Metra chief cool to Kendall County service extension Suggests study funds could be better spent on other local project

mschury@kendallcountynow.com Metra Board Chairman Martin Oberman suggested Monday that Kendall County leaders may want to consider using $6.6 million in federal funding currently earmarked for studies for a possible extension of Metra commuter rail service into the county for some other project.

“If I were making the decision I’d say if I look at the odds of ever getting a railroad versus the odds of what I need today in terms of infrastructure or public works – I could use that $6.6 million for something I could sink my teeth into right now rather than a study that is going to sit on a shelf,” Oberman said.

The former Chicago alderman, who was elected chairman of Metra’s Board of Directors in 2014, spoke Monday during a task force meeting at the Historic Kendall County Courthouse in Yorkville. The meeting was set up

by U.S. Rep. Randy Hultgren, R-Plano.

Oberman stressed that no one was suggesting taking the money away from Kendall County but he added the funds could probably be redirected to another local transportation improvement project.

Oberman said it would currently cost between $200 million to $300 million to extend Metra service from Aurora to Kendall County, depending on how far west the service would extend.

“If it is physically impossible to do anything else with it, I suppose you might as well do the studies,” Oberman said. “If you want to say to me, ‘Listen, Oberman, we think you’re all wet, we think that we are such persuasive people that if we had our studies in hand we could get Springfield and Washington to give us the $300 million,’ then, OK, make that judgment. I just want us to make the judgment rationally.”

Oberman added that Metra has its own financial difficulties funding its existing infrastructure. He said the agency has $11.7 billion in capital needs.

“If we had the funds I’d put a train in every town where anybody wanted a train,” Oberman said. “We’re not against providing service to Kendall

County or any place else.”

Michael Gillis, a Metra spokesman, said after the meeting the $11.7 billion in capital expenses the agency is facing is the amount of money the RTA estimates that Metra needs to spend over the next decade to maintain its facilities in good repair.

“At best, we can expect about $2.8 billion during that same timeframe from traditional state and federal sources,” Gillis said.

Among those listening to Oberman during the meeting were elected officials, staff and mayors from Plano, Yorkville, Oswego, Montgomery and Kendall County. Also in attendance was former State Rep. Tom Cross and State Sen. Jennifer Bertino-Tarrant, D-Shorewood.

Cross said only a few years ago most people thought an Oswego Metra station was going to happen sooner rather than later.

“There was an expectation that this was going to get done,” Cross said.

Kendall County Board member Scott Gryder said he agreed with Cross that it felt like just a few years ago Metra service might become a reality here.

“It’s something that we expected to have happen and I think many people thought it would be done by now,” Gryder said. “We all know that government can move very slowly at times.”

Cross recalled about six or seven years ago the Illinois General Assembly passed a capital bill that was to in-

clude a portion of the estimated $125 million to bring the line from Aurora through Montgomery to Oswego. Cross said there was also talk that former U.S. Speaker of the House Dennis Hastert, R-Plano, was going to get about $75 million in federal funds for the project.

Cross said he recalled Hastert secured that $75 million for the project before leaving office.

“It may have been in or it may have been out – it sounds like it’s not there,” Cross said. “I realize life changes but that’s where the municipalities were coming from and where Oswego was coming from,” Cross said. “I was told to my face by Phil [Pagano, former Metra executive director] that this was going to happen.”

Pagano died in 2010.

Hultgren said they looked and can’t find the money to pay for the service extension anywhere.

“There has been some misunderstanding of what dollars are actually available and what dollars have actually been allocated,” Hultgren said.

“There have been other things floated out that there have been $75 million. I don’t believe that’s true, we have not been able to find that anywhere – if anybody can help us identify that.”

Hultgren said he feels like the engineering can get worked out later.

Larry Nelson, owner of Nelson Multimedia, spoke during the Kendall Country Board meeting March 1.

Nelson told the board that his lawsuit is not against the county but against the county coroner’s office.

“This surveillance video that is in question, and I think all of you are aware of it, it is what it is and it’s not going to change,” Nelson said.

“I would hope that we don’t go down the same road through the FOIA and through the courts because, somehow, I think at the end the county board and me and you, the taxpayers, are going to get stuck with the bill for the lawyer end of it and I don’t think that’s right.”

He added that the interests of the County Board are different than those of the coroner, who is an independent officeholder.

“I think the person who has signed on to defend the coroner is the state’s attorney office and the state’s attorney,” he said. “I don’t see how he can serve two masters in defending the coroner and representing the best interests of the Kendall County Board and the taxpayers in this case,” Nelson said.

Nelson also made reference to the fact that he heard the Illinois State Police were interviewing county employees.

“Also, recently, one of your employees, was interviewed by the state police I understand – the man in charge of building and grounds. He is an employee of yours. He is not an employee of the county coroner or the state’s attorney’s office, yet it would be my guess when the state police went in to interview him they said, ‘We’re here at the request of the coroner and the state’s attorney, I’m here to interview.’”

“That’s an unfair position to put that employee in and any other employee of the county board. They work for you,” Nelson said.

Illinois State Police District 5 Investigations Commander Nelson added that there are comments on the surveillance video about things the state’s attorney’s office has said.

He said the lawsuit could end up involving the state’s attorney, coroner and county board.

“You might need three attorneys before it’s over,” Nelson said.

When asked by the media if they had a public comment on what Nelson said, board members declined.

Weis added that he didn’t have anything to say.

“From the state’s attorney’s side we don’t comment on pending litigation and we’ve been told by the state police that we are not to make any comments, so we will not,” he said.

“I guess mum’s the word here,” County Board Chairman John Shaw said after no one on the board spoke up.

When asked if the board would appoint a special prosecutor to represent the coroner’s office, Shaw said he didn’t know.

“I have no idea if we are going to go with a special prosecutor,” Shaw said.

“I’ll defer to Mr. Weis on that.”

Weis added, “I have nothing in front of me to request a special prosecutor at this time so I have nothing at this point. And just so it’s clear I don’t choose to represent the coroner, that’s my statutory duty to represent the coroner.”

The Illinois State Police have been conducting a criminal investigation of the Kendall County Coroner’s Office over the past several weeks, State Police Lt. Richard Wilk, District 5 Investigations Commander, has confirmed.

Wilk declined to discuss the nature of the investigation because he said the agency does not comment on active investigations.

“It is a criminal investigation,” he confirmed.

The investigation began in February at the request of County Coroner Ken Toftoy, according to Wilk.

“Generally in situations of a conflict of interest we are called in to have an unbiased approach to look into any criminal allegations,” Wilk said. “It’s an active investigation and there’s not a whole lot I can comment on. We need to find evidence and that will dictate the direction we take.”

Toftoy declined to comment when questioned about the investigation.

According to Kendall County State’s Attorney Eric Weis, the investigation involves a Freedom of Information Act (FOIA) request Nelson Multimedia of Plano filed with Toftoy’s office in January. After the coroner’s office denied the FOIA request, the company filed a lawsuit in the 23rd Judicial Circuit on Feb. 8.

Nelson Multimedia owns the radio station WSPY-FM. The lawsuit seeks electronic copies of “all of the audio and video recorded from the closed circuit monitoring equipment and system(s) used in the lobby and reception area, the Main Entrance and Sally Port Entrance of the Kendall County Coroner’s Office (in Yorkville) between June 1, 2015 and August 31, 2015.”

According to the lawsuit, it ap-

pears Toftoy requested the investigation of his office before he sent a letter of denial to Nelson Multimedia on Feb. 4.

The letter says the ongoing police investigation is one of the reasons the FOIA request was denied.

The lawsuit includes a copy of the letter of denial from Toftoy’s office.

The letter states that Nelson Multimedia filed the FOIA request on Jan. 28 and the coroner’s office requested a five-day extension that is allowed under the Freedom of Information Act. The letter signed by Jacquie Purcell, chief deputy coroner, states that the records are exempt from disclosure because the records contain “private information and the disclosure of this private information is not required by any other provision of the Freedom of Information Act.” “The requested records contain personal information, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy,” according to the letter. The letter goes on to say that the material is the subject of a police investigation and cannot be turned over to Nelson Multimedia.

The letter concludes that turning over the records would “obstruct an ongoing criminal investigation by the agency that is the recipient of the request.”

Under the FOIA Act, Nelson Multimedia has the option of having the denial reviewed by the Illinois Attorney General’s Public Access Counselor.

Candidates seeking election to county office next Tuesday should remember to obtain final unofficial voting results Tuesday evening they

The number of registered voters in the Aurora potion of the county is small compared to the rest of the county but there are certainly more than enough Aurora votes to change the outcome of races for coroner and county board district 2.

When reindeer were sent to solve a non-crisis in Canada REFLECTIONS Roger Matile On March 9, 1898, the Kendall County Record’s Oswego correspondent Lorenzo Rank noted that a group on its way to the Klondike gold fields in Canada had steamed through Chicago by rail: “The outfit went through Chicago one day last week, and consisted of 539 reindeer and 118 Laps, including the women and children.”

Reindeer? Laplanders? Yep, right here in northern Illinois.

As you may recall, gold was discovered in the late 1890s up in the Klondike River region of Canada’s Yukon Territory, resulting in the Klondike Gold Rush, and more than a few years later, “Sergeant Preston of the Yukon,” who with his great lead dog King went sledding along on both radio and TV. Back to the reindeer. It took a year for word of the gold strike to get back to the Lower 48 States, but when it did the media created a firestorm of gold lust. Tens of thousands of Americans and Canadians headed to the Yukon, either to Washington State and from there north along the coast to Juneau and then on through Alaska to Skagway, or overland through Canada where Edmonton in British Columbia was the jumping off place for the gold fields.

Her ongoing education and training as well as her countless certifications, professional affiliations and 12 years of experience as a full time deputy coroner in the Kendall County Coroner’s Office make her the best fit for the job.

Knowing Jacquie personally, we have spoken to her multiple times about why she wants this opportunity. Naturally, she sees this as the next logical step in her career. This would be a great move for her and the perfect opportunity to continue to serve the taxpayers of Kendall County.

As a current employee of the Kendall County Coroner’s office, Jacquie relayed to us that she is on call about 285 days of the year. Why wouldn’t we want someone who is already dedicating so much time and effort to the coroner’s office?

With the recent escapades in the coroner’s office, we taxpayers are not looking forward to another lawsuit that will come out of our pockets. With Jacquie in charge, we don’t foresee anything like that being an issue ever again.

The Kendall County Board for many years now has tried to just ignore Todd, thinking he will just run out of steam; little by little he has continued to bring significant issues--which are just wrong-into focus for the rest of us to read about. Oswego Village President Gail Johnson said she felt they should move forward with the studies.

“If the study is going to tell us some of these things and I think we ought to get that information from the experts rather than me making up whether my constituents will bear it,” Johnson said.

“I don’t mind continuing the conversations about what if – I mean I’m from the generation that thought we were going to have George Jetson-style hovercrafts by now,” she said. “My concern is that the faces around this table change every two years and so if we don’t have the willpower to pull the trigger and say ‘Let’s get this study done’ … we’re going to keep pushing it out.”

Johnson added that Kendall County’s population is expected to grow exponentially over the next few decades.

“We’re going to have an onslaught and are expected to double within the next 20 years. Kendall County is still the fastest growing county in the state by quite a bit,” Johnson said. “We just want the studies done so that when federal money becomes available we can say we need a piece of that – without that [study] we have nothing.”

The Village of Oswego funded a study in 2002 looking at bringing a Metra station to the village. At the time the estimate for that site was around $100 million.

Hultgren suggested the group to meet again in a few weeks to discuss how to move forward with the remaining funding. He said that in the next

few months they need to figure out if they want to move forward with the engineering studies.

“What I think we take away from this is common commitment to look forward to what’s good for Kendall County, a common commitment that this money was intended to be used here and should still be used here,” Hultgren said.

Johnson said they need to get beyond “guesstimates.”

“Right now we have nothing ready,” Johnson said. “Right now all we are asking for is those studies to be completed so that we know the true costs and we can talk to our residents about joining the RTA if that’s the direction we decide we are going.”

Cross said everyone in the room realizes it’s going to take some time and financing is hard to come by at the state and local level, but they have to at least ask if they expect to make progress.

“For folks that don’t live out here – it takes me, if I’m lucky, an hour and a half to two hours to drive into the city of Chicago; on a bad day it takes three hours – that’s insane. That’s bad for the economy, that’s bad for my blood pressure, it’s bad all around,” he said.

A Yorkville man was arrested Sunday following a hit-and-run crash at the intersection of Dickson Road and Route 30 in Montgomery.

Peter J. Holich, 28, of the 1300 block of Evergreen Lane in Yorkville, was charged with leaving the scene of a property damage accident, driving on a suspended license and a Kendall County failure to appear warrant for a charge of improper use of a credit/ debit card.

Holich was later located and taken into custody by Sugar Grove police when his vehicle was parked at the Aldi supermarket along Route 47 in Sugar Grove. He was detained by Sugar Grove police and transfered to Kendall County sheriff’s deputies, at which point charges were filed. He was also cited for failing to reduce speed to avoid an accident and operating an uninsured motor vehicle.

Sheriff’s deputies honored for saving lives

mschury@kendallcountynow.com The Sons of the American Revolution’s (SAR) Fox Valley Chapter along with the Kendall County Board and Kendall County Sheriff’s Office recognized three Kendall County sheriff’s deputies during a recent Kendall County Board meeting for lifesaving acts of heroism.

The honored deputies are Jason Larsen, Tyler Johnson and Zach Tongate.

Mike Campagnolo, president of the Fox Valley Chapter Sons of the American Revolution, said the group presents its awards to law enforcement agents, firefighters and EMS (emergency medical service) personnel.

Campagnolo attended the meeting along with Vice President Rod Herbig and Jon Fixmer, the group’s genealogist. Herbig and Fixmer were dressed in full Revolutionary War era regalia, including tricorn hats. They presented each of the deputies with their organization’s Law Enforcement Commendation Medal and Certificate.

County Sheriff Dwight Baird also presented them each with his office’s Lifesaving Award. Finally, the county presented each law enforcement officer with a special recognition plaque.

Baird read a short description of what each man did to deserve his recognition.

On Jan. 1 at about 1:40 a.m. Johnson responded to a report of a vehicle that crashed into a pond in Oswego, Baird said. Johnson arrived at the scene in one minute and saw the vehicle was 100 feet off the shore, was sinking and was occupied. The temperature was in the mid to low teens that night, Baird noted.

“Deputy Johnson quickly entered the frigid waters and swam out to the car,” Baird said, adding “Deputy Johnson used his expandable baton to attempt to break the driver’s window but was unsuccessful. As the car continued to sink he then attempted to break the backseat window but was unsuccessful.”

Johnson was able to break the back window and pull the female occupant from the car, Baird explained.

“Deputy Johnson then started swimming with the female towards the shore where he was met by firefighters and he helped get the female into a boat. He was nearing the point of exhaustion and hypothermia when he then returned to the submerging car and he stood on it until the car sunk and he could no longer stand,” Baird said. “He then started swimming back to the shore where he was met by firefighters and they took him back to the

shore.”

The next deputy to receive recognition was Deputy Larsen.

On Oct. 12, Larsen responded to a call of a male believed to have overdosed from heroin, according to Baird.

“Deputy Larsen observed a male subject laboring and his skin was gray in tint. Deputy Larsen then administered two milligrams of Narcan to combat the effects of heroin or opiate,” Baird said.

The male subject started breathing normally and regained consciousness.

Paramedics arrived and transported him to the hospital where he has entered into rehab, Baird told the audience.

Deputy Tongate was the final deputy to receive recognition. On Dec. 29, Deputy Tongate responded to a report of an individual who fainted and was barely breathing.

Tongate arrived in three minutes and found the male unresponsive and unconscious, according to Baird. A friend was performing CPR but the man was not breathing. Tongate used an automatic electronic defibrillator on the male subject, providing a shock.

Tongate then continued CPR until paramedics arrived and the male subject survived, he said.

“Party for a Purpose,” a St. Patrick’s Day fundraiser for a new Yorkville school for regular and special education students, will be held from 6:30 to 9 p.m.

This year the theme is “An Evening in the Enchanted Forest.” The dance is set for Saturday, April 9, from 6 to 8 p.m. at Yorkville High School.

KENDALL COUNTY RECORD Pack 350 of Yorkville hosted its annual Blue and Gold event in which seven Webelos Scouts received their Arrow of Light award.

The following earned their Arrow of Light: Carmine Cinardi, Jonathan Doucette, Paul Emmert, Eric Montano, Jack Ward, Ryan Weiss and Benjamin Whaley.

Upon receiving their award, Webelos Scouts cross over into Boy Scouts. Three each from Pack 350 will join local Troops 34 and 40. Scouts joining Troop 40 will include: Emmert, Montano and Ward. In addition, Cinardi, Doucette and Whaley will become members of Troop 34. At the Pack 350 Blue and Gold, Troop 40 assisted with performing the crossover ceremony.

The Arrow of Light is the highest recognition bestowed upon Cub Scouts. Newark closes first season under coach Barb Scott

Newark girls basketball coach Barb Scott is thankful she had the opportunity to work with the Norsemen for the first time in her coaching career. In Scott’s debut, the Norsemen ended up 18-10 overall and 6-2 in the Little Ten Conference.

“I enjoyed every minute of my experience,” Scott said. “I had a great group of girls who worked hard every single day, encouraged and supported each other and enjoyed playing the game.”

Scott especially credited the seniors – Megan DiClementi, Kelsea Zitt, Morgan Myre and Madison Friestad – who played their last game as Norsemen in the Class 1A Gardner-South Wilmington Regional final, where Newark lost to Indian Creek, 49-31. The Timberwolves went on to place third in state. “[The seniors] set a great example for the younger girls to follow,” Scott said.

“I felt honored to have the opportunity to coach them for their senior season.”

Newark’s season started at Somonauk’s Breakout Tournament, where it went 2-2. After a four-game losing streak playing without junior Jasmine Mitchell (who was on a missions trip), the Norsemen went on an eightgame winning streak. They finished fourth at the Lisle Christmas Classic and were 10-6 going into 2016.

Newark ended up finishing third at the Little Ten Conference Tournament behind Indian Creek and Serena and also finished third in the overall conference standings. Mitchell, Zitt and DiClementi were named to the All-Conference team. Mitchell led Newark with 15.8 points and 10.6 rebounds a game and is a three-time All-Conference selection. Zitt, a two-time selection, was next with 12.5 points, 6.1 rebounds, 4.3 assists and 4.2 steals per game.

Mitchell will lead the pack of returning players next year that also include sophomores Alyssa Schofield, Riane Tomsa, Reegan Skelton, Mikayla Williams and Becca Sweeney and freshman Alyssa Gittins.

Spirit Cheerleading competed in the GLCC Showdown at the Renaissance Schaumburg Convention Center last weekend. Spirit took eight teams – six full season and two prep teams.

Spirits prep teams Frenzy and Ambition both won first place and the Spirit award. All six full season teams placed.

Envy won sixth place, Team Pride won fifth place, Team Inspire won third place, Team Legacy won second place, and teams Passion and Int3nsity won first place. As the competition season schedule comes to an end, Spirit will enter the American Championships next weekend, the US Finals and Summit in April, and Spirit’s local spring rec competition in May. Correction : Spirit Cheerleading’s most recent team recap omitted the placement of Team Passion in Atlanta, Ga., at Cheersport. The squad captured fourth place in the large event.

Yorkville Middle School: Last weekend, the Foxes competed in their sectional tournament at DeKalb-Huntley Middle School. Engelhardt ‘proud’ of Yorkville squad’s season accomplishments

In his six seasons as the Yorkville girls basketball head coach, Luke Engelhardt has produced five winning seasons with the Foxes.

The most recent season, the Foxes finished 25-3, which fell just shy of the program record 26-2, which was set in the 1980-81 season.

This was also the Foxes’ first undefeated Northern Illinois Big 12 Conference finish at 13-0. The season ended in the Class 4A Yorkville Regional title game, when Neuqua Valley defeated Yorkville, 48-41.

“Going undefeated [in the conference] this season was no joke, and being in the game in another regional final and being in the gym. It was an exciting atmosphere,” Engelhardt said. “I’m extremely proud of the kids. They

didn’t quit. [This was a] great group of kids and I’m sad the season is over. I’m extremely proud of everything they did.”

Yorkville’s first loss of the season came against eventual Class 1A third-place finisher Indian Creek in the first game of the year at IMSA’s Hoop Happenings Tournament. The Foxes won the next 11 games before falling to Kaneland in the title game of Ottawa’s Christmas Classic.

The Foxes built a 14-game win streak in 2016 until the loss to Neuqua Valley. Going undefeated in conference helped junior Katie Nolan win the East Division’s MVP honor. Sophomore Lauren Daffenberg was also named to the NIB12 First Team while junior Audrey Macciomei and senior Sydney Beach were Honorable Mention.

The Foxes graduate six seniors – Beach, Aynia McGowan, Brooklyn Mispagel, Bekah Hahn, Eri-

ca Cyko and Clarissa Perez. The bulk of the scoring will return, including Nolan, Daffenberg, Macciomei, sophomore Lindsay Harrison and juniors Ellysse Trembley, Hayley Farren and Jasmine Bracero.

Nolan led all scorers at 12.8 points per game (IBCA Fourth Team All-State), followed by Daffenberg (10.8 ppg; IBCA Special Mention All-State), Harrison (7.8 ppg) and Macciomei (6.9 ppg).

Harrison’s 49 blocked shots were the most ever in a single season.

“I couldn’t have had more positive kids,” Engelhardt said.

“We’ve set the standard, and now we have to keep up with it. Our future is bright, as long as the kids keep working at it.”

The Newark boys basketball team continued its winning ways after the Norsemen defeated Flanagan-Cornell 53-46 in overtime in the Class 1A Marquette Academy Sectional final on Friday in Marseilles.

Newark (28-2) claimed its fifth sectional title in seven years to advance into the Elite Eight for the first time since 2013.

“It was fun to play a team that sound. It’s unfortunate we both can’t advance,” Newark coach Rick Tollefson said of Flanagan-Cornell (265). “We really appreciate getting here, and we are going to try and enjoy it.”

Last year, Flanagan-Cornell defeated Newark in overtime for the sectional title. The Norsemen were relieved to be on the winning side this time.

“It was a dark feeling [last year].

That same day, Evan [Schomer] and I said we were not going to let that happen again,” Newark senior Jack Clausel said. “It felt good to come alive. We really pulled this one out.”

At the end of regulation, the game was tied at 44. Newark led 42-37 with 3:21 to play in the fourth quarter before Flanagan-Cornell went on a 7-0 run to hold a 44-42 with 40.1 seconds remain-

Norsemen fall one game shy of state tournament with loss to Panthers

The Newark boys basketball team was certainly not ready for its season to come to a close at the Class 1A Illinois State Supersectional on Tuesday.

The Norsemen had high expectations for a state run, but saw their impressive season come to a close against LeRoy. The Norsemen played against, perhaps, the most talented player they have seen all season in Matt Chastain.

He scored 23 of his game-high 34 points in the first half alone for LeRoy (26-5).

“Obviously, [Chastain] is a very good player,” Newark coach Rick Tollefson said.

“He’s incredible. He’s all he’s been built up to be. He was 9-for-10 in the first half. I don’t know if he’s always like that.”

The Panthers led the entire game.

The contest was tied twice - 14 at the end of the first and at 16 two minutes into the second quarter. That’s when LeRoy outscored the Norsemen 20-5 for the 34-19 advantage going into the break.

Newark’s biggest problem in the first half was two early fouls on junior point guard Will Clausel. He eventually fouled out in the middle of the fourth quarter.

“That was hard,” Tollefson said.

“Those two fouls dictated the game. It just changed the game. It was unfortunate. It was a real shocker.”

LeRoy led by as much as 17 points twice in the first few minutes of the third before Newark went on a 10-2 run at the end of the quarter.

After Cam Myre’s putback at the buzzer, the Panthers led 40-31 entering

the final frame.

In the fourth quarter, the Panthers kept a comfortable distance. Free throws from Jack Clausel with less than a minute left in the game reduced the lead to 55-50, but that was as close as Newark came.

“We just struggled to shoot. I thought in the second half, we’d come

back,” Tollefson said. “I give our kids a lot of credit for battling.”

Jack Clausel led Newark with 19 points and 10 rebounds. Fellow senior Evan Schomer finished with 15 points and five rebounds.

“We never quit,” Jack Clausel said.

“We just worked so hard. It just didn’t fall our way.”
