JOLIET – Police are seeking additional information about a fatal shooting Sunday.

“We are seeking the public’s help to identify any suspects in this homicide or any connection to other recent homicides,” Deputy Chief Al Roechner said Tuesday.

About 3:15 p.m., Terion D. Steward, 21, and his 15-yearold brother were walking near McDonough and Joliet streets when they were ambushed in a drive-by shooting. The car

was described as a dark-colored sedan.

Steward was hit twice and later pronounced dead at Presence Saint Joseph Medical Center. His brother was struck in the right foot and is expected to survive. Roechner said the teen did not provide any description of his attackers.

In January 2013, Steward was arrested after admitting to taking part in a gunfight in the 200 block of North Eastern Avenue. Steward reportedly called detectives and said he’d been shooting in self defense at a man on a nearby porch.

Steward pleaded guilty to aggravated unlawful use of a weapon and was sentenced to 18 months in prison, according to Will County court records. His conviction was later vacated after he spent 140 days in custody.

Steward’s slaying comes two weeks after Keon D. Kelly, 30, and Tariq J. Purnell, 17, were fatally shot in an ambush in the 400 block of Strong Avenue.

By LAUREN LEONE–CROSS lleonecross@shawmedia.com JOLIET – The City Council on Tuesday night approved a $279 million budget for next year, with a last-minute amendment to hire additional neighborhood police officers.

That means six more officers will join Joliet’s Neighborhood Oriented Policing Team next year, bringing the longstanding program closer to pre-recession levels. Two sergeants also will be hired, one for training and another to oversee the NOPT team.

District 1 Councilman Larry Hug suggested the addition of more officers. After the meeting, Hug said the police department headcount is still down about 45, but Tuesday night was a move in the right direction, considering the string of recent shootings across the city.

“Frankly, the homicides are far removed from the district I’m elected in, District 1, but again I look at the city as a whole,” Hug said. “Is this going to solve these problems? No, but it can go a long way.”

The $279 million budget – which calls for no tax or fee increases – anticipates about $163 million in revenue and $172.3 million in operating

expenses. The city is using about $8.7 million from its reserves to balance the budget, bringing reserves down to about $44 million, which keeps roughly two months worth of operating expenses on hand.

The city also included $600,000 in the budget for the Rialto Square Theatre.

Rialto board reappointments

The timing of Mayor Tom Giarrante’s reappointments for the Will County Metropolitan Exposition and Auditorium Authority – the Rialto Square Theatre’s governing board – came into question Tuesday night with the April mayoral election around the corner.

Giarrante had reappointments of Mary Babich, wife of Will County Board member Joe Babich, and Dan Vera, supervisor for Joliet Township, on Tuesday’s agenda. Babich and Vera have been on the WCMEAA board since 2001 and May 2014, respectively.

But Councilman Jim McFarland questioned the timing, and why a third board member, David Thorton, whose term expired back in 2009, wasn’t also on Tuesday’s agenda. Board members are appointed to the board for five-year terms – four by the mayor and three by the Illi-

nois governor. Babich’s term expired in 2004, McFarland said.

“Is there any reason why we cannot delay these until after the April election? My only concern is that we’re approving these for a five-year term when they could have been approved long before,” McFarland said.

Giarrante said Vera asked him to be reappointed, and Babich’s reasoning was “personal” and agreed to discuss the issue in closed session.

Outside of closed session, the reappointments were then approved, with Hug abstaining, and Bob O’Derkirk, a mayoral candidate for 2015, voting against.

“I personally like Ms. Babich and Mr. Vera ... I’ve seen them work on the board and I know they have a passion for the Rialto,” O’Dekirk said.

“But I have issues with the timing, with the politics of this.”

The reappointments comes on heels of controversy surrounding the Joliet theater’s new marquee design. Many residents have criticized the new design, first unveiled last month, saying it doesn’t fit with the character of the 88-year-old building and that the space devoted to honor the donor’s parents is too prominent.

Bolingbrook police take kids out to ‘Shop With a Cop’

“It was awesome. He let me take my time going [through the store],” said Carson O’Connell, 9.

The pair made their way through jewelry, office supplies, sporting goods and video games without reaching their spending limit.

Cops and kids paired up for the 16th annual “Shop With a Cop” event in Bolingbrook.

For the past seven years, Meijer has hosted the activity, which provides 100 students in the Valley View School District with $50 gift cards and a police escort through the store.

“Shop With a Cop” is an outreach program used by police departments throughout Illinois and in other states each Christmas. Other local departments that take kids shopping for Christmas gifts each year include Joliet, New Lenox and Shorewood.

Lt. Mike Rompa said the Bolingbrook Police Department asks the Valley View district to identify both students with financial needs, and those with outstanding academic performance and good behavior.

“We pick the students at random and ask the district to rotate the [potentials] each year. One hundred kids sounds like a lot, but when you look at our population, it’s only a small dent,” Rompa said.

Forty-five officers signed up to take the kids through the store, while 20 teens in the Explorer program volunteered to wrap gifts.

“The girls seem to have experience wrapping, while the guys just put more tape on.

It’s a ball of plastic by the time they’re done with it,” Officer Michelle Geier joked.

“It lets them realize officers are just regular people ... moms and dads. This year that’s more important than ever,” he said.

While the event has run smoothly over the years, there have been attempts from adults who weren’t invited to obtain gift cards.

But despite the occasional disappointment, Rompa said “the positives far outweigh the negatives.”

Block said it was heartening to see Carson was more interested in buying gifts for

his relatives than picking out things for himself.

“I work the night shift and really don’t get the chance to interact with as many kids,” Block said. “He was a little shy, but he opened up as we went along. I think we found we like some of the same things.”

Kori O’Connell said while her son wasn’t “afraid” of the police, he wasn’t used to seeing them in a relaxed setting either.

“He’s only seen them if something bad happened in the neighborhood. This can show him they’re not scary and I think they both get something out of that,” she said.

Another fast-food restaurant robbed Police investigate third robbery since Dec. 9

JOLIET – Two men robbed a Subway Tuesday, the third time in little more than a week that a fast-food restaurant was hit during daylight hours.

Deputy Chief Al Roechner said the robbery occurred at 8:56 a.m. while two employees and one customer were in the restaurant at 1710 Jefferson St. “Two suspects came in. One of them lifted his shirt to show he was carrying a handgun.

They took cash [from the register] and fled,” Roechner said.

Roechner said Tuesday detectives were investigating if the hold-up had any connection to two other recent robberies at fast food restaurants. About 2:30 p.m. on Dec. 9, a man came into Burrito Loco, 315 E. Cass St., showed employees he was carrying a handgun and demanded money.

About 10:15 a.m. Dec. 10, a man came into Taco Bell, 125 S. Larkin Ave., and demanded employees open the safe. The suspect fled in a tan or gold car, according to police reports.

No one was injured in either of those robberies, either.

Appellate court rules reporter does not need to reveal source

By FELIX SARVER fsarver@shawmedia.com JOLIET – Appellate court judges have reversed a lower-court decision ordering a Patch editor to divulge the source of a leak in a Joliet murder case.

Joseph Hosey, Patch editor and former Herald-News reporter, will not have to reveal the source of confidential police reports used last year to write a series of articles on the Hickory Street murder case that left two dead and four charged in the grisly double-homicide.

Last year, Hosey was found in contempt of court by Will County Judge Gerald Kinney for not complying with an or-

der to disclose who gave him the police reports. Hosey’s attorney, Ken Schmetterer, appealed to the Illinois Appellate Court, arguing Hosey is protected under the state’s shield law.

On Dec. 3, Third District Appellate judges in Ottawa heard arguments from Schmetterer and Neil Patel, attorney for Bethany McKee, one of the four defendants in the Hickory Street murder case.

Patel argued McKee’s fair-trial rights were violated because Hosey’s articles added to pre-trial publicity and potentially prejudiced jurors.

At issue for the appellate court judges was how Hosey obtained the police reports and whether the identity of

Hosey said he thought the court made the right decision.

“I appreciate all the support from different media outlets … as well as from the public,” Hosey said.

Patel said he was disappointed with the decision, but he is exploring options to further appeal the case or seek a re-hearing.

He said Hosey can report on whatever materials he receives, but Patel’s issue was the method of the reporting.

He had materials he should not have obtained, and whom-

ever gave them to him did something wrong, he said.

“Depending on who did it ... our opinion was that could have serious impacts on [McKee’s] ability to have received a fair trial,” Patel said.

In recent months, McKee and Joshua Miner were convicted in the killings of 22-year-olds Terrance Rankins and Eric Glover Jr., which occurred Jan. 9, 2013. Alisa Massaro pleaded guilty to robbery and concealing a homicide in exchange for testifying against the others.

A fourth defendant, Adam Landerman, is awaiting trial.

On Monday, the Third District Appellate Court reversed Kinney’s decision.

“Because the identity of Hosey’s source cannot be said to relevant to a fact of consequence to the first degree murder allegations, we hold that the circuit court erred when it granted the motion for divestiture,” the judges stated in their ruling.

Plainfield school board member leaving for new job PLAINFIELD – The Plainfield School District 202 School Board will be down a member after Board Member William Dargan tendered his resignation Monday.

Dargan’s resignation will be effective Wednesday, Board President Roger Bonuchi said. “[Dargan] has been a good contributor as a school board member with his business

experience and experience being involved in athletics boosters,” Bonuchi said. “We’re at a loss that he is William leaving.”

Dargan The board will have 45 days after Wednesday to appoint someone to Dargan’s seat, which still has more than two years left until it’s up for re-election, Bonuchi said. Dargan was elected to

the board for the first time in 2013, to a four-year term.

Dargan said he needs to move to Florida for his new job at Synder’s-Lance Inc., a snack food company. Dargan previously worked with Hostess Brands LLC. “I liked working to make

the education process better for all the kids in Plainfield,” Dargan said.

On the district’s contract negotiations with teachers, Dargan said it was important to put a contract in place that doesn’t force the board to make big cuts in the long run.

No injuries in house fire

Lockport Township Fire Chief Dave Skoryi said crews were called at 12:17 p.m. to the 1800 block of Shoreline Court in Romeoville and found fire in a room on the second floor.

Skoryi said the fire was

contained to the second floor, but the house suffered “smoke damage.” Romeoville and Plainfield firefighters assisted Lockport Township firefighters at the scene.

One man who’d been in the house was treated by ambulance crews, but refused transportation to the hospital, Skoryi said. The cause of the fire was under investigation.

By VIKAAS SHANKER PLAINFIELD – Plainfield is moving forward with a plan for tax incentives to spur development in the Route 30 corridor.

The Village Board on Monday authorized an eligibility study to determine if tax increment financing could be used to redevelop Route 30 from Renwick to Spangler roads.

Trustees also approved spending about $1.05 million for the village’s portion of a joint Route 30 project with the Illinois Department of Transportation.

Wilson said the technology that will be used at the Joliet bridges is not new.

“I think the future is coming and I think we are not right

“We met with the superintendent of schools and taxing jurisdictions that are impacted by the creation of a TIF,” Village Administrator Brian Murphy said. “There is general agreement that this is an area where TIF would make very good sense. And there is strong support for the project to go forward.”

The board authorized Murphy to execute a $78,200 contract with SB Friedman Development Advisors to complete the TIF eligibility study and take other measures needed before the incentives can be approved for the U.S. 30 corridor.

Trustee Margie Bonuchi said the Route 30 corridor is one of the key locations in the village, with direct access to Interstate 55.

“There are open parcels of land, areas that need improvement all around,” Bonuchi said.

Public Works Director Allen Persons said some improvement will come with the $32.9 million Route 30 improvement project, including a bike path, sidewalks and upgraded water and sewer lines.

Persons said the project would cost the village a little more than $1 million. Federal agencies would pay $25.6 million and the state organizations would pay $6.1 million.

The TIF eligibility study was approved in a 4-1 vote.

Trustee Paul Fay voted against the study, saying he did not think there was enough land to warrant a TIF district.

He also said a TIF is a questionable way to spur development in the Route 30 corridor.

maintenance engineer, said a study was conducted 10 years ago and determined the project was feasible. At the time, the estimated cost was $6 million.

The project entails installing fiber-optic cables and cameras, which would be used to move bridge tenders off individual bridges and to a central location at the IDOT facility on Bridge Street. Each bridge would have 14 closed-circuit television cameras. There also would be a boat detection system, backup networks and radio links to each bridge.

Wilson has said the project could begin next fall and finish by late 2017. But each bridge would come online one at a time, she said at Tuesday’s meeting.

JOLIET – Residents, elected officials and waterway workers got a closer look at a plan to change how Joliet bridges are controlled.

The Illinois Department of Transportation is spearheading a project to centralize operation of six bridges in Joliet to a combined station between the Ruby and Jackson street bridges.

In partnership with the U.S. Coast Guard, they held a public meeting on their plans Tuesday at Joliet City Hall, where some attendees raised questions about the costs and safety of the project.

The public meeting came at the request of the Coast Guard.

IDOT needs Coast Guard approval to move forward with the project.

IDOT officials say the total cost of the project will be an estimated $10.3 million, which concerned Walter Martin of Coal City. He said the state is in bad financial shape with pension issues.

“You want to spend more money that necessarily does not need to be spent,” Martin said.

A: Many clients inform me that avoiding probate is a primary concern or goal in their overall estate plan. Putting aside the question of whether probate truly is the “absolute evil”it is perceived to be (believe it or not, there are certain advantages to probate), for various reasons I always discourage adding children or other non-spouse relatives as joint tenants on bank accounts, investment accounts and real estate. Adding a non-spouse as a joint tenant on property is the equivalent of making a cash gift to the individual, which may require the filing of a federal gift tax return. Depending on the value of the property and the overall size of your estate, adding a non-spouse on title may reduce the amount of property you can pass to your heirs free of the

federal estate tax. In addition, if your new joint tenant becomes disabled, it may be necessary to institute guardianship proceedings in order to manage or dispose of the asset. Finally, if your new joint tenant encounters problems with creditors, is an unsuccessful party to a lawsuit, voluntarily/involuntarily files for bankruptcy, or faces divorce proceedings, then your asset could become subject to the claims of those creditors.

For these reasons, if avoiding probate is a crucial goal in your overall estate plan, you should consider the alternatives to joint tenancy, which include utilizing a funded estate plan trust, a land trust at your local bank or trust company, establishing“payable on death” or“transfer on death”accounts naming your intended recipient(s) as beneficiary.

In addition, the recent Transfer on Death Instrument Act may be appropriate for your particular situation.

Personally, I have just been appointed by the Illinois Supreme Court to the Supreme Court Committee on Illinois Pattern Jury Instructions. In personal injury and other civil trials, at the end of hearing all the evidence the judge instructs the jury as to the law so that they can apply the law to the facts and reach a verdict. His instructions aren’t pulled out of the air, but rather are for the most part pattern jury instructions which have been developed by this Supreme Court Committee. I am very honored both because the Supreme Court choose me, based on my many years of experience in complex civil cases, and because I am following in the footsteps of my neighbor and fellow personal injury attorney, Laird Ozmon, who is an excellent attorney.

As far as the Illinois Worker’s Compensation Commission goes, the chairman has resigned, and there will be a new chairman to be appointed by our incoming governor. We also have four Commissioners up for reappointment in January. While both business and labor may have quarrels with the particular laws that apply to workers’ compensation cases, I don’t think either side would dispute that for the most part, since correcting some mistakes in 2011, the personnel, being Commissioners and Arbitrators have been good people, some coming from a business background and others from a laborer background. Overall these people have done a good job. It would be good have to have them reappointed, but we will just have to wait and see.

12 Romeoville man charged

with child pornography THE HERALD–NEWS

ROMEOVILLE – A Romeoville man asked a 15-year-old girl to send him naked pictures of herself, police said.

Johnny Cura, 37, of the 200 block of Haller Drive, was arrested on three counts of child pornography Monday and booked into the Will County jail, according to the Will County State’s Attorney’s Office.

Cura’s arrest is the result of an ongoing investigation by the Will County High Technology Crimes Unit. According to reports, Cura told the victim, who lives in another state, to take and send photographs of herself in lewd positions during text chats.

Cura faces four to 15 years in prison if convicted on each count. He is being held on $1.5 million bond.

The investigation was a joint initiative that also involved the Illinois Attorney General Internet Crimes Against Children Task Force,

Will County sheriff’s computer forensics team and the Romeoville Police Department.

“I want to issue a wake-up call to concerned parents to vigilantly monitor the online activities of their children,” Will County State’s Attorney James Glasgow said in a statement. “Predators are combing the Internet seeking vulnerable children. They use personal computers, tablets and cellular phones to connect with apps and social networking sites like Facebook, KIK and Skype that enable them to target victims.

“Parents should never underestimate the vulnerability of their children when they are online. In some instances, these predators use persuasion,” Glasgow added.

“In other cases, they utilize threats and intimidation to coerce victims into taking lewd photographs and videos of themselves. The harm they can cause to our children is immeasurable.”

Channahon holds tax rate steady Expects less revenue because of decline in property values

By JEANNE MILLSAP Shaw Media correspondent CHANNAHON – The Channahon Village Board will keep the tax rate the same and expects to bring in less revenue from property taxes.

Presented with two property tax levy choices, the board Monday chose to keep the tax rate the at 0.748 per $100 of equalized assessed valuation – rather than raising the levy to bring in the same amount of

revenue as last year.

Equalized assessed value estimates from Will and Grundy counties have decreased again for the fifth year in a row. Finance Director Heather Morandi said the EAV suggests a reduction in local property value of $15.7 million, or 5.55 percent.

If trustees had chosen to keep revenue the same as last year, the tax rate would have risen to 0.787, increasing the amount of the village’s portion

of property tax bills by $26 for the owner of a $200,000 house.

Trustee Mark Scaggs said keeping the tax rate the same would mean the village would have to come up with another $103,000 to match last year’s revenue, but taxpayers would not pay more.

Village President Joe Cook said that not only did the EAV decrease this year, but the village will see a decrease in revenues from other sources.

By JEANNE MILLSAP Shaw Media Correspondent CHANNAHON – Teachers in Channahon District 17 will get 5 percent pay increases in each of the next five years under a new contract.

The school board Monday approved the deal by a 6-0 vote, with one board member, Jim Bogacz, abstaining because his wife is a district teacher.

Earlier Monday afternoon, Channahon Teachers Local 604 ratified the contract by a 61-0 vote. The new contract will begin with the 2015-16 school year.

“We were looking for a fair contract, and we got this done in three sessions,” said Bill Stonich, co-president of the teachers union. “They were pretty receptive to what we brought to the table.”

School Board President George McCoy said the negotiating process went well.

“I think there was good discussion,” he said after the meeting. “We’re happy with what [the teachers] are doing. It was a collaborative effort on both sides.”

The five-year contract also adds two sick days and one institute day. Insurance contributions and course reimbursement will remain the same.

Stipends for leading extracurricular activities were increased. An initial lump sum of $25,000 was added to the stipend pot for the first year. The last four years of the contract will provide 3 percent increases per

Superintendent Karin Evans said the extra institute day for professional development was added because of many new responsibilities given to teachers, including testing and Common Core academic requirements.

She said the increases in salary and stipends were the result of data presented to the board of comparative area salaries.

“It was based on data and comparison with benchmark districts,” she said.

Fees and taxes

The board Monday also discussed whether to reduce or eliminate registration fees for students. They also talked about whether to reduce band, lunch and graduation fees.

The board plans to vote on proposed fee changes in January.

The board also adopted the district’s 2014 property tax levy of $17.39 million, which is $89,000 less than last year’s levy.

dent population, and teaching positions are being reduced by attrition.

Board member Derek Breen proposed eliminating registration fees last year and brought up the issue again at the November board meeting.

Parents of early childhood students currently pay $70 in registration fees at the beginning of each school year.

Fees for kindergarten through seventh grade are $135, and eighth-graders pay $170, with the extra going toward graduation fees.

Band fees are $50, and lunch is $2.30 a meal. Last year, interscholastic fees were reduced to $15 and intramural fees were eliminated last year.

“This board has been very financially responsible,” Evans said, “and they’ve done a fantastic job at watching the tax rate. ... Our financial condition is pretty healthy.”

Registration fees go toward textbooks, workbooks, technological supplies and other expenses. Those expenses have not risen for nine years, Evans said.

Although no vote was taken, the board consensus appeared to be the $135 registration fee could be eliminated, with eighth graders paying the $35 for graduation expenses.

Members did not favor total elimination of band fees, but there was a suggestion to reduce them from $50 to $15. The board also leaned toward keeping lunch fees as they are.

“The other advantage is that with the da Vinci system we have something called Firefly technology,” Bass said. “It

allows us to fluoresce anything that has bile in it. As we dissect we can better identify the structures. Any time we can improve safety with better visualization of anatomy is a plus.”

The surgery typically requires less than an hour, on an outpatient basis, with little post-op pain and discomfort, said Bass, who has been performing robotic surgery for three years.

“We’ve had excellent results,” he said. “This technique is very effective and very safe.”

Bass stressed that there is no robot conducting surgery in robotic surgery.

“There is no artificial intelligence,” he said.

The surgeon uses a console to manipulate instruments and the system translates the surgeon’s movement directly to the instrumentation inside the patient.

“It’s like conventional surgery, but the mode of surgery is different,” Bass said. “This is the most advanced mode of surgery providing great benefits for the patient.”

SYREETA CAMPBELL Syreeta Renee Campbell “Re,” age 33, passed away suddenly on December 7, 2014.

A lifelong resident of Joliet. Syreeta graduated from Joliet West High School in 1999, and was employed for many years with Trinity Services.

Preceded in death by her grandfather, Willie Campbell, Sr.; stepfather, Tony Woods; and grandparents, Mildred and Damos Knight.

She is survived by her two loving sons, of whom she loved unconditionally, Davarius and Delveon Gadson; devoted parents, Kimalene (nee Campbell) Woods and Christopher Knight; her loving sister and brothers, Kenneth Campbell, Anthony, Tiara and Antwione Page; stepsisters, Schwoan Stepney and Quiona Woods; special aunt and uncles, Barbara King, Verdis Tyler and Willie Campbell (Denise); maternal grandmother, Teattie Bee Campbell, who shared a bond with Ree that was without measure; paternal grandmother, Marie Knight; maternal great aunt, Ethel B. Rich is survived by his beloved wife, Jodi (nee Snyder); loving children, Jenni (Vern) Smith, Jessi, Jerry, and Jacob Daniels; three cherished grandchildren, Nathan and Riley Smith, and Zachary Schweitzer Jr.; dear sister, Gina Cimino-Boggs; as well as numerous nieces, nephews, and cousins.

Rich was a long time plumber with Local #422 and Will County Land Use Department. He was an avid fisherman, hunter, and NASCAR fan. His greatest joy was watching his grandson, Zachary. Richard will be greatly missed by his family and friends.

A Celebration of Rich’s life will begin on Friday, December 19, 2014, with prayers in the funeral home chapel at 9:00 a.m., then driving in procession to St. Joseph Catholic Church in Manhattan, for a Mass of Christian Burial to be held at 10:00 a.m. Interment to follow at Woodlawn Memorial Park.

Helen is survived by her loving husband of 69 years, Joseph D’Atri; one son, Frank (Lana); and one grandson, Justin (Rahel).

Helen was born and raised in Joliet and graduated from Joliet Township High School. In her early years she worked for U.S. Steel and Wire as well as an ammunition plant. She was also a member of the Croatian Cultural Club and the American Legion. Helen was a lifelong member of St. Mary Nativity Catholic Church in Joliet. She will be dearly missed.

Mardeen “Nonie” Berta, age 91 and a lifelong resident of Coal City, passed away peacefully, Monday December 15, 2014, at Park Pointe Morris Senior Living.

Born July 2, 1923, in Coal City, Margaret Aldeen was a daughter of the late Charles and Margaret Borella Boggio. She was raised and educated in Coal City where she graduated from Coal City High School. On May 12, 1946, Mardeen married Bernard “Barney” Berta at Assumption Catholic Church in Coal City.

Mardeen was an active member of Assumption, where she served as a liturgist, lector, Eucharistic minister, minister of care, funeral organist, was a member of the choir and the hand bell choir and served as chairman of committee. She was also known for her wonderful Italian cooking; being an avid Chicago Cubs fan, and for her passion for music. Not only would Mardeen and Barney attend the Chicago Symphony where they held season tickets, but they treasured playing and singing music together with their children.

Survivors include her four children, Michael (Cindy) Berta and Charlie Berta, both of Coal City, Mary Jean (Dave) Tures of Little Rock, AR and Amy (Keith) Giordano of Morris; ten grandchildren, Jason (Colleen) Berta of Coal City, Todd (Cara) Berta of Saint Louis, MO, Teresa (John) Gallis of Durham, NC, Jenny (Ryan) Petersen of Kalispell, MT, Matthew (Callie) Tures of Conway, AR, Joshua, Megan, Anna, and Kristen Tures, all of Little Rock, AR and Alex Giordano of Morris; eight great grandchildren, Nicholas, Brant, Keaton, Thad, Addison, Grace, Margaret and Jeremiah; sister-in-law, Jessica Brandt of Gardner; brother-inlaw, Gordon Palmberg of Thomasboro, IL and numerous nieces and nephews, including Lynne Brooker, Karen Kessler, Jayne Becker, Dr. John Roberts, and Gail Quillman who was especially devoted to her godmother.

He is survived by two sons, Paul (Deborah) Huettemann of Channahon and Don (Cindi) Huettemann of White Salmon, WA; 4 grandchildren; 6 great-grandchildren; 4 step-grandchildren; and 8 step great-grandchildren.

He was preceded in death by his wife, Edith May Huettemann on December 20, 2008; one son, David Huettemann; and one brother, Melvin Huettemann.

June married the late Glenn Nagel in 1997 at St. John.s United Church of Christ, Peotone, IL. Glenn died in 2005.

June is survived by her son, Ralph (Elaine) Lauffer of Fort Collins, CO; two grandchildren, Darin (Stephanie) Lauffer of Fort Collins and Sharon (Jeremy) Marburger of Wellington, CO. Rauner: Agencies will be asking for $760 million extra

SPRINGFIELD – Illinois’ Republican governor-elect said Tuesday he’s learned state agencies are planning to ask him for at least $760 million more than they originally were given to spend in 2015, but he declined to indicate how he’d address those requests once he’s sworn in – or when.

“They’re now saying, ‘We’re calling in the chip. We want the money now,’ ” Bruce Rauner told attendees at a Better Government Association luncheon in Springfield of conversations with agencies that he said are on pace to spend more than they were allotted.

At issue is the state’s $35.7 billion budget approved by lawmakers in the spring, which Rauner on Tuesday called “intentionally misleading,” as well as “disgusting” and “wrong.”

The plan didn’t provide enough money to cover agency expenses, as lawmakers originally planned to return to session after the November election to debate whether to fill a roughly $2 billion revenue gap by extending the state’s temporary income tax increase, set to roll back Jan. 1. But lawmakers in the Democratic-led Legislature abandoned those plans following Rauner’s victory, noting they were heeding the governor-elect’s request not to take up any “substantive” issues until his inauguration.

As Rauner has said his transition team is “finishing its homework” on the budget and wouldn’t be “discussing any recommendations” until the new year, state agencies – caught between the transition between governors – are

grappling with the possibility of having to halt operations in the coming months.

Warnings of impending shutdowns at the Department of Corrections and Department of Human Services if additional funding isn’t approved came in reports issued this fall from the state of Illinois and the Civic Federation of Chicago, noting the current budget is short of providing funding to maintain existing programs and operations, including payrolls.

City of Chicago releases youth violence report

CHICAGO – The city of Chicago has released a report with 28 recommendations to address the city’s youth violence problem.

Mayor Rahm Emanuel and the Mayor’s Commission for a Safe Chicago released the report Tuesday. The recommendations include adding eight “peace rooms” in Chicago public schools for conflict resolution and connecting families with counseling.

This is the commission’s first report. It was written after three forums held over the summer attended by government representatives, faith groups and community organizations. The commission also sought out opinions from about 200 young people in more than a dozen Chicago communities.

State-grant fraud case in hands of federal jury

SPRINGFIELD – A multimillion-dollar state-grant fraud case is in the hands of a federal jury.

Defense attorneys argued Tuesday that Chicago businessman Leon Dingle Jr. and his wife, Karin, were unaware their trusted bookkeeper was stealing Illinois Department of Public Health grant money intended for AIDS and cancer awareness.

conspiracy, mail fraud and money laundering. Authorities said they stole $3.4 million out of $11 million in grant money issued from 2004 to 2007.

Defense attorney Ed Genson says the Dingles’ failure was trusting employee Jacquelyn Kilpatrick, who stole $1 million and has pleaded guilty.

Assistant U.S. Attorney Tim Bass countered in a rebuttal closing argument that it’s absurd to believe the Dingles were in the dark about the rampant fraud.

The jury will begin deliberating Wednesday.

Unions sue to stop Chicago pension overhaul law

CHICAGO – Current and retired city workers and their labor unions have filed a lawsuit arguing a law overhauling Chicago’s pension systems is unconstitutional.

The lawsuit, filed Tuesday in Cook County Circuit Court, also asks a judge to stop the law from taking effect Jan. 1.

Chicago has the worst-funded pension system of any major U.S. city.

Legislation approved last year seeks to eliminate a $9.4 billion unfunded liability in two pension systems by increasing contributions and cutting benefits. It would affect about 57,000 laborers and municipal

employees.

The plaintiffs are 12 current and former workers and four unions, including AFSCME Council 31 and the Illinois Nurses Association.

Mayor Rahm Emanuel said the law is constitutional. He said the changes are needed to ensure pension funds remain solvent and retirees receive benefits.

Officials offer tax form notification signup online

CHICAGO – State officials said anyone who collected unemployment insurance this year can sign up to be notified when a tax form needed to complete state and federal tax returns is available.

The 1099G form is needed to complete tax returns and is available for the last seven years. Unemployment insurance benefits are subject to taxes.

The Illinois Department of Employment Security said there’s an online signup to be notified in January when the forms are available. Registrants will be sent an emailed notice in January with further instructions.

State officials said the online program saved the department hundreds of thousands of dollars in postage and paper.

NEW YORK – Hackers calling themselves Guardians of Peace made ominous threats Tuesday against movie theaters showing Sony Pictures’ film “The Interview” that referred to the terrorist attacks of September 11, 2001.

The group also released data files including about 8,000 emails from the inbox of Sony Entertainment CEO Michael Lynton.

The data dump was what the hackers called the beginning of a “Christmas gift.” But the group included a message warning people to stay away from places where the film will be shown.

Invoking 9/11, it urged people to leave their homes if located near theaters showing the film.

The Department of Homeland Security said there was “no credible intelligence to indicate an active plot against movie theaters,” but noted it still was analyzing the messages.

“The Interview” is a comedy starring Seth Rogen and James Franco as TV journalists involved in a CIA plot to assassinate North Korean leader Kim Jong Un.

OAKLAND, Calif. – A federal jury decided Tuesday that Apple didn’t compete unfairly when it sold music players and songs with copy-protection software that was incompatible with rival devices and music from competing online stores.

a victory by rejecting a claim from attorneys for consumers and iPod resellers, who were seeking as much as $1 billion in a class-action lawsuit. The plaintiffs argued Apple was able to overcharge consumers for iPods by making it difficult to switch to a rival music player, as music bought from Apple’s iTunes store wouldn’t work on other players, nor would music from other stores work on iPods.

The jury accepted Apple’s argument that the software provided necessary security protection and was part of a larger package of improvements to make iPods and iTunes popular.

Family sues over fatal shooting at Ohio Wal-Mart CINCINNATI – The family of a black man fatally shot by a white police officer as he held an air rifle inside a Wal-Mart filed a federal lawsuit Tuesday charging negligence and violation of the man’s civil rights.

The lawsuit was filed in U.S. District Court in Dayton against the city of Beavercreek, the two Beavercreek officers involved, the police chief and Wal-Mart.

John Crawford III was shot Aug. 5 inside the store. Police responded after a 911 caller reported Crawford was waving what appeared to be a firearm.

A grand jury concluded the shooting was justified.

End game: No immigration deal, just continued divisions

By ERICA WERNER The Associated Press WASHINGTON – A Congress that began with bright hopes for immigration legislation is ending in bitter divisions on the issue even as some Republicans warn that the political imperative for acting is stronger than ever for the GOP. In place of a legislative solution, President Barack Obama’s recent executive action to curb deportations for millions here illegally stands as the only federal response to what all lawmakers agree is a dysfunctional immigration system. Many Democrats are convinced Latino voters will reward them for Obama’s move in the 2016 presidential and Senate elections, while some Republicans fear they will have a price to pay.

“If we don’t make some down payment toward a rational solution on immigration in 2015, early 2016, good luck winning the White House,” said Republican Sen. Lindsey Graham of

South Carolina, an author of the comprehensive immigration bill that passed the Senate last year with bipartisan support but stalled in the GOP-led House.

With the expiration of the 113th Congress this month, that bill officially will die, along with its path to citizenship for the 11 million immigrants in this country illegally.

Immigration is certain to be a focus for the new, fully Republican-led Congress when it convenes in January – but there’s little expectation the GOP will make another attempt at comprehensive reforms.

Instead, GOP leaders in the House and Senate have pledged to take action to block Obama’s executive moves, setting up a battle for late February when funding expires for the Department of Homeland Security, which oversees immigration matters. House Speaker John Boehner, R-Ohio, has promised action on a border security bill as part of that.

Whether Congress can

do anything to stop Obama remains unclear, since he’s certain to veto any effort to undo his executive moves.

It’s also not clear lawmakers could pass a border bill, or that Obama would sign it if they did.

While some congressional Republicans are arguing for action on piecemeal reforms, most advocates are resigned to wait until a new president takes office in 2017 for lawmakers to make another attempt at a comprehensive overhaul that resolves the central immigration dilemma – the status of the millions here illegally.

“They had the best chance in a generation, and they couldn’t get enough support from the Republican caucus,” said Frank Sharry, executive director of America’s Voice, an immigrant advocacy group.

“It may well be that they’re going to have to lose the White House and both chambers of Congress for us to get comprehensive immigration reform,” Sharry said.

ALEXANDRIA, Va. – A New York Times reporter will be subpoenaed to answer questions ahead of an upcoming trial of a former CIA officer accused of leaking classified information, although a Tuesday hearing indicated there is much confusion about what the journalist may be asked to reveal.

Prosecutors said they will not ask James Risen if ex-CIA man Jeffrey Sterling was his anonymous source for part of the 2006 book “State Of War” that detailed a botched CIA effort to cripple Iran’s nuclear program. But they do want to know if the two had a prior, onthe-record source relationship.

Risen’s lawyer, Joel Kurtzberg, said at Tuesday’s hearing he is not sure if his client is willing to answer the questions prosecutors want to pose.

And defense attorneys indicated they may have their own questions, which puts Risen at risk of being found in contempt of court if he refuses to answer.

U.S. District Judge Leonie Brinkema ordered a moot hearing of sorts to be held next month, ahead of Sterling’s trial, to test what questions will be asked, what Risen will answer, and what questions the judge will deem relevant. Brinkema said Risen will be subpoenaed and required to attend the January hearing.

Risen has been unwilling to testify in the case about anything but most basic facts – such as confirming he is the author of the book and he stands by its reporting – saying he made a commitment to his sources to protect their anonymity. Sterling’s case has been held up for more than three years as courts have decided whether Risen would be required to testify. A federal appeals court in Richmond ordered that Risen can be compelled to testify just like any other citizen, and that his role as a journalist does not shield him from a subpoena.

Taliban assault on school in Pakistan leaves 141 dead

By RIAZ KHAN and REBECCA SANTANA The Associated Press PESHAWAR, Pakistan – In the deadliest slaughter of innocents in Pakistan in years, Taliban gunmen attacked a military-run school Tuesday and killed 141 people – almost all of them students – before government troops ended the siege.

The massacre of innocent children horrified a country already weary of unending terrorist attacks. Pakistan’s teenage Nobel Peace laureate Malala Yousafzai – herself a survivor of a Taliban shooting – said she was “heartbroken” by the bloodshed.

Even Taliban militants in neighboring Afghanistan decried the killing spree, calling it “un-Islamic.”

If the Pakistani Taliban ex-

tremists had hoped the attack would cause the government to ease off its military offensive that began in June in the country’s tribal region, it appeared to have the opposite effect.

Prime Minister Nawaz Sharif pledged to step up the campaign that – along with U.S. drone strikes – has targeted the militants.

“We will take account of each and every drop of our children’s blood,” Sharif said.

Taliban fighters have struggled to maintain their potency in the face of the military operation. They vowed a wave of violence in response to the operation; but until Tuesday, there has only been one major attack. Analysts said the school siege showed even diminished, the militant group still could inflict horrific carnage.

Horror over Sydney siege turns to anger

By KRISTEN GELINEAU The Associated Press SYDNEY – Horror over a deadly siege morphed into anger Tuesday as leaders of a grieving nation demanded to know how a man with a violent criminal history slipped through the cracks and ended up in the downtown Sydney cafe where he took 17 people hostage.

The 16-hour siege ended in a barrage of gunfire and screams early Tuesday morning when police stormed into the Lindt Chocolat Cafe in a desperate bid to free the hostages. Two of the hostages were killed, as was the gunman, Man Haron Monis, a 50-year-old Iranian-born, self-styled cleric described by Australia’s prime minister as a deeply disturbed person carrying out a “sick fantasy.”

“How can someone who has had such a long and checkered history not be on the appropriate watch list? And how can some-

one like that be entirely at large in the community?”

Prime Minister Tony Abbott asked at a news conference.

“These are questions we need to look at carefully and calmly and methodically.

That’s what we’ll be doing in the days and weeks ahead.”

Monis was convicted and sentenced last year to 300 hours of community service for sending what a judge called “grossly offensive” letters to families of soldiers killed in Afghanistan between 2007 and 2009. He later was charged with being an accessory to the murder of his ex-wife. Earlier this year, he was charged with the 2002 sexual assault of a woman. He had been out on bail on all the charges.

That history prompted a flurry of questions a day after the siege began Monday morning. Why was Monis out on bail? Why was he not on a terror watch list?

How did he get a shotgun in a country with tough gun ownership laws?

Public School and College began in the morning when seven militants scaled a back wall using a ladder, a military spokesman. When they reached an auditorium where students had gathered for an event, they opened fire.

A 14-year-old, Mehran Khan, said about 400 students were in the hall when the gunmen broke through the doors and started shooting. They shot one of the teachers in the head and then set her on fire and shouted “God is great!” as she screamed, added Khan, who survived by playing dead.

They then went to other parts of the school. Of the 141 people slain before government troops ended the assault eight hours later, 132 were children and nine were staff members.

Another 121 students and three staff members were wounded.

Morris uses late rally to edge Lockport

By CURT HERRON cherron@shawmedia.com LOCKPORT – Things weren’t looking especially good for Morris’ basketball team after it fell behind by six points with 6:05 left in Tuesday’s nonconference game at Lockport.

The Porters looked to be in control after they rallied from a 20-11 deficit in the second quarter by outscoring Morris, 18-7, to start the second half.

But Lockport’s fine execution up to that point started to come undone down the stretch, and the visitors capitalized by scoring the final eight points to rally for a 40-38 victory.

Morris’ freshman guard Mya Shannon, who had six rebounds, collected her only points on a rebound bucket with 18 seconds remaining to account for the game-winning score.

“It wasn’t as pretty of a win as we hoped for, but we fought to the end and came out on top,” Shannon said. “They were a scrappy team, and it was really rough playing them, and we were very lucky to come out on top. I love being on this team since they all accepted me and support me so much. We’re an incredibly well-rounded team with a lot of heart. And we’re also a family. We aren’t just teammates – we’re all friends, and it’s so much fun.”

The Porters (5-3) grabbed their largest lead at 38-32 with just under two minutes gone in the final quarter when Kianna Campbell (nine points) hit a 3-pointer.

But things started to unravel after that as Lockport misfired on its final nine shots and its last seven free-throw tries, and it turned the ball over four times.

Morris (9-2) began its comeback with a layup by Meghan Smith (five points) and a jumper from Julie Jurasits (23 points, 14 rebounds) and eventually forced a tie with 49 seconds left when Leona Burton put in a rebound basket.

Jurasits, who tied her school’s single-game scoring record with a 37-point effort Monday that also featured 20 rebounds, tossed in 11 points in the first quarter to help her squad grab a 15-7 lead after one period that grew to 20-11 a short while later.

But the Porters began to chip away and pulled to within 25-20

at the break before moving in front, 33-30, with just one quarter remaining. Tia Parrinello (nine points, six rebounds) scored seven of her points in the final half to spark the hosts.

Morris also received five points from Jessica Jurak, while the Porters also got eight points and nine rebounds from Kassandra Panfil, six points and five boards from Ciara Mayes, and four points and six rebounds from Laurel Kucharski.

“Losing is always difficult, but there were definitely some positive signs that we saw,” Porters coach Dan Kelly said.

“We have 10 girls on our team, and we’re going to use all of them, and I was impressed with the way that they worked as a team. It’s a credit to the girls that they’re willing to sacrifice their own individual credit for what’s best for the team. I just told them that we’re going to be much better in February when winning matters.”

When Joliet Catholic graduate Coby Fleener was selected high in the second round of the NFL draft in 2012, he was thought to be in an advantageous position.

The reason was his buddy and quarterback at Stanford, Andrew Luck, was the Colts’ No. 1 pick that year.

As is often the case, however, it took a while for Fleener to get accustomed to the entirety of the NFL game.

Now, he has grown into a major weapon for the AFC South champion Colts and a player fantasy football owners may consider starting.

Last season, the 6-foot-6, 251-pound tight end caught 52 passes in 2013 for 608 yards, an 11.7 average, and four touchdowns. With two games remaining this season, he has 42 receptions, which is a similar average per game.

Defense helps Plainfield Central over LP

By JEFF DEGRAW Shaw Media Correspondent PLAINFIELD – Plainfield Central’s boys basketball team was desperate for a win Tuesday, and a poor shooting night from both the field and the free-throw line is not a recipe for victory.

But despite that, the Wildcats still found a way to pull out a 48-45 nonconference victory over LaSalle-Peru.

“We stuck with it tonight,” Central coach Steve Lamberti said. “In the second half, we

made some adjustments, and our big guys did enough to pull this one out. Our defense came up big when they had to. We needed that (win).”

The Wildcats (3-6) shot 4 of 14 from the field in the first quarter and trailed, 12-9, at the first break. Then their defense came up big in the second quarter.

LaSalle-Peru (4-3) hit a 3-pointer to open the quarter to take a 15-9 lead, but the defense held the Cavaliers scoreless for over five minutes and the Wildcats clawed their way

back, trailing 20-19 at halftime.

The shooting wasn’t any better, though, as Central was 4 of 16.

Midway through the third quarter the Cavaliers built a 32-24 lead. But the Wildcats went on a 10-0 run to take a 3432 lead heading into the final quarter. Central was a little better from the field in that period, going 6 of 18.

That run continued as senior Nick Thomaston made two shots after grabbing offensive rebounds to give Central a 44-36 lead with three minutes

left in the game. But the Cavaliers put a run of their own together and tied the game at 44 with 2 minutes left.

Senior Robbie Brooks, the Wildcat point guard, hit a free throw and then a basket, after a steal by junior Scott Gustafson, for a 47-43 lead with 1 minute to go.

LaSalle-Peru cut it 47-45 on a basket with 36 seconds left but could get no closer as Chris Bowitz hit a free throw to finish the scoring for Central.

Lockport squeaks past Sandburg

By DRAKE SKLEBA Shaw Media Correspondent ORLAND PARK – After numerous close calls against quality opponents to open up their 2014-15 season, Lockport’s boys basketball team finally was victorious in a heart-stopping game Tuesday at Sandburg.

Lockport’s 6-foot-3 senior forward, Gehrig Hollatz, nailed four crucial free throws in the final 1:39 of the game to lead Porters to a 4543 victory over the Eagles, which was also their first SouthWest Suburban Conference Blue win.

Hollatz hit both ends of a one-and-one with 49 seconds left to give the Porters (3-5, 1-2) what seemed to be an insurmountable 45-40 lead.

However, Lockport missed three consecutive free throws; and when Sandburg senior guard Alec Martinez (seven points) buried a 3-pointer with eight seconds to go, the Porter lead was

down to two.

The Porters missed two more free throws and gave the Eagles (3-4, 1-1) a last chance with 6.3 seconds left.

Sandburg’s 6-foot-7 senior, Tommy Demogerontas, (eight points) drove the length of the floor and was fouled with 1.6 seconds left.

Demogerontas missed the first of two shots and then intentionally missed the second, and Hollatz grabbed his fourth rebound of the quarter.

The Porters inbounded the ball and wrapped up the victory.

“Anytime we can win on somebody else’s court, it’s great,” Lockport coach Lawrence Thompson Jr. said.

“The kids stuck with it, and we finally won a close game.

“Ralph (Blakney) put the ball in the basket for us, and the whole team played well.

Gehrig really came up huge for us with those four big free throws. It’s great for him because it will instill confidence

in him when he is faced with that situation in the future.”

Sandburg senior guard Niko Kogionis (20 points) hit three 3-pointers in the first quarter to lead the Eagles to a 13-8 first-quarter advantage.

Lockport senior guard Ralph Blakney scored eight of his team-high 17 points in the first half to keep the Porters within two, 21-19, at the break.

The third quarter was a shootout between Kogionis and Blakney. Kogionis nailed three 3-pointers in the quarter while Blakney scored nine big points for the Porters to pull the teams even at 32 after three periods.

“We were really in a slump. We weren’t shooting the ball well. We lost three games in a row,” Blakney said.

“Tonight we came out and shot the ball well, played good defense and came away with a big victory. I had been in a shooting slump, and Coach

Thompson told me to screen more, which will get me more open shots. I did that, and I hit my shots.

“I’m really looking forward to the Pontiac tournament. We play West Aurora in the first game, and I am originally from Aurora and know a lot of the guys on their team.”

Hollatz scored all six of his points in the fourth quarter.

The senior also had five big rebounds in the quarter, including the game-clincher.

He finished with a gamehigh seven boards. Porter senior Mikolaj Nowobilski had a fine all -around game, scoring nine points and hauling in five rebounds.

“It was really nice to get a big win tonight,” Hollatz said.

“I started out not shooting well, but I gained confidence tonight and shot the ball well.

I played good defense, and the whole team played good defense. Sandburg scored 78 points in their last win, and we held them to 43 tonight.”

White Sox have high hopes after major offseason moves

By JAY COHEN The Associated Press CHICAGO – General manager Rick Hahn contacted a representative for Melky Cabrera right after the World Series, and agent Peter Greenberg said the freeagent outfielder appreciated the interest from the White Sox and wanted to know more about the team’s offseason plans.

Then the White Sox signed reliever Zach Duke and first baseman Adam LaRoche, and they traded for pitcher Jeff Samardzija and signed closer David Robertson during baseball’s winter meetings in San Diego.

“Actually was on the plane getting ready to take off from San Diego on Thursday, I sent Peter a text and said, ‘I don’t know how we would pay for this, but I hope at least at this point Melky sees how he fits and why we want him,’ ” Hahn said. “And that led to a series of exchanges.”

The result was a $42 million, three-year contract for the switch-hitting Cabrera that was announced Tuesday, another bold move in an impressive offseason for Hahn & Co. Samardzija, Robertson and Cabrera then pulled on their White Sox jerseys later in the day and posed for television cameras and photographers while the

team’s front office basked in the glow of a major chunk of its offseason work.

“So how was your week?” a beaming Hahn cracked soon after he sat down for the introductory press conference.

The 30-year-old Cabrera will make $13 million next year, $14 million in 2016 and $15 million in the final season of the deal. The agreement, which also includes a limited no-trade provision, put the Sox over its planned payroll for next season. But Hahn credited the aggressiveness of owner Jerry Reinsdorf and the positive response from Sox fans to the team’s earlier moves for making the contract happen.

“I think that this is a club from top to bottom that you can now start that process, you can start to raise your level of expectations and you can dream a little bit,” Executive Vice President Kenny Williams said.

Cabrera could slot in nicely behind lead-off hitter Adam Eaton in the Sox’s suddenly deep lineup. He hit .301 with 16 homers and 73 RBIs in 139 games with Toronto last season. He also is a .336 hitter with seven homers and 24 RBIs in 34 games at U.S. Cellular Field.

Cabrera, who was one of the top bats on the free-agent market, said the decision to

play for the Sox was based on a variety of factors.

“It was a decision that I made with my family,” Cabrera said through a translator. “I’m happy about the decision. My family is happy.

I like the city and I like the ballpark and I like the White Sox.” Cabrera missed the final part of the 2012 season with San Francisco when he was suspended for 50 games for a positive test for artificial testosterone. But Hahn said he had no concern about bringing him in.

Major League Baseball’s drug agreement “is set up in a way where there is specific punishment in place that he has served, and then you’re subject to a heightened level of scrutiny which he has been able to perform under for the past two years,” Hahn said, referring to additional testing given to players found to have violated the program.

“We’re very confident that the level of play will continue going forward.”

It was a homecoming of sorts for Samardzija, who was a White Sox fan when he was growing up in northwest Indiana. Samardzija also played college football for Notre Dame and spent the first 6½ seasons of his major league career with the Cubs before he was traded to Oakland last summer.

Best way to choose a successor for Topinka

Judy Baar Topinka was known for cutting through the clutter and making smart, common-sense decisions.

Attorney General Lisa Madigan honored that legacy on Monday.

Topinka, the state’s comptroller, died unexpectedly last week of complications from a stroke.

Her first term was to end Jan. 12, but voters in November re-elected her to a second term that will expire in 2019.

Topinka’s sudden death created something of a constitutional quandary. Should lame-duck Gov. Pat Quinn, a Democrat, appoint Republican Topinka’s successor?

Or should Gov.-elect Bruce Rauner, a Republican who will be sworn into office on Jan. 12?

Madigan – in Topinka-like fashion – cut through the clutter and offered a smart, common-sense legal analysis of the state Constitution. In an opinion released Monday, she said Quinn has the power to appoint a replacement to fill the remainder of Topinka’s current

term, and Rauner will have the authority to make the appointment to the four-year term when he takes the oath of office.

Madigan also encouraged Rauner and the General Assembly to call a midterm special election in 2016 for the office.

On all of these points, we agree with Madigan.

Bills need to be paid, so Illinois can’t wait until mid-January – after Rauner is sworn in – to have an acting comptroller. But Quinn, whom voters ousted from office, should not be the one who decides who the next comptroller will be for the next four years.

So there is some continuity in the office, we urge Quinn to work with Rauner and appoint the governor-elect’s choice to fill the remainder of Topinka’s current term.

We also urge Rauner and the state Legislature to call a special midterm election so voters can decide who will serve the remaining two years of Topinka’s term.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

obody is going to blame you if your holiday party spread includes a bowl of mixed nuts, some grapes and a wedge or two of cheese. After all, most people enjoy them and are willing to nibble mindlessly on them. But it is easier than you think to elevate your feast

by bolstering those tired party snack clichés with a few more creative offerings. You won’t need to work very hard at this. Most holiday party snacks can be assembled in less than 10 minutes, and many can be assembled ahead of time. And the only truly important rule is to make sure everything is neat and easy to eat.

Whisk together 2 tablespoons olive oil, 3 tablespoons balsamic vinegar, the zest of 1 orange, 2 minced cloves garlic and 2 tablespoons finely minced fresh rosemary. Sprinkle the top with 1/2 cup crumbled crisp-cooked bacon and 1/4 cup toasted sunflower seeds.

Allow to cool completely, then break into bite-sized pieces.

But as our tests for the disease have gotten better, we’ve recognized that the disease can produce much milder symptoms and can start later in adult life.

Gluten sensitivity is a recently recognized illness that is different from celiac disease. We don’t yet understand it, and some doctors don’t believe it really exists.

People with this condition have celiac disease-like symptoms but do not test positive for celiac disease. These patients are often asked to remove all gluten from their diet.

If their symptoms improve, they are usually diagnosed with gluten sensitivity.

Gluten is found in foods such as pasta, bread, wheat cereals and many baked goods. It can also be in less obvious items such as sauces, soups, salad dressings, medications and candy.

Luckily, these days, more and more gluten-free foods are appearing on grocery store shelves. And there are many alternatives for foods traditionally made with grains – everything from rice pasta to millet, quinoa or chickpea flour. I used to be a skeptic. Today, I encourage patients who think they may be gluten sensitive to try a gluten-free diet. And to stick with it if it makes them feel better.

Dear Doctor K: Many people I know are going gluten-free. When I ask them why, I hear about gluten sensitivity and celiac disease. What do these terms mean?

Dear Reader: Gluten sensitivity and celiac disease are two separate conditions with one thing in common: gluten.

Gluten is a protein found in anything made with grains such as wheat, rye or barley. Gluten is what makes breads chewy.

Celiac disease is a disorder in which the body can’t tolerate gluten.

The gluten triggers an immune reaction, causing inflammation of the lining of the small intestine. In the short term, a person with celiac disease may experience gas, bloating, abdominal cramps and fatigue.

Celiac disease also can cause symptoms in parts of the body distant from the gut, including the brain, bones and kidneys.

Over time, if the problem remains unchecked, celiac disease damages the small intestine so that it can’t properly absorb nutrients from food. This can result in diarrhea, weight loss, anemia, malnutrition, joint pain, osteoporosis and even infertility. (On my website, AskDoctorK. com, I’ve put an illustration showing the effect of gluten on the intestines of someone with celiac disease.)

Diagnosing celiac disease generally requires a blood test and a biopsy.

During the biopsy, a small sample is snipped from the wall of the small intestine and checked under a microscope for damage.

The treatment for celiac disease is a completely gluten-free diet.

This stops the harmful immune reaction in the gut, and the symptoms the disease can have outside the gut. And it also allows the intestinal lining to heal.
