Marking Purple Heart Day Monument unveiled at county courthouse

By KEVIN P. CRAVER kcraver@shawmedia.com WOODSTOCK – The first Illinois county to be recognized for honoring Purple Heart recipients celebrated Purple Heart Day in style Aug. 7.

More than 200 people, many of them prior-service or active military, attended the unveiling of a large, double-sided granite monument at the main entrance to the McHenry County Courthouse. The monument honors the nearly 2 million American service members who have received the medal for being wounded or killed in combat.

More than a few audience members have the medal that the military likes to say is eligible to all but desired by none. Among them was Huntley native Jeremiah Homuth, who lost his right arm to a rocket-propelled grenade attack in 2005 while serving in Afghanistan with the Army’s 10th Mountain Division.

“I think this is a really nice gesture to Purple Heart recipients, past and present,” Homuth said.

The hour-long ceremony had guest speakers, including

a Medal of Honor recipient and aircraft flybys. Although all four branches of service were represented Aug. 7, the monument and the ceremony were a Marine operation.

Marine veteran Richard Young and his wife, Monica, spearheaded getting the monument built and getting McHenry County recognized as the state’s first Purple Heart County, which allows it to fly a special commemorative flag authorized under the Illinois Military Order of the Purple Heart.

Young and several other veterans raised the flag on one of the three new flagpoles that were erected as part of the monument. The retired sheriff’s deputy never received the medal but sought to honor those who have, including his father and his uncles, all of whom were wounded while serving in the Army in the Pacific Theater of World War II. The Purple Heart is the oldest American military medal still awarded and was originally conceived as a badge for military merit by Gen. George Washington. It also is the only military decoration for valor that has no requirement of a recommendation – any soldier, sailor, airman or Marine is entitled to it if he or she is wounded or killed in action

against an enemy.

It’s a fraternity that Dan Finn, state commander of the Purple Heart order, does not want to see grow. Behind the podium was a wall of honor with pictures of the 275 soldiers from Illinois who have been killed in action since the 9/11 attacks.

“We are the one veterans’ organization that wants to go out of business,” Finn told the audience.

Finn was one of several guest speakers. State Rep. Jack Franks, D-Marengo, called the monument “exactly the kind of event that makes us proud to call McHenry County home.”

But the most poignant speech came at the end from Allen Lynch of Gurnee, a veteran of the Army’s 1st Cavalry Division who received the Medal of Honor, the nation’s highest military honor, for rescuing and defending three wounded soldiers in a 1967 battle in Vietnam.

He challenged the audience and its veterans to make sure Americans, especially children, understand the high cost of freedom.

“It’s up to us, we who served and those who presently serve, to make sure this country is worth the sacrifices the men and women who earned the Purple Heart made,” Lynch said.

HUNTLEY – A truck company based in Canada could be fined by the Illinois Environmental Protection Agency for an accident that ultimately contaminated a lake in Sun City Huntley and killed nearly 3,000 fish.

The agency also ordered Trappers Transport in Manitoba, Canada, to cover the cost of a massive cleanup effort ongoing at Wildflower Lake, located in the middle of the Huntley retirement community, and a nearby creek that feeds from the Kishwaukee River.

Agency officials still don’t know whether a threat exists to residents who use the lake and creek as they continue to investigate the extent of the contamination that killed thousands of fish.

The agency is awaiting test results from a lab in Singapore, which apparently is the only one that can develop a standard used to analyze the water samples. Officials hope to hear the results within the week.

“It is not known if an environmental threat exists for residents who may use the lake or creek for recreational purposes,” IEPA spokesperson Kim Biggs said. “The investigation is continuing and information will be provided as it becomes available.”

The environmental hazard happened July 25 after a Trappers Transport truck caught fire on Interstate 90 near Huntley. The water runoff from the firefighters’ hoses mixed with a chemical carried by the truck, seeped into a ditch and likely entered a branch of the Kishwaukee River that led to Wildflower Lake.

HUNTLEY – After extending Kreutzer Road west earlier this year, Huntley officials turned their focus eastward last week by asking for federal dollars to help fund a $6 million realignment of the local road.

The long-term project would primarily widen the eastern portion of Kreutzer Road, between Route 47 and Haligus Road, to a three-lane cross section and reconfigure a small bridge that crosses over a creek.

Officials increasingly have done maintenance work on the eastern stretch of Kreutzer Road, while the bridge has been a frequent cause of car crashes, Village Manager Dave Johnson said.

“There’s an alignment issue that we would like to straighten out,” Johnson said.

“It gets a significant amount of traffic with residents going out to Huntley-Dundee Road or St. Mary Church, or Wing

Pointe [subdivision] residents getting on Route 47.”

Construction on the project likely won’t start until five years from now since officials have to try and secure funding for the $6.03 million estimated price tag. Village Board members started the lengthy process this week after submitting a proposal for $1.5 million in federal funds.

Trustees made the request with the McHenry County Council of Governments, which now will spend the upcoming months ranking various road projects from area municipalities before seeking federal funding.

If the Kreutzer Road project ranks high enough, the village could see the funding in 2017, 2018 or 2019.

In the meantime, village officials will try and work with a nearby developer on lowering the village’s $4.53 million estimated share of the project, Johnson said.

“We don’t have those dollars today,” he said. “If the de-

veloper doesn’t step up, it’s going to be every bit of five years before construction starts.”

PAR Development agreed in the late 2000s to widen a portion of the road to a five-lane cross section, as part of an annexation deal that slated hundreds of acres south of Kreutzer Road for development.

The developer has yet to make the road improvements, Johnson said.

The village has successfully formed partnerships in the past. Officials and Centegra Health System agreed last year to share costs to reconfigure a portion of Reed Road for the new Huntley hospital.

Aside from the multimillion dollar realignment, the village asked the county’s council of governments for federal funds to resurface Haligus Road from Algonquin Road south to Huntley-Dundee Road.

The $675,600 project would require a $151,120 contribution from the village, according to cost estimates.

Quick scams enter digital world

While the old summer scams still exist, local law enforcement said faceless threats have become much more prevalent and seniors are the target. McHenry County Sheriff’s deputy Aimee Knop and Undersheriff Andrew Zinke said the “grandparent scam” has been on the rise in the county and is done exclusively over the phone or Internet.

Knop said, in many cases, a person will call a senior and pose as a relative or grandchild. The person will mention how they are away on vacation and need money for an emer-

gency. With the rise of social media, would-be scammers are able to easily find the names of relatives and when people are on vacation because of status updates and photographs.

“With the Internet, our personal information is everywhere so it is very easy to get,” Knop said. “When you take pictures that show you’re on vacation or just celebrated grandma’s birthday, it airs everything [scammers] need.”

Zinke said, the “grandparent scams” pose a different set of challenges than the in-person soliciting scams common after storms. Because everything is done over the phone or computer, it can be difficult to track offenders that might be located out of the state or country, in some cases, he said.

“People that started learning on computers 20 years [ago] are starting to get to that senior-citi-

zen age,” Zinke said. “There is a growing group of sophisticated computer users getting older, and that is going to help.”

According to the Better Business Bureau, one of the most common summer scams have been bogus 5k events where pre-registration fees are not refunded after “organizers” cancel the event days before its scheduled.

Knop and Zinke said good prevention tips include never giving out personal information over the phone, verifying with family if someone claims to be a relative and understanding agencies such as the IRS never call a personal residence.

The McHenry County Sheriff’s Office also holds quarterly scam prevention meetings.

Anyone who thinks they have been scammed or were targeted should report it to local law enforcement, Knop said.

By STEPHEN Di BENEDETTO sdibenedetto@shawmedia.com HUNTLEY – An elusive group of so-called “Polish gypsies” are responsible for a spat of recent home burglaries within the Sun City Huntley retirement community, Huntley police said.

Investigators believe an organized faction of self-identified gypsies have burglarized 24 homes in Sun City since 2011, including two recent burglaries July 25 and 28. Sun City before last week hadn’t reported a residential burglary since October, police said.

The sporadic pattern fits the characteristics of a broader gypsy group, which changes targets and members frequently across multiple states, Huntley Deputy Chief Michael Klunk said.

The group, which police believes comes from Polish descent, has been linked to incidents in Chicago and the surrounding suburbs, Klunk said. Their techniques have confounded area police, since they target hard-to-trace items such as jewelry and cash.

“A lot of them use fictitious identification. A lot of the time the plates we come up with are from rental vehicles,” Klunk said. “There’s often dead ends.

It’s a difficult group to break into, with ever-changing participants and ever-changing vehicles.”

In the majority of cases – dating to 2011 – men and women of the group drive around Sun City neighborhoods using rental vehicles purchased through fake identification and look for residents leaving their homes.

They typically check for unlocked windows or doors but also have been known to force their way into unattended homes, Klunk said.

The burglaries usually happen between 9 a.m. and 1 p.m.

The most frequent area of activity has been homes that border Cold Spring Drive, Klunk said.

Once inside, they check master bedrooms, take jewelry and cash, stow the items away in small handbags and leave within minutes, Klunk said.

As police investigate, they urge residents to be vigilant.

“They have to make sure they have good, secure doors, a quality lock,” Klunk said. “We always recommend once people leave their home to circle back to see if anything looks out of the ordinary.”

Leading entries for the Cheesecake Factory is its “Bruleed French Toast,” coming in at 2,780 calories, 93 grams of saturated fat, 2,230 milligrams of sodium and 24 teaspoons of sugar. Other Cheesecake Factory “winners” include the Farfalle with Chicken and Roasted Garlic (2,410 calories, 63 grams of saturated fat and 1,370 milligrams of sodium) and, for dessert, a slice of Reese’s Peanut Butter Chocolate Cake Cheesecake (1,500 calories, 43 grams of saturated fat, 21 teaspoons of sugar).

rancisco Velazco couldn’t wait any longer. For several years, the 35-year-old Seattle handyman had searched for an orthopedic surgeon who would reconstruct the torn ligament in his knee for a price he could afford.

Out of work because of the pain and unable to scrape together $15,000 – the cheapest option he could find in Seattle – Velazco turned to an unconventional and controversial option: an online medical auction site called Medibid, which largely operates outside the confines of traditional health insurance. The four-yearold online service links patients seeking non-emergency care with doctors and facilities that offer it, much the way Priceline unites travelers and hotels. Vetting doctors is left to prospective patients: Medibid does not verify credentials but requires doctors to submit their medical license number for patients to check.

Velazco paid $25 to post his request for knee surgery. A few days later, he had bids for the outpatient procedure from surgeons in New York, California and Virginia, including details about their expertise. After accepting the lowest bid -- $7,500, a fee that covered anesthesia and related costs -- he learned that his surgeon would be William T. Grant, a Charlottesville, Virginia, orthopedist.

A few weeks later, after several online discussions with Grant, Velazco arrived in Charlottesville, where he had rented a $50-anight room and would spend two weeks recuperating. On Dec. 4, 2013, he underwent knee sur-

gery, performed in an outpatient surgery center that Grant coowns.

“I’m back working four days per week and climbing ladders,” Velazco said recently. “I’m doing great.”

To Medibid founder Ralph Weber, a benefits consultant who said he left his native Canada for the United States in 2005 to escape “socialized health care,” using the Internet to arrange non-emergency medical care is long overdue. Americans, he says, are increasingly going online to book travel and even find a mate. Medibid enables them to strip away the opacity that surrounds health-care pricing, Weber maintains, where charges vary wildly even in the same market and can be nearly impossible for consumers to obtain.

“We introduce transparency and also competition,” said Weber, whose company is based in Murfreesboro, Tenn. “We are a disruptive innovation, a freemarket alternative to Obamacare.”

How it works Weber said that about 120,000 consumers -- Medibid calls them “seekers” -- have used the service.

Many are uninsured, holders of high-deductible plans or enrollees in faith-based plans, which have grown as a conservative alternative to the Affordable Care Act. Seekers are charged $25 for each request or about $60 for an unlimited number of requests per year.

Roughly 6,000 doctors or surgery centers and a handful of hospitals, most seeking patients from abroad, have registered as “bidders”; physicians pay a fee ranging from $50 to bid on one

request to $250 to bid on many.

Once a bid is accepted, Medibid bows out, and patients work out arrangements with the doctor.

Many bids are a package deal, covering the facility fee, the surgeon’s charge and anesthesia services. Patients pay the bidder in full, upfront and in cash or by credit card.

Is it safe?

But critics, who agree hospitals’ prices are too often inflated, arbitrary and opaque, express concerns about Medibid. They say the service provides little in the way of quality indicators for prospective patients, something hospitals convey by granting a doctor privileges and insurers do by accepting doctors on a plan’s roster. Surgery or procedures such as colonoscopies are typically performed in physician-owned outpatient centers, which are more lightly regulated than hospitals and have fewer safeguards for patients. Unlike hospitals, which are required to track infections, outpatient surgery centers are usually exempt from such reporting requirements.

And complications are rarely covered under the terms of Medibid.

Medibid “is a phenomenon that is in part being spawned by the absurd, nonsensical and inexplicably unfathomable pricing of American health care,” said Arthur L. Caplan, head of the division of bioethics at NYU Langone Medical Center in New York. “Cheap sounds good, but in these auctions you’re not getting any information: Was the guy at the bottom of his class in medical school?”

the name -- the institutional reputation of a doctor or hospital. Insurance companies or hospitals drop people who have high complication rates or costs due to errors, “ he added. “Medical care is not like buying a watch on the street or a hotel room online. The stakes are much, much higher.”

Marty Makary, an associate professor of surgery at Johns Hopkins Hospital and the author of “Unaccountable,” a 2012 book about hospital quality, agrees. “I have concerns about the lack of good metrics of quality,” he said. “How do you know what you’re getting?”

Weber says that consumers are competent to make such decisions without relying on a provider directory or the imprimatur of a hospital.

“Is there anything that says the Internet is any worse than a Blue Cross directory?” he asked.

“Once they choose a physician, we will send them the license number, and there are a bunch of third-party sites” that patients can use to check out a doctor. If a patient is dissatisfied with a doctor after accepting a bid but before surgery, Medibid will repost the query free of charge.

Mental Health Board building expansion proving to be tricky

By KEVIN P. CRAVER kcraver@shawmedia.com A new and improved McHenry County Mental Health Board is doing its best to take it in a more fiscally responsible direction.

But dealing with one legacy from the old board – a half-empty, 22,000-square-foot expansion that taxpayers are still paying off – is proving to be tricky.

The expansion, actually a separate building, sits behind the Mental Health Board’s headquarters in Crystal Lake.

Former board members built it anticipating future growth that never took place, and their successors are, at the very least, discussing whether it can be utilized in a manner that helps defray the cost.

However, the fact that it’s a public building financed through a unique federal bond program places limits on what can be done. The building is one of the many issues that interim Executive Director Lyn Orphal has on her plate in steering the board to a better future after a tumultuous year of change that critics say was much needed and long overdue.

“There are so many different nuances that are popping

up as we work to find out what is allowable,” Orphal said. “It can open up a whole big can of worms if we think we can do something only to find out that we can’t.”

And for the time being, the conventional wisdom seems to be that the list of things they can’t do with the building is a much longer list.

The Mental Health Board in 2009 made a pitch for the expansion, arguing that it ran out of space at its 8,000-squarefoot headquarters. It would fund the project with $4 million in federal bonding authority granted to the McHenry County Board as a means to stimulate the economy and get people back to work in the midst of the Great Recession.

Three-million dollars was used to build the new building and renovate parts of the original one, with the remaining $1 million covering planning and architecture costs.

The County Board approved the bond issuance in 2010 over the objections of a minority that questioned expanding government while taxpayers were hurting.

A number of the client agencies that the Mental Health Board funds also questioned the need. Some pointed to the expansion as proof to their al-

legations that the board had far exceeded its primary mission to distribute tax money to agencies working with the mentally and developmentally disabled. They also alleged that the money to pay back the bonds would do more good given to them, especially in a state that has chronically underfunded social service agencies.

Time would justify the concerns.

The same Great Recession that created the funding mechanism shrank property values and, therefore, shrank the Mental Health Board’s revenues, 96 percent of which come from local property taxes. Its staff has shrunk from 50 full-time equivalents at the time of the building’s construction to about 14 today.

And if property tax revenues continue to fall, the amount spent each year paying back the loan will become a bigger financial hit as the board finds fewer and fewer things to cut. The Mental Health Board paid $474,386 last year in debt service and occupancy expenses, according to its annual report.

Class-action suit alleges millions improperly charged without due process

Anyone who’s ever been in McHenry County court for a traffic offense knows there are two pipers to pay: the fine and the court fees.

The judge hands down the fine, plus whatever fees the circuit clerk will charge. And when you walk to the clerk’s office to pay the fees, they oftentimes add up to more than what the judge ordered you to pay for breaking the law.

A class-action lawsuit, however, alleges the process used by the county’s 22nd Judicial Circuit is unconstitutional and that defendants over the years have been improperly charged millions of dollars.

The suit filed Aug. 13 in federal court in Rockford claims fees imposed by the circuit clerk’s office after cases are adjudicated are, in fact, added fines, which violates defendants’ constitutional right to due process and governments’ constitutional prohibition against ex post facto addition of penalties.

And because they are fines, the total paid often illegally exceeds the maximum financial penalty allowed under state law, the lawsuit alleges.

The lawsuit lists four plaintiffs represented by three attorneys and names Circuit Clerk Katherine Keefe as the defendant in her capacity holding the office. Court fines and fees are set by state statute, not by Keefe or the court’s judges.

“There are a whole bunch of [fees] that are statutorily considered fines,” said attorney Matt Haiduk, one of the plaintiffs’ attorneys. “In McHenry County, you walk out of court with an order that says, pay $50 plus court costs, but the problem is that the only person who can order fines is the judge. HUNTLEY – A lake at Sun City Huntley re-opened Aug. 15 after preliminary results from a lab in Singapore revealed the chemicals that spilled and contaminated the lake wouldn’t harm residents.

The Illinois Environmental Protection Agency last week sent two rounds of samples from the retirement community’s Wildflower Lake to southeast Asia for testing. The cleanup effort ongoing at the lake since July 31 is now winding down, IEPA spokeswoman Kim Biggs said.

“The Illinois EPA and Illinois Department of Public Health have determined that the water from the lake would not cause adverse health effects for the residents,” Biggs said. “We are still reviewing data to determine what, if any, effects might still be present for the aquatic life.”

The environmental hazard happened after a truck from Trappers Transport, based in Manitoba, Canada, caught fire July 25 along Interstate 90 near Huntley. The water runoff from the firefighters’ hoses mixed with a chemical carried by the truck and likely entered a branch of the Kishwaukee River that leads to Wildflower Lake.

The chemical contamination killed nearly 3,000 fish inside the Sun City lake and a nearby creek that feeds from the Kishwaukee River. Residents typically use the lake to catch and release fish.

Upon hearing about the contamination, the state environmental agency ordered Trappers Transport to cover the cleanup costs and replace the dead fish.

Environmental officials are still determining the tab for the work and also don’t know when the fish will be replaced.

They are still considering whether to fine the truck company for the contamination.

Biggs said the agency can work with the company on a compliance agreement or refer the issue to the Illinois Attorney General’s office, which would assess any financial penalty.

But when you listen to her describe the battle to provide pastoral care to immigrant detainees in the McHenry County Jail, you know Sister JoAnn Persch is one nun you don’t want to mess with.

Sweet as an angel but tough as nails When local county, jail and immigration officials in 2007 told Sisters Persch and Pat Murphy they weren’t allowed access to the jail to provide pastoral care to the immigrant population, the nuns became the face of Illinois’ Access to Religious Ministry legislation.

The law allowed them in the jail, and what Sister Persch described as access to detainees not granted at other detention centers in the country.

“Pat and I have a motto that we do all of this peacefully, respectfully, but we never take no for an answer.

That’s how we got where we are,” Persch said.

“We never take no for an answer because these men and women deserve this, and if we don’t speak up for them, who’s going to do it?”

McHenry County has a 10-year-old contract with Immigration and Customs Enforcement to house up to 400 immigrants who are awaiting deportation proceedings.

Some of those detained are allowed to stay in the county for any number of reasons.

The immigration defenses are too many to list here.

Those who are not so fortunate are sent back to their native country but first processed through the Chicago-area Broadview Detention Center. It’s the last stop before deportation.

The Sisters’ Interfaith Committee for Detained Immigrants prays weekly outside the Broadview Center. What Sister Persch sees there still sends shocks to her system. Men and women shackled at the hands and feet, packed onto vans to be sent off. Tearful goodbyes

with loved ones who remain in the country. Farewells that are never long enough.

“Every time, I come out ready to cry,” she said. “I just can’t believe that’s how we’re sending people out of this country. … You tell us they’re civil detainees, they’re not criminals, then why are you sending them off in shackles? That always bothers me.”

But at the McHenry County Jail, it’s a little different, Persch said.

“They’re hopeful,” she said. “Some know they might be deported, but some have court dates hoping maybe they’ll get to stay. At Broadview, that’s it. They’re done.”

As part of the county’s pastoral care program, volunteers – there are about a dozen on average each week – come every Tuesday, outfitted with religious reading materials to provide to the detainees, an allowance unique to McHenry County, Persch said. They visit with them, pray with and for them. The volunteers take home stacks of prayer requests. They call a detainee’s family members with updates on their loved one.

They have testified at deportation hearings. If a detainee doesn’t have money, the committee will put $10 on their commissary.

lucrative to bondholders during an economic downturn could make the building a white elephant for the board.

It can lease space only to fellow government agencies, not private interests.

And the hurdles that would be involved in selling the building could likely negate any cost savings in doing so, at least for a number of years.

The legal opinion on what can and can’t be done continues to evolve, said McHenry County Board member Paula Yensen, D-Lake in the Hills. Yensen holds the County Board’s voting seat on the nine-member Mental Health Board.

“There still isn’t a consensus about what we can do with the building because we receive differing opinions … it seems like every time we are ready to move forward there’s a new wrinkle,” Yensen said.

But the board has made some progress. It discovered that it can charge occupancy fees to the four mental health agencies that have space in the original 8,000-square-foot building, Yensen said. It will start doing so next fiscal year.

Yensen, a fiscal hawk, was appointed to the board in 2013 as talk of the need for an overhaul of the board gained strength. All but two of the board’s current members have been appointed in the past 18 months.

While Yensen opposed the building expansion and voted against it when it came up four years ago, she does not consider telling people “I told you so” nearly as productive as having a plan for the here and now.

She said she is confident the new board will come up with a solution to help defray the building costs.

“I think people in the community and on the County Board understand that we are moving forward in resolving these problems in a very positive manner. I really believe that,” Yensen said.

4 Marengo library gets ready to move

By STEPHEN Di BENEDETTO sdibenedetto@shawmedia.com MARENGO – The long-awaited move to a larger facility began Monday for the Marengo-Union Library, as staff and volunteers will work to set up their new home for an early September opening.

The massive move of books, materials and furniture from the library’s State Street building in downtown Marengo means the library will be closed through the week of Sept. 8, when the staff is slated to re-open the new library on Grant Highway in Marengo.

Furniture and other larger items will be moved into the new building later this month, Drinka said.

Although the library will be closed during the threeweek move, residents can still return rented materials at drop-off locations at either library building, Drinka said.

Officials also are planning a grand-opening celebration in October.

Skala: Well, I didn’t see – and I still don’t see – a lot of good focus being put toward doing what’s right for county residents. That’s a frustrating part of county government.

There’s a lot of people making political decisions instead of decisions that are good for the people of the county. A lot of the individuals I feel are not doing board work; they’re doing staff work.

Coleman: So what made you decide to get involved with local government?

Skala: In 1997, our oldest was just about a year and a half. I went to private Catholic school, and my wife went to public school. So we were having that question about how we were going to school our children. I said I don’t mind sending them to the public school system as long as they’re going to get a good education.

We started inquiring as to whether the school district, which was [District] 158, was a good, quality school district.

They just happened to be having elections that spring for the school board, so I decided the only way to find out was to get on the school board. So I ran and I was elected. That’s how it all started.

Coleman: Was there something individuals convicted of driving under the influence, one of improper lane use and one of speeding between 11 and 14 mph over the speed limit.

In the case of the two DUI plaintiffs, a judge fined them $1,250 and $1,000 each. But the fees added an additional $1,538 and $1,771, respectively, resulting in totals exceeding the $2,500 maximum fine allowed by statute for their type of offense, the lawsuit states.

Haiduk said the fines should be part of the court proceedings in McHenry County. He said lawbreakers in Kane and other counties know what they will

Skala: As board members, we’re asked to make decisions, and we should be making high-level decisions as far as policy and direction on where the county should be going. As you start doing staff work, then you’re getting into the weeds. You’re trying to do the work of the people you hired to work. be paying in court fees before they leave the courtroom.

The lawsuit argues that fees charged to administer programs unrelated to the charge are actually fines, and, therefore, cannot be levied after court proceedings without due process. The two plaintiffs charged with improper lane use and speeding each paid $28 to finance the state-mandated drug court, mental health court and child advocacy center.

“The fines imposed by the clerk without a court order are void and must be refunded to plaintiffs and all similarly situated individuals,” the law-

But for many in this population, Persch said, their crime was not having the legal paperwork for a better life.

“They’re not definitely not hardened criminals,” she said.

“The majority of them might have an infraction of the law, but a lot of them don’t. They were picked up some other way, but they have no papers.”

Maralee Gordon, is the Rabbi at Crystal Lake-based McHenry County Jewish Congregation and part of the Interfaith Committee for Detained Immigrants since the beginning. She talked with the Shaw Media about national immigration issues – the political tug of war to pass meaningful reform, the images of protesters demonstrating at the border that’s flooded with immigrants – the vast majority children fleeing war torn areas of Central America.

Rabbi Gordon described a xenophobia she can’t wrap her head around.

“It’s very strange to me that, here we are in a country of immigrants, that we have this whole hue and cry from people that we should not welcome immigrants,” she said.

“This country is built on the work of immigrants.

“Knowing that everybody in this country is an immigrant … it’s incumbent on us to recognize that part of ourselves and have compassion

and care for the immigrant population.”

Both Gordon and Persch took their break time on a recent Tuesday to meet with Shaw Media in the jail lobby. A request to Immigration and Customs Enforcement to observe the weekly meetings in the jail was denied on the grounds Immigration and Customs Enforcement didn’t have enough staff to accommodate such a request.

Such denials are not foreign to Sister Persch. In 2008, she and Sister Murphy were denied entry into both the Broadview Center and McHenry County Jail. But political pressure and a new law on the books eventually forced their hands. And so the pastoral care program was born.

“All of this was always very pleasant but pleasantly saying no,” Persch said.

David Warren of Crystal Lake also was key to the Interfaith Committee from the getgo. He and a handful of others first met twice monthly with the jail’s Chinese population.

“They took my little lemonade stand and turned it into a Fortune 500 company,” said Warren, who belongs to the Order of Secular Franciscans with the Catholic Church.

As for the amount from which to draw for restitution, the lawsuit singles out eight different fines and fees totaling more than $23.5 million paid to

While there are numerous separate court fees a circuit clerk can charge, about 30 of them are the most common.

And they can add up.

The Northwest Herald asked the Circuit Clerk’s Office for a 2012 story on court fees to calculate them for an adult driver pulled over by a sheriff’s deputy for speeding 15 mph above the speed limit. Besides the $50 fine and court supervision for pleading guilty, the driver would pay an additional $220 in fees.

he Affordable Care Act was supposed to mend what President Barack Obama called a broken health care system, but its best-known programs — online insurance and expanded Medicaid for the poor — affect a relatively small portion of Americans.

A federal office you’ve probably never heard of is supposed to fix health care for everybody else.

The law created the Center for Medicare and Medicaid Innovation to launch experiments in every state, changing the way doctors and hospitals are paid, building networks among caregivers and training them to intervene before chronic illness gets worse.

One example: George Washington University’s $1.9 million award to improve care and cut costs for at-home dialysis patients.

Another: CareFirst BlueCross BlueShield’s $24 million grant to reduce unnecessary hospital visits for chronically ill Medicare patients.

The center’s 10-year, $10 billion budget is the largest ever devoted to transforming care. In several states the office is working to overhaul medicine for nearly all residents — not just those with government Medicare and Medicaid coverage.

Every few months it awards test grants of $3 million or $10 million each — or sometimes tens of millions — to community groups, clinics, hospitals, insurance companies, nursing homes and states.

Its programs touch millions of patients. Hundreds of organizations have gotten money. More than $2 billion has been doled out or committed since 2011.

Skeptics on both sides One of the biggest experiments is the center itself. Skeptics, including Republicans but also those who support the health law, wonder if it’s up to the task.

“While I certainly appreciate innovation in the delivery of health care, the CMMI is just another big government bureaucracy created by Obamacare that costs billions and duplicates other efforts,” Utah Sen. Orrin Hatch, ranking Republican on the Senate Finance Committee, said through a spokesman. Hatch mused at a hearing last year whether the center’s hundreds of tests represent “barely controlled chaos.”

Even policy pros who hope the innovation lab succeeds wonder if its investment will pay off and complain that it is slow to disclose information on spending and results.

“This is absolutely necessary” to try to change how care is bought and delivered, says Christopher Koller, president of the Milbank Memorial Fund, a nonprofit that works to improve medical deci-

sion making. “Is this the right way to do it? A whole bunch of experiments? Is the innovation center adequately resourced in an administrative way to do this? The jury is still out on this.”

Who’s getting money With a staff of 265 and growing, CMMI must not only administer ACOs and other reimbursement tests that reward quality care at lower cost. It also manages hundreds of grants and dozens of contractors hired to monitor and evaluate the programs.

Projects tend to focus on people with expensive diseases such as cancer, diabetes, heart failure and schizophrenia. In one round of grants, awardees were urged to deploy projects “as rapidly as possible” and show results within six months.

The Johns Hopkins University got $19.9 million to improve care for East Baltimore’s chronically sick and mentally ill. An AsianAmerican community group got $2.7 million to help low-income Californians navigate the medical system. The University of Tennessee got $3 million to help ensure repeat hospital patients in Memphis stay on their medications after discharge. Intermountain Health Care got $9.7 million to test software that forecasts the best ways for caregivers to interact with patients.

Many efforts don’t just involve the elderly Medicare and poor Medicaid patients in HHS’ primary insurance programs. Six states including Maine, Arkansas and Oregon got up to $45 million each to involve commercial insurers and their members as well as government programs in trials to improve health and control costs.
