Sycamore arson suspect held on $300K bond

Man told police he’s an alcoholic, set fires to release anger

browland@shawmedia.com SYCAMORE – A man charged with arson in connection with five dumpster fires in the area told police that he’s an alcoholic and that he set the fires as a way to release his anger.

Wlady H. Teran, 49, of the 1500 block of West Stonehenge Drive, Sycamore, was charged with five counts of arson, five counts of criminal damage to property and a single court of trespassing. If convicted of a single count of arson, a Class 2 felony, he could face three to seven years in prison.

Sycamore police officers arrested Teran on Sunday after he Wlady H. set two fires within three hours, Teran according to police reports and court documents. Sycamore officers and firefighters responded to the a report of a fire in a dumpster in the 2600 block of DeKalb Avenue just before 10:30 a.m. Sunday. Officers determined the fire had been set intentionally. Shortly after 1 p.m. the same day, officers were called to another waste bin fire in the 2600 block of DeKalb Avenue.

Officers discovered Teran near the scene of the second fire and arrested him.

After further investigation, Teran was connected to other dumpster fires Sept. 9 and June 24. After being read his rights, Teran told police that he set fires at a dumpster behind Braden Counseling, two dumpsters behind the shopping center where Hy-Vee is located,

SLOW TRAIN CROSSES MARATHON COURSE, HURTS QUALIFYING TIMES

ALLENTOWN, Pa. – A slow-moving train in Pennsylvania might have brought some runners’ dreams of the Boston Marathon to a halt.

Lehigh Valley Health Network’s Via Marathon was in full swing Sunday when a slow train crossed the race course near Allentown, stopping runners in their tracks.

Runner Charlie Young told Lehigh Valley Live the race was his last chance to qualify for the 2017 Boston Marathon.

Teran told police that he’s an alcoholic and has been upset recently. He also said setting fires was a way to release his anger.

Sycamore Deputy Police Chief Jim Winters said many of the dumpsters were near other buildings where people were present. The total damage from the fires was estimated at more than $3,500, he said. Dumpsters cost about $900 to $1,000 each. Some fencing also was damaged.

Winters said surveillance video played a role in helping investigators solve the crimes.

He said it should serve as a reminder to businesses to properly maintain such equipment and make sure that the video equipment works as intended.

The Sycamore Police Department was helped in the investigation by the Sycamore Fire Department and the DeKalb County Sheriff’s Office, Winters said.

The case remains under investigation.

In court Monday, Assistant State’s Attorney Timothy Mandel asked Judge Marcy Buick to set bond at $75,000. He cited Teran’s prior criminal history and his history of failing to appear in court when ordered to do so. On the other side, DeKalb County Public Defender Tom McCulloch told the judge that Teran’s previous felony criminal history was 17 years old.

Buick ordered bond set at $300,000 – four times the amount Mandel had requested. He remained in DeKalb County Jail as of Monday evening.

Teran is next due in court Sept. 27.

The 22-year-old Young said he and over 100 others were held up for about 10 minutes as the train crossed. He says he missed his qualifying time by 8 minutes.

Registration for the Boston Marathon started Monday, opening first to those who beat their qualifying time by 20 minutes.

Barbs, Spartans up ante with annual First National Challenge game

gillespie@shawmedia.com DeKALB – Kickoff will have a bit more at stake Friday when DeKalb and Sycamore hit the gridiron as part of the highly anticipated annual First National Challenge game and fundraiser.

There will be a friendly – and cool – $1 million on the line as the schools’ sophomore football game kicks off at 5 p.m. and the varsity gets going at 7 p.m. at Huskie Stadium. The money is the amount the fundraiser will have collected in the 17 years that it has been going, said Gary Evans, event co-chairman.

After raising more than $50,000 last year and $30,000 to $85,000 in each of the previous years, Evans said the First National Challenge is only about $35,000 away from hitting that $1 million mark, and fingers are crossed that the goal will be met.

“This has been a very unique fundraiser over all these years,” Evans said. “We’ve had some wonderful sponsors, and people have donated a lot of money.”

This year, organizers are hoping for even bigger crowds, greater community support and an uptick in sponsors as part of the fundraising effort that takes place for both the DeKalb and Sycamore high school football and basketball seasons.

Sycamore has won 13 of the 16 meetings since 2000, when the game found a sponsor and became the Castle Challenge. DeKalb has won the past two games, however, including a 31-28 win last year on a late field goal by then-freshman kicker Connor Tierney. The game was played at DeKalb’s field instead of Huskie Stadium because lightning the night before pushed the game to Saturday.

The First National Challenge, formerly known as the Castle Challenge, is expected to draw the usual large crowds, and Evans said about 95 sponsors already been have secured.

The money raised helps booster clubs at both schools. All of the sports teams can benefit from the money.

“They all get a little piece of [money raised] to help them buy things that they could use,” Evans said.

Rochelle restaurant was destroyed in tornado that later hit Fairdale Grab some grub

eolson@shawmedia.com ROCHELLE – It was a long 17 months for Ava Mirtoska, owner of Grubsteakers Restaurant.

The business she’s run for almost 12 years was destroyed by a tornado on April 9, 2015, the same storm that later tore through Fairdale in northwestern DeKalb County, where it destroyed several homes and killied two people.

After more than a year of working part-time jobs and contract work, Mirtoska recently reopened Grubsteakers in a new building at the same location at the northeast corner of Routes 64 and 251. It’s been a pleasure to be reunited with regulars, who begin arriving when the restaurant opens at 6 a.m.

“Pretty much all of them have been here, and they’re glad to be back and they’re very happy to be back to home,” Mirtoska said said from the restaurant Thursday afternoon, the sound of dishes and flatware audible in the background. “That’s what all of them pretty much tell me, our home is back to normal now.”

For Mirtoska, the feeling is mutual.

“I’ve been in the place close to 12 years, I really like to be here and it makes me feel good to be around family,” she said. “This is my family.”

The restaurant, several vehicles in its parking lot, and several nearby homes were smashed by the twister before it moved on to Fairdale, destroying farm buildings and homes along the way.

About a dozen people rode out the storm with only minor scrapes and were rescued a couple of hours later by firefighters.

The community pitched in with several fundraisers to help with rebuilding costs.

The restaurant’s new floor plan resembles the one its customers grew to love, along with more seating, a bigger bar area and larger bathrooms.

Debris from the restaurant was scattered by the EF4 tornado, with signs, credit-card receipts and menus being found as far as 60 miles away. Mirtoska said some people have returned items to her, but she hasn’t really incorporated anything from the old place into the new building.

The menu does include a few new items: a tornado burger, tornado skillet, and even a tornado waffle with fruit, whipped cream and chocolate syrup.

“It’s a lot better,” Mirtoska said. “It fits more people now, and of course everything is new.”

One customer who Rochelle police say did not go into the cellar was 68-year-old Michael McDonald of Whiting, Indiana, who would later be charged with stealing almost $1,000 from the restaurant’s cash register that night. McDonald pleaded guilty and was sentenced to 18 months supervision earlier this year.

Pepperdine told a Sandwich Fire Department EMS member that he was an EMS worker while at the fair and reporting a woman who was unresponsive or in need of medical attention, according to court documents.

Pepperdine is not an EMS worker, according to the news release.

Pepperdine also was ticketed for possession of less than 2.5 grams of marijuana and possession of drug par-

aphernalia, according to court records.

In 2009, Pepperdine was charged with falsely impersonating a police officer. He later pleaded guilty and was sentenced to jail, according to DeKalb County Circuit Court records.

Assistant State’s Attorney Timothy Mandel told Judge Marcy Buick that Pepperdine also had a 2006 traffic offense that involved the use of blue oscillating lights.

Buick set bond at $4,000.

Pepperdine is next due in court Oct. 4.

OBITUARIES GLENN U. PORTER

Born: June 1, 1952 Died: Sept. 10, 2016

Glenn U. Porter, 64, of DeKalb, IL, died Saturday, Sept. 10, 2016, at Kishwaukee Hospital.

Born June 1, 1952, in Sycamore, IL, he was the son of Walter and Barbara (Miller) Porter. Glenn married Susan Stewart on Feb. 14, 1974, in Sycamore.

Glenn was a graduate of DeKalb High School, Class of 1970. He was employed by Johnson Controls for more than 25 years.

Glenn enjoyed his motorcycle, camping and bowling.

He is survived by his wife, Susan; his children, Walter (Jennifer) Porter of Belvidere, and Toni Porter of Temple, TX; nine grandchildren; two sisters, Peggy (Les) Smelcer of Bean Station, TN, and Pam (Clayton) Ile of Russellville, TN; several nieces and nephews and great-nieces and -nephews; and his four legged companions, Polly, Beulah and Mr. Bently.

He was preceded in death by his parents.

The funeral service will be at 1:30 p.m.

Friday, Sept. 16, 2016, at Anderson Funeral Home in DeKalb, with the Rev. Eric Wyzard of the Cathedral of Praise officiating. Burial will afterward at Fairview Park Cemetery in DeKalb. Visitation will be from noon until the time of services, Friday, at the funeral home.

Marjorie Gladys Sweet, 88, of Sycamore, IL, died peacefully in her home Wednesday, Sept. 7, 2016.

She was born March 24, 1928, in Bradford Township, Rock County, WI, to Raymond and Gladys (MacArthur) Clowes. She married John Franklin Sweet on April 28, 1946, in Evanston, IL. He preceded her in death July 18, 2000. While in high school during World War II, she worked in a factory making anti-aircraft shells, then she worked with her husband in the construction and operation of various A&W drive-in restaurants in Illinois, Iowa and Pennsylvania. She also was a secretary for her husband’s real estate business. Marjorie was the family historian, loved reading, gardening, and feeding backyard birds.

Survivors include her sons, John F. Sweet, Jr. of Sycamore, IL, and Michael J. Sweet of Lakeville, MN; her daughter, Barbara Sweet of Arlington Heights, IL; granddaughter, Amber (Andrew) Nelson; grandson, Scott Sweet; great-grandson, Matthew Sproull.

She was preceded in death by her parents; her husband, John; three brothers, Laurel, Calvin and Gordon Clowes; two sisters, Ruth Singletary and Anita O’Donnell.

The family would like to thank Journey Care Hospice for their loving care and support for Marjorie.

Kishwaukee College eyes $31.4 million budget

rgillespie@shawmedia.com DeKALB – The public will be able to give input at a public hearing Tuesday on Kishwaukee College’s proposed $31.4 million fiscal 2017 budget.

The hearing is on the agenda for the college’s board of trustees regular meeting, which will be held at the college. The proposed budget has been on display since July, college officials said.

According to the spending proposal, the college is expecting a dip in general operating revenue, anticipating it would go from $23.2 million in the current budget to $20.4 million.

The fund is used for such things as salaries, and college operations and maintenance.

Overall, the new budget indicates a $809,000 deficit for the college, which laid off 24 employees in March citing financial problems. However, the employees were paid through June 30.

in state aid expected, and as enrollment in the two-year college continued to decline.

There have been other personnel changes at the college, including several resignations, promotions and new positions created. Also, tuition increased starting this past summer semester.

Kishwaukee College President Laurie Borowicz told trustees at previous meetings held this summer that her administration would be researching and implementing austerity plans, including tackling the schools yearslong enrollment declines and seeking more public-private partnerships.

rgillespie@shawmedia.com DeKALB – The city approved the last request for video gaming licenses for a while Monday, after aldermen agreed to a moratorium on them until March.

“I have concerns about the density of gaming businesses. … They seem to be coming up more frequently,” 5th Ward Alderwoman Kate Noreiko previously had said. She echoed that Monday.

The city has approved about 100 terminals in 20 establishments in DeKalb since it started granting licenses in 2013. The latest count came after the City Council approved at its

regular meeting Monday a second request from owners of Lucky Poker to license five devices at the 3260 Sycamore Road location in DeKalb.

“This is the last of three requests” that had been pending before talk of halting approvals intensified, City Manager Anne Marie Gaura said Monday.

But there will be no more before March 13, 2017 – the first council meeting scheduled for that month.

Aldermen voted 6-1 on that, with 1st Ward Alderman Dave Jacobson abstaining because of what he called a potential conflict of interest.

The six-month moratorium is designed to give aldermen a chance to put before the city planning and zon-

ing committee the issue of where establishments with the devices should be located. Also, aldermen said they want to hear – through public hearings – what the public has to say on the issue.

“I don’t think anything longer than that would serve anyone’s purposes,” 6th Ward Alderman Dave Baker said.

The time frame also ensures that the current contingent of aldermen will deal with the issue, the elected officials collectively agreed, instead of it possibly being passed on to any new aldermen who may join the council as a result of the April 2017 election.

The council engaged in a nearly hourlong discussion on the issue.

Talks were kicked off early in the meeting when one resident suggested that aldermen change the order of the agenda to consider the moratorium before voting on Lucky Poker’s latest request.

“You’re not obligated to pass the permit [request] just because it’s in the pipeline,” said resident Steve Kapitan, a former alderman.

But the meeting followed the original agenda flow, and the moratorium was voted on after the last license request was approved.

City Attorney Dean Frieders said that the moratorium means that the City Council would not approve or consider any more license requests until it is lifted.

Former DeKalb poultry research farm given historical marker

news@daily-chronicle.com DeKALB – A state historical plaque marking the original site of the DeKalb Agricultural Association poultry research farm was dedicated Tuesday on Roberts Lane in DeKalb, near the intersection of Oakland Drive.

At this site in 1944, Tom Roberts Sr. and Ray Nelson of DeKalb Ag established a research farm to study how to boost egg production by using the genetic principles of hybridization that they had successfully applied to corn.

The farm is now the site of the Oak Crest-DeKalb Area Retirement Center.

The marker is seventh in a series planned around the county by the DeKalb Area Agricultural Heritage Association.

Among those speaking at the ceremony were William Furry of the Illinois State Historical Society, state Rep. Bob Pritchard, DeKalb Mayor John Rey, Doug Roberts of Zea Mays Holdings LLC, Steve Cichy of Oak Crest, and moderator Norm Larson of DAAHA.

City, police investigating Bloomington coliseum management

BLOOMINGTON – City officials in Bloomington said they’re working with Illinois State Police to investigate past operations at the city-owned U.S. Cellular Coliseum.

The venue seats up to 8,000 people and hosts concerts and sporting events.

It opened in 2006. On Monday, city officials said in a news release that the investigation focuses on the venue’s operations before the facility’s current management company took over.

Bloomington Mayor Tari Renner said questions surfaced while the city was closing out financial paperwork during the management transition. Central Illinois Arena Management operated the facility from its 2006 opening until March 31, when the company’s contract expired.

The city signed a five-year management contract with new manager, VenuWorks, in June.

Illinois State Police said the investigation is ongoing and had no comment.

American man arrested in Nepal on charges of child sex abuse

KATHMANDU, Nepal – An American who has been a frequent visitor to Nepal has been arrested in the capital’s tourist district on charges of sexually abusing children.

The Central Bureau of Investigations said in a statement Monday that Kenneth Joseph Coombs and a local man arrested with him were being held for further investigation.

Five boys were rescued after police raided Coombs’s hotel room in Kathmandu over the weekend. The raid was initiated after police got information from boys who had been abused there.

Police said Coombs, 48, was from Illinois and had last entered Nepal on Aug. 23.

Other details were not given because the case involved underage victims.

SPRINGFIELD – For the first time in recent history, Illinois Republicans are vastly outspending Democrats in fall legislative races with the help of a wealthy governor determined to curtail a traditionally blue political landscape that has thwarted his agenda for two years.

The more than $13 million the GOP’s main campaign committee has disbursed to House and Senate candidates so far – nearly all of it coming from Republican Gov. Bruce Rauner – dwarfs what either party has been able to spend sometimes in entire election cycles. And the Illinois Republican Party Committee still has $3 million from Rauner in the bank.

“This is a new ballgame and we’re taking it very seriously,” said Rep. Barbara Flynn Currie, the Democrats’ House leader.

Infusions of cash from the former venture capitalist demonstrates how much – and how easily – he’s willing to invest in pursuit of his goal to give his party greater influence in the state Legislature.

The November results could determine the fate of Rauner’s proposals to weaken unions, pass business-friendly laws, impose term limits, and change

state House speaker, Michael Madigan, who has held that post for all but two years since 1983. When Rauner was elected, he became the first Republican in 12 years in Illinois, a Democratic stronghold that hasn’t backed a Republican for president since 1988.

Before Rauner, the Illinois Republican Party Committee spent $3.4 million on races in 2012. The Democratic Party of Illinois, meanwhile, spent $6.7 million. Both parties distribute money to candidates through several other committees so those totals don’t tell the entire story, but they’re indicative of each party’s past spending prowess, according to campaign disclosures The Associated Press analyzed dating back to 2006 from the Illinois State Board of Elections.

“There’s never been a time in recent history where House Republicans have outspent House Democrats. It’s been a considerable disadvantage,” said Rep. Jim Durkin, the GOP’s House leader.

Breaking the Democrats’ supermajorities in either chamber won’t be easy because the party enjoys advantages of 71-47 in the House and 39-20 in the Senate. But Durkin said Rauner’s money “for the first time in many years gives us a fighting chance.”

Rauner has repeatedly declined to comment on the legislative races or his involvement in them.

Clinton scrambling to head off weekend fallout

The Associated Press WASHINGTON – Hillary Clinton’s campaign is scrambling to head off lasting damage from her brutal weekend.

Aides are promising to release more of her medical records after her bout of pneumonia and conceding they were too slow in providing information about her condition.

Democrats said Monday that Clinton’s health incident alone is unlikely to fundamentally alter the presidential race, but some also said it adds to a growing sense of uncertainty less than two months from Election Day. For many supporters, Clinton’s battle with Republican Donald Trump is worryingly close, raising concerns not only about holding the White House, but also retaking control of the Senate.

“If you look at the way the last couple months have gone, it feels like the race should be further apart,” said Greg Haas, an Ohio-based Democratic strategist and former county party chairman.

Aaron Regunberg, a Democratic state representative from Rhode Island, said he was “surprised and concerned” that the race is so tight.

“I still think that we are likely to win, but I think anyone who’s not concerned about a bigoted, KKK-endorsed sociopath being this close right now in the polls is not living in reality,” Regunberg said of Trump.

After a staff shake-up in August, Trump has largely abandoned the free-wheeling style of campaigning that energized his supporters but also led to an endless string of controversial comments about women, minorities and others. The Republican nominee’s newfound ability to stay on script has coincided with tightening in both national polls and surveys in some key swing states.

Democrats are also warily watching a Senate landscape that looked to be favorable for the party if Trump proved to be a drag on GOP candidates.

But Rob Portman in Ohio has distanced himself from Trump and appears headed for re-election, and Republicans are also feeling more confident in Florida since Marco Rubio reversed course and decided to run for re-election.

“The last few days feed into a sense of uncertainty,” said Chris Kofinis, a Democratic strategist. He said Clinton’s rough weekend raises the stakes for the first presidential debate on Sept. 26, which “will either finish Trump or, if he does well, it will create a race.”

Leadership is key to success As the start of football season is upon us and baseball playoffs are quickly approaching, it makes me think about how these teams are put together.

Being a diehard Cubs fan, this is a very different feel. It’s normal not to be in a playoff run in September, but not because they are more than 15 games ahead of the nearest competitor. The Cubs took the approach of bringing in leaders to rebuild the franchise with a plan.

Northern Illinois University football went through a similar situation in the late ’90s. Put together a plan and stick to that plan to achieve the required results. DeKalb High School football spent 20 years without a visit to the playoffs and is coming into the season with back-to-back appearances in the playoffs. Coach Matt Weckler came in with a plan and has his players buying into that plan to accomplish their team goals.

One thing all of these have in common is that it wasn’t always easy to see the success at the other end of this plan. Trust and buy-in by those involved was key to the ultimate success of these teams. Another common key was they were all created by strong leaders. Taking a situation that is less than ideal and turning it around is something that requires strong leadership as the first ingredient.

Donald Trump’s immigration hypocrisy

A month ago, Donald Trump and officials in his campaign assured voters they would organize a news conference to clear up questions about the legal means by which his Slovenian-born wife, Melania, entered the country in the mid-1990s and obtained a green card several years before they were married in 2005.

Those questions persist, the Trump campaign has refused to answer them, and no such news conference has occurred.

Melania Trump insists she violated no immigration laws; that may prove to be the case. Yet her own sketchy and not-quite-consistent account of her initial immigration status, along with the publication of nude modeling photos of her taken in New York the year before she says she entered the country, have combined to stoke doubts that she played entirely by the rules.

If she didn’t, some sympathy may be in order. U.S. immigration laws are so abstruse, so dysfunctional and so out of step with the demands of the American labor market that – well, it’s no accident that 11 million people live in this country without proper documentation, and that many or most of them have been here for 15 years or longer.

Less sympathy would be due Donald Trump, who, having built his campaign around vilifying illegal immigrants, looks like a Grand Wizard of Hypocrisy. And having spent months as the most prominent exponent of the detestable “birther” movement, badgering the president to release his plainly valid and unexceptional birth certificate, the Republican presidential nominee now can’t be bothered to come clean on legitimate questions about the terms under which his wife entered the country and remained here.

Trump’s two-facedness on immigration doesn’t end there. As a developer, he employed and may have exploited undocumented immigrants to work on at least one of his most prominent projects, Trump Tower in New York. He has attacked the United States’ main visa program for highskilled workers, calling it a job killer and vowing to end it with “no exceptions,” but his own companies have used it liberally to import hundreds of foreign workers, including fashion models.

Of course, Trump and hypocrisy have long been on intimate terms. Although he has invested overseas in an array of businesses and projects, he thinks nothing of bashing other U.S. companies for launching plants and operations abroad. A champion of “traditional” marriage, he has tried it three times. And then there are his claims about charitable giving, which, upon close examination by The Washington Post, look wildly inflated.

Melania Trump, like many an immigrant, may be reluctant to delve too publicly into the details of her earliest days in the United States. Yet it is Donald Trump’s own double standards, on immigration and other issues, that invited questions – questions he himself said publicly would be addressed. The country is still waiting.

Illinois’ expensive prison problem Concerned about overcrowded prisons, Gov. Bruce Rauner appointed a commission to study the issue and make recommendations on how to reduce the state’s prison population by 25 percent over the next decade.

The commission issued its report earlier this year. Its recommendations included giving judges more discretion in fashioning probation sentences rather than prison, expanded use of home electronic monitoring and offering more educational programs and drug abuse and mental health counseling.

There was nothing groundbreaking in the report, just the usual alternatives to prison.

The commission’s report received a warm public reception.

After all, who really wants to see large numbers of people – 48,921 in June 2014 – in prison if there is a better way to address law enforcement and public safety issues?

But people are conflicted.

Recently, Chicago Police Superintendent Eddie Johnson called for a special legislative session to pass tough sentencing laws for gun-law violations. Attempting to cope with a weekly slaughter of citizens in his city, Johnson said it’s time to crack down on gun-law violators.

“Until repeat gun offenders recognize we’re serious about holding them accountable, we’re going to continue to see this gun

violence,” he said.

The “lock ’em-up, don’t lock ’em up” debate has been ongoing for decades, attitudes shifting in response to events.

It’s a vexing problem that has defied permanent solution.

Inmate-advocate groups were thrilled with the recent news that the state’s inmate population has dropped by 4,261 since the 2014 fiscal year – it was 44,680 as of July 1.

But Jennifer Vollen-Katz, executive director of the John Howard Association, had no ready explanation for the drop.

State officials were similarly flummoxed by the decline, candidly explaining that no one has a ready explanation.

Two factors drive prison population – admission numbers and length of stay.

The Illinois Sentencing Policy Advisory Council, a unit inside the Corrections Department, collects a mountain of statistics identifying who is in prison, why they are there and for how long.

As of June 2013, 39 percent of Illinois inmates were in for committing murder or Class X felonies. Obviously, they’re not going anywhere anytime soon.

The lower-hanging fruit is reflected by Class 3 and 4 felons.

They make up 21 percent of the prison population.

The state could let them go to reduce the numbers. Or could it?

Although less serious offenders, Class 4 felons – repeat shoplifters – are not strangers to the criminal justice system.

Accounting for six of every 100 inmates who left state prison in fiscal 2009, they have extensive criminal histories.

Drug felons represented 26 of every 100 felons released in fiscal 2009.

The average drug offender is 31, has been arrested 18 times for a variety of offenses and serves six months in prison.

Once released, he can be expected to be re-arrested three times over the next three years.

These profiles pretty much blow up the widespread impression among the uninformed that Illinois prisons are full of otherwise stalwart citizens busted for holding a few grams of marijuana. It just ain’t so.

Prison numbers and demographics mostly reflect a problem driven by poverty, lack of education, family disintegration, mental health, and drug and alcohol abuse.

It’s fine to say judges should have more discretion, that penalties should be reduced and that more sentences of probation, rather than incarceration, should be ordered.

They usually are for firsttime offenders. But what about those who are back in court time after time after time?

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Don’t trust the polls, trust their average

Yes, it’s time for a back-to-school refresher class on how to read the presidential polls, which at this point are good indications of what will happen in November.

First assignment: What to make of the CNN poll released last week showing Donald Trump coming out on top, by two percentage points, over Hillary Clinton among likely voters.

You’ve heard it a million times from me and others (such as political scientist Matthew Dickinson and number-cruncher Harry Enten): Look at the polling averages, not individual surveys.

As Greg Sargent at the Plum Line explained it: “Surprising poll results can either be outliers, or can reflect statistical noise or short-term fluctuations. Fortunately, we have a remedy for this: The polling averages, which have

massive samples that cover longer periods of time and help screen out the noise. Depending on who is doing the averaging, Clinton is up by three (The Upshot), four (Real Clear Politics), or five (Huffpollster).”

Those are the main numbers needed to make sense of what’s happening.

And they show what they’ve shown throughout the campaign: Clinton remains likely – not certain, but likely – to win.

Looking at individual states and the Electoral College implications right now is more likely to confuse than enlighten. Yes, first-rate projection sites such as Drew Linzer’s at Daily Kos and Nate Silver’s FiveThirtyEight use predictions for each state, but be careful when trying to interpret any individual state’s poll.

Again, polling averages for states tell us more than any specific survey, and even then these averages can be misleading because there are fewer polls (and sometimes very few quality

ones) in many states.

It’s still the case that the national estimates tell us what we need to know, because the winner of the national vote will almost always win the electoral vote. If there is a popular vote vs. electoral vote split, it’s still too early to see whether one party has an electoral-vote advantage.

Remember: Man-bites-dog stories always get more coverage, so “surprising” results such will always get the attention.

And probability theory tells us that we absolutely should expect goofy-looking statistical fluctuations from time to time.

Yes, surveys can sometimes spot something new that is happening with the electorate. But there’s just no way to know from a single poll whether such a thing is really happening.

Individual polls, even from quality pollsters, could be poorly done, introducing more error. Some Democrats

on Twitter recently were going after the CNN poll, just as Republicans have gone after surveys that are good for Clinton. Polling is hard, especially since the response rates are so small these days. It has always been as much art as science, and it involves all kinds of debatable choices.

But questioning the methodology is the wrong way to respond to a poll with unwelcome results. Going down that path – carefully scrutinizing every result one doesn’t like – is certain to lead to biased results.

The right way to deal with a (seemingly) weird poll is the same way one should deal with every poll: Toss it into pool with all the others, and look at the averages.

Trump’s call for more high-skill immigration Would he go hard or go soft? That was the mainstream media template for judging Donald Trump’s speech on immigration Wednesday in Phoenix.

The verdict: hard. “How Trump got from Point A to Point A on immigration,” was the headline in the Washington Post’s recap.

Similarly, the often-insightful Talking Points Memo blogger Josh Marshall characterized Trump’s discourse as “hate speech.” “Precisely what solution Trump is calling for is almost beside the point.”

That’s precisely wrong. Marshall found the Phoenix crowd’s raucous shouts distasteful, and so did I. But a search through Trump’s prepared text and his occasional digressions fails to disclose anything that can be fairly characterized as “hate speech.”

Instead it discloses some serious critiques and proposals for recasting our immigration laws, which almost everyone agrees need changing.

Start near the end, with the 10th of Trump’s 10 points. He notes that we’ve admitted 59 million immigrants since the last major revision of immigration law in 1965, and that “many of these arrivals have greatly enriched our country.” No asides about criminals or rapists.

Then he proposes a major policy change: “to select immigrants based on their likelihood of success in U.S. society, and their ability to be financial-

VIEWS Michael Barone ly self-sufficient ... to choose immigrants based on merit, skill and proficiency.”

That’s not racism or hate speech, and it’s not out of line with American tradition.

Emma Lazarus’ oft-quoted poem commends America for welcoming “your tired, your poor, your huddled masses” and “the wretched refuse of your teeming shore.” But during the great wave of immigration from eastern and southern Europe from 1892 to 1914, the Ellis Island inspectors, in line with national policy, excluded those deemed incapable of supporting themselves as well as those with communicable diseases.

And the U.S. deported immigrants judged to be terrorists.

American immigration policy even then wasn’t completely open door.

Trump seems to be calling, in nonprovocative language, for changing immigration law to give priority to high-skill immigrants, as do the immigration laws of Canada and Australia.

That’s not racist: Those countries admit plenty of nonwhites. But they do required proficiency in English (or French in Canada).

Both have higher foreign-born

percentages of population than the U.S., and both have students who score higher on PISA international achievement tests than U.S. students do. No wonder a diplomat from one of those countries told me, half in jest, “Please do not adopt our immigration system.”

Every serious expert concedes that the 1965 immigration act resulted in an unexpected huge flow of low-skill immigrants, especially but not only from Mexico. Most serious scholars agree that has tended to reduce, at least a little, wages for low-skill Americans.

Do we really need another inrush of unskilled workers in the next few decades?

Near the beginning of his speech, Trump said, “The media and my opponent discuss one thing, and only this one thing: the needs of people living here illegally.”

That’s an exaggeration, but not by much: mainstream media judges Trump hard or soft depending on what he says about illegals. “The central issue is not the needs of the 11 million illegal immigrants – or however many there may be,” he went on. “The only one core issue” is “the well-being of the American people.”

To some, this sounds like bigotry, prejudice against foreigners, a preference for a mostly (but far from totally) white populace over a vastly larger (and mostly nonwhite) humanity.

They instinctively prefer Hillary Clinton’s version of open borders,

allowing anyone who gets here and isn’t criminally convicted to stay.

Trump’s answer came earlier in the day, in Mexico City, as he shook hands and spoke cordially with President Enrique Pena Nieto. I like and admire him, Trump said; he loves his country and I love mine. Nieto’s invitation, much criticized in Mexico, was prompted by his need to get along with whoever is elected U.S. president. That need likewise prompted his cautious remarks about Trump in a joint news conference with President Barack Obama earlier this summer.

Trump’s threats of trade retaliation and suggestion he might not honor NATO obligations provide rationales for voting against him as irresponsibly reckless. His immigration proposals don’t.

His proposals for visa tracking and E-Verify validation of job applicants – similar to Marco Rubio’s – would marginally reduce the illegal population, as would his deportation of some illegals.

More important, though ignored by mainstream media, is that his policies would produce more high-skill immigrants and Hillary Clinton’s plan would produce more low-skill immigrants.

WHAT DIRECTION NOW? Huskies face crossroads after 0-2 start following loss at South Florida

TAMPA, Fla. – Being in Florida, it felt right to have an orange.

It was the best response to be in the Sunshine State, so early in the third quarter I started to peel an orange.

As South Florida rained touchdowns on the Huskies in the second half, I looked to the right side of my computer, and there were orange peels stacked on top of a plate – and it was a perfect metaphor.

The Orange Bowl appearance in 2012 must feel like ages ago for Huskie fans – nothing more than ripped-apart peels on an empty plate.

The Northern Illinois Huskies are 0-2; and considering they face San Diego State (2-0) in the home opener,

VIEWS Jesse Severson there’s a real chance they will lose their first three games to start the season.

They haven’t lost the first three games of the season since 2007, when they went 2-10.

There’s a lot of commotion with fans, but one thing is certain: The Huskies no longer are the darlings of the Power 5. They had a good run while it lasted, but all of the attention and all of the goals are now on winning a

seventh consecutive Mid-American West championship.

Central Michigan just knocked off a top 25 team – granted, on poorly regulated rules – and Western Michigan and Toledo are off to a hot start. This could be the toughest year yet for the Huskies to get to Detroit.

Starting quarterback Drew Hare is, tragically, likely out for a long time with an ankle injury, so making the MAC Championship again probably would be a big accomplishment. There are reasons for optimism – wide receiver Kenny Golladay is really good, the defense could turn around, the run game can’t be this poor the entire year – but there’s a real question facing the

Huskies this year if all of those good vibes don’t come through.

Is this Northern Illinois’ fall from grace?

After that 48-17 loss Saturday to the Bulls, the players and NIU coach Rod Carey were singing the same tune: It’s two games, and the whole season is ahead of them.

That’s really true, actually.

They lost a weird, heartbreaking game at Wyoming to start the year – a game they probably should have won.

South Florida, which features 96 players from the coveted Sunshine State, seemed to have too many athletes for

Continued from page 15 the Huskies. That makes sense. If they are to lose against San Diego State, which features mostly players from the other coveted recruiting state of California, maybe that isn’t NIU against the rest of the world.

It comes down to the MAC against the other conference.

It’s really hard to recruit players from sunny states to come to the freezing cold, and the truth is that the Huskies may have caught lightning in a bottle having Chandler Harnish and Jordan Lynch back to back.

So the Northern Illinois fan base must be broken into two camps.

The first argument is that since the Huskies have proved themselves to be a 10-pluswins-a-year team, that expectation must stay the same. The Huskies have reached that point, so it only makes sense that they can stay at that point. Since Carey has gone 8-6 last year and 0-2 – possibly 0-3 – to start this year, he has to go. That’s a real vibe with some fans, who see the ice beginning to crack around him.

The other argument is that Northern Illinois every college football team has its football coach hills and valleys, that the Huskies Rod Carey can still own the MAC and – at the level Northern Illinois is at – the conference title is the most important aspect of success. Northern Illinois already has trouble drawing fans at Huskie Stadium, so maybe it is better to focus on getting trophies and be a bigger fish in a smaller pond right now. The Huskies have lost five straight dating back to last year, but Carey still has the second-best win percentage of any NIU coach in school history – and has won three straight MAC West titles.

GENOA – A hat trick by Cesar Velazquez led the way Monday as the Harvest Christian Academy boys soccer team defeated the Genoa-Kingston Cogs, 4-0.

“I was looking for the inside cross today,” Velazquez said. “I was looking for [passing] lanes, and I ended up with three goals instead. Our defense is maturing more and more, and instead of being a team, we are becoming a family.”

Harvest Christian Academy was able to dictate much of the pace and style of play to the Cogs (6-3) for what seemed like the entire game. Cogs coach Randy Tate was not happy with his team’s energy level from the opening kick.

“It started right from the beginning,” Tate said. “Sometimes, when you have a Monday game and you have the weekend off, you come out flat. Today, we came out uninspired, flat and with no energy. We let them dictate the game, and they’re a good enough team that they took it to us.”

The Lions (4-1) were able to play most of the game in control of the ball and on the Cogs’ half of the pitch. Coach Sina Vitic chalked Monday’s win up to the way his team prepares.

ST. LOUIS – Kyle Hendricks took a no-hitter into the ninth inning before giving up Jeremy Hazelbaker’s leadoff homer, and the Cubs beat the St. Louis Cardinals, 4-1, Monday night to close in on the NL Central crown.

Hazelbaker drove an 0-2 pitch into the right-field stands for his 12th home run. Hendricks (15-7), the major league ERA leader at 2.03, was relieved by Aroldis Chapman.

“Just left that one up right there. What are you going to do?” Hendricks said.

Ben Zobrist and Dexter Fowler homered for the Cubs, who lowered their magic number to three for clinching the division title.

They lead the second-place Cardinals by 17 games and can wrap up the NL Central with a three-game sweep in St. Louis.

Soon after Hazelbaker’s shot cleared the fence, teammates went to the mound to talk to Hendricks – leading to an argument between Cubs manager Joe Maddon and plate umpire Joe West.

“I made a lot of good pitches,” Hendricks said. “I probably made four or five bad pitches, just kind of one of those nights where you get away with them.”

The last time the Cubs won a division title was 2008. They did it by beating St. Louis on Sept. 20 at Wrigley Field.

Gibbs Racing again favored CHARLOTTE, N.C. – The odds are stacked once again for Joe Gibbs Racing, the team with all four of its drivers in NASCAR’s playoffs.

Throw in Martin Truex Jr., who is aligned with the team, and the numbers point to a Toyota winning the Chase for IN THE the Sprint Cup championship PITS for a second Jenna consecutive Fryer year.

Kyle Busch gave Toyota its first Cup title last season, and the first championship for team owner Joe Gibbs in a decade. His bid to repeat begins Sunday at Chicagoland Speedway in Joliet, where the 10-race Chase begins.

His top competition could again come from within his own organization.

Including Truex, who drives for Furniture Row Racing in an alliance with JGR, the five Toyota drivers have combined for 13 wins through the first 26 races. They’ve led more than 4,000 laps and again routed the field in the regular-season finale at Richmond by leading 385 of 407 laps in a Denny Hamlin win.

So can anyone beat their effort?

Well, Gibbs isn’t preparing any championship speeches just yet.

“There’s so many, I think, well prepared cars. This is going to be a battle,” Gibbs said. “There’s no way that you can pick a favorite right now. Everybody that’s in there is going to have a shot.

He doesn’t have the finishes to show for how good he’s been, but Harvick’s 1,211 laps led this year trails only Busch (1,244) and Truex (1,234).

He also leads the series in top-five finishes (13) and top10s (21).

There’s nothing at all to suggest Harvick won’t be in the final four at the Nov. 20 finale at Homestead-Miami Speedway. He made it last year, only to finish second to Busch in his bid to repeat his title.

Few are as hell-bent on winning as Harvick, who takes no prisoners and spares no feelings in his pursuit of a title.

• BRAD KESELOWSKI and JOEY LOGANO: There’s no

Keselowski had six wins in 2014 and a strong Chase until a mechanical failure in the first race of the third round put him against the ropes. A pair of top-four finishes wasn’t enough to get him into the finale, and he settled for fifth in the final standings.

Last year was Logano’s year, and he seemed unbeatable, particularly when the Chase began. As with Keselowski the year before, he also won six races, including three straight in the Chase.

But a feud with Matt

Kenseth that wouldn’t go away blew up badly at Martinsville Speedway (same place as Keselowski’s problem a year earlier), and Kenseth intentionally wrecked Logano in a race Logano seemed poised to win.

Logano didn’t recover and failed to make the finale as Penske was denied in yet another season it had dominated.

• KYLE LARSON: So, Larson may be a stretch, and definitely not a favorite. But it’s hard to count him out considering the way he’s running.

Larson has hit a groove this year, especially since winning his Chase-clinching race at Michigan last month. The third-year driver followed it with a third-place finish at Darlington, then hustled from 12th to second on a two-lap overtime sprint Saturday night at Richmond.

It’s Larson’s first appearance in the Chase, but he raced like a participant during his 2014 rookie year.

He wasn’t eligible that season, but reeled off five consecutive top-six finishes in the first half of the Chase.

He hasn’t hit career numbers this year in many categories, but his 241 laps led is his best to date.

Larson’s biggest fight will be advancing through the first three rounds, but should he somehow make it to the final four, he considers Homestead one of his favorite race tracks. He has not finished lower than 15th there, and was a career-best fifth last season.

Dear Reader: Most men don’t like to ask for help or to talk about their feelings. That’s not going to be easy for your husband. However, doing nothing could make it harder for him. If he is suffering from depression and doesn’t get help, it could threaten everything important in his life, starting with family, friends and work.

Left unchecked, the symptoms of depression can make a person miserable.

The sadness, lack of energy, loss of interest in sex, difficulty thinking and constant feeling of stress can cause serious problems at home and at work. They even might lead to destructive behavior such as alcohol or drug dependence.

Your husband likely recognizes these negative feelings and changes. But he might not know the root cause, or if he does, what he can do about it. You gently need to help him recognize he is unhappy, and it is causing tensions at home and at work (assuming that’s true). And you need to assure him help is available, and what that involves.

You might explain to him, generally speaking, a therapist will help establish treatment goals and then outline a strategy to meet them. This may include a combination of therapy during regular sessions and “homework” in between

it possible people can just fall out of love with each other? We have been married for 21 years and have three kids who are older.

Over the past five years, my wife and I have stopped communicating. We don’t do anything together and have little desire to be with each other anymore. We are good parents, but as far as being husband and wife, we pretty much have neglected each other emotionally and physically. Neither of us has strayed.

Last Saturday, I gave a deal in which third hand had to play deceptively to mislead declarer about honor-card locations. Here is the theme again, from the World Youth Teams Championships in Italy last month.

South’s three-spade cue-bid asked partner to bid three no-trump with a spade stopper. North’s double was card-showing.

At every other table where diamonds were trumps, East either played the spade ace and king at the first two tricks, or won with the spade king and shifted to a club.

Each declarer realized that if East had the spade ace and king, he or she could not also have the diamond king. So they all cashed the diamond ace and dropped West’s king.

Only Kirstyn Fuller from Australia anticipated this future. To change it, she won trick one with the spade ace and immediately switched to the club nine. Now the declarer thought that Jessica Brake (West) had the spade king. This made it likely that East had the diamond king, and as long as West was not void in trumps, the diamond seven would be a second dummy entry.

South won with her club ace, cashed the heart ace, played a heart to dummy’s king, and returned a low diamond to her queen.

If that had held the trick and both opponents had followed suit, declarer would have cashed the diamond ace, led a diamond to dummy’s seven, and hoped to discard her remaining clubs on the hearts.
