JOLIET – A judge will take two weeks to decide if Bethany McKee is guilty of murder.

McKee’s bench trial finished Tuesday with Judge Gerald Kinney saying he will “take some time to go over” the case, setting an Aug. 29 date for his decision.

McKee is charged with murder for allegedly luring Terrence Rankins and Eric Glover on Jan. 9, 2013, to Alisa Massaro’s house in the 1100 block of North Hickory Street.

Glover and Rankins were allegedly strangled to death and robbed of cash by Adam Landerman and Joshua Miner shortly after they arrived.

All four suspects were charged with murder, but Massaro pleaded guilty to lesser charges in exchange for testifying against the others.

Landerman and Miner are awaiting separate trials.

Massaro testified last week that she did not have sex with Miner on the victims’ bodies, but while being questioned by police, Massaro acknowledged she did. In a video recording played in court Tuesday morning. Massaro said she is “very embarrassed” to talk about the sexual encounter, which investigators apparently learned about from questioning Miner.

“At what point did you have sex on the bodies?” Detective Carlos Matlock asked Massaro during questioning.

“I don’t want to talk about it,” she replied.

Massaro also acknowledged Landerman stood on the bodies to “surf” on the victims.

Massaro told detectives “it was a possibility” the victims came over expecting to have sex with her and McKee. “They got real [upset to see Miner and Landerman there].

You could tell by the look on their faces they were upset,” she said on the video.

McKee did not testify in her own defense.

“She knew Terrence Rankins had money. She and Massaro left the room as they

were supposed to and she saw him get hit [by Miner],” Assistant Will County State’s Attorney Dan Walsh said during his closing argument. “[McKee] knows the plan is in motion. This is happening,” Walsh said.

Defense attorney Chuck Bretz said McKee could’ve been successfully charged with other crimes, such as concealing a homicide or obstructing justice, for her conduct after the slayings.

“But actions afterward cannot be used to establish guilt beyond a reasonable doubt,” Bretz argued. While McKee knew about the robbery, didn’t prevent it or notify anyone, she is not accountable for it under the law, Bretz said.

Bretz said McKee believed Miner’s robbery suggestion was “trash talk” and didn’t take it seriously.

Bretz said McKee and Rankins were friends who exchanged 133 text messages in December 2012 and more in the days before the slaying.

Rankins and McKee exchanged 21 text messages during the day of Jan. 9, 2013, according to cellphone records submitted in court. Rankins called McKee once the day before, eight times during the day and nine times in the 20 minutes before he and Glover arrived, according to the records. McKee did not call Rankins’ phone once, Bretz noted.

“All this communication, but she left out there’s two other guys [at Massaro’s] because it’s a plan to get money,” prosecutor John Connor said.

Kankakee man charged in fatal crash

By BRIAN STANLEY bstanley@shawmedia.com MANHATTAN TOWNSHIP – A Kankakee man has been arrested after a fatal crash involving a riding lawnmower.

Zevez A. Murrell, 31, was arrested on charges of reckless homicide and aggravated driving under the influence of alcohol.

State police said that about 12:48 p.m. Sunday, Thomas Knepper, 68, of Myrtle Beach,

South Carolina, was cutting grass in the 23000 block of Route 52 in Manhattan Township when he Zevez A. was struck by a Murrell Toyota Camry traveling south that left the roadway.

According to the Will County Coroner’s office, Knepper was operating a John Deere lawn tractor to cut his girl-

friend’s lawn while he was visiting from out of state.

Knepper was pronounced dead at the scene at 1:25 p.m.

Sunday.

Murrell, of the 300 block of North Wildwood Avenue, was booked into the Will County jail and is being held on $500,000 bond.

Murrell also was ticketed for improper lane usage, transporting open alcohol and failing to reduce speed to avoid an accident.

QUICK NEWS Lemont maintains Aa2 bond rating LEMONT – Moody’s Investor Service has issued an Aa2 bond rating for the Village of Lemont, according to a village news release.

The release said Moody’s cited “moderately sized tax base in the Chicago metropolitan area, structurally balanced operations bolstered by healthy general fund reserves and a moderate debt burden” as credit strengths.

According to the release, the credit rating was issued as a part of two general obligation refunding bond issuances and the village expects to have cost savings due to lower interest rates as a result of the refunding.

Lemont also receive a Aa2 bond rating the last time Moody’s analyzed its debt in 2012, according to the release.

For the Joliet Slammers, maintaining and expanding the fan base requires promotions and special events on a daily basis, a food and drink menu that caters to local tastes and wallets, and alternative events that have little in common with America’s favorite pastime.

“Baseball is only the lion show in the circus,” said Josh Schaub, Slammers CEO and co-owner. “We do so much more than that.”

This month, for instance, the Slammers hosted a Princess Night on Aug. 1, which brought out younger girls and their families to Silver Cross Field.

“The girls [wore] their princess outfits and qualified to win a free ticket to a future game,” said Heather Mills, the team’s box office manager.

Queen Elsa from the Disney film “Frozen” made an appearance, much to the delight of a bevy of costumed girls. The evening ended in fireworks, choreographed to Disney princess songs.

Promotions give the Slammers a chance to reach a variety fans of different age groups with different interests.

Princess Night gave way to NASCAR Night the next evening, followed by a Slammers bobblehead giveaway Aug. 9.

The August lineup will close out with a Jimmy Buffett Night on Aug. 21 and a Halloween Night for kids Aug. 29.

“It might reach some people who typically wouldn’t come out to a baseball game,” Mills said.

That’s a big boost from the average attendance of 2,028.

A lot of events still are based on trial and error. The July 14 Battle of the Sexes, which pitted the Slammers against the Dutch National Fastpitch Softball Team, is a good case in point. The game drew a lot of interest from area softball teams, though not so much from regular fans. Only 688 turned out for the event.

“Obviously we’re always looking for a bigger crowd, but the people who were here loved it,” Mills said. “We’re

hoping to build on it in the future.”

But like a manager opting for a hit and run, the Slammers appear willing to shift positions when something

isn’t working.

Take the team’s much-heralded beer garden, which offered five craft beers and an all-you-can-eat menu for $38.

Turns out that not that many

fans wanted to suck down five bottles of suds during a threehour game. So the Slammers promptly changed the venue to individual beer sales, with a $28 all-you-can-eat menu.

Every home game on the Slammers schedule has its own promotion, offering everything from cash and merchandise giveaways, to $2 admission and $10 in casino slot play, to free food and cheap beers.

Another new promotion is the Absolutely Amazing August cash giveaway, which the Slammers plan to award a fan a cash prize of $250 to $5,000, depending on announced attendance, during

I-55 construction nearing completion

By LAUREN LEONE–CROSS lleonecross@shawmedia.com JOLIET – Bridgework on Interstate 55 near Channahon – marred with seven fatalities and more than 100 accidents over the course of two construction seasons – will likely wrap up next week.

Illinois Department of Transportation crews could complete repairs as early as next week, but the reopening of lanes won’t start until the week of Aug. 25, state Rep. Larry Walsh Jr., D-Elwood, said Tuesday.

Labor Day is still considered the target completion date, but IDOT officials are working to complete the work “as soon as possible” and reopen lanes prior to the holiday weekend, IDOT spokeswoman Paris Ervin said in an email.

Northbound lanes will likely reopen first, Walsh Jr. said, while southbound lanes will take a little longer because cement barriers have to be removed.

During the news conference state Rep. Larry Walsh Jr. announced that construction on Interstate 55 over the Des Plaines River Bridge should be wrapping up next week. repairs to the twin 58-yearold truss bridges’ pier, abutment and structural steel, along with new decks and a paint job.

News of the bridge construction nearing completion comes just three weeks after five people, including two from the area, died as a result of a July 21 collision involv-

ing a semitrailer in the I-55 construction zone. Last year, sudden backups resulted in 172 crashes and two fatalities between July and November.

A second collision that same day resulted in the death of a sixth man.

I-55 over the Des Plaines River Bridge has been plagued with major traffic

congestion during the past two construction seasons, but last month’s fatal-chain reaction crash brought the issue back to the forefront.

Elwood Police Chief Fred Hayes said in an email statement Tuesday he was “encouraged” by the near-completion of the I-55 construction, while noting much more needs to be done to reduce the number of trucks along Route 53 through Elwood – a route often used by semitrailers as an alternative to I-55.

Walsh Jr. first announced I-55 construction is nearing completion during a news conference Tuesday at CenterPoint Properties’ Joliet location. Alongside him were U.S. Sen. Dick Durbin, Will County Executive Larry Walsh Sr., and Eric Gilbert, senior vice president of CenterPoint Properties.

‘Just the beginning of CenterPoint’ The focal point of Tuesday’s news conference with Durbin was to highlight CenterPoint Properties’ desire

to build out and fully develop two adjacent industrial parks in the coming years.

Durbin spoke of CenterPoint’s importance to the area’s economy, touting 8,000 permanent jobs and thousands of other construction jobs that resulted from the development of both intermodals.

“Location. Location. Location. We are smack-dab in the middle of the United States, right near the Great Lakes, with all the rail transportation that follows and all the interstate highways,” Durbin said. “We can’t let it end here. Our obligation now is to continue to build the infrastructure that serves this area ... This is just the beginning of CenterPoint.”

A little more than half of CenterPoint’s 6,400 acres across both intermodals have been built out, Gilbert said.

That equates to roughly 14 to 15 million square feet of facilities, he said.

“We believe we could double that upwards to 28, 30 million in the next 15 years,” Gilbert said.

Semitrailer driver pleads not guilty to charges related to I-55 crash

By FELIX SARVER fsarver@shawmedia.com JOLIET – An Indiana semitrailer driver pleaded not guilty Tuesday to charges related to last month’s fatal chain-reaction crash on Interstate 55 near Arsenal Road.

Francisco Espinal-Quiroz, 51, of Leesburg, Indiana, faces several charges after he was arrested on charges that he caused a multi-vehicle collision July 21 that led to the deaths of five people, including one child. Another person died in a second collision.

On Tuesday, Espinal-Quiroz formally entered his not guilty plea during an appearance at the Will County Courthouse. He is being held in lieu of a $1 million bond.

His next court appearance is scheduled for 9:30 a.m. Sept.

9. Espinal-Quiroz’s attorneys said they expect all evidence to be turned over

by Aug. 26.

“Our position is that this was a tragic accident,” said Sarah Toney, one of his attorFrancisco neys.

Espinal Charges -Quiroz against Espinal-Quiroz include falsifying a log book and failing to maintain a log book.

Police also cited him for failing to reduce speed to avoid an accident. Espinal-Quiroz has a history of traffic violations that date back to 1991 and include three speeding tickets

since 2012.

His attorneys said they hope his charges are not upgraded. Assistant Will County State’s Attorney Jim Long has previously said other charges, including reckless homicide, are possible as state police continue their investigation.

During Tuesday’s hearing, a judge granted a motion to preserve evidence that was filed Aug. 7 by Espinal-Quiroz’s attorneys. His attorneys said they were concerned about evidence being destroyed during tests.

According to the motion, evidence included interviews, recordings, pictures, vehicles involved in the accident and blood and urine samples taken from Espinal-Quiroz.

His attorneys said they

were not aware of any results from blood tests conducted or if reconstruction of the accident was completed. Assistant Will County State’s Attorney Mike Fitzgerald said crash reconstruction is ongoing, as is the state police’s investigation of the accident.

The Federal Motor Carrier Safety Administration suspended the operating authority registration of Espinal-Quiroz, who does business as Espinal Trucking, according to an Aug. 8 news release.

The suspension was the result of his failure to cooperate in an investigation of the carrier’s compliance with federal safety regulations. FMCSA officials said investigators were denied access to company records by an Espinal Trucking

representative.

Authorities said Espinal-Quiroz was traveling 15 mph over the speed limit at the I-55 construction site July 21 when he slammed into vehicles at 2:17 p.m.

Those who died on the day of the first collision were Kimberly K. Britton, 43, and Piper Britton, 11, of Urbana; Vicky L. Palaciocs, 54, of Coal City; and Ulrike P. Blopleh, 48, of Channahon. Timothy Osburn, 64, of Urbana, also was involved in the first collision and was pronounced dead Aug. 6.

A second collision occurred at 2:33 p.m. July 21 in the southbound lanes near Route 6, when one semitrailer rear-ended another. Deividas Mockus, 41, of Darien was killed as a result of that collision.

Father, son enter not guilty pleas in killing of Romeoville man

By FELIX SARVER fsarver@shawmedia.com JOLIET – A father and his son pleaded not guilty Tuesday to first-degree murder charges over the death of a 55-year-old Romeoville man.

Mark Ballard, 42, and his son Adam, 15, were charged with first-degree murder in the connection with the death Mark of Richard Pol- Ballard lack, 55, who was pronounced dead Sunday after being transported to a hospital for severe injuries.

According to a criminal complaint, Mark and Adam Ballard had struck Pollack in the head with a bat, knowing such an act created a strong probability of death for him.

Mark Ballard is being held on a $5 million bond and his son on a $1 million bond. A preliminary hearing for Mark and Adam Ballard has been scheduled for 9 a.m. Sept. 2.

On Sunday, Romeoville police responded to a call of a large fight in progress on the 400 block of Tallman Avenue in Romeoville at 2 a.m.

“Several of the participants were armed with baseball bats,” Chief Mark Turvey said Monday.

Police found Pollack severely injured. The Romeoville resident was sent to Adventist Bolingbrook Hospital, where he was pronounced dead at 3:05 a.m.

Pollack “appears to be the victim of a homicide,” the Will County deputy coroner reported.

Mark and Adam Ballard were found in the area by Romeoville police and taken into custody.

Paul Napolski, the attorney for both Mark and Adam Ballard, said Tuesday the event that led to Pollack’s death was a tragedy but still is under investigation. Turvey said Monday the reasons behind the fight remained under investigation.

Members of Pollack’s family declined to comment Monday.

JOLIET – Two men were being questioned by the FBI following a bank robbery Tuesday.

Joliet police were notified at 10:29 a.m. of a robbery at Merchants and Manufacturers Bank, 990 Essington Road, according to Cmdr. Al Roechner.

No one was injured during the robbery, and witnesses said a small white car fled the area after the holdup.

A few minutes later, patrol officers spotted a matching vehicle in the 1500 block of North Larkin Avenue and attempted to pull it over, Roechner said. A chase ensued to an alley near the 1000 block of Cora Street, where two men ran out of the vehicle.

Roechner said the men were found hiding in a yard in the 1000 block of Vine Street at 10:49 a.m. They were taken into custody and will face charges of obstructing justice and fleeing from police, Roechner said.

The identities of the two suspects had not been released as of Tuesday afternoon because the FBI was interviewing them at the police station about the bank robbery, FBI Special Agent Joan Hyde said.

Tuesday’s robbery was the area’s second bank robbery in two days.

A teller was shot during a robbery at 12 p.m. Monday at the First Midwest Bank, 450 N. Bolingbrook Drive in Bolingbrook. In that robbery, police were looking for a black man in his early 20s, about 6-foot, 190 pounds. He was wearing

Judge to rule on admissibility of statements for trial

By FELIX SARVER fsarver@shawmedia.com JOLIET – A judge plans to rule on whether statements made to police by a Crest Hill man accused of killing his neighbor will be admissible when he stands trial.

The ruling is scheduled for Aug. 20 and will be based on arguments attorneys made in court Tuesday regarding statements Bruce J. Gempel, 50, made to Romeoville Police Cmdr. Kenneth Kroll.

Gempel’s attorneys said those statements were obtained

in an illegal arrest and should not be admissible during trial.

Gempel was taken into custody by Romeoville police in connection with the killing of Dorothy Dumyahn, 89, of the 2300 block of Caton Farm Road. She was found dead by an off-duty firefighter Nov. 18, 2012.

Kroll testified in court on July 24 that Gempel made statements to him while in custody despite being read his Miranda rights multiple times. He was also allowed two phone calls to connect with an attorney, he said.

Gempel had said he “couldn’t believe this was happening” to him and that he was going to “spend the rest of his life in jail,” Kroll said. Gempel said he wanted to meet with the state’s attorney, police and his own attorney to figure out his “best-case-scenario,” Kroll said.

On Tuesday, Gempel’s attorneys, Kristine Honiotes and Frank Astrella, both with the Will County Public Defender’s office, argued Romeoville police did not have probable cause to take Gempel into custody and the male DNA

tissue taken from underneath Dumyahn’s fingernails was not sufficient probable cause, either.

“That essentially narrowed down the suspects to 50 percent of the world’s population,” Honiotes said.

She argued the statements from Gempel were not legally obtained. He was taken into custody by Romeoville police without probable cause for roughly 20 to 30 hours, a calculated move on their part, she said.

Gempel’s time with the police had worn him down and he

was unable to seek help since he was in their custody, she said.

Assistant Will County State’s Attorney Mike Fitzgerald said the police did not try to solicit statements from Gempel and repeatedly warned him of his Miranda rights.

He said police had probable cause, since Gempel was the only one of six men taken in for questioning with scratches on his face. One woman also was considered a suspect.

Gempel also lived close to Dumyahn and borrowed things from her, he said.

Vote on director planned for Plainfield park district meeting

Members also are scheduled to decide on the appointment of a new general counsel to replace attorney Matt Campbell; auditing services with Lauterbach & Amen, LLP; and an engagement letter with Foley and Lardner LLP, to assist in negotiating a contract with the new union formed by

maintenance employees.

Although discussions were rocky between commissioners, a majority selected Worth Park District Executive Director Carlo Capalbo to take up the executive position with the Plainfield park district.

According to a draft copy of the 3-year contract, Capalbo

will be paid a starting salary of $115,000 for the first year.

His pay will increase from 3 to 6 percent each of the next two years, dependent on a board evaluation.

The draft contract includes reimbursement for reasonable and necessary expenses incurred on the job, a $100 a

month vehicle allowance and use of a park district pool vehicle.

Capalbo will be allowed eight personal days, one sick day a month, 15 vacation days and holidays. He is expected to start in early September.

Contract details may change at Wednesday’s meeting.

JOLIET – A Joliet chemical storage, handling and distribution company faces $143,400 in penalties from the U.S. Department of Labor’s Occupational Safety and Health Administration for 19 safety and health violations – findings the company disputes.

In its most serious citation, OSHA maintained Seeler Industries, 1 Genstar Lane, willfully failed to train its employees on the appropriate handling and safe use of hazardous chemicals.

“Workers have the right to know what workplace chemicals they are exposed to and to be protected against exposure, which can have severe health effects,” said Kathy Webb, OSHA’s area director in Calumet City. “Mishandling chemicals can result in catastrophic fires and explosions. It is the employer’s responsibility to protect workers from these hazards.”

OSHA’s investigation also found Seeler Industries did not implement engineering controls to reduce employee exposure and failed to label containers with information that identified and warned of the hazardous chemicals contained inside. Workers were exposed to quantities of chemicals greater than the OSHA permissible exposure limit.

Challenge filed to petition to redraw council districts

By BILL WIMBISCUS bwimbiscus@shawmedia.com JOLIET – A Joliet woman is objecting to the petition sheets for the Joliet For Eight Districts referendum.

Sarah M. Andreano, of 1215 Glenwood Ave., filed papers with Joliet City Clerk Christa Desiderio on Aug. 11, alleging many of the signatures were invalid.

Andreano’s objections maintain that the petition papers contain forged signatures, illegible or incomplete signatures and incomplete or missing addresses, as well as petitioners who are not registered voters or Joliet residents.

“The number of valid signatures contained in the Petition Sheets is less than the minimum number of valid signatures required by law to place the aforementioned proposal on the official ballot and ... (the) proposal should be found invalid,” Andreano’s papers state.

The 14-page objection filing lists specific objections by sheet and line regarding the first 135 sheets of the referendum petition, plus about 25 other full sheets that Andreano maintains were improperly notarized.

“There exists throughout

the first 135 Petition Sheets over 300 invalid signatures,” Andreano’s objection maintains.

Nearly all of the individual objections involve signers not being registered to shown addresses. Other objections cite residency issues, lack of signature, legibility and incomplete addresses.

About 2,440 signatures were attached to the 305-page petition, according to Rich Rodriguez of Concerned Citizens of Joliet, the group pushing for the referendum.

The referendum petition requires 1,500 signatures in order to be placed on the Nov. 4 ballot.

Aug. 11 was the last day objections could be filed over the petition.

Desiderio said the city’s electoral board must now rule on the objections.

“The matter is pending before the city’s electoral board,” Desiderio said. The board consists of Desiderio, Mayor Tom Giarrante and Councilman Mike Turk.

The last time the electoral board convened was in 2011, over the residency of Alicia Morales, a candidate in the Fourth District. The board ruled in favor of Morales’ candidacy.

Rodriguez said he was not

surprised by the objection.

“This is a prime example of concentrated political power not wanting to give in to change,” Rodriguez said.

Andreano is listed as chairman of the Friends of Judge Dinah Lennon Archambeault on the Illinois State Board of Elections website.

Concerned Citizens of Joliet wants to change the current City Council structure from five district seats and three atlarge seats – a format that has been in place since the 1950s – to eight district seats.

The group maintains that mixed district and at-large representation does not accurately or fairly reflect the city’s geography and population because too many council members reside in the same part of town.

Those opposed to the idea have cited several reasons for not changing, including that, as of right now, residents can vote for five of the nine people on the council. The new proposal would drop that to two people.

In its current form, the referendum question will be: “Shall The City of Joliet be divided into Eight Districts with one Council Person to be elected from each District, but with the Mayor to be elected from the City At Large?”

SHOREWOOD – If you push the center of the two-story window frame at the back of the Shorewood-Troy Library with a little force, it bends like cardboard seams.

Those windowpanes are the only thing separating the inside to the forested outdoors north of the library.

“That side of the building is in serious need of repair,” Director Jennie Mills said.

The windowpanes cover both floors of the library.

The library has planned to close Monday through Wednesday to allow for the

project.

The closure is for the heaviest part of the demolition. But the full project will take about six weeks. Some bookshelves have been moved in anticipation of the two-story project.

In October, Tria Architecture and KGZ Consulting Engineers surveyed the library and discovered that the frame of the windowed wall was undersized and in need of immediate repair.

The consultants’ report revealed that the two-story glazing system of windows bends and could buckle in weather events with high winds, creating a potential safety hazard.

Graduate of Joliet West High School and Eastern Illinois University where he received his Masters degree in music education. Formerly employed by Laraway Grade School as the band director and music teacher. Member of Phi Mu Alpha Sinfonia Fraternity. Jim had a love for music and was an avid golfer.

Survived by his loving wife of 43 years, Jae Rita (nee Smith) of Joliet; his daughter, Jessica (Kale) Martin of Shorewood; his mother, Violet Biro of Joliet; two brothers, John (Amy) Biro of Oak Creek, WI and Jeff (Beth) Biro of Mesa, AZ; several aunts, nieces, nephews, cousins and dear friends including Marcus Taylor and Pavel Kalmykov also survive.

Timothy James Connolly, age 41, of Channahon, Illinois passed away August 8, 2014.

Tim was born to Judy Lucasey Clusen (Paul) and the late Terry J. Connolly on March 31, 1973, in Springfield, IL. Most importantly he was and will always be the loving father of Kelly Lynn Connolly, age 17, and James Robert Connolly, age 15. Tim will be dearly missed by sister Karin Jilek (Timothy) who was his best friend, fishing partner, and could be found sitting in the stands with him at any given race.

Also missed by his sister Cindy DeKlerk (Bill), his aunt Beverly Swigelson (Jim) and Uncle Rick Connolly. Special Friend of many years Jen Heeman (and “the little dogs”) will dearly miss him and the good times they had together.

His love for anything wheels began as soon as he could peddle a Big Wheel. He earned trophies on the BMX track, rutted neighbors’ yards with a mini-bike and absorbed every opportunity to learn about cars in his dad’s garage.

His cherished family memories always involved outdoor activities: camping, fishing, playing baseball, football and watching or participating in racing, and traveling with his family to auto racing.

He was willing to risk poison ivy, thin ice or discovery by property

that doesn’t involve his quick-witted Irish great sense of humor. He had a magnetic smile that attracted friends from every walk of life. He was respected by all for his stubbornness and direct “tell it like it is” personality.

He beamed with pride at Kelly’s softball games and James’ baseball games, often expressing strong opinions from the outfields, even traveling to Cooperstown, NY to be James’ biggest fan.

He fell in love with the open-water during his first sail on Lake Michigan, playing pirate and appreciating nature’s beauty. If the fish weren’t biting, he grabbed the golf clubs and hit the links, sharing his natural talents with his golfing buddies.

He acquired skills in the tree-trimming business, but returned to his first love of wheels, finding his second home and loving family at Bill’s Speed Shop, “wheeling” and dealing parts and autos. It is here that he was given the opportunity to travel with race crews, drive competitively, and to be around people he loved. He worked at the shop with his adored pets Tank and Patty Cake close by his side. They will be cared for by the Knippenberg Family continuing to go to the speed shop.

Tim was a part of the Knippenberg Family for many years.

Tim always spent time with Kelly and James and his mother fishing, riding go karts, and golfing. He rarely missed an event involving his kids. He discovered his love of golf with his mother and continued his love of fishing that he inherited from his father. Everybody knew Tim had those “secret” fishing spots. Most of you have a fish story to tell that involves Tim. It’s hard to tell a story about Tim

Lauren Bacall, sultry-voiced actress, dead at 89 The ASSOCIATED PRESS NEW YORK – Lauren Bacall, the slinky, sultry-voiced actress who created on-screen magic with Humphrey Bogart in “To Have and Have Not”

and “The Big Sleep” and offscreen magic in one of Hollywood’s most storied marriages, died Tuesday at age 89.

Bacall, whose long career brought two Tonys and a special Oscar, died in New York.

The managing partner of the Humphrey Bogart Estate, Robbert J.F. de Klerk, said that Bacall died at home, but declined to give further details. Bacall’s son Stephen Bogart confirmed his mother’s death to de Klerk.

She was among the last of the old-fashioned Hollywood stars and her legend, and the legend of “Bogie and Bacall” started almost from the moment she appeared on screen.

Her sly glance, with chin down

and eyes raised, added to her fame; she was nicknamed “The Look.”

Bogart and Bacall married amid headlines in 1945. Their marriage lasted until his death from cancer in 1957.

DAVID R. HACKER David R. Hacker, age 55, was called to his Lord, suddenly on August 9, 2014.

He is survived by his loving wife of 23 years, Kim (nee Abrams) Hacker; and his children, Alyssa, 16, Ryan, 13, and Jordan, 10. He is also survived by his loving parents, Robert and Cottie (Murphy) Hacker; his sister, Diane Keay; his nephew, Christofer; and niece, Katrena. Aunts, uncles, cousins and many special friends also survive.

He was preceded in death by his grandparents, Chris and Lucy Hacker, and Thomas and Katherine Murphy; a cousin, Bryan Murphy; and his inlaws, Russell and Audrey Abrams.

Dave graduated from St. Paul the Apostle School in 1973, Joliet West High School in 1977, and received his degrees in Accounting and in Aviation from the University of Illinois in just three years. He soloed an airplane at the age of 16 and enjoyed flying.

Dave was self-employed for much of his life. Most recently, he worked in lumber sales with his dad at Alexander Lumber and as an appraiser for James V. Smith Appraisals. He was a devoted campaign manager for his father and many other politicians over the years. Dave was a dedicated member of the Rialto Square Theatre board for over 20 years, serving as chairman for 17 years.

Dave will be greatly missed by everyone who was fortunate enough to know him. He was an animal lover and will also be missed by his two dogs, Zach and Zoey, and his cat, Scout. They spent their days keeping him company in his office while he worked.

She also enjoyed sewing.

Illinois state education reports from 2013 overdue

SPRINGFIELD – Problems collecting information have forced a delay in the release of last year’s state education reports, Illinois State Board of Education officials said.

The reports for 2013 were required to be completed last October, but the state board says they’ve had trouble collecting school district teacher and administrator salary details, The Arlington Heights Daily Herald reported.

The agency is “still trying to clear up the issues,” education board spokeswoman Mary Fergus said. ISBE officials said a new employment information collection system was burdensome for districts when they started using it nearly two years ago. The districts stopped using it, and the system was reintroduced in March.

Inconsistencies and incomplete data prevented public reporting when the school year ended in July 2013, ISBE spokeswoman Amanda Simhauser said.

“This process has proved time-consuming as we are collecting and cleaning data for two school years,” Simhauser said. “Many districts are short on staff; and since it’s a newer data system, many users aren’t as literate with the functionality of the system.”

Simhauser said data weren’t released piecemeal because that would have created skewed statewide information.

Board officials said state law requires them to collect salary data. The annual district report cards are due no later than Oct. 31 each year. They track each district’s student performance history, class sizes, spending on students and attendance.

Chicago man gets life for 1994 Waukegan death

WAUKEGAN – A Chicago man didn’t attend when a Lake County judge sentenced him to life in prison for the 1994 bludgeoning death of an appliance store owner in Waukegan.

The Daily Herald reported 44-year-old Hezekiah Whitfield refused to attend the Tuesday sentencing hearing. He has maintained his innocence in the death of 71-year-old Fred Reckling of Libertyville. Prosecutors say Whitfield killed Reckling before robbing his store and stealing his car.

Whitfield was convicted of Reckling’s murder in April.

Rule would limit immigrant driver’s license calls

SPRINGFIELD – Illinois wants to head off businesses that are swamping the Secretary of State’s office with robotic requests for appointments for special immigrant driver’s licenses.

Appointments are required for the licenses, which are designed for immigrants living in the United States illegally. Some business-

es have promised to speed up the process for a steep fee and are using automated dialing machines that are tying up the phone system.

The Springfield bureau of Lee Enterprises reported Tuesday that state licensing officials want a limit on the number of times someone can call the appointment system. The rule, if adopted, would limit the number of calls from an individual or a computer address to three each day.

About 53,000 Illinois immigrants living in the United States illegally have received the special driver’s licenses made possible by a new state law.

Fairfield, California-based Jelly Belly Candy Company says a smaller number of North Chicago employees will continue to make private label and contract candies.

Jelly Belly was formerly known in North Chicago as Goelitz Confectionery Company. The company has been making candy at the Illinois plant for more than 100 years.

NATION & WORLD BRIEFS Deadline to clear up health law eligibility near WASHINGTON – Hundreds of thousands of people who signed up under the new health care law risk losing their taxpayer-subsidized insurance unless they act quickly to resolve questions about their citizenship or immigration status. The government warned on Tuesday that they have just over three weeks to show that they’re eligible.

Of the 8 million people who signed up for private coverage through President Barack Obama’s law, more than 2 million at one point had discrepancies of some sort that clouded their eligibility. That number has been greatly reduced – but the remaining cases are proving difficult to untangle.

People living in the country illegally are not allowed to get coverage. Officials at the Health and Human Services Department said letters are being sent to about 310,000 people with documentation issues involving citizenship or immigration.

The letters will notify enrollees with unresolved issues that they still need to upload their documents to the HealthCare. gov website by Sept. 5, or mail them in. Otherwise, their coverage will end on Sept. 30.

U.S. job openings in June hit 13-year-plus high WASHINGTON – U.S. employers in June advertised the most monthly job openings in more

than 13 years.

Employers posted 4.67 million jobs in June, up 2.1 percent from May’s total of 4.58 million, the Labor Department reported Tuesday. The number of advertised openings was the highest since February 2001, a positive sign that points to a strengthening economy.

The report “provides further confirmation that the U.S. labor market has indeed shifted to a period of stronger growth,” said Jeremy Schwartz, an analyst at the bank Credit Suisse.

Known as the Job Openings and Labor Turnover survey or JOLTS, the report provides a detailed look at where employment might be heading. It records job postings, overall hiring and the number of workers who either quit or were laid off.

Wife of detained American asks for mercy LEBANON, Ohio – The wife and three children of an American man charged with “anti-state” crimes in North Korea apologized Tuesday to the communist country and pleaded for its government to show him mercy, saying in a statement they’re “desperate for his release and return home.”

Police won’t release name of officer who shot teen

Al Sharpton pressed police Tuesday to release the name of the officer who fatally shot an unarmed teenager in suburban St. Louis, and he pleaded for calm after two nights of violent protests over the young man’s death.

Police said death threats prompted them to withhold the name of the officer, who was placed on administrative leave after fatally shooting 18-year-old Michael Brown in Ferguson, where the incident has stoked racial tension, rallies and a night of looting.

Investigators have released few details, saying only that a scuffle unfolded after the officer asked Brown and another teen to get out of the street. At some point, the officer’s weapon fired inside a patrol car, police said.

“The local authorities have put themselves in a position – hiding names

and not being transparent – where people will not trust anything but an objective investigation,” Sharpton said during a news conference in St. Louis where he was joined by Brown’s parents.

He also echoed pleas for peaceful protests by the NAACP and Brown’s father, Michael Brown Sr., who told the crowd: “I need all of us to come together and do this right. ... No violence.”

President Barack Obama also urged calm, saying people must comfort each other “in a way that heals, not in a way that wounds.”

Missouri Gov. Jay Nixon told a standing-room only crowd at a community forum Tuesday night that the shooting feels “like an old wound torn fresh” in a nation still struggling with race relations.

The forum, held at a church, was organized as an alternative response to two nights of unrest in which more crowds have burned stores, vandalized vehicles assaulted reporters and

taunted officers. Ferguson’s mayor and police chief also attended the meeting and were welcomed with applause.

Earlier in the day, Police Chief Tom Jackson said he had decided against releasing the officer’s name Tuesday after death threats were called into police and City Hall and posted on social media. Jackson said it could be weeks before he releases the name.

“If we come out and say, ‘It was this officer,’ then he immediately becomes a target,” Jackson said. “We’re taking the threats seriously.”

The officer has been with the force for about six years and was on a routine patrol when he encountered the two young men, Jackson said.

Police have not disclosed the race of the officer, but witnesses said he was white.

Brown was black.

The Ferguson police force has 53 officers, three of whom are black. Jackson said the city has had trouble recruiting and retaining black officers.

Best wishes for a fabulous school year Spring is usually considered a time of hope and renewal.

But we can’t help but think that right now, as students get ready to return to the classroom, also is a fitting time for both.

The first day of school conjures images of students dressed in new outfits and armed with freshly sharpened No. 2 pencils, spilling off buses into classrooms decorated by teachers eager to create engaging learning environments.

There’s the promise of potential.

About a half-dozen districts have held or will hold their first day of class this week. Students return in droves next week to classrooms through Will and Grundy counties.

They likely have a mixture of feelings churning inside as they prepare for that first day. Excitement to start the new year, maybe a little anxiety about a new teacher or starting a new school, and a little bit of sadness at the end of summer vacation.

Whatever the feelings are that first day, we’re sure students and their parents have hopes and dreams for this academic year.

Maybe those wishes include getting straight A’s, making the team, getting the lead in the fall musical or making new friends. Maybe last year wasn’t a great year, and they’re excited about the potential that a new year brings.

We also have hopes for this academic year at schools in Will and Grundy counties.

We hope students come to class every day ready to learn something new and build on the knowledge they have.

We hope they take advantage of opportunities to get engaged in their schools, whether that’s through academics, athletics or extracurricular activities.

We hope parents help their children transition into the new year by helping them get organized, talk to them daily about how their day went, lend a hand with homework and get engaged with each child’s teachers.

Learning doesn’t stop at the classroom, and success at school needs to be a partnership between parent and educator.

We hope each school is gifted with teachers and administrators who want to share their love of learning with every student who walks through their doors.

When I first mentioned this incarceration perk a couple years ago, a Rock Island woman wrote me and said, “God has hardened your heart” toward inmates.

Sorry. I do think inmates should be treated humanely.

But cable TV? No way.

My tax bill hardened my heart, not God. While the money for the cable TV comes from funds raised from inmate commissaries, the Legislature could divert it to pay for more worthwhile endeavors.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

It spent $669,608 for a set of six on the west side of the statehouse.

The bureaucrats jumped to the defense, saying you can’t just go to Menards and buy doors for a building as ornate as the statehouse.

No, but there are plenty of carpenters out there who could make respectable doors for less than 100 grand a pop.

When I hear politicians say they don’t see much waste in the budget, I have to roll my eyes.

It’s not as if there is a line item in the budget labeled “waste” that can just be cut.

Budgets need careful deliberation and debate.

But our Legislature often votes on budget within hours

of actually seeing the document.

Most folks give their household spending more thought than lawmakers give our state’s multibillion-dollar budget.

How else can we account for programs such as “urban fishing”?

The state and federal government fund a program that teaches city kids how to fish.

Is that really a core state service?

At a time when the state pays its bills late, can we really justify this program?

My dad and grandpa taught me how to fish.

And they added a dollop of something the state just can’t provide: love.

Unfortunately, the state increasingly views itself as a surrogate for family.

And it does a pretty lousy job at it.

If you don’t believe me, take a look at the appalling high school graduation rate

of state foster children – 54 percent nationally.

Or one need look no further than the Illinois Medicaid system for more evidence of our bloated bureaucracy.

Recent state-funded audits have found 60 percent of enrollees in the program do not meet income guidelines or other eligibility rules.

And yet these people were able to collect benefits.

That’s government waste at its worst.

A push is now afoot to make the temporary 67 percent income tax increase permanent.

How can lawmakers even consider raising taxes when so much waste goes unaddressed?

JOLIET – The first order of business when you stop at Joliet Catholic for the opening of fall football practice is to check out the offensive backfield.

Josh Ferguson, Malin Jones, Ty Isaac and Mike Ivlow all have starred running from the wingback position in recent years. Who is next in line, and will he be able to continue the some sort of production?

Nick Borgra, a senior who started at the wingback opposite Ivlow last season and quietly had an excellent year, opens as the main man this season. While it is unfair to suggest he is another Isaac or Ivlow, coach Dan Sharp said it’s all good.

“The thing about Nick is, he is quicker than he looks and is extremely strong,” Sharp said.

“He reminds me of Joliet Catholic backs from the old days.

He’s a throw-back.

“Plus, we have Michael Johnson and Harry Davis to play the other wing, and Drew Voss and Jordan Green for fullback.”

Junior quarterback Cade Earl has a strong arm and “has a perfect demeanor for the game,” Sharp said. “He has respect for the game.”

Offensive line coach Dave Douglas said with the horses up front who gained at least some experience last fall, that part of the game should function well.

“We’re in transition now, but I think we’ll do OK,” he said.

And if the backs aren’t breaking as many 60- and 70-yards runs, that may not be all bad.

“The last five years or so, we have had so many long runs that we haven’t had the 12-play drives much,” Douglas said. “Those can help our offense and keep our defense off the field more.”

Defensive coordinator Jake Jaworski said, “We’re excited about what we can do as a unit.

We’ll be more athletic in some spots, but what it will come down to playing strong team defense.”

“For college, I’ll want to hit [punts] 45 yards with 4.5 to 5 seconds hang time. I’ve been hitting that a lot, sometimes even a little better hang time.”

Sky’s Quigley earns WNBA honor VIEWS Dick Goss A former co-worker used to joke about how he was a jinx.

If he profiled an accomplished athlete, you could bet his or her next game or next tournament would be a bummer. It was not unlike the Sports Illustrated cover jinx.

I’m glad I never caught the jinx virus when it was going around. Last week, I wrote a column about Allie Quigley and how the former Joliet Catholic All-American is helping the Chicago Sky in their drive toward the WNBA playoffs.

Since then, she has had two more outstanding games.

In fact, she was named the WNBA Eastern Conference Player of the Week for Aug. 4 through 10.

After hitting 7-of-10 shots and scoring 17 points in an 8266 win over Connecticut shortly before we talked last week, Quigley had big games against defending WNBA champion Minnesota and Eastern Conference leader, Atlanta.

In a 74-64 loss at Minnesota, a game where the Sky hung close until the final two minutes, she scored a team-best 20 points on 9-of-14 shooting, including 2-of-4 from 3-point range. She also had three assists and two rebounds.

Then in an 80-69 win over Atlanta, Quigley scored a team-high 17 points. She hit 5-of-6 from the floor, 2-of-2 from 3-point land and 5-of-7 free throws to go with five assists and four rebounds.

That all resulted in a plus/ minus of 18.

A 2-guard, Quigley played about 29 minutes in both games, with some of those minutes spent running the show from the point.

“A well-deserved honor for a player that has stayed the course throughout her career,” Sky coach and general manager Pokey Chatman said of Quigley in a story on the team’s website.

“More importantly, she stayed the course this year for us, transitioning from a

2-guard to a point guard, back and forth, and she’s still been able to maintain a high level of consistency. That’s been the big reason we have been able to win some games lately, so I am happy for her.”

For the season, Quigley is averaging 24.4 minutes, 10.8 points, 2.1 rebounds, 1.8 assists and 0.7 steals while shooting .438 from the field, .360 on 3-pointers and .873 from the free throw line.

The top four teams in the Eastern Conference will qualify for the WNBA playoffs.

Helped by the huge victory over Atlanta, the Sky – with three games remaining – is tied with Indiana for third place in the East at 14-17. Atlanta is 17-14, and Washington 15-16. New York was 13-17 entering Tuesday night’s game against powerful Phoenix.

The Sky visits Washington for a 10:30 a.m. game Wednesday, travels to Indiana on Saturday, and closes the regular season at 5 p.m. Sunday against San Antonio at Allstate Arena.

A push for the playoffs always is fun to watch. When one of our own is so vitally involved in helping the Chicago team get there, it doesn’t

get any better.

ALL IN THE FAMILY The Quigley family, of course, has been prominent on the local sports landscape.

Last week, the Joliet Dirtbags baseball team competed in the NABF Regional in Kankakee. It finished 2-2 and was ousted from the double-elimination event by the Beecher Muskies.

However, in the regional opener, manager Kevin Campbell handed the ball to Ryan Quigley, Allie’s brother. All he did was throw a no-hitter to beat the Suburban Thunder, 1-0. He struck out 15 and walked one over the seven innings. And to think, he is more or less retired.

Quigley pitched for JCA and Saint Xavier before embarking on a professional career that included the independent and affiliated ranks.

He established the Frontier League saves record in 2011 when the Slammers won the league championship.

Rumpf served at various schools before becoming coach at JT West

JOLIET – On one hand, Chuck Rumpf experienced some of the same types of experiences as many others before they landed their first head coaching job.

However, the 2001 Lincoln-Way graduate took a somewhat circuitous route in the coaching profession before accepting the spot to lead Joliet West’s wrestling program.

Rumpf, who lost in overtime in the Class AA finals at 112 pounds in his last high school match, served as an assistant with five different programs during the past seven years before accepting a full-time teaching position along with the Tigers coaching job.

“I got hired in late May, and that was important for my athletic director because he wanted me to have the summer with the kids,” Rumpf said. “He not only wanted me to meet them but also to run a successful summer program. We did two days a week of summer camp here, and on Tuesdays we went to the summer league. We had a good core group that showed up consistently, but it’s tough in the summer because of football and jobs.

“I haven’t met all of the kids yet, so I’m looking forward to meeting the rest when school starts. The ones who showed up in the summer are good-character kids, and that’s fun when you get to coach wrestlers like that. Hopefully, you’ll see kids here who set high goals for themselves and not only have the desire to win and, if they win, to do it with class.”

The new Tigers coach, who succeeds Joey Benefiel and will teach photography, knows the area all too well after not only competing at a nearby school but also spending most of his years as an assistant coach with a variety of local programs.

By TIM O’BRIEN Shaw Media Correspondent JOLIET – Having dropped four straight series, the Joliet Slammers entered Tuesday’s game with Lake Erie having won just four of their past 12 games.

But with four weeks remaining in the Frontier League regular season, the potential is certainly there for the Slammers. Of the team’s remaining seven series, five remain with teams entering Tuesday with a sub.500 record.

A disappointing 2014 season for the Slammers?

Sure, but the chance to end the campaign on a positive note is there for the taking.

Continuing a six-game home stand, after a 1-2 showing against Southern Illinois this weekend at Silver Cross Field, Joliet opened a threegame series Tuesday with Lake Erie.

Although the Slammers took an early 4-2 lead, host Joliet could not hold onto the advantage and fell 7-4 to visiting Lake Erie.

Lake Erie (42-33) remains very much in the mix to clinch a playoff spot, one of six teams within 9½ games of each other in chasing down the four wild-card spots.

The two division winners and the next four teams with the best records qualify for the playoffs.

Scoring four runs in the bottom of the second, Joliet (29-47) appeared to be in control early courtesy of a smallball mentality.

Max Casper got things started, laying down a beautiful bunt down the first base line that allowed Adam Giacalone (two hits) to race home from third.

The next man up, J.D. Dorgan, ripped a hard-hit single to left field to plate Seth Granger and tie the game 2-2.

The Slammers went up 3-2 when Dorgan scored from third on a Lake Erie infield error on an Adrian English groundout.

Coming into the game with a 2-5 record, Joliet starter Andrew Busby pitched well early, but the Crushers kept chipping away at the big right-hander.

Lake Erie scored three runs in the fifth, including RBI hits from Trevor Stevens, Andrew Davis and Anderson Hidalgo, to go up, 6-4.

Busby was chased after 42⁄3 innings, giving up six runs on 10 hits with two strikeouts.

The Joliet starter did post a highlight-reel double play defensively to end the third, snagging a screamer hit back at him off the bat of Lake Erie’s Davis.

Busby calmly fielded the

ball that narrowly missed hitting him in the head and threw to first to double off Lake Erie’s Craig Hertler and put an end to the Crushers’ threat.

With Lake Erie threatening in the fourth after two hits to lead off the inning, Casper and English turned a gorgeous 6-4-3 double play to thwart the Crushers.

Joliet led off the ninth with a walk and a single against Crushers closer Trevor Longfellow but could not bring the runners around.

The Slammers stranded 10 runners overall.

Joliet continues the series with Lake Erie at 7:05 p.m.

Indeed, the “elephant” role Dom Capers envisions for Peppers will include him spending time at outside linebacker and end, but also three-technique and, on occasion, maybe even next to Matthews. The goal is to create presnap confusion, and the belief is that Peppers’ size and athleticism can cre-

ate conflict for opposing blockers. The Packers think using Peppers less than the Bears did, closer to 50 percent of snaps than the 80-plus percent he was deployed last season, will also help maximize his productivity.

He might be rejuvenated, but Peppers remains the same quiet, subdued personality he was during four years with the Bears.

Packers left tackle David Bakhtiari, who as a rookie had the task of blocking Peppers, admitted as much when asked if he’s had the chance to ask his foe-turned-teammate for any pointers.

“He’s a very quiet guy,” Bakhtiari said, “and the last thing I want to do is interrupt a quiet man in his own thoughts. If he ever came up to me, of course I would love it.”

The Packers didn’t sign Peppers to give advice to Bakhtiari, nor to have him suddenly transform into a dependable locker room sound bite. They acquired him to take heat off Matthews – a job Green Bay has struggled to fill – and fortify a Capers defense that failed to pull its weight last season, when the offense was weighted down by injuries.

“It’s about maximizing my abilities to try and fit into this defense and help this defense be more productive,” Peppers said. “I’m coming here to try and help this defense, help this team.”

Clausen edging Palmer in backup QB role

Jimmy Clausen will be the first quarterback off the bench in the team’s second preseason game Thursday night against the Jacksonville Jaguars and play with the second team.

Jordan Palmer will get the third-team reps.

“Right now, Jimmy will relieve Jay,” Trestman said Tuesday after the team’s final practice of training camp.

“He’ll have the shot after Jay comes out of the game, whenever that is. But both of them will play.”

Palmer was the second quarterback in Friday night against the PhilJordan adelphia Eagles, Palmer so it comes as no surprise that Clausen gets his chance against Jacksonville. However, in Tuesday’s practice, as well as Monday’s, Clausen got all the reps with the second string; there was no rotating. Despite Clausen’s ascension since joining the team

in June and his two-touchdown performance against Philadelphia, Trestman said no permanent decision has been made.

“They’re both making plays. They’re competing. I’ve talked to both of them that nothing’s set in stone from last week,” Trestman said about the backup competition. “We grade them every day. We’re watching all the tape. We’re making the corrections with each of them. It’s still a competition, and they know it. We’re repping them that way.”

Injury update: Jeremiah Ratliff, Matt Forte and Charles Tillman took the day off, while Lance Briggs returned after his veteran’s day Monday.

GREEN BAY, Wis. – Seeing Julius Peppers sporting a green and gold uniform, numbered 56 for linebacker, rushing from a two-point stance opposite Clay Matthews was an unfamiliar sight for one Chicago Football writer Tuesday observing his first Packers practice of 2014.

The grace and fluidity with which the 6-foot-7, 287-pounder flew around the practice field – however impossible it still seems – was as familiar as ever.

Even at age 34, Peppers – who joined the Packers on a three-year deal with $7.5 million guaranteed shortly after being released by the Bears in March – remains one of the game’s elite athletes and most formidable physical specimens. The Bears simply couldn’t justify keeping a player with an $18 million cap hit whose productivity and motor waned sharply last season.

That didn’t stop one team source in April from predicting a change of scenery would lead to a big rebound from Peppers, who certainly looked the part of a player enjoying a fresh start during and after practice Tuesday.

“We’ll see about that,” Peppers said when asked if he’s too old to make an impact. “I’m not going to really get

into much of discussing what I can and can’t do – we’re going to let the film speak.”

Last season’s film spoke volumes. It showed a player still capable of taking over games, as he did in monster performances at Minnesota and Detroit.

But in roughly 12 other starts, Peppers was close to invisible, a tough task for a man of his incredible stature.

Tuesday’s practice – albeit one, non-padded session – revealed a player seemingly with plenty left to give.

From talking shop on the sideline with fellow outside linebackers Matthews and Mike Neal, to blowing by hapless offensive linemen in one-on-one pass rush drills, Peppers was fully engaged and looking at home in a Green Bay defense priding itself on increased versatility.

Coach Mike McCarthy seemed pleased not only with his more flexible defense but the progress of its biggest addition.

“I think Julius is doing good,” McCarthy said. “We’ve asked a lot of him – we haven’t just lined him up in one spot. He’s getting more and more comfortable. I think Julius is having a good camp.”

By JIMMY GOLEN The Associated Press Tony Stewart could still face criminal charges for running down Kevin Ward Jr. with his sprint car, even if the threetime NASCAR champion didn’t mean to kill Ward, hurt him or even scare him.

Ontario County Sheriff Philip Povero, who announced on Tuesday that the investigation is continuing, has said that his initial findings have turned up nothing that would indicate criminal intent in the crash at the Canandaigua Motorsports Park.

But legal experts agree that does not mean Stewart is in the clear.

The NASCAR star could be charged with second-degree manslaughter under New York law if prosecutors believe he “recklessly caused the death of another person,” with negligent homicide another possibility, said criminal law professor Corey Rayburn Yung of the Kansas University School of Law.

Athletes in competition often do things that would get the average person arrested – think of two boxers in the

ring, or a baserunner sliding into second with his spikes high. But sometimes an act is so far outside the bounds of accepted sporting behavior that it becomes a crime, as former major leaguer Jose Offerman learned when he was charged with felony assault for rushing the mound – swinging a bat – after he was hit by a pitch in a minor league game.

So Stewart would not expect to be charged for the car-on-car bump that sent Ward spinning into the wall. But if, for example, he were to tell police that he saw Ward on the track and tried to shower him with dirt or otherwise send him a message, a first-degree manslaughter charge could be a possibility, Yung said.

In a 1949 case that Yung uses in his class, midget car racer Joseph Sostilio was found guilty of manslaughter after he tried to squeeze a 4-foot-wide vehicle through a 2-foot opening at 40 mph, crashing into another car and sending it into the one driven by Stephen D. Bishop. Bishop’s car flipped

three times and he was killed.

Sostilio’s conviction was upheld on appeal by the Massachusetts Supreme Judicial Court. Noting that a violent or aggressive act on a football field or in a boxing ring is not necessarily a crime, Justice Henry Tilton Lummus wrote: “In the present case physical contact was not an essential part of the racing of automobiles.”

That was a half-century ago, and racing has changed. Trading paint is a part of the sport, and it’s not even uncommon these days for racers to leave their cars to confront rivals after a crash, which Ward appeared to be doing when he was killed.

“In sports, we tend to allow all sorts of conduct we’d never allow in another circumstance,” Yung said. “But this isn’t a collision. It’s not in that ballpark; it’s something you don’t expect. This is a more complicated scenario. We’re assuming Stewart didn’t mean to do this, and yet a death resulted.”

By JAY COHEN The Associated Press CHICAGO – Rookie Kyle Hendricks pitched 71⁄3 innings of six-hit ball in his third consecutive win, and the Cubs cooled off Wily Peralta and the Milwaukee Brewers with a 3-0 victory on Tuesday night.

Hendricks struck out five and walked one in his third consecutive win, continuing an impressive opening run for his major league career. The right-hander is 4-1 with a 1.01 ERA in five starts since he got a no-decision in his debut at Cincinnati on July 10.

Anthony Rizzo hit his 26th homer for the Cubs, which had lost three of four. Arismendy Alcantara had two hits and drove in a run after going 1 for 14 through the first four games of the Cubs’ seven-game homestand.

Trying for a major league-

high 15th win, Peralta allowed three runs and seven hits in 61⁄3 innings.

The right-hander had won each of his last five starts and was 10-1 with a 4.06 ERA in his previous 12 games coming into the night.

Peralta (14-7) has lost each of his three starts this season against the last-place Cubs. He is 6-0 with a 1.10 ERA in seven games against the rest of the NL Central.

The Cubs grabbed the lead on Justin Ruggiano’s RBI single in the second, and Alcantara added another run-scoring single in the fourth. Alcantara’s hit drove in Starlin Castro, who reached on a leadoff double to extend his hitting streak to 11 games, the best such streak for the Cubs this year.

Rizzo then led off the sixth with a towering drive to left for his first homer since July 22.

Pedro Strop replaced Hendricks (4-1) with the bases loaded in the eighth and got Jonathan Lucroy to ground into an inning-ending double play. Hector Rondon then got three outs for his 15th save in 19 chances.

NL Central-leading Milwaukee had won four of five.

Brewers center fielder Carlos Gomez made a great leaping grab on the warning track in the first, taking extra bases away from Javier Baez. Gomez then was hit by a pitch on his right wrist in the third, but stayed in the game.

That’s how John Tobias of Indiana described the ribs he prepares with his rib-making partner – Tim Cavlovic of Plainfield – under their joint name of Jack the Ribber. It’s the third year they’ve competed in rib cook-offs, partly because Tobias puts his faith in Cavlovic’s special rub.

“Most people like it,” Tobias said.

On Aug. 2, for the sixth year in a row, the village of Frankfort partnered with the Frankfort Area Jaycees and the Frankfort Lions Club to raise money for charity, said Mary Canino, manager of community relations for the village. Hosting such an event made perfect sense to Canino.

“Denise [Lenz] from the Jaycees had been involved with other rib fests, and they had been successful,” Canino said. “So I thought, ‘Why not?’”

The Jaycees coordinate the contestants; the Lions sell beverages, Canino said.

Steve Juveland, president of the Frankfort Lions, said the organization raises several hundred dollars at the rib fest and hopes to raise close to $30,000 at its Frankfort Lions Wurst Festival on Aug. 28.

Proceeds from both events help support local food pantries; scholarships for community-minded, financially disadvantaged students; and local hearing and visually impaired individuals.

On event day, 19 contestants set up their booths starting at 6 a.m. Each received 15 slabs they prepared on-site.

Judging began at 12:30 p.m., and the public was allowed to buy samples starting at 1 p.m.

Winners were not announced until 3 p.m.

Within an hour, most of the ribs had been sold, Canino said. About 700 people attended. By the end of the day, Canino said the Jaycees had raised about $2,000, and the Lions had raised close to $500.

“We probably had 500 to 600 people here at the peak,” Canino said.

BBQ (Frankfort, second place) and Full Slabs (New Lenox, third place). Judges hailed from three Frankfort eateries: Jim Garofalo, owner of Kup a Joe Café; Matt Grisetta, chef from White St. Café; and Vicky Shaulk, manager from Durbin’s. Local blues artist Marty “Big Dog” Mercer provided live entertainment.

Jason Werner of Frankfort and his 9 Piggies BBQ won “People’s Choice” last year, Werner said. That had been the first time he had competed, and Werner said he owes his success to his wife, Mary Trent of Frankfort, for starting the process in a roundabout way.

Trent had tried chicken cooked on a Big Green Egg grill and felt she just had to get

one, Werner said. When Trent did, Werner experimented and then began competing against his cousin, who lives down the street, in friendly rib cook-off competitions, with the neighbors as taste-testers.

Strangely, the recipe for the sauce that earned him “People’s Choice” mysteriously disappeared, so Werner had to create a new one, he said. Last year, Werner said he received few comments from the crowd and won. This year, he quickly sold out.

“As soon as people left, more showed up,” he said.

Many other contestants also ran out of ribs, but that’s why the Jaycees also pitch a cooking tent. They not only sold 60 slabs of ribs but also rib

tips, pulled pork, corn and hot dogs for the kids, said Paige Lenz, president and Denise Lenz’s daughter, who chairs the event.

The fun of an amateur rib cook-off is that contestants can show off their special recipes and attendees can sample many different varieties of ribs, Paige said.

“Some people smoke them, others deep fry them, and some grill them,” Paige said. “Some use rubs; some add rubs and sauces after they smoke them.”

The Jaycees never prepare ribs the same way twice, Paige said. This year, the organization used a jalapeno jelly sauce from member Jen Roney.

Some of its ingredients included three commercial sauces – Sweet Baby Rays, Open Pit and the Sam’s Club brand – along with the jalapeno jelly, honey, brown sugar and peppers.

“We used it on the slabs, rib tips and pulled pork,” she said.

Fred Klaus of Tinley Park, back for the fourth time, said he only competes in the Frankfort Amateur Rib Cook-Off. He doesn’t enter for the competition, Klaus said, but to spend time with his family, because they all come out and help that day.

Along with the ribs, Klaus also offered homemade pulled pork, jardinière and lemonade.

His granddaughter Olivia Vanegas, 10, was there with her parents, Neil and Kathy Vanegas, helping serve. Olivia said her grandfather cooks good food all the time.

Still, Kathy said, Olivia’s favorite entrée is Klaus’ ribs.

“She stayed at his house all last week,” Kathy said, “and he made them for her.”

Now to West’s lead. It is normal to select partner’s suit – except when you have an ace-king holding in an unbid side suit. Here, West should definitely lead the club ace. East will signal with the eight, starting a highlow (an echo) with his doubleton.

West will cash the club king and lead a third round. East will ruff it and the diamond ace will defeat the contract.

Note that after a spade lead, declarer will ruff his low spades in the dummy, draw trumps and lose only three tricks.

ADVICE Daughter’s stalker ramps up accusations Dear Abby: I am very concerned about my 33-year-old daughter’s safety. A man in his mid-60s, someone she met at a previous job, has become obsessed with her. He has declared his love for her and divorced his wife.

She has refused his advances on nearly a daily basis, and he is now tracking her every move. If she leaves her house for even 30 minutes, he knows and accuses her of going to have sex with someone. Heavy sugar intake increases cardiac risk factors Dear Doctor K: I’ve read that sugar increases the risk of heart disease. How does it do that? Also, any advice for those of us with a sweet tooth?

Dear Reader: So far as we know, sugar doesn’t directly harm the heart. But it sure indirectly harms the heart, by promoting the following cardiac risk factors – problems that lead to heart disease: Obesity: Excess calories contribute to obesity. Added sugar is a major source of excess (and empty) calories. Overweight and obese people are at greater risk for heart problems. Today, we’re discovering that the cells containing fat make hormones that travel in the blood and have many harmful effects on the heart. The more fat cells, and the more fat in each fat cell, the higher the blood levels of these nasty hormones.

Diabetes: Sugar-sweetened drinks appear to play an important role in the increase of Type 2 diabetes. One reason for that is that the sugar is rapidly digested.

Cholesterol: Like obesity and diabetes, cholesterol is a major cardiac risk factor. Excess sugar lowers HDL (“good”) cholesterol and increases harmful triglycerides.

Blood Pressure: Two major studies have tied sugar to blood pressure. One linked sugar-sweetened beverages to increased blood pressure. The other found that cutting out just one sugary drink a day lowered blood pressure.

Metabolic Syndrome: The metabolic syndrome is a cluster of risk factors that signals a sharp increase in heart disease

risk. Sugary drinks substantially increase the risk of metabolic syndrome.

Sugar clearly impacts cardiac risk factors. But does that translate into actual heart attacks? It does. A long-term Harvard study of nearly 90,000 people found that those who averaged one sugary drink a day were 23 percent more likely to have heart attacks than people who drank no sugary drinks. The risk was even higher in those who had two or more sugary drinks per day.

Try these strategies: • Give up sugar-sweetened drinks. Quench your thirst with sparkling or tap water.

• Think fruit, not juice. Eat a piece of fruit instead of drinking fruit juice or drinks.

• Read the cereal box. Choose one with minimal added sugar.

• Read food labels. Many processed and packaged foods contain added sugars.

Bilingual population all part of living in a free society Dr. Wallace: I just returned home from Santa Barbara, California. Five of us spent a fun week there. We are sophomores at the University of Wisconsin on summer break.

This was our first time in California, and we were surprised at the number of people that spoke Spanish.

Some of the stores advertised in both English and Spanish. How many Spanish-speaking people are now living in the U.S.? – Kelly, Madison, Wisconsin Dear Kelly: According to the U.S. Census, about 32 million people speak another language in their homes. There are over 325 different languages spoken, and Spanish ranks number one, but no numbers were given.

Following Spanish as most frequently spoken in order were French, German and Italian.

Talkin’ ‘The Expendables 3’

By ED SYMKUS More Content Now Fans of the first two “Expendables” films will be happy to know that while most of the series’ formula – insane action sequences, tight camaraderie and wiseguy humor – is intact in “The Expendables 3,” things have also gotten more personal.

Sly Stallone again stars as Barney Ross, the leader of a rather crusty team of government-backed mercenaries. The twist is that this story has Ross bringing in a batch of young blood – new youthful recruits to replace the aging crew.

The film also introduces a big-time adversary: Conrad Stonebanks (Mel Gibson), a former cohort of Ross who has turned into his bitter enemy. Stallone and Gibson sat next to each other in a Los Angeles hotel earlier this week to talk about their roles in the film, and hint at their future career moves.

Symkus: There’s a great scene in “The Expendables 3” where Stonebanks tells his back story, and reveals why he’s become Ross’ adversary.

Sly, did you write out that whole scene, and Mel, did you stay on script?

Stallone: I just wrote a guideline, and then Mel came up with some ideas.

Gibson: I worked on the script a little bit at night, then I came in and handed the pages to Sly and [director] Patrick Hughes, and they said, “Yeah, that’s cool.” It was a theme of somebody who’s subcontracted by his government, and then thrown under the bus.

Stallone: I think what gave it some heart is that he was saying something that had some truth, and it was valid, and I don’t believe he saw himself as the bad guy. But then you bring in the aspect of Cain and Abel, and two best friends becoming the worst of enemies, because usually when you love something

In that scene, I had some dialogue back and forth with him, but the more he did the scene, the more I realized that I shouldn’t speak. So I just let him roll.

Symkus: Everyone watching is waiting for the two characters to finally go at it mano a mano, and you guys don’t disappoint.

Stallone: It’s a good fight.

You know, there are situations in sports where two rivalries get together, two teams that have done very well in their own world.

Then you wonder how they would do against each other.

When that finally happens, it becomes an event.

Gibson: King Kong vs.

Godzilla.

Stallone: That’s right.

Contact is made, and you do get hurt, and it’s freezing, and you don’t want to do [the scene] again but you have to do it again. But Mel is very fast and he’s very strong and it was great being punched by him.

Gibson: There was no actual contact.

Stallone (interrupting): That’s a bald-faced lie.

Gibson (laughing): It was kind of like movie sex. You don’t actually do it. And of course, you’re battling arthritis. But it was fun.

Symkus: If each of you could take one of your earlier characters and make him an Expendable, who would it be?

Gibson: The obvious one is the crazy cop from the “Lethal Weapon” series. But maybe that whack job from “Conspiracy Theory.”

Stallone: I think Rambo, but then he would turn around and kill them all.

That’s the down side of working with him.

Symkus: Sly, your character in the film is talking about retirement. What are your own thoughts about retirement?

Stallone: I’m not ready to sit at home and play with Pomeranians for 12 hours a day. Actors don’t want to retire; they’re usually forced to retire. And that’s sad, because you really get better as you get

older. You may not remember as much dialogue, but with the dialogue you DO remember, you’re better at it. We’re just adult children; we’re there to perform. I’ve always said that an artist dies twice.

The first death is the hardest, which is the career death, or the creative death. The physical death is an inevitability. So I think that everyone should just keep going, and I think that’s happening.

The genre is opening up, and television is providing more alternate careers or second acts in adult actors’ careers.

Symkus: Mel, are your plans leaning toward more acting or more directing?

Gibson: I think the most fun you can have standing up is directing a film. I think my gift is directing, and I’m going to pursue that. I’ve got a few irons in the fire, but it doesn’t pay to talk too much about it because industrial espionage is rife. The minute you say anything, somebody swipes the idea, and it ends up on TV. But that’s OK, too.

I’ll direct TV. TV is getting amazing.
