Advantages to Utilizing a A critical piece in one’s estate Revocable Trust plan is the disposition of assets upon death. This can be done in Your Estate Plan through a last will and testament or a revocable trust, which is referred to as a “will substitute.”

When a revocable trust is utilized, it is the governing instrument as to where assets go, and it does have some advantages over a will.

A revocable trust provides more privacy than a will. When someone dies, his or her will is lodged with the court and becomes public record. A trust does not become public record, and there is no need to show any public parties or entities the dispositive provisions of the trust. This protects the privacy of the creator of the trust and the beneficiaries.

Furthermore, a trust is a good vehicle to manage assets in the event of incapacity. While a will does not come into effect until death, a trust is in force as soon as it is signed.

If the trust is properly funded, meaning that the person’s assets are transferred into the name of the trust, then the successor trustee can easily step in if the creator of the trust (also known as the “settlor” or “grantor”) becomes incapacitated and can manage the trust assets and make distributions for the benefit of the settlor. It is also typically easier, faster, and cheaper for the successor

trustee to administer the trust upon the death of the settlor, rather than going through the probate process to administer an estate.

It is especially beneficial to use a revocable trust when you have outof-state property. This is because, typically, one must go through the court process of probate to administer your estate in any state where you own real property in your name individually.

Therefore, if you have real property in two states other than Colorado, your loved ones could be forced to open probate in three states, resulting in greater costs and a much longer process. If the real properties are transferred to a revocable trust, then this is avoided.

While there are advantages to using a revocable trust, it may not be the best estate planning tool for everyone. Simply ask the below questions to any agency, then record and compare your answers!

Does your agency have a drug testing policy?

Most agencies: don’t have a drug testing policy because it’s currently not mandatory from the state health department (Colorado), plus it increases costs. These types of agencies could be considered dangerous by allowing themselves to be open for possible issues, law suites, etc. Also, you may find some agencies that do one 5-panel drug test upon hire… and to be frank, that’s not enough! Instead: try and find an agency that conducts a 14-panel drug test that includes some major pain medications on the panel. Also, ask if they do it upon hire, annually & at random. This will ensure you have a ‘clean’ Caregiver within your home as long as they are providing care.

What kind of background checks does your agency provide? This can be tricky, because not all background check companies are created equal! If the agency: simply conducts a BG check online with any company, you may not be getting the full report. Why you ask? because depending on where the data was pulled, it may be stagnant and outdated, thus your critical results may

be tainted. Instead: try and find an agency that conducts at least a 150 point checks that include DMV reports (including DWI and DUI), Social Security trace, county and state-wide searches for felonies and misdemeanors but most importantly… freshly updated data! Also, try and use an agency that does the BG check upon hire, annually and at random. This will ensure you have solid, historically clean Caregivers within your presence… for the entire time they work in your home.

The first visit, do the Caregivers just show up? Most agencies: will do this; they will assign a Caregiver without an introduction. This can be awkward and unnatural because both parties are unfamiliar with each other, their role, duties, etc.

Instead: try and find an agency that has an Area Manager that will set up a meeting between the Client and Caregiver for a warm introduction.

Non Medical Home Care Definitions 24 HOUR ON CALL – Refers to ‘around the clock treatment’ in a home environment. The care may be shared by multiple caregivers or by a single caregiver.

ALZHEIMER’S/DEMENTIA CARE – Non-skilled care provided for clients with memory issues includes but not limited to establishing a routine, reminders for activities for daily living, rerouting if necessary and assistance with sleep issues or ‘sun downing’. By using creativity and caregiving skills, you can adapt routines and activities as needs change.

BONDED – Being bonded means that a bonding company has secured money that is available to the consumer in the event they file a claim against the company.

HOMEMAKER/COMPANION – Non-medical assistance with meal preparation, laundry, light housekeeping, errands, activities, outings, companion-ship and other household duties. These agencies are licensed by the state.

HOURLY MINIMUM – This refers to the minimum number of hours that an agency provides service.

INSURED – This refers to what happens if someone gets hurt on the job.

If the company isn’t insured, then the

claim gets filed against the homeowner’s insurance. If the company is insured, then the claim gets filed against the company’s insurance.

LICENSURE – A home care agency, whether medical or non-medical, shall be issued a license consistent with the type and extent of services provided.

CLASS A – A home care agency that provides any skilled healthcare service. Agencies with a Class A license may also provide personal care services.

CLASS B – A home care agency that provides only personal care services. An agency with a Class B license shall not provide any skilled healthcare service.

STATE REGISTRATION – The State of Colorado does not license homecare placement agencies. Placement agencies are registered with the state. Registration ensures that placement agencies are adhering to certain minimum standards such as background checks for caregivers and insurance requirements for agencies and caregivers.

NON-MEDICAL HOME CARE – Assistance with Activities of Daily Living (ADL’s), homemaking, companionship and other non-medical in home care. TRACH CARE – Refers to care administered to patients who have undergone a tracheotomy. A tracheotomy is a surgical procedure in which a cut or opening is made in the windpipe (trachea). The surgeon inserts a tube into the opening to bypass an obstruction, allowing air to get to the lungs, or remove secretions.

WOUND CARE – Refers to services for providing diagnosis and treatment for ulcers, pressure sores and other wounds. Treatments may include but is not limited to irrigations, dressing, and wound vacs. Some agencies may employ specialty nurses to provide and instruct in care specifically for patients with more complicated wounds. ~

These memory lapses have little impact on your daily performance and often require no assistance.

So when should I ask for help?

If you are having difficulties performing simple tasks such as: paying bills, forgetting how to do things you have done many times, getting lost or disoriented (even in familiar places) having trouble following simple directions, or making simple decisions – you need help.

There are many reasons older adults have memory issues. Some are reversible and some are not.

Hormones and proteins that protect and repair brain cells and stimulate neural growth also decline with age. Older people can experience decreased blood flow to the brain, which could impair memory and lead to changes in cognitive skills.

Reversible causes can include: stress, depression, vitamin deficiencies, side effects of medications, Thyroid problems, dehydration, poor diet, insufficient sleep, lack of phys-

ical activities and being alone most of the time as well as smoking and alcohol abuse.

If your memory loss is persistent, disabling, disrupts your work, hobbies, social activities, and family relationships - you should ask for help. Schedule an appointment immediately with your primary physician for examination. Your doctor can evaluate your symptoms, eliminate reversible causes of memory loss, lessen decline in vascular dementia or improve quality of life in Alzheimer or other types of dementia.

Aging well depends on various factors, such as genes, environment, and lifestyle. Healthy lifestyle choices may help you maintain a healthy body and brain.

Keep your memory sharp by doing mentally stimulating activities.

Playing games, learning new things, and attending social activities may help. CC-CONTINUOUS CARE – Provided to prevent the individual from going to the hospital when a crisis occurs.

It also is given when more help is needed to assist the individual and family in coping with the crisis. This level of care is usually provided at the individual’s residence no matter where that may be. The criteria for continuous care may include: Severe pain or symptoms which are out of control, psychotic episodes, breakdown of caregiver, imminent death and family unable to cope.

Continuous care is typically reserved for end of life or other crises that requires a constant presence by a nurse or care team.

24/7 ADMISSIONS – If a patient qualifies for hospice care, they should be admitted as early as the family requests. Many agencies admit patients to hospice,24/7, evenings weekends, and holidays.

AROMATHERAPY – Uses plant materials and aromatic plant oils, including essential oils, and other aromatic compounds for the purpose of altering one’s mood, cognitive, psychological or physical well-being.

This is not reimbursed by Medicare.

GRIEF SUPPORT GROUPS – Grief is the normal and universal reaction humans have to the loss of those they love. When your loved one passes, you may go through a period of bereavement and experience grief. Many provide Grief Groups that meet and address issues of grief in a supportive group setting.

INDIGENT PATIENTS – Does the hospice accept non funded or indigent patients? This is usually on a case by case basis and at the determination of the hospice company.

Many have a non-profit organization that can help support the care of non-covered patients.

IN-PATIENT CARE – These hospices offer full hospice services in their on-campus unit or building.

The patient moves into the inpatient care facility to receive their hospice services rather than in the patients’ home setting.

LICENSED MASSAGE THERAPY – Used as a method for relaxation to alleviate stress, anxiety and pain with a light hands-on approach, as well as providing an alternative to those who can’t take medication or prefer not to, massage therapy has become essential in hospice care.

This is not reimbursed by Medicare.

MUSIC THERAPY – Music Therapy is an established healthcare profession that uses music to address

PAIN PUMPS AVAILABLE – Many patients have their symptoms controlled through oral medications. Some situations require a pain pump where medications are administered through an IV pump.

If this is the situation, inquire with the hospice RN case manager to see if pain pumps are available through their agency.

PALLIATIVE CARE – Specialized medical care for people with serious illness. It is focused on providing patients with relief from the symptoms, pain and stress of a serious illness – whatever the prognosis. It is appropriate at any age and at any stage in a serious illness and can be provided along with curative treatment.

PCP-OVERSIGHT – Can the hospice patient retain their own

primary care physician in addition to the hospice medical director? All hospice organizations require a medical director, a physician to oversee their care. Many times the hospice medical director will work in conjunction with the patient’s own physician. The patient, family and hospice team can determine which physicians will oversee the care and certify the hospice eligibility criteria.

The Connection Between Every individual grieves differently Nature and Grief following the loss of a loved one.

There is not one “right way” Management to navigate the overwhelming and complicated emotions that accompany bereavement.

When it comes to grieving children, the emotions they experience are even more difficult to work through because they lack the maturity to fully express their feelings.

One outlet that has been known to offer unique support throughout the grieving process is interaction with nature.

There are numerous aspects that make nature, specifically gardens, an ideal environment for navigating grief, such as its cyclical traits.

When spending time in gardens, children can experience the sea84 NORTHERN COLORADO - OCTOBER 2017-2018

sons and life-death cycle. They can witness growth, life and comfort but also come to understand dormancy, death and some of the less pleasant changes that occur in nature.

All of these features create a special and meaningful foundation for children to navigate the grieving process. Gardens offer positive, peaceful emotional outlets, opportunities for memory reinforcement, social interaction and stress reduction. Through learning the characteristics of nature, children can build self-efficacy, improve creativity and engage in reflection.

Horticulture therapy allows for interactive healing opportunities that are not easily experienced through other means. This unique type of therapy uses plants as tools to help individuals through the restoration process. By participating in garden-based activities – such as planting and caring for plants – children can release stress through positive

In order to bring this remarkable form of healing to the thousands of grieving children in northern Colorado, Pathways has embarked on a new initiative to build the Children’s Healing Garden on the east side of its Fort Collins location. This Garden will include several unique features, such as an oversized “bird’s nest” with an “eggs” seating area, vine tunnels, memory gardens, mandalas and more.

The Garden will be a public facility for use by everyone in the community, young and old. What the therapy gardens bring to the grieving process is helpful for both children and older adults. The Garden will

Facilities may use a nurse as a their consultant and the residents receive periodic assessments from a licensed practitioner.

LONG-TERM CARE – Chronic, custodial care provided on an on-going basis MEDICAID WAIVER – An assisted living waiver may be used to transition individuals out of nursing facilities or to provide persons at risk of institutionalization with options for remaining in their communities.

Assisted living waivers are designed to provide an alternative to more costly nursing home care.

What Are Home Care Services?

Home care involves a collection of health care services that don’t require the patient to go to a health care provider.

Instead, a nurse or other health care professional comes to the patient’s home.

Medical procedures like vaccinations, wound care, physical therapy, occupational therapy, mental counseling, and more make up home health care.

Governmental organizations like Medicare, nongovernmental organizations, and private agencies are all entities that provide home health care. It’s often more convenient than receiving care from a traditional facility and just as effective.

Who Are Home Care Services for?

patients who may have medical concerns but are still able to live in their own home n Individuals

Home care services certainly aren’t limited to patients meeting these criteria. PRICE DEPENDENT ON LEVELS OF CARE – Flexible levels of service geared to accommodate different needs over time. Rates may vary depending on the changing levels of care while one maintains the same physical residence.

PUBLIC HOUSING (PH) – Affordable apartments for low-income families, the elderly and persons with disabilities.

REHABILITATION AND THERAPY – Many skilled nursing facilities offer restorative and rehabilitative physical and occupational therapy, and speech-language pathology services. Short-term rehabilitation services may be provided to individuals with diagnoses such as joint replacements, stroke, etc. Long-term rehab may also be provided for permanent residents of the facility who have chronic or progressive illnesses. Occupational therapy services in this setting are generally reimbursed by Medicare Part A for short-term, acute care clients; Medicare Part B for long-term residents who require skilled services and have medically necessary need for rehab; and often by private insurance, Medicaid, or private pay for younger clients.

RESIDENTIAL HOME – Assisted living homes are private residential homes that typically have a small number of residents who

live together and receive care from live-in caretakers. Adult family homes offer room and board for seniors who want a more private, home-like community. Assistance with activities of daily living such as bathing and dressing are provided.

Amenities and nursing services vary greatly between homes. Ask about their services when you tour. They are also referred to as personal board and care homes. Most accept private pay; Medicaid in some instances.

RESPITE CARE / SHORT-TERM STAY – Otherwise known as a short-term stay. RETIREMENT COMMUNITY – Housing designed specifically for mature adults. Typically Studio, 1 BR or 2 BR rental apartments with full kitchens, and private baths are available. over the years however, we could not find photos of seniors who were old enough to represent our population. It seemed as if the oldest person in the photo was 15-20 years too young -more representative of the children. My goodness – we call ourselves advocates for the elderly and then our pictorial representations were inaccurate.

We hired our own photographer.

We were lucky to find a photographer who had a family member in long term care. Her grandmother had lived in one of our independent living and then assisted living, and passed away in one of our nursing homes. She also has a personal mission to take pictures of those she feels are “under represented” in photographs. Presto magic!

Our photographer has been capturing the essence of day-to-day events and the “life of the facility”.

She has a big task, as we have 12 facilities. I enjoy listening to her stories of participating with residents at the Rockies Game, in an art project, or having deep discussions of current events. All are captured on her digital camera for our use.

Our first “coming out photo” has been used in digital and print ads, on a billboard, and even on our wa-

ter bottles. Our featured resident is thrilled, as is her family! The other residents in her facility and the staff all think they are special. What a wonderful effect of our program we had not really anticipated.

We sent an ad with her photo for a publication. The publication’s design team asked if they could use the photo from last year – an IStock photo of a family. When I asked them why, they stated our photo for this year “was of her whole face and it showed every wrinkle and imperfection”. My response – “Yep. That’s the point”.

It takes many years to develop the wrinkles and imperfections of wisdom and experience. We love our new photos and celebrate with our residents their long lives and beautiful faces! ~

is gaining interest in the senior care industry. This innovative approach is relatively new but there is evidence that it can reduce anxiety and the use of chemical restraints for people with dementia by engaging them in both purposeful and meaningful activities.

The Montessori Method of education was developed in the early 20th century, by Maria Montessori.

Through her work with underprivileged children she determined that focusing on the individual’s strengths and providing a hands on sensory stimulating environment were both essential elements in the successful learning process. More recently these concepts have been used successfully when caring for persons with dementia and are referred to as the Montessori Inspired Lifestyle® approach.

Montessori based programming utilizes activities as a means to reconnect to persons with dementia who may seem unreachable. This is done by creating experiences where these individuals are able to use their hands and their five senses to engage and stimulate their minds.

When an individual with dementia is able to actively participate in

Montessori Inspired Lifestyle® The Montessori Inspired Lifestyle® Approach for approach to caring for those with Dementia Care dementia is a new concept that

experiences and enjoy their successes, their self-esteem increases and they enjoy a sense of accomplishment. The Montessori Inspired Lifestyle® approach focuses on a person’s strengths, on what they CAN do rather than what they can’t.

It allows patients to reconnect with a world they’re losing access to and is a source of comfort to them and their loved ones.

The key to successful Montessori programming requires that we change our expectations of what individuals with dementia are capable of. To assume that they can no longer be active participants in their own lives, have new experiences, and connect with others is to further debilitate them. The goal is to engage each person in purpose driven activity that is meaningful to them.
