Proposed fee hike pushed back

By BOB OKON bokon@shawmedia.com JOLIET – The Joliet City Council for a second straight night put off proposed rate and fee hikes for water and sewer services, saying they wanted more information before making a decision.

The council on Monday decided to delay a proposed hike in general water and sewer rates that was to start on Oct. 1.

Flying under the radar were about a dozen fee increases ranging from tap-on charges for water mains to fines for late water payments.

Those hikes were discussed at a public meeting for the first time Tuesday, and council members had to ask for clarification on how much some fees were being hiked.

Councilman John Gerl also called for the fee increases to be postponed so the city

“I think if we’re going to do something like this we need to reach out to our business community and find out if these fees are acceptable.”

Councilman Michael Turk at one point asked if staff had a comparison of the proposed fees with those of other municipalities. Utilities Directer James Eggen said he did not have the information.

The council on Monday put off hikes in water and sewer rates sought be Eggen.

Eggen had asked for a 9 percent increase on Oct. 1, followed in the next three years by hikes of 8 percent, 6 percent and 5 percent.

Councilman Larry Hug said Monday he did not want to vote on a rate hike until a consultant was brought in to find cost savings in the city’s utility operations.

“We brought in a consultant to tell us how to spend money. I’d like to bring in a consultant to tell us how to save it,” Hug said.

The rate hikes were based on a consultant’s analysis looking at needed revenues to pay for $71 million in mandated sewer improvements as well as about $50 million in spending to improve water mains and other utility lines and facilities.

Joliet High School D-204 board approves 2016 budget

By FELIX SARVER fsarver@shawmedia.com JOLIET – Joliet Township High School District 204 board members approved the fiscal 2016 budget, which projects conservative revenues because of uncertain state funding.

The budget received unanimous approval from the board Tuesday, with board member Arlene Albert absent. The final budget estimates revenues at about $103.8 million and expenses at about $103.5 million, District 204 officials said.

“Due to the uncertainty with our state, I have been very conservative in the revenue estimates,” stated Ilandus Hampton, assistant superintendent for business services, in a memorandum.

Under the fiscal 2016 budget, general state aid is estimated to be at about $7.8 million and all other state

and federal aid is expected to remain the same as last year, district officials said. Student-related fees are included in the budget with no increase for the fifth year.

Health insurance costs will see a minimal increase in the budget, as well as transportation because of fuel costs, state legislation changes, added personnel and wages, district officials said.

Enrollment

The fiscal 2016 budget anticipates an enrollment increase for District 204 over last year.

Enrollment trend continues to be below estimated growth projections stated a previous Kasarda report. District officials recommended waiting a few more years before another projection is done in light of uncertainty with economic recovery.

District 204 officials presented the 10th day enrollment

count for the 2015 semester, showing a continuing trend of increasing number of students districtwide since the 2008 school year.

Districtwide enrollment is at 6,299 students, which is four more students than the 2014 school year and 166 more than the 2013 school year.

Central High School enrollment, which is at 3,102 students, decreased from last year by 17 students. West high school’s enrollment of 3,140 students represented an increase of 31 students over last year.

District officials said the figures do not include students housed in facilities other than the assigned campuses.

The school district has private day facilities, other public day facilities and residential facilities, according to the enrollment report. The total amount of students housed in those facilities was 105.

On Tuesday, Councilman Pat Mudron questioned the decision to push back rate hikes to fund the mandated project. He noted some council members had complained that previous city councils had not finished the job in the past.

“With us kicking this down the road again, aren’t we doing the same thing we said other councils have done?” Mudron asked.

But some council members want to know how much of a rate increase would be needed to fund the mandated improvements alone before making a decision.

Work underway at Chicagoland Speedway for NASCAR Sprint Cup

By LAUREN LEONE–CROSS lleonecross@shawmedia.com JOLIET – It was only Monday – days away from the start of the Chicagoland Speedway’s Chase for the NASCAR Sprint Cup race – but workers and team members were at the Joliet racing venue, hard at work preparing for the arrival of thousands of race fans for the weekend event.

“As you can imagine, it’s an amazing, massive undertaking. Historically, it’s been the state of Illinois’ largest single-day spectator sporting event,” Speedway President Scott Paddock said. “We have been planning [for the Sprint Cup] since the day the event ended last year.”

The Friday and Saturday precursors of the Spring Car race – including the Furious 7 300 Xfinity Series and the Camping World Truck Series – serve as a buildup to Sunday’s big race that kicksoff NASCAR’s Chase for the Sprint Cup Series.

Workers, including Kenny Bogner, head graphic designer with Missouri Turf Inc., will be out in full force all week preparing the grounds.

Bogner stood in the middle of the expansive, grassy infield of the Speedway’s NASCAR track Monday, his blue gloves speckled with latex paint.

He and his crew are responsible for the colorful, gigantic logos and designs race fans will see painted across the infield of the NASCAR track when they arrive. At least 500 gallons of paint will be used for the planned 11 logos.

By LAUREN LEONE–CROSS lleonecross@shawmedia.com BOLINGBROOK – Investment in freight movement is key to Will County and the Chicago region remaining players in the global economy, business experts said Tuesday during the Will County Center for Economic Development’s ninth annual Global Summit.

“Without a unified effort to prioritize freight coordination and investment, we risk eroding our metropolitan region’s competitive advantage,” Joseph Szabo, executive director for the Chicago Metropolitan Agency for Planning, told a filled banquet hall at the Bolingbrook Golf Club.

Congress for too long has delayed the prioritization of funding for the nation’s freight system, said Elaine Nessle, executive manager director for the Coalition for America’s Gateways and Trade Corridors.

That gives lawmakers opportunity to delay tough decisions about declining gas tax revenue and a need for designated freight funding.

John Greuling, president and CEO for the Will County Center for Economic Development, said this year’s theme – “Connecting Globally, Acting Locally” – was chosen to highlight the need for local solutions to a global problem, Greuling said.

He said he often hears about the traffic congestion from an unlikely associate – his wife.

“The No. 1 challenge that I hear about, and I hear about it from my wife, is traffic,” Greuling said. “So every time she gets stopped at a railroad crossing, and a double-decker container freight train is going by, she texts me and says, ‘You’ve done it again.’ ”

handle the retiring workforce, namely baby boomers.

“How do we replenish that workforce?” he asked.

Rick Blasgen, president and CEO for the Council of Supply Chain Management Professionals, said recruiting college students is key, while noting a truck driver shortage – brought on by lagging improvements in pay, efficiency and quality of life.

Few hands rose in the air when Blasgen asked how many audience members had children aiming for a career in the trucking industry.

“Yet 75 percent of our freight still moves on a truck. It’s a big issue for our country and we’ve got to figure it out,” Blasgen said. “We have to spend more money on truck drivers as manufacturers and shippers spend more money on making sure we secure the capacity we need to move freight.”

Speakers also included Randy Blankenhorn, secretary for the Illinois Department of Transportation, and Doug Whitley, executive director of Supply Chain Innovation Network of Chicago.

Gaffney going to D.C. to hear Pope Francis speak

By BOB OKON bokon@shawmedia.com ROMEOVILLE – Brother James Gaffney, president of Lewis University, will be in the gallery to hear Pope Francis’ address to the U.S. Congress on Sept. 24.

Gaffney will Brother attend as the James guest of U.S. Gaffney Rep. Bill Foster, D-Naperville. He will be among the 535 Americans attending the speech – the first made by a pope to Congress.

Gaffney said Tuesday attending the speech will be “a great honor.” Gaffney also said he is very interested in what the pope has to say to Congress.

“I think he’s tremendously respected,” Gaffney said. “He’s able to get through to people and not be dismissed because he’s not condemnatory.”

Gaffney said students at Lewis are interested in the pope’s visit to the United States.

“They find him to be really genuine and authentic,” Gaffney said. “A lot of them see he is addressing issues that mean a great deal to them, whether

ocratic caucus leader for the Will County Board and pastor of St. John Missionary Baptist Church in Joliet, and R. Dale Evans, a member of the Joliet Township High School District 204 Board of Education who organizes the annual “Day On, Not a Day Off” volunteer projects on Martin Luther King Jr. Day. Brooks said he is looking forward to hearing what Pope Francis has to say to Congress.

“I think it’s very important,” Brooks said. “This pope is different. He’s the people’s pope. I like his message. ... I’m very interested in his message to America.”

Trial: Man hit wife with car twice

By BRIAN STANLEY bstanley@shawmedia.com JOLIET – Jerry M. Nichols hunched over in his chair sobbing Tuesday afternoon while a video recording of him hunched over in his chair sobbing played on the large screen beside him in a courtroom in the Will County Courthouse.

The jury of six men and six women watched the recording, which was taken by the Crest Hill Police Department on Jan. 26, 2013, in which Detective Renee Maly told Nichols his wife, Diane, had died at the hospital.

“The evidence will show [it was] a very simple crime – a domestic murder,” Will County Assistant State’s Attorney John Connor said.

But defense attorney Michael Ettinger said Diane Nichols’ death was the result of Jerry Nichols accidentally striking her with the car and lashing out when the accident triggered his post-traumatic

stress disorder.

In the recording, Nichols told Maly he and his wife were going shopping for a birthday present for her grandson and he went to the garage of their home in the 16000 block of Arbor Vitae Circle to warm up her 2007 Honda Accord. He said she’d parked too close to the wall and he backed up to give her room to get in.

“He was stepping on the gas pedal to [rev the engine] and warm it up faster, had his other foot on the brake and thought it was in park or neutral,” Sgt. Jeff Reick testified Jerry Nichols told him at the scene.

The Accord went forward, pinning Diane Nichols to the rear wall of the garage, her husband told Maly.

“I heard [her say] ‘Back up!’ but I must have moved the lever down instead of up,” Nichols said on the recording.

By LAUREN LEONE–CROSS lleonecross@shawmedia.com CHANNAHON – A Missouri man who claimed he was kidnapped after a night out with coworkers was arrested Tuesday by officers with Illinois State Police District 5, according to a news release from ISP. The car he was traveling in was located along Interstate 55 near Channahon.

After an investigation, James Stamer, 32, of St. Charles, Missouri, was taken into custody and charged with

two counts of disorderly conduct, a Class 4 felony, according to the news release.

Family and friends of Stamer reported to police that he sent them text and social media messages during the early morning hours Tuesday that he was being held “against his will” in a vehicle traveling north on Interstate 55, according to the news release. He asked family members to call state police for help.

Several calls also were made about 1 a.m. Tuesday from Stamer’s cellphone to the Logan

911 on his cellphone and was told to perform CPR. Lockport Township Fire Battalion Chief Frank Blaskey was a mile from the Nichols’ house when the call came in and saw Jerry Nichols “standing over something in the garage” as he drove past the driveway, Blaskey testified.

“I walked through the yard and came [in] the garage to see him raise his foot and stomp very forcefully on the face and head area of the person laying on the ground two times,” Blaskey said.

Blaskey asked Jerry Nichols what he was doing and Nichols replied he “was trying to give her blood,” according to the 911 recording.

Blaskey told defense attorney Mark Besbekos that Jerry Nichols agreed to come out of the garage as other paramedics arrived and he was not enraged or evasive.

The trial will continue Wednesday.

County 911 dispatch center, the news release stated, prompting state police to request assistance from other state and local police departments in locating Stamer.

Police determined that the claims were a hoax perpetuated by Stamer, without the knowledge of the driver of the vehicle he was in, according to the news release.

Channahon Deputy Police Chief Adam Bogart said Tuesday his department was not involved with locating Stamer or the investigation.

LOCAL BRIEF Joliet sees 2 shootings in 2 hours Monday night

JOLIET – Police are investigating two shootings that occurred Monday night in Joliet.

The first happened at 9:07 p.m. in the 1100 block of Magnolia Avenue, where witnesses said a white Chevrolet Impala was traveling north and its occupants fired about five shots before driving away, according to Joliet Deputy Police Chief Ed Gregory.

A 44-year-old man and a 37-year-old man were each struck in the left foot and driven by friends to Silver Cross Hospital in New Lenox, Gregory said.

Neither wound was considered life-threatening.

An unoccupied pickup truck parked on the street was also struck by a bullet, according to Gregory.

In the second shooting, a 23-year-old woman was in her home just before 11 p.m. in the

800 block of Robin Lane when a bullet broke the front door window and lodged in the kitchen wall, Gregory said. The siding of the house also was damaged.

Will County sheriff’s deputies in the area heard the shots, but police did not locate any suspects, according to Gregory.

Both shootings still were under investigation Tuesday, and it was unknown whether they are related.

Township given go-ahead to inspect Bicentennial Park

By BOB OKON bokon@shawmedia.com JOLIET – City officials have given Joliet Township permission to inspect Billie Limacher Bicentennial Park as a prelude to a possible change in park ownership.

Joliet Township Supervisor Dan Vera sought permission to bring contractors onto park property to inspect buildings and grounds as he pitches a plan to put the park under township control.

The City Council met with Vera in closed session at the end of its meeting Monday.

During that closed session they gave Vera permission to inspect the park, which is owned by the city.

City Manager Jim Hock said there was no need to take a formal vote in open session on the matter.

“It was just a consensus,” Hock said. “It doesn’t require any action by the city.”

Mayor Bob O’Dekirk said Tuesday he did not think

the decision to allow the township to inspect the park means the council is ready to cede control, adding that the township has not yet made a formal proposal to the city.

“I think until something is put on the table you’re not going to get a hard answer from the council,” O’Dekirk said.

The council did debate in open session Monday whether or not to allow the township to inspect Bicentennial Park.

Councilman Jim McFarland said he opposed giving the park to the township and also said he was against letting township contractors onto the property to do inspections.

Councilman Pat Mudron, however, said the city does not have money in its budget to bring back major events at Bicentennial Park and Joliet should consider the township option.

“I see no downside in letting them do their due diligence,” he said.

Vera has said he wants to

be able to inspect the park to determine its condition so the township board can vote at its October meeting on whether to pursue an intergovernmental agreement with the city that would allow the township to operate the park.

What that agreement would look like is not clear.

But Vera told the council in open session Monday he wanted a transfer of ownership because the township would invest money in upgrading the park and staging events.

Vera also said he planned to keep activities at the park and did not want to change the historical features, which include plaques on boulders commemorating the site’s history as Joliet’s old Bluff Street business district.

The boulders “would stay,” Vera told the council. “We have no intention of moving boulders and those plaques. ... There is no intention of getting rid of history.”

Vera could not be reached Tuesday for comment.

Tornado victims set to receive aid starting in October

By HEIDI LITCHFIELD hlitchfield@shawmedia.com COAL CITY – The Long Term Recovery Committee in charge of the distribution from the relief fund for victims of the June 22 EF3 tornado said it will begin distributing money in October to affected residents.

To date there is $299,235.54 in the fund managed by the Community Foundation of Grundy County. About $20,000 of that was in place before the tornado and will remain in the fund in the event of another disaster. Operation St. Nick and Community Foundation of Grundy County each donated $10,000 to the fund after the Diamond tornado.

Gagliardo, program director with the foundation, said at Monday night’s Coal City Village Board meeting. “We hope the first disbursement of funds will be by mid-October.”

Gagliardo said Tuesday that the committee met again Tuesday morning and decided how to distribute the funds.

“A majority of the funds will be released between mid-October to the beginning of November to those who are registered,” she said. “Some funds will be set aside and will be used next spring on an as needed basis for those still needing assistance.”

Families must be registered by Oct. 2 with their case management team to be eligible for the funds. Gagliardo said just under 400 people are registered, and the group has decided those who have not registered either do not need or want the assistance. More than 800 properties were damaged by the tornado.

ELWOOD – Elwood School parents were notified Tuesday morning of a student’s “inappropriate” post on the Internet during the weekend.

“Over the weekend we did have a student make an inappropriate post on the Internet,” Principal Tom McLaughlin said in a message that went out to parents via phone, email and Facebook.

“We would like everyone to know that there was no evidence found of an immediate threat to a specific student or staff member,” he said.

The message doesn’t explain the nature of the post. Phone calls to the school’s administration and the Elwood Police Department weren’t immediately returned Tuesday afternoon.

The message stated Elwood Community Consolidated School District 203 officials have been in contact with the district attorney and Elwood police.

Trustees generally were in favor of the new impact fee structure. But some cautioned on keeping the impact fee total high.

“I don’t want us to price ourselves out of the market,” trustee Brian Wojowski said.

The economic incentive policy also was well-received by trustees, as well as its minimum criteria for businesses or organizations receiving benefits.

According to the policy, incentives potentially available include extension of public utilities, tax-increment financing, industrial development bonds, revenue bonds, waiver of village fees, real estate tax abatements or tax rebates, sales tax rebates, waiver or modification of village code and assistance in acquiring parcels of land for development.

New Lenox appoints new trustee

By SARWAT S. AHMAD Shaw Media correspondent NEW LENOX – New Lenox resident and businessman Doug Finnegan unanimously was approved Monday night by the Village Board to fill the trustee seat vacated by Nancy Dye in July.

Mayor Tim Baldermann and trustee Annette Bowden chose Finnegan for a two-year appointment from a pool of 12 candidates who expressed interest in the position.

Bowden said the decision “was not an easy one.”

Finnegan, 49, grew up in Iowa and moved from Lombard to New Lenox in 2005.

Finnegan works at the New Lenox office of Bank of England Mortgage, where he is a sales manager and senior mortgage banker.

Finnegan said he would like to help continue growth in New Lenox, especially for small businesses.

“I’m a pro-business guy,” he said. “I like to see people do well for themselves, their families and for New Lenox.”

Finnegan said he had entertained running for the board in April, but seeing the incum-

bents he supported were running for those seats, he opted not to run.

He said he plans to run again in 2017, after his appointed term ends.

Sewer service rates to go up

According to an ordinance introduced to the board Monday night, sewer service rates will go up starting Jan. 1 to generate revenue for upgrades and expansion of the village’s sewage system.

Once approved at the board’s Sept. 28 meeting, the village expects to see about $1.4 million in additional revenue a year from the increased rates.

According to Baldermann, the village has estimated the average family, which uses about 4,000 gallons a month, will see about a $15 increase on its monthly bill in 2016.

Residents under age 65 will see their volume rate go up from $5.05 to $7.87 per 1,000 gallons, the ordinance stated. The fixed monthly rate also will increase – to $11.19 from $7.

Senior citizen’s fixed monthly rate will stay at $7 and their volume rate for the first 1,000 gallons used also will stay

at $5.05. Consumption above that will be billed at the $7.87 per 1,000 gallon rate.

Rates will increase 8 percent in 2017 and 2018, with 5 percent, 4 percent and 3 percent increases in 2019, 2020 and 2021.

Keeping plants maintained and upgraded to accommodate increased use in a growing community and maintaining the quality of life is “an expensive proposition,” Baldermann said.

The village this year started the process for upgrading and expanding Plant No. 2, on Cedar Road north of Route 30.

Last April the board approved an agreement with a Chicago-based firm to submit an engineering proposal for the proposed $19 million project to the Illinois Environmental Protection Agency in order to secure a loan that would save the village thousands of dollars in interest payments.

PLAINFIELD – Plainfield officials may bring back residential impact fees for new home construction, which the village halted during the Great Recession.

But they also are considering an economic incentive policy to help business growth.

Village trustees discussed Monday a new business plan and impact fee structure for residential development.

In 2010, the village eliminated annexation, municipal, traffic and beautification fees totaling $6,750 a home. The current fee structure includes fees for water and sanitary-sewer connection, amounting to $7,172, not including school and park district fees.

“We are seeing the recovery now,” Village Planner Michael Garrigan said. “We are looking for whether there is support for

reintroducing some municipal impact fees.”

The goal is to raise more revenue while still being competitive.

The new fee structure would increase each of those fees to $4,000, and add a $1,000 annexation fee an acre and a $2,000 municipal impact fee a home, based on a density less than 2.9 units an acre.

The municipal impact fee would rise to $6,000 an acre for densities between 3 and 3.9, $12,000 for densities between 4 and 4.9 and $20,000 an acre for densities between 5 and 5.9.

At the same time, the new business plan calls for the elimination of impact fees, including annexation and traffic fees, for new commercial development.

Garrigan said the village is in talks with Plainfield School District 202 and others to determine how the proposed fees would impact development.

While Illinois does not allow attorneys to claim they are “specialists”, it is true that most attorneys have certain areas of law that they practice on a regular basis and are therefore, more familiar with the rules and local courtroom procedures. Q: Are the claims that we need more workers’ compensation reform valid?

A: For the most part, no. For over 100 years, the Workers’ Compensation Laws have been the result of agreements between business and labor that in exchange for employer immunity, employees would get reasonable workers’ compensation benefits. It is a no fault system, but benefits are limited and capped.

The last major changes in Workers’ Compensation Act were in 2005 and 2011. In 2005, there were minor increases to the values of losses of scheduled body parts, increases to the maximum amount of wage differential payments which could be made, and a medical fee schedule was established so that runaway medical costs could be controlled. While employers keep trying to lessen the cost of employee benefits, the major cost in workers’ compensation claims is actually medical expenses.

Because of this, in 2011 reforms were made which were strictly pro-business. The Medical Fee Schedule was reduced by 30%.

Traditionally, medical fees in workers’ compensation cases are higher mostly because of the red tape and bologna doctors and hospitals have to put up with in dealing with workers’ compensation adjusters. But there were also changes which hurt employees. First,America Medical Association guidelines, which are as phony as a three dollar bill, were introduced as a factor to be considered in determin-

ing this disability. Second, wage differential payments were capped at age 67, although we commonly now see people working well into their 70’s. Employers were given the opportunity to create preferred provider programs so that they could have doctors under contract to perform less expensive medical care, and there were other benefits for employers.

The worst, change, however, in addition to the AMA Impairment Ratings, was that theArbitrators were removed from Civil Service and were appointed to three year terms, to be renewed at the whim of the Governor, which made their jobs completely political. Previously, Arbitrator’s could simply award what they thought was appropriate under Workers’ Compensation Commission precedent.

With all these changes, Illinois, one of the top States in the Country, is 7th in terms of Workers’ Compensation costs, because we are a northern state whose employees have a higher quality of life, and which for the most part provides better workers for the employers. This is right about where we should be. Yet, notwithstanding, business insist on Workers’ Compensation “Reform”, which is just not needed. The number of workers’ compensation claims the last several years have been down, and the awards, thanks to the introduction of these artificially low AMA Ratings, have likewise been down. So when the Governor asks for Workers’ Compensation Reform, all he is doing is appealing to his base, when in fact the reforms have already been made.

were from her lawyer’s office and they were at her home to get information for a new will and trust.

I called my client to find out what happened. She told me about the repeated calls; the evening appointment at her home and her missing jewelry. I told her that at no time would anyone at our office go to her home unless she had first called me and had scheduled an evening “house call” for me to go to her home. I suggested to her that she call her children and tell them no one from our office was at her home and that she file a police report.

Not more than two weeks later my other client called. She told me of her son-in-law’s death; of repeated calls to her home; and that the caller said he was from her lawyer’s office. She told me that she had set up an appointment with the caller for the next evening at 8:00 p.m. The caller left no return phone number. With her permission, I called my client’s son and her town’s police department to make sure someone was with my client when the con-artists showed up for “the appointment”.

My second client thought the caller’s proposal sound “fishy”. She had foresight to call my office to find out if someone from my law firm had called her.

Luckily, no one showed up for “the appointment”.

I doubt the con-artists wanted to keep “the appointment” when they saw the police car parked in front of my client’s home.

Beware! Beware! Beware!

If someone keeps calling you and asking you to do something that seems “fishy”; it probably is.

Q: Is it possible to leave property to my pet when I pass away?

A: Under the Trust for Domestic or Pet Animals Act, an individual may leave property at death in trust for the care of a beloved pet. Since enactment of the Act, an individual may provide for a pet with the knowledge that enforcement authority exists to ensure that the bequest is utilized exclusively for the care of your pet (under prior law there was no mechanism for enforcement). Under the Act, an individual is given considerable flexibility to create instructions regarding the use of funds for the benefit of a pet, as well as restrictions on the Trustee’s ability to use trust funds other

than for the express purposes set forth in the instrument. Complete prohibition of the Trustee to use funds for his or her own benefit is also permitted under the Act. Know also that if the designated “protector” or the court finds that a Trustee breached its duty, or went beyond the authority set forth in the document, theTrustee can be removed, and a replacement Trustee appointed.

Similar, disturbing incidents have happened to two of my clients in the past few weeks. One became a victim of some con artists; the other almost became a victim. What happened in both episodes was this: My clients had younger relatives pass away. The younger persons’ obituaries read something like this: “Mary Ann Smith [names changed], 55, late of Joliet died unexpectedly last week at her home. Surviving are her loving husband, Walter; her children, Ann Marie and Mark Thomas Smith, of Joliet; mother-in-law Margaret (late Martin) Smith of Crest Hill; her sister...”

What does this obituary notice tell us besides the fact that Mary Ann Smith died unexpectedly?

It tells us that 55-year old Mary Ann Smith’s mother-in-law is a widow, her father-in-law, Martin, is deceased; Margaret is probably in her late 70’s or early 80’s; she probably lives alone; and if Margaret’s name is not listed in the phone book, her telephone is probably still listed under her late husband’s, Martin’s, name.

For some con artists this is an open invitation to do their dirty work. Both of my clients were called at home within two weeks of the obituary notice appearing in the newspaper. They were told their attorney wanted them to get a new will and a trust. The con artists kept calling and calling and calling my clients until both of my clients relented and set up an appointment to meet the con artist in my clients’ homes between 7:30 p.m. and 9:00 p.m.

A middle aged man and woman came into the home of my first client. While the woman engaged my client in pleasant conversation, the man asked to use the bathroom and apparently “cased” the house.

He also apparently took some very valuable jewelry from my client’s upstairs bedroom. My client’s children called me several days later to ask if I had sent someone to their mother’s home. They said their mother was told they

C. RICHARD ANSELMINO C. Richard “Dick” Anselmino, passed away suddenly, Saturday, September 13, 2015. Age 80 years.

Dick was a lifelong Joliet resident. He attended Joliet Township High School where he played the clarinet in the band and was part of two Presidential Inauguration parades (Truman and Eisenhower). He attended Marquette University and while in Milwaukee met his future wife Phyllis whom he married on June 22, 1957.

Upon his return to Joliet he joined the family business Anselmino’s Fine Foods with his mom and dad, Mary and Charlie. A business Charlie started in 1933 and served the community for 54 years. Dick was not just a store owner, he was a friend and a mentor to many. After the store closed in 1987, he became a Realtor with Karges Realty for over 25 years. As long as he was working with people, he was happy.

He never met a stranger, and made friends wherever he went. Dick’s favorite place in the world was Door County Wisconsin. He loved taking photos of the fall leaves, sail boats, and the beautiful scenery. He spent 36 wonderful years enjoying his

She was born April 17, 1931, in Joliet, the daughter of Louis and Mary Todorovich, and attended Joliet Township HS (Class of 1948) and the College of St Francis, where she earned a BA in Music Education in 1952. She married Ernest O. Caneva of Lockport and resided in Lockport and New Lenox for most of her adult life.

Lillian was a teacher at Providence Catholic High School in New Lenox, Bolingbrook High School, ChaneyMonge Grade School (Crest Hill) and Ludwig Grade School (Lockport), and served as Organist for United Methodist Church in New Lenox and Choir and Bell Choir Director for Grace Methodist Church in Joliet.

After her husband’s death, Lillian moved to Champaign where she was

active in PEO, St Matthew’s Parish, and the University of Illinois Oratorio Society. She also served as a volunteer at the Krannert Center for the Performing Arts, and was a member of the Slovenian Union of America.

She is pre-deceased by husband, Ernest O. Caneva; parents, Louis and Mary (Pasdertz) Todorovich; siblings, Mary (Bruno) Briick, William (Winefred) Todorovich, Olga (Frank) Strysik, Helen (Richard) Sak, Richard (Dorothy) Todorovich; and step-children, Maureen Caneva (Joseph) Fitzgerald and Donald (Brenda) Caneva.

He was proud to have golfed the old course at St. Andrews in Scotland, with his brothers-in-law, Bill and Jessie.

Illinois stops health claims payments for 146,000 workers

SPRINGFIELD – Gov. Bruce Rauner’s administration has stopped paying health care claims for at least 146,000 state workers because of the budget mess.

The Springfield State Journal-Register reported the Department of Central Management Services has halted funding for claims covered by the state’s self-insurance plans.

But payments will continue to private companies operating managed-care plans for another 158,000 workers.

The newspaper reported it’s unprecedented for the state to stop paying claims. It’s unclear whether health care providers will demand upfront, out-of-pocket payments.

Prosecutors: Schock ‘deceptively refused’ to hand over docs

SPRINGFIELD – Federal prosecutors say Aaron Schock has “deceptively refused” to hand over all of the documents they’ve subpoenaed as part of an investigation into the former congressman.

The Chicago Tribune reported Assistant U.S. Attorney Timothy Bass wrote in a filing late Monday that documents not yet turned over include emails between

Schock and congressional staffers, his campaign treasurer, his friends and sister.

The Peoria Republican has turned over about 10,000 financial records. He is to make another nearly 3,000 records available by Thursday for a judge to decide if they will be given to prosecutors.

Schock resigned March 31 after media reports about his spending.

A grand jury has been meeting all summer in Springfield over the issue. His attorneys have until Sept.

30 to reply to Monday’s filing.

Major pumpkin manufacturer says harvest down

MORTON – A large canned pumpkin manufacturer says yields in Illinois appear to be less than anticipated this year.

Roz O’Hearn is corporate and brand affairs director for Libby’s, which grows most of its pumpkins in central Illinois. O’Hearn told the Peoria Journal Star “the yield could be off by as much as a third” and the company is “disappointed.”

O’Hearn said weather could further reduce yields. The harvest is underway now through October or early November. However, O’Hearn said the company thinks it will have enough pumpkin to meet fall holiday demand.

Libby’s has run a processing plant in Morton since 1929. It is owned by Nestle.

The University of Illinois said 90 percent of the pumpkins grown in the U.S. are raised within a 90mile radius of Peoria.

CHICAGO – A leading child advocacy group warned Tuesday that even if legislators and Gov. Bruce Rauner end the state budget impasse soon, the damage already is done to numerous services, including afterschool programs and efforts to prevent infant deaths.

Voices for Illinois Children released a report outlining over 60 programs and services affected by the stalemate. The document is among the first detailing the impact during the complex fiscal limbo, where many state services are being funded through court orders while other groups who provide state services have pursued layoffs or closed doors because Illinois doesn’t have the authority to pay them without a budget. Advocates estimated groups in the report represent billions in state money.

Some groups said they fear furloughed or laid off employees won’t return because of the unpredictable situation. A coalition overseeing teen afterschool programs reported more than dozen programs – serving over 1,000 children – have closed.

Sudden Infant Death Services of Illinois Inc., which provides education to families about SIDS prevention, said it was down to

The new tests focus on math, English and language arts, and were given to third and eighth graders and high schools students in the spring. The PARCC exams replace the Illinois Standards Achievement Tests for grade-school students and the Prairie State Achievement Examination for 11th graders.

In 2013 and 2014, more than 40 percent of students in those grades failed the old exams statewide.

Floods kill at least 16 in U.S. park, polygamous Utah town

By KIMBERLY PIERCEALL and BRADY McCOMBS The Associated Press HILDALE, Utah – Rescuers trudged through muddy streambeds Tuesday in a small polygamous town on the Utah-Arizona border and found the bodies of several children who died when their two vehicles were swept away in a torrent of floodwaters that killed at least 12 people. The same flash floods claimed at least four lives in nearby Zion National Park.

The van and SUV were filled with three women and 13 children when a wall of brown water overtook them Monday evening, carrying the vehicles several hundred yards downstream and sending them plunging down a flooded-out embankment with terrifying force. The SUV was smashed beyond recognition. Three people survived, all of them children, in the secluded community that is the home base of Warren Jeffs’ polygamous sect.

A witness described rush-

ing to where the vehicles came to a stop and seeing a gruesome scene of body parts, twisted metal and a young boy who survived the flood.

“The little boy was standing there,” Yvonne Holm said. “He said, ‘Are you guys going to help me?’”

One person was still missing Tuesday in the border town, and authorities had not identified the dead.

The children in the vehicles ranged from 4 years old to teenagers.

At nearby Zion National Park, authorities found four bodies, and they searched for three missing hikers who set out Monday to rappel down a narrow slot canyon. They left before park officials closed the canyons that evening because of flood warnings, park spokeswoman Holly Baker said. The hikers, from California and Nevada, were all in their 40s and 50s, Baker said. She had no details on their identities.

In Hildale, the streets were caked in red mud, and earth movers cleared the roads and

piled up mounds of dirt. As a helicopter buzzed overhead, crowds of boys in jeans and girls and women wearing deep-colored prairie dresses watched the rescue effort.

Residents called it the worst flood in memory for the sister towns of Hildale, Utah, and Colorado City, Arizona, located about 315 miles south of Salt Lake City at the foot of picturesque red rock cliffs. It was in this area at Maxwell Canyon where heavy rains sent water down Short Creek and barreling through the towns.

The torrent was so fast, “it was taking concrete pillars and just throwing them down, just moving them like plastic,” said Lorin Holm, who called the storm the heaviest in the 58 years he’s lived in the community.

The women and children were in the SUV and van on a gravel road north of the towns. They were returning from a park when they stopped at a flooded crossing and got out to watch the raging waters, Hildale Mayor Philip Barlow said.

In 911 call, professor admits to shooting girlfriend

By JEFF AMY and KEVIN McGILL The Associated Press GAUTIER, Miss. – In a 911 call, his voice only slightly shaky, college professor Shannon Lamb told police he had shot his wife and officers needed to get over to their house. Lamb made a point to say his “sweet dog” was there alive and probably upset, and said the dead woman’s family contacts could be found on her phone.

Inside the home, officers found Amy Prentiss’ body and a hand-written note scribbled on white legal pad: “I am so very sorry I wish I could take it back I loved Amy and she is the only woman who ever loved me,” read the letter authorities say was signed by Lamb.

There was no indication Lamb, who was teaching two online classes for Delta State University in Cleveland, Mississippi, already had traveled 300 miles to the school’s campus, where police believe he shot and killed a well-liked his-

Delta State University Police Chief Lynn Buford said university officials heard about the shooting at 10:18 a.m. Monday.

He said Lamb made the fateful 911 call sometime after that.

By the end of the day, there would be one more death: Lamb took his own life as police closed in on him.

A day after the school shooting forced students and faculty to hide behind locked doors, authorities still were trying to piece together what motivated Lamb. The details released by investigators at both ends of the state, as well as students and staff who knew him, helped paint a picture of a talented but possibly troubled teacher.

forward to his class. Police in Gautier, where Prentiss died, said he had no history of violence or criminal record.

Schmidt had included Lamb in a book he wrote where he acknowledged the “wonderful people” he shared his academic life with. Both taught in Division of Social Sciences and History.

At the same time, there were some inclinations of problems. A student who praised Lamb, Brandon Beavers, said he also seemed agitated and jittery, “like there was something wrong with him.” Another student, Mikel Sykes, said Lamb told him he was dealing with stress at the end of the 2014-15 academic year.

Lamb earlier had asked Delta State University for a medical leave of absence, saying he had a health issue of some sort.

This year, he was only teaching two online classes. Recent changes in the university’s hiring policies meant that the doctorate Lamb had worked to earn would not guarantee him

an automatic tenure track to become an assistant professor.

University President William LaForge said he didn’t know of any conflict between Lamb and Schmidt, but “obviously there was something in Mr. Lamb’s mind.”

After fleeing the campus, police later picked up Lamb’s trail when he crossed back into Mississippi from Arkansas.

Before he could be apprehended, Lamb killed himself with a single .38-caliber pistol shot in the backyard of a home about a mile south of his parents’ home near Greenville, Mississippi, said Washington County Coroner Methel Johnson.

It was not immediately clear why Lamb went to that home, although Johnson said she believes he knew the people who lived there. Lamb grew up in the area.

Lamb and Prentiss had apparently been dating for some time. In the 911 call, Lamb said “I killed my wife,” but there was no record of them ever marrying.

HORGOS, Serbia – Hungary sealed off its border with Serbia with massive coils of barbed wire Tuesday and began detaining migrants trying to use the country as a gateway to Western Europe, harsh new measures that left thousands of frustrated asylum-seekers piled up on the Serbian side of the border.

Human rights activists condemned the move, with Amnesty International saying Hungary’s “intimidating show of militarized force is shocking.”

But Prime Minister Viktor Orban defended the measures, saying he was acting to preserve Christian Europe, which he said had become threatened by the large numbers of Muslims streaming into the continent.

“The supply is nearly endless – we can see how many of them are coming,” Orban said in a televised address just before the new laws took effect at

midnight. “And if we look at the demographics, we can see that these people have more children than our communities who lead a traditional, Christian way of life.”

“Mathematics tells you that this will lead to a Europe where our way of life will end up in a minority, or at least face a very serious challenge.”

By nightfall Tuesday, thousands of migrants, including many babies and children, prepared to spend a night in the open or in flimsy tents erected in the bushes or on the main highway near the Serbian border with Hungary.

Men collected wood in a nearby forest for fires in preparation for a chilly night.

“I had hope until now, but it’s all gone,” lamented Mohammad Mahayni, a 32-yearold Syrian from Damascus, who became separated from his wife as they tried to enter Hungary a day earlier.

“I lifted the razor wire for her, she got in before a Hungarian border patrol came by,” he said. “Now I don’t know where

Lawmakers, not judges, should spend tax dollars SPRINGFIELD – It seems everyone is angry at the state of Illinois.

And one of the hottest is Danny Chasteen, who won $250,000 in the Illinois Lottery in July but, so far, has had to settle for an IOU. The factory foreman from Oglesby is none too happy.

“When you buy a winning lottery ticket, you ought to get paid,” Chasteen told me. “I paid $5 for that ticket and had to look at it four times before I convinced myself that I had just won $250,000.

And then I got a call from the lottery department and was told they can’t pay me until the state passes a budget.”

So Chasteen has made a federal case out of it. He is suing the state.

A judge will decide whether the state should start forking over the dough.

An unfortunate part of the budget impasse our state now faces is that it’s judges – not lawmakers – who are deciding how tax dollars are being spent.

That’s not the way things are supposed to work.

In June, Gov. Bruce Rauner vetoed most of the budget passed by the state Legislature because it was $4 billion out of balance.

Since then, we have had a constant tug of war between the state’s chief executive and the legislative leaders.

And we have been without a budget.

A judge has stepped in and said state employees must get paid.

Also, judges are enforcing a dozen other agreements regarding funding for state programs.

And more lawsuits are being filed asking judges to order more spending.

In fact, state Comptroller Leslie Munger said last week that between the court orders, numerous judicial agreements and some statutory requirements, the state is fulfilling 90 percent of its financial obligations.

We are also going broke one court order at a time.

REEDER REPORT Scott Reeder The General Assembly is supposed to be a deliberative body that sets priorities and develops policy.

Instead, we have seen lots of posturing but not much action.

The Legislature is allowing other branches of government to do the heavy lifting.

When the General Assembly passed a budget billions of dollars out of whack, it whined that the governor vetoed it rather than try to make cuts on his own.

And, increasingly, lawmakers have sat back and watched the judicial branch do its job for them by authorizing spending.

And what have legislators been doing? Looking busy, but accomplishing little.

Look no further than the measure passed by the Senate last week. It would increase state spending on welfare by $2 billion.

I don’t claim to be a math wizard, but anyone who ever has balanced a checkbook knows you can’t withdraw more than you have deposited.

In the case of the Senate, its latest measure – along with its original budget – arguably would put the state $6 billion into overdraft territory.

It’s the politics of gridlock.

Instead of making tough choices on a balanced budget, legislators are performing a charade and calling it governing.

We deserve a General Assembly that will work with the governor to make tough choices.

Instead, we have a legislative majority that wants others to make the tough calls.

We deserve better, and they know better.

LETTERS TO THE EDITOR Budget impasse must be solved quickly by legislature

To the Editor: We’re in our third month now without a budget, and many are speculating there’s a lack of compromise in sight. Despite this, the majority of state government is still operating, with the comptroller’s office estimating overspending by $300 million a month because of the continuation of appropriations through consent decrees, agreements and court orders.

Each week since adjournment, I have traveled to Springfield ready to arrive at a solution; but given the top-heavy nature of our legislative system, that solution has yet to come. In the House, legislation is prohibited from coming to the floor unless approved by the Democratic speaker, who holds a supermajority in the chamber. A similar problem faces my colleagues in the Senate.

And while rank-and-file members such as myself have tried to impress upon our chamber’s leaders the urgency of the situation and the necessity they negotiate with the governor on his reform agenda,

these calls have fallen on deaf ears. There continues to be an insistence by the Democrat majority in Illinois that unchecked spending should continue with absolutely no changes to the way Illinois operates.

There is no problem, they say, we just need more revenue. I believe the vast majority of Illinoisans recognize this isn’t the case. Illinois needs reform before new revenues should even be considered, and that is the sticking point.

If you agree Illinois needs reform before taxes are increased, then get engaged. I have a petition on my website, www.repmcdermed.com, that you can sign. Write a letter to the editor. Tell your friends on social media that Illinois needs reform.

Our colleges, service providers and state vendors are stuck in a cycle of fiscal uncertainty. That’s not fair, but neither is asking taxpayers to pay more without fundamental changes to the way Illinois does business. This impasse needs to be solved quickly, but it must be done with an eye toward the future.

But that was the case Tuesday for Allie Lindroth and Plainfield North.

Plainfield Central needed a total team effort to beat Southwest Prairie foe North, and that’s what the Wildcats had.

For the first time since 2013, the Wildcats beat the Tigers, 25-18, 23-25, 25-17.

“We were really excited to play them,” Erin Eulitz said.

“We knew that it was going to be very hard to beat them.

So we had to come out strong, ready to play, and everyone stepped up and played really well.”

The Wildcats (6-3) started the first game strong. Central, which out-blocked North

6-3, had a 4-1 block advantage in the first game and did that with only one middle.

Not only was junior Ashley Shook running a 5-1 offense, she had to pretend she was a middle blocker for the day – and she did it well. Shook totaled two solo blocks by out-jousting an opponent and three block assists good for 3½ blocks total in the game.

Eulitz tallied a team-high 14 digs, while Obradovich had nine and Hotchkin six.

The consistency in the back row on defense and serve-receive allowed Shook to earn 18 assists. Aside from leading the team in digs and aces (three), senior outside Eulitz had a break-out offensive game with 11 hard-swinging kills.

Shook tallied seven kills off effective setter dumps. Hotchkin had with six kills, one of which ended the match; and Megan Brock (five kills), Korrine Beard (three kills) and Grace Brock (two kills) each tallied more than one block assist.

The win was a team win for Central, but it was also a good loss for North. Compared with its match against Minooka on Thursday, Plainfield North (7-6) looked as if it improved.

The most noticeable part of North’s improved game was Lindroth. The senior outside worked with setter Lauren Murphy (34 assists) to run a faster tempo. With the quicker set, Lindroth was nearly unstoppable with .412 hitting percentage and 20 kills. Close to a third of her kills were bounces.

Senior middle blocker Lauren Robeck (seven kills) and Amy Stumpf (four kills) also worked with the faster offense.

“That was the smartest thing to do,” Lindroth said. “We talked about it before the game – faster tempo right off the bat.

When they blow the whistle, that’s when you have to push the serve. You speed the game and

offense up, and it makes it harder for the other team to react.

“We wanted to make sure that we had a faster-running offense that could hopefully throw them off. If it could’ve stayed consistent, we would have won the third game as well.”

Staying consistent comes with experience, something

North lacks this year. Although the Tigers appear senior-heavy on the roster, most of the seniors are defensive specialists.

“They are learning and growing, so you’ll see them morph over the season, but right now they’re learning hard lessons about mental focus all the way through and different things tactically,” North coach Tracey Marshall said. “I have to be able to input something into you and you be able to output it onto the court, and that’s

where they’re struggling right now. You see glimpses of what it could be. Hopefully, we’ll be there by the end of the season.”

The Tigers are focused on increasing their skill by the end of the season, but the Wildcats are fully ready to celebrate this in-season victory.

North has won conference numerous times in the past 10 years. Any win over the Tigers is a great one for Central and speaks to how the Wildcats have continued to improve.

“This type of win for us is something we’ll enjoy. I can’t say enough about how our program has progressed over the past couple of years,” coach Erik Vogt said. “The girls tonight played extremely well. We had a lot of girls play above and beyond what they are capable of doing.”

“They’re a big rival for us,” Shook said. “It was a great team effort. I’m very proud of the team, and I think that this is a good stepping stone for us and a turning point.”

By TIM CRONIN Shaw Media Correspondent JOLIET – Jim Messig has been a Jeff Gordon fan since the racer was a teenager wheeling midget cars around the bull rings of U.S. Auto Club. That’s back when it seemed Gordon, whose family moved from California to Indiana to further his quest, was destined for a career not in NASCAR, but in Indy car racing.

That’s more than 20 years ago.

On Sunday, the CARCARE Collision Centers chain he coowns with fellow Gordon fan Bill Aeschliman will have its logo on Gordon’s stock car when he runs in the Sprint Cup race at Chicagoland Speedway.

Was that the result of two fans from Joliet pooling their money and buying the spot on the Hendrick Motorsports car?

No, it was the result of two body shop guys merging their businesses nearly 20 years ago and growing it to the point that Axalta, Gordon’s main sponsor, offered them the promotional spot on the car as a reward for being a good customer.

Axalta Coating Systems – paint, quite simply – is the old DuPont paint division that DuPont, which has sponsored

Gordon his entire career, sold off a few years ago. CARCARE has been a steady customer; and as its operation has grown to 16 shops from Rockford to Effingham – with more on the way – it has used more and more paint.

“We’ll be guests of Axalta,” Messig said. “We’ve invited all our employees. We’ll have pit tours, getting a firsthand look at how NASCAR operates.”

Messig expects more than 125 employees – close to half the 280 on staff – to be in the stands Sunday. Messig and CEO Chris Ward will be in the pit area before the race and hang out in a suite during it, rooting for Gordon to grab his 93rd career victory in NASCAR’s top series.

“It’s tremendously exciting,” Ward said. “It’s the fruition of a tremendous amount of hard work, building a multishop platform. The television exposure will be significant.”

For Aeschliman and especially Messig, the serendipity of being Gordon fans and getting to have their company’s name on his car in his last race in their town is just too good.

“For me, it’s full circle,” Messig said. “In his early days, we’d go to Indianapolis Raceway Park and watch him run in midgets. Then it was sprint cars.”

Then, when Gordon couldn’t find a ride in the old CART series, Hendrick put him in a stock car. In 1994, less than two years after his first race, he was in Victory Lane in Charlotte; a few months after that, he won the first Brickyard 400. A racing star was born.

Messig and wife, Diana, are true fans.

“We go to about 13 races a year,” Diana Messig said. “It’s very rewarding.”

Last year, Gordon won the Brickyard 400 for the fifth time, the first driver to capture more than five races on the Indianapolis Motor Speedway oval. Messig and Aeschliman were there.

“Our paint distributor was on the back of the car,” Aeschliman said. “We happened to be in the pits and then in the winner’s circle. Got champagne sprayed on us.”

It doesn’t get much better, unless you’re in the car.

Speaking of which, guess where these two Gordon fans will be before the race? Riding with Gordon on his pre-race lap around the track with the other 42 starters.

Aeschliman sees a benefit beyond the thrill factor.

“It’s a great thing for Joliet to have our Joliet company on a car in the race in Joliet,” he said. “It’s an amazing opportunity.”

Local Jeff Gordon fans merit promotional spot

From a statistical standpoint, Brad Keselowski is not be having his best season on the NASCAR Sprint Cup circuit.

But that does not mean better times cannot lie ahead.

Keselowski, who will attempt to defend his myAFibRisk.com title Sunday afternoon as the Chase for the Sprint Cup gets underway at Chicagoland Speedway in Joliet, has won only one race this season – in the spring at Auto Club Speedway in Fontana, California.

Contrast that with 2014, when he led everyone with six victories, or with 2012, when he also won at Chicagoland Speedway, one of his five victories that season, and claimed the season championship.

“We have had a good year,” said Keselowski, the Team Penske teammate of fellow Chase qualifier Joey Logano, who has won twice in the past five weeks and three times in all. “We have

had more top 10s right now than what we had at this time last year. Yes, we have had very few wins. But we peaked about this time last year, and this year, we haven’t peaked yet. It’s a good feeling.

“Even though we won the most races and led a lot of laps last year, we did not win the championship. This year, we seem to be projecting toward peaking at just the right time.”

Keselowski is focused on that potential and is not overly concerned with the Joe Gibbs Racing team, whose drivers have combined for eight wins in the past 11 weeks.

“They are doing very well, very well,” he said.

“But we’ve seen Joey win, and I’ve finished second some. I think we’re right there.”

Coming to a track where Keselowski has won twice in the past three years can do nothing but help psychologically.

“We’ll be on a racetrack where we will have a positive attitude because we had had success there,” he said.

Johnson enters Chase with new contract, title hopes

By JENNA FRYER The Associated Press CHARLOTTE, N.C. – There’s an anecdote told to illustrate how little fame and fortune have changed Jimmie Johnson in the 14 years since he went from middle-of-the-road driver to NASCAR superstar.

Apparently, demand for Johnson-signed memorabilia was so low back then, the driver took the time to dot the two I’s in his name. Six championships and $148 million in winnings later, they get ignored.

“That’s really, truthfully, the one thing that’s changed about him,” said Tom Lamb, chief marketing officer of Lowe’s. “His demeanor, his humility, his relationship with sponsors and with fans, very little to nothing has changed over that time frame. It tells me, ‘This is a guy who knows who he is, knows what his values are, and his values aren’t for sale and won’t compromise him.’”

The success, the humility, the dignity and grace are all part of the many reasons why Lowe’s confirmed Monday a two-year contract extension with Johnson and Hendrick Motorsports that runs through 2017. Lowe’s has been Johnson’s sponsor since his 2001 Cup debut.

Johnson chuckled with appreciation at Lamb’s anecdote, one of the many feel-good yarns often used to describe the most dominant NASCAR driver of the last decade.

He recognizes what a break he got in 2001 when Jeff Gordon sold Rick Hendrick on the idea of building a new team around Johnson. It was a long shot: Johnson at that point was best known for sailing nose-first into a wall in a 2000 wreck at Watkins Glen, where he climbed on the roof of his crumpled

But Gordon was adamant in 2001 that Johnson could be something special, and so was Hendrick’s late son, Ricky, who had developed a friendship with the former off-road racer from California who had migrated to North Carolina to take a shot at stock cars.

Nothing could happen, however, without sponsorship. Hendrick worked hard to sell Lowe’s on coming aboard.

The company had been in NASCAR at various levels for years, had never been to Victory Lane, and was unsure about this Johnson kid. But Hendrick was persistent and was certain he had closed the deal.

“I am sitting at motorsports thinking the deal is done, and in walks Bob Tillman, chairman of Lowe’s.

Scared the (crap) out of me,” Hendrick

recalled.

Johnson initially was not present but rushed to team headquarters when told the Lowe’s executive team was waiting to meet him.

He had limited goals for his Cup career at the time: “I hoped to win a race; I knew that would keep me employed for a couple of years.”

But within minutes of sitting down at the table with Tillman, Johnson recognized he needed to sell himself, and quickly.

“He looked me in the eyes and said, ‘We’ve been in racing a long time, we’re tired of losing, my company needs a winning driver. Can you win?’ ” Johnson said. “I’m sitting there, I’ve only won two ASA races in my whole life, and I’m only in my fourth year ever in a stock car. I somehow am able to put it together and in a convinc-

ing manner, through all my insecurities, say, ‘Absolutely. I can win.’ ” Hendrick said Johnson never flinched in his delivery and sold it perfectly.

Fourteen years later, they all recognize that was a defining moment.

“As time went on, we found out that moment and how I handled myself was a huge factor in Lowe’s signing the contract,” said Johnson.

Never have the parties regretted their decision, and Johnson on Sunday begins his quest for a record-tying seventh championship when the Chase for the Sprint Cup opens at Chicagoland Speedway in Joliet.

Although he goes in tied with Kyle Busch and Matt Kenseth as the top seed, he’s a bit of an afterthought because Hendrick’s drivers struggled through the summer. Although Johnson has four wins this year, his victory was 13 races ago, and Joe Gibbs Racing has taken off during that stretch.

Everyone at Hendrick Motorsports admits the organization is behind the competition right now, but the team owner dares anyone to dismiss their chances. Johnson, Gordon and Dale Earnhardt Jr. have three of the 16 slots in the Chase field.

Johnson proved in that meeting 14 years ago with Lowe’s he doesn’t rattle. He knows how to race a 10-race shootout and isn’t buying into the JGR hype.

“Like it or not, whether we want to admit it or not, the summer months are always hard on us,” Johnson said.

“We feel like we are behind, we’re not building the mouse trap the way we need to, and we are aggressively working on it. But the format is more forgiving, we are getting back on our best tracks, and I would never count us out.”

This is the second year of the Chase playoff format where, in the final 10 races of the season, four of the 16 qualifiers are eliminated after three races, four more

after the next three races and another four after the next three, leaving four drivers for a championship showdown on the final race.

Winning at Chicagoland in 2014 automatically vaulted Keselowski into the second group of three races. He wound up making the final eight before being eliminated.

Asked his thoughts on the playoff format, Keselowski said, “Our fans have really taken to it. That’s the import-

ant thing. We want to make it exciting for them.

“Our job is to run whatever format NASCAR gives us. We just want to be successful.”

Keselowski is not downplaying the importance of winning races, but he noted, “It’s not the be-all and end-all.

What matters is a lot of consistency. Look at Ryan Newman last season. It was crazy. He had a lot of top 10s, a few top 5s and zero wins, and that got him to the doorstep of win-

ning the championship. That made us take notice.”

Keselowski took time out Tuesday from his hot dog tour in Chicago for our phone conversation.

“It’s been a good day in the heart of the city, strolling from one hot dog place to another,” Keselowski said. “The deal is, if you win the race, you will have a hot dog to eat in Victory Lane. They’re having a contest to see who has the best hot dog and will

supply the hot dog that’s in Victory Lane.”

Keselowski said he was not a judge in the contest. “You can call me a consultant,” he said.

In fact, the self-proclaimed “brat guy” is not a big hot dog lover. But if he winds up in Victory Lane on Sunday afternoon, the Chicago-style dog will taste awfully good.

Bears waive quarterback David Fales

Fales, a sixth-round pick in 2014, spent most of his rookie season on the Bears’ practice squad. He was activated to the 53-man roster in December after the Patriots and Chargers reportedly tried to sign him. think he played his most complete game as a Bear, run-blocking and receiving, but he appeared to take a few plays off.

The San Jose State record holder for single-season passing touchdowns, Fales missed most of training camp with an illness. He returned to play in the final two preseason games, including the finale, when he completed 14 of 18 passes for 131 yards and two touchdowns.

The Bears elected to keep Fales on the 53-man roster over former Broncos quarterback Zac Dysert, who was

1 of 4 in the final preseason game.

Fales is eligible to return to the practice squad if he clears waivers, and it’s expected the Bears hope he does. The Bears have only four defensive linemen on the roster after placing Cornelius Washington on injured reserve and could use Fales’ roster spot to promote Brandon Dunn or Terry Williams from the practice squad.

Bears wideouts get an incomplete as it was great to see Alshon Jeffery, Eddie Royal and Marquess Wilson all out there, but it seems clear none

of them was near 100 percent.

The offensive line rates a C. Montgomery played really well, and Jermon Bushrod was effective, too.

After watching several reruns of the Bears’ 31-23 loss Sunday to the Green Bay Packers on at Soldier Field, it’s hard not to be encouraged about the ability they showed to compete on offense, but also difficult to be too optimistic about how long it’s going to take the defense to catch up.

Several players – including Matt Forte, Martellus Bennett, Will Montgomery and Eddie Goldman – played very well.

No one really disappointed, and several players weren’t great but played better than expected.

I know the majority of you are going to focus on the interception Jay Cutler threw to Clay Matthews with 3:55 left in the game.

It’s clear on the tape Cutler never saw Matthews but caused him to break across the field by eyeballing Bennett from the second the ball was snapped.

Typical Jay? Probably yes.

But it really was the only mistake Cutler made all day in an otherwise very strong performance.

He only completed 50 percent of his passes because, on multiple occasions, he threw balls away rather than force them into harm’s way.

He threw a couple lasers as only he can throw, was effective moving in the pocket and was very good coming out of the pocket.

Most importantly, he converted 11 of 17 third-down opportunities and won the time of possession battle, keeping Aaron Rodgers and company on the sideline.

The pick did not cost the Bears the game. It hurt the Bears, but didn’t kill them, and I give Cutler a B-minus on the day that would have been a B-plus without the pick.

He appeared to do exactly what offensive coordinator Adam Gase wants him to do.

Forte gets an A-minus, downgraded only for two dropped passes, including an easy touchdown at the goal line.

Bennett gets a B-plus. I

Vladimir Ducasse played poorly, and Kyle Long really struggled early, but seemed to come on in the second half in his first game at tackle.

Eddie Goldman offered hope for better things to come on defense with a couple of flash plays, including one of only two tackles for loss the Bears registered all afternoon.

But as a group, the front seven – defensive line and linebackers – get a D-plus.

Bears linemen and linebackers failed to put Rodgers on the ground or even record a hit on the quarterback, and the Packers converted 6 of 10 third-down attempts while rushing for 133 yards, 4.4 a pop.

Shea McClellin was credited with five tackles and three assists, but he made only one play within four yards of the line of scrimmage.

His tackles were after gains of 7, 4, 5, 1 and 5 yards and the assists came after gains of 20, 16 and 21 yards.

The Bears’ safeties were somewhat invisible as the Packers ran few plays to the middle of the field, but Antrel Rolle and Adrian Amos handled what they saw, rating a B-minus or C-plus.

The cornerback play was awful.

Alan Ball was beat twice early, on plays Rodgers might be the only guy in the league who can make the throw despite very good coverage, and Ball seemed to lose confidence from there.

Kyle Fuller made far too many mistakes for a top prospect expected to mature and emerge in his second season.

Their coverage rated a D-plus.

Robbie Gould was perfect on three field goal attempts, and Patrick O’Donnell only punted once, but it was 56yard beauty out of bounds, so give them both B-plus or A-minus, and the coverage and return teams were B-minus.

Coaching and preparation were a huge upgrade from last year. I’d give John Fox and company a B for their maiden voyage.

Cubs top Pirates 2-1 to split doubleheader

By WILL GRAVES The Associated Press PITTSBURGH – J.A. Happ has spent most of the last six weeks doing a pretty solid Jon Lester impersonation.

Pitted against the real thing on Tuesday night, Happ wasn’t quite crisp enough on the mound – and his Pittsburgh Pirates teammates not nearly crisp enough at the plate – to produce a doubleheader sweep of Lester and the Cubs.

Lester limited the Pirates to five hits in a 2-1 win that earned the Cubs a needed split if it wants to have any shot at catching the Pirates for the top spot in the NL wildcard chase. Pittsburgh took the opener 5-4 when Pedro Florimon scored on Starling Marte’s sacrifice fly in the eighth, but Lester’s first complete game for the Cubs drew them back within four games. “(Lester’s) an ace for a reason,” Pittsburgh first baseman Michael Morse said.

“Guys say they saw him well but he was able to keep it off the barrel.”

Lester (10-10) walked one and struck out nine while picking up his 12th career complete game. David Ross and Javier Baez had two hits each for the Cubs.

Happ (9-8) had his fivegame winning streak end.

Happ pitched in and out of trouble, allowing two runs on eight hits in 52⁄3 innings. Aramis Ramirez had two hits but Pittsburgh’s rejiggered lineup mustered little.

The Pirates’ best chance came in the seventh. Ramirez led off with a single and moved to third on single by Francisco Cervelli. Morse worked the count to 3-1 before hitting a sharp grounder to Chicago shortstop Addison Russell, who turned a double

play. Lester then hit Sean Rodriguez to put the tying run on first. With the crowd chanting his name, Lester struck out pinch-hitter Jung Ho Kang with catcher David Ross pumping his fist in celebration.

“I think that was probably the turning point in the game as far as momentum,” Lester said. “We gave up the one right there to get two and we did a great job. That’s really the game right there.”

Lester retired the final seven batters he faced, needing only six pitches to navigate the heart of Pittsburgh’s order in the ninth.

“Any time you try to see a guy on his game, it’s tough,” Happ said. “He was tough to-

night and just a little bit better than us.”

Lester began the year as Chicago’s de facto ace thanks to a $155-million contract he signed in the offseason. The left-hander has ceded his spot atop the rotation to the whitehot Jake Arrieta – whose 19 wins are tops in the majors – but Lester provided a needed reminder on why the Cubs made such a hefty investment.

Pittsburgh rested regulars Gregory Polanco, Pedro Alvarez and Kang against Lester, who took advantage by silencing the backups and watched Chicago’s offense do just enough against the resurgent Happ.

The 32-year-old has been a revelation since being acquired from Seattle as an afterthought at the trade deadline. All Happ has done is help the Pirates survive in the hyper competitive NL Central while A.J. Burnett spent six weeks on the disabled list with a strained right forearm.

Happ came in unbeaten since Aug. 4 but wasn’t quite as sharp this time out.

Week 1 yields 4 missed extra points, half of ’14 total

By DAVE CAMPBELL The Associated Press Tony Romo dropped the low snap, and then snatched the ball off the turf in time to find trusty tight end Jason Witten open at the goal line with seven seconds left in the season opener.

Touchdown, Dallas Cowboys. The dramatic comeback against the New York Giants was complete. Except, well, it wasn’t. They still had to kick the extra point, an afterthought no longer in light of the NFL’s decision to push it back from the 2-yard line to the 15.

Dan Bailey ordered the snap on the right hash mark, lined up and sent the ball sailing through the uprights.

Only then could the home team and its anxious fans ex-

hale.

Bailey’s 33-yard kick proved to be no more memorable or difficult than the rest of the extra points over the course of league history.

But if opening weekend was any indication of what is to come, these post-touchdown conversions could be mustwatch moments rather than the bathroom breaks they’ve long been for viewers on the couch or customers at the stadium.

Cleveland’s Travis Coons made an outlandish 48-yard attempt, after a pair of penalties pushed him back. But four extra points failed over the weekend in 75 attempts, with one blocked for Cincinnati’s Mike Nugent in addition to misses for Houston’s Randy Bullock, Jacksonville’s Jason Myers and San Diego’s Josh Lambo. That’s

already half the amount of extra points that were missed in 2014, when NFL kickers went 1,222 for 1,230 (99.3 percent).

“It’s going to happen,” said Myers, whose Jaguars lost 20-9 to Carolina. “It happens to the best of them.”

Over the previous 10 years, according to STATS research, the league had an average of 10.2 missed extra points per season. The collective success rate over that period was 99.1 percent. Hence the reason why the NFL’s competition committee devised the shift for 2015, with a review of the rule before further enactment. Owners voted 30-2 to make the change, so the extra-long extra points probably will become permanent.

The NFL’s other goal with the new extra-point rule was to entice more teams to opt for a 2-point conversion try

from the 2-yard line. Though all of the attempts on opening weekend were made by teams trailing by an amount of points that made sense to try it in the past, teams went four for five.

That’s a small sample size, but with a 47 percent success rate (269 for 572) on 2-point plays over the previous 10 years, there undoubtedly will be some coaches this season who choose the 50-50 proposition of a 2-point pass or run over the 33-yard kick.

Kickers went 304 for 328 on 33-yard field goals (92.7 percent) over the last 10 years, according to STATS. They were remarkably perfect on 33-yard field goals in 2013 (29 for 29) and 95.1 percent in 2014 (39 for 41), but predicting a new rate for the pushed-back extra points isn’t as simple as returning to that data.

A bit of acid and fat do wonders to amp up the flavor of fish

iven how quickly it cooks, fish stands out as the perfect candidate for a weeknight meal, especially in the fall, when the resurgence of school and work can seem like the onset of hurricane season.

The only problem? Fish can be bland, the light white variety in particular. Happily, white fish fillets are like chicken breasts – they play nicely with all sorts of ingredients. And that means there are plenty of ways to amp up the flavor.

The simplest fix is to reach for acid.

At the very least, a cooked fish fillet always will benefit from a spritz of lemon or lime.

If you briefly marinate that fillet in lemon or lime juice before cooking it, it becomes much more flavorful without tasting acidic. And if you add a little salt to the marinade, the fish will be quickly and deeply seasoned, as well.

However, since acid also changes

the texture of the protein in fish – essentially firming it up – you don’t want to leave it in the acid for too long before cooking. About 30 minutes is perfect.

I added crunch to this soft fish dish by topping it off with crushed tortilla chips flavored with chili powder, then baking it so the chips stay crispy.

Tortilla-Crusted Tilapia with Pickled Red Onions and Crema

A kind of Mexican sour cream, crema is increasingly available at U.S. supermarkets.

If you can’t find it, sour cream or creme fraiche diluted with a bit of milk, cream or water will do.

Start to finish: 60 minutes (30 minutes active) Servings: 4 For the fish: Two ½-pound tilapia fillets 1 teaspoon kosher salt 2 tablespoons lime or lemon juice 2 tablespoons vegetable oil, preferably grapeseed

2 cups tortilla chips 2 teaspoons chili powder For the pickled onions: 1 medium red onion, sliced ¼-inch-thick ¾ cup distilled white vinegar ¼ cup orange juice 1 ½ tablespoons sugar ¾ teaspoon kosher salt ½ teaspoon cumin seeds ½ teaspoon dried oregano 2 tablespoons chopped pickled jalapeños To finish: 1 tablespoon unsalted butter, melted Crema or sour cream, to serve To prepare the fish, cut each fillet down the center seam to separate the thin half of the fillet from the thick half. Cut each of the pieces in half crosswise (for a total of eight pieces).

Sprinkle the fish pieces with the salt, then transfer to a zip-close plastic bag. Add the lime or lemon juice and oil.

Refrigerate for 30 minutes, turning the bag several times. While the fish is marinating, in a large, wide bowl, finely crush the tortilla chips (with a few larger pieces, it should not be a pow-

der) and toss with the chili powder. Set aside. To make the pickled onions, in a small saucepan over medium-high, combine the red onion, vinegar, orange juice, sugar, salt, cumin and oregano.

Bring to a boil and simmer for 5 minutes. Set aside and let cool. Drain the mixture and chop the onions. In a small bowl, combine the onions with the jalapeños.

Heat the oven to 375 degrees F. Line a rimmed baking sheet with kitchen parchment. Remove the fish pieces from the marinade and arrange in a single layer on the prepared baking sheet.

Keep the thin pieces on one side and the thick pieces on the other. Pack the tortilla crumbs on top of the fillets, then drizzle the crumbs with the melted butter. Bake the fish on the oven’s middle rack until it is just cooked through, about 5 minutes for the thinner pieces and 8 minutes for the thicker pieces.

Transfer a thick and a thin fillet piece to each of four serving plates. Serve each portion topped with some of the pickled onions and the crema.

Did he, or did he stay in a stew over it? For today’s deal, though, “three” is the key word. How should the defenders card to defeat three no-trump?

South starts with six top tricks: four spades, one heart and one club (the suit West will be leading). Declarer must drive out the diamond ace and hope that the defenders either do not or cannot run clubs (in this case, because there is an unavoidable blockage).

So, after West leads the club seven, South takes East’s queen with his king and immediately attacks diamonds.

What should West do?

He does not know! Trick one marked South with the club jack, because if East had held the queen and jack, he would have played the jack, not the queen. Pernicious anemia was a fatal disease until the mid-20th century. Scientists here at Harvard Medical School discovered that vitamin B12 (which was extracted from the livers of animals) could be given as treatment. It was a life-saving discovery that was honored with the Nobel Prize.

In pernicious anemia, it won’t do any good to take vitamin B12 pills – not even megadoses. The disease won’t let it get absorbed by the gut. As a result, it won’t get into the blood and get carried to all the cells of the body that need it. So, for pernicious anemia you need the vitamin B12 shots. The vitamin B12 in the shots goes directly into the blood: It doesn’t need to be absorbed by the gut.

Besides pernicious anemia, there are other conditions that interfere with the ability of the gut to absorb the vitamin. Any diseases that affect the ileum interfere with the absorption of vitamin B12.

An example is Crohn’s disease.

Often, B12 shots are necessary. And if Crohn’s disease has injured the ileum badly enough that it needs to be surgically removed, then a B12 pill definitely won’t work.

Dear Dr. K : I was recently diagnosed with a vitamin B12 deficiency.

Can I take B12 supplements by mouth? Or do I need the shots?

Dear Reader : Tissues throughout the body need vitamin B12, especially in the brain, spinal cord and bone marrow, where blood cells are made. Vitamin B12 in the diet gets absorbed in the part of the small intestine called the ileum. There, it enters the blood. Vitamin B12 deficiency can cause anemia, and problems with the bones, brain and spinal cord.

Low vitamin B12 levels in the blood basically have two causes: Either there is not enough B12 in the diet, or the B12 in the diet has trouble getting absorbed by the ileum. B12 is found naturally only in animal products like meat, fish, poultry, eggs and milk.

Many cereals are fortified with it.

In the United States, Canada and other developed nations, there is only one relatively common situation where there is not enough B12 in the diet. Vegans, who avoid all animal-based foods, are at increased risk. I order blood tests for vitamin B12 for all my patients who are vegans.

While there is only one common cause of B12 deficiency due to inadequate amounts of the vitamin in the diet, there are many causes of poor absorption of the vitamin by the gut.

The most serious is a disease called pernicious anemia. This autoimmune disease is caused by an attack of the immune system on the ability of the ileum to absorb vitamin B12 in food.

One of the hallmarks of pernicious anemia is that the red blood cells are both larger and less numerous than normal.
