Medicaid Planning - How to Pay for With the monthly cost of care in a the Nursing Home nursing home averaging $8,500 in Without Going Broke the Denver and Boulder metropolitan area, one of the greatest challenges faced by elders and their families is how to pay for such care. For many, the Medicaid Program is there to help. To qualify for Medicaid for longterm care, the Medicaid applicant: (1) must need a nursing home or assisted living level of care; (2) have gross monthly income of less than $8,039 (the income of the well spouse is not included in this calculation); and, (3) not have more than $2,000 in “countable assets.” “Countable assets” do not include: a home, an automobile, prepaid burial/funeral plans, small life insurance policies, medical equipment, and most personal property. For married couples, there are some very important protections. First, the well spouse is entitled to keep $1,991 of the couples’ income (increased to a maximum of $2,981 if the well spouse has certain additional qualified expenses). Then, in addition to the home, car, personal property and other exempt assets, the well spouse is also permitted to retain roughly $119,000 in countable assets. If a Medicaid applicant has countable assets in excess of the permissible amount ($2,000 if single; $119,000 if married), there are

Medicaid planning strategies which can be used to protect your estate. One set of strategies involves converting excess countable assets into exempt assets. For instance, the well spouse might use some of the assets in excess of $119,000 to make improvements to the home, purchase a newer automobile, prepay burial/funeral plans for both spouses, etc. The other set of Medicaid planning strategies involves giving away assets. This only works if it’s done just right. There are penalties for giving away assets to create Medicaid eligibility. If done properly, however, a significant portion of a person’s assets can often be preserved. Because Medicaid is a very complex and rapidly changing area of law, and this is only a brief summary, individuals considering Medicaid should seek the assistance of a knowledgeable Elder Law attorney prior to acting on any such information. Long Term Acute Hospitals Long term acute care hospitals (LTACH’s) (LTACH’S) provide specialized medical, nursing, and rehabilitation services for patients who need more advanced care for their recovery process, but who no longer require services in a traditional acute care hospital.
Patients typically have a chronic or medically complex medical condition that requires hospitalization for an average of 25 days or more in a facility that offers a 24/7 specialized treatment program. Original Medicare is a government health insurance program primarily for people age 65 and older. It has four main parts: A, B, C & D. The chart below is an example of how Parts A & B work together with a traditional Medicare supplement also known as a "Medigap Plan." Medicare Part A HOSPITAL INSURANCE

Starting an Exercise Program: We recognize and have heard time What Do and again that the key to staying healthy is proper diet and exercise. Seniors Need? But “exercise” can be quite vague to those who encounter age-related physical obstacles or have never been part of a fitness regimen.
Few activities are more important to senior health than those which help improve balance, flexibility, strength and endurance. Simple practices around the house can help improve balance or strength without disrupting daily routine. Standing up from a chair or walking up stairs can improve a sense of balance and build muscle strength when practiced and repeated. Even bending over to pick something up can be beneficial. In addition to building strength and balance, endurance exercises are important to maintaining heart health and metabolism. This can mean anything from raking leaves to going for a bike ride –it’s simply important to increase the heart rate. And for individuals with joint problems, swimming allows seniors to access all of the challenges and benefits of exercise while easing strain on problematic areas. It’s also good to remember that keeping the mind active and atten-
40 BOULDER COUNTY - OCTOBER 2015-2016
tive is just as important as physical health, often driving the body’s overall health. Some of the best exercises for both body and mind are derived from Eastern cultures. Tai chi is an excellent practice for older adults. Yoga has many different forms, but all include a two-fold approach: holding and maintaining a series of postures while focusing on breathing. Before attending just any yoga class, make sure it is specifically tailored for older adults to ensure comfort and safety. I can say over and over how important it is to our physical wellness to practice balance, strength, endurance and stretching, but perhaps the ultimate benefit of exercise programs is an increase in self confidence. REHABILITATION HOSPITALS Rehabilitation Hospitals, sometimes referred to as Inpatient Rehabilitation Hospitals, provide intensive rehab to patients who are generally medically stable but need help to recover from injury or other medical conditions. They can be found within a hospital or in a free-standing building. Rehabilitation Hospitals must offer a minimum number of physician visits, increased daily rehab hours (3 hours/day, 5 days/week of PT, OT, and/or Speech), and
interdisciplinary services including increased RN oversight and nursing hours per day.

ehabilitation is a medical specialty that helps people recovering from disabling diseases or injuries such as strokes, brain, spinal cord, or orthopedic injuries. “Rehabilitation helps patients to improve their quality of life and reduce subsequent illnesses or problems,” says Dr. Revelyn Arrogante, Medical Director of Northern Colorado Rehabilitation Hospital. “The goal is to help a person reach the highest level of function possible – physically and cognitively. For some, this may mean learning to walk again or how to maneuver a wheelchair. For others, it may mean learning how to communicate with loved ones.” For Judy Hartman, a Scottsbluff resident, it meant getting her life back. Today, you can find Hartman gardening, camping, swimming, or even jet skiing. But two years ago, she thought none of this was possible. After a serious car accident, she was left in a wheelchair and could only walk about 5 feet with assistance. She was referred to Northern Colorado Rehabilitation Hospital. “Even though it was more than two hours away, I was so glad I could get treatment at a hospital that’s nationally known for its care,” Hartman says. “I would have traveled even further to reach them if I had to.” Patients like Hartman who receive rehabilitative services often experience positive results in regaining or improving productivity and independence. For example, a national study commissioned by the ARA Research Institute, shows that patients treated in inpatient rehabilitation facilities live longer, have less hospital and ER visits, and remain longer in their homes without additional outpatient services. With Hartman, after 10 days of individualized therapy – and much determination – she could walk on her own, perform daily activities and was able to go home. “While I don’t wish for anyone to need these services, the good news is that we have rehabilitative services available to us right here in Johnstown that are recognized among the top 10 percent nationally,” Arrogante says. Hartman agrees. “They are my Angel Army,” she says. “They provided me with optimal conditions to heal and find peace. because of juvenile eye disease, a working aged adult who struggles with Diabetic eye disease, or an older loved one who has Age-Related Macular Degeneration, the outcome is the same. Vision is lost and they have to learn to adapt.
According to the 2014 US Census, approximately 15% of Coloradoans are experiencing medical issues that leads to low vision, including diabetes. Low Vision is defined as the loss of vision that cannot be corrected through the use of prescription lenses and cannot be fixed through medical interventions. A person with low vision may find it difficult or impossible to accomplish activities such as reading, writing, shopping, watching television, driving a car or recognizing faces. This is where adaptation becomes a necessity. Because many people who are currently living with vision loss are over 60, (1 in 6 people over the age of 60) adaption maybe very difficult. The team at the Ensight Skills Center for visual rehabilitation urge Coloradoans to reach out to find services that will help walk them through the difficult transition. A skilled team of professionals, like the team at Ensight, can facilitate skills training, modifications
to activities, and introduce devices that can help to manage tasks. Non Medical Home Care Definitions 24 HOUR ON CALL – Refers to ‘around the clock treatment’ in a home environment. The care may be shared by multiple caregivers or by a single caregiver. ALZHEIMER’S/DEMENTIA CARE – Non-skilled care provided for clients with memory issues includes but not limited to establishing a routine, reminders for activities for daily living, redirecting if necessary and assistance with sleep issues or ‘sun downing’. By using creativity and caregiving skills, you can adapt routines and activities as needs change. BONDED – Being bonded means that a bonding company has secured money that is available to the consumer in the event they file a claim against the company. HOMEMAKER/COMPANION – Non-medical assistance with meal preparation, laundry, light housekeeping, errands, activities, outings, companion-ship and other household duties. These agencies are licensed by the state. HOURLY MINIMUM – This refers to the minimum number of hours that an agency provides service. INSURED – This refers to what happens if someone gets hurt on the job. If the company isn’t insured, then the claim gets filed against the homeowner’s insurance. If the company is insured, then the claim gets filed against the company’s insurance.

LICENSURE – A home care agency, whether medical or non-medical, shall be issued a license consistent with the type and extent of services provided. CLASS A – A home care agency that provides any skilled healthcare service. Agencies with a Class A license may also provide personal care services. CLASS B – A home care agency that provides only personal care services. An agency with a Class B license shall not provide any skilled healthcare service. STATE REGISTRATION – The State of Colorado does not license homecare placement agencies. Placement agencies are registered with the state. Registration ensures that placement agencies are adhering to certain minimum standards such as background checks for caregivers and insurance requirements for agencies and caregivers. MED-ALERT SYSTEMS – Personal medical alert products activated by pushing a button. MEDICATION REMINDER – Assistance with reminding an individual about medications but not dispensing medications. TRANSPORTATION – Rides to shopping, appointments and other outings. WORKER’S COMP – Insurance that covers medical and rehabilitation costs and lost wages for employees injured at work.

You should also expect a home care agency to match your loved ones’ needs and preferences to a caregiver who shares similar expertise and interests. If the match doesn’t lead to a comfortable connection, ask the agency to provide another caregiver. And don’t be afraid to ask about caregiver training and agency hiring
practices. The best agencies will adhere to rigorous requirements including criminal background checks, drug screenings, and a check of the driving records. Ongoing Updates and Communication While caregivers offer daily assistance, expect agency administrators to handle the business end of billings and scheduling. Some may even help families access their long-term care insurance to cover the costs of home care. This kind of administrative support allows the caregiver to do what she does best, care for your loved one and to document the daily routine so that family members and other care providers can stay up-todate on the older adults’ needs. When hiring home care look for the agency that not only delivers compassionate care to your loved one, but also provides peace of mind for the entire family.

The care may be shared by multiple caregivers or by a single caregiver. 24 HOUR ON CALL – Refers to someone being available 24 hours a day to speak with you. CARDIAC CARE – Refers to services including patient assessment, specific diet information, and management of the disease process, medication management and education. Cardiac care is a program designed to help a person with heart disease return to health. Cardiac care may consist of exercise, modifying risk factors to prevent further heart damage, or psychological rehabilitation. DIABETIC CARE – Refers to services including patient assessment specific diet information, management of the disease process, medication management and education on all the above. Services Provided: N-NURSE – Assesses patient’s physical needs, develops and coordinates the plan of care, ensures symptom control and management, provides patient/family teaching as needed SW-SOCIAL WORKER – Assesses patient and family emotional and social needs, develops a plan of care, provides counseling, referrals and support to meet identified needs CHAPLAIN – Assesses patient and family spiritual needs, develops a plan of care, provides counseling, assists with memorial preparations. HOME HEALTH AIDE – Provides direct personal care to patient, emotional support to patient and family, reports identified needs to RN. VOLUNTEER – Provides respite and needed non-medical services for patients and their families, offers support at time of death and during bereavement. Levels of Care: RO-ROUTINE CARE – Occurs when regularly scheduled visits are adequate in maintaining the individual’s symptom management. Care is provided at the individual’s private

GIP – General In-Patient Care – Provided in a skilled nursing facility when the symptoms cannot be managed elsewhere. The skilled nursing facility must have 24-hour R.N. coverage as deemed by Medicare guidelines. General in-patient care is usually short in duration. This level of care is usually due to symptoms which are out of control and more intensive nursing services are required. If an individual is at a care facility, room and board are covered by hospice during this period. CC-CONTINUOUS CARE – Provided to prevent the individual from going to the hospital when a crisis occurs. It also is given when more help is needed to assist the individual and family in coping with the crisis. This level of care is usually provided at the individual’s residence no matter where that may be. The criteria for continuous care may include: Severe pain or symptoms which are out of control, psychotic episodes, breakdown of caregiver, imminent death and family unable to cope. Continuous care is typically reserved for end of life or

Assisted Living is Assisted Living is big business. Big Business! Senior care communities are expanding rapidly in response to our aging population. Baby boomers, people born between 1945 and 1964 now represent 25% of the total population.
Seniors have more choices than ever for care options. One alternative that some families are unaware of is a group home. A group home is a single family home, licensed by the State of Colorado to offer assisted living services. This option is often not considered because these homes are tucked away in ordinary neighborhoods. You may have a group home in your neighborhood. Group homes offer the same services such as bathing, dressing, meals and laundry but for fewer residents. Most group homes have five to eight residents. A group home feels more like the home your mother lived in prior to needing assisted care. Research also shows that people with dementia respond better in a home environment. Residents do not sit alone all day in their apartment, they are helping fold laundry, setting the table or making the salad. These activities give the residents a sense of purpose and

belonging. Most experts agree that the single most important factor when considering options for a loved one is the care that is offered. The most important person is the caregiver that interacts every day with your loved one. When evaluating senior care, look past the fancy amenities and take a good look at the way the business is managed. Look at the care staff, look at the company training standards, and ask the staff if they are happy. The care staff sets the tone for residents. If the staff is cheerful and well trained the residents will receive excellent care. Four of the caregivers at MillBrook Homes have been nominated this year for The Pat and George Sugerman Award (an award offered by the Colorado Chapter of the Alzheimer’s Association to a professional caregiver that offers outstanding care). While no one plans or expects to fall ill or become injured requiring a hospitalization, even fewer people think that they will not be able to go directly home from the hospital. However, when you no longer need the amount of care provided in the hospital, but are not able to safely return home, your care team will recommend continuing your recovery in a skilled nursing facility. Skilled nursing facilities provide care and rehabilitation for people who are not yet able to care for themselves at home. The goal of your stay in a skilled nursing facility is to participate in physical, occupational, and speech therapy while being under the care of a medical team including nurses and doctors, in order to regain your mobility, strength and health to return home safely. Physical therapists (PT’s) will help you improve your strength, endurance, and balance to increase your ability to get in and out of bed and a chair, walk better, climb stairs, and help to reduce your risk of falls. Occupational therapists (OT’s) help you return to completing your activities of daily living, including dressing, bathing, meal preparation, leisure activities, and the use
of adaptive equipment and activity modifications. Speech and language therapists (SLP’s) evaluate for and treat problems with swallowing, speaking, thinking, and memory to work on the skills and cognition required to live independently. During your stay your medical care will be overseen by a physician and you will be under the daily care of a registered nurse (RN) who will assist in your medication administration, wound care, and daily assessment of medical conditions. Other members of your care team will include a case manager and social worker who will assist in your discharge planning and ensure you have the services and support you need for a safe and successful transition to home.

Rates are monthly, and are typically based on size/location of apartment. SECURED UNIT – Dedicated to Alzheimer’s/Dementia residents to prevent wandering outside the community without supervision. SKILLED CARE – 24 hour licensed nursing services, eight hours of which are RN covered. Patient may receive rehab services either inpatient or outpatient and may be fully dependent for ADL’s. Patients receive medications by an RN according to a licensed physicians orders. SKILLED NURSING FACILITY – Facilities provide 24/7 care for residents and offer full assistance with ADL’s. Daily rates typically include a furnished bedroom and a private or shared bath, meals, activities, transportation, phone service, cable television and all personal/nursing care. Payor sources usually accepted are Medicare,
Medicaid, VA, some insurance plans and private sources. TRACH CARE - Refers to care administered to patients who have undergone a tracheotomy. A tracheotomy is a surgical procedure in which a cut or opening is made in the windpipe (trachea). The surgeon inserts a tube into the opening to bypass an obstruction, allow air to get to the lungs, or remove secretions.

VENTILATOR - Moves breatheable air into and out of the lungs, to provide the mechanism of breathing for a patient who is physically unable to breathe, or is breathing insufficiently. WANDERGUARD - Offered at some facilities. A resident with memory loss or confusion wears a small discrete pendant. Each external door in the care home is fitted with a radio detector which detects when a pendant moves near an exit. The WanderGuard will sound an audible alarm, alerting the staff of a patient wandering.
