had to witness individuals lighting fireworks before they could ticket them.

“That very, very rarely happened,” Meyers acknowledged.

Village President Matt Brolley told board members he supported the ordinance because it grants village police some additional enforcement authority when dealing with individuals using fireworks.

Referring to the ordinance, Brolley said, “I like the fact that it takes it (enforcement) up a notch up and there is one more level of accountability. If you let people do this on your property you are going to end up with a ticket.”

Four new laws that took effect Aug. 22 seek to expand hunting opportunities and fishing opportunities while protecting state lands and wildlife.

The laws were signed Aug. 20 by Gov. Bruce Rauner during Conservation Day at the Illinois State Fair.

Senate Bill 2410 expands the youth license program to include trapping.

People younger than 18 may apply for a license, and must be accompanied by an adult age 21 or older who also has a valid state trapping license.

House Bill 5788 added catfish to the list of fish that can be taken by bow fishing, or the use of specialized archery equipment to shoot them, and House Bill 4604 allows for permits to take bobwhite quail, chukars and gray partridge on public hunting grounds. Both bills allow the Illinois Department of Natural Resources to set rules setting limits without re-

quiring a state statute.

Under Senate Bill 3003, the department can offer free landowner hunting permits for deer and turkey as long as the landowner has at least 40 acres. The bill also combines the application for deer and turkey into one, and requires the department to hold a youth turkey season for two consecutive weekends instead of the current one weekend.

Department Director Wayne Rosenthal said in a statement that the new laws will “help our conservation efforts and will allow a new generation to develop a love for the great outdoors here in Illinois.”

Rauner, who hunts and fishes, called the youth bill an investment in young hunters and fishers that also promotes stewardship.

“Giving more opportunities to appreciate our resources to these young Illinoisans will ensure conservation of our lands for generations to come,” Rauner said.

Yorkville prepared for ‘seamless’ transition to Class 3A

After five consecutive Class 2A state championships, a new challenge awaits the Yorkville girls’ cross country team in November.

Yorkville makes the anticipated move into the largest class for the 2016 season, ending its reign at the Class 2A level now that its growing enrollment has pushed the Foxes into Class 3A. But with six of the seven returning from that state title team, hasn’t lost pace with the top teams in Illinois, ranked No. 2 in the preseason polls behind defending state champion Minooka.

“I truly believe they don’t feel the pressure this year. We’re brand new and we’re the underdogs,” Yorkville coach Chris Muth said. “That’s something they thrive on, and they have a lot to prove. They’re excited for the challenge, but they don’t have the pressure of winning five times in a row. They just get to be the first to do this in our program and that’s something they take excitement in.”

Sophomore Nicole Greyer is currently setting pace as the front runner for Yorkville, with senior Alexis Grandis, senior Maddie Dearborn and junior Alyssa Edwards returning as All-State finishers and giving chase with the lead group. They will be joined by sophomore Olivia Borowiak, sophomore Emily Eberhart, senior Julia Megazzini, sophomore Victoria Crawford, sophomore Colleen O’Connor and senior Piper Buyansky in the top 10.

“We have a lot of experience coming back, and you can’t discount that,” Muth said. “Freshman year is a long season for those just coming out and it’s great to have a top seven that doesn’t currently have a freshman in it, and

has that experience and knows what it takes to get there.”

In similar fashion, the boys’ cross country team was historic as a Class 2A competitor, having qualified in nine consecutive state meets since the IHSA divided the sport into three classes in 2007.

“I truly am excited for this team.

It’s a team that’s under the radar,” Muth said. “If they come together and keep gaining confidence, they can do some really good things by the end of the year. I think the goals are different from the girls team to the guys, but the excitement is still the same – that they get to be the first team in school history to do anything in 3A, and that’s a first no one can take away. They’re really excited to try.”

Senior Alexx Nauman is the early leader as junior Zach Price returns from an injury that kept him out of the track season, while junior Patrick Black also returns from last year’s third-place state team. Senior Brett Staufenberg, sophomore Alex Loos and junior Matt Cox are emerging early as well.

Yorkville opened the season with its annual Yorkville Invite on Aug. 22, and the Foxes swept both varsity races.

Nauman won the boys’ race in 15:56.9, and Borowiak won the girls’ race in 18:03.2.

“The kids were very tired from the previous day when we had a hard workout, so they were a little flat, but we were still able to come away with two wins,” Muth said.

Sleep apnea is most common in overweight men over age 40, but having a large neck size, large tonsils, or a large tongue can also be contributing factors. If you have reflux disease,

Jenna Fosnacht had three aces, two blocks and a kill while Sydnei Aver had two aces and four digs and Katie Nolan had two kills and three blocks.

Emily Gutzwiler had three digs and two blocks and Laiken Miller finished with 25 assists.

“Outstanding night for sophomore Corey Jacobson. He played very consistently on a long course with very large greens,” Newark coach Chad Baker said. “Breaking 40 is an accomplishment.”

Newark opened the season with a win over Earlville, 168-176. Cam Myre was the medalist with a 36, and other Newark scores came from Baker (41), Jacobson (41) and Snyder (50).

After winning three straight Barb Cups from 2012-14, the Barbs have now lost two straight Barb Cup finals as they were defeated by Yorkville 1-0 on Saturday in DeKalb.

The first half was back and forth, with both teams struggling for offensive chances, and the game was still scoreless at the half. In the second half, the Foxes came out and put consistent offensive pressure on the Barbs, which culminated in Bobby Reichert scoring for the Foxes in the 21st minute.

The Barbs sought an equalizer, but were turned away on two corner kick chances in the final few minutes, and Yorkville took home the 2016 Barb Cup.

“Yorkville’s got some size and experience on us,” Barb coach Brent McIntosh said. “We knew they would have those in their favor, and we wanted to take away some of their numbers. But I think we executed our defensive game plan very well, unfortunately it came down to one individual brilliant goal.”

Yorkville has now started the season 4-0, and looks to be a formidable opponent for the Barbs in upcoming conference play. But Foxes coach Andrew Johnson says that his team doesn’t take anything for granted from this early season victory.

“I’m more of a big picture kind of coach,” Johnson said. “The victory is nice and we know we can beat them, but at the same time we’ve given them some ammunition now. We’ve got the championship and that’s nice, but we’re going to need to stay focused when we come back to this field. We always play tight ball games with these guys, we never blow each other out. So it’ll be tough coming back, but we look

Yorkville has no answer for West Aurora’s twin talents

By KRISTIN SHARP ksharp@kendallcountynow.com Despite a chance to watch film over the 14-hour break between halves, the Yorkville football team could not find a way to stop West Aurora twin brothers DaQuan Cross and DaVion Cross.

West Aurora held a 19-3 lead over Yorkville in Friday’s season opener, but the game was delayed due to lightning just as the Blackhawks’ marching band was set to begin their halftime performance. Play resumed on Saturday morning, and DaQuan Cross added a pair of fourth quarter touchdowns to seal the Blackhawks’ 33-3 victory.

“West Aurora is a good team. We have to give them a lot of credit; they’re well-coached and have some tremendous athletes,” Yorkville coach Dan McGuire said.

“It was pretty evident that we can’t shoot ourselves in the foot against a good team. I think we showed some flashes where we’ve got some good players ourselves, but we just have to gain some confidence on both sides of the ball.”

Yorkville fumbled away its first possession of the game on the second play from scrimmage, and West Aurora answered five plays later with a 11yard touchdown run by Cionte Carter to give the Blackhawks a 6-0 lead with 7:16 to play in the opening quarter.

The Foxes were aided by a pass interference call late in the first period, and Brandon Lee ran for a first down to the West Aurora 10. The drive eventually stalled on the 15-yard line after a false start penalty and three incomplete passes by Yorkville quarterback Ty Liaromatis. McGuire opted to send sophomore kicker Cade Henry onto the field for the 32-yard attempt, and Henry put the ball through the uprights for a 6-3 game with 33.9 seconds on the clock.

The offensive struggles continued for Yorkville, with two plays for negative gains and a holding call that resulted in a fourth-and-26 situation.

“Our entire defense was pretty dominant. We dominated field position and it came down to the big stop we made where they had to kick a field goal after we had some penalties not go our way, I thought was big,” West Aurora coach Nate Eimer said. “DaVion and DaQuan

West Aurora added two more scores, with the first coming on a nineplay, 37-yard drive that ended with a 2-yard score by DaQuan Cross. Then, DaVion Cross intercepted Liaromatis and returned the ball 52 yards for the touchdown with 2:03 remaining in the first half to give the Blackhawks a 19-3 lead.

After a scoreless third quarter, DaQuan Cross (70 yards) scored a 14yard touchdown to cap a seven-play, 58-yard drive with 11:35 left to play in the game, and the Blackhawks added one more on their ensuing possession – another 14-yard TD from DaQuan Cross, which proved to be the final score of the day after a quick 50-minute

second half.

Despite the setbacks of Friday’s opener, Yorkville appeared to respond better in its return to the field on Saturday. The Foxes gained first down runs from Trent Delaney (13 carries, 76 yards) and Lee, and Liaromatis connected with receivers Jason Lewan and Austin Avery for better gains in the second half.

Yorkville’s best drive of the day came on its final possession. Andres Mata ran 9 yards for a first down at the West Aurora 27, and Avery caught a 12-yard pass from Liaromatis to put the Foxes at the 9-yard line. But the Foxes were pushed back for a 5-yard loss, a pass attempt in the corner of the end zone was caught out of bounds and Li-

aromatis was then sacked for an 8-yard loss on third down as the closing seconds ticked off the clock.

“We have some kids who have not played varsity football and when the lights turned on, I think our inexperience showed there,” McGuire said.

“But you have to give our kids a lot of credit for bouncing back and eliminating those mistakes. We just have to shore a few things up and continue to get better. We made some improvements from last night to today.”

Yorkville will make its home opener next Friday against Chicago Heights’ Marian, winner of a 53-16 season opener over Chicago Urban Prep/ Englewood. Kickoff is set for 7:15 p.m. at Campbell Field on Sept. 2.
