Plainfield officials say there’s plenty of blame for farm dump

By VIKAAS SHANKER vshanker@shawmedia.com PLAINFIELD – Trustee Jim Racich is tired of people saying the issues with a Plainfield resident illegally dumping waste near the DuPage River fall solely on the village.

Herman Fritz, the owner of Fritz Farm west of Route 59, has been accused of allowing people to illegally dump materials – from yard waste to concrete to tires – on his property near the river for a profit.

“I’m proud of this community and I want to definitely see the right jurisdiction responsible for bad action,” Racich said at Monday night’s board meeting, noting a pattern of people blaming the village for issues that fall with other governing bodies.

Racich, other trustees and village officials said dumping issues also include several other jurisdictions, including the Will County state’s attorney and state environmental agencies.

The state’s attorney’s office filed an emergency motion in court Nov. 20 to stop

Fritz from dumping any more materials, spokesman Charles Pelkie said. The motion came on the same day a CBS investigative reporter initially broke the story.

Fritz was summoned to court the following day for the preliminary injunction. Pelkie said Fritz’s next scheduled court date is Dec. 23 on allegations that he endangered the public health and welfare by dumping illegal waste on his farmland.

Pelkie said Fritz is accused of dumping waste in a three-step process. First, Fritz charged people a fee to dump garbage. Then, a construction company dumped concrete waste on the garbage. After that, Fritz himself covered the waste and concrete with dirt.

Fritz did not return calls for comment. No one answered the door at a house on his farm or at his home in a nearby subdivision.

Pelkie said the state’s attorney’s office is working with the Illinois Environmental Protection Agency and U.S. Army Corps of Engineers.

The dumping still remains under investigation, he said.

No one besides Fritz has been charged.

“The next step is to make a determination of what has been dumped over the years and to take all the steps to mitigate the damage done to the DuPage River, farmland and any wetland areas,” Pelkie said.

Problems with Fritz

Plainfield Police Chief John Konopek said there has been a history of calls complaining about Fritz over several years.

“We’ve been out there for illegal burning, ATVs noise complaints late at night and illegal dumping,” Konopek said, adding that the department has forwarded several reports to the Illinois Environmental Protection Agency.

However, Konopek said the department is limited in what it could do because the farm is private property and police can investigate only when there is a complaint from a village resident. Many complaints have come from nearby residents living outside the village limits.

Konopek also said the limited visibility from nearby roads makes it hard to see what’s happening on the farm.

WILMINGTON – Three teens were hospitalized Wednesday morning after driving out in front of a car carrier.

Illinois State Police Sgt. Fred Rivera said the crash occurred at 7:36 a.m. at Route 102 and Rivals Road.

“A Chevrolet Cavalier was turning from Rivals onto westbound 102 and crossed into the path of an eastbound car carrier,” Rivera said.

The Cavalier was driven by a 17-year-old Wilmington boy.

There was a 15-year-old boy in the passenger seat and a 13-year-old girl in the back seat, Rivera said.

The truck driver was not injured. The 17-year-old suffered a broken leg and was taken to Riverside Medical Center in Kankakee. The other teens were also examined at the hospital and released, according to Rivera.

The teen driver was ticketed for failing to yield on a left turn.

Metra commuters exposed to elements while transportation center is built

By VIKAAS SHANKER and LAUREN LEONE–CROSS Shaw Media JOLIET – Commuters waiting for Metra trains in Joliet are being left in the cold at a temporary boarding platform that may be in use for nearly two years.

“I hate this,” Cynthia Dixon of Joliet said Wednesday before she boarded the 7:05 a.m. Heritage Corridor train to Chicago. “They don’t have shelter from the elements.”

Other commuters said the situation was not so bad.

But delays in the complex maze of construction projects that will eventually make up the Joliet transportation center means those taking daily trips through Joliet will have to deal with the snow and cold without the interior comforts of a train station.

Access to the temporary platform is at the northwest corner of the intersection of Jefferson Street and Mayor Art Schultz Drive. A set of stairs leads directly to the platform and a 216-foot ramp provides disability access.

The platform doesn’t have a canopy or structure that could shield people from snow or rain.

While tunnel access may be available for commuters within six months, it will take two years to replace the temporary platform with a permanent one.

A warming shelter is set up at Silver Cross Field across the street from the platform.

However, Dixon said it wasn’t enough.

“There’s no shelter overhead on the platform and you can’t just stand at the station,” she said, adding that cars parked on Mayor Art Schultz Drive make the area more dangerous for commuters. “The disability access is still not good.”

“It really doesn’t affect me,” Joliet resident Don Bailey said as he stood at the foot of the stairs waiting for the train. “It’ll get cold out and icy, but the platform is fine.”

Ian Wilson, another commuter from Joliet, used to drive to work, but now takes the Heritage Corridor line.

“I get here five minutes before the train leaves,” he said.

“So the cold doesn’t bother me too much. As long as the train is on time, I’m fine.”

Construction delays

Work on the access tunnels

from the new station to the Rock Island and Heritage Corridor lines is delayed because other projects that intertwine with the tunnel are delayed, Joliet Civil Engineer Lisa Dorothy said, adding that Metra, Amtrak, BNSF and Union Pacific are responsible for parts of the overall transportation project.

Tunnel construction was anticipated to start in November. But Dorothy said construction was delayed until May because those other projects left little time for work to be completed before the cold weather and snow hit.

“Multiple crews are work-

ing up there at that diamond,” she said. “It’s a big puzzle that has to have everything coordinated with [Metra, Amtrak, Union Pacific and BNSF].”

“The city has done everything it can,” Dorothy said about the temporary access to the platform, noting the platform has an ADA compliant

access ramp and warming area.

There were issues with the last snowfall not being cleared near the ramp. Dorothy said it was an internal communication failure within Metra, which is responsible for the

By BRIAN STANLEY bstanley@shawmedia.com JOLIET – Police have not been able to identify who killed two men in a street ambush Tuesday night in Joliet.

Keon D. Kelly, 30, of Lockport and Tariq J. Purnell, 17, of Joliet were killed while an 18-year-old man was wounded.

Deputy Police Chief Al Roechner said the three men were in the driveway outside 429 Strong Ave., standing near a silver Buick sedan when they were attacked.

“They had either just arrived or were preparing to leave,” Roechner said. None of the victims live at the residence, but were acquainted with a woman who does.

Roechner said detectives believe the victims were approached by someone on foot, but they had not confirmed Wednesday that there was

only a single assailant. Roechner said bullets were recovered from the scene and would be examined. No weapons were found on the victims.

The Buick, which was not registered to any of the victims, was towed from the scene by police.

Kelly and Purnell were both shot multiple times, Roechner said. Purnell collapsed in the 50-yard driveway along the side of the house, while Kelly ran through a vacant lot to a driveway around the corner of Miles Avenue and fell.

The 18-year-old man who’d been with them was struck in the buttocks and ran inside the house to have someone call 911, Roechner said. He was taken to Presence Saint Joseph Medical Center and later flown to Loyola Medical Center in Maywood for internal bleeding, according to reports.

Kelly died at 6:07 p.m. in

the emergency room of Presence Saint Joseph, according to the Will County Coroner’s office.

Purnell was pronounced dead at the scene at 8:04 p.m.

Purnell was a senior attending the Joliet Central alternate school. Joliet Township High School District spokeswoman Kristine Schlismann said Wednesday support services and guidance counselors “are available to assist students and staff who are dealing with the loss.”

Purnell’s death is the second shooting death of a JTHS student in six weeks. On Oct. 23, Latray Wright, 16, a sophomore at Joliet West High School, was shot while walking with a friend along a Lockport Township street in the afternoon. Another 16-yearold was later arrested for the

OTTAWA – An appellate court will decide in the coming weeks whether a Joliet-area reporter found in contempt of court by a Will County judge must face jail time or disclose his sources in the high-profile Hickory Street double murder.

A panel of judges heard oral arguments in the case of Patch reporter Joseph Hosey Wednesday in the 3rd District Appellate Court in Ottawa.

At issue is how Hosey obtained police reports used to write a series of articles on the Hickory Street murders in Joliet and whether the identity of the source is relevant and essential to the murder trial proceedings of Bethany McKee, one of four defendants in the case.

Will County Judge Gerald Kinney last year sided with McKee and found Hosey in contempt for not complying with his order to disclose who gave him the police reports. Hosey’s attorney, Ken Schmetterer, appealed to the Illinois Appellate Court, arguing Hosey is protected under the state’s shield law, which provides journalists the right to protect confidential sources.

A gag order was not in place when Hosey published his articles, but defense attorneys received one shortly after the articles appeared on Patch.com’s website for Joliet.

McKee’s attorney Neil Patal argued Wednesday that his client’s fair-trial rights had been violated because Hosey’s articles added to the pre-trial publicity and could have potentially prejudiced jurors. He also said the source is likely someone involved in the case – further tainting the

But Third District Appellate Judge Daniel Schmidt, one of the judges hearing oral arguments Wednesday, questioned how forcing the disclosure of the source would have protected McKee from a biased jury.

“How does disclosing [the source] … unring the bell?” he asked.

Oral arguments lasted less than an hour Wednesday. Outside the courtroom, Schmetterer said it’s now a waiting game while the appellate court issues a written decision on whether to affirm or deny Kinney’s ruling.

Hosey also is a former reporter for The Herald-News.

The controversy stems from the January 2013 murders of Terrence Rankins and Eric Glover Jr. On Jan. 9, 2013, Rankins and Glover Jr. were lured to an apartment in the 1100 block of North Hickory Street by Alisa Massaro and McKee. The victims were strangled by Joshua Miner and Adam Landerman, according to authorities and trial testimony.

All four suspects were charged with murder. Massaro pleaded guilty to lesser charges in exchange for agreeing to testify against the others.

McKee was found guilty in trial and sentenced to life in prison. Miner also has been found guilty and sentenced to life in prison, and Landerman is awaiting trial.

City of Joliet lifts snow parking ban for some

By LAUREN LEONE–CROSS lleonecross@shawmedia.com JOLIET – The City Council this week voted to loosen the reins on the city’s snow removal policy, which forbids on-street parking during snowfalls of 2 inches or more.

But the policy changes, approved Tuesday, only affects neighborhoods deemed the most problematic, including areas near University of St. Francis and in the St. Pat’s Neighborhood.

That exclusion concerned District 1 Councilman Larry Hug. “Have we researched this exhaustively? Are these the only two [areas] that have problems?” Hug said.

City Manager Jim Hock said those areas proved most problematic last winter during periods of heavy snowfall, but added he’s certain residents from other neighborhoods will come forward with similar concerns.

“They’re going to ask us, ‘How come you didn’t do it for my neighborhood?’ ” Hock said. “So we will review any of those requests and make sure that if they do meet the criteria, we’ll present [any proposed changes] back to you again. But we think that this addresses all of the concerns that were raised with all the snow we had last winter.”

Carol Ann Heinemann, president of the St. Pat’s Neighborhood Association, said the policy change was a compromise that works well for St. Pat’s, but also allows the city to adequately plow the streets.

LOCKPORT – Lockport City Council approved the budget for next year but one council member questioned salary raises and another was concerned about tax increases.

In a 6-2 vote, city council members passed its budget for the 2015 fiscal year. City officials decided to switch to a full calendar year for its budget, which is an increase over the 2014 budget with roughly $37 million in revenue and $44 million in expenses.

While Fourth Ward Alderwoman Denise Marynowski – who voted against the budget – found “a lot of good things” in it such as the capital improvement projects, she didn’t agree with the proposed salary increases for nonunion employees.

According to the 2015 budget, the base salary for nonunion employees – including the city administrator – would receive a 2.5 percent raise.

She said considering costof-living adjustments for next year, which at 1.7 percent, she thought a 2 percent increase was appropriate. She also said she didn’t think the employees were underpaid considering the average full-time hourly wage.

“There is a lot of good in the budget. I know it’s going to pass, but because of this pay-

roll issue, I just don’t think the taxpayers are being treated fairly,” she said.

Third Ward Alderman Jason VanderMeer disagreed with Marynowski, saying he would have liked to see a 3 percent increase but thought 2.5 percent was fine. He pointed to the low average wage growth for nonunion employees and lack of raises during some periods.

“I agree with Denise that we have to be very careful stewards of the taxpayer dollar …

I feel like [she] is tripping over dollars to get to pennies here,” he said.

Second Ward Alderman Kelly Turner said his vote against the budget would be symbolic.

He said as taxes rise, property values continue to plummet. He was worried about residents who are retired or senior citizens.

“The economy is not doing that great and so because government always want the same amount of money no matter what, my vote is going to be no,” he said.

Both Second Ward Alderman Brian Smith and First Ward Alderman Kris Capadona voted for the budget, with Capadona saying the city in the past was paying below market value for leadership positions.

LOCAL BRIEF Lemont names new police chief

LEMONT – The village of Lemont has picked Marc Maton as the Lemont Police Department’s next Chief of Police, according to a village press release.

Maton – pronounced Maytawn – will be replacing Kevin Shaughnessy, who is retiring Jan. 2.

According to the release, Maton has 28 years of experience in various levels of responsibility from the Illinois State Police, most recently as the Deputy Director of

the Administration Division with the Illinois State Police.

His first day will be Jan. 5.

Lemont Mayor Brian Reaves said the village went through an extensive interview process before choosing Maton.

“Col. Maton was one of the top candidates that we had interviewed, and we are very excited that he has accepted the position of police chief and look forward to working with him here in the village of Lemont,” he said.

Shaughnessy, who also previ-

ously worked for the Illinois State Police, said he has known Maton for many years.

“He’s going to be a great asset to the Lemont Police,” he said.

“He’s a great professional.”

Having made the same transition as Maton, Shaughnessy knows the different between working for the state police and a municipal department.

“In the state police, he’s operating at a level where the numbers are higher, the action is quicker,” he said. “The village, the

This free event will be held at the Channahon Village Hall, 24555 S. CHANNAHON – Channahon village trustees will consider a program offering low-interest loans to local businesses for building improvements.

Qualifying projects could include facade improvements, new awnings, signage, architectural details such as cornices, new doors and windows, rooftop mechanical screening and repair or replacement of building systems such as heating, cooling and electrical.

The village made its first foray into lending to businesses when it loaned $36,447 to Lone Star Restaurant last month in a five-year, 1.8 percent interest agreement. Lone Star owners plan to switch from a septic system to the village sewer.

Brandon Road Lock and Dam eyed as test site

By BOB OKON bokon@shawmedia.com JOLIET – The Army Corps of Engineers plans to use the Brandon Road Lock and Dam as a test site for new technology aimed at controlling Asian carp and other invasive species.

A public meeting on the plans will be held 1 to 4 p.m.

Saturday in TCS Building 240 at Argonne National Laboratory in Lemont. A second meeting will 3 to 6 p.m. Tuesday at Gleacher Center, 450 N. City Front Plaza in Chicago.

The meeting will focus on using new control methods to block the movement of nuisance species from the Mississippi River basin to the Great Lakes.

OBITUARIES ELWYN J. ALLEN Elwyn J. Allen, age 95, at rest Tuesday, December 2, 2014, at Lakewood Health Care & Rehabilitation Center in Plainfield.

Born in Gardner, he was a 50-year resident of Joliet, residing in Plainfield the past ten years. A WWII U.S. Navy veteran, honorably discharged as a Gunner’s Mate 2nd Class in 1946. Retired from RustCraft Greeting Card Company. Member of Stone City Post VFW #2199 and the New Lenox American Legion.

He was an avid fisherman and Chicago Cubs fan.

Surviving are his daughter, Mary (Thomas) Pirc; two grandsons, Scott (Renee) Dimmick and James (Corinne) Dimmick; great-grandchildren, Samuel, Alex, Benjamin, Kinsley, and Colvin Dimmick.

Kay retired from Trinity Services, Inc. in Wilmington. She was a member of the St. Rose of Lima Catholic Church in Wilmington.

She had many hobbies, but her favorites were flower gardening, shopping, and enjoying her cats. Her greatest joy in life was spending time with her family and grandchildren, especially around the holidays.

She was born July 31, 1921, in Bath, England, the daughter of the late Frank and Amy (Rodway) Butler. She married the late Charles R. Nelson on March 2, 1945, in Bath, England. He died on May 5, 1991.

She was a member of the Green Garden United Methodist Church for almost 50 years and was affiliated with the Wilton Center Federated Church for the past few years. She served her church in Green Garden by providing the altar flowers for over 35 years. She loved to garden and knit and enjoyed bowling.

She was preceded in death by her parents; her husband; her son, John C. Nelson (April 18, 2005); a brother, Cyril Butler; a sister, Norah Toogood; and a daughter-in-law, Penny Nelson.

Born: March 6, 1923; in Saugatuck, MI Died: Nov. 14, 2014; in Walnut Creek, CA Dr. Robert G. Olsen, 91, died November 14, 2014, of cancer at Walnut Creek, California.

Robert was born in Saugatuck, Michigan, on March 6, 1923. He was the son of the late Robert and Margaret (Menard) Olsen.

Mary P. Olsen, his wife of 44 years, preceded him in death as did his son-in-law, Kevin Cawley; and his brothers, Bill Green, Jim Green and Jack Olsen.

Robert was a resident of the Joliet area for over 40 years. He received his medical degree from the Loyola School of Medicine, Chicago, Illinois.

He practiced radiology with the Associated Radiologists of Joliet which, in addition to its practice, served Silver Cross Hospital and the hospitals in Kankakee and Aurora.

Robert was active in many charitable and civic organizations, including the Knights of Columbus, the Kiwanis, the Boy Scouts of America, and Silver

Cross Hospital where he served on the board of trustees. He served in the US Army as a doctor in the late 1940s. He was a parishioner at St. Paul the Apostle Catholic Church.

Robert was the beloved father of eight children, Christine (Hank Gibbons) Olsen of Pasadena, California; Margaret (Douglas Jones) Olsen of Annandale, Virginia; Catherine (Thomas Sando) Olsen of Milton, Massachusetts; Robert (Beniko) Olsen and of Longmont, Colorado; Mary Ann Olsen of Fairfield, Ohio; Joseph Olsen of Loves Park, Illinois; Thomas (Meg) Olsen of Wheaton, Illinois; and, Jean Cawley of Park Ridge, Illinois.

He was the adored grandfather of 18 grandchildren. He is also survived by his wife, Auguste Olsen of Walnut Creek; and his sister, Mary Wolf of St. Joseph, Michigan.

Robert will be remembered for his steadfast love for his family, his absolute selflessness as a father and grandfather, his kindness to all, and his enduring faith in God. He will be missed by those who knew him.

Terry was also a great supporter of the D’Arcy Family Auto Dealerships.

She would tell her family and friends, “If you need a car, call me.”

Mary Nette, age 92, resident of Joliet for 48 years, passed away peacefully November 24, 2014.

Born in Shelby County, OH in 1922, one of twelve children from French immigrants, with surviving sisters, Grace Grunkemeyer and Rose Marie Wildenhaus, of Piqua, OH. Beloved nieces and nephews, many residing in the Piqua, OH area.

Preceded in death by her husband, Fritz; and three sons, Karl, Steve and Alex.

Survived by sons, Paul (Robin) and Fred (Val); and daughter, Teresa (Jeff) Lange; grandchildren, Valerie, Dustin, Kasie and Kristina Nette, and Alexandra and Hagan Lange; great-grandchild, Alexis Johnke.

Mary lived her early life in rural Ohio on a farm, before moving to Piqua with her family. She supported the World War II war effort for several years with Bill Lear, aviator and inventor, and met future husband Frederick Nette while in Piqua.

Moving to Grand Rapids, MI and then DeKalb, IL in the 1950s, she and her husband owned a successful tavern there before moving to Joliet, where her husband opened a transmission shop, now owned as Joliet Transmissions by son Fred.

In the 1970s, she owned and operated Mary’s Coffee Shop on Western Ave. in Joliet. In later years, she volunteered as election judge and was also engaged in other public service volunteer activities, as well as helping out at Joliet Transmissions three days a week.

Mary was extremely active into her 90s and was an avid gardener, with an exceptional talent for cultivating a variety of decorative flowers and vegetables. She will be remembered for her bright smile, hard-work ethic and inimitable view

of life. She will be greatly missed by her family.

A celebration of life will be held on Saturday, December 6th at the Cultural Club, (1503 Clement St., Joliet, IL) from 2:00 to 5:00 in the afternoon.

In lieu of flowers, donations can be made to the Morning Star Mission (Joliet, IL) or Will County Humane Society.

Mary’s wishes were that her body be donated to medical research.

A private ceremony will be held at a later date, and she will be interred at Resurrection Cemetery in Romeoville, IL.

Hostile queries of Obama friend allowed with proof

SPRINGFIELD – An Illinois friend of President Barack Obama could be called as a “hostile witness” by the government in a federal criminal trial over misused funds in the state agency he used to run, a judge ruled Wednesday.

U.S. District Judge Richard Mills told Justice Department lawyers they would have to show that Dr. Eric Whitaker is uncooperative or too closely tied to the trial defendant before he would allow him to be asked leading questions in the $13 million fraud case.

The U.S. attorney in Springfield may question Whitaker outside the presence of the jury in the trial of Chicago businessman Leon Dingle Jr. Dingle is accused of diverting $3 million in Department of Public Health grant money to his personal use. Prosecutors have not decided whether to summon Whitaker, the director of the agency from 2003 to 2007, which was while Obama was in the Illinois Senate.

2 Illinois utilities seek option for rate hikes

SPRINGFIELD – A legislative committee has taken action that gives a pair of the state’s electric utilities an opportunity to receive what could be two more years of rate hikes.

The Illinois Senate Executive Committee voted 12-1 Tuesday on a measure involving Ameren Illinois and Commonwealth Edison, both of which want to avoid legislative oversight until 2019 on upgrades to the state’s aging electric grid, the Springfield bureau of Lee Enterprises newspapers reported.

CHAMPAIGN – A group of department heads and others at the University of Illinois is asking the incoming president to address the damage they believe was caused by the decision to withdraw a job offer to a professor.

The News-Gazette reported that 14 department heads and 20 other academics wrote to incoming university system president Timothy Killeen and asked him to commit to free speech and academic freedom.

The letter writers’ concerns stem from the decision to rescind Native American studies professor Steven Salaita’s job offer this year after he wrote profane anti-Israel Twitter messages.

The letter writers note that more than 5,000 academics from other schools have said they’ll boycott events at the University of Illinois.

Illinois firearm, muzzleloader permits available

SPRINGFIELD – Illinois hunters can now buy firearm and muzzleloader deer permits directly from vendors this week.

The Department of Natural Resources says the remaining permits will be sold by overthe-counter vendors through Monday, or until quotas are exhausted. Late-winter antlerless-only deer county permits will be available from the DNR and vendors beginning on Tuesday.

SPRINGFIELD – Illinois lawmakers began wrapping up their annual fall veto session Wednesday, pushing off some of the state’s business until Republican Gov.-elect Bruce Rauner and a new General Assembly take office in January.

Without the votes in hand to pass minimum wage legislation, the House announced it was done for the year. But the Senate passed the measure, which would raise the state’s wage to $11 an hour by 2019, hours after House Speaker Michael Madigan gaveled his chamber out of session.

Madigan said he does not plan to call the House back into a “lame duck” session before Rauner’s inauguration.

That would leave hanging what to do about the state’s financial crises, among other issues.

But outgoing Democratic Gov. Pat Quinn – who has made raising the wage a focus in recent months – has the power to call the House back himself in an attempt to force a vote, if he wishes. The gov-

ernor’s office hasn’t indicated precisely what it plans to do, issuing a statement saying Quinn will “continue working with the members of the House of Representatives to raise the wage, which will be good for the economy and for workers.”

The Senate will hold its last scheduled session day Thursday.

Lawmakers on both sides of the House aisle said they had warmed to the idea of concluding business now rather than holding an early January session, a time when controversial legislation often is pushed through by outgoing lawmakers free from fear of political ramifications.

“It’s a time of transition,” said Democratic state Rep. Elaine Nekritz, a House assistant majority leader. She said Rauner has been “very clear” about his request that lawmakers wait to take up substantive issues until he was in office. “We’re doing some things, but we’re trying to be respectful – which is not a word often used when describing the General Assembly,” Nekritz said.

STATE BRIEFS SPRINGFIELD – Illinois lawmakers have approved a plan that makes same-day voter registration permanent.

The concept was tried out for the Nov. 4 election under legislation lawmakers approved in the spring. The plan also extended early voting and made it easier to vote on college campuses.

The House approved the plan, 70-44, on Wednesday. The Senate followed with a 40-17 vote.

Supporters said voters should have every opportunity to register and cast a ballot through Election Day and that long lines at same-day registration locations provided evidence of its popularity.

WASHINGTON – Two of the three women on the Supreme Court vigorously questioned a UPS lawyer Wednesday over the company’s refusal to give lighter duty to a pregnant worker, a closely watched case with potentially broad impact for female workers and their employers.

Questions from several justices during arguments suggested the court could be searching for a middle ground in the dispute between UPS and former driver Peggy Young.

UPS declined to give the woman temporary light-duty work so she could avoid lifting heavy packages after she became pregnant in 2006.

Air bag maker balking at coast-to-coast recall

By DEE-ANN DURBIN and MARCY GORDON The Associated Press WASHINGTON – Japan’s Takata Corp. rejected federal regulators’ demand Wednesday for an expanded, nationwide recall of millions of air bags, setting up a possible legal showdown and leaving some drivers to wonder about the safety of their cars.

Amid the standoff, Honda Motor Co. decided to act on its own and recall cars with the potentially defective equipment in all 50 states. But other automakers have yet to make a decision.

At issue are air bags whose inflators can explode with too much force, hurling shrapnel into the passenger compartment. At least five deaths and dozens of injuries have been linked to the problem worldwide.

Over the past six years, Takata and 10 automakers issued a series of recalls covering 8 million cars in the U.S., mostly in high-humidity

areas such as the Gulf Coast, because of evidence that moisture can cause the propellant to burn too quickly. But after incidents in California and North Carolina, the National Highway Traffic Safety Administration began pressing for the recall of 8 million more vehicles from coast to coast – a demand that Takata flatly rejected.

“There’s not enough scientific evidence to change from a regional recall to a national recall,” Hiroshi Shimizu, Takata senior vice president of global quality assurance, told a House subcommittee on Capitol Hill.

Takata also contends that NHTSA has authority to seek recalls only from auto manufacturers and makers of replacement parts, not from original parts suppliers – a position NHTSA contests.

Shimizu insisted the air bags are safe: “I would drive a car with a Takata air bag.”

David Friedman, NHTSA deputy administrator, said he was “deeply disappointed” by

Takata’s response.

The agency is gathering proof a recall is needed, which it will present at a public hearing. After that, NHTSA could order Takata to undertake a recall, and could take the company to court if it refuses. But Friedman acknowledged that could take months.

“It’s time for industry to step up,” Friedman told lawmakers. “Until (Takata) and automakers act, affected drivers won’t be protected.”

The stalemate is likely to add to the confusion among car owners, many of whom already are bewildered because some of the recalls have covered driver’s-side air bags, while others applied to passenger-side air bags, and a few covered both. The NHTSA-demanded recalls would involve driver’s-side air bags.

At Wednesday’s hearing, Rep. Jan Schakowsky of Illinois, the panel’s senior Democrat, said she has received letters from constituents “who are literally afraid to drive their cars.”

ing could be included in a tax overhaul package and predicted progress on overseas trade agreements.

On immigration, Obama said he expected Republicans to attempt to dismantle his recent executive orders, then eventually come around to the idea of pursuing legislation to deal with the millions of people in the U.S. illegally.

“I don’t think that’s something this Congress will be

able to do right away,” Obama said during a question-and-answer session with business leaders. “Temperatures need to cool a bit in the wake of my executive action.”

McConnell, the Kentucky lawmaker who soon is to become Senate majority leader, has broadly agreed with Obama’s calls for tax reform, improving the nation’s infrastructure and inking free trade pacts. But McConnell

said Tuesday he has been “perplexed” by Obama’s response to his party’s sweeping defeats in the midterm elections last month, specifically his decision to press forward with presidential directives on immigration.

“I don’t know what we can expect in terms of reaching bipartisan agreement,” McConnell said. “That’s my first choice, to look at things we agree on – if there are any.”

Joyce Craig of Joliet attended Monday night’s City Council meeting to air her concerns about the temporary platform and the closing of Union Station.

“People are cold. They’re in temporary buildings. This is America and they have no bathrooms. They have to use

[portable toilets] and go over to the Silver Cross ballpark to warm up,” said Craig, who occasionally commutes to downtown Chicago.

Councilman Jim McFarland was visibly upset about the situation Tuesday night.

He drilled Dorothy and City Manager Jim Hock about the construction delays and about the questions surrounding Amtrak’s people-movers – transports for people with disabilities – which have yet to be rolled out.

“Do you have any idea? ’Cause it sounds like dealing with Metra and Amtrak and

all these different groups has been a mess. Can anybody legitimately give us a timeline?”

McFarland said.

“Or are we going to do … something ourselves as a city?” he added. “Because I’ve heard nothing but complaints and every day this goes on. We’re not coming up with a solution.”

“We’ve applied as much pressure to Amtrak as we can to expedite the process,” Dorothy said Wednesday.

Spokesmen from Metra and Amtrak in turn said the temporary platform was built by a contractor working for the city of Joliet.

Court records show Kelly was a registered sex offender. He also pleaded guilty to aggravated unlawful use of a weapon in 2006 and was sentenced to three years in prison.

Councilman Terry Morris, whose district includes Strong Avenue, said Wednesday he had not heard from any residents about recent problems in the neighborhood.

“I don’t think it’s the area. [The shooting] was a situation with individuals,” Morris said.

Records show police used a warrant to enter 429 Strong Ave. in August during a “search for weapons.” Charseka C. Ward, 28, of that address, was arrested on charges of reckless discharge of a firearm and unauthorized possession of a firearm.

Ward is awaiting trial.

Autopsies performed Wednesday confirmed both Kelly and Purnell died from multiple gunshot wounds, Will Coroner Patrick K. O’Neil said. Kelly’s funeral arrangements are being handled by Minor-Morris Funeral Home. Purnell’s funeral arrangements were pending Wednesday.

No one answered the door at several houses Wednesday in the block where the shooting occurred.

LETTERS TO THE EDITOR Misinformation doesn’t help state’s woes

To the Editor: I read the opinion column “High court holds our future in its hands”

by Scott Reeder that appeared Nov. 26 in The Herald-News, and I was amazed the same line of misinformation and group of scare tactics were being used.

Reeder likes to scare readers into believing the sky will fall tomorrow. It’s true there is a big debt to repay. The state government has shorted pension fund payments for decades and made conscious choices to not raise taxes to create this debt.

As far as the union declaring victory, that’s not quite true.

They say they won the battle, but know there are more plans to defend against – plans that have one thing in common: The people receiving pensions should be the ones to pay for the state’s neglect.

When Reeder talks about people retiring in their 50s, he may be right for a tiny percentage. Pensions are based on years of service, so the pensions they receive will be small. Pensions, just like Social Security, grow over time.

But state workers don’t get Social Security unless they have earned it in another job. And if they do get both, the Social Security in Illinois is cut to below 50 percent of what actually is earned. How’s that for an injustice?

Reeder likes to continue on his mission to make sure pensioners pay by spreading the fear that programs will be cut. Not so. What is needed is a few more legislators to tell the truth, by saying the whole problem is a revenue problem and they need to fix taxes.

But Reeder doesn’t want that. He wants to keep getting more from the state without paying for it, just as he has for decades. Just like we all have not paid for the projects and programs that have passed through our Disneyland called

It’s time to speak our piece about Obama’s actions

To the Editor: Emperor Obama – or how about Queen Clinton? Rolls right off your tongue, doesn’t it? I have to admit it takes a lot to really get me mad, and the Democrats finally have managed to do it – and it is probably exactly what they wanted to do.

I’m not against updating our Immigration laws. But who does the president think he is to make up his own laws bypassing the Congress, just to get more votes for the political left?

After the November election, when we tried to let the politicians know how upset we all are, the president makes up his own laws again bypassing the Congress and perhaps even the Constitution.

This man is so arrogant it wants to make me scream.

My fellow Americans, it’s time to speak your piece. Call your legislators and let them know how mad we are. Don’t sit around yelling at your TV or ripping up your newspaper – a call. Put your opinions in writing to all the newspapers. What this man has done makes me very uneasy about the future of our great nation. Glenn Beck, where are you? You were sure right about what these guys planned to do.

Let’s keep shenanigans out of state government There is good news and bad news regarding state government during the past week.

The bad news, of course, is that our state is still in shambles. The half-hearted pension reform legislators passed has been ruled unconstitutional. The unfunded pension liability is around $100 billion. There’s another $6 billion remaining in unpaid bills.

The good news? It appears there will be no lame-duck session of the Legislature in January. Or as state Rep. Jack Franks put it: “There will be no shenanigans as there have been in the past.”

Those past shenanigans include the January 2011 lame-duck session, when tax rates were raised 67

percent and 46 percent on households and businesses, respectively. The increases were billed by Democratic lawmakers as necessary to stabilize the state’s desperate finances.

Instead, almost all of the revenue was swallowed by ballooning public pension obligations.

How the tax increase was pushed through in that lame-duck session was despicable. Some outgoing Democrats who lost re-election bids traded a “yes” vote for a government job. Those leaving the Legislature who voted “yes” no longer could be held accountable for their actions.

No lame-duck session this January means the January 2011 tax increase will start to sunset. It will

decrease from 5 percent to 3.75 percent on individuals, and from 7 percent to 5.25 percent on businesses, not counting the 2.5 percent corporate personal property replacement tax.

Now, it’s on to Jan. 14, when Bruce Rauner is sworn in as governor and the 99th General Assembly is seated.

Rauner and lawmakers have their work cut out for them. Hard decisions must be made, including decisions on wasteful spending, a budget that will have a large hole in it and whether lawmakers will vote to increase taxes again.

Perhaps all involved can continue to keep shenanigans out of the equation.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Coach Jason DePolo’s squad looks for a third state appearance, while Josh Oster’s Lockport squad hopes to get back to state following a two-year absence.

In Class 2A, coach Brian Glynn’s Lincoln-Way West team fell a win shy of a trip to the finals after getting there the year before.

And in Class 1A, coach Greg Goberville’s Peotone squad looks for a return visit, while Rob Murphy’s Wilmington program hopes to get back to state for the first time since 2012 and Mark Masters hopes that his Coal City squad can earn its first state trip since 1999.

Here’s a closer look at some of the programs that provided information about this season: Coal City: Defending state champion senior Cody Minnick (120/126), who went 46-1 a year ago, and runner-up senior Cody Minnick (138/145), who finished 33-4 last year, lead the way for the Coalers.

Coach Masters also will look to senior Jake Frost (220), who finished 24-16 last year; and juniors Joey Rivera (106), who was 39-11, Jonah Englert (145), who went 23-17, and Riley Kauzlaric (182), who was 33-15. Juniors Nate Buck (145/152) and Alec Leasure (195) also won 10 or more matches last season for the Coalers.

Joliet West: New coach Chuck Rumpf has a young group he believes will improve as the season continues. Junior Darvell Flagg (106) is a two-time state qualifier, while junior Meekah Ben-Israel qualified for the sectional a year ago. Sophomore Austin Poch (113) and junior Roman Johnson (132/138) are joined by returning senior starters Jesse Hurtado (170) and Matt Iwinski (195).

Johnson (195), expected back from injury later this season, went 51-1 and lost in the finals in 2014, while Oster (138), who was 43-7, placed third. He also was an All-American at the Fargo Nationals last year.

Timmons (145/152) went 36-10, while Wolfe (145/152) was 3212. Sophomore Abdullah Assaf (113) went 30-20, senior Cameron Roat (126/132) was 26-20, and senior Chris Murino (220) went 18-15 for the Porters.

Peotone: Coach Greg Goberville’s Blue Devils return five state qualifiers from last year’s squad, which advanced to the dual team finals. They are Chase Emerson (113), Liam McLaughlin (126), Nick Goberville (160), Joey Winkelman (182) and Tom Ruffino (195).

Plainfield East: Coach Nick Curby’s squad returns two of the four individuals who made program history by qualifying for state. Junior Zach Krause went 36-4 a year ago, while sophomore Michael McGee was 38-8. Senior Jake Mayon

Junior Tyler Myers (113) went 19-15 and qualified for sectionals, sophomore Luke Smiley (126) went 18-11, and freshman Matt Hennessey (160) was an Illinois Kids Wrestling Federation state placer last year.

Reed-Custer: Junior Jon Costain (170) won 24 matches a year ago, and senior Billy Marquardt (160) collected 15 wins, as both qualified for state a year ago. Other top returnees for coach Andy Gleixner’s Comets are seniors Tristan Windsor (182) and Fabian Marchan (132), juniors Robert Miller (113) and Dylan Williams (126), and sophomore Jackson Branum (195). Others with experience for coach Todd Yegge’s squad include senior Zach Russell, who was 27-11 last year, and junior Bryce Coyle, who went 24-14. Sophomore Tyler Draine and juniors Wyatt Rodriguez and Kyle Sigmon also collected 10 or more wins a year ago.

Wilmington: Veteran Wildcats coach Rob Murphy welcomes back a number of key performers from last year’s 25-8 squad. They include junior Nick Hawkins (160), who went 44-12 last year and placed third at state, and senior Austin Headrick (132), who was 38-15 and took sixth in his second state trip. Joliet Central holds off Lincoln-Way East

By CURT HERRON cherron@shawmedia.com JOLIET – In a game neither side likely will include in its scrapbook, Joliet Central’s boys basketball team prevailed over Lincoln-Way East, 42-39 in a SouthWest Suburban Conference Blue contest Wednesday.

The Steelmen won their fifth straight to open the season, but it was a far cry from the efforts they turned in when they won the WJOL Thanksgiving Tournament.

Central (5-0) misfired on six straight free throw tries late in the game, but East (2-2) was unable to capitalize as it

turned the ball over 27 times, including 15 times in the second half and three times in the last 35 seconds.

“At Thanksgiving, we played the way that we wanted to a lot,” Central coach Jeff Corcoran said. “But today, it was a little bit of a different feel on a Wednesday night. As ugly as it was, to hold any team under 40 points is a good thing, and East is much improved.

“I don’t want to use it as an excuse, but our group was dealing with a lot of stuff in the community that happened yesterday which has affected a lot of these kids. Some of them just weren’t there mentally since they’ve been kind of a

mess.”

Things looked good for Central after it jumped out to an early, 10-3 lead and carried that advantage into the second quarter.

To the Griffins’ credit, they managed to pull to within 20-18 at the break and then jumped out to a 29-22 lead midway through the third quarter.

But that’s when the wheels started to come off of the wagon for East, which only held a 32-31 lead heading into the fourth quarter, thanks in part to Central’s Taquan Sims tossing in seven of his game-high 15 points in the third quarter.

“We overcame a lot tonight,” Griffins coach Rich Ko-

limas said. “We started out unable to score, but our defense was solid – and it was 10-3, 10-3 and 10-3 – and then at half we were within 20-18, and we were OK with that because we had played so poorly offensively.

“Then we were up, 29-22, and we had three possessions to really take a significant lead. And we missed a laner, we missed a jumper and then we had a turnover. More than our failure to execute at the end, we didn’t take advantage of things at the other end.”

The Griffins took their last lead at 39-37 with 3:11 left on a layup by Clint Nooner (10 points, nine rebounds). Central moved in front for good on

a layup by Sims with 1:18 left.

Three Lemont athletes commit to colleges SUBMITTED REPORTS LEMONT – Nick Urban, Kyra Udziela and Jorie Dybcio signed national letters of intent to further their athletic careers at their respective colleges.

Urban, who will attend Grand Valley State, is the most decorated boys’ tennis player in Lemont’s history. He has served as the Indians’ top singles player since his freshman year, and he has helped the Indians to a 45-9 record in dual matches, as well as three South Suburban Conference-Blue Division titles, the school’s first-ever sectional crown and two sectional runner-up finishes.

Urban enters his final varsity season with a career record of 83-13 and has won SSC Blue titles at No. 1 singles three straight years. He also has qualified for the IHSA State Finals three times, compiling a 10-6 record in those appearances, finishing in the top 24 his junior year.

Udziela will continue her bowling career at St. Francis (Pa.). Udziela has qualified to compete in the National Junior Gold event in Chicago in 2015.

As a junior, Udziela posted a Lemont single-season record 205 average and cemented team MVP honors with three medalist finishes in postseason play.

Udziela averaged 207 over six games to win individual honors at the SSC Meet, which helped the squad to its second straight SSC Blue crown.

She put together a career-best 1,354 series – a 225.7 average – at the IHSA regionals over six games to become the individual IHSA regional champion and help Lemont to a third-place finish. She followed performance by averaging 222.0 at the sectionals; that effort keyed the Indians to a second-place finish and an accompanying state finals berth. Lemont finished 23rd in the team standings at the IHSA state finals, but Udziela advanced to the final day of competition and averaged 200.3 over 12 games to place 52nd in the individual standings. She posted the team’s best game (279), three-game series (733) and six-game series (1,354).

Dybcio will run track and cross country at Trinity Christian. During Dybcio’s tenure, Lemont has won three South Suburban Conference-Blue Division crowns in cross country and also captured the 2014 SSC Blue Girls’ Track and Field title. She twice has earned AllSSC honors in cross country and has five SSC titles in track and field. Dybcio’s personal best in the 3-mile distance in cross country is 18:57. Her best

1600 meter time in track is 5:29, which helped her to all-sectional honors at the IHSA sectional in 2013. She has posted a personal best of 2:21 in the 800 meter run.

Dybcio helped the Indians not only capture the SSC Blue crown but also win regionals and sectionals before finishing fourth at the 2014 IHSA Class 2A girls’ cross country state finals – the best finish in school history. Dybcio earned All-SSC accolades by finishing fifth at the SSC meet. She also was one of the team’s top five runners at regionals (24th individually), sectionals (23rd individually) and IHSA State Finals (124th individually).

As a sophomore, Dybcio won the 1,600-meter run (5:30) and was part of the school’s victorious 4 x 800 squad (10:12).

In the Indians’ SSC Championship season in 2014, she won the 800 (2:27) and 1,600 (5:37) meter runs, and was part of the winning 4x800 relay team (10:39).

IHSA issues statement after concussion suit filed

In response to a class-action lawsuit filed over concussions, the Illinois High School Association issued a statement on Wednesday, saying that the organization is best equipped to handle safety concerns from football.

The lawsuit was filed last weekend against the IHSA on behalf of Daniel Bukal, a quar-

terback at Niles Notre Dame from 1999 to 2003. It argues that the IHSA failed to adequately protect players from concussions, and calls upon the association to develop stricter protocols regarding the management of head injuries.

“While this lawsuit alleges that it exists to help aid in that matter, simply put, high school football should not be subject to being dismantled or reassembled,” the IHSA said in a 450-

word statement. “Those who oversee safety measures on a day-to-day basis are the people best equipped to address these improvements, not those operating within the courts.”

Representing Bukal is Joseph Siprut, a Chicago-based attorney who filed a similar suit against the NCAA over concussions in 2011 on behalf of Adrian Arrington, a former safety at Eastern Illinois.

“Risk minimization for

high school student-athletes in all sports, including football, has been and will continue to be a top priority for the association,” the IHSA said. “We believe that since the IHSA began sanctioning football competition, the safety procedures and protocols in place for high school football have been on par with, or have exceeded, those that exist around the country, regardless of the level of football.”

“At its core, high school football is not college football, nor is it the NFL, and for the vast majority of these young players this is the highest level at which they will compete.

The IHSA bears that in mind as it continues to bring safer standards of play to practice, games and off-season workouts.”

The IHSA has scheduled a press conference for Friday at 11 a.m. at Lincoln-Way West High School in New Lenox.

He had the chance to play again in 2014 but declined a big salary in order to finally start spending quality time with his family.

“I was really blessed to be able to play in Chicago and Boston,” Dempster said. “Two great cities with the two oldest ballparks. People asked: ‘What did you like more, Fenway or Wrigley?’ and I’m like, ‘Who do you like, (Bobby) Hull or (Stan) Mikita?’ How do you pick between two hall-of-famers? You can’t – it’s really unfair. One’s the greatest in the National League, and one’s the greatest in the American League – that’s how I feel about it. I got to walk into both of those places and call it my office. I feel pretty fortunate to have done that.

“Boston was a great city to play in; and obviously, given everything that happened with the bombing on April 15, the entire city felt like a cul de sac and we all lived there and it was really special to be around. The Red Sox were in last place in 2012, and we had a bunch on new guys who came in and we said before spring training that we weren’t going to talk about last year and the only thing that mattered was this year and we’re going to win.

“I’ve really enjoyed it since I left baseball. I’ve probably spent as much time with my kids in one year off than I did in for a lot of their lives during baseball seasons. Whether it’s getting to Little League games or dance and gymnastics classes or other things that I never got to do much, like playing a lot of golf and traveling. I got to go back home for the first time in the summer since I was pretty much 18 years old, so that was a lot of fun to do that. I didn’t realize how much I’d missed them until I got the chance to do them now, so I’m just trying to make the most of it while still trying to stay around the game.”

JOLIET – As a young man growing up in a small coastal community in British Columbia, Ryan Dempster was determined to pursue an unusual career for someone from an out-of-the-way place that was north of the border – to become a professional baseball player.

But Dempster not only was able to make it to the major leagues, he also enjoyed a long and successful career as a pitcher. He finished with the second-most victories of any hurler from Canada, trailing only Hall of Famer and longtime Cub Ferguson Jenkins.

The 16-year major leaguer, who was with the Cubs from 2004 to 2012, was in Joliet on Tuesday to speak at the University of St. Francis’ Brown & Gold dinner. Before the event, Dempster, who did analyst work for MLB Network this year, talked about a variety of topics, including his Canadian roots, playing for the Cubs and winning a World Series with Boston.

“Coming from Canada, people always ask if I played hockey; but my grandfather loved baseball, and my parents played in a slow-pitch softball league. And I remember being 4 years old and them giving me a glove to go stand in the outfield to run down the balls in the outfield that they didn’t want to run after,” Dempster said. “It was just a passion and dream that I had as a kid, and it just kept growing and growing as I got older, and it never stopped until pretty much this year.

“Looking back and just trying to put it into perspective, it’s something that I’m proud of. I’m proud to be a Canadian and also proud to come from a little small town outside of Vancouver called Gibsons, British Columbia. I remember taking countless amounts of ferry rides to go over and play baseball. So to think that you’re second in wins behind Fergie Jenkins is something that I don’t think that I ever dreamed of as a kid. It gives hope for kids not just from Canada but from anywhere that might be remote that if you put in hard enough work and are determined enough, that you can get there and be successful.”

Some of his most enjoyable years in the sport came while playing on the North Side. He looks forward to seeing the long-frustrated franchise finally enjoy consistent success in the years to come and he thinks that it could happen in the near future.

“I think that the Chicago Cubs are in the best position that they’ve been for the possibility of winning and being able to sustain that winning for a long time,” Dempster said. “I played with

Cowboys real, but Bears can win BEARS INSIDER Hub Arkush It’s not that the Dallas Cowboys aren’t for real – they are. They’re deserving of their 8-4 record, and they should beat the Bears on tonight at Soldier Field.

But Dallas is flawed. And interestingly enough, the Bears will be far from the best matchup Dallas has seen this year.

Question No. 1, of course, is will the Bears show up?

It’s impossible to know right now what their relationship is with their coach and what kind of hold coach Marc Trestman has on the locker room.

But I don’t believe, whatever you might want to say about them, that guys such as Jay Cutler, Matt Forte, Brandon Marshall, Jermon Bushrod, Roberto Garza, Jeremiah Ratliff, Jared Allen, D.J. Williams or Tim Jennings are quitters.

I don’t think anyone else on the roster is either, but those players specifically are proud veterans who’ve won in the league before. Whatever issues they have right now, they will show up and fight.

Particularly crucial for the Bears will be whether Ratliff, who is listed as questionable because of a balky knee, can go. Not because he’s an ex-Cowboy looking for revenge, but because he’s that rare three-technique who plays the run as well as shoot gaps and penetrate into the backfield.

If the Bears are to win, defensive linemen Ratliff, Stephen Paea, Allen, Willie Young, Will Sutton and Ego Ferguson will have to play their best game of the year.

You probably have heard by now

the strength of this Cowboys team is the offensive line, led by Tyron Smith, Travis Fredericks and Zack Martin.

As good as running back DeMarco Murray has been, those guys are the biggest reason for his success. If the Bears veterans up front on defense can turn it into a street fight, they won’t stop Murray but can keep him from taking over the game.

That will be where Williams comes in. Knowing what the Cowboys want to do, it would be a mistake for the Bears to play as much nickel as they have to date, and the linebacker has the stuff to take the middle of the field away from Murray if given the chance.

Jon Bostic must play sound assignment football at weakside linebacker.

And I’d start Christian Jones over Shea McClellin at strongside linebacker. But if McClellin has the ability, this is the game to silence a lot of doubters.

Of course, that still leaves Cowboys receiver Dez Bryant, who right now is a better player than Bears receivers Marshall or Alshon Jeffery. Bryant is gong to make some plays.

Again, this is a game to flip the script. Kyle Fuller has been asked to be the Bears’ No. 1 corner since Charles Tillman went down, and he’s struggled.

If the Bears get Jennings on Bryant as often as possible, Jennings will lose a few, but I suspect he’ll win enough to stay competitive.

If you dare Cowboys quarterback Tony Romo to beat you, he usually can’t.

Defensively, the Cowboys come in just 22nd in total defense, 22nd vs. the run, 20th vs. the pass, 28th rushing the passer, 30th in third-down efficiency and 16th in points allowed.

The Cowboys’ best defensive player was LB Justin Durant, who went out for the season about five weeks ago.

Barry Church now leads them in tackles from the safety spot; but if the Bears turn Forte loose, the Cowboys have nobody to match him.

Dallas linebacker Rolando McClain will get my vote for Comeback Player of the Year, and he will make some splash plays tonight, but he’s not a guy who will run with Forte all night.

Defensive tackle Henry Melton is healthy, and I’m happy for him. But the truth is he really has been just average this year with five sacks, with only two tackles for loss and two passes batted down. Bears offensive guard Kyle Long should win that matchup.

The Cowboys come in sixth in the league in time-of-possession advantage; the Bears are 11th.

If the Bears will commit to Forte on the ground, stay with him and win that battle to keep Murray off the field, this becomes a winnable game.

Gould hurt; Bears sign kicker Feely

By KEVIN FISHBAIN kfishbain@chicagofootball.com With Robbie Gould’s status for Thursday night’s game against the Cowboys listed as doubtful, the Bears signed veteran kicker Jay Feely on Wednesday and waived/injured Chris Williams.

Gould missed Tuesday’s practice with a quad injury, and rookie punter Pat O’Donnell handled kicking duties during the practice. Gould last missed a game in 2012, when he missed three contests – his only absences since taking over as the Bears’ kicker in 2005.

Feely, 38, made 30 of 36 field goals last season for the Cardinals. He was 1 of 2 this past preseason before losing the competition to Chandler Catanzaro.

In his 13 NFL seasons, Feely has kicked for Atlanta, the Giants, Dolphins and Jets. He spent the past four seasons with the Cardinals and missed only one game from 2001 to 2013. Feely’s career field goal percentage is 82.7.

Of Feely’s 86 kickoffs last season, 33 were touchbacks. The Bears also might elect to use O’Donnell on kickoffs, because it is something he did in college.

Feely has kicked against the Bears four times but never at Soldier Field.

In his career in December, Feely has a rate of 83.2 percent on field goals.

Williams missed the past two games with a hamstring injury.

Marc Mariani has done well as the Bears’ returner in Williams’ absence and now will have the job to finish the season.

Blackhawks use three-goal third period to beat Blues

By JAY COHEN The Associated Press CHICAGO – Kris Versteeg scored 59 seconds into the third period, Patrick Kane added two more goals, and the Blackhawks beat the St. Louis Blues, 4-1, on Wednesday night for their fourth consecutive victory.

Marcus Kruger also scored for the Hawks, and Antti Raanta had 40 saves in his first start since Corey Crawford was sidelined by a left foot injury.

Versteeg also had the primary assist on each of Kane’s goals as the Blackhawks’ second line enjoyed another big performance.

Back at home after a 5-1 road trip, the Hawks killed off each of St. Louis’ six power plays and won for the seventh time in eight games.

Ian Cole scored in the second for the Blues, who had won

four of five. Jake Allen made 29 saves.

Martin Brodeur was the backup to Allen in St. Louis’ first game since the NHL’s winningest goalie signed a oneyear contract on Tuesday.

The line of Versteeg, Brad Richards and Kane has played a key role in the Blackhawks’ resurgence. Versteeg has four goals and 10 assists in his last eight games, and Kane has eight goals and seven assists in his last nine games.

Versteeg put the Hawks in front for good when he onetimed a pass from Jonathan Toews into the lower right side of the net for his eighth of the season. He then made a pair of nice passes to Kane to help the Blackhawks put the game away.

Kane beat Allen to the stick side at 2:47 of the third. He added his 12th goal when he made a

terrific move to get past defenseman Barret Jackman before sliding a shot between Allen’s legs at 5:19.

Crawford had made 14 consecutive starts, but he hurt his left foot when he missed a step while leaving a recent concert and is expected to be sidelined two to three weeks. Crawford said Wednesday he was embarrassed and frustrated, but declined to reveal any further details about what happened.

He said he is focused on returning quickly.

Crawford’s injury put Raanta in goal for the first time since he had 28 saves in a 3-2 loss at St. Louis on Oct. 25. It was just his fourth appearance of the season.

The Blues, trying for their third consecutive win, got off to a fast start, with Cole and Alex Pietrangelo shooting pucks off the post in the first 6:45.

Making peace with God and man Homer Glen dance/theater troupe adds Catholic spin to classic Dickens story

By SEAN LEARY Shaw Media Correspondent HOMER GLEN – Charles Dickens’ “A Christmas Carol” has long been a holiday favorite for its uplifting message of transformation and forgiveness. Now, a local theater group has added a spiritual spin to that classic tale of rebirth.

The Homer Glen-based Little Flowers Catholic Dance and Theater Troupe, a local traveling arts group that presents faith-based shows, is performing “The Conversion of Scrooge,” a Catholicism-infused retelling of the Christmas chestnut that retains its central plot and details but adds God into the mix, particularly in Scrooge’s reformation.

“The Conversion of Scrooge” will be performed at the Lemont High School Performing Arts Center this weekend for one show Saturday; it also will be at Plainfield’s St. Mary Immaculate Parish for two shows Dec. 14.

“The essence of the show is the same. The idea is that Scrooge is a horrible man who is a miser and self-centered, who has closed himself off from the world,” said Simonetta Pacek, the creator, producer and director of the play.

The biggest difference in the productions, Pacek added, is the conclusion.

“In the traditional show, he reconciles himself only with the world,” Pacek said. “In my show, he goes to church and also reconciles his life with God.” There also are little stylistic additions that lend it a religious feel as well, including a friend of Scrooge who is a priest who pops up at key moments throughout the show, most notably at the end, where he assists Scrooge in his conversion to a positive path.

His daughter, Grace, had been a part of Pacek’s dance troupe, so Sniegowski said he took the stage to pitch in, help make the show a reality and be involved in something with his family.

“I loved it,” Sniegowski said. “It was a lot of fun and a chance to share my faith with my acting. All of the time and effort was so worth it because of the positive messages of the show.”

Sniegowski then played a part in Pacek’s Christmas Nativity show. When Pacek had the idea to take on Dickens, Pacek said she knew Sniegowski would be “perfect” for Photos provided the part. Swollen legs and ankles have multitude of causes Dear Doctor K: Why are my legs and ankles swollen?

Dear Reader: Swelling of the legs from a buildup of extra fluid is known as edema. In addition to the swelling, the skin above the swollen area is stretched and shiny. Your doctor can easily check for edema by gently pressing a finger over your foot, ankle or leg with slow, steady pressure. If you have edema, you will see an indentation where the doctor pressed.

Swelling of the legs and ankles is usually not serious. However, it can be caused by diseases of the heart, lungs, liver and kidney.

Where does the extra fluid come from? About 60 percent of our body weight is from water. The water is in three “spaces.”

Most is in the space inside each cell. Some is in the space between our cells.

The rest is in the space inside our blood vessels and a few other locations. Water passes back and forth between these spaces.

The presence of edema means that there is more fluid than normal in the space between the cells.

Usually, this extra fluid comes from the fluid inside the blood vessels.

Edema of any cause is often worst in the legs and ankles.

When we’re sitting or standing, gravity pulls the water inside blood vessels downward. That raises pressure inside the blood vessels, which pushes water out into the space between the cells.

The two most common causes of leg and ankle swelling are (1) prolonged standing or sitting, especially in hot weather; and (2) weakness of tiny valves inside the veins of the legs. The weakened valves

ASK DOCTOR K Anthony L. Komaroff make it more difficult for the veins to pump blood back to the heart. As a result, water leaks out of the veins and into the space between the cells.

Pregnancy can cause edema in the legs. The baby and uterus press on the veins carrying blood from the legs to the heart.

Like weakened valves in leg veins, this causes water to leak out of the veins and into the space between the cells. Fluid retention during pregnancy also can be caused by a more serious condition called pre-eclampsia.

One serious cause of leg and ankle swelling in adults is congestive heart failure. When the heart is not pumping efficiently, some blood pools in the veins of the legs (again, because of gravity), and water leaks into the space between the cells.

Another cause is low protein levels in the blood, often the result of malnutrition or kidney and liver disease. This produces swelling not only in the legs and ankles but everywhere; puffy eyes and face are common.

A more serious cause of swelling in the legs and ankles, and in the face, is a seriously underactive thyroid gland.

Dear Abby: You mentioned in a recent column that few people write to follow up on what happened since their original letter was published. You printed mine April 1, 2001.

I am “Hurting in Houston,” the son who, with his partner, was suddenly no longer welcome in his parents’ home after they moved to a retirement community, because they were afraid their neighbors would shun them if they discovered they had a gay son.

You advised that I should live my own life and, maybe, someday they would come around – and that is what I did.

After a number of years, I received a call from a sibling informing me that my father was ill with only a short time left, and I should fly to their city to see him.

I asked if I was wanted, and he said, “It doesn’t matter, just come!” So I swallowed my pride, flew there and made my way to the hospice house.

Although my mother received me well, Dad did not, and we never had a good moment before he died a few days later. I told my mother I was staying for the funeral whether she liked it or not and had my partner fly in.

After the service there was a gathering at my mother’s house with all their friends. I introduced my partner to them and everyone was as kind as could be. Many mentioned their own gay siblings or relatives.

When the event was over, my mother said, “Wow, this has all been pretty silly, hasn’t it?” It was such a colossal understatement that I could not find words to respond.

Ten years have passed; my mother is now in hospice care with only a short time left.

We have built a great relationship, and she loves my partner of more than 20 years very much. We are glad to be able to be there

Much has changed in the world over these years and the acceptance of gays has been remarkable, but for me, having these last years with my mother’s love will be a comfort I can hold onto for the rest of my life.
