Will County eyes property tax hike

By LAUREN LEONE–CROSS lleonecross@shawmedia.com JOLIET – Will County property owners could see their tax bills increase under a budget proposal floated Tuesday at the County Board’s Finance Committee.

The proposal – which sparked some debate between Republicans and Democrats – calls for increasing the tax levy by 1.5 percent, the rate of inflation.

The increase would generate about $3 million annually, $2.4 million of which would be put toward capital improvements, including a new courthouse, a remodeled county complex and major road projects, Finance Committee Chairman Steve Wilhelmi said Tuesday.

“We need to start somewhere. Levy increases have to start somewhere, and in my opinion, it should be this year,” Wilhelmi said. “We’ve put it off for years with the notion that we could always start next year. If we don’t start sometime, we’ll never get our capital projects off the ground.”

County Board Republican Chairman Jim Moustis argued there would be no need for a tax hike if the county opted to cut operating expenses by a percentage each year.

“We can accomplish the

same thing by not raising taxes necessarily. Never is there a mention of [cutting operating expenses],” Moustis said.

“It’s hard for me to support a tax increase without reducing operation costs by a percentage. We have to look at a balance of both.”

The proposed $466 million budget for 2015 is down from last year’s $503 million, but provides increased spending for capital projects. It includes $32 million for roads, when the county historically has spent $27 million annually. About $11 million will be spent on other capital projects, such as buildings and technology.

In his budget address last month, County Executive Larry Walsh proposed using a larger portion of RTA and motor fuel tax funds to help pay for planned capital projects.

Balancing act Moustis suggested the county’s largest departments – such as the state’s attorney office, along with the sheriff, health and highway departments – “make their case” at the next committee meeting on Oct. 28 on why their budgets should not be cut.

Board Member Chuck Maher, R-Naperville, agreed.

“I think it’s a really good idea that we know how many employees they have and

what their [personnel budget] is ... administration versus the rank-and-file,” Maher said. “[We’re asking them to] justify it. We’re talking about budget justification.”

But Nick Palmer, chief of staff for the County Executive’s Office, said that information is already available.

He said county executive staff, along with the budget office, had two weeks of “marathon meetings” with department heads and elected officials to go over those exact details.

Many departments are already working with reduced headcounts, such as the Land Use Department, which has reduced headcount by two dozen over the past few years, leaving “little cushion” in some cases, Palmer said.

“If the decision is to cut, would the board then give [the county executive office] direction as to where to cut in those departments? ... If we’re going backwards, we’re probably talking about, and I don’t say this is a terrible thing, but it’s a fact, it’s a reduction-in-force potentially,” Palmer said.

Wilhelmi said the department heads’ presentations will give board members a better idea of where the county should cut, if at all.

The board must approve a new budget before the start of the new fiscal year Dec. 1.

Plainfield deputy fire chief put on leave

By VIKAAS SHANKER vshanker@shawmedia.com PLAINFIELD – A longtime deputy chief for the Plainfield Fire Protection District has been put on administrative leave, and many residents are not happy about it.

Deputy Chief Jon Stratton confirmed he was put on administrative leave Oct. 1, but said he could not comment on the issue.

Fire Chief John Eichelberger also wouldn’t comment, saying it was a “personnel issue.”

The move comes shortly after the district’s other deputy chief, Dave Riddle, was chosen to become the new fire chief effective Jan. 1, 2015.

Stratton started at the fire district as a volunteer in 1994.

He was hired as a fire inspector in 2001 and became a deputy chief in 2005.

More than 60 people protested Stratton’s administrative leave and asked the fire district board for answers during an Oct. 9 special meeting of the fire district.

The Plainfield Fire Protection District headquarters is expected to be crowded again Wednesday evening at the district’s regular board meeting. The meeting will start at 6 p.m. at 23748 W. 135th Street in Plainfield.

QUICK NEWS Man hit by car in Crest Hill identified JOLIET – A man who died when he was struck by a car Saturday night in Crest Hill has been identified.

Will County Coroner Patrick K. O’Neil said fingerprint records confirmed the identity of Leon Guillermo, 56, of Joliet.

About 9:50 p.m., Guillermo was crossing Route 53 near Ludwig Avenue when he was struck by an oncoming vehicle.

The driver stopped and cooperated with police.

Police departments across the country, including in Will County, have acquired equipment through a federal program that provides the kinds of military-grade equipment previously only seen in the armed forces.

Joliet has been part of that police program, but Police Chief Brian Benton said good relationships in the community are still the best deterrent to violent, citizen uprisings.

“We’re prepared, but we rely on our relationship with the people to calm certain situations,” Benton said. “That’s one of the big things.”

Ferguson is the site of ongoing racially-charged protests after the fatal shooting of 18-year-old black man Michael Brown by a white police officer.

The shooting led to protests, rioting and a militarized police response that resulted in several officers being disciplined and a federal lawsuit against the leaders of the Ferguson and St. Louis County police departments for excessive force.

Viral videos of officers from various police departments nationwide using what critics said is excessive force have surfaced.

Local officials said the statewide Illinois Law Enforcement Alarm System deals with rioters with a trained response.

The Ferguson incident sparked a national discussion on the apparent militarization of law enforcement agencies using a program called the Federal Law Enforcement Support Office, a program to obtain surplus military equip-

Equipment Police departments in Will County have used the LESO program to gain many pieces of tactical equipment. But they aren’t the only ones.

Agencies can opt into the program for an annual fee of $500 to $1,000 and can apply to receive any military-grade equipment, vehicles or even aircraft for just the shipping costs.

According to documents obtained by Shaw Media reporters, Will County agencies have received $878,476 in tactical equipment, including rifles, utility trucks, night vision goggles, an infrared illuminator and a mine-resistant ambush

protective vehicle.

The documents only break down the information by county. And there doesn’t seem to be a pattern as to how or why counties receive equipment.

For instance, Sangamon County, with a population of 197,465, received $1.5 million in tactical equipment, while DuPage County, with a population of 916, 924, received $843,160.

On the other hand, some counties didn’t receive much.

In Grundy County, departments only requested and received four military-grade rifles valued at $1,996.

LESO also allows departments the opportunity to receive general equipment not used for deadly force.

The only players for that

equipment in Will County were the Beecher, Plainfield and Joliet police departments, as well as the Will County Sheriff’s Office, which received $54,442 in computer and exercise equipment.

Beecher received $25,792 in equipment, including several repair tool kits, a pistol holster, clothes and a generator. Joliet received $94,536 in equipment, with 50 bayonets and scabbards, a cargo truck, 40 pairs of industrial goggles and several shipping and storage containers.

Benton said the bayonets are used by the SWAT team as utility knives that are not primarily for combat. The SWAT team has 25 members, so 25 bayonets are in storage.

Also, Benton said the department received an MRAP from the program. The vehicle has never been used, except in training scenarios.

“This equipment is for worst-case scenarios,” Benton said, adding much of the equipment the department gets from LESO is worn out and unusable.

“We’re very strict in the use and it isn’t used in patrol,” he said.

But Plainfield eclipses the three other departments, bringing in $284,101 in general equipment, including clothes, two trailer-mounted diesel generators, a rescue bus, several rifle accessories, gas detector kits and two all-terrain vehicles.

Plainfield Police Chief John Konopek said the equipment and vehicles may be used during a dangerous riot or situations where SWAT teams are needed. But the primary use is for rescue operations.

“We have a history of floods in the area,” Konopek said.

“The bus and other vehicles we purchased are high off the ground, and we can transport first responders and people trapped in a weather event.

“We’ve been very active in the LESO program. But everything we apply for we think we can put to use, not for a traffic stop, but for an active criminal response,” he added.

Response ILEAS is a strategic consortium of law enforcement officials, which responds to events such as what occurred in Ferguson with forces specially trained for such situations.

Konopek is the regional manager for Will County’s program.

“ILEAS trains for not just rescue type operations, but emergency situations like rioting and crowd control,” he said.

Board’s committee leaves marijuana zoning laws alone

By VIKAAS SHANKER vshanker@shawmedia.com JOLIET – Republican candidate Mike Webster has an uphill battle to the Illinois Secretary of State’s office, but he hopes to provide vigor in an office that has been dominated by one person.

The Joliet native is running against Secretary of State Jesse White, who has held the office since 1999.

Webster stopped at Cemeno’s Pizza, 1630 Essington Road in Joliet, for a meet-and-greet with about 50 local residents and supporters on Monday.

“The state needs a change,” Webster said. “[White] has done some good things over the years, but we need to advance this state and bring forward issues that need a new vision.”

Webster graduated from Joliet Catholic High School and attended Joliet Junior College for two years. He transferred to University of Illinois, where he earned an accounting degree before heading to DePaul University for a law degree.

He practices law in Naperville and is the board president for Cass School District 63.

A Darien resident with a wife and four daughters, Webster traces his roots back to the Joliet area, where his mother and one of his sisters still live.

“Joliet is home when he comes back,” his sister, Stevie Alexander, said.

“Joliet is a great example of a boom city back in the day,” Webster said. “I have a soft spot for it. I’ve watched a lot of business leave the area. I will encourage new business and help revitalize Joliet.”

Helping businesses is a big part of Webster’s platform. He wants to reform the Department of Business Services licensing procedure to drive more job creation.

He also wants to address road safety, specifically making sure businesses are properly training commercial drivers to follow the law to avoid incidents such as the five-person fatal crash on Interstate 55 in July.

Webster, a supporter of term limits, said if he is elected

to office he will only serve two terms.

His spot on the school board is the only elected position Webster ever sought before running for secretary of state. Webster said he was approached by Republicans who wanted him to run for the state office.

“Mike is good, honest and reliable,” said Joliet resident Margaret Hoffman, who has known Webster’s family for more than 40 years. “We know he has our interests at heart.”

Resident Bill Ferguson also has known Webster’s family for a long time. He believes Webster has the right tools to get things done in the office.

“Mike is a breath of fresh air,” he said.

Webster acknowledged it’s tough running against a candidate entrenched in the position, but he hopes his message of change will help him win.

“I ran because I believe people need to have a choice,” Webster said. “There really is nothing progressive happening right now. We need to change that.”

JOLIET – One Will County Board member’s attempt to tighten medical marijuana zoning laws failed Tuesday when the board’s Land Use and Development Committee opted to maintain the status quo.

By a 4-1 vote, with two members absent, the committee voted to keep the county’s zoning ordinance as is, meaning cultivation centers will not be required to obtain a special-use permit to do business in unincorporated Will County.

Last month, Republican Chairman Jim Moustis raised concerns that the ordinance spelled trouble because it didn’t provide for public hearings and special approval from the county.

Moustis voiced his concern after opposition arose in Wilton Township to a cultivation center proposed there.

But Board Member Ragan Freitag, R-Wilmington, on Tuesday said she’s OK with the ordinance as is, noting state law is strict enough and bars medical marijuana businesses from opening up near residential areas and

daycare centers.

The county board voted earlier this year to leave the application process wide open with the idea that an easier application process with fewer hurdles would lead to a greater chance of landing one of the businesses, Land Use and Development Committee Chairman Tom Weigel said.

Longtime Board Member Walter Adamic, D-Joliet, cast the only vote in support of changing the ordinance.

Moustis is not on the committee.

Competition for medical marijuana cultivation centers is expected to be fierce in the region.

Earlier this month, the state received 14 applications – the highest received in any police district – for cultivation centers in Illinois State Police District 5, which is made up by Will, Grundy and Kendall counties.

It’s unclear how applications are split among the three counties, but Illinois’ medical marijuana law only allows 21 growing center licenses statewide – one per police district – out of the 159 applicants vying to get into the business.

Administration engaged in message battle with teachers union

By VIKAAS SHANKER vshanker@shawmedia.com CREST HILL – The Richland school district administration and board of trustees hired a public relations firm to help with negative perceptions stemming from a vote of no confidence by teachers.

The district hired Chicago-based Greentarget Global Group LLC on Aug. 8 for an estimated initial cost of $20,875, according to a contract and invoice.

The estimated cost was calculated for services between Aug. 18 and Sept. 18. As of Oct. 10, the district has paid Greentarget $5,000 in initial retainer fees.

In an email to The Herald-News, Richland Board of Education President Julie Starasinich said the district hired the firm to provide counsel on how to “effectively and directly convey our positions, actions and goals in light of recent tensions.”

The agreement followed a June vote of no confidence in Superintendent Michael Early by 89 percent of tenured teachers and in Principal Kelly Whyte by 75 percent of the teachers.

trators have fostered a hostile work environment for years.

But the board issued a vote of full confidence in administration.

The public relations firm’s objectives are to increase public confidence in the district, curb rumors and misinformation and build trust with the public through communication, according to the contract. Early said this is the first instance in his time as superintendent the district has hired a public relations firm.

The contract details tasks and timetables of how Greentarget will help the district change its public image, including using media, online and social media along with face-to-face meetings with parents.

“The process ... is geared to prepare [the district] to manage communications surrounding the vote-of-no-confidence matter in a manner that preserves the reputation of the district and its leadership among key stakeholders,” the contract states, adding that it will focus on fostering an empathetic view of the district.

Laura Miller, Greentarget has helped draft at least two responses to parent letters sent to Starasinich. The emails were obtained through a request under the Freedom of Information Act. The emails also referenced engaging the community to reverse opinions of “parents that have been given wrong and/or inaccurate information” by the teachers union.

Miller also met with administrators to devise a strategic public relations plan.

“Right now, obviously with recent developments in the district, we’re concerned about what we can convey,” Early said, noting the district has no public relations professional on staff. “The board wanted to stay proactive and not reactive.”

Early likened the firm’s hiring to the hiring of an accounting firm to look through its budget.

Steve Camp, teachers union vice president, said the hiring was “outrageous.”

“I don’t know why the board is spending money protecting the reputation of their leadership,” he said. “That’s absurd. These are resources that should have been devoted to our students.”

Summers challenges Weber for treasurer

By BRIAN STANLEY bstanley@shawmedia.com JOLIET – A Romeoville man who filmed himself having sex with a 12-year-old girl will be sentenced to between 34 and 165 years in prison.

Timothy J. Brandt, 38, had a brief stipulated bench trial Tuesday before Judge Robert Livas.

Assistant Will County State’s Attorney John Connor and defense lawyer Jeff Tomczak agreed Livas would find Brandt guilty of four counts of child pornogra-

phy and two counts of predatory criminal sexual assault in exchange for having seven other child Timothy J. pornography Brandt counts dismissed.

Brandt was arrested in May 2013 after a two-month investigation by the High Technology Crimes Unit, Romeoville police and the Secret Service.

In addition to molesting the girl and recording it,

investigators said Brandt downloaded more than 5,000 images of child pornography.

Livas sealed the case file after agreeing the facts both sides presented in writing showed Brandt’s guilt.

Before Brandt was arraigned, prosecutors said his laptop had photos and videos of him and the girl made in November and December 2012.

In some videos, the victim was holding the camera, prosecutors said at the time.

Brandt allegedly confessed to police after his arrest.

JOLIET – The man convicted of murdering his 15-year-old ex-girlfriend withdrew his motion for a new trial Tuesday.

Erick M. Maya, 24, had claimed attorney George Lenard was ineffective in defending him against murder and attempted murder charges when he filed the motion on his own last week. Maya was found guilty last month of killing Briana Valle and wounding her mother, Alicia Guerrero, on Feb. 13 outside their Romeoville home.

Maya met with Lenard and public defender Samantha LaRowe before he told Judge Robert Livas he wanted to withdraw the motion.

“I explained the steps [of post-trial motions] and what could ultimately happen as it proceeds,” Lenard told Livas.

The judge asked Maya for the court record if he’d changed his mind due to any promises or threats and scrapped the motion when Maya confirmed it was his decision.

“So you decided it would be in your best interests to withdraw this motion,” Livas asked.

“Yes, your honor,” Maya answered.

Lenard will motion for a new trial before Maya’s sentencing hearing starts next week, but that is done by attorneys after any criminal conviction and should not delay sentencing.

Maya’s behavior Tuesday is unlikely to generate any mercy from the court at that hearing. As other cases were called before the meeting with his lawyers, he repeatedly turned toward Valle’s family in the audience and grinned.

Livas had sheriff’s deputies take Maya into another holding area until his motion came up.

Maya, who faces up to life in prison, met Valle on Facebook in 2012. They maintained a relationship despite her parents’ disapproval until her family moved from Cicero to Romeoville and she met

other boys. Maya sent text messages threatening to rape the girl and kill her family before they obtained an order of protection against him.

Maya took a taxi to their home in the Erick M. 300 block of Emery Avenue Maya the morning of the shooting and was found hiding under a nearby porch after police surrounded the area.

Lockport wraps up ash tree removals, gears up for winter

By FELIX SARVER fsarver@shawmedia.com LOCKPORT – Lockport public works crews are gearing up for the winter ahead and finishing some projects started this summer.

Public Works Director Joe Findlay recently gave the City Council a preview on plans for snow removal this winter. After Veterans Day on Nov. 11, workers will review snow plow safety and coverage.

This year, the city received 3,700 tons of salt at a cost of $53.09 a ton from the state’s Central Management Services program, he said.

“A great price from what I’ve seen recently from some surrounding towns,” he said.

In recent weeks, city officials approved equipping a GPS system for 14 public works vehicles, including snow plows.

The system is meant to reduce fuel costs and make it easier to track vehicles.

The system also is meant to improve “customer service and accountability” in the Public Works Department, Findlay said.

Emerald ash borer Public Works staff also removed 215 trees affected by the

emerald ash borer, Findlay said. Trees were removed in subdivisions such as Regency Point, Victoria Crossing and Cedar Ridge, he said.

Once the removals are complete, city staff also will remove remaining stumps, he said.

Findlay said the city is removing trees in very bad condition.

The city began its emerald ash borer program in the early summer, with 400 dead ash trees planned for removal this year and 2,300 in the next several years.

The trees were planned for removal only in parkways and property owned by the city. Officials planned to replace the ash trees.

Hydrant flushing The flushing of hydrants around the city has led to few complaints this year, Findlay said. He said the flushing should last until the end of November if the weather poses no obstacle.

The city decided to flush hydrants in the fall and spring only, he said.

“I know complaints have dropped considerably over the years with us flushing consistently in the spring and the fall,” he said.

Gas leak reported at Bolingbrook mall

The leak was reported to Bolingbrook Police earlier Tuesday, according to a news

release from Lt. Mike Rompa.

Upon arrival, Bolingbrook Police and Nicor Gas personnel discovered a gas line was damaged in an area where a new roadway was being installed.

Seven stores were temporarily closed because of the odor. The surrounding area was secured as Nicor made repairs.

New judge will decide if defense can be used

By BRIAN STANLEY bstanley@shawmedia.com JOLIET – Lawyers for a Crest Hill man being tried for murder will have another chance to claim they can use a psychological diagnosis of post-traumatic stress disorder during his trial.

In July, Judge Robert Livas said the 53-page report psychiatrist Orest Wasyliw produced on Jerry Nichols was “circular [and] redundant,” and barred it from the case. Livas agreed with Assistant State’s Attorney John Connor that Wasyliw’s conclusions were “speculative.”

On Tuesday, defense attorney Michael Ettinger submitted an amendment Wasyliw wrote to explain his conclusions. Connor expects prosecutors will renew their argument against the psychiatrist’s report.

But Livas is retiring in November, so another judge will evaluate if it is proper for the new report to be used in Nichols’ defense.

Investigators said on Jan. 26, 2013, Nichols, 63, struck his wife, Diane, 57, with a car in the garage of their home in the 16000 block of Arborvitae Circle. Jerry Nichols called for an ambulance and paramed-

ics arrived to allegedly see the Vietnam veteran stomping on his wife’s head.

Ettinger said the stress from accidentally hitting his wife with the car triggered post-traumatic stress disorder, which led to the stomping.

At another evidence hearing in August, Livas decided prosecutors could use computer search histories and printouts from Jerry Nichols’ computer.

According to Connor, someone had looked up “poisons not detected in autopsy,” “how to make ricin poison,” “how much nicotine poison is [fatal],” and “ricin

Gay, a waitress at Louis’ Restaurant in Joliet, hasn’t been seen since June 10, 2013 – hours after sheriff’s deputies responded to a domestic disturbance involving the couple at their home. Police reports indicate deputies were called to the residence 13 times in the six months the couple lived together.

Borg also awaits sentencing after being found guilty of threatening to kill a neighbor in 2012, but that matter has been delayed until the arson allegations are resolved.

Sheriff’s police said Gay’s disappearance remains an open investigation.

JOLIET – The boyfriend of a woman missing since last summer will consider a plea deal for allegedly blowing up their house.

Assistant Will County State’s Attorney Fred Harvey said Tuesday James J. Borg can plead guilty to one count of residential arson to have three counts of aggravated arson dismissed.

Remembering missing loved ones BOLINGBROOK – Maple Park resident Sue Olsen was in Bolingbrook on Tuesday, not only to spread the word about her missing son, Bradley P. Olsen, but to help others as well.

Bradley Olsen was 27 years old when he disappeared on Jan. 20, 2007. He went from his parents’ home in Maple Park to Bar One, 1000 W. Lincoln Highway in DeKalb, but never returned. Several searches by hundreds of volunteers in the DeKalb area failed to turn up any information.

But working with others who are missing loved ones helps, Sue Olsen said.

“We always backed each other and supported each other,” she said. “I’ve been on many, many searches for all of these people.”

The search for missing loved ones has not ended for almost a dozen people who rallied Tuesday in Bolingbrook to spread awareness and gather more leads as part of a nationwide effort for CUE Center’s annual “On the Road to Remember” Missing Persons Tour.

The nonprofit organization holds the national tour to raise awareness of missing people whose disappearance stories have not received enough publicity on the local or national level, according to their website.

They gathered under a tent decorated with images of missing people, including the familiar image of Bradley Olsen that can be seen on streets around the DeKalb, Sycamore and Maple Park areas, years after his disappearance.

The tent was next to tree at Wipfler Park that was planted in memory of Rachel Marie Mellon Skemp of Bolingbrook, who went missing Jan. 31, 1996.

The gathering was hosted

by Skemp’s family. Skemp, who was born in 1982, disappeared from her home.

Her uncle, Al Schuch, said the gathering was important to get the word out and encourage people to ask more questions about those who went missing like Skemp.

“I think that people asking questions is more important than ‘Facebooking,’ ” he said.

Missouri resident Dave Sullivan also was at the event to help. He said he helped Will County law enforcement and emergency management agencies search for Stacy Peterson when she went missing in 2007.

The CUE Center’s tours attract people who have information about people who went missing, Sullivan said.

“By doing this, like this, you get a lot of publicity,” he said.

About 7 p.m., Paul A. Williams, 43, of the 100 block of Enclave Circle, was driving a gray GMC eastbound on Boughton Road, Lt. Mike Rom-

pa said.

“The driver was observed operating the vehicle while utilizing his cellular phone,” Paul A. Rompa said.

Williams When the van was pulled over at Schmidt Road, the officer could smell marijuana inside, Rompa said.

A canine unit was called to the scene and found 236 grams of marijuana inside, according to police reports. The marijuana has an estimated street value of $2,360.

Williams was arrested on charges of delivery of marijuana and possession of drug paraphernalia and booked into the Will County jail. He was also ticketed for using a cellphone while driving.

About 8 p.m. Thursday, Will County Gang Suppression Unit deputies brought a search warrant to enter the home of Walter D. Boykin, 41, in the 300 block of Connor Avenue.

Spokeswoman Kathy Hoffmeyer said Boykin was leaving his driveway when officers arrived, but was taken into Walter D. c u s t o d y o n Boykin drug charges.

“While they were at the residence, a white Toyota pulled into the driveway. The man inside saw the Cleveland V. officers and put Grimes the vehicle in reverse,” Hoffmeyer said.

Deputies stopped the Toyota at Connor and Lois Street, but Cleveland V. Grimes, 41, repeatedly refused to get out after deputies noticed he smelled of alcohol, according

to Hoffmeyer.

“While being taken out, he pushed an officer in the chest and continued kicking and resisting,” she said.

Grimes was charged with aggravated battery to a police officer, resisting arrest and driving under the influence of alcohol.

Grimes was on bond for a December 2010 arrest on drug charges.

Joliet narcotics officers said Grimes supplied cocaine, heroin, cannabis and Ecstasy to dealers operating in The Hill neighborhood on the city’s Northeast side.

Nine of his alleged dealers also were arrested, and pistols, handguns, cocaine, marijuana and cash were seized from properties Grimes had rented in Bolingbrook and Lockport Township, police said.

Grimes once escaped a murder conviction when a jury decided he had acted in self-defense when he killed Robert L. Barefield.

On Aug. 27, 2007, Barefield, 18, was sitting at the bar of One-Stop Liquor & Bar watching a strip show, when Grimes arrived and stepped on Jeff Lindsey’s foot. Lindsey, a relative of Barefield,

clubbed Grimes with the butt of a handgun before he started shooting at him.

Grimes dove over the bar and went into the adjacent liquor store, where he saw a gun by the counter, and returned fire into the tavern, killing the uninvolved Barefield.

Grimes was indicted the following April and arrested in June. He was acquitted during a nine-day trial in October 2008.

In April 1992, Grimes was accused of firing several shots at a crowd in the parking lot of a Lockport bar after his girlfriend was in a fight there, but no one was injured.

He was sentenced to three years in prison after pleading guilty to the March 1993 shooting of “a rival gang member’s car.”

Grimes was charged with home invasion, armed violence and unlawful use of a weapon after allegedly kicking in a door and using a handgun to threaten a Joliet resident in November 2004.

He has multiple convictions for criminal trespass to a vehicle, unlawful use of a weapon and a six pages of traffic offenses on his court record.

Once again I would like to address the issue of those late night T.V. ads and newspaper inserts which urge you to “avoid probate and get a living trust”. Too many of my clients in the past few months have come to me with a “Living Trust” that another lawyer prepared for them.

My clients were under the assumption that these “living trusts” were going to shelter their assets now if one of them had to go to a nursing home. My clients tell me the ads promoting these living trust seminars implied that their assets would be protected if dad had to go to a nursing home. My clients tell me that the attorney at these seminars insisted that the ‘living trust’ would protect their assets if dad had to go to a nursing home.

Well, now dad has to go to a nursing home.

My clients paid over $3,700.00 for their living trust and the cruel reality is that their “living trust” protects NOTHING!!

Not only will their “living trust” not protect their assets but the trust was never funded.

Their attorney never took the time to help them “fund” or put their assets into their trust.

In this situation my partner, Jennifer Lynch, and I were able to take some steps to help this couple preserve their assets. The first step taken was to dissolve the “living trust”.

I get very angry when people are enticed into getting a “living trust” when they do not need one. Just because your sister and her husband have a “living trust” does not mean that you need one, too.

There are, however, situations

where a “living trust” or intervivos trust (a trust between living persons) is needed. They are as follows: 1. If your assets are at, or near $3 million, you may need a living trust.

2. If you are entering into a second (or more) marriage, you may need a “living trust”.

3. If you own real estate in another state, you may need a living trust.

As mentioned in previous articles, a “living trust” will not necessarily limit legal fees upon your death. If the kids are going to fight over dad’s estate, it does not matter whether you have a trust or a will. They are going to run up legal expenses. Also, an uncontested probate matter is usually less expensive than creating and funding a living trust. In Illinois lawyers can only bill their hours of work; they cannot bill a percentage of the estate. As for us keeping things confidential, the only people I have ever seen (other than lawyers) take the time to fully read a probate case are dedicated genealogists.

Please, dear Reader, do not be stampeded, bombarded or enticed into having a “living trust” prepared when you do not need one.

Go to your regular lawyer the one you have known, or know of, for a long time to get legal advice. Out of town or county attorneys who ask you to come to their seminars are only trying to do one thing: Their “product”, a “living trust”.

Please follow this legal advice regarding “living trusts”.

A lot. The primary thing we do is to protect the legal system and the rights of our clients and others similarly situated. For example, you may have heard of “Tort Reform.” Reform is a misnomer, as it’s really attempts by special interests to destroy the rights of the injured to seek fair redress. For example, for years the insurance companies and large corporations have been after caps on damages at $250,000.00, even if their conduct is horrific and the injuries catastrophic or fatal.

Would this be fair compensation for a double amputee? To fight these special interests, the American Association for Justice, formerly the American Trial Lawyers’ Association, lobbies to oppose them, and to a limited degree distributes public information. I served on their board for over 10 years, which entailed four out of town trips at my own expense each year. If you are thinking of hiring a lawyer that is not a member of AAJ, in my opinion that lawyer has one significant deficiency. On the State level, the Illinois Trial Lawyers’ Association does the same thing. I have been on their Board over 25 years. If an Illinois Lawyer is not a member of ITLA, in my opinion you probably don’t want him handling your personal injury or workers’ compensation claim.

My partners, Elizabeth Klukas and Thomas Manzella and myself have given presentations at educational seminars to teach younger or less experienced lawyers how to handle claims properly. For example, Tom was just out in Denver conducting a class for The American Association for Justice for lawyers on how to properly conduct depositions, so they can learn the ins and outs of asking the appropriate questions to get the information necessary to properly bring the claim.

department are trained in handling riots in case they happen locally. ILEAS works with local departments to respond to events. It also conducts training exercises on different situations every month.

ILEAS officers also are subject to use-of-force policies outlined in section 720 ILCS 5 of the Criminal Code.

“We don’t want to punish the peaceful protesters,” Konopek said. “It’s the instigators that are often not even from the area that incite the others.”

Konopek said peaceful protests can turn into riots quickly when instigators start causing trouble. They may hurl objects at law enforcement officers, and as emotions heighten, people who may have started out peaceful may follow the instigators.

“It’s a mob mentality,” Konopek said, adding ILEAS officers are trained to detect the instigators and may use deadly

fire weapons or use any other force that is reasonably likely to cause death or serious injury must be reported separately from nondeadly force, such as physical touching, gripping, holding, frisking, pressure point application or handcuffing.

Police officers receive training every year on deadly force policies and every other year for nondeadly force.

Police batons, pepper spray and tasers are the only authorized nondeadly weapons issued by Joliet’s department. And the use-of-force policy states in what general situations the weapons can be used.

“It really depends on the situation,” Benton said, adding that the department focuses on training officers to make those decisions in tense situations. “We’re also quick to criticize and discipline any violations within the department with termination of police officers.

“But the best defense is a good relationship with the people.”

OBITUARIES GERALDINE A. AUSTIN Geraldine “Gerry” A. Austin, nee Stephen, passed away peacefully on Monday, October 13, 2014.

Born in Joliet to Frederick and Loretta (Baker) Stephen, she was a graduate of St. Francis Academy. Early in her adult life she was employed by the Joliet Arsenal and later she worked as a part-time real estate agent for the Hensel Agency. She also worked for Joliet Public Schools District 86 and the Will County Circuit Clerk’s office, from which she retired.

But most of Gerry’s life was devoted to her family, raising seven children, traveling the world with them, and always ready for a good game of cards.

She was the loving mother of William III (Vickie) of Wheaton; Janet (Pat) McCann of Wilmette; Thomas of Phoenix; Mary Pat (the late Steve) Allmandinger of Walcott, Iowa; James (Barbara) of Indianapolis; Judy (Rick) Short of Shorewood; and Michael of Chicago.

She is also survived by 13 grandchildren, three great-grandchildren, and numerous nieces and nephews.

She was preceded in death by her husband, William E. Austin, Jr. (2008); her parents; and her sister, Mary Louise Schwartz.

The Austin family expresses its sincere gratitude to the staff of the Timbers of Shorewood, Willow Hospice, and Gilda for the loving care they gave to Gerry.

She also loved to fish, mostly in Canada and Wisconsin and was most proud of her 5lb walleye she caught in Canada.

Preceded in death by her loving husband, Edwin (2004); her parents, John and Mary Rose (Stalets) Laris; brothers, Clarence and Walter Laris; and a sister, Josephine Lansaw.

BY VERENA DOBNIK The Associated Press NEW YORK – David Greenglass, who served 10 years in prison for his role in the most explosive atomic spying case of the Cold War and gave testimony that sent his brother-inlaw and sister, Julius and Ethel Rosenberg, to the electric chair in 1953, has died at 92.

Greenglass – who admitted decades after the trial that he lied on the stand about his own sister – died in New York City on July 1, according to the Rosenbergs’ sons, Michael

bomb for the Soviet Union and were executed at New York’s Sing Sing prison, insisting to the end they were innocent.

Greenglass, indicted as a co-conspirator, testified for the government he had given the Rosenbergs research data obtained through his wartime job as an Army machinist at Los Alamos, New Mexico, the headquarters of the top-secret Manhattan Project to build the atomic bomb.

He told of seeing his older sister transcribing the information on a portable typewriter at the Rosenbergs’ New

York apartment in 1945. That testimony proved crucial in convicting Ethel along with her husband.

In 2001, in revelations more boastful than contrite, Greenglass was quoted in the book “The Brother” by New York Times reporter Sam Roberts as saying he had not actually seen Ethel typing and knew of it only from his wife, Ruth.

For the prosecution, however, the typewriter “was as good as a smoking gun in Ethel Rosenberg’s hands,” Roberts wrote.

“Without that testimony, I believe she would not have

been convicted, let alone executed,” Roberts said in an interview Tuesday.

In the book and a CBS interview, Greenglass shrugged off any notion of a betrayal. He said he lied to assure leniency for himself and keep his wife out of prison so she could care for their two children.

“As a spy who turned his family in. ... I don’t care. I sleep well,” Greenglass said in the interview, adding that “stupidity” had kept the Rosenbergs from possibly saving themselves by admitting guilt.

No vote on Illinois fracking rules until November

CHICAGO – An Illinois legislative panel has put off voting on rules for high-volume oil and gas extraction until next month, as it grapples with how to ensure regulations are fair to industry while protecting the environment.

The Joint Committee on Administrative Rules has the last word on whether the rules for hydraulic fracturing, or “fracking,” can take effect. It met Tuesday to discuss the matter but did not vote and said it would meet again Nov. 6.

Hydraulic fracturing uses a mixture of water, chemicals and sand to crack open rock formations thousands of feet underground to release trapped oil and gas. Opponents fear it will pollute and deplete groundwater or cause health problems. The industry insists the method is safe and will bring a badly needed economic boost to southern Illinois.

Indiana police: Megabus crashes; 18 injured

INDIANAPOLIS – A Chicago-bound double-decker passenger bus flipped onto its side on a highway in suburban Indianapolis on Tuesday after striking a crashed car, leaving 18 people with mostly minor injuries, police said.

CHAMPAIGN – Champaign police said they are investigating a string of assaults on the University of Illinois campus

that left four people injured.

Police said the victims in all four attacks reported being assaulted between 3 and 4 a.m. Saturday as they walked on campus.

In each case, a group of six to seven men described as being in their mid-20s punched and kicked the victims. In a fifth incident, a person reported being able to run away from a group of men in a blue vehicle yelling at him.

Robber fires gun during robbery of suburban bank

ORLAND PARK – Authorities say no one was injured when

a gunman fired shots inside a First Midwest Bank branch during a robbery.

FBI spokeswoman Joan Hyde said the robber took an unknown amount of money during the Monday robbery.

Orland Park police Cmdr. John Keating said the gunman fled into a residential area near the bank. Police with dogs searched the area but were unable to track down the suspect.

Keating said the bank was empty when the robbery began. A male customer came in while the crime was taking place and was shot at. He was uninjured.

First Midwest Bank spokesman James Roolf refused to say how much money was stolen because an investigation is ongoing.

Turkish strikes against Kurds complicate anti-IS campaign

By JULIE PACE and SUZAN FRASER The Associated Press WASHINGTON – In a fresh test for U.S. coalition-building efforts, Turkey is launching airstrikes against Kurdish rebels inside its borders this week despite pleas from the Obama administration to instead focus on an international campaign to destroy Islamic State militants wreaking havoc in the region.

Media reports about the Turkish strikes surfaced Tuesday as President Barack Obama and military chiefs from more than 20 nations gathered in Washington in a show of unity against the Islamic State group.

“This is an operation that involves the world against ISIL,” Obama declared, referring to the militant group.

The Turkish airstrikes occurred Monday and marked the country’s first major strikes against Kurdish rebels on its own soil since peace talks began two years ago.

The strikes came amid anger

among the Kurds in Turkey, who accuse the government there of standing by while Syrian Kurds are being killed

by Islamic State militants in the besieged Syrian border town of Kobani.

The Islamic State militants also have targeted Kurds in Iraq, who have to some extent been able to hold off their advances.

The U.S. has pressed Turkey – a NATO ally – to take a more active role in the campaign to destroy the Islamic State group, but the Turks have said they won’t join the fight unless the U.S.-led coalition also targets Syrian President Bashar Assad’s government. The Obama administration sees those as separate fights and has no appetite to go to war against Assad.

Officials from Ankara participated in Tuesday’s meeting at Andrews Air Force Base, Maryland.

Earlier Tuesday, the U.S.-led coalition stepped up attacks on Islamic State targets in Kobani, launching 21 airstrikes in and around the

town. One of the strikes targeted the Tel Shair hill that overlooks parts of the city, according to Idriss Nassan, deputy head of Kobani’s foreign relations committee.

Nassan said Kurdish fighters later captured the hill and brought down the black flag of the Islamic State group. But the extremist group still controls more than a third of the predominantly Kurdish town.

While the White House has tried to point out progress in the campaign against the militants, it also is preparing the American public for a military effort that could extend well beyond Obama’s presidency. Officials acknowledged Tuesday the airstrikes in Kobani may not be enough to prevent a militant takeover, given the lack of an effective ground fighting force.

“We certainly do not want the town to fall,” White House spokesman Josh Earnest said.

“At the same time, our capacity to prevent that town from falling is limited by the fact that airstrikes can only do so much.”

Conservative bishops move away from gay overture

By NICOLE WINFIELD The Associated Press VATICAN CITY – A fight for the soul of the Catholic Church has broken out, and the first battlefield is a document on family values that pits increasingly alarmed conservatives against more progressive bishops emboldened by Pope Francis’ vision of a church that is more merciful than moralistic.

On Tuesday, conservative bishops distanced themselves from the document’s unprecedented opening toward gays and divorced Catholics, calling it an “unacceptable” deviation from church teaching that doesn’t reflect their views and vowing to make changes to the final version.

The report – released midway through a Vatican meeting on such hot-button family issues as marriage, divorce, homosexuality and birth control – signaled a radical shift in tone about welcoming gays, divorced Catholics and unmarried couples into the church.

Its message was one of almost-revolutionary accep-

tance and understanding rather than condemnation. Gays, it said, had gifts to offer the church – and their partnerships, while morally problematic, provided gay couples with “precious” support. The church, it added, must welcome divorced people and recognize the “positive” aspects of civil marriages and even Catholics who live together without being married.

The leaders of the bishops’ meeting, or synod, that produced it stressed Tuesday it was merely a working paper and never was intended to be a statement of church doctrine but rather a reflection of bishops’ views that will be debated and amended before a final version is released Saturday.

Still, its dramatic shift in tone thrilled progressives and gay rights groups, and dismayed conservatives already deeply uncomfortable with Francis’ aim to make the church a “field hospital” for wounded souls that focuses far less on the rules and regulations emphasized by his two

The document was remarkable both in what it said and what it didn’t say: Absent were assertions of Catholic doctrine present in most church documents that gay sex is “intrinsically disordered” and that couples who cohabitate are “living in sin.” In their place were words of affirmation and welcome.

“The report, obviously composed under pressure, has eas-

ily given rise to some misinterpretation,” British Cardinal Vincent Nichols said Tuesday.

“It is not a doctrinal or decisive document. It is, as stated in its conclusion, ‘intended to raise questions and indicate perspectives that will have to be matured and made clearer on reflection.’ ” Several conservatives who participated in the synod immediately distanced themselves from the report. The

head of the Polish bishops’ conference, Cardinal Stanislaw Gadecki, called it “unacceptable” and a deviation from church teaching.

South African Cardinal Wilfrid Fox Napier said the report didn’t reflect the opinion of the synod in its entirety and contained problematic positions.

He hoped the final report “will show the vision of the synod as a whole and not the vision of a particular group.”

“My worry is that the message has gone out – and it’s not a true message – that this synod has taken up these positions, and whatever we say hereafter is going to be as if we’re doing some damage control, which is certainly not what is in my mind,” he told reporters.

Hard-line American Cardinal Raymond Burke, the head of the Vatican’s supreme court, told Catholic World Report that the document contained positions “which many synod Fathers do not accept and, I would say, as faithful shepherds of the flock cannot accept.”

By WAYNE PARRY The Associated Press WILMINGTON, Del. – A federal bankruptcy court judge will rule Friday on what the owners of Atlantic City’s Trump Taj Mahal Casino Resort consider a life-or-death decision for the troubled facility.

Trump Entertainment Resorts and billionaire investor Carl Icahn want the judge to cancel the casino’s union contract, saying it can’t survive without shedding costly pension and health care obligations.

Allan Brilliant, a lawyer for Icahn, told U.S. Bankruptcy Judge Kevin Gross on Tuesday that Trump Entertainment needs the financial relief that breaking the union contract would provide. As the judge appeared to be making up his mind whether to rule, Brilliant said if the decision went against the company, the business could not survive.

LOS REYES LA PAZ, Mexico – A Harvard University student stuck in Mexico for months after breaking an immigration rule was told Tuesday he will be allowed to return home to the United States.

The U.S. Citizenship and Immigration Service had declared that Dario Guerrero Meneses effectively deported himself when he crossed the border without permission to accompany his dying mother to clinics offering alternative treatments to cancer patients in Mexico.

His mother died in August, and the agency denied Guerrero’s initial attempts to return home to his remaining family in California.

But only hours after The Associated Press reported on his predicament Tuesday, the agency sent Guerrero a letter through his attorney saying he had been granted humanitarian parole, and will be allowed to return after all.

“Oh my God. I don’t know.

I feel good!” Guerrero said moments after hearing the news.

This parole is temporary. It lasts for two years and does not give him legal residency, let alone a clear path to U.S. citizenship.

Guerrero, who was brought from Mexico to California by his parents at the age of 2 and only learned of his illegal status as a young adult, was one of hundreds of thousands of young people granted a reprieve from deportation in 2012 by the Obama administration.

“The U.S. Citizenship and Immigration Service did a great thing just a few minutes ago,” his attorney Alan Klein said. “He should be back in America in a few days.”

“This is the perfect (humanitarian parole) case,” Klein added. “He knew that he could possibly give up his right to be here so he could take care of his mother. He’s the reason we have immigration, and he’s the reason we have a Statue of Liberty, because he is what we want here.”

Business climate helps Indiana’s economy top Illinois’ REEDER REPORT Scott Reeder WEST LAFAYETTE, Ind. – Mitch Daniels has been a transformational leader for Indiana.

For eight years as governor, he charted a much different course for the Hoosier State from the one taken by Illinois.

I sat down with the former governor, who now leads Purdue University, and asked him to discuss his time at Indiana’s helm.

“I told my people early on in my administration that I wanted to build the best sandbox in America.

I wanted to create an environment that encouraged the hiring of people and more investment in Indiana,” he said.

Daniels said focusing on improving the overall business climate has been the key to Indiana’s success.

Just consider: • Illinois remains down 157,000 jobs since the recession began in January 2008.

But Indiana has regained all the jobs lost during the recession and created 6,200 additional jobs. And that’s despite Indiana’s job losses from the recession being more severe than Illinois’.

• Since the bottom of the recession, Illinois has created 253,000 net new jobs while Indiana has created 235,700. Indiana’s population is only half of Illinois’.

• Since January 2009, when Illinois Gov. Pat Quinn took office and Daniels entered his second term, Illinois has created

33,800 net new jobs and Indiana 139,400.

Daniels said Illinois and other states have become overly reliant on offering special incentives to select businesses. Folks on the left call this “corporate welfare,” and on the right they call it “crony capitalism.”

Daniels added he had a firm policy against offering tax incentives to companies threatening to leave Indiana unless they received a taxpayer subsidy. And while the Hoosier State does give some incentive packages to companies considering moving there, Daniels said his administration was selective and frugal when making such offers.

Illinois, on the other hand, has given incentive packages to a variety of large corporations in hopes of keeping jobs from leaving.

Daniels also focused on reducing taxes for businesses and individuals.

Illinois’ income tax is 5 percent, while Indiana’s is 3.4 percent and scheduled to drop to 3.23 percent in 2017.

Illinois’ income tax is set to drop to 3.75 percent in 2015 and 3.25 in 2025, but that could change during the lame duck session.

Daniels pushed for property tax caps. “We now have one of the lowest property tax rates in the country. I can never resist pointing out that depending on where you live, Indianans pay one-third to one-fifth the average rate in Illinois.”

It’s no secret to anyone that abuse of social service programs here is more pandemic than Ebola in Africa. Those most often rejected for assistance are the law-abiding patsies who paid into the system all their life.

I read that fines should be increased for illegally parking in handicapped spots. Identifying blatant offenders is easy, but they probably account for only about 20 percent of the total violators exploiting this entitlement. That leaves 80 percent. The elephant in the room has gone overlooked.

The biggest part of the problem never has been addressed.

Today, a plethora of new and questionable ailments has exploded on the scene, some with symptoms so vague that doctors can’t officially dismiss suspect claims and have been forced to authorized handicapped parking privileges for hordes of able-bodied patients. Some of these scammers stoop even lower by having the audacity to report the obvious poachers without placards.

If you believe I’m exaggerating,

handicapped parking spaces could be seen everywhere. Now, I hear legitimately disabled folks grumble all the time about how difficult it’s become to find one anymore.

By CURT HERRON cherron@shawmedia.com JOLIET – After experiencing some recent struggles in competitive tournaments, Plainfield Central volleyball coach Erik Vogt felt his team needed to communicate better.

With a 6 a.m. practice Monday helping to serve notice of that, the Wildcats responded to the challenge with a nice effort Tuesday against Plainfield South.

The Wildcats grabbed early leads in each set and held off a determined comeback by the Cougars in the finale to claim a 25-13, 25-18 win in the Southwest Prairie Conference.

With a nice crowd on hand to support South’s Volley for the Cure night to honor individuals who’ve dealt with breast cancer, Central donned pink shirts while South went with black shirts with pink lettering.

While that may have made it difficult for some fans to tell who was who, it quickly became clear the Wildcats were determined to come out with a different kind of look.

“The No.1 thing that we’ve improved on is our communication on and off the court,” Vogt said. “We have a supportive bench, and the kids on the court communicate very effectively in serve-receive and the transition offense, and it’s helped in our ability to sideout.

“Over the past couple of weekends, we’ve had two challenging tournaments, and we struggled in the Waubonsie Blast and Mizuno Cup, and that caused us to have to change. With that and our 6 a.m. practice, you can see it in how we play, and I’m proud of that.”

Central (21-11, 9-2) remained in a first-place tie with Plainfield North atop the SPC by diversifying its attack against the Cougars (10-14, 5-8).

Five different Wildcats collected kills in each set, with Elizabeth Hyland leading the way with 11 kills while adding seven digs. Erin Eulitz chipped in with four kills and six digs, and setter Ashley Shook added three kills, three aces, four digs and 16 assists.

After Central jumped out to 10-1 and 13-3 advantages to open the second set, it appeared there would be little drama, but the hosts picked themselves up and began to rally.

The Cougars actually were able to pull to within four points, at both 19-15 and 21-17, before the Wildcats used kills from Hyland and Eulitz and an ace from Hyland to pull away.

For South, Jordan McNeill had seven kills and three digs, Deyshia Lofton added six kills,

Alyssa O’Boyle contributed 15 assists and three digs, and Kaylin Doran had four digs.

The fight demonstrated by the Cougars in what could been a much-briefer contest is an encouraging sign for a program that won only twice last season but already has recorded 10 victories for first-year coach Amanda O’Boyle.

“Our girls will fight tooth and nail for a point,” O’Boyle said. “But their biggest problem is that while they’ll attempt to finish it, they don’t start well, so I guess that’s encouraging. They like to get about five points in the hole, and then they want to play.

“Central has a very strong team, and we’ve had a rough couple of weeks; so seeing them come back and fight in the last game was encouraging. We have four seniors, nine juniors and a sophomore, so we’re trying to get them to mesh and also play with confidence.”

It’s almost as if Starcevich knew the Warriors had more fireworks coming. Gabe Montalvo provided a highlight-reel, 28-yard touchdown run to put West ahead, 28-24, with 2:51 left. And Nate Paniak returned an interception (or a fumble recovery after a completion, depending on your interpretation) 50 yards

to account for the 35-24 final.

“Chase brings a toughness to the team,” Ernst said of Starcevich. “Without him, we are not as physical of an offense. He is a tough guy.

“We were pretty confident we could win even when we were down 24-7. We just had to keep playing and believing.”

If the playoffs were to begin now, the Warriors –

whose football enrollment is 1,285 – would be the second-largest team in 5A. The largest would be Nazareth at 1,285.35.

Nazareth, of course, knocked off Joliet Catholic, 24-21, on Saturday to remain unbeaten. The Hilltoppers (5-2) know they will be in 5A, so it is possible they will be bracketed with Lincoln-Way West and/or Nazareth.

West, which finishes the regular season with games at Thornton and against Lincoln-Way Central, has picked up a hop in its step thanks to how last week’s thriller finished.

“Everything is better in the hallways at school this week,” Ernst said. “The kids are walking down the halls with smiles on their faces.

You say something, that’s one thing. But it’s your actions that really matter.”

The Warriors’ actions last week spoke volumes.

The Lincoln-Way West football season appeared to be taking a turn for the worse.

The Warriors had lost at Bradley, 17-6, in Week 5 and were trailing previously unbeaten Lincoln-Way North, 24-7, in the second half last week.

West, however, did not lose faith.

“We felt during the game that there was no reason to panic,” Warriors coach Dave Ernst said. “Just keep doing what we were doing. We just had to protect the football.

We changed a couple things we were doing in isolation – but really, we just kept doing what we were doing.”

Indeed, West had committed four turnovers and had not forced any through 2½ quarters. Still, the Warriors stayed the course, and slowly but surely, good things began to happen. Ultimately, West wound up celebrating a 35-24 victory.

The Warriors had just gotten back within 24-21 on Connor Lohman’s 17-yard touchdown pass to Joe Shirley with 8:12 remaining. The Warriors kicked off, and the North return man fumbled.

A massive pile of players around the 20-yard line left it to everyone’s imagination.

Which side would be credited with the critical recovery?

When the officials finally were able to sort things out, North came away with the ball.

Chase Starcevich, a fiery sort any time he is on the field, is on the kickoff team and was in the pileup. He got up, trotted off the field and smiled. He said to a couple of his teammates, “Man, I love football.”

Starcevich was an offensive standout that night, catching nine passes for 103 yards. He normally starts at a safety sport or outside linebacker on defense.

“I play baseball, too, but I just love the physical part of football,” Starcevich said.

One-handed grab got everything rolling for Providence standout

dgoss@shawmedia.com NEW LENOX – Ask Miles Boykin about his varsity football debut at Providence Catholic, and he responds he had one play as a freshman.

Humility prevented the Notre Dame-bound receiver from elaborating. Providence offensive coordinator Luke Senffner and head coach Mark Coglianese took care of that.

“His one play, we were facing Wheaton Warrenville South in the playoffs,” Senffner said. “They were one of the best teams in the state. He made a heck of a catch at the 1-yard line on a fade route.

“My friend Don Rousher, who is now the running backs coach with the New Orleans Saints, was a Michigan State assistant [offensive coordinator and tight ends coach]. I was with him and asked him to sit down and watch the video.

He saw Miles’ catch and said, ‘That kid’s a freshman?’ Michigan State was on him from then on.”

“That one-handed catch at the 1-yard line when Miles was a freshman, that was a sign of the special kid he would be,” Coglianese said. “We thought we’d sneak him in there and they wouldn’t know who he was. They found out.”

Now a 6-foot-4, 225-pound senior, Boykin is a package of excitement whose presence puts bodies in the stands on Friday nights, home and away.

With Nate Vejvoda – another tall, talented receiver and an Iowa recruit – lining up opposite Boykin, and quarterback Justin Hunniford completing his throws at an uncanny rate, the Providence attack is a can’t-miss.

“Last year, someone nicknamed Nate ‘7-11’ because he was always open,” Senffner said. “We didn’t go to him that often, but all his catches seemed to be for 25 or 30 yards and a touchdown because Miles was getting so much attention. This year, they’re trying to pay attention to both

Boykin has caught 43 passes for 665 yards, a 15.5 average, and 16 touchdowns to help the Celtics to a 6-1 start. He has been clocked at 4.41 in the 40, has the leaping ability to win virtually every jump ball, is stronger than most receivers and has excellent hands.

“Miles does it all,” Vejvoda said. “He’s so smooth. He is so fast compared to me. His agility ... I’m in awe of some of the plays he makes.”

Hunniford said. “A guy like Miles, with his leaping ability, he is going to win a jump ball every time.”

True, but Vejvoda does not lose many, either.

“When we get in the red zone, Nate and I laugh about it,” Boykin said. “We say, ‘Let’s see who Justin chooses.’

He says he goes with the best matchup. I think he switches off to keep us both happy.”

Joliet Catholic lost to Providence, 21-10, in the season opener. Hilltoppers defensive coordinator Jake Jaworski faced the task of devising a

strategy to slow the Providence offense. The job his defense did looked better and better as the weeks went by as Providence piled up bigtime passing yards and points against one quality opponent after another.

“The big problem with Providence is them having two of those guys [Boykin and Vejvoda],” Jaworski said. “You can’t really defend that kind of size. Even on the NFL level, you see the Bears throw to Brandon Marshall and he’ll block out a defender. That’s what those two guys do to you.

“Boykin is so strong, too.

Boykin grew up in Tinley Park. His dad, George Jr., played football at Eastern Illinois University. His mom, Felicia, accompanied him on visits to big-time colleges throughout the country.

His older brother, George III, played basketball and football at Providence until a concussion ended his athletic career after his junior year.

George III is attending Lewis University and is a pilot.

“I wouldn’t be anywhere without my family,” Boykin said. “My dad provided the basics for my athletics. My mom has taken me everywhere. My brother has been my biggest fan since my freshman year.”

Boykin was into basketball and baseball starting at age 5.

He played baseball until his freshman year and has been on the varsity basketball team since freshman year. He already was All-Chicago Catholic

“They were looking at him mainly for basketball,” she said. “Nic [Weishar] and Miles were good friends, but I told him he would be the second man behind Nic, or he could go to Providence and be a star.

“I told him you’re going to hate me now but love me in the end. I honestly don’t think he would have gotten the college looks he has gotten at Providence.”

ABUNDANCE OF SUITORS In addition to Michigan State getting in early on Boykin, Wisconsin and Illinois did as well.

“Freshman year, I started getting letters,” he recalled.

“Wisconsin was my first letter. I’ll never forget that.

“The last day of my sophomore year, I got an offer from Illinois. Then coaches started contacting me all the time. It

got pretty stressful midway through my junior year. It seemed like I was talking to coaches every night.”

Playing well at the Core 6 7on-7 Showcase helped increase Boykin’s national exposure. Offers arrived from the likes of Wisconsin, Ohio State, Mississippi, Indiana, Arizona State, Oregon, North Carolina State, Kentucky, Toledo, Connecticut, Virginia Tech, Bowling Green and Western Michigan. His finalists included Notre Dame, Florida, Illinois, Michigan State, Michigan and Missouri.

“Miles and I were travel buddies,” Felicia laughed. “I went everywhere with him, from Florida to Michigan and other places.”

“I went to a bunch of camps this summer, too,” Boykin said. “I had been splitting time between basketball and football. This summer, I played

The mayhem ended in early July, when Boykin announced his commitment to Notre Dame. He’ll begin there by lining up at the wide receiver spot he plays for Providence.

He wants to major in sports management and become a sport agent some day.

Had Boykin been the recruiter rather than the recruit, he said he “would want to get to know the families of the kids and about their lives. Notre Dame cared about me and my family. It’s more than just football. It’s definitely a family atmosphere. That’s why I’m going there.”

As busy as the recruiting process was, from all accounts, Boykin kept a level head.

League in basketball as a sophomore.

His football career did not begin until fifth grade.

“His dad didn’t want him to play that early, but Miles sat and watched the [Tinley Park] Bulldogs and said he wanted to play,” Felicia said. “We also didn’t want him to fall behind other kids, so we let him start playing then. He just took off.”

“Fifth grade is almost late in Tinley Park,” Boykin said.

“I’ve been playing basketball ever since I could remember.

Basketball definitely was my favorite growing up.

“But now having experienced high school football, it’s so different. The Friday night football game means a lot more than anything else I have been involved with.”

Boykin said he will play basketball again this winter for Providence coach Tim Trendel. Felicia said it has always been that way, with her son going from one sport to the other.

“He was very busy as a boy, always on the go,” Felicia said.

“I think if he hadn’t been in sports so much, he would have gotten in trouble. He was that busy.

“There was a time he thought he would be a major college basketball player, but he would have to give up football, and he didn’t want to do that. Along the way, he found out he is better in football and eased off basketball a little.”

Nic Weishar, an all-state tight end/receiver at Marist last fall, is a freshman at Notre Dame. He and Boykin are good friends, having grown up playing sports together.

Boykin said he originally wanted to attend Marist.

“Coach Cogs [Coglianese] had recruited my brother to come to Providence,” Boykin said. “My mom said I could transfer to Marist after my brother graduated [George III is two years older] if I wanted, but I really like it here. Everyone makes me feel welcome.

“And, it helped earlier that some guys from my travel team were playing basketball here.”

Tim O’Halloran, publisher of EdgyTim.com, has covered recruiting in Illinois for Rivals.com for the past 15 years.

He said Boykin has a 4-Star rating, is the No. 2 player in Illinois and is No. 151 nationally. But he is more than a talent.

“The first impression I had of Miles is that he is a good kid,” O’Halloran said. “That hasn’t changed. You can tell he was raised quite well. He is a terrific young man, well-mannered, exactly the type you would expect to wind up at Notre Dame.”

And if football doesn’t work out? ‘”He has the best voice for a 17-year-old kid that I’ve ever heard,” O’Halloran said.

“When you hear him talk, it’s fantastic. I thought, ‘Wow, this kid has a set of pipes.’ ”

Chicago Bears get lots to love against Falcons BEARS INSIDER Hub Arkush The tape of the Falcons game was the first Bears’ tape I’ve studied in a long time that was fun to watch.

With their backs very much against the wall, the Bears stepped up and played their best game of the season in all phases.

The Jay Cutler we saw in Atlanta is the quarterback who causes coaches to gush about his natural abilities and general managers to give him $100 million contracts.

He was sharp, he was efficient, he made every play he had to and, most importantly, he was turnover-free.

Cutler never will be one of the more accurate quarterbacks in the league, but he was more accurate than usual in playing his best game of the season and he earned an A for his performance.

The running backs received a B+.

Matt Forte continues to play at a Pro Bowl level and Ka’Deem Carey showed another flash of what coach Marc Trestman and general manager Phil Emery seem to like. But both can pass protect better, and Carey has to earn enough trust soon to give Forte more than seven plays off a game.

The receivers get an A-. I’ve actually got As for Brandon Marshall, Alshon Jeffery and Martellus Bennett, and kudos for Josh Morgan for his first touchdown as a Bear.

I don’t know if it’s because he was more healthy, more focused or what, but Marshall was Marshall again without having to steal targets from the

rest of the group. And when Marshall is good, Jeffery usually is great and always better than he is on his own.

Bennett had several clutch catches and his best all-around game. All that hung the minus on this grade is Santonio Holmes doesn’t appear to be making any progress in the passing game, even if he is an able punt returner.

Roberto Garza was excellent and Matt Slauson much better in his second game back, while Kyle Long has gotten so good you often don’t notice him.

Unfortunately, Michael Ola struggled at times and Jordan Mills had one of his worst games against a below-average Falcons defensive front.

Because the Falcons came in with four sacks on the season and they got three on Cutler, the offensive line gets a B-, trending toward a C+.

Stephen Paea had another really solid performance, Willie Young a good second half and Jared Allen a nice fourth quarter rushing the passer, but the defensive line still isn’t good enough.

Jeremiah Ratliff was fine coming back from his concussion and Lamarr Houston was, for the most part, missing in action again.

The rush was great once the jail break started at the end of the game, but for 60 minutes they were a B-/C+.

Bottom line, this is the first time this year I think I’m going to watch the tape one more time even though this column is done, because good movies are hard to find.

Boykin always had talent, but his production this season borders on historic.

“Just when you think it can’t get any better, it does,” Coglianese said.

“His stock has risen so fast.

He’s no longer the tight end the college guys thought he

was.”

Providence has won nine state championships, more than anyone except Joliet Catholic and Mount Carmel. Coglianese began his Celtics coaching career under the legendary Matt Senffner in 1988, the year after Providence’s first state title. He has seen most of the school’s all-time greats.

“We’ve had a few D-I linemen,” he said. “We’ve had great athletes, but nobody with the size and D-I tools like Miles has.

“Brandon Johnson went to Western Michigan several years ago and was an excellent receiver. Miles is a little bigger, a little faster and a little more polished than Brandon was.”

“I haven’t been around athletes his caliber at all,” Luke Senffner said. “They come along once in a very long while. I can’t think of anyone here who was even close to his level.

“They talk about fivetool athletes in baseball.

That’s what he is in football.”

SAN FRANCISCO – The St. Louis Cardinals handled the tough part well, erasing a four-run deficit to force extra innings.

It was the simplest of tasks that sent them to a frustrating loss.

Randy Choate made a wild throw to first base on a bunt, allowing Brandon Crawford to score the winning run in the 10th inning as the San Franci sco Giants beat the Cardinals, 5-4, Tuesday in Game 3 of the NL Championship Series.

“That’s the stuff you dream about when you’re a kid, besides hitting the homer,” Choate said. “Being out on the mound in a game like that with a crowd like that on the road, those are the kinds of challenges I look forward to. I love be-

ing out there for that. That’s just what makes that all the more disappointing, is that ball would get away from me like that.”

The 10th inning got off to a bad start for Choate, a specialist whose submarine deliveries make him especially difficult on left-handed batters. He couldn’t put away the first lefty he faced, walking Crawford on eight pitches.

Juan Perez then fouled off two bunt attempts before swinging away. He fouled off a couple of two-strike pitches before singling to left field to bring up another lefty in Gregor Blanco.

Choate got Blanco to bunt the ball right back to him and turned to throw to first, a play the reliever has rehearsed countless times in pitchers’ fielding practice throughout his career.

FOOD ‘Higher-end food at blue-collar prices’ Romeoville native is head chef at new downtown Joliet restaurant

Thomas Murtaugh, the executive chef for Juliet’s in downtown Joliet, grew up in an Italian household, where “food” equaled “love” and guests were greeted with, “Are you hungry? What can I get you to eat?”

“If you said, ‘no,’ my mother kept repeating everything she could whip up in 20 minutes,” Murtaugh said, “just to make sure she fed you.”

One day, when Murtaugh was 12 years old and no one was home, he found a recipe for cookie bars on the back of a can of sweetened condensed milk. He made a batch – and a mess – but the family enjoyed the cookies, and Murtaugh discovered his calling.

It’s this sense of sharing and caring that Murtaugh hopes to impart at Juliet’s, an Italian/steakhouse restaurant and sports bar, recently opened by Frankfort native Carmen Rossi. Every menu item was developed in-house from Murtaugh’s own recipes, Murtaugh said.

“None of our recipes are out of a book,” Murtaugh said.

The most exciting part of Juliet’s, Murtaugh said, is its “small plate share,” designed to coax people’s attention away from their cellphone and back to the great food and the people sitting at their table.

The stack of small plates at each place setting – instead of a single dinner plate – and the smaller-than-average meal sizes are designed to encourage patrons to order multiple entrees and share with fellow diners.

“Everyone can taste a little of everything,” Murtaugh said. “It gets people talking about what they’re eating. If they like something, they’re

This week, trick one has been a one-trick spade pony with the king-four in the dummy opposite declarer’s queen-eight-three. But there can be more than one trick in this pony.

Today, South is once more in three no-trump and West again leads the spade six. But there is a difference – in this deal, West opened two spades to show a respectable six-card suit and some 6-10 high-card points. How does that affect declarer’s line of play?

North might have overcalled two spades with two no-trump, but with an inflexible spade stopper and four hearts, a takeout double was preferable. Then South went for what looked like the most likely game, despite his uncertain spade stopper. (Note that five diamonds looks reasonable on the North-South hands, but the bad trump break would kill that contract.)

South starts with eight top tricks: one spade (given the lead), four hearts and three clubs.

Three more winners can come from diamonds, but since East probably has that ace (not many players open a weak two with a pair of aces), there is a risk that the defenders will take five spade tricks first.

In the last two days, declarer had to play dummy’s king at trick one. Now, though, the only way to make this contract is to play low from the dummy and low from hand, letting East take the trick with his 10. That anesthetizes the spade suit and the contract comes home with an overtrick.

Dear Abby: I think I have an abuse problem. I have been with my boyfriend for a year, and already I feel like he is fed up with me. I don’t want to lose him.

When I was younger, my father used to abuse me. It was years ago, but I feel like I might have gotten that trait from him. In addition, I have a tendency to smack my boyfriend on the arm when he’s verbally abusing me. I just want it to stop.

I love this man and I feel terrible after I do it. I keep telling him I’m sorry and that I have the worst tendency to act on impulse.

PUBLIC NOTICE To Patrons of Commonwealth Edison Company: Notice to Current and Former Customers Regarding Refunds.

In compliance with a ruling by the Illinois Commerce Commission ComEd will refund $46.2 million to its customers. The refunds relate to payments made by customers as a result of ComEd's 2007 rate case and the Smart Meter pilot program.

Current ComEd customers will receive refunds in the form of bill credits on their November, 2014 bills and do not need to make application. Refunds to residential customers will average approximately $8.

Former ComEd customers that paid for electric service during the time period of between September 30, 2010 and December 31, 2012, but who are no longer customers, may be eligible to receive a refund.

In order to be eligible for a refund, former ComEd customers must apply between October 19, 2014 and February 15, 2015. Applications received after February 15, 2015 will not be accepted. To apply, visit ComEd.com/ComEdRefunds and download the application forms.

Return the completed application along with the necessary documentation and send to ComEd at the address provided on the application form.
