GENEVA – A Geneva woman is accused of fatally poisoning her husband of 31 years last week, according to a news release from the Kane County State’s Attorney’s Office. She is the second city resident in two years to face a first-degree murder charge in the death of a spouse. Associate Judge Marmarie Kostelny read the charge to Julia L. Gutierrez, 53, during bond court Tuesday morning, less than a week after authorities found her husband dead in their Crissey Avenue home. Gutierrez, who worked for Geneva School District 304 as a bus driver between 1992 and 2004, was being held Tuesday in the Julia L. Kane County jail in St. Gutierrez Charles Township. She was expected in court this morning for a continued bond hearing. According to the release, the Geneva Police Department and the Kane County State’s Attorney’s Office allege that Gutierrez mixed Temazepam, a sedative, into a drink and gave it to her husband sometime between Jan. 26 and Jan. 28. “Eduardo Gutierrez, unaware of the Temazepam, consumed the drink and died as a result,” the release states.
