Estate Planning: Not Just A well-executed estate plan is for Boomers! critical for everyone. A will or trust, and powers of attorney are the best way to ensure your wishes are honored after your death, and during any period of incapacity.

In past columns we have discussed the importance of estate planning for seniors. Here, we’ll look at these issues for the younger generation. Planning for these events seems natural as we age and families grow. It is especially important for younger adults and for unmarried couples to develop or update a plan that accurately reflects their wishes. People without a plan in place face the very-real possibilities of passing their assets to someone for whom they never intended to provide, leaving someone out altogether, or having someone they do not trust (or even know!) make decisions on their behalf. Once we turn 18, we have the right to make our own financial and medical decisions. While we might still rely on our parents’ advice and direction, the law does not give parents the power to make decisions for their adult child, even if the child is incapacitated. In a situation such as this, a parent would likely have to go to court to be appointed as their child’s guardian. Executing powers of attorney documents can prevent this. Powers of attorney designate

someone (an “agent”) to act on your behalf should you become unable to do so. Anyone 18 years of age or older can, and should execute medical and financial powers of attorney, to avoid unnecessary delay, expense, and to ensure the decisions made on their behalf come from a trusted person. Unmarried couples face similar risks. Without a document designating an agent, an unmarried partner is not treated the same as a spouse. In fact, the partner may be left out of any medical decision-making, entirely. Further, if an unmarried couple does not designate each other as beneficiaries of their assets, the property passes according to law at their death, rather than to each other. So, a loved one could be left out of their partner’s estate altogether. Therefore, planning for these events is crucial. Editor’s Note: This article was submitted by Richard E. Romeo. Navigating the World Navigating the world of Medicof Medicaid aid can be a daunting prospect. There are differing varieties of Medicaid with a variety of different names and an even wider variety of differing requirements.

One of the most useful of the Medicaid programs for those who are elderly or disabled is Long Term Care Medicaid. There are actually a variety of different programs that can be accessed if Long Term Care is being received. These can vary from Home and Community Based Services that provides services to allow someone to stay in their home to skilled care in nursing facilities. Medicaid and Long Term Care have different financial requirements. Under the most common form of Medicaid, your maximum income for an individual is $1,305 per month. Under Long Term Care, the maximum income is $2,199 per month. Generally, under Medicaid your assets will not be used to determine eligibility. Under Long Term Care, while a lived-in home and one car is exempt, there is otherwise an asset cap of $2,000 for a single person, $3,000 for a married couple with both asking for assistance, or $119,000 for a married couple where only one spouse is requesting assistance. In addition, to receive Long Term

Care services, the person requesting services will need to functionally qualify. This means that a case manager must assess them to determine whether or not they meet nursing facility level of care. Part of this process includes a request for information from the person requesting services’ doctor in order to assist in the process of determining whether or not the person qualifies. The purpose of Long Term Care is not to get Medicaid just for the health care coverage, although that is an added benefit, rather the purpose is to provide services that will allow an individual to stay safely in their homes as long possible. Examples of services that can be provided include fall buttons, electronic med minders, and caregivers to assist in the home with a variety of needed tasks. The best way to get further questions answered regarding these services is to contact your local ADRC for a discussion of your options. Managing Your With aging comes many Medications for changes that affect health and how health is managed. Better Health Seniors are more likely to have one or more chronic health issues such as diabetes or heart disease. With more illness comes the need for more medication. The average senior will take more than four medications daily either to treat or to prevent disease. The more medication one takes the more potential there is for the medications to interact with each other or to cause an adverse effect on the person taking them. Seniors are more likely to be hospitalized for adverse medication effects such as falls, fractured bones and confusion. Polypharmacy, too many pills, occurs when a senior is taking four or more medications. The best way to minimize polypharmacy is to regularly review medications with your primary care provider by bringing in all your medication bottles as well as any nonprescription medications you take to each regularly scheduled appointment. It is important to work with your primary care provider to reduce medications whenever possible. A senior should not stop taking a medication unless the decision is made in collaboration with their primary care provider.

The time of day a medication is taken can affect how well it will work. Some medications, like thyroid pills, need to be taken on an empty stomach while others, such as pain medications, should be taken with food. Some medications, like cholesterol lowering drugs, work best at night. A primary care provider or the pharmacist can help determine the best time for you to take a medication. Remembering when to take medications is best achieved when medications are taken no more than once or twice a day. Medications have a place in helping to keep a senior healthy and free from disability but they must be managed appropriately. To do this effectively, a partnership must exist between the senior and the primary care provider that takes the senior’s health goals into account. As you or your loved one begins to require increased attention to health issues, keeping an up-to-date medical journal can come in handy. Having quick access to this information is not only useful to you on a day-to-day basis, but to health care providers as well — especially in a time of emergency. Keeping the journal is something you and a love one can do together. In a notebook, create sections to include the following: Health Insurance Information In nearly every circumstance when medical care is received, patients must provide health insurance information. Having your loved one’s health plan name and policy number readily available can help facilitate quicker access to care. Doctor/Hospital Contact Information You never know when you’ll need to unexpectedly contact a doctor or emergency medical facility. On one page of the journal, write down the names and phone numbers of the doctors and specialists your loved one sees regularly. Prescription Medications Doctors should always be aware of any medications a patient is taking — to prevent “overprescribing” or harmful drug interactions. Your health journal should include a list of the medica-

tions your loved one is taking and the condition(s) they treat. Allergies There’s a reason why health care providers always ask if patients have any allergies: it can impact the course of treatment provided. Make a list of any allergies your loved one may have, along with the symptoms and current treatment (if applicable). Major Illnesses or Surgeries Devote a page of your journal to listing any major illnesses your loved one has had in the past. Examples include pneumonia, cancer and heart disease. Also make note of past operations, such as heart surgery, hysterectomy, gall bladder removal, appendectomy, etc.

Emergency Contact Information Finally, be sure to list the names and phone num¬bers of family members and/or friends who should be notified in the event of a medical emergency. ALZHEIMER’S/DEMENTIA CARE – Non-skilled care provided for clients with memory issues includes but not limited to establishing a routine, reminders for activities for daily living, rerouting if necessary and assistance with sleep issues or ‘sun downing’. By using creativity and caregiving skills, you can adapt routines and activities as needs change. BONDED – Being bonded means that a bonding company has secured money that is available to the consumer in the event they file a claim against the company. HOMEMAKER/COMPANION – Non-medical assistance with meal preparation, laundry, light housekeeping, errands, activities, outings, companion-ship and other household duties. These agencies are licensed by the state. HOURLY MINIMUM – This refers to the minimum number of hours that an agency provides service. INSURED – This refers to what happens if someone gets hurt on the job. If the company isn’t insured, then the claim gets filed against the homeowner’s insurance. If the company is insured, then the claim gets filed against the company’s insurance.

LICENSURE – A home care agency, whether medical or non-medical, shall be issued a license consistent with the type and extent of services provided. CLASS A – A home care agency that provides any skilled healthcare service. Agencies with a Class A license may also provide personal care services. CLASS B – A home care agency that provides only personal care services. An agency with a Class B license shall not provide any skilled healthcare service. STATE REGISTRATION – The State of Colorado does not license homecare placement agencies. Placement agencies are registered with the state. Registration ensures that placement agencies are adhering to certain minimum standards such as background checks for caregivers and insurance requirements for agencies and caregivers.

These services are available for hire after, or in conjunction with, Medicare certified services. Private payment, Medicaid and Veterans Benefits are a few of the ways personal care can be paid for. PSYCHIATRIC CARE – Refers to the agencies’ ability to offer services related to psychiatric support with the prevention, diagnosis, and treatment of mental illness. Services may include counseling or administering of medications.

SOCIAL WORKER – A clinical social worker whose purpose in health care is to enhance, promote, maintain, and restore the best possible social abilities of the patient or family. Services provided may be preventive, developmental, or remedial in nature. THERAPY SERVICES (ST, PT, OT, RT) – Speech Therapy – Refers to services to assess and treat speech and swallowing disorders. Speech therapy can treat speech, language, cognitive skills or swallowing. Physical Therapy – Refers to services for the treatment and the rehabilitation process where a physical therapist will often stretch, strengthen, facilitate muscles, challenge balance, test coordination abilities, teach home exercise programs and enhance basic mobility skills.

INTRAVENOUS THERAPY (IV) – Refers to any medical treatments/medications that need to be introduced into the body via a patient’s veins. Numerous IV Therapies can be provided in a patient’s home under supervision of a MD. Some of these include: inter-infective/ antibiotic therapies, hydration therapy, pain management, chemotherapy and central line care and maintenance.

Occupational Therapy – Refers to services to assess and treat patients to improve their ability to perform tasks in their daily living and working environments. Patients may have mental, physical, developmental, or emotional disabilities. Therapists also help them to develop, recover, or maintain daily living and work skills. Occupational therapists help clients not only to improve their basic motor functions and reasoning abilities, but also to compensate for permanent loss of function. RE-RESPITE CARE – Provided when the family needs time to rest or go out of town for a short time. Care may be provided in a long-term care facility depending on the condition of the individual. Hospice is responsible for financial arrangements with the Long-term care facility. GIP – General In-Patient Care – Provided in a skilled nursing facility when the symptoms cannot be managed elsewhere. The skilled nursing facility must have 24-hour R.N. coverage as deemed by Medicare guidelines. General in-patient care is usually short in duration. This level of care is usually due to symptoms which are out of control and more intensive nursing services are required. If an individual is at a care facility, room and board are covered by hospice during this period. CC-CONTINUOUS CARE – Provided to prevent the individual from going to the hospital when a crisis occurs. It also is given when more help is needed to assist the individual and family in coping with the crisis. This level of care is usually provided at the individual’s residence no matter where that may be. Call Me in the “You just don’t know,” he said, leanMorning ing back into the careworn recliner in his living room. “First, I was serving in the Air Force during the Vietnam War; then, I was a fireman; then, I got cancer. And now... now, I have a song. You just don’t know what this means to me.”

Music has transcendent qualities- it can affect us in ways we’re not even aware of. It can remind us of amazing times we’ve had. In Calvin’s case, it helped him leave a legacy. Calvin worked with a Music Therapist and several other team members from Seasons Hospice to turn one of his poems into a song entitled “Who Cares.” He not only wrote the words for his song, but with a Music Therapist facilitating the process, he was able to choose the style, structure, tracks, key, and instrumentation. He even played the shakers on the recording! Calvin’s song will live on with his family as a legacy project allowing them to stay connected to him for years to come. While his song is a wonderful token for them to keep, leaving a legacy wasn’t the only benefit. People may not think about it much, but music can have a profound physical effect on us, including easing pain. Listening to some of our favorite tunes can provide a welcome distraction from unpleasant symptoms. More often than not, the experience of pain is lessened or

goes away completely while enjoying music. Music affects bodily functions that we think are beyond our control, including heart rate, blood pressure, and the release of our body’s natural painkilling chemicals. Even when people are no longer conscious or speaking, we can console and comfort them through music. Living with cancer can be incredibly painful. While painkillers are often used to alleviate symptoms, music therapy can be used where medicine falls short. Seasons Hospice employs more board-certified Music Therapists than any other organization in the country, precisely because of the physical and emotional power of the music interventions they are able to provide. In the end, Calvin was able to fulfill a lifelong dream of writing and recording his own song. He found a new sense of pride, hope, and happiness in his legacy project, and the burden of his passing was lessened. His spirit will live on through his song and lyrics. Senior Housing Definitions continued from page 87 RESIDENTIAL HOME – Assisted living homes are private residential homes that typically have a small number of residents who live together and receive care from live-in caretakers. Adult family homes offer room and board for seniors who want a more private, home-like community. Assistance with activities of daily living such as bathing and dressing are provided. Amenities and nursing services vary greatly between homes. Ask about their services when you tour. They are also referred to as personal board and care homes. Most accept private pay; Medicaid in some instances.

SECURED UNIT – A secured unit dedicated to Alzheimer’s/Dementia residents to prevent wandering outside the community without supervision.

RESPITE CARE / SHORT-TERM STAY – Otherwise known as a short-term stay. Any provider of IL, AL, ALZ or SNF care can elect to provide fully furnished accommodations to a person for a short period of time. Rates usually quoted on a daily basis and are typically inclusive of all services and amenities.

SKILLED NURSING FACILITY – Facilities provide 24/7 care for residents and offer full assistance with ADL’s. Daily rates typically include a furnished bedroom and a private or shared bath, meals, activities, transportation, phone service, cable television and all personal/ nursing care. Payor sources usually accepted are Medicare, Medicaid, VA, some insurance plans and private sources

RETIREMENT COMMUNITY – Housing designed specifically for mature adults. Typically Studio, 1 BR or 2 BR rental apartments with full kitchens, and private baths are available. Services include meal plans, transportation, housekeeping, laundry and maintenance. Amenities are usually abundant; formal libraries, computer stations, swimming pools, gardens, and other social gathering spaces. Rates are monthly, and are typically based on size/ location of apartment.

SHORT-TERM CARE – Acute care provided on a short term basis. SKILLED CARE – 24 hour licensed nursing services, eight hours of which are RN covered. Patient may receive rehab services either inpatient or outpatient and may be fully dependent for ADL’s. Patients receive medications by an RN according to a licensed physicians orders.

Long-Term-Care Ombudsman Ombudsman: Swedish What’s That? word meaning “One who speaks on behalf of another”

Our Purpose: We are a free advocacy service mandated by the Older Americans Act to help all nursing home and assisted living residents maintain their quality of life by ensuring that their rights are protected. Who We Help: Residents, families, and friends of longterm-care residents are encouraged to contact the Ombudsman. We work with facility staff, hospice, adult protection, and others to get the resident what they need. What We Do: Within facilities, we help with things as simple as hot coffee or negotiating shower times. Feeling uncomfortable for any reason, your Ombudsman will listen and keep what you say confidential until you give us permission to act. We also investigate serious violations of resident’s rights. Substandard care, verbal or physical abuse, privacy, and the right to selfdetermination are examples. If you are considering longterm-care for a loved one, contact an Ombudsman. We can provide information and suggestions that

will make choosing a long-term-care option easier. We can also refer you to resources that might be able to help keep your loved one at home longer.

When To Call: If you need help understanding your rights, feel that your rights are being violated, think that your choices are not respected, or if you have questions about what long-term-care services are available, it is time to call your Ombudsman.
