Life Care Planning – A Fresh Approach to As we age we navigate many changes Elder Law including social, work, physical, and financial to name a few.

We’ve become pretty good at addressing our physical, work and social opportunities. We might downsize to a smaller home as our children move out. We may plan for retirement by considering volunteer and travel opportunities. We also connect with a doctor to identify ways to stay healthy. As we are busy planning and enjoying the next phase of our lives, we sometimes forget about formally considering our legal and financial futures if faced with a life changing illness. We’ve paid into Medicare and saved into a 401K, but how do we protect ourselves and our assets in the event of an unforeseen medical crisis? One worthwhile solution is a Life Care Planning approach. Life Care Planning is a holistic, elder-centered approach to the practice of law that helps families respond to many of the challenges caused by chronic illness or disability.

There are several benefits to a Life Care Planning approach. First, Life

Care Planning is a prevention based model rather than a crisis-oriented one. In preparation for a possible debilitating health change, an individual can educate himself on available resources, evaluate current investment/insurance/burial policies, and budget accordingly, avoiding crisis driven decisions.

Second, good Life Care Planning relies on an inter-disciplinary team that evaluates current and future needs and locates and coordinates appropriate resources, helping to ensure quality care and services.

When an individual receives advice from several independent sources, communication and continuity suffer and important information can fall through the cracks. In contrast, Life Care Planning offers a “one stop shop” team of specialists, including a social worker, attorney and paralegal, that provide a more comprehensive, cohesive long term care plan.

Third, Life Care Planning assists with preserving family wealth. When a person requires professional inhome or residential care, families are often shocked at the cost. The Continued on page 26

Defining an emergency It starts with knowing what a health emergency is. Generally speaking, it’s a serious or life-threatening condition that requires immediate attention or advanced care such as heart attack, major broken bones and large wounds. What is PACE? Program of All-inclusive Care for the Elderly (PACE) are programs that provide comprehensive health services for individuals age 55 and over who are sufficiently frail to be categorized as “nursing home eligible” by their state’s Medicaid program.

Eligibility for PACE requires that individuals be 55 years old or older, certified by the state to need nursing home-level care, reside near a PACE program, and be able to live safely in the community.

Services include primary and specialty medical care, nursing, social services, therapies (occupational, physical, speech, recreation, etc.), pharmaceuticals, day health center services, home care, health-related transportation, minor modification to the home to accommodate disabilities, and anything else the program determines is medically necessary to maximize a member’s health.

How PACE works: PACE programs become the insurance and the health care provider and are directly responsible for providing all health services and manage all aspects of their participant’s healthcare. PACE is paid

through Medicaid and Medicare combined (dual eligible) or private pay on a monthly basis.

Most PACE patients have multiple diagnoses, with an average of over 7 diagnoses per member. Among the most common are cardiac problems, diabetes, hypertension, and vascular disease. PACE programs tend to provide high levels of preventive services, such as very frequent check-ups, exercise programs, dietary monitoring, programs to increase strength and balance, etc.

PACE programs organize their services in a “PACE Center”. These Centers have a Day Center, medical clinic, social services and rehabilitation services, along with administrative staff, all in one site. Members attend centers from rarely to 5 days a week, depending on their care plans. Care planning is done with the member, his or her care team, and appropriate family members; most members attend about 2 days per week.

Ask a Doctor: Talking Social isolation is a serious About Isolation problem with older adults that is expected to increase. and Loneliness There are many reasons we become isolated as we age, including loss of a loved one; health challenges like low vision, hearing impairment, limited mobility; and external barriers such as lack of transportation.

Dr. Elise Reinhard discusses why your Primary Care Provider (PCP) is a good person to tell about feelings of isolation and loneliness.

Why should I tell my PCP if I feel isolated?

Dr. Reinhard: Isolation is an issue affecting your emotional, mental and even physical health. Studies have shown that socially isolated older adults are at greater risk for depression, unrecognized memory problems, malnutrition, poor health, and medical emergencies.

Patients have told me they consider these feelings a normal part of aging that can’t be changed. The good news is that things can be done to help.

How can my PCP help?

Dr. Reinhard: Talking to anyone about these feelings is the first step in affecting change, but your doctor

may have some suggestions to improve emotional and physical issues contributing to your isolation.

A PCP is trained to support all aspects of your life: physical, mental, and emotional. You don’t need to have a physical symptom to bring up feelings of isolation or loneliness with your doctor.

How can I talk to my doctor about isolation and loneliness?

Dr. Reinhard: Many people have difficulty talking about their feelings. Letting your doctor know that this is an issue you are dealing with ahead of time is a great way to start the conversation. I suggest sending your doctor an email or letter before your appointment. If you have feelings of hopelessness, sadness, anxiety, or loneliness talk to your doctor to see how they can help. ~ Editor’s Note: This article was submitted by Elise Reinhard, MD. A Season for Full Community It was once said that, “Aging is Participation not ‘lost youth,’ but a new stage of opportunity and strength.”

The wisdom of this statement is demonstrated well by those seniors who, upon entering this new life stage, actively contribute to their community. Unfortunately, people of all ages often view seniors primarily as passive recipients of community services rather than full participants who also give back. While seniors may in fact need specific services and support, the act of also contributing to their community leads to the greater good of all.

What do these new opportunities and strengths look like for individuals entering the senior stage of life?

They can manifest in a number of ways, including a greater self-awareness of one’s individual skills and talents, an increased amount of available time, and wisdom born from diverse life experiences. And while it is true that physical, social, economic, and other challenges may come with aging, it is nonetheless vital for a community’s health that seniors seek to contribute in meaningful ways.

Don’t be too quick, however, to look beyond what’s already right in front of you. Invite the neighbor who may not have family living nearby over for dessert. How to Keep Your Spine Healthy It is not uncommon to experience increased aches, pains and joint stiffness as we age. When it comes to the spine, some decline in function and flexibility may be expected.

Here’s what you should know about what happens to your spine as you age, and ways to help prevent back pain and injuries.

Common spinal conditions in older adults may manifest themselves in symptoms such as early morning back pain, leg pain when standing and walking, loss of height and more. n

S pinal arthritis develops as the cartilage separating the facet joints gradually breaks down over time.

Symptoms include low back pain and stiffness that seem worse in the morning and at the end of the day, including after an extended period of physical activity. Osteoarthritis may also cause radiating leg pain known as sciatica.

L umbar spinal stenosis is a narrowing of the spinal canal, resulting in low back and leg pain that characteristically occurs while standing or walking but dissipates once you sit down or lean forward. Pain may also occur with symptoms of sciatica including tingling and numbness in the buttocks and legs.

These changes cause spaces in the spine to narrow and press against the spinal nerves. Many people with spinal stenosis also have spondylolisthesis, where one spine bone “slips” forward over the one below. Nerve pressure from these conditions can result in leg pain, tingling, or numbness that gets worse when walking or standing, and improves when sitting or bending forward.

While not all back pain can be avoided, it is never too late to start protecting yourself against preventable spine problems. This starts with exercising regularly to keep off excess weight and strengthen the core muscles in your back and abdomen. n

24 HOUR ON CALL – Refers to ‘around the clock treatment’ in a home environment. The care may be shared by multiple caregivers or by a single caregiver.

ALZHEIMER’S/DEMENTIA CARE – Non-skilled care provided for clients with memory issues includes but not limited to establishing a routine, reminders for activities for daily living, rerouting if necessary and assistance with sleep issues or ‘sun downing’. By using creativity and caregiving skills, you can adapt routines and activities as needs change.

BONDED – Being bonded means that a bonding company has secured money that is available to the consumer in the event they file a claim against the company.

HOMEMAKER/COMPANION – Non-medical assistance with meal preparation, laundry, light housekeeping, errands, activities, outings, companion-ship and other household duties. These agencies are licensed by the state.

HOURLY MINIMUM – This refers to the minimum number of hours that an agency provides service.

INSURED – This refers to what happens if someone gets hurt on the job.

If the company isn’t insured, then the claim gets filed against the homeowner’s insurance. If the company is insured, then the claim gets filed against the company’s insurance.

LICENSURE – A home care agency, whether medical or non-medical, shall be issued a license consistent with the type and extent of services provided.

CLASS A – A home care agency that provides any skilled healthcare service. Agencies with a Class A license may also provide personal care services.

CLASS B – A home care agency that provides only personal care services. An agency with a Class B license shall not provide any skilled healthcare service.

STATE REGISTRATION – The State of Colorado does not license homecare placement agencies. Placement agencies are registered with the state. Registration ensures that placement agencies are adhering to certain minimum standards such as background checks for caregivers and insurance requirements for agencies and caregivers.

CARDIAC CARE – Refers to services including patient assessment, specific diet information, and management of the disease process, medication management and education. Cardiac care is a program designed to help a person with heart disease return to health.

Cardiac care may consist of exercise, modifying risk factors to prevent further heart damage, or psychological rehabilitation.

DIABETIC CARE – Refers to services including patient assessment specific diet information, management of the disease process, medication management and education on all the above. Services are provided by Registered Nurse under the supervision of a M.D. Some agencies may have certified diabetic nurse instructors or cardiac care specialty RN’s.

ENTERAL FEEDING – Enteral feeding, or tube feeding, is a way to deliver nutrients through a tube if you cannot take food or drink through your mouth.

INTRAVENOUS THERAPY (IV) – Refers to any medical treatments/ medications that need to be introduced into the body via a patient’s veins. Numerous IV Therapies can be provided in a patient’s home under supervision of a MD. Some of these include: inter-infective/ antibiotic therapies, hydration therapy, pain management, chemotherapy and central line care and maintenance.

Helping Individuals With Parkinson’s The challenges faced by individuals Disease with Parkinson’s disease (PD), even within their own homes, can be many and varied. PD is a disease that develops and worsens slowly over time.

Symptoms range widely from motor symptoms (like tremors, coordination, balance, walking deficits, lack of facial expression, decreased vocal volume and inflection) to non-motor symptoms (like depression, anxiety, constipation, lethargy). Symptoms can vary greatly from person to person, depending on how long they have had the disease, what sorts of treatments they employ, as well as other disease processes and other factors which may impact them. Treatments which can be used to successfully manage the symptoms and may assist with slowing the disease progression include medication management, evidence-based, PD-specific exercise programs and possibly surgery.

Skilled home care agencies working with these individuals are in the unique position of seeing exactly what challenges patients with PD and their care partners face in their homes. Symptoms can fluctuate, sometimes in an unpredictable manner. Skilled home health staff can help to improve safety and function within the home, as well as help with the transition back to the community.

Within the home, individuals with Parkinson’s disease may struggle with slow, small movements which can affect their ability to dress, bathe, move in bed and prepare food efficiently and safely. Deficits in walking caused by PD may make it difficult to negotiate changes in flooring, small spaces and doorways, and may also increase an individual’s risk for falls.

Individuals with PD and their care partners may require community resources and/or may need to find additional caregiver help in the home and information regarding finances and planning for the future. Lack of facial expression, deficits in speech and decreased breath support may impact communication and individuals may have cognitive deficits. Correct and timely medication regimens are also integral to safe and efficient management of symptoms.

Home health clinicians with specialized training coordinate closely with all team members to target the deficits associated with Parkinson’s disease. RNs, PTs, OTs, STs, MSWs and CNAs enable their patients with PD to meet their goals and maximize their potential. ~ Editor’s Note: This article was submitted by Susie Lefebvre, PT, of Boulder Community Home Care. PSYCHIATRIC CARE – Refers to the agencies’ ability to offer services related to psychiatric support with the prevention, diagnosis, and treatment of mental illness.

Services may include counseling or administering of medications.

SOCIAL WORKER – A clinical social worker whose purpose in health care is to enhance, promote, maintain, and restore the best possible social abilities of the patient or family.

Services provided may be preventive, developmental, or remedial in nature.

THERAPY SERVICES (ST, PT, OT, RT) – Speech Therapy – Refers to services to assess and treat speech and swallowing disorders. Speech therapy can treat speech, language, cognitive skills or swallowing.

Physical Therapy – Refers to services for the treatment and the rehabilitation process where a physical therapist will often stretch, strengthen, facilitate muscles, challenge balance, test coordination abilities, teach home exercise programs and enhance basic mobility skills.

Occupational Therapy – Refers to services to assess and treat patients to improve their ability to perform tasks in their daily living and working environments. Patients may have mental, physical, developmental, or emotional disabilities. Therapists also help them to develop,

It may include the therapeutic use of medical gases and their equipment, environmental control systems, humidification, aerosols, ventilator support, bronchi pulmonary drainage and exercise, respiratory rehabilitation, assistance with cardiopulmonary resuscitation, and maintenance of natural, artificial, and mechanical airways.

TRACH CARE – Refers to care administered to patients who have undergone a tracheotomy. A tracheotomy is a surgical procedure in which a cut or opening is made in the windpipe (trachea). The surgeon inserts a tube into the opening to bypass an obstruction, allowing air to get to the lungs, or remove secretions.

WOUND CARE – Refers to services for providing diagnosis and treatment for ulcers, pressure sores and other wounds. Treatments may include but is not limited to irrigations, dressing, and wound vacs. Some agencies may employ specialty nurses to provide and instruct in care specifically for patients with more complicated wounds. ~

Use it or lose it. Exercising your brain is key to maintaining its functioning. Do things that are new and challenging to best work your brain.

You can grow new brain cells.

This is scientifically proven for brains of all ages. Exercise, nutrition, and mental stimulation are the keys to growing new brain cells.

Your brain is constantly changing. The pathways in your brain are not fixed and static. Through a process known as “neuroplasticity,” our brains are constantly rewiring and changing. The more we are learning, the more this process occurs.

Brain exercise can lower the likelihood of dementia. Research has clearly demonstrated that increased cognitive activity levels are associated with significantly lower incidence of Alzheimer’s disease and dementia.

Social activities are important.

Participating in cognitively engaging activities with others have positive effects on brain health.

Some functional decline is normal. The speed and accuracy

of recall and some types of cognitive functioning do decline as the brain ages. By taking care of your brain in the ways listed above, however, you can have a significant positive impact on this process.

Functional improvements are possible. Under the right circumstances, the brain can recover many apparent age-related losses.

Purpose and meaning in life are beneficial to your brain. The more you engage in activities that have meaning, purpose and joy for you, the healthier your brain will be.

As the saying goes, “When you stop growing, you start dying.”

Lifelong Learning can keep you young! Henry Ford once said, “Anyone who stops learning is old, whether at twenty or eighty. Anyone who keeps learning stays young. The greatest thing in life is to keep your mind young.”

Memory Loss vs. Forgetfulness: How If your mom and dad are to Recognize the advancing in years, chances are you’ve noticed some Difference changes in their memory, like not remembering where they parked or forgetting to grab eggs at the grocery store.

But where’s the line between “this is a normal part of aging” and “dad may need help”? Here are some signs to look for when assessing whether or not your parent might be having a significant decline in their memory.

1) Repetitive short-term memory loss A lot of times, seniors with memory loss can recall the name of every friend they had 30 years ago, but they can’t remember what they ate for breakfast. Checking your parents’ short-term memory is easy: ask them questions about their day.

If they have a hard time with their responses, that might be a red flag.

2) Difficulty following storylines If your mom has a puzzled look on her face every time you explain why you had a rough day at work or try to catch her up on your favorite TV show, you might want to look into other symptoms of memory loss.

Why? Because memory loss impairs our abilities to recognize words, both visually and audibly. So, if your mom can’t follow your stories, it may be because she doesn’t recognize some of the words you’re using.

3) Failing sense of direction Did your dad always have an impeccable sense of direction that guided your family through every summer vacation, but now he needs to pull out a map?

Chances are, that’s a normal part of aging. But what if your dad gets lost on his way to the same grocery store he’s gone to for 15 years? Or takes the wrong turn on his routine morning walk around the block?

If your mom or dad has multiple episodes of being disoriented in familiar places, that may be a sign of more significant memory loss.

If you can’t see your mom every day, some things to look for when you visit are unkempt hair, uncommonly bad breath or stained clothes.

5) Losing things… a lot. Have you ever been in a panic over misplacing something important and thought to yourself “where is the last place I had it?” People with memory loss have a really hard time answering

that question, so a lot of their stuff, important, mundane, or anywhere in between, gets lost and stays lost.

Also, people with memory loss sometimes stash things away in “safe” places and forget where they are, compounding the lost-and-can’t-befound conundrum.

Rates usually quoted on a daily basis and are typically inclusive of all services and amenities.

RETIREMENT COMMUNITY – Housing designed specifically for mature adults. Typically Studio, 1 BR or 2 BR rental apartments with full kitchens, and private baths are available. Services include meal plans, transportation, housekeeping, laundry and maintenance. Amenities are usually abundant; formal libraries, computer stations, swimming pools, gardens, and other social gathering spaces. Rates are monthly, and are typically based on size/ location of apartment.

SECURED UNIT – A secured unit dedicated to Alzheimer’s/Dementia

residents to prevent wandering outside the community without supervision.

SHORT-TERM CARE – Acute care provided on a short term basis.

SKILLED CARE – 24 hour licensed nursing services, eight hours of which are RN covered. Patient may receive rehab services either inpatient or outpatient and may be fully dependent for ADL’s. Patients receive medications by an RN according to a licensed physicians orders.

Daily rates typically include a furnished bedroom and a private or shared bath, meals, activities, transportation, phone service, cable television and all personal/ nursing care. Payor sources usually accepted are Medicare, Medicaid, VA, some insurance plans and private sources.

TRACH CARE – Refers to care administered to patients who have undergone a tracheotomy. A tracheotomy is a surgical procedure in which a cut or opening is made in the windpipe (trachea). The surgeon inserts a tube into the opening to bypass an obstruction, allow air to get to the lungs, or remove secretions. ~
