Schools are using their snow days

jdallke@shawmedia.com The Arctic temperatures in McHenry County this month have landed cars in ditches, caused pipes to burst and – for the first time in years – kept kids out of the classroom.

Area school districts are used to one or two snow days a year but because of the subzero temperatures most schools have canceled four days of classes, which will push the school calendar further into the summer.

“This winter has been awful,” District 158 Superintendent John Burkey said.

“I can never recall having to have so many days off of school because of extreme temperatures.”

Burkey said it is a “rarity” to have school canceled because of the cold, but he added it made predicting the weather – and informing parents – much easier.

“Temperatures you know ahead of time. With snow, you don’t,” he said. “Temperature forecasts tend to be much more accurate than

snow forecasts.”

District 158 and all other districts in the state are required by the Illinois State Board of Education to have five emergency days built into the schedule. Districts have the option of using institute days, which are work days for teachers, to make up missed classroom time, but many districts prefer to extend the school year so teachers can use those days for professional development, according to Carol Smith, spokeswoman for Woodstock District 200.

“This is an unusual year,” Smith said. “In my 12 years of working in school districts, I have never worked a year where we have used all of our emergency days.”

The last day for District 200 schools was originally scheduled May 21, but it has been extended now beyond Memorial Day to May 28, Smith said.

If there is another drastic temperature drop or a heavy snowstorm that keeps students out of school for two more days, districts will have used up their allotment of emergency days, causing schools to request

an “Act of God” day.

“Act of God days reduce the required number of student attendance days in the school calendar but do not negatively impact general state aid,” Illinois Board of Education Media Relations Manager Mary Fergus said.

An Act of God day must be approved by the district’s regional superintendent and the state superintendent of education, and they are not required to be made up at the end of the year, Fergus said.

Schools also are allowed to modify their calendars to schedule additional days at the end of the school year if they have used all of their emergency days, she said.

While closing school often puts a burden on working parents who need to find child care, Burkey said the feedback from parents has been mostly positive.

“It’s definitely an inconvenience for parents,” he said. “But most parents understand why we had to do it. They don’t want their kids out in this. We don’t want kids standing out on bus stops in the cold.”

MARENGO – The Marengo-Union Library Board will start discussing Tuesday the sale of its building along State Street after renovations began earlier last month on the library’s new home on Grant Highway.

Board members won’t be making major decisions on the asking price for the building or the timetable of a potential sale until the renovation at the library’s new facility, 19714 E. Grant Highway, nears completion later this year, said Library Director Mary Hanson.

“We are not going to be making any decisions at this point,” Hanson said.

“We can’t really sell the building until we move out.”

The preliminary discussion Tuesday night on selling the current library at 200 S. State St., Marengo, should set the tone for more detailed planning in the coming months. The Marengo-Union Library first moved to the downtown State Street building in 1991.

Library officials started looking for a bigger space in 2011, eventually acquiring the former Miceli drapery plant along Grant Highway.

Crews recently started renovating the 20,000-square-foot facility with basic plumbing and electrical work. If construction proceeds as planned, the library could open the new building by mid-2014, Hanson said.

Using its existing budget, the library bought the former drapery plant for $1.2 million. Secretary of State Jesse White also helped the library with its remodeling work, handing officials a $543,000 grant last summer.

The library has a $750,000 total renovation budget for the new facility.

Regulations increase for electronic cigarettes

Suburban smokers who have ditched the Marlboro Man for the electronic cigarette won’t face smoking bans like those recently passed by major cities such as Chicago and New York anytime soon, area experts and business owners said.

Depending on future research studies, states and cities – small and large – eventually could start enacting prohibitions that outlaw electronic cigarettes in the same ways as traditional smokes.

“E-cigarettes are still in its infancy,” said John Nothdurft, government relations director for the Heartland Institute. “Big cities are open to heavy-handed regulations, but I don’t think the suburbs are as quick to jump on the regulatory bandwagon.”

The Heartland Institute, a free-market policy think tank based in Chicago, was one of the many groups to criticize Mayor Rahm Emanuel and Chicago aldermen for enacting a smoking ban earlier this month that prohibits e-cigarettes in bars, restaurants and most other indoor public places.

New York City passed a similar prohibition in December.

Los Angeles, San Francisco and the state of California are expected to debate e-cigarette regulations later this year, while Illinois and 26 other states already have banned the sale of the alternative tobacco product to children, according

Unlike traditional cigarettes, e-cigarettes emit vapor instead of smoke, and don’t contain harmful byproducts, such as tar. The vapor can contain nicotine, synthetic nicotine, or no nicotine, and is usually mixed with artificial or natural fruit flavoring.

Supporters of the trending product argue that e-cigarettes contain far fewer chemicals than regular cigarettes and often help smokers quit the habit. Opponents say the health risks to the smoker and bystanders are unknown, and the product encourages

tobacco smoking.

The Heartland Institute mainly criticized Chicago for enacting a premature ban, since the health studies on e-cigarette use are inconclusive, Nothdurft said.

“It’s inevitable that regulations will come up eventually, but I think a lot of cities and suburbs are still trying to figure out more about e-cigarettes,” he said.

In McHenry County, the debate over e-cigarette use and its health effects has slowly started.

McHenry County College in 2011 was one of the first community colleges in the Chicago area to become a tobacco-free

campus. The no-smoking policy prohibits the use of cigarettes, e-cigarettes and other tobacco products on any college-owned property.

The college included e-cigarettes in its policy because the health effects are unknown, said Lena Kalemba, director of health and wellness at MCC. “E-cigarettes are not monitored by the [Food and Drug Administration], manufacturers are not required to reveal the chemicals contained in them, and, therefore, the health effects are not known,” Kalemba said. “Until additional information is known, MCC chose to include them ... as a

tobacco product.”

Steve Clai opened VapeTech Inc. in the Huntley Outlet Mall off Interstate 90 nearly five months ago after trying e-cigarettes first-hand. He said the product is misunderstood.

“We have people who have smoked for 30 years come in and quit just like that,” he said.

“For people who say it encourages smoking, I don’t agree with it. They keep associating it with tobacco, and it’s not.”

Clai sells e-cigarettes, batteries and other related accessories. The e-cigarettes behind his store counter contain four ingredients – nicotine, fruit extracts, propylene glycol and a carbohydrate derived from plant oil.

At Huntley Village Hall, officials want to clarify the state’s new prohibition on underage e-cigarette sales that went into effect Jan. 1.

The law penalizes the sale of e-cigarettes to minors but didn’t include provisions on kids caught possessing them, Trustee John Piwko said.

Piwko wants to amend the village’s local ordinances on tobacco to include underage e-cigarette possession. He proposed the idea after his sons saw classmates smoking e-cigarettes on a bus ride home from school.

The Village Board could vote on an amendment by early February, village officials said.

“I don’t think it’s something that anyone under the age of 18 is mature enough to deal with,” Piwko said. “I thought it was a health concern, and I thought we should address it.”

WOODSTOCK – In sentencing a man to 40 years in prison for the beating death of his girlfriend, a McHenry County judge Friday called it “one of the worst cases of domestic violence” she’d ever seen.

A jury in November found 45-year-old Robert Signorile guilty of first-degree murder for the death of Michelle Mathieu. It took jurors 90 minutes to convict him of the crime.

Medical crews responded March 18, 2012, to the couple’s Sun City Huntley home where they found Mathieu, 52, unconscious and face down in vomit.

She died after languishing six days in a coma.

Autopsy photos showed the woman was covered in bruises, and medical testimony revealed she had fractured ribs and spine and a head trauma that ultimately killed her.

Tenants fight for rights

If she could do it over, Halverson would make sure those promises of maintenance – now part of a court case Halverson and her husband, Bill Zieske, have filed against their Woodstock landlord – were more than just verbal.

“I think we would have done a lot different,” said Halverson, reflecting on the experience.

“You think you’re dealing with a person who seems honest and trustworthy. We didn’t really do a lot of research.”

Zieske and Halverson’s battle has tilted toward the extreme end of tenant-landlord disputes, but such disagreements are hardly rare. In the fall, when the couple gathered an informal group of renters to speak for greater tenant rights at a Woodstock City Council meeting, they heard from families that accounted for some 40 leases.

Longtime renters tend to develop their own stories of landlords who’ve abused their power: The dishwasher that never worked, or that time the deposit was withheld without explanation. Often left up in the air, though, is whether that power is real or a guise formed by someone more informed of the law.

Bill Zieske and his wife Denise Halverson moved from Chicago in May to Woodstock. Since then they have been dealing with a landlord they’ve accused of property damage from neglect of needs, consumer fraud, breach of the lease and assault, among other claims.

The answer – depending on who gives it – is a little of both.

“There’s not very much law and it’s not very good and it’s not very pro-tenant,” said Shannon Weiss, who owns the state advocacy group Renter’s Rights with her husband. “Out there it’s still God’s country, and the landlord still rules the roost.”

But Weiss and others say renters who are knowledgeable of their rights and options and who are willing to exercise them, can decrease their chances of a nightmare scenario or of getting pushed around.

It starts from the very beginning. During the run through, tenants should make sure they note any and all pre-existing damage and have the landlord sign off on it. Such damage often becomes a key point for

landlords to withhold a deposit later on, said Dominic Buttitta, a Barrington-based attorney and former McHenry County Assistant State’s Attorney.

Any damage the renter wants fixed upon moving in should be, as Halverson suggested, in writing – before the signing of the lease, Buttitta said.

Added Michael Smoron, an attorney who represents the municipalities of Bull Valley, Hebron and Johnsburg: “Even if you have a pre-printed lease, nothing precludes you from adding in writing that the landlord will fix the furnace ... and have the landlord initial it. It doesn’t look very legal, but it’s sufficient to show what the agreement was.”

lords who then neglect the needs of their tenants, Smoron has two suggestions. For one, he said, tenants can choose to withhold either part or all of a rent payment in order to cover costs toward maintenance that protects the “habitability” of the residence.

The landlord, after all, has a responsibility to keep the place up to a standard fit to live in.

“If he or she is not doing that after you’ve given the opportunity, I think courts are sympathetic to that,” Smoron said.

Finally, Smoron suggests getting the municipality involved in more serious cases. Maintenance issues like broken windows and a lack of heat generally break municipal code and open up a landlord to a citation.

He added that municipalities would likely try to pressure the landlord into fixing the problem before issuing code violations or ultimately taking a case to court – a sentiment echoed by Woodstock officials last year when Halverson, Zieske and others spoke out about their landlord troubles.

One reason those tenants came forward, Halverson has said, is that many felt trapped.

They felt that getting the municipality involved meant they’d receive a notice of eviction – some who spoke in the fall said they’d had that fear become reality. Faced with

jengelhardt@shawmedia.com CRYSTAL LAKE – Loaded guns will now be allowed to be securely stored in vehicles on any McHenry County College parking lot after the board of trustees lifted restrictions it once considered.

The initial proposal called for “safe harbors” in Lot C and Lot D near the child day care center, prohibiting any vehicle with a firearm from parking in those spaces. But some trustees were concerned with late-arriving students needing to scramble for a spot or needing to park off campus.

Trustee Linda Liddell said the college should simplify the policy to make it easily understandable.

“I really think that limiting it from two parking lot facilities is too hard to police and … manage.”

Restricting Lots C and D would have taken away roughly 20 percent of the college’s parking spaces for those

with guns in their vehicles.

Under the concealed-carry law passed by the Illinois Legislature during the summer, all firearms are banned on college campuses. But lawmakers also gave authority to individual colleges to draft policies on concealed carry in college-issued vehicles; establishing “safe harbor” parking lots; disciplining violators of the law; and reporting methods for students presenting a “clear and present” danger.

The law took effect Jan. 1, but the state does not expect to start issuing permits until April.

Trustees also planned to require all firearms in vehicles to be unloaded, but a closer reading of the law showed

that was not required so they decided to lift that restriction as long it’s locked in a gun console or glove compartment.

Restrictions on firearms in college-issued vehicles remain, meaning staff and student-athletes would not be able to carry while traveling for college functions or competitions.

Trustee Chris Jenner remained opposed to the policy, saying the law is a bad one and the college should inform associations that represent colleges to push for reform. He argued those with permits to carry should be able to carry.

“Does anyone really believe a gun-free zone really reduces or prevents violence?” Jenner asked. “I don’t want to embrace the law, but it is what it is.”

the belief that they’d need a costly lawyer to fight a bogus eviction notice, many chose to live out their leases in silence, Halverson said.

But Smoron views the system with more hope. He said even without hiring legal representation, a tenant has a good shot at fighting an eviction notice issued without sound reason.

“If the tenant has the courage or the ability to express the circumstances in basic language ... the court is sensitive to that and they understand it,” he said.

Halverson remains skeptical a tenant could hold their own without a lawyer, and she points to her own dispute as proof. The Woodstock couple hired Buttitta to represent them against Woodstock-based Advantage Plus. Earlier this month, they filed a 61-page defense and counterclaim.

While the couple await a response, they’ve started slowly packing up their home and searching the market for a place – although they aren’t sure yet when the time to move will come.

“It throws your life into turmoil,” Halverson said. “It’s very stressful and it’s emotionally draining because you don’t know from one day to the next what you’re going to be handed.”

During trial, Signorile’s public defenders argued Mathieu was an alcoholic and her injuries were the result of seizures and falls.

Kenneally called it a “comically bad defense.”

“It’s evident that alcohol did play a negative role in his life and put him in the position that he’s in today,” Assistant Public Defender Angelo Mourelatos said.

Signorile will be in his 80s by the time he’s released from prison. He previously rejected the state’s offer of 25 years.

He’s already filed an appeal.
