Marengo firefighter quits after funds went missing

By STEPHEN Di BENEDETTO sdibenedetto@shawmedia.com MARENGO – A Marengo Fire Rescue lieutenant resigned July 26 after he was caught taking $6,700 from the volunteer fire department’s nonprofit, according to multiple sources.

Lt. Russ Kahl took funds from the Marengo Fire Rescue Association in three separate incidents this month while serving as president of the nonprofit, said president Scott Klaassens, who was named to the position July 26.

Kahl, who had been serving as association president for

nearly two years, returned the $6,700 to the organization this week before resigning. The association notified Marengo police of the incident, although no charges have been filed.

“As a board, we decided at this time that he shouldn’t be charged,” Klaassens said. “It’s not a closed case yet. It is still open, pending on what we discover in our audit.”

Kahl was suspended from the fire department a week ago, after the association’s treasurer, Klaassens said, noticed a number of withdrawals that didn’t appear to be approved.

The association has policies in place to guard against unau-

thorized withdrawals. Going forward, the group will be conducting an audit to ensure no other money was taken.

The board also will examine ways to strengthen its financial policies, Klaassens said.

“I am very happy the money was returned in a timely manner,” he said. “For us to go forward, we want to audit our books and set new policies and procedures in place so this won’t happen again.”

The funds in question came from private sources within the association, fire officials said. No public funds were taken from Marengo Fire Rescue.

The fire rescue association is a nonprofit that primarily uses donations to buy supplies and materials – not covered by the state – for the volunteer firefighters at the department.

Marengo Police Chief Joseph Hallman said police were notified of the incident two weeks ago. He said his department can’t investigate until a complaint is made, adding Marengo Fire Rescue internally handled the matter.

“No one filed charges. No formal complaint was made,” Hallman said. “We will investigate anything, but it didn’t come to our door.”

The McHenry County Mental Health Board is maintaining its funding levels for its client agencies next year despite yet another decline in tax revenue.

The board predicts in its tentative 2015 budget it will have $8.4 million to distribute to mental health agencies, which matches what it hopes to dole out this year and what it gave out in 2013, the year it underwent significant change and began slashing its budget to account for getting less in taxes.

“We’re not cutting any funding, period. It’s staying the same for what it was in 2014,” Interim Executive Director Lyn Orphal said.

The board’s draft 2015 budget anticipates collecting $10.4 million in property tax revenue next year, which is about $400,000 less than the $10.9 million it expects to collect

By LINDSAY WEBER editorial@shawmedia.com WOODSTOCK – After a day filled with events such as a swine carcass class, poultry show and a K-9 demonstration, why not end it with a battle for the crown? The county fair, a perfect backdrop for the event.

Amid the dirt mounds of the grandstand sat a small stage where 11 contestants vied for the 2014 Miss McHenry County Queen title. In its 66th year, the pageant still brings drive, intelligence and pretty dresses to the stage.

Friends and family members of the contestants filled the bleachers, some wearing Judges Christin Niemerg, Coleen Gephart and Allie Kelson make notes July 27 on the final five contestants of the T-shirts with their contestants name on it.

The master of ceremonies, Stew Cohen of STAR 105.5, led the event with musical performances by Project Two during intermissions.

The pageant began with a presentation of the contestants in their formal wear and the opportunity for each contestant to speak about a topic that was important to them. The topics of volunteering, county pride and embracing confidence were on the agenda.

Some quoted their influences such as Mahatma Gandhi, and encouraged others to be an (Thomas) Edison.

The presentation of the candidates in their swimsuits followed before narrowing it down to the top five.

A teacher at Marengo High School, David Boies, also gave Franks the push he needed.

Boies’ son is a well-known attorney. One day, Franks asked his teacher if he thought he had a future in law. “[Boies] said, ‘You aren’t too smart, but if you work hard you might make it,’ “ Franks said, laughing. “With an endorsement like that, how could I go wrong?”

Franks graduated high school at 16 years old. He left

the Marengo farm to eventually graduate from Roosevelt University in Chicago. He attended law school at American University, Washington College of Law in Washington, D.C. He worked on the Hill during the day and attended class at night.

He was drafted into the Army and met his wife, Eileen, in 1956 while stationed at Fort Jackson, S.C. Her sister was married to a man in his platoon.

“She came to visit her twin sister, and she got a husband instead,” he said. They married in 1957.

They have three children – all lawyers – David Franks, state

He has six grandchildren.

Back in Illinois, a young Herb Franks began working for a law firm in Rockford. A friend offered him not only a job, but all the cases that were “absolute dogs.”

“And I tried ‘em all. Most state’s attorneys were as young and dumb as I was,” he said. “And eventually I started winning a few.”

His career eventually brought him back to Marengo, where he opened the Franks, Gerkin & McKenna law firm on land where he once milked cows for his father.

But first, a watershed moment.

Decreasing tax revenue has presented the board with increasing challenges. Its tax rate of 15 cents per $100 in assessed valuation is the maximum allowed under state law, meaning it cannot raise that rate like other governments have to adjust for decreasing property values. About 96 percent of the board’s budget comes from its property tax levy, according to its 2013 annual report.

Critics of the board allege its fiscal problems have been exacerbated by questionable decisions over the years that have resulted in mission overreach, staff and administrative bloat, and construction of a massive expansion to its headquarters.

The board underwent almost a complete turnover the year prior that coincided with a shake-up of its administrative staff. The McHenry County Board committee in charge of filling the Mental Health Board’s seats ended up after

the 2012 election with a majority that wanted to pursue fundamental reform of its size and spending.

The Mental Health Board has since slashed the size of its staff from 34 to 19. The $1.2 million in personnel expenses it is tentatively budgeting for 2015 is half of the $2.4 million it budgeted in 2013.

The levy for helping the mentally disabled accounts for about $90 of the property tax bill for the owner of a $200,000 home who takes the homestead exemption.

Herb Franks in 1974 represented a local woman to win the county’s first million dollar judgment. A semitrailer missed a turn on Route 20 in Marengo and drove through the woman’s house in the middle of the night.

She survived, but with a severed spine she never walked again. She sued the trucking company and was awarded $1 million.

“I said, ‘damn. I’m a lawyer.’ Boies was right. I could be one,” he said.

And he shows no signs of slowing down. When asked if when he’ll retire, he shakes his head.

The final five were asked what they would say to people who do not believe pageants are a good influence on young women.

Finalist Denielle Alvarez of Huntley was frank.

“Maybe you’ve been watching the wrong pageants,” Alvarez said.

Yesenia Mercado of Harvard boasted of the pageant’s success in teaching her good interview skills, poise and confidence, which she plans to put in her arsenal for future job hunting.

In the end, the sash and crown went to Algonquin resident Stephanie Vargas, who also took home the Miss Photogenic title.

“We are overjoyed that she won,” said Vargas’ mother, Susie. “We’re very proud, and it’s wonderful to see her blossom into the young lady I always knew she would be.”

Vargas couldn’t stop smiling after the announcement

and is confident her reign will be a success.

“It’s like a job interview and I fit the part,” Vargas said.

Vargas said she plans to volunteer and reach out to children to teach them to be themselves. She takes the same approach when it comes to her pageant strategy.

“Don’t be who you think they want you to be. Be who you are,” said Vargas.

Vargas also encouraged the crowd to, at the end of the day, be human.

While the night welcomed a new queen, it also bid farewell to longtime pageant director Linda Zielinski, who will pass her duties onto McHenry resident Marisa Merkel after a 35-year-run. Through misty eyes Zielinski gave thanks to her family and those who helped her keep the pageant running for all these years.

“The pageant will go on,” said Zielinski.

Vargas will go on to represent the McHenry County Fair Association in January at the Miss Illinois County Fair Contest in Springfield.
