TGI Fridays closes in St. Charles

By ASHLEY SLOBODA asloboda@shawmedia.com ST. CHARLES – Another business has shut its doors on the city’s east side in the same month that a project’s groundbreaking ceremony brought promise of new vitality.

TGI Fridays, 3875 E. Main St., St. Charles, closed Friday for business reasons, a company spokesperson said in an email Monday.

It had opened in October 2002.

“This was a very difficult decision, as we understand the impact it has on our guests who enjoyed dining at our restaurant and on our team members who worked there,” said the spokesperson, who did not give a name.

“We’re working with our team members to provide job assistance and look forward to serving our guests at our other Chicago-area Fridays locations. We appreciate and thank our guests for visiting Fridays in St. Charles over the years.”

The Batavia location, 490 N. Randall Road, remains open, the spokesperson said.

KANE COUNTY CHRONICLE editorial@kcchronicle.com GENEVA – The city of Geneva will be searching for a new Economic Development Department director after director Ellen Divita announced her resignation last week.

Divita, who has worked with the city since 2008, accepted the community development director position with the city of DeKalb.

Divita’s last day is expected to be in late Oc- Ellen Divita tober, but a final date has not been determined, according to a news release issued by the city of Geneva.

The city is working on a recruitment profile and job description for the position, which should be posted to the city’s website at www. geneva.il.us in the coming weeks. Officials hope to select a new director later this year.

The Economic Development Department provides retention, recruitment and training resources to attract and help the city’s businesses.

The department also coordinates special-event permits, promotes tourism opportunities and distributes communication pieces to the city’s merchants and business owners.

After Divita leaves, the director responsibilities will be split between City Administrator Mary McKittrick and business development specialist Paul Evans until Divita’s replacement is hired.

Geneva aldermen eye city hall space needs, home rule

By BRENDA SCHORY bschory@shawmedia.com GENEVA – Geneva aldermen agreed to postpone working on a plan to address city hall space needs, but determined they wanted to hear more information about home rule sometime this year.

Aldermen met at the Public Works Facility on Monday at a special Committee of the Whole meeting to discuss issues including space needs and home rule.

City Administrator Mary McKittrick said having Economic Development and the Finance departments across the street from city hall is

more than an inconvenience.

“With Economic Development and Community Development right there provides better customer services and better communication,” McKittrick said. “A number of other communities have space crunch horror stories about how disjointed it is. … Meeting at the moment makes all the difference in the world.”

McKittrick said she was not coming to aldermen to say there was an emergency, but for long-term planning as described in the city’s strategic plan.

City resident Colin Campbell said the former DuPage Library System building at

127 S. First St., Geneva, was recently bought by Batavia Enterprises.

Campbell said the three story building has enough room “that would serve all city hall needs forever and ever.” He suggested officials talk to the developer about leasing the building with an option to buy.

By consensus, aldermen told McKittrick to postpone any planning by six months.

In terms of home rule discussion, aldermen decided they wanted a program to provide them with more education about it.

Home rule units of government can regulate and impose taxes, among other expanded powers. Municipalities become home rule when their population reaches 25,000 or by referendum. Geneva’s population is about 22,000.

Mayor Kevin Burns said the possibility of imposing more property tax is what stopped City Council support when the issue was considered in 2006.

“The last time we took the temperature of the community, it was, ‘We don’t trust you,’ ” Burns said.

D-303 staff detail drug use, prevention programs in schools

Student Assistance Counselors Patricia Emery of St. Charles East High School and Pat Radke of St. Charles North High School led the presen-

by District 303 school board members, during the board’s regular Community Relations Meeting. A total of 71 percent of the district’s high school seniors had consumed or used some sort of alcohol, cigarette, inhalants or marijuana at least once in the past year, according to data from the 2014 Illinois Youth Survey. The numbers for student use of illicit drugs besides marijuana are far lower in the district – about 10 percent of the dis-

areas of focus to address substance abuse – prevention, intervention and what it calls “post-vention.” For example, counselors speak to classes and provide education to faculty, as well as parents, Radke said. Any involvement with the school resource officers also is an opportunity for intervention with the students, she said.

A NATIONAL OUTCRY October is Domestic Violence Awareness Month

eschelkopf@shawmedia.com The topic of domestic violence has been in the spotlight after the recent release of a video showing professional football player Ray Rice striking a woman, now his wife, in a casino elevator. But Mutual Ground Executive Director Michelle Meyer did not need to see that video to understand how serious the issue is.

Aurora-based Mutual Ground works to help victims of domestic violence.

“It’s good there was an outcry because people are now making more attention to the seriousness of domestic violence,” Meyer said. “It’s unfortunate to me that it took a TMZ video of Ray Rice knocking out his now wife to create a national outcry.”

Formed in 1975, Mutual Ground is one of the largest and oldest domestic violence/ sexual assault agencies in the state. Mutual Ground, a nonprofit organization, serves several communities in Kane County, including Geneva, Batavia, North Aurora, Elburn, Sugar Grove, Maple Park, Aurora, Montgomery and Oswego, along with all of Kendall County. All of its services are free and confidential.

The Elgin-based Community Crisis Center serves the northern part of Kane County, including St. Charles.

Meyer said she hopes the conversation will continue.

October is Domestic Violence Awareness Month, which evolved from the first Day of Unity, observed in October 1981 by the National Coalition Against Domestic Violence.

The intent was to connect advocates of battered women from across the nation, who were working to end violence against women and their children.

October is Domestic Violence Awareness Month.

Against Domestic Violence, one in every four women will experience domestic violence in her lifetime, and an estimated 1.3 million women are victims of physical assault by an intimate partner each year.

Last year, more than 1,400 individuals used Mutual Ground’s services, with more than 400 of them being children, Meyer said.

“Domestic violence doesn’t involve just spouses,” she said. “Domestic violence is a family or household member, not just intimate partners. It can be any family member that you are living with.”

Mutual Ground operates two hotlines, which are manned around the clock. In 2013, Mutual Ground received more than 7,000 calls for information about domestic violence and sexual assault services, Meyer said. In addi-

tion, Mutual Ground provided more than 1,700 programs in area schools focusing on domestic violence and dating violence along with sexual assault and sexual harassment.

The attention domestic violence is receiving these days might be making victims feel more comfortable about coming forward. After Mutual Ground recently gave a presentation at a middle school, six students came forth to disclose situations that were going on in their lives revolving around domestic and sexual violence, Meyer said.

“We don’t normally have six kids that come forward at once after a presentation,” Meyer said. “I don’t know if that has anything to do with what is going on now and the higher attention that is being paid to domestic violence, but that was pretty shocking to

me.”

When a domestic violence victim makes contact with Mutual Ground, one of the things the organization does is help the victim put together a safety plan, she said.

“It is never a victim’s fault, and I think we spend too much time wondering why a victim is staying or why a victim is in the situation and not as much time why wondering why an offender is abusing the victim,” Meyer said. “Maybe somebody is going back to their abusive husband. We would implement a safety plan for that. We would put together a separate safety plan if that person was planning on leaving the offender.”

Ruth Glenn, executive director of the National Coalition Against Domestic Violence, said she is pleased to see the attention being brought to

the issue of domestic violence.

She said her organization these days is seeing more people seeking help.

Because her organization doesn’t provide direct services, it refers those people seeking help to local agencies that would serve them. She dismissed the idea that professional football players are more prone to domestic violence.

“I am not a subscriber to [the idea that] because you are violent on the field, you are going to be automatically prone to violence,” Glenn said. “Domestic violence is about power and control over another individual. It is about gaining and maintaining and sustaining power and control over another individual.

That’s why you most often see domestic violence as we define it with intimate relationships, intimate partners.”

Glenn said she hopes the actions taken against Rice – who was suspended indefinitely by the NFL – and other players involved in domestic violence incidents will help reduce the amount of domestic violence.

“If the result is that they’re changing their culture through the actions they are taking right now, I think the actions they’re taking right now are appropriate,” she said.

Second Dunkin’ Donuts store opens

By CHARLES MENCHACA cmenchaca@shawmedia.com ST. CHARLES – The second Dunkin’ Donuts store in St. Charles opened its doors Saturday, said Karim Khoja, one of the store’s franchisees.

The store, at 2057 Lincoln Highway in St. Charles, is a combination Dunkin’ Donuts and Baskin Robbins, said Khoja, who is a franchise partner for this location with Tom Thiem. Its operating hours are 4 a.m. to 10 p.m. every day.

The combination store is the former site of Goody’s Fast Food, which officially

closed after manager Lorenzo Alba auctioned off equipment April 22, Marv Vestuto of Vestuto Real Estate said. Vestuto was the listing agent for the Goody’s site.

The Goody’s building was converted into two units, and the combination store occupies only one of them, Khoja said. The owner had plans to lease out the other unit, Vestuto said.

The other St. Charles Dunkin’ Donuts location also is on the city’s west side at 1711 W. Main St. Talks still are ongoing to bring a Dunkin’ Donuts to St. Charles’ east side, Khoja said Monday.

MARJORY GREENE Born: Nov. 20, 1926; in Chicago, IL Died: Sept. 23, 2014; in Batavia, IL Marjory Greene nee Mather, died peacefully at the Holmstad in Batavia on the evening of September 23, 2014. She was born in Chicago November 20, 1926, and lived in Aurora, IL for much of her life. She enjoyed 20 memorable retirement years in Santa Fe, NM before returning to Illinois.

She was preceded in death by her parents,William J. and Mabel E. Mather; and her brother. Charles.

Starting in nursery school, she received all of her education from the University of Chicago, completing her Bachelor of Philosophy degree before marrying William Alexander Greene of Aurora, IL on January 27, 1947. She was an active member of several community organizations including the YWCA, AAUW, Tuesday Garden Club, Santa Fe Desert Chorale and Minerva Coterie.

She was a patron of the arts, a skilled gardener, a voracious reader, a self-driven thinker, passionately curious, and a woman of great spirit. Marjory was a whirlwind of energy and excitement in the lives of all around her. She cared deeply for family and friends near and far, staying connected through her prolific correspondence and “clipping service.” She loved a good party. Her life was richly lived as wife, mother of three, grandmother of nine and great grandmother of eleven, though she rarely felt old enough to have earned the title of matriarch over such a large crowd.

ELEANOR F. MOUNTSIER Born: Aug. 18, 1924 Died: Sept. 25, 2014 Eleanor F. “Ellie” Mountsier, age 90, of Geneva passed away Thursday, September 25, 2014, at Delnor Hospital surrounded by her loving family.

She was born August 18, 1924, the daughter of Henry and Blanche (Shepard) Franz. Ellie was raised near Cleveland and attended Miami University in Ohio. She was a peace activist during the Vietnam War and was a volunteer and member of Another Mother for Peace. She was also a longtime member of Geneva United Methodist Church. Ellie’s top priority was her family. She was very proud of her children and grandchildren and found great joy in sharing both their accomplishments and their memories. With her competitive nature, she loved playing almost any type of board or card game and was particularly skilled at bridge. She will be dearly missed by all those whose lives she has touched.

JEANNE D. VERVYNCK Born: Aug. 22, 1923 Died: Sept. 18, 2014 Jeanne Dorothy VerVynck (Anderson), 91, traveled through the predawn light to be with long missed members of her family on September 18, 2014.

Fondly called Grandma Jean by family and friends, he home of 73 yrs was the family gathering place, holidays, birthdays, graduations, weddings or just to be together on the patio.

Grandma Jean lived a life of many joys, sprinkles with pain and losses yet she

always greeted the day with hopes for sunshine. She especially loved the arrival of a new baby cherishing the times she could “just sit and quietly hold an infant.” Our Grandma Jean was a strong woman, a hard-working woman, a woman who showed her love through support, good deeds, advise, examples and warm caring.

She shared her life’s adventures with a story teller’s glee. Telling enhanced stories of living through the depression, reading childhood books by kerosene lamps, that she had weekly clean. Her stories of a woman’s life at home during WWII raising children alone and burning 14 tons of coal to keep the babies warm spoke volumes of fortitude and fears.

Grandma Jean left her family with an array of lie experiences, heart-filled memories and albums of family photos. The opening page a photo of her Grandmother Jandeau dated 1916.

Jeanne joins immediate family members, husband, Mike; daughter, Rita; and son, Stephen.

She is survived by sons, Mike and Scott; daughters, Nanette and Sally; along with 25 grandchildren and great great grandchildren ranging in age from 3 months to 54 years old.

Jeanne was born in Aurora on August 22, 1923. The third daughter of Louise and John A. Anderson, she lived her entire life in the Fox River Valley.

She was raised in the Catholic faith, attending Our Lady of Angels School as a child. Marriage in 1940 brought her to St. Charles as a lifelong member of St. Patrick Church. She began working in retail sales when her children no longer needed Mom helping at school.

As a collector of old things, her favorite job was at the thrift store, sharing the fun of a find with patrons. Always aware of the love her family shared with her, she pre-planned her passing and left us with these words.

“Do not stand by my grave and weep; I am not there; I do not sleep.

I am a thousand winds that blow. I am the diamond glints on snow. I am the sunlight on ripened grain, I am the gentle autumn rain. When you awaken in the morning hush, I am the sweep uplifting rush, of quiet birds in circle flight. I am the soft starts that shine at night. Do not stand by my grave and cry I am not there - I did not die.”

Grandma Jean will be in our hearts for many generations to tell her stories, teach by her examples, and always love our babies, at every age.

Charlotte Roberta Ferrill (Everhart, Richardson), 96 years old, born July 17, 1918, passed away September 26, 2014, at Prairie Crossing Living & Rehab Center, Shabbona, IL. She was born and raised in Batavia Illinois and lived most of her life in Batavia. She was confirmed at Bethany Lutheran Church in Batavia and graduated from Batavia High School in 1936. She is best known for working more than 30 years at Deluxe Cleaners in Batavia, retiring at age 79. She married Edward Richardson December 2, 1938, and she married Paul Ferrill December 1962. She was a member of the Women of the Moose, Yorkville Chapter. She moved to Shabbona Assisted Living Center in January of 2010 and then to Prairie Crossing & Rehab Center July of 2012.

She was preceded in death by her parents, William and Lillie Everhart; 2 sisters, Winifred Swanson and Beatrice McKeown; two brothers, Delbert Everhart, William Everhart; two husbands, Edward Richardson and Paul Ferrill; and one grandson, Jason Weekly.

She is survived by two sons and one daughter, James (Luz) Richardson of Elgin, Illinois, Jack (Sang im) Richardson of Grosse Isle, Michigan, and Susan(Willard) Dobson of Shabbona, Illinois; one brother, Robert (Nancy) Everhart, of Myrtle Beach, South Carolina; 8 grandchildren, 5 step grandchildren, 9 great grandchildren, 14 step great grandchildren, 8 step great great grand children.

By ASHLEY SLOBODA asloboda@shawmedia.com KANEVILLE – Kris Conley was vacationing in Washington state in 1997 when her now-late husband, Bruce, told her he bought the farm – and he meant it quite literally.

The nearly 10-acre property at Main Street and Dauberman roads in Kaneville Township was theirs. Conley said her husband thought it was too beautiful to keep to themselves.

“We have to be able to share it,” she recalled him saying.

They did. Over time, the farmland would become their home, as well as a venue for weddings and Conley Outreach Community Services programs, such as a children’s grief camp.

But now, four years after her husband died, Conley has decided to sell the property. At a Farewell to the Farm event Sunday, she said he would understand, as he knew each of the things he started had a lifespan.

“As much as I would love to keep it going, I can’t,” Conley said. “I think it’s time.”

Carol Alfrey, the executive director of Conley Outreach, said it is hard to let go of a

She was born to George and Victoria Visnowski, in East St. Louis, IL. She moved to Chicago, where she met her future husband; and they were married in San Diego County, before he was shipped to the South Pacific Theater. She returned to the Chicago area, and raised her family in Stickney. In the mid 1980’s she and Joe retired, moving to Sun City West, AZ. Sophie was very active in the women’s guild and arts and crafts club at Our Lady of Lourdes parish in Sun City West. She loved spending time with her granddaughters, and enjoyed preparing her families’, favorite Polish Dishes.

Over the years she cared for and loved her dogs, especially her dog Cricket who became her closest companion after her husband Joe’s death.

She is survived by her son, Joseph (Diane) Winkler of St. Charles, IL; daughter, Patricia, of Middletown, MD; three

grandchildren, Jessica (Thomas) Warda, of Geneva, IL, Rebecca MacLachlan, of Virginia Beach, VA, Sarah Winkler, of Chicago, IL; one great-granddaughter, Noralee, Frances Warda; sister, Mary Dorogi; of Orlando, FL; sister-in-law, Helen Soucek, of Sun City, AZ; and many nieces and nephews; She was preceded in death by her loving husband, Joseph; sister, Josephine Gutierrez; brother, Joseph Visnowski; sister, Helen Kromray; and brother, Stanley Visnowski.

“The programs will go on,” she said.

“They will continue because I think people need them,” Conley said.

As the sun shone brightly Sunday afternoon and Alfrey prepared a fire for s’mores, Conley greeted visitors to the farm, thanking them for coming out.

Among them were Tom and Mary Fink of Batavia, whose 12-year-old son died 10 years ago from cancer. Tom Fink said they have attended

It took four hours to get her runway ready, three of which were spent just on her hair.

Her locks were spray painted a grayish silver and pipe cleaners were placed inside of it so it would stand upright and look like a stalactite, which forms from calcium salts and hangs like a icicle inside a cave.

Davoust collaborated with Stephen Wake, owner of Focas Hair Salon in St. Charles, to complete the hairdo. She also worked with her two models

and another one of her daughters, Madeline Davoust, to complete the choreography for the show.

Dobies told Schmidt and Thomas to act extravagant for their runway choreography.

The black tulle petticoats the two models wore took about a week to make, but the large wigs that Dobies created for them took three months to put together.

Dobies had a sculpture in the first On-som’ bel show in 2012 and worked behind the scenes at the 2013 show. She was thrilled to once again be part of the fundraiser.

With Fall just around the corner, it might be a good idea to start thinking about yard waste. Yard waste, which includes leaves, grass clippings and tree trimmings, is created as a result of care and maintenance of lawns. One must now decide what to with the waste and two great options are to can it or compost it. To can it, one must gather up the waste in a proper container or bag of no more than 50lbs and place it on the curb for garbage pickup. It is also important to remember to separate yard waste from your regular garbage.

The other option for yard waste is composting. “By composting you are providing valuable nutrients back to your lawn,” said Chris Rooney of Advanced Disposal. There are four components of the composting process: organic material, moisture, oxygen and bacteria. The Unites States Environmental Protection

Agency provides several tips for backyard composting. · Select a dry, shady area for your pile or bin. Bins can be made or purchased at home improvement stores. · Collect in small pieces brown and green material as the waste is created. Brown materials include dead leaves, branches and twigs. Green materials are grass clippings, vegetable waste, fruit scraps and coffee grounds. · Moisten dry materials as they are added. · Mix grass clippings and green waste into the pile and bury fruit and vegetable waste under 10 inches of compost material. · Turn and fluff the pile every time you add to it to provide oxygen. · It is ready to use when the compost material is dark and rich in color usually about three months longer during winter months.

BATAVIA – The multicolored wig Lauren Schmidt wore Saturday added about three feet to her 5-foot, 6-inch frame, but surprisingly, it did not weigh her down.

“It was more hot than anything,” said Schmidt, a Glen Ellyn resident.

Schmidt walked a runway with Marcy Thomas of DeKalb as they wore designs from Aurora artist Danielle Dobies during the third annual Onsom’ bel fundraiser. The event was held Saturday at Water Street Studios, 160 S. Water St., in downtown Batavia.

The first On-som’ bel was held in 2012 at the studios, and the event gets bigger every year, said Laura Spicer, event chair and Water Street Studios board member. The event, which raises money for the nonprofit Water Street Studios and its programs, included a gallery show, a silent and live auction, a dance party with DJ and, of course, a fashion show.

The fashion show featured the work of 10 artists worn by 19 models under the theme “Avenue + Passage.” They walked a dramatically lit runway in a loading dock at the studios while the music of groups such as Inner City and the Sex Pistols filled the space.

Chicago resident Lisa Gagne and her husband, Matthew, were two of the show’s roughly 200 attendees. Gagne’s employer, Robis Marketing, is one of the show’s sponsors, but she said she had to pay her own way to get in. The show is so popular that all the company’s passes already were taken, she said.

“It was really unexpected, but very, very entertaining,” said Gagne, who also attended last year’s show. “Some of the things they did were amazing.”

Among Gagne’s favorite pieces were the two designs from Water Street Studios resident artist Patricia Davoust of Warrenville. The looks were awarded Best of Show by evening’s end.

12 Grant to support Kane County drug court services KANE COUNTY CHRONICLE editorial@kcchronicle.com The Kane County Drug Rehabilitation Court has been awarded a $1.2 million federal grant, the bulk of which is dedicated to purchasing residential treatment services for drug court participants, according to a 16th Judicial Circuit news release.

The grant was awarded by the Bureau of Justice Assistance and the Substance Abuse and Mental Health Services Administration.

Judge Marmarie Kostelny and adult drug court coordinator Carrie Thomas applied for funds to get more services

to address the needs of participants who suffer from mental health issues and have a history of trauma, according to the release.

Continuing state budget cuts have caused the wait for bed space in residential treatment facilities to increase, resulting in continued incarceration of participants while waiting for treatment.

With the grant, a new screening tool will be bought to help the drug court determine what, if any, trauma might have occurred in an addict’s life that needs to be addressed and treated before he or she can begin the recovery process, the release stated.

It will assist in buying bus passes necessary for participants to attend drug treatment therapy and travel for required drug testing.

Kane County drug court participants commit to complete a drug treatment program while complying with 30 months of intensive probation and regular judicial supervision. The court’s mission is to break the connection between drug abuse and the commission of crimes, the release stated.

The grant will be administered under Kostelny’s leadership through Kane County Adult Court services with the assistance of the drug court team.

POLICE REPORTS Kane County Sheriff’s Office • A resident of the 3N900 block of Bittersweet Road, St. Charles, reported Tuesday, Sept. 23, that her credit card was used to order about $489 in uniform items, which were delivered to her house. She also discovered it was used Friday, Sept.

19, for another $948 transaction that hadn’t yet been completed.

She reportedly didn’t know how the information was obtained, as she possessed the card and rarely used it.

To the Electors of the State of Illinois: The purpose of a state constitution is to establish a structure for government and laws. There are three ways to initiate change to the Illinois Constitution: (1) a constitutional convention may propose changes to any part; (2) the General Assembly may propose changes to any part; or (3) a petition initiative may propose amendments limited to structural and procedural subjects contained in the Legislative Article. The people of Illinois must approve any changes to the Constitution before they become effective.

PROPOSED AMENDMENT TO SECTION 8.1 OF ARTICLE I OF THE ILLINOIS CONSTITUTION ARTICLE I – BILL OF RIGHTS SECTION 8.1. CRIME VICTIMS’ VICTIM’S RIGHTS. (a) Crime victims, as defined by law, shall have the following rights as provided by law: (1) The right to be treated with fairness and respect for their dignity and privacy and to be free from harassment, intimidation, and abuse throughout the criminal justice process.

(2) The right to notice and to a hearing before a court ruling on a request for access to any of the victim’s records, information, or communications which are privileged or confidential by law.

(3) (2) The right to timely notification of all court proceedings.

(4) (3) The right to communicate with the prosecution.

(5) (4) The right to be heard at any post-arraignment court proceeding in which a right of the victim is at issue and any court proceeding involving a post-arraignment release decision, plea, or sentencing. make a statement to the court at sentencing.

(6) (5) The right to be notified of information about the conviction, the sentence, the imprisonment, and the release of the accused.

(7) (6) The right to timely disposition of the case following the arrest of the accused.

(8) (7) The right to be reasonably protected from the accused throughout the criminal justice process.

(9) The right to have the safety of the victim and the victim’s family considered in denying or fixing the amount of bail, determining whether to release the defendant, and setting conditions of release after arrest and conviction.

(10) (8) The right to be present at the trial and all other court proceedings on the same basis as the accused, unless the victim is to testify and the court determines that the victim’s testimony would be materially affected if the victim hears other testimony at the trial.

(11) (9) The right to have present at all court proceedings, subject to the rules of evidence, an advocate and or other support person of the victim’s choice.

(12) (10) The right to restitution. (b) The victim has standing to assert the rights enumerated in subsection (a) in any court exercising jurisdiction over the case. The court shall promptly rule on a victim’s request.

The victim does not have party status. The accused does not have standing to assert the rights of a victim. The court shall not appoint an attorney for the victim under this Section. Nothing in this Section shall be construed to alter the powers, duties, and responsibilities of the prosecuting attorney The General Assembly may provide by law for the enforcement of this Section. (c) The General Assembly may provide for an assessment against convicted defendants to pay for crime victims’ rights. (d) Nothing in this Section or any law enacted under this Section creates a cause of action in equity or at law for compensation, attorney’s fees, or damages against the State, a political subdivision of the State, an officer, employee, or agent of the State or of any political subdivision of the State, or an officer or employee of the court. or in any law enacted under (e) Nothing in this Section or any law enacted under this Section shall be construed as creating (1) a basis for vacating a conviction or (2) a ground for any relief requested by the defendant appellate relief in any criminal case.

EXPLANATION The Constitution sets forth substantial rights for crime victims. The proposed amendment expands certain current rights: 1) Victims are currently entitled to fairness and respect throughout the criminal justice process. The amendment would also provide that they shall be protected from harassment, intimidation and abuse.

2) Victims currently can make a statement to the court when a criminal defendant is sentenced to punishment. The amendment would allow a victim to be heard at any proceeding that involves the victim’s rights, and any proceeding involving a plea agreement, release of the defendant or convicted individual, or sentencing.

3) Victims may obtain information about conviction, sentencing, imprisonment or release. The amendment would require prosecutors and the court to notify victims of those events before they happen.

The amendment would also grant additional rights to crime victims: 1) A victim would have a right to formal notice and a hearing before the court rules on any request for access to the victim’s information which is privileged or confidential information.

2) A victim would have the right to have the judge consider the victim’s safety and the safety of his or her family before deciding whether to release a criminal defendant, setting the amount of bail to be paid before release, or setting conditions of release after arrest or conviction.

3) The victim would have the right to assert his or her rights in any court with jurisdiction over the criminal case, but would not have the same rights as the prosecutor or the criminal defendant and the court could not appoint an attorney for the victim at taxpayer expense.

The proposed amendment would not alter the powers, duties or responsibilities of the prosecutor. Further, a criminal defendant would not be able to challenge his or her conviction on the basis of a failure to follow these provisions.

FORM OF BALLOT Proposed Amendment to the 1970 Illinois Constitution Explanation of Amendment The proposed amendment makes changes to Section 8.1 of Article I of the Illinois Constitution, the Crime Victims’ Bill of Rights. The proposed amendment would expand certain rights already granted to crime victims in Illinois, and give crime victims the ability to enforce their rights in a court of law. Policing border patrol THE WASHINGTON POST Few federal government agencies have grown as quickly as U.S. Customs and Border Protection, which includes the 21,000 agents, double the number in 2004, who patrol the nation’s frontiers with Mexico and Canada. That growth has been accompanied by an alarming number of incidents involving the use of lethal force, particularly along the Mexican border and all too frequently under circumstances that suggest the agency is indifferent or hostile to the most basic standards of restraint, transparency and self-policing.

Reports by news organizations and independent experts – including one report that was suppressed by Customs and Border Protection for more than a year – have finally prompted the agency to address its problems with accountability. The agency’s new commissioner, R. Gil Kerlikowske, a former police chief in Seattle and Buffalo, has proposed serious reforms.

The question now is whether an organization that badly needs change, and the National Border Patrol Council, the union that represents some 17,000 agents in the field, will be receptive to reform.

Kerlikowske’s ideas for revamping the agency’s policies and culture are far-ranging.

Soon after taking office in March, he initiated a review of hundreds of incidents since 2009 involving agents’ alleged misconduct and use of deadly force; 155 such incidents remain under review.

In recent days, he has announced the creation of an Integrity Advisory Panel, led by Karen Tandy, former head of the Drug Enforcement Administration, and Bill Bratton, commissioner

of the New York City Police, to devise recommendations for avoiding and addressing abuses by agents and inspectors. Kerlikowske has promised the agency will be more forthcoming about future incidents involving the use of deadly force, which would be a constructive change from its deeply ingrained habit of stonewalling. To that end he is establishing a rapid-reaction force of investigators whose mission will be to gather evidence following incidents and allegations of abuse.

In a move that was authorized by Homeland Security Secretary Jeh Johnson, to whom Customs and Border Protection reports, the agency will start overseeing its own internal investigations, which previously were led by other agencies. It remains to be seen whether having CBP investigate itself heralds an improvement, although Kerlikowske insists that it does.

The most promising measure under consideration involves outfitting thousands of Border Patrol agents with wearable cameras, which could provide independent evidence of incidents involving misconduct. Kerlikowske said the agency is purchasing and preparing to test various cameras.

Video footage of encounters between uniformed law enforcement and civilians has been in increasing use in police departments across the country with positive results.

We hope the National Border Patrol Council will support the use of the cameras.

Agents have some legitimate privacy concerns about the terms of the cameras’ use – especially when they are turned on and off. But cameras can help transform conduct in a vital law-enforcement body.

for football fields, tennis court lighting and other somewhat nonessential items. It’s important to keep pace, but the Batavia school system is one of the best in our area. From athletics to extracurricular programs, to the classroom, we have done a stellar job.

With the city’s electrical problems, which are being passed on to the taxpayers, the relentless increase in real estate taxes and – now – a possibility of another $15

million expenditure, I feel it is way too much.

With the recent $6 million payment from the outlet mall TIF funds account, I would hope the school board would be satisfied with their increase in revenue from the Aurora outlet mall.

Please do not support this huge additional referendum suggestion.

“Depending on how close she is, usually I’d wave, ask her how she’s doing,” Furrie said. “We don’t really get to talk that much unless it’s on holes next to each other.”

Furrie, Lillie and the rest of the North Stars found plenty to discuss once they all convened at the clubhouse late in the afternoon. The North girls registered a team score of 330 to win the Upstate Eight Conference River Division meet by 13 strokes against runner-up Batavia.

“Everybody is playing really well, and I think that if we just keep on doing what we’re doing and improving, that we might even be able to get to state again this year, like last year,” Lillie said.

North earned a UEC title in 2013 en route to a team berth in the Class AA state meet.

With recent conference expansion, there were enough teams this fall to split the scoring into River and Valley Divisions, although further shuffling on the Valley side figures to return the competition to its familiar format next season.

Furrie fired a 5-over-par 76 to earn River medalist honors, three strokes ahead of Lillie and 5 shots better than her conference score last season.

Rushing inside was hardly the norm on a day the high temperature hovered near the mid-80s, a far cry from what most teams have experienced during the season’s first six weeks, namely during 18-hole Saturday invitationals.

“It’s really pretty out. It was, like, a perfect day to golf,” said Shah, who topped her personal best by one stroke. “It was hot at times, but it was really nice.”

About the only party who might have seen enough of St. Andrews was substitute East coach John Stock.

Assisting Rod Osborne, who was celebrating a 40th anniversary weekend with his former University of New Mexico golf teammates, Stock arrived around 7:15 a.m.

Monday, then stayed into the early evening as the boys team he regularly coaches practiced on the course.

North uses Batavia loss ‘to fuel us’ A quicker offense and more aggressive defense helped St. Charles North challenge host Batavia on the heels of a frustrating, Week 4 home loss to Geneva.

It was a one-score game for much of the night until Batavia’s Jake Hlava rumbled for a 46-yard touchdown run with 2:11 to play in an eventual 21-7 win.

Because North didn’t get the ultimate result it was seeking – a victory against the defending Upstate Eight Conference River Division champs – the program still viewed that improvement as going almost for naught.

“We had a fire in our belly the entire week, since last week’s loss to Geneva,” North senior defensive end Jordan Bergren said. “This is just going to fuel us even more. We’re not satisfied.”

Similarly, North Stars coach Rob Pomazak was firm that moral victories don’t exist, but still planned to pluck building blocks from the game.

“I want to quantify it as, ‘How many good plays were there to bad plays, or what did we do wrong in practice that we did right in the game?’ That’s what I’m going to look at, you know,” Pomazak said. “If I can come back, and from a quantifiable standpoint, say we were this much better, then that’s a good game.

It’s a learning game.”

Despite their woes against Geneva and Batavia – whose Week 8 meeting at Bulldog Stadium undoubtedly will determine the conference champ – the 3-2 North Stars remain in prime position to earn the program’s first playoff berth since 2009.

North’s final four opponents – Larkin, Streamwood, St. Charles East and Elgin – enter Week 6 with a combined 3-17 record.

Working for the weekend games Wheaton Academy played the third of four scheduled Saturday regular-season games over the weekend.

Although the result was a

new one – the Warriors suffered their first loss of the season – the preparation felt like clockwork, especially since the program operated without lights before the recent renovation of Performance Trust Field.

“The main difference is we just get that extra work day on Thursday before the lighter, polish day on Friday,” Warriors coach Brad Thornton said. “The kids know it, and I don’t think our practices are getting stale … but I think our guys have done a good job with that for the weeks that we’ve had Saturday games.”

After visiting Metro Suburban West power Glenbard South this week, Wheaton Academy plays a Saturday matinee at IC Catholic Prep in Week 7.

The Warriors close the regular season with Friday night home games against Fenton and Aurora Central Catholic.

Kaneland seniors Connor Fedderly and Isaac Swithers were fifth-graders the last time the Knights endured a three-game losing streak, and not even alive during the program’s worst skid of the past generation.

None of that matters when Fedderly, a wide receiver, and Swithers, a running back/safety, gather their teammates before and after practices. That’s because neither player focuses on 2007 or 1993 – when the Knights went 1-8. Instead, they keep the team’s gaze fixed on the present and what it can do to earn a victory for the first time since Week 2.

“Everybody’s really listening to those two guys, especially now that Swiz is doing this with his knee, you know,” Knights coach Tom Fedderly said. “Those guys are just being the leaders that we need them to. We really had a good week of practice with the kids [last week], and a large part of that is because of the senior leadership those two have had.”

Limited by an early-season knee injury, Swithers has inspired teammates with a speedy recovery while working back into heavier duty each week.

He’ll be a key cog when the Knights travel to Sycamore this week, bidding to avenge last season’s loss to their longtime rivals.

Sycamore handed Kaneland its first Northern Illinois Big 12 East defeat since the league’s 2010 inception last season.

Another loss here would be a potentially crippling blow to the Knights’ playoff hopes.

AURORA – The Rosa ry girls volleyball team is working on diversifying its offense.

For much of Monday’s 258, 25-21 win against visiting Aurora Christian, the Royals didn’t have to show it.

Rosary racked up 10 aces at the service line, seven in Game 1, en route to the Suburban Christian Conference win.

Senior Joanna Wedge had three straight aces in the first game that put the Royals ahead, 10-3. Teammate Michaela Ping also supplied a trio of aces in the game.

“When we get aces, our team just goes insane,” said Wedge, a Geneva resident.

“We just feel like we have all the power. Aces are just an exciting thing.”

The 6-foot Wedge said she sometimes struggles from the service line, but a more measured approach paid dividends against the Eagles.

“I think I worked on being very calm,” Wedge said.

“I took a second before I kept

serving … I really enjoy serving and I want the chance to keep on serving so I just kept pushing and being mentally strong and getting them in, I guess.”

Rosary (13-10, 1-1 Suburban Christian Conference) received a match-high five kills from sophomore Erin Burke and four kills from Ping on a balanced night for the attack.

That spread-out productivity fits in nicely with where coach Rachel Hartmann envisions her team heading in as October nears.

“Just starting to mix up our offense a little bit,” Hartmann said. “Teams start to get in a rut and run the same things so we try to change things, get some different girls some different opportunities.”

Sophomore libero Martha Konovodoff added 11 digs and junior Brooklyn Martner had 10 assists for the Royals, who wore pink shirts on a night in which funds were raised to fight cancer.

While the Eagles were much more competitive in the second game – closing to within 18-16 of the Royals at

one point – Aurora Christian coach Allison Nyberg said the match closely resembled recent setbacks against Kaneland and Montini.

“This is our third game in a row where we lost big the first game and then fought really hard the second game,” said Nybgerg, whose team is 0-2 in conference play. “We feel like this is a pivotal point in our season where we’re going to be not the team that is always having to fight back, and come out strong, and just kind of change our mental attitude.”

Senior libero MaKayla Beebe had a match-high 13 digs while junior outside hitter Natalie Hayes finished with seven digs and four kills for the Eagles.

“Our libero got some great digs on some big hitters,” Nyberg said. “You can see that really give us a big momentum boost. And when we’re blocking, that’s a huge help.

We didn’t really get a ton of blocks tonight but we got a few solid touches that really helped, so defense for our team is a really big momentum booster.”

“We know that coming in we got three difficult games this week.”

While East gears up for its conference games, Marmion faces St. Francis today.

“We haven’t lost to St. Francis in a while and we’re playing them at home,” Marmion coach Ricky Del Toro said. “We always play well at home.”

The Cadets have not lost a home game in two seasons.

WHEATON – Batavia senior boys soccer player Ian Larson moved quickly from the top of the 18-yard box to near the end line, then fired a shot on goal toward Wheaton Warrenville South’s goalkeeper.

The save caromed near Bulldogs junior Davis DiBiase, and his instincts helped Batavia secure the lone goal in Monday’s 1-0 victory against the Tigers.

“The goalie basically deflected it, we were framing the goal well, and Davis just basically cleaned it up,” Bulldogs coach Mark Gianfrancesco said.

Batavia (12-1-1) scored with just less than three minutes to play in the first half. After intermission, Gianfrancesco kept players fresh with frequent substitutions as the team prepares for today’s key Upstate Eight Conference River Division match against visiting West Chicago.

ST. CHARLES – The St. Charles East boys soccer team defeated Glenbard North in convincing fashion to win its home tournament Saturday, scoring five unanswered goals in the second half for the 6-1 victory.

The Saints (11-1-1) got on the board first on a penalty kick by midfielder Jordan Moore. The penalty kick was set up by the Saints’ midfield pressure, specifically Taylor Ortiz. The Saints’ pressure dominated as the match unfolded.

“It’s a game of patience,” East coach Paul Jennison said. “…The message was simple, if we are patient and we get one, we can get three or four.”

BY TERRY KOVEL KOVELS.COM Is it called a fruit bowl, berry bowl, fruit stand, fruit dish, epergne, basket or bride’s basket? A search of 1880s and ‘90s catalogs of silver and glass tableware manufacturers had similar pieces called by any one of these names. A formal Victorian dinner party served multiple courses with special serving pieces for each one. The manynamed stand was used at the end of the meal. A typical dinner had up to nine courses. First was raw oysters, then soup, meat, poultry, salad, dessert, then fruit and perhaps cheese, followed by coffee and tea in the drawing room. The table was cleared between courses and sometimes even fresh tablecloths were used. The bowl with many names often was the centerpiece for the dessert and fruit courses.

There were small berry bowls and berry sets that held strawberries or raspberries or similar fruit served with fresh cream and sugar.

Elaborate stands that held colored glass bowls probably held fruit like bunches of grapes, or apples that are easier to serve since the bowl and stand would be too heavy to pass around the table. The silverplated stands were decorated with three dimensional figures, animals, flowers or strange groupings like a cupid driving a chariot pulled by a peacock or the Greek god Poseidon with his spear poised to catch a piece of fruit from the bowl below. The bowls were sometimes silver but more often were colored art glass like Amberina, Burmese, Peachblow, Pomona, satin glass, or pressed or cut glass. Because collectors since the 1960s have preferred colored glass, art glass pieces found in stands today often are replacements for the original old clear glass bowls. An all-original “berry bowl set” on a silverplated stand with two Burmese bowls decorated with flowers sold recently. The silver stand featured young boys riding on turtles. It sold in 2014 at an Early’s Art Glass auction in Milford, Ohio, for $3,220. *** Q: A family member has a coffee table and two end tables that are stumping us. The tables

A: Your tables are in the style called “Black Forest,” a term used to describe the elaborate, naturalistic wood carvings of animals, plants and landscapes thought to be made in the Bavarian Black Forest region of southwest Germany.

But most pieces were really made in Brienz, Switzerland, where the carving style started in the early 1800s. From the mid-1880s to the 1940s, Brienz wood carvers made rustic clocks, benches, hall trees, smoking stands, chairs, tables and other furniture they sold to tourists.

It was popular with Americans. The mark on your tables stands for Deutsches Bundes Gebrauchsmuster (German Federal Registered Design) and was used in West Germany from 1948 to 1985. So your tables were probably made in the 1950s. Black Forest carvings from Brienz are from the 1880s to 1920s are sought after and sell for a lot of money. Most midcentury

A: Dainty Dorothy was a line of dolls sold by Sears, Roebuck & Co. and by T. Eaton Co., a Canadian department store, from 1910 until; at least 1922. Kestner, Simon & Halbig, Armand Marseille, and Gebruder Heubach made bisque heads for the dolls. If you find a manufacturer’s mark on the doll’s head on the back of the neck, you can identify the maker. Dolls with composition forearms and lower legs were made beginning in 1912. An all composition version was sold by Eaton in 1918. Not having the original dress doesn’t affect the value very much but the value of your doll is lower

because it’s missing a hand. Your doll is worth $50 to $75. *** Tip: Cover the nose of your hammer with a piece of felt to protect the wall when you are putting up picture hooks. Dear Abby: How can I convince my aging, sick sister-in-law that her feeble husband’s care is too much for her at this point? She can barely care for herself, yet she must help him eat, get out of chairs – everything short of chew his food for him.

Have you any ideas how I can convince her she is literally killing herself and deserves some assistance? Their three daughters are no help at all to them. – Relative Who Cares In Ohio Dear Relative: I can think of a few things you might do to help.

The first would be to talk to the daughters and explain your concerns for their mother’s health – because if she doesn’t get some respite care, SHE could die before their father does. Be sure to point out that if that happens, their father’s care would become THEIR responsibility. When they realize the effect it would have on their

The second would be to do some research and see what options are available for part-time caregivers or senior day care centers where her husband would be safe and looked after while your sister-in-law has a few precious hours to herself.

Hearing loss is difficult because it is often subtle and can be extremely isolating for the person who has it.

Hands-only CPR is best for treating cardiac arrest Dear Doctor K: I thought CPR involved chest compressions, breathing into a person’s mouth and checking their pulse. But my daughter told me that the “new” CPR involves only chest compressions. Is this correct?

Dear Reader: That’s right. Since 2008, the American Heart Association has recommended “hands only” cardiopulmonary resuscitation (CPR) if an adult suddenly collapses.

Cardiac arrest is usually to blame when someone collapses and stops breathing. It occurs when the heart’s electrical system malfunctions. The heart beats rapidly and chaotically – or stops beating altogether. The person stops breathing and becomes unresponsive.

In contrast, when people faint they also lose consciousness for a brief period, but they don’t stop breathing. You don’t want to perform CPR when someone has fainted, so be sure you have determined if the person is breathing.

If someone goes into cardiac arrest, first call 911, then immediately perform CPR. Place the palm of your non-dominant hand on the center of the person’s chest. If, like most people, you’re right-handed, you would place the palm of your left hand on the

Then with the dominant hand (your right hand, in this example), push down forcefully onto the top of your left hand, at about 100 times a minute. Pushing down this way squeezes blood out of the heart and keeps it flowing throughout the body. Every part of that person’s body needs a constant circulation of blood. The brain needs it most: If it doesn’t have a circulation of blood for more than four minutes, brain cells start to die.

In adults with cardiac arrest, this hands-only approach is just as effective – and possibly better – than CPR with rescue breathing. That’s because a person who suddenly collapses has a fair amount of oxygen in his or her bloodstream and doesn’t need the extra oxygen supplied by rescue breathing. Stopping compressions for rescue breathing may do more harm than good because it temporarily stops blood flowing to the brain.

All 911 operators are trained to give verbal cues for CPR. You

can put your phone on speaker and ask the operator to talk you through the steps. The operator will count out loud to help you administer compressions at about 100 beats per minute.

CPR can be the difference between life and death. It keeps blood circulating until the person’s heart can be shocked back into a normal rhythm with an automated external defibrillator (AED). Emergency personnel will bring and use an AED. Many public areas have AEDs, which use voice prompts, lights and text messages to guide users (even someone who hasn’t been trained) through the steps.

The AHA, American Red Cross and other organizations offer classes on CPR and using a public defibrillator. You can also learn CPR by using a smartphone app or watching a brief video at www. heart.org/HandsOnlyCPR. It’s worth the time and effort. Four out of every five cardiac arrests happen at home, so the person you save is likely to be someone you love.

Dr. Wallace: I’m 16 and still not allowed to date or even to go out with my girlfriends in the evenings. In fact, even if I’m just going out with my girlfriends, I have to give my dad a complete itinerary of my plans.

I’m a trustworthy and dependable teen, and I understand my dad’s concern for his only daughter, but I think this is ridiculous. He acts like he’s afraid I’m going to have sex every time I walk out the front door.

I really do love my father, but lately, when it comes to my social life, I’m beginning to hate him. I have no social life at all because I’m always stuck at home every weekend watching stupid programs on television. I happen to enjoy attending my reunions to “rub it in” to the popular students that I turned out much better than they did. I “float” among them bragging about my many successes. I smile when the “best of the best” became alcoholics, drug abusers, had abortions and lost their houses when the bank foreclosed because of missed mortgage payments. And, of course, many had kids who were in trouble with the law.

We have been looking at deals with two potential trump suits, not three.

By far the best analysis of the subject was written by Albert Morehead for his book, “Morehead on Bidding.” This was updated by Alan Truscott and your Present Author under the title “On Bidding.” It was an easy job because it was such a good book.

Sadly, it has been out of print for years, but maybe you can find a copy online.

In today’s deal, the problem is not locating the best trump fit, but landing in a game contract that can be made.

North-South have only one eight-card fit. Five diamonds, though, can be defeated if East establishes his club trick quickly. Then the defenders will take two hearts and one club.

Reaching a 4-3-fit contract is always difficult. Here, South’s three-heart cue-bid asks North to bid three no-trump with a heart stopper. When North cannot oblige, he shows threecard spade support. (With four spades, he would have raised on the previous round.) Then South, with such strong spades, goes with the 4-3 fit, the only game that cannot be defeated.

West leads the heart three.

East takes two tricks in the suit and – best – plays a third round.

Ruffing this trick will be fatal unless the trumps are breaking 3-3. Instead, South discards a club. If East either plays a fourth heart or shifts to the club king, declarer can win, draw trumps and claim.
